Now my understanding anyone who violates the consumers privacy without notifying the consumer is called fraud, 15 U.S. Code 1681q - Obtaining information under false pretenses Any person who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses shall be fined under title 18, imprisoned for not more than 2 years, or both. I have addressed this issue to the CFPB, and the issue was transfer to the Federal Trade Commission which this notification was never given proper notification to the consumer I have rich out to the XXXXXXXX XXXX XXXX XXXX in regarding this issue which this issue has been ignored and mislead I have tried to contact the Federal Reserve Bank XXXX XXXX to address the issue I continuously has leave messages. I have reappealed My dispute until present day I have not received a noticed by mail from the Federal Reserve of XXXX. XXXX XXXX XXXX has violated my personal information by selling my information to a recovery agency by the name of monarch recovery. Follow with 15 U.S. Code 1666a - Regulation of credit reports is Reports by creditor on obligors failure to pay amount regarded as billing error After receiving a notice from an obligor as provided in section 1666 ( a ) of this title, a creditor or his agent may not directly or indirectly threaten to report to any person adversely on the obligors credit rating or credit standing because of the obligors failure to pay the amount indicated by the obligor under section 1666 ( a ) ( 2 ) of this title, and such amount may not be reported as delinquent to any third party until the creditor has met the requirements of section 1666 of this title and has allowed the obligor the same number of days ( not less than ten ) thereafter to make payment as is provided under the credit agreement with the obligor for the payment of undisputed amounts. I received phone calls from a company called Monarch Recovery quite a number of times. The company has never made any mention of any amount specifically, however, I continued to receive more phone calls from this company. It became so bad that the company not only used the phone number listed initially, but retained several other numbers in order to continue to harass me, threatening me with legal actions. The additional phone numbers that were associated with the company are : XXXX and XXXX. From the phone number XXXX are the dates and times recorded by my phone call log : XX/XX/2018 Beginning on XXXX XX/XX/2018 The company called me every single day during the dates listed above. The number of calls received in total is : 135 times ( average calls per day were 5ea ) I have made the following attempts to contact this company. I have made screen clips of every way that I have reached out to this company, via email phone conversation, in order to inform them to cease and desist from communications with me. First, I called the company to let them know to cease and desist contact with me. I am unsure as to the date. I did however, go onto Monarch Recovery website provided. I wanted to ensure that they understood the reason that I was reaching out to them. So in order to ensure that I was able to somehow get proof that I made contact with the company. So, I utilized the chat option so that the communication could be captured to have proof that I specifically made contact with a representative from the company. Finally, I sent an email to the email address specifically included within the many correspondence that I continued to receive via US postal. Additionally, I also have recordings of the conversations between myself and the representatives from this company. I have all the images saved and to uploaded to my phone in order to provide proof that this company harassed me continuously over almost a 5-6 month period, the few times that I did answer the phone calls, I was once cursed out by a representative, another time the conversation between myself and the representative became so aggressive and threatening, simply from because of a statement the representative made regarding about my XXXX XXXX health. I insistently told him that, due to intensity of our conversation continuing to become more aggressive, I needed to get off the phone call with him. His reply was, I completely understand what you are going through, but you need to resolve this issue and stop using time I spent in the military as a an excuse to not pay this debt that I owed. He went on say that my XXXX state could not in fact be that bad. As he continued, he became so violently aggressive that, I began scaring me to the point that I began to have severe XXXX and XXXX XXXX that I just hung up the phone on him. For over 2 weeks, I could barely function XXXX and XXXX. I became so XXXX that I did not get out of my bed for over 5 days.

On XX/XX/2020 I sent a certified letter to Monarch Recovery Management , Inc I sent a certified letter to Convergent for an alleged debt for a collection. I feel that these accounts are adversely affecting my credit report and costing me thousands of dollars in interest every year. I need this problem fixed asap. I demand these accounts be deleted immediately or I will file for litigation due to the stress you caused me. Section 611 ( a ) it is plainy stated that a failure to investigate these items within 30 days gives a reason to immediately remove those items from my credit report. They are in violation according to the FDCPA. The violations are 15 USC 1692 B 5 and 15 USC 1692 B 2. Also, the name on the account is inaccurate, unverifiable, and incorrect. # 1 who gave them my location information, # 2 where they present for this transaction that that they are referring to. # 3 I was not delinquent on anything, there is nothing that defines what delinquent is. There is no such thing as delinquencies. They didnt have permission to contact me Pursuant 1692 C, they didnt have my prior consent. Thats a violation. Where did you get my location information, which is my address? Who granted them permission to contact me? Threatening to report credit information that which isnt true, that another violation. They are violating my consumer rights ; I am a Federally Protected Consumer Under Title 15 Chapter 41. They are infringing up on my privacy and for an alleged debt for a collection. As of XX/XX/XXXX, I contacted Monarch Recovery XXXX XXXX to obtain a receipt for each payment I've made to them regarding my debt with XXXXXXXX XXXX. This account was settled with my final payment of [ {$180.00} ] being made on XX/XX/XXXX. The payments I made to Monarch Recovery XXXX XXXX, were done by phone and while they recently sent me an account settlement letter, indicating that my debt with XXXXXXXX XXXX is settled, when I asked the representative for receipts for the payments I've made to Monarch Recovery XXXX XXXX he told me that he could not do that. I explained that I didn't receive receipts for my payments to Monarch Recovery XXXX XXXX but only the few accounts letters he acknowledged that were sent, but which only indicated my account balance and my final payment to Monarch Recovery XXXX XXXX The most recent letter I received from Monarch Recovery XXXX XXXX, dated XX/XX/XXXX, also shows a Total Balance Due of [ {$94.00} ], despite the fact that my account was settled on XX/XX/XXXX, and while it was explained to me that amount reflected a remaining so-called " savings balance '' after agreeing to their settlement offer, the way it appears in this statement from them, could easily be misconstrued as indicating that I still owe an outstanding balance. In light of this fact as well as the fact that I've never received receipts from Monarch Recovery XXXX XXXX, I implored the representative from Monarch Recovery XXXX XXXX that I'm entitled to a receipt of payment for each transaction I made to them and that, specifically, this is what I was requesting, to which he continued to assert that Monarch Recovery XXXX XXXX had issued, when in fact, I have NOT received any receipt for any of the payments I've made to Monarch Recovery XXXX XXXX. I know, by law, I am entitled to a receipt for any transaction I make, and before my XXXXXXXX XXXX debt was sold to Monarch Recovery XXXX XXXX, it was being managed by the XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, of whom always provided a receipt of payment to me, along with a confirmation number, for every payment I made to them as collection on the debt I originally owed to XXXXXXXX XXXX. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. I, XXXX XXXX demand a complete purge of my personal information from an original creditor, a debt buyer and a debt collection agency. In fiscal year XXXX I filed for personal bankruptcy under case number XXXX, XXXX XXXX of Pennsylvania, United States Bankruptcy Court. At no time was a debt ( s ) from XXXX needed as my debts with XXXX were charged off in fiscal year XXXX, and the statute of limitations had run out on enforcement and/or credit reporting. As the Consumer Financial Protection Bureau is aware that the debt collection industry is broken, it does not give the right for federal collection laws under the Fair Debt Collection Practices Act to be use illegally. I attach XXXX recent collections mailed to me that are not legal, but my information can be considered stolen and now an identity theft issue that I must submit complaints about to the Office of Attorney General, Commonwealth of Pennsylvania. The Fair Debt Collection Practices Act is being violated as follows : XXXX no longer has a legal right to collect under restrictive guidelines in the Commonwealth of Massachusetts, as well as under the Fair Credit Reporting Act to report on credit, or the right to maintain a collection under the Fair Debt Collection Practices Act. Essentially, XXXX had a responsibility to purge my file and my personal information such as my social security number. My personal information has been illegally shared with a debt buyer known as XXXX XXXX XXXX XXXX and a debt collector named Monarch Recovery Management , Inc . Monarch XXXX Management , XXXX, claims that they are collecting a debt on behalf of a debt buyer named XXXX XXXX XXXX XXXX. There is no historical connection of a purchase of any debts from XXXX, XXXX, and my information was obtained by an illegal debt pooling process XXXX uses to obtain collections that are no longer legally enforceable. This is pure identity theft by a debt buyer and their counterpart collection agency known as Monarch Recovery Management , Inc . I am showing proof that illegal collection activities still go on in the United States, even after the Federal Trade Commission and the Consumer Financial Protection Bureau has fined these types of illegal activities in the millions of dollars. I demand that my files must be purged by XXXX, XXXX XXXX XXXX XXXX and Monarch Recovery Management , Inc. permanently. A follow up complaint will be submitted to the Office of Attorney General, Commonwealth of Pennsylvania within 30-days if I do not receive a purge letter from all three entities.

On or about XX/XX/2021 I contacted the original creditor ( XXXX XXXX ) with regards to the debt that has been forwarded to XXXX Account XXXX to which they are attempting to collect from me in violation of both Civil and Federal Rights. I had informed XXXX XXXX that no one had been authorized to open an account in my name and that I did not provide my explicit consent to authorize an account for electricity usage to be opened in my name at the property located at XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, RI XXXX. I further informed them that for the 5 years of my residency at the said location the electricity had always been included in the rent because the electrical wiring was not up to building code nor was the property legally wired as a 3 apartment dwelling which would allow for the appropriately apportioned calculations for each unit. Therefore, the meters that had been installed were a result of criminal activity and a violation of the states building code at the time. XXXX XXXX intentionally ignored my numerous complaints and inquiries that followed soon thereafter my initial complaint in violation of my civil rights as an individual as well as federal rights as a consumer. In fact, the state 's city inspector affirmed that the meters were illegally installed and remanded the landlord XXXX XXXX XXXX to conduct the necessary repairs that would bring the electricity up to code at the above mentioned property. Attached is a copy of those said violations which clearly indicate that there was a jumper cable wire that still connected the 2nd and 3rd floor unit in order for the electricity to work because, the property had never been legally rewired in order to separate the electricity and install 4 separate new meters legally. Once again, I explained this to XXXX XXXX repeatedly and they did absolutely nothing to resolve the situation which will most likely end up in further litigation as the electricity should have never been transferred from the landlord to the tenant without my consent nor application. Especially, under the illegal circumstances and since, the landlord could not have legally made the tenants responsible for the electricity then this is not legally my debt. It's been nearly a year and until this date the property 's household meter still reads XXXX which is a clear indication of why this was all illegal in the first place. I disputed a collection account reported by Allied Account Services Inc. ( Account # XXXX ) to XXXX. I 1st filled out the dispute form and was assigned File ID # XXXX by XXXX. This disputed collection account stemmed from an alleged {$2600.00} debt from XXXX XXXX, a utility company, for electric & gas service that were not mine, and incorrectly billed to me. I did not authorize the XXXX XXXX utility service, did not request it, and did not live at the premises where the utilities were wrongly put in my name. To Whom it XXXX concern ; I have filed a few disputes with XXXX XXXX, formerly known as XXXX XXXX. For the first part of my dispute, I never made an agreement with XXXX XXXX to begin with. On XX/XX/XXXX XXXX had approved my buyer protection claim for the charge in question, this was verified by XXXX Employee XXXX Employee ID # XXXX on XX/XX/XXXX during a phone conversation. XXXX XXXX said they would not honor XXXX terms and conditions. They do not get to make this decision as the credit agreement I entered guaranteed those protections with the use of XXXX XXXX. XXXX can not unilaterally decided that I no longer am protected because I did not enter into an agreement with them. They can not negatively report on my credit with this either. I also filed a fraud claim with XXXX XXXX, which was later approved by XXXX XXXX on XX/XX/XXXX. In this approved fraud claim synchrony bank stated that they may re-bill me for the items within 60 days of the approved claim. That time period began on XX/XX/XXXX and ran until XX/XX/XXXX ( give or take a day ). XXXX made no contact during this time window. Instead, after I filed a complaint they attempted to say that the issue had been resolved and I was credited on XX/XX/XXXX. It is impossible to re-bill someone for something when the claim that would require a re-bill hasnt even been approved yet ( Approved on XX/XX/XXXX ). The attempt to hide this and not be forthcoming in their report on the account is fraudulent and I can not be held liable for their unlawful behavior. I have attached all documents to this to show the dates and times. They also state in the approved fraud claim that they would send a letter of explanation with the re-bill, as you will see there is no letter from them with the re-bill ( this was also a 0 % interest purchase for 6 months, that would have had to be specified in the re-bill. ) The only letter stating there was a re-bill was in response to the CFPB complaint on XX/XX/XXXX, well outside the 60 day window. Credit card company turned off my ability to pay and I was not able to get them to turn it back on. After XXXX missed payments, they closed my account and I was sent to collections. I received a letter from a collections agency that stated a settlement offer. If I paid half of the amount due, the credit card company would forgive the other half. The letter stated the settlement was an option for the entire length of time that the collections agency serviced my account. I paid the 50 % to the collections agency and thought I was done with this debt. However, a few months later, I was checking my credit and the half amount was still showing as due. I called the collections agency and they told me that the credit card company had requested my account back. Since the collections agency no longer had my account, they apologetically let me know that there was nothing they were able to do. I called the credit card company and asked why the debt was still there if I paid the settlement, and the representative said it was not marked as a settlement. They said they would request the information from the collections agency and get the debt removed. Another couple months go by and I get a letter from the credit card company to open a credit card with the balance of my debt as the credit limit. I call the credit card company again and ask why my debt was not removed. The representative was extremely rude on the phone and went as far to say " what do you want me to do about it. '' I paid the collections agency in XXXX of 2015 and the credit card company requested my account back in XXXX of 2015. I have not been able to get the credit card company to assist me. On XXXX/XXXX/22, I used the functionality on XXXX XXXXXXXX XXXX website to start service at an apartment complex that I was planning to move in to. I chose the start date as XXXX/XXXX/22. In XXXX, when I went to pay my final bill for the apartment that I had been living in for a few years, I noticed there was an outstanding balance of {$60.00} for the apartment I never lived in. In XX/XX/2020 I received a written notification from XXXX XXXX XXXX , XXXX claiming they were attempting to collect on a debt for the original creditor XXXX XXXX with an account number referred to as ( XXXX XXXX XXXX XXXX ). Upon receiving this information and not having any previous knowledge of the account in question I requested validation under the Fair Debit Collection Act. In my request, I demanded a copy of any and all documentation showing this account was authorized and opened on my behalf including but not limited to a signed agreement. On the contrary to my request I notified Monarch that this account was previously investigated by law enforcement and deemed fraudulent due to identity theft but pursuant to law I would await their proof of ownership. On the contrary to my previous position on XX/XX/2020 I received notification including copies of what appears to be a credit card statement. In a review of these documents which did not include what I requested the name and address were both identifiers not associated with me personally. At this present time I have turned the matter over to our attorney for immediate action but I was instructed by law enforcement to open a claim pertaining to Monarch 's failure to comply.

Called in to pay a debt that I did acknowledge that belonged to me. I was told if I paid the debt it would be reported to the original creditor and a receipt or letter would be provided to me within 10 days after payment. I called back in on XXXX informing the representee I still yet to have received any receipt of the payment I made on XXXX The representee continue to try over talking me while on the phone. The representee did acknowledge I paid said the account was closed. My question to her was, can I get my receipt that the debt was paid and settled? She said they would mail it out. I asked for a email option or fax and that was denied. My second question was this paid debt reported to the original creditor? The representee said she did not know. I asked to speak with a supervisor that could answer the question? I was on hold for over 24 minutes and 44 seconds and they hung up on me! On XX/XX/ the first representee took my payment and said it could be sent by email or XXXX after ten days. I was misinformed by both calls to take my payment and now I can not get any proof of the debt being settled or resolved feel I was lied to to just take my money.

I continuously receive calls to my personal cell phone from Monarch Recovery, XXXX, regarding my ex-husband. They identify themselves as a recovery agency ( sometimes ) and ask for him by name. I have told them numerous, repeated times that this is not his phone, we do not have a legal or financial relationship, and I have variously provided his contact information and also asked them to stop calling. I receive a call from this number almost daily and sometimes during working hours XX/XX/2016, and at least weekly during XX/XX/XXXX. I have added them to my auto-block list on my cell phone to avoid the annoying and disruptive contacts. I found out that they are also calling my mom ( his ex-mother in law ), who has even less history with him. This firm obviously has my ex-husband 's current contact information, as I discussed the incident with him and he was aware of the firm and had been contacted by them as well. It should n't be OK to repeatedly contact disinterested third parties just for the sake of annoying them into pestering a person ( over whom they have no control ) into paying their debt.

I sent a return certified letter requesting more insight for this alleged charge. Monarch Recovery sent me a letter stating I owed over {$320.00} for a debt through XXXX XXXX XXXX, a credit line through XXXX that I 've never used or authorized to use. The letter gives no information other than this, so it 's completely unhelpful and vague. I have never received any notice from XXXX XXXX XXXX stating I owe money. Once again, I 've never used it or heard of it until I received this letter. I 've never made late payments on anything in my life and have worked hard to maintain an excellent credit score. My credit score is now ruined because of XXXX XXXX and XXXX XXXX XXXX because of their false claims. I had never heard of either one of these entities until I received the debt collection letter, but by then it was too late. I received a collection letter from Monarch Recovery Management XXXX Inc XXXX Monarch XXXX dated XXXX XXXX, 2015. In the letter they state they are attempting to collect a debt on behalf of XXXX Bank. I was immediately suspicious as I have never held an account with XXXX Bank. I contacted XXXX Bank and they confirmed my suspicion of not ever having an account with them, not owing them money and that they never turned anything over to Monarch nor do they use them for collection. I then sent Monarch a debt validation letter on XXXX XXXX asking them to provide details of the debt. I had not heard from them until today when I received a second debt collection notice dated XXXX XXXX, 2015. I called the number listed on the letter and while I did not get an actual person, I left a voicemail asking them to cease and desist any further collection attempts until such debt validation has been made per FDCPA guidelines as enforced by the FTC.

I have repeatedly told Monarch Recovery Management that the debt that they are trying to collect was from my old business. The debt was from a XXXX business loan. I have been tirelessly going back and forth between Monarch and the original bank, XXXX, and neither are of any help. XXXX sent me the statements in questions and they all have my name and my company 's name on them. I did not personally guarantee the loan and have since dissolved the company. The proper procedure would be to pursue my company and not me. They have put the debt on my credit report and it's destroying my FICO score. Everything else is positive, but this is negative. I have also tried to resolve this with the three different credit reporting agencies, but have not been able to. After I have told Monarch that this is not a personal debt, they will not stop calling me and remove the debt from my credit report. Please help me in dealing with them.

I received a collection notice from Monarch Recovery Management , Inc. on XX/XX/21, claiming debt owed on an old XXXX checking account of mine in the amount of {$3900.00} and for a settlement amount of {$790.00}. Upon looking into this further by speaking with XXXX, I was informed that there was a lump sum transferred to this account that I have no knowledge of. I next made action to obtain the proper debt validation from Monarch Recovery by sending a Credit Validation letter by Registered Mail on XX/XX/21. I have signed receipt of mail on XX/XX/21, however, Monarch failed to return the validation information to me within the allotted 30 days. It should also be mentioned that upon looking into other consumer 's experience with Monarch, there are anecdotal reports of other consumers receiving fraudulent debt claims from Monarch. I received a call at XXXX today from XXXX from a person identifying herself as XXXX. She stated she was representing Monarch Recovery Management based in XXXX and asked if I was XXXX. I affirmed that I was, and she asked for my birth date. This I refused for obvious reasons. I asked the nature of the call, and she replied it was about a debt to a bank I had never heard about. I told her I had no debts and had never heard of the bank she mentioned. I asked her for the birth date of the person she was looking for and she refused, citing privacy. She then suggested that my providing her with my birth date might help me detect identity theft. As a retiree from the California Department of Consumer Affairs, this raised a red flag for me. It appears to be a XXXX so can't talk to anyone. They never send any information to verify the debt. So I am unsure of validity of any debt. They call usually XXXX times a day. For the past two to three months, I have been receiving calls from Monarch Recovery Management attempting to collect a debt. The callers leave a message on my cell phone voicemail because I do not answer calls from callers not in my cell phone address book or callers with an Unknown caller ID. The phone numbers being used to call me show up in my caller ID with no name. The area codes used are XXXX and XXXX. The phone numbers change within the XXXX area codes on subsequent calls. The callers identify themselves as Monarch Recovery Management, stating that this is a call from a debt collector. Sometimes they say they are calling to collect a debt. In ALL cases, the callers NEVER give the name of the supposed debtor. On occasion no message has been left at all. Monarch recovery sent me a debt collection and the company is lying about the account and when I made a payment last. This is a XXXX credit account that XXXX XXXX bought after I had a huge issue with XXXX and them not helping me with a bunch of orders from XXXX that never were shipped. I have contacted Monarch Recovery Management Incorporated on several occasions to obtain a receipt of payment for a debt with XXXX XXXX. They keep sending me a receipt saying that " in the event that your funds are returned unpaid by the bank, this letter will be null and void. '' I need a letter indicating that the debt was settled and that they have received their funds. These folks were paid over a year ago. I called again today and spoke with the same supervisor and she says that this is the letter that is created by them. She could not send me a letter without that statement attached to it. She told me that I was welcomed to file a complaint with your office. I have to wonder if they are a legitimate company since my credit report still reflects the accounts as a charge off.

Monarch Recovery XXXX Calls and messages have used extremely abusive tactics. One agent claimed to be a law office and said they had repeatedly sent communications to my address that were not responded to, so they were going to file with the local courthouse ( not named ). This was false. Yesterday an agent claimed they were from a local courier agency ( not named ) and that they were required to show up to both my employer and my home that day. Of course, nobody came.There have been repeated calls to my mother, grandmother, my mom 's ex husband, and my ex husband. The company is calling about XXXX or XXXX times a day. Once on my wife 's cell phone and the other on the landline. But they do n't leave any messages or nothing for me to call them back but I did google there numbers. But they are Monarch Recovery. They use a robo type call to get to talk to somebody but then they hang up. I did n't get anything in the mail or nothing about why they are calling. It is usually morning noon and night they call.
