I have been discriminated against and taken advantage of and am being forced to leave my home of 18 years because of my combat injuries and cognitive issues. My name is XXXX XXXX XXXX and I'm a Combat XXXX Veteran VA rated 100 % Total and Permanent and in XXXX I spent a lot of time in VA XXXX and my finances were damaged so in that same year I filed XXXX XXXX XXXX and was led to believe that a 2nd home loan included was discharged. Never heard anything for 10 years and on XX/XX/XXXX I received a letter from a law firm named Millsap and Singer saying that my home would be foreclosed and sold on XX/XX/XXXX. I am Combat XXXX and have some cognitive issues so I called my mortgage company XXXX and informed them of the letter and they said no worries, I was in good standing and my home would not be foreclosed on the XXXX. I called Millsap and Singer and told them what my mortgage company XXXX said and also explained to them in great detail my hardships from my combat injuries, my many VA XXXX stays and how I damaged my finances from my injuries, how I made extra payments to XXXX to ensure no foreclosure and that XXXX said I was in good standing and current and that no foreclosure will happen on XX/XX/XXXX and they said they would have to hear it from XXXX. So I talked to my mortgage company XXXX again and a different person said the same thing, that I was in good standing and there would be no foreclosure and that it was a scam. I explained that the Lawyers said they needed to hear it from them, a 3rd XXXX employee once again said no, it is a scam there will be no foreclosure and that I was safe. I tried calling the lawyers back but was unable to reach them till the XXXX and they told me my house sold XXXX minutes ago and there was nothing I could do about it. They told me a company called XXXXXXXX XXXX XXXX foreclosed on my 2nd mortgage loan I thought was discharged in XXXX in my XXXX XXXX XXXX, 10 years ago, and I never, ever heard of XXXX XXXX XXXX till that very second. I asked the lawyer why did they let me keep thinking it was my regular mortgage company after speaking with them on the phone and explaining my situation and that I was searching for a solution and if I knew of XXXX XXXX XXXX I would have called them and worked something out. I told the lawyer I received my first letter from them XX/XX/XXXX and nowhere on the letter says XXXX XXXX XXXX. Millsap and Singer said I should have known and that they posted it in the paper and not their responsibility what I thought. I then called XXXX XXXX XXXX whom I just found out about and they said my home already sold to a company called XXXX and so I called them and they said they will give me some time to get a VA Loan and then give them {$110000.00} and I can have my home back, I have until XX/XX/XXXX, and then I am a Homeless Veteran. In 23 days of my first letter they take my home, I am beside myself and under extreme stress of being a Homeless Veteran and not being able to take care of my family, everyone will be scattered and they all helped me deal with my injuries. I am having a very difficult time finding a bank to help with a VA Loan because of my damaged low credit score. I have lived here in my home for 18 years with my wife of 34 years and my 2 sons and 9 cats ( I found a cat and turned out she was pregnant ) and so I have my cats who are my best friends and have helped me cope with my injuries and there is no way I can abandon any of them. If I can't find help I will have no choice but to do my best living out of my car because I have to have heat for the winter. I'm pretty depressed and really don't know what to do. I deal with a lot of pain from my combat injuries in XXXX and suffer from severe XXXX and I am really scared. I hope someone can help me.

On XX/XX/XXXX, a notice of foreclosure was received from Millsap & Singer, P.C./LLC ( `` Millsap '' ) dated XX/XX/XXXX. A response was sent dated XX/XX/XXXX requesting a validation of the alleged debt they claim to be in default, opportunity to witness the Original wet-ink note which they claim to have, and what legal authority they have to foreclose on this property purchased by XXXX XXXX in fee simple in XX/XX/XXXX, and refinanced in XX/XX/XXXX. Rather than validate the debt, a lawsuit was filed accusing of slander of title and then proceedings for foreclosure/Quiet title. XXXX XXXX. XXXX et al, attorneys of Millsap, failed to rebut point-by-point with specificity, the affidavit sent to him within the time allowed, he failed to give an opportunity to witness the original wet-ink note which he claimed to possess and has continued to insist that there is a default without providing the evidence of bookkeeping showing the Sum Certain that was lent to XXXX XXXX and how XXXX XXXX XXXX , XXXX ( " XXXX '' ) was damaged by not receiving alleged payments. The Note filed as evidence in court has been altered and is null and void when altered. The note signed by XXXX XXXX, which the bank monetized and turned into money and put back in their pockets, is not consideration to XXXX XXXX. The exchange amounted to a gift to them and a charge to me. For my generosity, XXXX XXXX was given a bill in the same amount and asked to pay for 30 years with interest. There is no contract without consideration. Therefore a voided not can not be used as legal standing for foreclosure. XXXX XXXX. XXXX et al knowingly evidenced a fraudulently recorded assignment claiming to be from Mortgage Electronic Recording System, Inc. ( MERS ) without any evidence of XXXX being in MERS database search as the servicer of the alleged mortgage note number, with intent to foreclose on my property. The note signed by me had a government form in it from the United States Department of Housing and Urban Development ( HUD ). This makes the loan under governmental regulations as to authority to foreclose. A bank or servicing company can not legally foreclose if no commissioner has been appointed by HUD to oversee the foreclosure and none has been disclosed to me per U.S.C. Title 12. XXXX XXXX. XXXX falsely admit immaterial facts as evidence in color of law before this court to defraud XXXX XXXX et al. Such offense in court have penalties per Missouri Laws 575.040 and 575.060. XXXX has continuously refused to show evidence showing how XXXX XXXX XXXX , XXXX and/or MILLSAP & SINGER , LLC [ XXXX XXXX. XXXX, et al ] have been damaged by XXXX XXXX. Where there is no valid claim, there is no case. However, the court has continuously dismissed the pleadings and demand for evidence and allowing XXXX XXXX. XXXX to continue his fraudulent actions, violating the state and federal laws with regards to foreclosure proceeding. The Missouri Attorney general, SEC, FBI, and other government agencies including the Federal Court have been notified of this fraudulent activities of the attorneys of Millsap & Singer, P.C/LLC.

Late XXXX I applied for loss mitigation and in XXXX I received a letter saying my application was being processed ... On XX/XX/2018, I received a letter saying I am ineligible for loss mitigation, then on XX/XX/2018, I received a letter saying why I'm ineligible and the other dated XX/XX/2018 saying I had until XX/XX/2018 to decide if I would be doing a short sale, as noted this is now too late ... I then call XXXX, XX/XX/2018 and tell them everything listed above and ask how to stop for closure and they tell me to pay {$1200.00}, then next day XX/XX/2018, I sent a check for {$1500.00} to the Illinois p.o box, the check was signed by my father in-law, with a note that has my name and account information so there wouldn't be a mix up..I then called XXXX and talked to XXXX extension XXXX , and he noted check was on the way ... so to my surprise I received a letter on XX/XX/2018 saying I for closure proceedings may happen if I don't dispute and so I'm disputing ...

Milsap and singer a foreclosure law firm who was suppose to be the trustee and have mine and the mortgage companys best interest in mind only had the mortgage companys best interest in mind as they have a financial insentive to side with the mortgage company not only did they not check to see if the lender had grounds to foreclose the stood by and did nothing as I was dual tracked during the foreclosure process the lender violated regulations z and x acourding to the Dodd Frank act tila act respa act and many other laws milsap and singer are in violation of breach in Trust laws and also present a conflict of interest as they are representing the lender in a lawsuit I have filed
