DUE TO COVID I HAVE BEEN AFFECTED BY THE HARDSHIPS THAT HAVE FOLLOWED. I NEEDED HELP WITH MY MORTGAGE AS A RESULT OF LOSING MY JOB IN XXXX AFTER BEING OUT OF WORK FOR XXXX XXXX XXXX XXXX XXXXXXXX ) FROM XXXX. I WAS GIVEN INFORMATION ABOUT A PROGRAM THAT WAS DUE TO START IN PA FOR HOMEOWNER ASSISTANCE FOR INDIVIDUAL FAMILES THAT HAVE FACE EXTREME HARDSHIPS BECAUSE OR DUE TO COVID. I SIGNED UP FOR THIS EMAIL LIST FOR PAHAF IN XX/XX/XXXX. I WAS UPDATE VIA EMAIL OF WHEN THIS PROGRAM WILL LAUNCH. I WAS RECEIVING UNEMPLOYMENT WHILE SEARCHING FOR NEW EMPLOYMENT. THAT UNEMPLOYMENT STOP IN XX/XX/XXXX. THIS IS WHAT CAUSED ME TO FALL BEHIND WITH MY MORTGAGE. I RECEVED CONFIRMATION I BELIEVE IN XX/XX/XXXX THAT THEY WILL BE STARTING IN XX/XX/XXXX. ALSO IN XX/XX/XXXX I FOUND AND WAS OFFERED FULL TIME EMPLOYMENT. I HAVE APPLIED FOR PAHAF. MY APPLICATION HAS BEEN COMPLETED ALL DOCUMENTS HAVE BEEN SUBMITTED AND THIRD PARTY AUTHORIZATIONS HAVE BEEN SIGNED A SUBMITTED. TO THIS DAY AND AS OF JUST RECENTLY I WAS TOLD THAT PAHAF HAS BEEN WAITING FOR MIDWEST LOAN SERVICES TO SIGN OFF ON AN AGREEMENT. IM NOT SURE WHERE MY APPLICATION IS AT THIS POINT. MY MORTGAGE IS CURRENTLY BEHIND AS OF TODAY {$7300.00}. I CONTINUE TO WAIT FOR CONFIRMATION OF MY APPLICATION AND IF THIS HAS BEEN APPROVED ACCEPTED AWARDED =PAYMENT. I FEEL LIKE THIS PROGRAM WAS SET UP TO HELP FAMILIES IN PA BUT ITS MAKING SITUATIONS WORST BECAUSE OF THIS LACK OR STAGANT MOVEMENT THEY ARE PUTTING FAMILIES LIKE MINE IN FORECLOSURE STATUS! IM WONDERING IS THIS THE GOAL? I want to start by saying this is more than beyond Unfortunate ( to say the least ). I am in the same situation as I have been patiently waiting for this process to be completed for months now. And I am in a worse situation than I was in XXXX and XXXX. Everyone that I have spoken to from PAHAF is aware of this. I have done everything asked of me to do per my participation and applying for assistance with PA HAF. I would like to know why this was not caught ( XXXX ) non-participation with PA HAF in the beginning stages of this application process? It makes no sense and is Grossly Negligent to me that I am just literally finding out as of XX/XX/XXXX from MIDWEST LOAN services- servicing provider for XXXX that they ( XXXX ) is not participating. And I will continue to do what I can to shed light on XXXX non-participation. However, it seems I was not properly notified or made aware of all of this in a timely manner from PAHAF- MIDWEST LOAN- XXXX. I am behind on my mortgage 5 months with this current month of XX/XX/XXXX XXXX {$1000.00} all due in total as of today {$6200.00}. It would have only been 3 months but due to MIDWEST not accepting any more payment from me since XX/XX/XXXX i am now a total of 5 months. I was trying to pay my mortgage payment each month starting XXXX XXXX once I obtained employment for the purpose of not falling further behind. However, I was not able to make the payment independently because I have been in collections. I was told by XXXX XXXX ( who works with Midwest Lost Mitigation or Collections dept. ) who was working with me to call her each month so that she will process my payments. That stopped in XX/XX/XXXX. I explain all of that to say I have been doing what I can to not fall further behind as I'm waiting for the process of approval and award / payment from PAHAF. Really ( at this point ) I want help with saving my home! This is MY and My Family home, me and my children! I am not getting any more information to help me with getting my mortgage payments current! I don't want to believe that this program was created to " NOT '' help families like mine. Families through no fault of our own that have been Financially affected and forced to deal with this PANDEMIC! I want to know what are the next steps from here? How and ( if any ) what options do I have to get assistance now to catch up on my past due mortgage payments? Are there any other NON profit organizations that PAHAF works with that may be a liason to XXXX so that I can get the payment to them for my mortgage? Will anyone assist me with this? Is PAHAF working on solutions to find another way to help me? Do I or Should I reach out to XXXX XXXX directly? Do I need to reach out to the U.S. DEPARTMENT OF TREASURY and Pennsylvania State treasury? I refuse to do nothing and I have not been given any options from anyone. I am currently waiting for XXXX to get back to me, as she PROMISED ( yesterday afternoon ) she will contact me this morning. I have left XXXX a text message ( not sure if she has received it ). OUT OF 30+ CALL AT LEAST 15 I REQUESTED A CALL BACK FROM PAHAF SUPERVISORS FOR CLARITY ON MY APPLICTION. I NEVR RECEIVED CALL BACKS OR INFORMATION. IN XX/XX/XXXX I FINALLY RECEIVED GENERIC EMAIL FROM PAHAF OUTREACH. I THAN WAS IN CONTACT WITH XXXX WITH PAHAF. I DID NOT THINK BACK IN XXXX THAT I WOULD STILL NOT HAVE THESE ANSWERS. I HAVE RECORDINGS ALSO WITH SPEAKING TO ALL OF THESE INDIVIDUALS FROM PAHAF-MIDWEST LOAN SERVICESXXXX XXXX XXXX XXXX XXXX THEY ARE NOT ASSISTING ME OR GIVING ME CONFIRMED ANSWERS WITH MY APPLICATION FUNDS PROCESSING I WANT TO KNOW IF I HAVE BEEN APPROVED FOR ASSISTANCE ( BECAUSE IT SOUNDED THAT WAY BASED OFF OF EMAIL FROM XXXX. ) ALSO WHEN WILL THE MORTGAGE LENDER GET THESE FUNDS? Midwest Loan Service handles the payments and processing of loans from a credit union that I have my loans through. The complaint that I am filing at this time is because my mortgage payments are due on the first of each month, when the loan was handled with the prior organization I received coupons/statements well in advance of the due date. I now consistently receive my statements near ( a day or two before ) on or even after the due date, and once received no statment at all. I have contacted Midwest numerous times regarding this issue. Each time they give me an answer of " well, you have a 16 day grace period to pay the bill '' .... in other words you don't get charged a late fee until the XX/XX/XXXX of the month. ( why would a mortgage company have a due date of XX/XX/XXXX, but not charge late fees until the XX/XX/XXXX?? Careful checking and you can figure it out ) I received XX/XX/XXXX statement after it was due and paid it the evening of XX/XX/XXXX ( in the XXXX. ) ( marking the XX/XX/XXXX as the morning it went out in the mail ). Mid West has added late fees to that months payment saying they did not receive it until the XX/XX/XXXX, this is very important to note because today when I called to complain to them again and while talking to XXXX, he informed me that the payment was received on the XX/XX/XXXX and that they open and process the mail the same day it is received which means ( according to his statements ) it takes at least 8 days for the mail to travel from XXXX Pa to their location. Take that into consideration when understanding I receive my statements after the due date, also consider that according to him it takes at least 8 days to transfer mail from/to each other, consider when they process/print their mail/invoices and send the statements ... I believe their system is set up to force people to use electronic payments ( to avoid late fees and charges ) or they benefit ( increase their profits by sending statments out after the due date and then adding late charges to the accounts because they then state they have received the payments late ). This should actually be considered racketeering, or criminal, I know this much if I were to do this with my business in Pa I would loose my license/ability to work/provide service and most likely be charged criminally. IT IS UNACCEPTABLE TO ALLOW A " BIG BUSINESS '' TO EXPLOIT INDIVIDUALS FOR FINANCIAL GAIN. I am asking that all " late '' or " past due '' charges be removed from my accounts and that from this time forward they are held to the standards of the law in such that I receive my invoice/statements 14 days prior to the DUE DATE, ( I believe that is a consumer protection law in Pa at least ). I also ask that any reports that Mid West may have made to credit reporting agencies showing late or delinquent payments be removed ( they send a statement acknowledging the error was because they sent the invoices out in such a manner that they were received by me after the due date ). I am also asking that an investigation be conducted of their operations, how payments are received and processed, is the mail actually received and processed the same day, or is it allowed to " sit '' on their site for a period of time, and how they print and mail invoices to their customers, what day are they printed and when are they mailed, this is critical based on their representative confirming that mail from Pa - XXXX takes at least 8 days. Quite simply, hold this " business '' accountable to the law and fair business practice, again if it were a smal business doing this it would be shut down and most likely criminally charged, they should be held to standards and accountable. On another issue regarding the same company and their handling of my loans, they continued to charge me pmi, even after numerous request were sent to them, they were asked verbally, and continued charging pmi after it should have been removed - I checked online for other consumer complaints against them and this has shown up that they have done this to others as well. I would like my account audited and to be reimbursed ( with interest according to their rates that they charge their customers ) for the monies charged after my firsrequest to have pmi removed.

Mortgage service provider send me a letter in XX/XX/2016 bringing to my attention that my mortgage loan has outstanding late fees. This is after over 20 months of them charging me a late fee every month. As soon as I was made aware of the late fees, I made the necessary change to prevent further late fees from being incurred. I should have been notified right away, after the first month the late fee was charged. Just because I signed up for e-statements DOES NOT mean I gave my approval for ALL correspondence to be electronic. To my knowledge, there was no other letter sent to me. By the time Midwest sent me the letter, the outstanding balance of late fees was over {$1400.00} dollars. COMPLAINT # 1 : Midwest did not provide me, the mortgagor, with a clear explanation regarding scope of what paperless consent entailed when I signed up for e-statements. Per my discussions with them, they seem to indicate that since I signed up for e-statement, they were under no obligation to send me a letter about the late fees. Midwest Loan Services failed to provide me clear indication of the scope ( which documents, transactions, types of transactions or categories of records ) of the consent. I interpreted my consent to be limited to monthly statements. Why would I be expected to ASSUME that the consent to e-delivery also applies to other types of transactions, like the assessment of late fees? NEVER did I knowingly consent to online delivery of ALL COMMUNICATIONS from Midwest Loan Services. Midwest SHOULD NOT ASSUME that by consenting to online delivery of statements the mortgagee is waiving the right to written communication on all types of correspondence. There is a very good article written by the Director of Consumer Affairs, Federal Reserve Bank of XXXX, and XXXX, Senior Consumer Affairs Examiner, Federal Reserve Bank of XXXX which lays out in simple terms the E-SIGN ACT COMPLIANCE REQUIREMENTS. Among the requirements : ... a financial institution must inform the consumer in a clear and conspicuous statement whether consent relates to a particular transaction only or whether consent relates to broader categories of information. WHAT SHOULD BE DONE? Midwest Loan Services should rescind the late fees charged after the first one, as I would have rectified the situation by changing my auto payment date upon written notification, as I did when I was notified in XX/XX/2016. ************************************ COMPLAINT # 2 Midwest Loan Services did not provide me with sufficient or timely notice of the assessment of late fees. It appears that failure to take proper steps to notify borrower of late fees is part of a intentional methodology designed to maximize late fees that could have been avoided with a simple written communication. WHAT SHOULD BE DONE? Midwest should update their website to make it clear to consumers what kinds of communications they are agreeing to receive electronically only when they are signing up for e-statements. I have attached examples from creditors that do so. ************************************ COMPLAINT # 3 - Midwest Loan Services website is difficult to navigate and substandard. It lacks a lot of functionality that would be beneficial to mortgagors, like : 1 ) when selecting payment date for auto payment, there is no indication of due date or that the due date they are selecting will result in late fees. 2 ) it is unclear on the website how to opt out of e-statements once you 've enrolled. I had to call customer service to help me un-enroll WHAT SHOULD BE DONE? Midwest should update their website so 1 ) consumers are made aware of their payment due date when they are signing up for auto pay and selecting a date. I have attached of examples from other creditors that do this. 2 ) It is clear how to un-enroll in e-statements once you have enrolled

Dear Consumer Financial Protection Bureau, Today is XX/XX/XXXX. I am a member of XXXX XXXX XXXX in XXXX, OR. Besides my primary banking, I have a home mortgage with them. XXXX utilizes Midwest Loan Services XXXX XXXX XXXX, XXXX, MI XXXXto service their mortgages and XXXX as a subcontractor for their online bill pay. On XX/XX/XXXX, I used my XXXX XXXX online bill pay to make an automatic mortgage payment on my XXXX XXXX mortgage of {$1800.00} from my XXXX XXXX checking account to their mortgage loan servicer, Midwest Loan Services. I was in error as the escrow portion of my payment increased and my payment was short about seven dollars and I failed to increase my automatic payment. On XX/XX/XXXX ( same day ) Midwest generated a letter to me on XXXX XXXX letterhead that stated they no longer allow partial mortgage payments and have returned ( past tense ) my funds to me. On XX/XX/XXXX, I called Midwest Loan Services as I had not had these funds ( {$1800.00} ) returned to me. I was told on XX/XX/XXXX the funds were returned to XXXX and should be reflected within 48 hours on my account ; I had never heard of XXXX but learned they actually are a company behind my credit union 's online bill pay system. Midwest claimed your regulations required to return the funds back to whomever sent them to them, in this case XXXX. I called XXXX XXXX and filed a complaint that my {$1800.00} is missing. They said they would follow up with XXXX. On XX/XX/XXXX, 'XXXX ' from XXXX called me ( XXXX ) and said they had never received anything from Midwest Loan Services . We did a conference call with 'XXXX ' of Midwest Loan Services ( XXXX ). Midwest Loan Services stated they received a check from XXXX and therefore were going to return a check that may take up to three weeks to generate. I pointed out that I made the payment on XX/XX/XXXX electronically and that same day they generated the letter ( under XXXX XXXX XXXX letterhead ) stating they had returned the funds as a partial payment, so it could not have been a mailed check. 'XXXX ' from XXXX confirmed that the funds were sent electronically. I asked why were n't the funds returned electronically? I was told that CFPB regulations required that a hard check be returned only to the entity that sent them the money, in this case XXXX, to combat money laundering. I was told a check may take up to three weeks to be generated and received. I asked who the CFPB was and what the acronym stood for promising to follow up. There was some confusion about what CFPB stood for. As a consumer, it appears that this entire transaction is under XXXX XXXX XXXX. I did not point out that my original mortgage contract with XXXX XXXX did not state that partial payments are not authorized, in fact it states I can make early payments. I believe that Midwest Loan Services unilaterally made changes to the contract rules. I do remember receiving an email from them about no longer accepting partial payments. Bottom line is Midwest Loan Services, as an agent for XXXX XXXX XXXX, received {$1800.00} of my funds electronically transferred to them from my XXXX XXXX XXXX checking account, has refused to credit these funds towards my account due managed by them, has not to date returned these funds and states that they may not be returned to me for up to one month time period after receiving them. Further they stood to charge late fees if another payment had not been made again within a few days of when they notified me by letter. Further they state CFPB regulations require they act in this manner. Is this true? If so, I do not believe your regulations are protecting the consumer and you should consider changing them. If not, I would like to know so I can address this with my credit union and their contract with Midwest Loan Services. Thank you!

I went through a HAMP with my mortgage servicing company in XX/XX/XXXX. The process was long and ended with me calculating my payments and sending that information to my mortgage servicer to draw up the paper work correctly. I should have known then that this company was not equipped to handle my loan. Today is the first time I found out that if a person pays on time they can get an incentive through the HAMP program. I was on the government website and found that information, but my servicing company never disclosed that and they never implemented my incentive in the past 3 years. My escrow account is not adding up. I have gone over the numbers and when I attempted to speak with the servicing company about what I found, I was hung up on. I have not had the time to throughly research the escrow account, but I am almost certain that if one year is wrong, all the years are not calculated correctly. My mortgage payment has continued to climb back up after my HAMP and they say it is because of my homeowners insurance, but I do n't see how it made such a big impact on my monthly payments. I am frustrated because I ca n't seem to find anyone at this mortgage servicing company who can add and explain what they are doing or lack thereof. Today the company took XXXX payments from my checking account, both dated for XXXX/XXXX/XXXX. On Saturday XXXX/XXXX/XXXX I scheduled my XXXX payment for XXXX/XXXX/XXXX. When I checked my bank account yesterday ( XXXX/XXXX/XXXX ) the funds were still there, so I went on the servicer 's website and it changed my requested payment date to XXXX/XXXX/XXXX. I immediately thought maybe I picked the wrong date on Saturday and deleted the payment for XXXX/XXXX/XXXX and scheduled a payment for XXXX/XXXX/XXXX. To my surprise today, two payments were processed and my account was overdrawn. When I spoke with the servicing company they stated that I initiated both payments and it would costs me a fee to have the extra payment reversed ( $ XXXX-check, $ XXXX-wire ). I informed the lady that I picked XXXX but their website changed it to XXXX. She stated that that 's what their system does when a payment is scheduled, it switches to the next month automatically. I asked her why because that is not what I wanted and she again just stated that that is what their system does. She put me on hold and came back minutes later stating they will waive the fee and refund me. It was never my fault. It should have been processed on the date that I requested. I asked about my bank fee and she said I would have to send proof of the fee to get that back. She also said that I can keep both payments in the system and my next payment would be due XXXX/XXXX/XXXX. I informed her that is not an option because my account is overdrawn and also, that payment included a late fee so why would I pay a late fee for XXXX on XXXX XXXX? This company is not professional, they are incompitent and they are not doing anything to benefit the client. They do n't know how to explain any of their actions and numerous times they have gotten frustrated with me and my questions.

I have loans on 2 separate homes that were being serviced by XXXX XXXX XXXX. XXXX still retains the loans but sold the servicing to Midwest Loan Services. The servicing transferred in XXXX of XXXX and that is when the issues started. The original letter was almost like they were going to find a way to get you to pay late. ( I have zero late payments on many, many loans over the last decade ) The letter instructed you on how to mail in a check for payment. ( I don't use paper checks anymore ) I called to find an alternative payment arrangement and was on hold for an hour and when I reached someone they informed me that the loan wasn't in their system yet and to call back. Called back several times and was eventually able to get online with my 2 accounts and make a payment on each loan. ( the website and features seem to be from 20 years ago ) I then set up an autopayment. Assuming the autopayment would work and I didn't check that XXXX payments were taken and they weren't. I found out about this by calls from their collections area. A payment hadn't been taken on either of my 2 loans and they reported me late on 1 of the 2 loans ( why 1 of 2? ). I referenced the law that they shouldn't be reporting me late after a transfer of servicing for 90 days and they informed me it was only 60 days. I was able to talk to a supervisor in the collections group ( XXXX ext : XXXX ). XXXX was pleasant enough and was going to take care of things for me. I spoke to him on XX/XX/XXXX. Their system couldn't take 2 payments on each account the same day so I did a payment on each account and he said he would call me back the next day to take the second payment. No call. I called back 2 days later and XXXX said that he got busy. I then made the 2nd payment on both loans online while I was talking to XXXX. He said he would take care of the late payment on my credit since I tried to set it up autopay and their system didn't work. I asked him to cc me on correspondence with the department that was going to resolve it and nothing has ever been emailed to me. He then took all my information down to setup my auto payments on both accounts. Today is XX/XX/XXXX and no autopayments have been taken. I would like to be assured that their error on reporting me with a late payment is removed from my credit report and compensate me for the impact that it had to my credit. From my understanding, it never actually goes away once it is reported. I would also like to have my servicing of my loan moved to a company that have systems up to date with today 's technology. I refinanced my mortgage with XXXX XXXX XXXX XXXX XXXX, the servicer is Midwest Loan Services and my first payment was due on XX/XX/2020. I walked into XXXX on XX/XX/XXXX to make a payment and inquire about setting auto withdrawal for future payments. The XXXX person that helped me took a payment and told me how to contact Midwest to set up auto withdrawals. I did not do anything else regarding my XXXX payment and figured I would worry about XXXX later in the month. Today I received a letter in the mail from XXXX showing that I had insufficient funds to cover my mortgage payment on XX/XX/XXXX. So, there was already an auto withdrawal set up on my account, but I was not aware or told when I made my payment on XX/XX/XXXX. I called XXXX and they waived any fees associated with this event. Next, I called Midwest to ask for a reimbursement of my double payment because I could not make two payments in XXXX, they advised there is a {$10.00} fee to mail a check or {$25.00} electronic transfer. My request was to waive the fee because I am a new customer, the mixup was at the branch and I had good intentions to pay. I requested a manager and the operator said let me check because it is Friday and late in the afternoon, so there may not be one available. She connected me to a manager without telling me she was transferring me, then XXXX XXXX came on the phone ( she would not give me her last name after I asked for identifying information ) and I requested the fee to be waived in order to process the electronic reimbursement. Her response was no and she has no control over the fee waiver. Once I explained the situation, she said it was my fault that a double payment was made. Her solution was to let everything sit on the account and not make a payment for XXXX, unfortunately I need the payment or I would have been okay doing that. XXXX XXXX stated she is the highest manager and did not have someone above her, but she said I could call back on Monday, the customer service line, to speak to someone else. After asking for her managers name twice, she said her managers name is XXXX XXXX and I can call the customer service number on Monday to speak to her. XXXX XXXX was very sarcastic as the call continued, as I was upset at this situation, her customer service skills were not acceptable at defusing or showing any type of empathy. My request is/was to waive the {$25.00} fee in good faith, knowing I want to be on time and make my payment monthly.

I made my regular payment on XX/XX/XXXX ( the normal due date ) On XX/XX/XXXX I received a call by Midwest loan services hat said my payment had not been received. I informed the customer service rep, that I had paid via internet banking through my credit union and payment was sent ACH on XX/XX/XXXX and the funds were taken from my account. After a brief place on hold, I was told " sorry, you payment was n't late, we returned it due to our partial payment policy ''. But I did n't make a partial payment, I paid the same amount I do every month. This is when I found out there was a PMI miscalculation and I had and " escrow '' shortage of {$5.00}. They claim they sent a letter which I never received, it certainly was n't sent certified. So since they returned my payment, they now wanted me to pay it again with the {$5.00} added. Well I ca n't pay them, until I get the money back ( that they had ). At this point we started discussing a late fee and how I could be reported to the credit bureaus if I did n't pay it. This is when I started losing my temper. How can they do this? They had my money? After some negotiation, I was told they would waive the fee this one time and would not report me. But how many customers have they done this to? The status as of right now ( XX/XX/XXXX )? The rejected payment was sent to a third party internet banking partner of my credit union ( that is also their policy ). It will be 10-15 business days before it will be deposited back into my account ... at which time I can pay Midwest Loan Services AGAIN. It 's my opinion that they are in violation of the Truth in Lending Regulation as I have not been credited " promptly '' as the Reg states. I have spend at least 16 hours trying to track down my money. None of this was my fault and I 'm paying the price. Something needs to be done about this company.

This complaint is in regards to Midwest Loan Services ; located at XXXX XXXX XXXX, XXXX floor, XXXX MI, XXXX, who acts as a Mortgage Servicing company. The company recently updated their website and no longer allows consumers who are in bankruptcy to make payments online. Prior to this update I received an email notification regarding new login instructions. However, at no point did these instructions or any other documents notify me that those persons currently in bankruptcy status would no longer be able to make payments online. Additionally, the error message received online does not properly identify the issue and misleads the consumer into believing there is a payment scheduling issue that can be resolved. Prior to the new website, I had no issue making online payments. In XX/XX/2021 I contacted XXXX asking why I could not make a payment online. After speaking to the representative for several minutes, neither of us could conclude what the issue was ; therefore, I opted to make a payment over the phone. I attempted to make my XXXX payment online and again received an error message preventing me from making payment. I sent a screenshot of the issue to their customer service email. I received a reply back informing me I am no longer allowed to make online payments due to my bankruptcy status. Midwest Loan Services failed to properly disclose the changes to consumers prior to making a change that negatively impacts its consumers. Furthermore, if Midwest is charging fees for taking payments over the phone or via billpay, it has caused an additional financial burden to those already in bankruptcy. Lastly, in restricting online payments to those in bankruptcy, Midwest Loan Services is discriminating against those persons and could potentially ; unknowingly, discriminating against a certain class of people.

We are trying to get a refinanced mortgage, our rate is currently 5.25 % with XXXX XXXX. In the beginning of XX/XX/XXXX, XXXX XXXX from XXXX called us to see if we wanted a lower rate. We decided to check with other banks. Midwest Loan Services had our other mortgage prior to this house, so we called them.We talked to XXXX XXXX and went through the entire process, locked in rate of 3.125 % on XX/XX/XXXX. We received updated rate lock & good faith estimate on XX/XX/XXXX. On XX/XX/XXXX we received Approval with conditions form. On XX/XX/XXXX we were notified via email by Midwest that the Completed Appraisal report was received. On the same day we also received an updated GFE & truth in lending report. On XX/XX/XXXX we received an email stating that the property was not acceptable as collateral per XXXX guidelines as it is a manufactured home. Back in XXXX when we first started this process, we check with someone at Midwest in the department that handles manufactured homes and what is needed for it to be considered eligible property and we had everything that they stated and what is written in their website. Since this has happened the rates have risen a lot and that means $ XXXX of dollars and extra years of mortgage payments. We do n't fall under the HARP or other home preservation program that we are aware of because it was built in XX/XX/XXXX. My main issue is that Midwest stated on both their website and on the phone that they service manufactured homes yet after the entire process they inform us that they do not give mortgages for manufactured homes. We would n't have wasted XXXX months and all the hours of paperwork if we would have known this in the first place. We would have just refinanced with XXXX XXXX. Thank You

Our loan servicer, Midwest Loan Services, has applied a charge of {$760.00} to our home loan with XXXX XXXX XXXX XXXX XXXX. This fee was charged because our insurance provider dropped our earthquake insurance. We were unaware of the drop in coverage, but quickly re-established the coverage. On XX/XX/2018, I called Midwest Loan Service and stated that we restored insurance coverage. Our loan servicer has acknowledged that we restored insurance coverage, but that there was a lapse of coverage for two months. Our loan servicer stated that Midwest Loan Service will charge us {$760.00} for the lapse of two months. We complained that the drop in coverage was not because we did not have a lapse in payment, but because our insurance provider decided not to provide earthquake insurance for our area. I then emailed our bank, XXXX, and asked them to resolve this matter. On XX/XX/2018, I made another call to Midwest Loan Service, and asked for a supervisor. I demanded to remove this fee. Our loan servicer explicitly stated, " NO! '' I then demanded to reduce the fee to something commensurate to two months of coverage. The loan servicing supervisor explicitly stated, " NO, we will not do this for you! '' Please help us resolve this matter. Charging {$760.00} for a two-month lapse in hazard insurance coverage that occurred in the past is punitive. This amounts to over {$4600.00} annually. This is crazy!! Please help.

Hello. I hope this message finds you well. I write because in XX/XX/2020 I entered a covid forbearance plan. However, while on the plan with servicer # 1 I made payments of {$14000.00} and then made payments to the second servicer of {$16000.00} for a total of over {$30000.00} to both servicer out of the {$37000.00} total to be paid according to the statements rendered by both servicer. Unfortunately, I am unable to get out of forbearance because in order to do so, I must agree that I owe an additional {$17000.00} ( according to the partial claim delivered for my execution by servicer # 2 ). I am not sure why my past due balance is {$17000.00} when the difference between what I paid and what I should have paid is only {$6300.00}. I would have expected to find an escrow overage. However, I have just been informed that all that is left in my escrow account is less than {$3000.00}. I would very much like to exit forbearance but unless I agree that I owe an additional {$17000.00} that is not an option. I have asked both mortgage servicers to explain this discrepancy but rather than answer my direct questions they continue to send and refer me to payment histories which are not helpful in explaining this discrepancy. My insurance and property taxes are paid from an escrow account maintained by the lender. After receiving a notice from the insurance company that annual premiums had not been paid ( early XX/XX/2021 ), I notified the lender who deducted the annual premium ( {$2500.00} ) from escrow ( XXXX XX/XX/2021 ). Insurance company claimed they never received that payment and sent a policy lapse notice on XXXX XX/XX/2021 ). After a couple of weeks of going back and forth between the insurance company and lender, the lender deducted another {$2500.00} ( XXXX XX/XX/2021 ) from escrow and overnighted the payment, which the insurance company acknowledged receipt of. However, the lender is refusing to credit my escrow account by the original {$2500.00} and claim they will refund it when the insurance company returns the {$2500.00} to the lender ( insurance still claims they did not receive the initial payment ). This is an issue between the lender and insurance company any my escrow funds should not be in play in their dispute. I made a final attempt this morning ( XXXX XX/XX/2021 ) and was told the same thing - that the escrow department was supposed to issue a stop-payment on the check. I explained again that the funds should be credited back to my account regardless of the status of that check.

The mortgage company escrow dep. was supposed to pay our new insurance carrier for our home owners policy, they claim to have done so 4 times, each time the insurance company indicates they have not received the funds. We found the first 2 checks were sent with incorrect policy numbers despite me confirming the correct policy number the second time. Now the mortgage company keeps telling us they paid and when asked for calls back, and copies of checks front and back they claim they called and sent emails but we never received anything. The only time I received anything was when I had them send an email while I was on the phone with them. I have requested a copy of the back of the check they allege now was cashed on 3 sperate occasions and they said they would email the back of the check. I still do not have the evidence the insurance carrier is asking for so they can track the payment and match it to my account. I have spent hours on the phone making attempts to resolve the matter with out success and am disgusted that they keep telling me they call when they didn't and that they emailed us when we check our junk and spam and yet when we are on the phone it works fine. I refinanced my condo. the new loan is serviced by Midwest Loan Services. As was my old loan. I have never been late. Until, I paid my first payment on the new mortgage. I requested they add a homeowners insurance impound so the amount of the payment changed and I made two payments. I was off by XXXX cents. They were nice enough to call me right before a week- end and requested my checking account info for the XXXX cents. They said bill pay pay might not be in time. They say I gave them the wrong account info and they have a have recording, I have not heard it. IF I erred, I certainly do n't know where. I read I read the numbers directly from my check. Now they are charging me a late fee. While I 'm guessing this is legal, it 's also not right. I can not afford extra payments. I 'm a single mother of a XXXX and I have no otherfamily to turn to. It seems to be more than unethical, if not illegal. I tried to reason with them. It did n't work. I would like the late fee waived without affecting my " Once in 30 years waiver of a late fee. I recently paid off my loan in full after 6 years of condo ownership. Working with the company has been great. I believe I mistakenly paid late once during the period of my loan. The call center employees are very professional. In the last few weeks, I have been wishing resolution for my loan closure and my escrow refund check. On XX/XX/XXXX, you mailed my closing letter in full with the letter saying any applicable refund check would mail under separate cover. The next day, the XXXX, the check was mailed. On XX/XX/XXXX, I got the closing letter in my locked mailbox. It is common sense that two mailings a day apart would be received one day apart. It is now XX/XX/XXXX, a week after the first mailing. Your call center has told me several times that the check was mailed. No one can explain why the check has not shown up. I asked for them to cancel the check and they refuse to do it until 3 weeks after the mailing. I also was not told about their wire transfer option. Additionally, they refuse to waive the wire transfer fee if I cancel the check. It is 2022, and they dont have direct deposit as an option.

In the begininning of XXXX 2022 i made a payment on the online portal because this bank ( Midwest Loan Services ) doesn't send out statements or email notices regarding payments. I was given a confirmation that the payment went through however it never posted to my account but i never received a call or notice that the payment wasn't received. On XX/XX/XXXX i made an additional payment for the payment which was due on XX/XX/XXXX. i thought i was making the payment for XXXX but it was posting as the payment that they never received in their system for XXXX. on XX/XX/XXXX i called in because i went to view my online account and it was showing 2 payments being due. I made the 2 payments over the phone with the rep and that's when i finally found out they were showing me as 30 days late which was not the case. They had an issue with their computer system and my payment never posted. They don't send statements or give any updates on email etc about the account so i was completely un aware that the account was showing delinquient. This was an issue on their end and never once have i missed a payment.

On XX/XX/2023 l received a letter that no partial payments are accepted. I applied through the state of Florida DOE program and they are paying my mortgage. At the time l applied my mortgage was less {$47.00} but somehow my mortgage Escrow increased. Im not sure why and no one has explained. However, the state of FL DOE has made payments on my behalf and l was paying the difference. But now XXXX XXXX is sending the payments back and rejecting payment because its lesser {$47.00}. I have attempted to pay the difference but have been faced with the bank stating no partial payments will be accepted. This is absurd and l feel like the bank is trying to force my home into foreclosure by not accepting payments from the state and l pay the difference. They also have my cgecking account on file but are being very nasty. I may have to resort into taking them to court if no remedy is sought or reached. I feel they are being evil and nasty.

I XXXX XXXX, have been working with a housing counseling agency ( XXXX XXXX XXXX ) to resolve my mortgage arrears that occurred back in XXXX of this year. I submitted a modification packet through my housing counselor, and was offered a trial modification on XX/XX/XXXX. The three payment of XXXX were for the due dates of XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. My first two payments were sent and accepted, however the third payment ( sent prior to the first of XXXX ) was denied due to lender claiming that it was not received by the last day of the month. I am disappointed in the decision made by the bank and now have been faced with a XX/XX/XXXX sheriff sale of my property .I have made an attempt to resolve this matter to no avail. The lender Midwest Loan Servicing has now required that I submit new documentation, while not completely committing to the postponement of the foreclosure sale of my home.

Applied for mortgage furlough under cares act during my covid unemployment. Based on the request payment stopped withholding for Month of XXXX, XXXX & XXXX. Since I went back to work from XXXX, I have requested the payment to start with back withholding. The mortgage company still didn't collect any payments as of today XX/XX/XXXX. I have called them many times, worked with their loan officer. Finally got a payment deferral agreement, signed and returned back last month. They are still not collecting any payments ( due date was XX/XX/XXXX ) and it destroyed my credit score. I have been requesting them to start payment since XXXX and its XXXX And they have not collected any payments yet. My fear is getting foreclosed by them. I contacted Midwest Loan Services about my credit report. The reported status of my loan is incorrect. For one, l filed bankruptcy and the loan was never reaffirmed. So why is it still bring reported when they had previously halted reporting my credit to the credit bureaus. Then secondly, l was on forbearance and my payment was not due for the reported late payments reported to XXXX. I called last week about this and l am appalled at MLS because they are purposely doing this as l keep having problems which is ongoing. I want this corrected and my loan was not reaffirmed after my XXXX XXXX bankruptcy. They are in the wrong and l want this fixed. My credit already negative due to the bankruptcy and lm trying to rebound. Yet, MLS is not helping my situation as they are reporting in bad faith.

eOn XXXX XXXX , I called Midwest Loan Services , Inc . to get a payoff amount for my mortgage. They sent me a letter with instructions. On XXXX XXXX , XXXX XXXX , XXXX wired the payoff amount to Midwest. Since then I have called Midwest several times trying to get back the mortgage payment of {$890.00} that was " Transaction Date X/X/17 '' and Due Date X/X/2017 . On XXXX XXXX , I went to XXXX XXXX XXXX XXXX where I had gotten my mortgage to see if they could help me. They lady was on the phone for a lengthy period of time before she gave up and handed the phone to me and said good luck. I received email back asking to call, unable to reach them due to wrong extension. So left a XXXX Mail on operator 's mailbox. Several correspondence happened until XX/XX/XXXX when loan was placed on forbearance plan with a condition to suspend one loan and pay escrow on second loan. Within a week bank started reporting negative ( delinquency ) to credit bureaus despite state law to to report due to Covid19 situation. The mortgage servicing company for XXXX XXXX XXXX, XXXX, Az. failed to return excess funds at the close of escrow on XXXX XXXX, 2015. There appears to be a large accounting error and poor management oversight with our escrow account. The company Midwest Loan Service , Inc., failed to respond to therequest by the Title and escrow company handling the sale of our property. This failure has caused extra funds to charged via escrow at closing that were already covered in the escrow account. Also, they indicated that the property taxes had been paid to XXXX County, when in fact they had not! As of this writing, this company has not provided a proper audit or explanation of what happened to the funds accumulated in the account.

I purchased a home XX/XX/2020 and Midwest Loan Services funded the loan. Before the first payment was due they sold the note to XXXX XXXX to whom I now pay. The problem is that they have not reported this to the credit bureaus so I show 2 loans for the same amount on the same home doubling my reported debt and debt to income ratio. After a written request in XXXX that produced no acknowledgement or action I reached out by phone and spoke to someone who was rude and disinterested in helping to resolve a simple problem. I was dismissed with the explanation that It would be handled during the month of XXXX. It is now safely into XXXX and still no action.

My mortgage LTV is currently 77 % and the mortgage service company will not remove my PMI. They have sent a new letter stating I must have a 75 % LTV. Last year, when the LTV was at 79.6 %, I sent a written request to remove PMI and they denied my request but did not explain what specifically disqualified my request. This was a refi but I 'm not seeing anything in the rules making it different from an original purchase. If the law says PMI must be removed when I reach 78 % LTV, why can the mortgage service company keep charging me this fee?

As her daughter, I have tried to work with the lender ( Midwest Loan Services ) in regards to obtaining options to avoid the foreclosure so that my mother can keep her home. I was sent a packet by Midwest to complete and send back in which I did. They informed me they never received the package and will be proceeding with the foreclosure. We were never provided with a single point of contact and continue to make excuses so that they can proceed with the foreclosure.

They seem to think that when they initiate the call they are somehow not responsible to tell the consumer they are recording it. I have repeatedly called loan modification and told they are not able to talk to me. Per staff, they don't correspond or talk to customers. I guess they are too good for me or anyone. I called 40 times and nobody ever answers, it's a recording that is purposely used to hang up and say email they are too busy. Just utterly unprofessional but get agitated that this is upsetting and aggravates the customer. XXXX answers but can't talk to loan mitigation.

If an online payment fails to process, the ability to make online payments is immediately locked. At that point, your only option is to call their toll-free number to make a payment. I have not been able to speak to anyone for the entire month of XXXX despite spending repeated calls and hours spent on hold.
