In XXXX, I took out an auto loan with Midwest Acceptance. Shortly after taking out the loan, I lost my job of 15 years. I am only going to mention the foul and rude calls and harassment I received from the account managers at Midwest Acceptance. The XXXX XXXX XXXX XXXX did a news article on Midwest Acceptance that I am including with this complaint. When I lost my job, I entered into a payment agreement with XXXX XXXX and even though they were receiving and cashing my personal checks, they still initiated a garnishment. When I went to court with proof of the afore mentioned agreement, the judge refused to look at my documentation stating, I know this defendant and I know he would not tell you that. Now even though I search all Missouri laws and statutes I was unable to find where knowing someone trumped due process. As a civilian unable to find or afford an attorney to help, I was helpless to defend myself against this companies malicious and dishonest business practices. I have documentation that proves I paid over {$9000.00} towards this {$11000.00} debt. Why would the state of Missouri allow these people to continue to take this thing to court. Midwest Acceptance and their attorneys at XXXX XXXX and XXXX now say I owe a total of {$17000.00} on this debt. Why does the state of Missouri allow these types of business practices? What justifies them asking for and placing on my credit this large debt? This is the very basis of GREED in America. Please look into this company and its attorneys. I moved to Texas in XXXX. I notified XXXX XXXX and their attorneys at XXXX XXXX and XXXX that I moved to Texas. Over the past XXXX years XXXX XXXX and XXXX have unsuccessfully submitted wage garnishments to various Texas counties trying to garnish my payroll check. I would think that XXXX XXXX and XXXX, being attorneys, know the state of Texas does NOT allow these types of garnishments. The only approved garnishments in the state of Texas are for : past due IRS tax obligations, past due child support and past due student loans. If XXXX XXXX and XXXX know I am in Texas, why do they keep taking this to court adding egregious fees and interest when they are very well aware of the state I am currently residing in. This, to me, is just harassment and vindictive collection practices to ruin my credit and make my life hard. I am including copies that I received from Midwest Acceptance illustrating all the payments they have received. Times are hard for all Americans. In addition to that, I am a single mother of XXXX who lost EVERYTHING to Hurricane Harvey ( proof included ). I am here struggling trying to get myself together and rebuild and here is XXXX XXXX and XXXX and Midwest acceptance trying to rob me when I have paid more thatn 90 % of the original loan. It is disgusting to me the way that Missouri courts allow creditors to treat consumers which is one of the number one reasons I left Missouri. Please take a hard look at this attorney as well as XXXX XXXX. Imagine this, bulk cases being handled daily and attorneys developing biased relationships with judges. What justifies this type of greed?!?!?!?!? How do I owe {$17000.00} and the original loan was not even for that much AND I have paid more than {$9000.00} towards this? Does the state of Missouri want to see its lower and middle-class citizens ever get ahead??!?!? This attorney is only doing this to put money in his pocket. Why keep taking this to court adding attorney fees?

Today XX/XX/XXXX I received a call at my place of employment from someone who didnt share their name yet asked for mine. Seeing that we are a business I didnt seem to mind it and told her who I was. It was at this point the lady responded by saying, oh Im calling to verify employment for a XXXX XXXX in which I immediately said no we do not have anyone with this last name. She then responded back saying okay thank you and hung up without acknowledgment of who or where she was calling from. It was at this point I decided to verify the number she called From and came to realize it was a company called Midwest acceptance who I had financed a vehicle through back in XXXX, so I decided to Call them back and ask if the call was for me and not a XXXX XXXX. The lady then said for me to hold and put me through to another gentleman who was very unprofessional confirming that I was the reason for the call and almost immediately threatening garnishments. Now in the prior years I disputed these charges due feeling that I was lied to by the dealership and Midwest because of a car accident that i was not at fault for but left with a balance and no car due to not being provided or offered gap. Midwest and the dealership knew that this was my first time financing a vehicle and argued with me stating that the reason I was not offered gap was because I would not have been approved for the vehicle if gap was added. After one year of fighting I decided to go to this dealership and came to find they had closed their doors for good leaving me once again in the dark. Fast forwarding to XXXX while checking my credit report I had seen that their had been 2-3 collecting agencies assigned at different periods to collect this debt but without communicating was showing closed and written off as a loss which then made me believe that I was now going to be left alone as the damage to my credit had already been done. As for today not only was I lied to about who was calling and who they where looking for but was immediately intimidated with threats to garnish if I did not make a payment. I then explained everything about my discrepancies and that I had seen multiple debt collectors assigned but that this had gone away and written as a loss but was told that Midwest has never reassigned and that I was a lying. This then printed me to request my original signed documents so that I could dispute this once again but before getting off the call was told that I needed to make a payment or expect garnishment.

On XX/XX/XXXX a judgment was filed under case number XXXX from MIDWEST ACCEPTANCE for XXXX which included Principal, interest, attorney 's fees, court costs and process server fees. The first garnishment came out of my check XXXX XXXX XXXX on XX/XX/XXXX to XX/XX/XXXX totaling {$14000.00}, which that means they owe me the difference of {$2200.00}. Per case net it shows that Balance due as of XX/XX/XXXX was {$0.00}. After this judgment had been met including all the interest payments Midwest Acceptance and their attorney 's office came back on XX/XX/XXXX for a judgment amount of {$4500.00} in which they garnished out of my check on XX/XX/XXXX {$280.00} and will continue until this predatory collection activity STOPS! Also, they sent certified postal mail to an address we never lived at a day in our life XXXX XXXX XXXX XXXX # XXXX, XXXX XXXX, MO XXXX. This judgment was previously satisfied then when I called on Monday, XX/XX/XXXX they said it was interest payments however the interest was paid that was included in the original judgment amount. Midwest Acceptance is also garnishing my wife 's checks XXXX XXXX XXXX for the same vehicle when the judgment was previously satisfied by me, when she had a order of dismissal to dismiss without prejudice at Plaintiff 's costs. Also they never put in the system SATISFACTION OF JUDGEMENT BACK IN XX/XX/XXXX when the Balance had been met. My wife 's judgment was filed on XX/XX/XXXX in the amount of {$9600.00}, which also included Principal, Interest, attorney 's fees and court costs. This garnishment started on my wife 's check XX/XX/XXXX and so far has collected a total of {$800.00} now making the difference of what is owed to myself XXXX XXXX XXXX and my wife XXXX XXXX XXXX {$3000.00}. This is definitely predatory and they are not doing anything to stop collection activity. This has really been damaging to our credit and has caused punitive damages as well and we won't our money back and garnishment activity to cease. PLEASE HELP!! Thank you

I was late on my XX/XX/2018 & XX/XX/2018 car payments. Spoke with XXXX & XXXX on multiple occasions. Told XXXX someone would be making a payment for me, she was rude and asking who is this person and why are they making a payment for you. I told her that he would make half the payment and I would make the other half. XXXX then told me I had until XXXX XXXX to make the payment, she continued to call my job repeatedly thru out the days, then started to yell at me that this is their loan and I need to get it paid. I had to have my manager call her and tell her to stop calling my job. I then went to the XXXX to make a payment and she told me that I needed a bar code. I waited for the office to open and called to get the bar-cade, I spoke with XXXX. XXXX then sent the text and I told him the store was around the corner and I would go pay it. XXXX then called back an hour later to tell me I had not made the payment and said " we will hold this until XXXX XXXX the that's it ''. I returned XXXX 's call and he said I stated that I would pay in the next few minutes. I then told XXXX I never said that, I am at work and can not go out until my lunch break, he then began to get loud and tell me I had until XXXX to make the payment. I made the payment and am now seeking to take out a loan and pay the car off and never deal with this company again. I have been a great customer for over a year and half and have never been treated so horribly by a company representative like this in my life. It's amazing how they are so sweet when I am paying my car note 2-3 weeks early and the one time I fall on hard times they turn nasty.

For the past year, since XX/XX/XXXX, I've tried several attempts to call and get any information I can about this debt. I have talked to them twice. Once to let them know the vehicle was totaled, second time to call and resolve the debt. They said they would give information to my insurance company and my insurance company can let me know what is left to be owed. My insurance said that is not their job that they have no idea of the amount we owed left on the loan they could only tell us what the value of damage what and what the vehicle was worth. I've sent several emails, didn't get a response. I've made multiple phone calls which lead to being told, I didn't have an account with them, couldn't find my account, account was closed and due to being closed I couldn't make a payment. In XX/XX/XXXX I emailed and attempted to call to settle the debt in full and no luck. They have it on our credit report that it was settled in bankruptcy. We were discharged from bankruptcy in XXXX XXXX. We got our truck loan in XX/XX/XXXX so there is no way it could have been included in bankruptcy. Our credit lawyer brought this to their attention by disputing it and after 30 days we got no change or update in verification. We have never received any papers from them in the mail. Our insurance company has sent us all the paperwork and copies from them. Now they are taking us to court for refusal of payment, when they have refused our payment, refused our phone calls and emails to get information and the total debt owned to pay.

After several calls to XXXX XXXX XXXX XXXX XXXX XXXX and several voicemails left concerning confirmation of my car payments and remaining balance, on XX/XX/2018 I finally was able to speak with someone over the phone. XXXX XXXX, a very rude, and argumentative guy is who answered. I asked about my balance and he informs me of 5 months of payments here and there that were missed. I informed him that I have receipts for the payment, just not with me at the moment, ( as I was surprised they answered ). He did not understand why I was upset and told me he was still going to file a garnishment for my car, stating it is not their fault they did not receive the payment. What's so absurd to me is that the only way to make car note payments is by money order through the mail. This is not a safe method of payment, clearly, things can get lost in the mail. Most importantly I NEVER EVER have received not 1 confirmation of my payments since have bought the car. I would have NEVER agreed to the loan if I would have known the ONLY way to make a care payment was through the mail. Also following the rude call on XX/XX/2018, I received notification that XXXX XXXX XXXX has ran my credit/ SSN without my permission. This action was completely unauthorized. Which has dropped my credit score by 5pts. I plan to dispute this entire matter.

Midwest Acceptance is a predatory lending that has poor communication skills. I have tried to contact them on several occasions regarding my purchase. They are rude and disrespectful. I have filed a previous complaint the attorney general in XX/XX/XXXX. Since this has been done, they have made no effort to make an agreement with me to settle the balance. I have made payments that are not reflected on my credit report, and they have retailed against me by adding to my credit report that they are unable to locate me and sending to collections despite the voicemails that I left in an effort to an agreement. This account was written off 33 months ago and I have been patiently and desperately trying to get a response from the company. No agreement was ever offered to me. I was based and talked to poorly by the manager of this company. He stated " It is not my fault that you can't pay your bill, We have not pity for you '' before disconnecting the call in XX/XX/XXXX. Please investigate this company as they are not working within their rights. They refused to allow me to make any payments, and they are purposely trying to destroy my credit. I have been battling with this company for almost four years and yet to receive any results.

I got a loan from Midwest Acceptance in XX/XX/XXXX, and the vehicle was repossessed in XXXX. The account is showing open as of XX/XX/XXXX, however The account was open on XXXX XXXX. Information is inaccurate and defamation of character when I did not have that vehicle a text the beginning of XX/XX/XXXX. Secondly this vehicle was charged of & closed on XX/XX/XXXX, but is still reporting late payments and incurring interest. I called the office on XX/XX/XXXX & spoke to someone who was extremely rude and was threatened that they will keep reporting until the debt is paid off. The rep told me that the balance is incurring interest because i have not made a payment but thats not possible if the account has been charged off and closed. I Am asking that this account be closed and taken off my credit report as it is reporting inaccurate information, showing inquiries that i have not agreed to, charging interest on a closed & charged off account. This is grounds for removal

This account was opened in XXXX, the company Midwest Acceptance Reported the incorrect amount on my credit report and I fought this and the credit reporting agencies have removed this from my credit. Midwest Acceptance continues to do a hard inquiry on all the three credit bureaus without permission. Currently they have made inquiry as of XXXX XXXX, XXXX and XXXX XXXX, XXXX. I contacted Midwest Acceptance at XXXX XXXX on XXXX XXXX, XXXX and spoke with a XXXX man who was very rude on the phone, I explained about the inquiry and asked why they are checking my credit. He explained, I still have an open account with them. I have nothing listed on my credit from this company as a open, closed, charge off, or any other kind of reporting. I need this company to stop any access to my credit in any way shape or form. Thank you.

Midwest Acceptance Corporation is trying to recharge me for a car loan that has already been paid off. I appeared in court twice specking with Midwest Acceptance Attorney 's and showed proof that the car loan was paid off and I no longer owe them. However, I have another court date about this matter on XXXX XXXX, XXXX. Enclosed is a copy and proof that Midwest Acceptance Corp. no longer has a Lien on the XXXX Ford. Here we see that the names on the acceptance letter. They noted that the interest on the XXXX Ford was satisfied as of XXXX/XXXX/XXXX they also released us the title.

I have a past due charge off with Midwest Acceptance that is listed on my credit report as 'closed with balance '. My attorney and I agreed on a repayment plan on XXXX XXXX, XXXX that I would pay back loan as long as it would not negatively impact my credit. I am a co-owner of my daughters car. started to pay {$100.00} every month and I could n't for two months I tried to tell him that I am working again and I will pay {$100.00} every two weeks until I get caught up. He tells me that he did n't feel like doing a paper check every two weeks and if I did n't pay the full amount that he would garnish my check. I received a garnishment judgment on XXXX the XXXX. This year. From Midwest Acceptance. For a auto loan I didn't file for. They used stolen information. Mid West Acceptance Marked me late on my payment for A payment when I no longer owned the vehicle.
