On XX/XX/XXXX, our mortgage lender, Mid-Island Mortgage Corp., notified us that our hazard insurance was expiring and asked us to provide insurance information. When we contacted our insurance company, XXXX XXXX, to request information on our policy renewal, they informed us that our policy had been canceled on XX/XX/XXXX because our lender had failed to pay our premium out of our escrow account. We had been without hazard insurance due to Mid-Island Mortgage 's payment error, and they had not notified us that there was an issue. We immediately asked XXXX XXXX on XX/XX/XXXX to reissue a policy for us, which they did. The new policy was issued on XX/XX/XXXX. After repeated attempts to submit information about the new policy to Mid-Island ( including conversations with customer service representatives on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX ), Mid-Island acknowledged our new coverage and issued a check on XX/XX/XXXX to pay the premium on the new policy in full. However, on the check they cited the policy number of the canceled policy, causing XXXX XXXX to initially apply that payment to our canceled policy. However, XXXX quickly realized the error, applied the XX/XX/XXXX payment to our active policy issued on XX/XX/XXXX, and notified us of the error via email. We believed all issues had been resolved at that time. Yet on XX/XX/XXXX and again on XX/XX/XXXX, we received notices from Mid-Island Mortgage about our lapse in coverage from XX/XX/XXXX to XX/XX/XXXX. They insisted that we provide proof of insurance coverage during that time, or pay an insurance charge of {$1700.00} to them. I spoke with XXXX in the Resolutions Department on XX/XX/XXXX regarding this matter. She claimed that Mid-Island had issued a premium payment in XXXX, but said it was returned to our escrow account on XX/XX/XXXX. No one from Mid-Island had followed up on this return of funds at the time, or notified us that there might be any issue with the policy. I told her that I had documentation from XXXX regarding their communication with Mid-Island, which she asked me to send her on the communication portal. When I forwarded that information, however, I was notified that they were unable to open the PDFs, and that again I needed to provide proof of insurance coverage from XXXX or pay the {$1700.00} insurance fee.

Earlier this year I fell behind on my mortgage payments. For the past few moths I have been trying to work with the bank on a loan modification. First after receiving the letter that my application was complete and no foreclosure proceedings would be initiated, I received a letter from a law firm stating they were starting foreclosure proceedings. I mailed the law firm a letter as well as calling them and have not received a response. I have been submitting the requested documents as they ask. The documentation the bank has been requesting is repetitive in nature and they wast things explained that I have already explained. They seem to be dragging this out on purpose. I have been trying to contact someone at the bank without success. I have left voicemail messages and emails without any callback or reply. The only person I was able to get on the phone on Friday XX/XX/XXXX stated that they are not authorized to speak to me. However they were helpful in giving me phone numbers for FHA. The only contact I have have had with the bank is when they send letters asking for more documentation. The latest documentation they requested by letter was received by me in early XXXX and dated XX/XX/2019 giving me 30 days to comply. I sent the requested documents certified mail which was received by them on XX/XX/XXXX according to the postal service. Then, this past Sunday XX/XX/XXXX a strange man showed up at my house around noontime, banged on the door which frightened my wife and XXXX small children. I came running and found that it was a man stating that he was there on behalf of the bank to check the property and take pictures. This seemed like harassment or intimidation on behalf of the bank to me. In this day and age of more frequent home invasions and child abductions, this really frightened my wife. I have attached relevant documents, but this is not all the documents I have or have provided for the bank. I have sent the required forms as well as bank statements, pay stubs, spreadsheets detailing my families expenses, HSA tax form and document from health insurance detailing our high deductible plan. Our mortgage is with Mid-Island Mortgage Corp . On XX/XX/19 we received our Annual Escrow Account Disclosure Statement. The XXXX taxes had a RELEVY-PRORATA due to the purchase of the home and the four month balance of taxes because the prior owner had exemptions. Which added up to {$4800.00}. Increasing our taxes from {$14000.00} to {$19000.00} for the XXXX tax year. Which was paid. This is a one-time charge to cover the relevy. After talking with the Accessor office for Mid-Island Mortgage they asked for me to obtain a letter from the town showing the Taxes being paid and that it was a one-time charge. The Town Of XXXX sent a letter showing the amount, the taxes paid and stating it was a one-time charge. The mortgage company received the letter on XX/XX/XXXX at XXXX. Receipt reference # XXXX. On XX/XX/19 we called the mortgage company asking for a revised bill with the correct amount and they informed us that they will not make an adjustment because there system shows the taxes are {$19000.00}. Unfortunately common sense is not that common. They believe the taxes were raised {$4800.00} in a year and there is no thought of the exact amount of the increase is the same as the one-time RELEVY-PRORATA. We asked if we can make the correct payment on the mortgage till they figure it out and send a correct statement. They told us no and if we do, the funds would be returned and they will report it and cause our credit to be affected. We have reached out direct to the Mortgage provider and they tell us they cant do anything because we are dealing with their process center. Which makes no sense since they hold the mortgage and we are still the customer.

I refinanced my mortgage with another company on XX/XX/XXXX. Mid Island Mortgage Corp my previous mortgage company was sent the payoff for my mortgage and cashed the check on XX/XX/XXXX. On XX/XX/XXXX they took the automatic payment from my checking account of {$2500.00}. I called on XX/XX/XXXX and spoke with XXXX at extension XXXX she said she would stop and flag the payment and the money would be returned in three days. I called on XX/XX/XXXX and spoke to XXXX she said that the request to refund the money was refused by the manager and the payment was being added to my Escrow account and would be returned with that check usually in twenty days. I called three more times in the next 48 hours begging to give back my holiday money and was told it was my fault for not cancelling my auto pay. On XX/XX/XXXX I started calling again because I had not received my Escrow balance or my mortgage payment back yet. On their web site it showed the funds of {$9300.00} were released on XX/XX/XXXX. I called and messaged through their website for the past ten days every time being told to be patient and the check is in the mail. Today is XX/XX/XXXX I have not received the check and no-one from Mid Island has attempted to correct the situation. Every auto reply I get from my messages are the same " We automatically release funds in an escrow account sixteen ( 16 ) business days after the payoff. Generally, a check is issued and mailed within four ( 4 ) business days. '' Even with holidays figured in we are way past this time frame. My understanding of regulation XXXX says 30 calendar days not business days.

Mid Island Mortgage mistakenly submitted my loan for a short sale. This was not initiated by me and did not have my approval/consent. In this process they ran my credit and, to add insult to injury, charged me for the credit report. The only reason I found out about this was because I received a letter stating they needed more detailed information for my loss mitigation application, which I never submitted. In addition, I received a call from an appraiser requesting to make an appointment to come look at the property. When I called Mid Island to inquire about the situation, I was told if the letter did n't apply to me, then to disregard it. I was told this several times as I demanded more information about how this mistake happened. I finally was transferred to the loss mitigation department and had someone verify that they attached someone else 's short sale application to my loan. I was not informed that a credit report had been pulled until the charge appeared on my monthly statement. I take my credit very seriously and am taking steps to build my credit score. I understand that when a credit report is pulled, my credit score takes a hit. This is irrevocable damage and can only be cured with time.

My mortgage company ( Mid-Island Mortgage ) did not give me the 6 % allowed sellers concession by the FHA guidelines. They only gave me about 3.5 % even though it was agreed that the seller would allow up to the allowable 6 %. I been after them for over a month asking as to why and they would not give me a clear answer. I had to speak to the branche VP and he said something was wrong and he 'll look into. Had a conference call between myself, my attn. and XXXX XXXX ( branch VP ) he stated my cash to close was incorrect and was suppose to be XXXX dollars, when I paid XXXX dollars and said he 'll find out what happen as well as why I was n't allowed the 6 %. That was the last I heard from him. He has not returned my calls or emails for the pass 2 weeks. I had to come out of pocket last minute at closing to pay for the remaining closing fees, which I should n't have if they gave me the 6 %.

2 months after my closing, Mid-Island failed to pay my home owners insurance on time which I only discovered when my insurance provider sent me a Final notice before cancellation. That was since resolved after I frantically contacted anyone I could, including the loan officer, to have this issue resolved. As a result of the failed process of paying my insurance, I asked them to also check and ensure the tax payments, which were due around the same week, processed and were properly received by my town. At this time, the payments are now 6 months overdue and my property taxes are now in arrears and my name and property information appeared on my town 's Tax Lien Sale Bulletin this month.

I have my loan with Mid-Island Corp. My loan is FIXED The property Taxes and insurance are paid with the mortgage. The bank has increased my payments because they were left with an outstanding account, and the state of NY is charging them over {$4000.00} fine, and they charge me this amount in my monthly payment. Now my payments grew up from {$2400.00} to {$2900.00} They are charging me the late fees that the state charged them. That is not fair, I never pay late. I need help in this matter, and I want to know if you can help me.

I have recently made a XXXX payment to mid-island mortgage to bring my loan current. There is evidence to make me believe someone at the company is trying to rewrite my loan to get paid commission. I have a property inspection fee on my most recent invoice and have just received paperwork to modify the loan. Repeated calls to the company have resulted in hours on time on their automated phone system. I have no intentions of modifying the loan. Mid island mortgage is illegally trying to modify my loan and committing fraud.

On XX/XX/21 i made on online payment to mod island mortgage with an account set up with prior payments cleared. Mid island has acted as a predatory lendor by adding false charges and destroying my credit rating. The company has been contacted with their online chat and I was told they are allowed to do it?
