XX/XX/XXXX2019 I began having mechanical issues with the car and ended spending close to XXXX in repairs in which I sent the repair bills, pictures to Mid-Atlantic. XXXX XXXX, 2019. Legal Department, I am a victim of identity-theft. I am writing to request that you block all the following fraudulent accounts in my files with XXXX, XXXX, and XXXX. This information does not relate to any transactions I made. I did not authorize anyone to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim files an affidavit it shall be honored by all credit bureaus and all fraudulent information must be blocked within 4 days and proper notification shall be given to all furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The XXXX XXXX XXXX, Consumer Financial Protection Bureau, and Attorney General with legal action of your companys unlawful collection practices, misrepresentation of reporting inaccurate debts, and noncompliance to adhere to laws enacted to help who are victims of identity-theft. I request that an extend fraud alert be placed in my file explaining that fraudulent applications may be submitted in my name. Do not extend credit without first contacting me personally and verifying all applications. Furthermore, as victim of identity-theft I received notification that my personal information was compromise in the several different data breaches. It has made it difficult to resolve this matter in a timely fashion. I have made several attempts to resolve this. If action is not taken to properly assist me with this matter within 15 days. I shall file a class action lawsuit for violating the FCRA and FDCPA violations are as follows not limited to reporting inaccurate information, reporting information that resulted from crime ( s ) and/or crime ( s ) of identity-theft, unlawfully collections of debt, calling after designated hours by law, defamation of character, and misrepresentation of true credit worthiness. I ask that all fraudulent information listed below be removed without question. I have fraudulent accounts, employers, misspellings of my name, and address that are associated with crimes that were committed against me. Once deleting all fraudulent information, you acknowledge that it is indeed fraudulent and resulted from crimes of identity-theft. By doing so you adhere to the FCRA that make it unlawful of any, some, or all information to be transferred, sold to another collection agency or reinserted one 's credit report once it is deemed as fraudulent. You also understand in order to reinsert information to a consumers credit report notification must be given 5 days prior to reinsertion. Failure to comply will also be a violation of the Federal Fair Credit Reporting Act and Fair Debt Collection Practice. The below-listed accounts by the Original Creditors, who have reported these accounts within my credit reports, were not opened by me. I also did not give my authorization for anyone else to open these accounts. Someone else of who did these that I did not know. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of a such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. Finally, you are reporting the INQUIRIES that are the result of the same type of fraudulent activities. It must be noted that I did not apply for credit accounts with the below-listed companies and creditors, some of these are the result of attempts to open accounts, but the companies did not approve the accounts. Therefore, these inquiries must be deleted from within my credit file. You can not delete the fraudulently opened accounts without also deleting the fraudulent inquiries. It should be noted that an inquiry that was not made by me is not a factual record, just as a fraudulently opened account is not a factual record and not referred to the creditor to be disputed directly with them. The credit reporting agencies have attempted to address an inquiry as a factual record of file access, but if it was done through fraudulent means, it is not a factual record. As a consumer I should not be required to dispute each fraudulent inquiry directly with each company. These inquiries are the result of fraudulent activity and therefore, inaccurate in which the credit reporting agencies or the creditors can not verify, meaning that these inquiries are unverifiable information and must be deleted from out go my credit files. 1. MID-ATLANTIC FINANCE bal. $ {$3800.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity-theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity-theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. On Saturday, XX/XX/XXXX I went to XXXX XXXX XXXX XXXX at XXXX XXXX XXXX XXXX in hopes of purchasing a used car to replace an existing car loan that was seriously behind due to a few years of under and unemployment to be better prepared to start a new job in XXXX XXXX requiring travel. I explained my situation to XXXX the sales rep and he said he could help me as I had initially communicated with a XXXX at another location via online but not knowing it was in a different location. XXXX explained my situation to his manager and received the approval to offer car deals. Among the cars offered by name, I asked to consider at older XXXX XXXX offered although I did not want to spend additional money on increased gas usage but the numbers did not work with this because I needed the cheapest rate possible to get on my feet. After offering more vehicles, the manager came out and suggested a XXXX XXXX and of course to my surprise I thought I was being favored since it never entered my mind that I would possible get a XXXX that had a cute exterior being a woman. So when I saw the car I immediately jumped on it but XXXX pulled out the car and parked it again offering me a XXXX XXXX instead but after seeing the XXXX suggested by the manager I asked what was the problem with it. He then said it needed gas so he went to get money to put in gas and off we went to the gas station as he drove. After putting {$10.00} of gas in the car, he ( XXXX ) said oh this was the problem it needed gas, see how it drives so I just took his word for it. We returned to the dealer and completed paperwork and gave them a {$500.00} cash deposit and I had another appointment that I had to return to pick up the car with a friend. When I returned they had the key and paperwork ready and I got in the car for the first time. As I drove the car home, I noticed the engine and tire pressure light and I immediately called back to tell XXXX and he said to call him the next week for an appointment. I returned the car on that Tuesday, XX/XX/XXXX and XXXX said the technicians could look at it so I had to catch XXXX for {$10.00} home and to a call center job for the day and I returned by XXXX {$10.00} to pick up the car. The report was that the car was fixed so I drove the car home and the lights were off until I got home. I gave it another day but cranking the car became increasingly difficult after a few hours of sitting still and the lights were still on and I returned the car on Thursday, XX/XX/XXXX o take the car back to the dealership to have them look at the car again taking XXXX for {$10.00} to work. I sent a text to XXXX that I would come get the car on my lunch break between XXXX to pick up the car since I was not off until XXXX XXXX and they would be closed. I did not receive a response from XXXX so I returned to the lot to pick up my car via XXXX {$10.00} only to discover that the car was not there, it had been sent to another dealership for repairs by another mechanic which left me stranded without transportation since my ride left and the fee for a ride by XXXX had increased due to high demand and I did not have anymore money. So I had to call around to find a ride and call in to my job loosing out of pay since at this point I was very frustrated. Thankfully my friend XXXX who had accompanied me to take the car home the first on the XXXX was available to pick me up. When she picked me up she asked what was the problem with all of the back and forth since the reason you need a car was to get around and I have not been able to do this since getting this car. I explained the issues and she said to request another car since if this car needed this much work at the beginning this was not a good car to travel with for my new job beginning on XX/XX/XXXX. Being mild spoken and non confrontive she called the dealership to find out why do many trips back and forth and the desire to switch cars. She spoke to a XXXX, the manager and XXXX the salesman the conversation quickly escalated with the manager yelling how he did not have to do anything for me as he was just trying to fix it out of kindness. When asked to consider another car, he said no it doesn't work that this so if she doesn't the car they will just Repo it. At this point he hung up the phone and apparently all work stopped on the car and no communication was made to me. So I left the car there overnight and I returned Saturday morning to pick the car up to try to work with it. I took it to XXXX XXXX and had them put it on their machine and there were several things needed per the report for an average of $ XXXX and I just did not have any extra money for it is was the case, I could have just kept trying to work with my old car with payment arrangements at least there were not lights on. In the meantime there was a small crack in the windshield that the manager offered to fix and I was contacted by the repairman with an appointment scheduled for Friday, XX/XX/XXXX while at work that of course was obviously cancelled as well. So I had no other choice but return the vehicle which is what I did on Tuesday, XX/XX/XXXX @ XXXX XXXX when they opened. I parked the car on the side of the dealership 's office and placed the key in an envelope inside a thank you card that read " Thanks again, but unfortunately my budget can't afford the expenses associated with the car. Blessings, XXXX XXXX ''. I didn't even ask for the money deposit back, I just wanted out. I did not hear anything until I received a notice form Mid Atlantic dated XX/XX/XXXX with a 11 day notice. I called the company that I was unable to reach anybody in the department that dealt with my case but the general representative made a note on my account and said she would send an email that I did not have the unit. I received another notice in the mail dated XX/XX/XXXX and still could not get through to the department identified on the letter and I left another message that I did not have the car. I received another notice dated XX/XX/XXXX and I called again speaking with another rep who explained that they had the account noted that the unit was not in my possession but the dealership still had the account listed as open so it was affecting my credit and I needed to contact them to find out why. I did not make any attempts to contact the dealership as it was quite clear the goal of the manager was to ruin my credit and still hold me accountable for vehicle that I returned and was not in the best shape in retaliation. I don't want to fight, I explained my issue from the beginning and it was never taken into consideration.

Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). On XXXX/XXXX/XXXX, my vehicle was involved in a collision. As a result my insurance company deemed it a total loss. On XXXX/XXXX/XXXX, I received a debt collection call from Mid Atlantic regarding payment. I advised them the car had been totaled and that they should have already received communication from the insurance company. According to the representative they had not received any documentation from the insurance company at the time of the phone call. He then asked for the insurance contact information and claim info which I did not have at the time. I then received another call from them on XXXX/XXXX/XXXX about a payment. By this time, I had already contacted the insurance claims department who then advised me that they had already been in contact with someone from Mid Atlantic in order to discuss a settlement. After XXXX/XXXX/XXXX, the calls stopped but then on XXXX/XXXX/XXXX, one week after they had already been in negotiations with XXXX we received 2 certified letters via the USPS stating the vehicle was in repossession status as of XXXX/XXXX/XXXX ( please see attached ). We did n't even have an account with Mid atlantic on this date. The second letter was verbatim to the first with a different date. On XXXX/XXXX/XXXX I then log in to the account to see why we would receive this repossession notice when they are aware of the total loss. I noticed the account opens up with a delinquent status showing 18 days past due ( see attached ). It also shows that they received a check for a little over {$6800.00} from XXXX on XXXX/XXXX/XXXX. So why would the account still reflect a late status? At this point, I then called customer service and once my phone number was recognized, I received the automated " this is an attempt to collect a debt '' message before speaking to a rep. once the rep came on the phone I asked about the delinquent status showing after they received payment from XXXX, she then transferred me because she was not able to answer the question. Once transferred, I asked about the status of the account. I was told by this representative that there was still a balance on the account and it will continue to accrue " late days '' until the balance is paid. I then asked why GAP insurance coverage had not been applied to the remaining $ XXXX balance. She advised me that it could take 30-60 days for them to receive payment from GAP. I then asked, are they going to report this negatively on our credit if it reaches 30 days and she stated yes. I asked how could they do this knowing we have GAP coverage and we were n't notified of any settlement offers and balances. She could not explain this to me. I also asked for the information to the GAP and she provided me with a company named XXXX and a phone number of XXXX. I called the company and was told that I did not have an account with them and to clarify with my lienholder. Once I tried to call Mid Atlantic back I was transferred, placed on hold and then disconnected. After trying to resolve this with them several more times, I finally had to call my original dealership to get the correct GAP company. They provided me with information to XXXX. I contacted XXXX on XXXX/XXXX/XXXX and was told by the claims department that as of XXXX/XXXX/XXXX, there was not a claim filed on my behalf by Mid Atlantic. He proceeded to tell me that once a check is issued to Mid Atlantic from XXXX the document time line starts for the claim to be processed. I advised him the check was issued on XXXX/XXXX/XXXX and was told that it would be in my best interest to get the claim started so that we do not run into any delays of processing. Not only did Mid Atlantic falsely represent seizing my vehicle by sending a legal binding certified document that states " repossession '' with an invalid account date, they also lied about my GAP coverage and the time frame of receiving payment when they had not even filed a claim yet. By them delaying communication and filing a claim with GAP coverage ( XXXX ) they are allowing the " late days '' on a payment to accrue thus resulting in a negative credit impact.

NONE OF YOUR " MY LOAN IS A '' below apply to this situation! This was a car loan but the company is providing fraudulent information this is damaging my credit! RE : MidAtlantic Finance Company Account No. XXXX - NOT TO BE CONFUSED with my current MAF loan MidAtlantic Finance Company has reported several false items to all XXXX credit reporting agencies, and continues to do so. It is damaging my credit so much so that I was told I did n't qualify for a mortgage. Most recently, I settled this account per agreement on XXXX XXXX, XXXX, yet MAF reported it is a payment on the amount claimed owed ( which has been disputed since XXXX XXXX ). But that is just the most recent false information that was reported. It is showing a debt of {$250.00} per month along with XXXX different amounts charged off of the {$950.00} ( plus interest ) and another {$5100.00} that INCLUDES the {$950.00}. Please refer to the following as I NEVER owed MAF {$8100.00} as it reported. That was the original amount financed in XXXX XXXX with XXXX XXXX, and I made payments of {$250.00} a month through XXXX XXXX to XXXX XXXX. 1 ) Car was purchased in XXXX XXXX and was financed IN HOUSE until XXXX XXXX per MAF 's statement of XXXX XXXX, XXXX, with my first payment being due to MAF XXXX XXXX. Therefore, I was not responsible for any prior late payments ( MAF recorded my first delinquency as XXXX XXXX ) and that should never have been on my credit report. I do not know why or HOW it can be considered owned by MAF since XXXX XXXX. 2 ) There was NEVER a charge-off of {$5100.00} for the following reasons : a. Car was totaled XXXX XXXX, XXXX. I paid the {$250.00} XXXX payment plus additional interest fees on XXXX XXXX, XXXX. The insurance company paid {$4200.00} on XXXX XXXX, XXXX, leaving a balance per MAF of {$950.00} ( disputed since XXXX XXXX ) ; b. I was given a payoff in XXXX XXXX of {$5200.00}, with no expiration date, so I disputed the {$950.00} for 18 months before giving up. Finally, MAF sent me the accounting in XXXX XXXX, which supports my claim of payments made and wrongfully charged-off amounts. 3 ) On XXXX XXXX, XXXX, this account was PAID IN FULL per MAF 's own letter dated XXXX XXXX, XXXX, yet MAF did not comply with the verbal agreement with its representative XXXX XXXX to remove negative credit AND it applied the {$500.00} as a payment toward the ( disputed ) balance owed rather than showing Paid in Full. I submitted ( via certified mail ) a request to validate a debt from MID ATLANTIC FINANCE COMPANY, in regards to the fraudulent account that is being reported to creditors. Per the FAIR DEBT COLLECTION PRACTICES ACT, I have the right to request and receive validation of said debt. Therefore, I asked MID ATLANTIC FINANCE to please provide me with a copy of all the following : 1 ) An explanation of what this alleged account balance is for. 2 ) A calculation of this balance, including the complete payment history on this account, so I have proof that the amount is correct. 3 ) Documentation that shows I agreed to pay this debt with my signature. 4 ) The Agreement that grants you authority to collect on this alleged debt. 5 ) A copy of your state license, including license number that give you rights to collect in my state. ***This request arrived to MID ATLANTIC FINANCE on XX/XX/XXXX. This is the tracking number for the mailed dispute : XXXX. The fraudulent account in question, is MID ATLANTIC FINANCIAL ( Auto ) *** MID ATLANTIC responded to my request via USPS mail on XXXX XXXX. MID ATLANTIC presented documents from XXXX XXXX XXXX, including a Retail Installment Sales Contract, and the Loan Payment History. Upon review of the Retail Installment Sales Contract I found several blank signature spaces, as well as a forged/misspelled signature of my name. MID ATLANTIC claims to be the assignee, however both the ASSIGNMENT, and THIRD PARTY AGREEMENT sections of the contract, are blank, lacking both signatures and the assignee information ). There is also a NOTICE TO BUYER section, stating for the buyer to NOT sign the contract if it contained any blank spaces, this further strengthens the fraudulent allegations against this account. Furthermore, after inspecting the Loan Payment History document, I see that there is a big lapse in payment reporting. The Retail Instillment Sales Contract lists the VEHICLE SALE DATE as XXXX, however the payment sheet provided by MID ATLANTIC FINANCE states the first payment date as XX/XX/XXXX. Moreover, the payment sheet only displays partial payments beginning as of XX/XX/XXXX. The vehicles payment amounts are not listed in full, and there is no complete record of any transaction. These discrepancies, amongst others further supports my claim against this fraudulent account. Also, the presented contract from XXXX XXXX, lists the questioned accounts address as : XXXX XXXX XXXX XXXX. This was a previously disputed address on my credit report, which was successfully removed, as a result of identity theft. This attempt at a doctored contract further supports my claim. I have attached pictures of the presented contract, please pay close attention to the blank signature areas, as well as the forged XXXX XXXX signature. I have also attached a copy of my drivers license to compare the signature in question. MID ATLANTIC FINANCE was not able to provide me with an honest validation of this debt, neither were they able to provide me with the additional documents that I requested. I have an auto loan through Mid-Atlantic Finance that is due every two weeks for payment. When I initially received documentation that this company had bought my loan from the dealer I originally got the car from, my payments were due every two weeks. I am paid on a set schedule and have explained to this company that very fact. I recently fell behind on my payments to due financial hardship and other factors such as change and pay as result of company outsourcing. I contacted my finance company to inform them of what had happened and set up a payment arrangement with " XXXX XXXX '', who is supposedly my account manager. She stated on a recorded line that per the agreement for XXXX, I had to pay {$1000.00} to " Secure '' my account. Well, I did just that with a payment on XXXX of {$300.00} a payment on XXXX of {$500.00} and {$280.00} on XXXX. So, I called Mid-Atlantic this past Thursday to inform them that I would like to set up payment arrangement for my auto loan for XXXX as of the end of this month, I still owe a balance that is past due. The initial representative laughs and states that I am still past due, places me on hold for ten minutes and cold transfers me to my " account manager '' who states to secure the account, {$1000.00} has to be paid on the account for XXXX ... If I am not mistaken, the payments that have been made and posted total {$1000.00}. XXXX blatantly states that I had to make a payment of {$200.00} to satisfy the {$1000.00} for the month of XXXX to " secure '' my account from repossession status. I have done my research on this finance company and did not choose to have them purchase my loan. After clearly stating my situation, being assured that a resolution could be attained without repossession, I feel that this company and it 's morals are out of sync with XXXX another. I simply stated that I would like to pay $ 450- {$550.00} on the XXXX and XXXX of XXXX so that my ending month 's balance would be under {$220.00} as I am currently under by {$760.00} at the moment with payments due every two weeks of {$280.00} ( and then {$290.00} if received late ) and by XXXX XXXX, have my balance at {$0.00} after {$550.00} payment on XXXX XXXX. As you can see, I have calculated with my current salary of {$13.00} an hour from {$10.00} from XXXX XXXX - XXXX XXXX what I can pay aside from rent, car insurance, etc. I have made this XXXX person aware of my current pay and what I can afford to pay every two weeks to ensure I have a vehicle to get me to work. At this point, I do not know where else to turn. This company calls every day stating I have to call them back by the end of the business day and even does so while on payment arrangements. Is this legal? I mean, I understand that my credit is not superb or else I would have had a finer institution handling my account however, I am still human and this does n't seem legal to demand payment from me after the amount needed to " secure '' my account has been made. XX/XX/XXXX I signed paperwork at XXXX XXXX of XXXX for the purchase of a vehicle, the Sale Price of the vehicle was {$9000.00} financed through XXXX XXXX XXXX. I gave a {$1500.00} down payment to be applied to the Sale Price of {$9000.00} to bring the Sale Price to {$7500.00} for the purpose of lowering the amount financed. I was not notified that I could opt out of a credit check and was told it was necessary to get the vehicle. Around XX/XX/XXXX I received a call saying the financing wasn't approved and I should come back to sign new paperwork. On XX/XX/XXXX I signed the new paperwork with a new finance company XXXX XXXX. At this time the Sale Price of the vehicle changed from {$9000.00} to {$9700.00} Around XXXX of XXXX I was behind in payments, I received a call from collections asking where the car was and that they would call the cops for grand theft if I didn't pay. I asked them to please provide me with a billing statement and they refused. XX/XX/XXXX I came across some information which raised some questions. I called XXXX to ask a few questions about fees and finance charges. The representative told me that XXXX doesn't come up with any numbers on the Retail Installment Contract and I should call XXXX XXXX of XXXX, the dealership I purchased the car from. I called XXXX XXXX who then told me that the XXXX, XXXX XXXX comes up with all the numbers on the contract. So, I called XXXX back who redirected me back to XXXX XXXX, who then redirected me back to XXXX. I still have no answer. I asked for a copy of my full contract from XXXX, they only sent me XXXX page and that was the Retail Installment Sale Contract. XX/XX/XXXX I called XXXX to get the full copy of the contract. The XXXX XXXX told me it was sent. I informed her I only received XXXX page and I need the full contract. She then complained that it was a lot of paper and asked " what do you need it for anyway ''. I told her it was not her business, I just needed a copy, she then proceeded to get rude and said " call the dealership and get it from them ''. I then asked her if she was refusing to give me a copy of my contract and if she was I may have to get a lawyer involved. She then got really upset and yelled at me that she was " ending the call '' and to " call back when you have your lawyer ''. As I'm reviewing the XXXX page XXXX sent to me via email. I noticed there was a stamp on it that read " The within instrument or agreement is pledged as collateral to XXXX XXXX Bank, XXXX. '' I called XXXX XXXX to see if they have done any business with XXXX XXXX, I was told no and that they don't have any Title in my name nor is the VIN number in their system. I call XXXX XXXX back to ask what the stamp was and what does it mean. The same XXXX XXXX mentioned earlier said " The owner of the company took out the loan and paid the dealership so I can get the vehicle '' and that XXXX XXXX was their lender. I then emailed them for further clarification and they emailed me that same statement and added that there shouldn't be any questions about anything. To sum it up. I never got any questions answered or any problem resolved.

In XXXX of XXXX, I was in a car accident in which my car was totaled which necessitated the purchase of a car. I purchased a car from XXXX XXXX ( XXXX XXXX ) and the original finance company was Mid-Atlantic Finance. I made the payments through the year. In XXXX, I went into the office while visiting my brother in the area. When I did I was asked to contact XXXX XXXX because they had not received the title. After returning to XXXX, I contacted the dealership who explained that they had decided to pull the financing back from Mid-Atlantic and I would be making payments at the dealership. On XXXX XXXX, XXXX, I signed a new contract with XXXX XXXX. Within two weeks, the contract was sold to XXXX XXXX and I began making payments to them. At this point I thought everything was fine. I received an email from XXXX XXXX at Mid-Atlantic Finance stating that my account was seriously delinquent and that I needed to pay {$2000.00}. Upon contacting the company, I was informed that the car was up for repossession if the account was not brought current. I explained that I was making payments to XXXX XXXX. I was told there was no information about that and the car could be repossessed. I was upset by the conversation so I contacted the original dealership. When I told XXXX XXXX of the conversation he explained that Mid Atlantic was not the legal lienholder on the car and they have no legal right to repossess the car. On XXXX XXXX, XXXX, I had XXXX on my shoulder from the car accident in XXXX. On Monday, I was supposed to go to my post-op appointment and discovered, upon taking trash to the dumpster, the car was gone. I received a notice on XXXX XXXX, XXXX regarding the repossession stating that I had 45 days from the date of repossession to get my belongings from the car. I was finally able to get to the yard where the car was supposed to be on XXXX XXXX, XXXX. When I arrived there, the person who was supposed to meet me was not there. I waited for two hours when someone finally arrived, I was told the car was not there. My belongings were in a shed, though I do not believe I got all my belongings from them. I went to XXXX XXXX and spoke to XXXX. She gave me copies of documents showing Mid Atlantic Finance application for a duplicate title, marking through XXXX as the lienholder, a DMV report from XXXX XXXX, XXXX showing XXXX as the legal lienholder. XXXX also had information regarding the car being removed from XXXX on XXXX XXXX, XXXX. I filed a report with XXXX XXXX Sheriffs Office case report XXXX XXXX. Since the report has been closed and deemed a civil matter. It was explained to me be one of the detectives that for a car older than six years, the company was obligated to provide 30 days in which the consumer could retrieve the car. They did not have the documentation from the clearing house which shows the date the car was removed from the tow yard. My attorney contacted the clearing house and they provided the information showing the date the car was removed from XXXX.

I am writing to formally dispute a negative account that is currently appearing on my credit report. The account in question is attributed to Mid-Atlantic. I believe that this account is inaccurately reflected, and I kindly request its immediate removal from my credit report. In support of my request, I would like to reference specific provisions within the United States Fair Credit Reporting Act ( FCRA ) and the Fair Debt Collection Practices Act ( FDCPA ). FCRA - Fair Credit Reporting Act : Under the FCRA, it is stipulated that consumers have the right to accurate and fair credit reporting. Specifically, section 611 ( a ) ( 1 ) ( A ) of the FCRA mandates that credit reporting agencies must ensure the maximum possible accuracy of information contained in consumers ' credit reports. Any information that is unverifiable, incomplete, or outdated should not be reported. Furthermore, section 609 ( a ) ( 1 ) of the FCRA grants consumers the right to request and obtain a free copy of their credit report once every twelve months. In accordance with this provision, I have obtained my credit report and have identified the inaccurate information attributed to the Mid-Atlantic account. FDCPA - Fair Debt Collection Practices Act : Although the FDCPA primarily regulates the practices of debt collectors, it can still be pertinent in this context. I received notification recently of a 30 day delinquent reporting on my credit which resulted from the company that I financed my vehicle through. I immediately contacted the company in efforts of resolving this matter as I knew I had not been delinquent on my car payment recently as I'm working towards rebuilding my credit after losing my mother and being in/out of work as her caretaker. I spoke with countless representatives who stated that my account was reported as delinquent because of a deferment granted back when my mom was living and the loan was not satisfied so the account was reported 30 days delinquent. I had no understanding of this scenerio provided and advised several associates that this was very deceptive as if this was the case I would have never agreed to the deferment to begin with. After speaking with several reps, I finally called back and spoke with with XXXX XXXX XXXX who appeared to be very understanding and stated that she saw the deferment and maturity date had nothing to do with the negative reporting and she saw that my account had been paid timely for the past year at least. She stated that she would research further and follow-up with me. She asked that I send her the reporting as received from the alerts set up to monitor my account. I quickly complied and after sending the documentation. XXXX responded and stated that all recent reporting was accurate and that the XX/XX/2021 payment was delinquent and sometimes the updates are delay. AFter providing XXXX with my payment history as shown on their website as well as confirming that my payments are due on the XXXX of each month and the XXXX payment was made on XX/XX/2021 using two debit cards and should not have been reported as 30 days delinquent. This adverse reporting has hindered myself and my family from being able to move forward in the marketing to purchase my first home and gather back the pieces of my life since the passing of my mom. I'm asking that this be assessed and updated immediately. I had emailed the company and XXXX but I'm being asked to file a formal dispute instead of making the adjustment to avoid this type fo escalation. I am writing in reference to our auto loan that was bought by this company in XXXX XXXX from a local buy here pay here dealer. We were told that the terms of the contract would remain the same and it was just a transfer. Our loan terms indicate that we make a payment on the XXXX and the XXXX of each month in the amount of {$140.00} ; however XXXX calls us every other week claiming a payment is due. From XXXX to the present date of XXXX XXXX, XXXX we have received over 30 collection calls from them as well as written correspondence. These calls were not warranted and have no merit based on our original contract signed by us. I have called midatlantic twice to request a copy of our terms and contract and was told that it 's the same as whatever I signed with the dealer but they still have not provided me with a copy. The only information we received was them informing us that they bought our loan. If in fact the contract is the same then we should only have payments due on the XXXX and the XXXX and not every other week as they are saying in their collection calls. Additionally we had a 10 day grace period to make payments without any penalty but this has not been honored as their system is not accurately showing our payment due dates. This is predatory and harassing to repeatedly call customers before the payment due date and every single day following. My most recent collection call was received today XXXX/XXXX/XXXX, one day before the payment is due and this has been going on for months now. When I tried to explain to the rep my concern he stated their system was not showing payments were on the XXXX and XXXX and he would get a supervisor to review it. My daughter bought a car from a buy here pay here lot called XXXX XXXX XXXX in XXXX, TN. in which I was told that I should sign on so that her payments and insurance would be much lower. After having the car for approximately XXXX weeks I began to get collection calls from Mid Atlantic Finance. I explained to the representatives that I did not have a contract for a automotive loan with them and neither did my daughter. After that my daughter and I began to be harassed by phone continuously. No contracts where ever sent to me or proof that they owned the car or car loan. They also stated that all payments had forwarded to Mid Atlantic and we should not be behind at all on the payments. Approximately a week later our daughter went to stay all night with a family member. The vehicle was pulled into a gated and locked fence on the property, but when she got up the next morning the gate was cut open and the vehicle was gone. When the police was called they told us the vehicle was repossessed by Mid Atlantic Finance Company and that we should make contact with them. When we contacted them we where told the car was already taken to the car auction in XXXX, TN. and would be sold the next day. We have only been contacted once since then with a letter telling us that we still owed approximately {$4000.00}. I have requested by certified mail a copy of any so called contracts they have or for them to remove this debt from both my and my daughters credit reports. The finance charge shall not include fees and amounts imposed by third party closing agents ( including settlement agents, attorneys, and escrow and title companies ) if the creditor does not require the imposition of the charges or the services provided and does not retain the charges. Examples of charges which are included in the finance charge include any of the following types of charges which are applicable : As you can see above there are no exceptions and/or in the law. The law simply states that finance charge should not include any comparable cash transaction which was the down payment. I paid my car in full XX/XX/2021 with Mid Atlantic Finance. My payment in full was made a month early the supervisor that took my payment advised me I would be recieiving a paid in full letter along with payment receipt that reflects a XXXX balance. She then explained I wouldn't be able to recieve those documents right then due to processing of the payment which would take 3-5 business days depending on bank, I used my debit card on file that is set up for automatic withdrawal that payment cleared almost immediately. However come Monday XX/XX/2021 I still havent recieved a email from the supervisor or anyone associated with Mid Atlantic I have called over 5x today, spoken with 3 supervisor that were EXTERMELY RUDE, they were not helpful and never sent me any emails even after repeately telling me I would after 5mins. I called back for the 6th time to finally speak with a supervisor that actually sent an email with an attachment however the attachment was nothing more than my payment history something I could see on the app The payment history still shows my monthly installment due to XX/XX/2021 nothing indicates the car is paid off. The supervisor did explain it would be 30 business days before I recieve my title, I have no problem waiting 30 business days for the title but i do have a problem waiting 30 days for paid in full letter or copy of reciept that reflects it was my last payment I am running into issues trying to trade in my car because it's simply showing I am still responsible for a payment and my car isnt paid off. This is a medical bill that was sold to a bill collector, suspect representatives, XXXXXXXX XXXX XXXX XXXX XXXX XXXX bought this debt and sold to another collection agency, who sold the loan again to mid XXXX. I have written to Mid-Atlantic Finance Company about providing me with a copy of any viable evidence bearing my signature showing the account is being reported accurately to the credit reporting agencies. On XX/XX/2016, I received a letter about what I had asked for, then I preceded to wait til 31 days to see if they would provide a " notice of dispute '' to the credit reporting agencies like the law requires them to do so. When I checked my credit reports, they have not provided the statement that I had disputed the item directly to them by letter. They were suppose to place the statement that I had " disputed by consumer '' in the remark area on all the credit reporting agencies. They have not done a thing and it 's been over 30 days. I sent them another letter saying they have violated the federal law to place a Notice of Dispute to all the credit reporting agencies within 30 days time frame. They have violated the FCRA. My letter clearly says to them that all they have to do is remove their company 's name and the negative remarks off my credit report on all the credit reporting agencies because they have broken the law and I will not decide to take them to court. I also let them know that I was going to report them to this website as well. Since they violated the Federal law I wanted them to know that I was going to take them to court in my area and I was suing for {$5000.00} in damages for the following : defamation, negligent enablement of identity fraud and violation of the FCRA. They still have not place the notice of dispute on my credit reports. Two days after I left the dealership the bank called me and told me I owed {$24000.00} and my payments were at {$600.00} a month. I immediately called the dealership and told them I didnt know what kind of crooked games they were playing but that I wanted to return this truck and get mine back. They then told me the truck was already sold at auction and that I could just return their truck and be left with nothing. I asked the bank to send me their financial papers and everything is different then the dealerships by thousands of dollars. Even the interest rates arent the same. The down payments, total amount for truck, sales price, monthly payments, nothing is the same. Oh and the total amount they are expecting to receive for this truck to be paid off is {$33000.00} dealer total and {$34000.00} bank total including price for down payment. I went to a car dealer lot and got ripped off for XXXX the car and my down payment. The way to resolve this is to give me back my money for the down payment and remove it from my credit. I am a victim of What I now know as a " BUY HERE PAY HERE '' scam. In XXXX, I paid a {$2500.00} down payment in purchase of a XXXX XXXX XXXX car from XXXX. Signed all the documents with the agreement that I 've been financed in house ( Meaning there is no third party financing involved ). ( This is common practice with MID ATLANTIC FINANCE as I found out in several online complaints ). I contacted XXXX and the owner stated " they will receive payments from you for now ''. I made payments to Mid Atlantic finance monthly, and still got payment reminders to be sent to XXXX. Very confusing. A couple of late payments were as a result of this inconsistencies. However, on XXXX XXXX XXXX, I was in a car wreck and the automobile was no longer drivable. I contacted XXXX and notified the owner of the accident. The balance of {$2500.00} cash was paid to an employee of XXXX who usually receives payments. I got a call from Mid Atlantic finance about an outstanding pay off amount. I explained to the representative that it was paid to XXXX to which she said it was okay. To my surprise, this negative item remains on my credit report as an unpaid balance. This is not accurate and is damaging my credit file. i purchased a car from this " dealership '' in XX/XX/2021, the day i purchased the vehicle the check engine light came on, i alerted the dealer immediately and he assured me he would fix the problem. Over the next 3months i had to take the car back and forth to the dealership and each time he claimed the mechanic was fixing my car and it was never fixed. the car broke down on me in early XXXX, i got a ride to the dealership to talk to him about what happened and instead of having the car towed from my house he sent an employee to my home to put water in it and drive it back to the dealership. about 3 days later he called me and assured me the car was ready and fixed and he alleged he had taken my car to a XXXX dealership to be repaired, when i asked for an invoice or diagnostic paperwork from him he could not produce it. after driving the car get the back home it broke down again in a parking lot. On the evening of XX/XX/XXXX, Mid-Atlantic repossessed my vehicle at 47 days past due. I did not receive any written notification, voicemails and only received 1 email in regards to this issue. My vehicle was purchased in XXXX, from a buy here-pay here dealer ; however, my loan was sold to Mid Atlantic financial a year later without my knowledge. I have made every payment within a 30 day window since my loan was sold to this company and this is the first time my loan has gone this past due. There are a number of issues regarding this repossession, the first including that the tow truck driver came into a public establishment, and announced that my car was taken from in front the building. The lack of communication, and customer loyalty is astounding. After almost 2 years of timely payments, my vehicle was taken without due notice or any consideration for me as a consumer. I attempted to contact the company on XX/XX/XXXX at XXXX XXXX and XXXX XXXX, and was given little information regarding this repossession. After speaking with two representatives, I asked to speak with a supervisor, but was left on an extended hold that ended with my call being disconnected. As someone who works in the finance sphere, I understand that it's my responsibility to adhere to my contractual obligations, but I do not agree that this was done fairly or at a reasonable time period - given the industry standard is 55-60 days past due.

I sent Mid ATL fin a certified letter to the address on my credit report on XX/XX/XXXX. It was returned to me stating invalid address. I then researched the address to find another address in FL to resend the letter via certified mail. If no such proof is provided within 15 days from receipt of the letter received. I bought a car from a buy here pay here place in XXXX Ky. The dealership sold the loan to Mid Atlantic Finance in XXXX Florida. I was contacted and told the agent at the time, that the payment is due on the XXXX of each month, but not past due until the XXXX. I told them not to contact me unless the payment is past due and they agreed. They contacted me as a " Courtesy Call, '' on the XXXX to let me know the bill was going to be due on the XXXX. I told them not to do that again. They contacted me the next time on the XXXX, and told me the bill was late, and if I didn't pay I would be charged extra fees and my credit would be affected. I bought the vehicle at a buy-here because I am going through bankruptcy at the moment and needed a vehicle to replace one I lost from voluntary repossession. I again told them to not contact me at all. So the next month, they called my WIFE and demanded that she tell me to make my payment, on the XXXX. Then they contacted her on the XXXX. Again, I called and told them to no longer call me, at all, period. I followed this with an email. They just contacted me again, on the due date, not the late date, to demand I pay. i purchased a vehicle from a buy here, and my loan was sent to Mid-Atlantic. and apparently in the loan agreement I could n't have a bad payment within the first 90 days or I would terminate my loan. needless to say life happened and my account was XXXX dollars short so my bank returned payment. the next couple of days the dealership calls and says do n't make a payment with them they are going to take back the car for the bad payment. he then goes to say with the next couple of days they are making me buy back the car. so I am out of XXXX dollars so I need my car back unless you can bring me the car. does n't sound right so I call the finance company and they first say yes the dealerdid buy back the car make the payments with them. I call again and another manager says no your account is active and you still should pay us. but if the buyback is in process you would then have to talk to dealer about the payments. I let the finance company know that I traded a 2006 truck for the 2006 Honda civic and what happens to my trade inif my deal is no longer any good. she goes well its up to the dealership if they give you back the trade in or not. and I feel as if I am being ripped off. here. because I also paid my tax tag and title up front to the dealership.

This account has tied two addresses to my credit report, that are not related to me as well. On the date XX/XX/2019, I did a consumer credit transaction with XXXX XXXX XXXX dealership and extended my credit with a finance charge through Mid Atlantic Finance. I'm the original creditor extending my credit using my credit card ( SSN Card ) pursuant to 15 USC 1602 ( L ) but the creditor fraudulently financed me a car through this process. Pursuant to 15 USC 1605 ( a ) the finance charge which was included within my credit transaction should be the sum of all charges. Mind you the finance charge is a total of {$3500.00} exact but this dealership and Financial Institution gave me a total sale price of {$13000.00} ( see attachment for Exhibit A ). That is a total of {$10000.00} charged over the sum of all charges which is inaccurate and unfair credit card practice that utterly goes against this subchapter of the TILA ( Truth in Lending Act ). The finance charge section under my signed contract does not include my insurance coverage which should, which downright breaks federal law pursuant to 15 USC 1605 ( a ) ( 5 ) ( see attachment for Exhibit B ). In XX/XX/2019, I filed a complaint against Mid Atlantic Finance with CFPB. Since filing the complaint, we have not been able to communicate with anyone regarding the details of our account. After two months, XXXX auto finance came and repossessed the vehicle because i owed {$610.00}. I initially submitted a dispute with the credit bureaus in XXXX of 2017 reques ting validation of this debt w ith Mid-Atlantic Finance. I never received any proof that I requested, just stating that it meets the FCRA Act, duri ng that dispute process they continued to report a late payment for a debt that is past the Statute of Limitations for Texas, meaning they ca n't collect on the debt, but still failed to provide a legal form of indebtedness with a physical signature. I was in a car accident involving this car in XX/XX/XXXX. The car was a total loss. After the parties insurance paid out, I was left with {$5700.00} in negative equity. I dont remember exact dates they have all the dates as they keep calling with dates. My car was totaled in an accident I had gap insurance. The insurance company contacted the leasing company they told them the amount due. They sent them a check for more than the amount owed. The finance company in turn sent me a check for the over payment. The finance company now continued to call and harass me that I owe them {$140.00} when they paid me out. I am writing to file a complaint against Mid Atlantic Finance Company for their failure to properly validate a debt and their refusal to refund payments made to an account that has been charged off. On XX/XX/2022, I sent a debt validation letter to Mid Atlantic Finance Company, requesting validation of an alleged debt and proof of my legal obligation to pay it. Basically i came to the end of my car loan, made the last payment and got a confirmation number. A week later the funds were still not taken out of the account, i called Mid Atlantic Finance back to find out what 's going on - they said the method of payment - check over the phone - can not be done for the last payment. I payed using this method for 15 consecutive months. When i payed off the car the first time the final payment was about {$330.00} + {$6.00} ( the XXXX is the fee just to make a payment ). When i payed it yesterday the new final balance was {$350.00} and the {$6.00} was waived. So basically i payed interest on an account that should have been closed, this constitutes fraud and after doing some research found all sorts of people with similar stories dealing with mid atlantic finance.

Mid Atlantic finance company in XXXX Florida keeps reporting negative information on my credit report for an old car loan that should already be off of my credit report. This issue is regarding my car loan with Mid Atlantic Finance : XXXX XXXX XXXX XXXX XXXX, XXXX, Florida XXXX I'm attempting to pay off my loan balance in full, which is over {$3000.00}. I've contacted MidAtlantic Finance about this bad debt on multiple occasions ; my last attempt being Monday, XXXX XXXX.
