I 'm sure you are aware of the provisions in the Fair Debt Collection Practices Act XXXX FDCPA XXXX. However, I would like to point out that your company has violated provisions of the FDCPA by implying that the legal status of the debt is collectible by reporting the alleged debt to the credit bureaus. The exact statute : XXXX 15 USC 1692e ] ( 2 ) The false representation of -- ( A ) the legal status of the alleged debtand ( B ) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt. I am also doubtful that you would have adequate documentation to prove in court that you have the right to report this negative information on my credit report, and therefore you are in violation of the Fair Credit Reporting Act as well as the FDCPA. However, I will give you the chance to prove that you are lawfully entitled to report this information by requesting an investigation. I do not believe I owe what you say I owe therefore I dispute this debt. I am well aware of my rights under the Fair Debt Collection Practices Act ( FDCPA ) and my state laws so I hope to save XXXX us a great deal of time by letting you know that not only do I dispute the validity of this debt, I have also checked with my State Attorney General and verified that the Statute of Limitations for enforcing this type of debt through the courts in XXXX, Virginia has expired. Therefore, should you decide to pursue this matter in court I intend to inform the court of my dispute of this debt and that the " statute of limitations '' has expired. This complaint is your formal notification that I consider this matter closed and demand that you, or anyone affiliated with your company, stop contacting me by phone on any number, regarding this or any other matter. You may contact me in writing to advise me that your debt collection efforts are being terminated or that you or the creditor are taking specific actions allowed by the FDCPA or my state laws. Be advised that I consider any contact not in accordance with the Fair Debt Collection Practices Act a serious violation of the law and will immediately report any violations to my State Attorney General, to the Federal Trade Commission and, if necessary, take whatever legal action is necessary to protect myself. Be advised that I tape record all phone calls and violations of the FDCPA can result in you or your company being personally fined up to {$1000.00}. Now remove these erroneous items from my credit reports immediately.

When I first walked into XXXX XXXX in XX/XX/2019, I told him I am XXXX and could not afford to run up a big bill. I also told him the insurance I had and showed him my card, which he copied. He assured me that my insurance would cover everything and that I should not worry. XXXX XXXX himself told me these things. My step-daughter was with me and she too saw him that day and witnessed the entire conversation. After our discussion he did his initial evaluation, then did an XXXX and several other procedures. These included a tens unit on my XXXX, heat and a compression device. At NO time did he tell me that these procedures were above and beyond the initial XXXX and that they would cost more money. I was unaware that he was intentionally running up a large bill that he could bill my insurance. When my insurance did not pay ( after he assured me it would ), he then came after me to pay a bill that I specifically told him I could not pay. I did not give permission for him to do all the extra procedures that he did. I have explained this in writing to his office and to his collection company. To date, I have received absolutely NO response from his office or the collection agency. I feel this is overtly fraud by his office. They KNEW I couldn't afford this yet continued to do procedures without my permission to run up the bill. I believe he did so because he thought he would bill the insurance. Additionally he put my step-daughter into a XXXX XXXX at his expense because he felt he could help her. She is XXXX XXXX. On our second visit, he became upset and told his son to " get her out of there NOW. '' His son obeyed and immediately got her out of the XXXX. On our way home, she got ill. This resulted in a visit to the emergency room for the XXXX. This is a condition in which they bring someone to normal pressure after being at a deep dive sea level pressure. It took her a week to recover from this incident. I believe that it directly relates this billing and collection because XXXX XXXX got angry that I was looking at his books in the hallway while waiting for the restroom. He became furious and made a loud scene about it. The people in the waiting room and other procedure rooms could all hear him yelling at me to " GET OUT. '' I told him I was not leaving without my daughter, which led to the removal from the XXXX This behavior was unprofessional and unprovoked. Again, I believe his anger at me is fueling this billing and collection activity.

Complaints : 1 ) Violation of Fair Debt Collection Practices Act, 2 ) Disregarded agreed upon amount, and 3 ) Ignoring my request to pay the agreed upon price. I called in to settle an account and they started talking to me about someones elses debt and told me the amount they owe, with USING THE DEBTEES NAME! This is a MAJOR violation according to the Federal Trade Commissions Fair Debt Collection Practices Act, 15 USC 1692d, 805 ( b ) Communications with Third Parties. I asked to speak with the Supervisor and his remarks were So what! This doesnt effect you, I told him that it is a violation of the Debtee and it causes me to have concern on their integrity and how they do business. He said everyone makes mistakes, and I agreed, however this violated Federal Law. He was very argumentative and kept saying what a you going to do about it?, I said I will take it further since he doesnt understand the magnitude of it. I then asked to go back to my issue and pay our mutually agreed upon amount to close my case. He gave me an amount of the original amount. I told him that was not it and that is was a different amount. He kept repeating that amount ( 6 times total ). I finally had to tell him to look at the notes in my file!!! He finally found it and admitted he was wrong. I kept telling him that I wanted to pay it but he insisted on going down a rabbit trail. He started asking me Dont I have a problem with him not looking at the notes first?, I said yes and it causes even more concern about his company. I told I want to pay my bill. He started saying that he is surprised I didnt want to complain about that. I said that I want to pay what I owe if he would stop acting like an XXXX XXXX . He said the call was over and hung up. I admit that I should not have used the word XXXX XXXX , but I was taken to my limit. I have sent an email to just get my agreed upon amount settled. I have not received anything other than a phone call from the Mid-America Collections Control Bureau , Inc. regarding this debt.

A year ago I was contacted by this company via a phone call. I answered and they started talking about a supposed debt from XXXX. I was confused because I had my information hacked by a data leak so I was consistently monitoring my credit report and this debt wasnt on my credit report. I proceeded to tell the person over the phone that I didnt have any debt as none was showing on my credit report and I have no information about this supposed debt. She proceeded to verbally harass me and say So what you are not going to pay a debt you owe? Youre just going to receive XXXX XXXX and not pay for it? I said No thats not what Im doing at all, I just dont any information about this debt and I would like to validate that its mine. I eventually hung up because she wasnt giving me information about the debt. I looked up my rights and realized I could ask for a debt validation letter. I called the number back and I got the same lady on the phone. I asked for a debt validation through the mail. She said they dont send information through the mail, so I asked for an email. She took my email and my address. I never received anything through the mail or through an email that was a debt validation letter. Fast forward to XXXX I received a phone call from this same company. I called them back and told him how I asked for a debt validation a year ago and never received anything. He stated they dont send anything through the mail and I said Ill check my email. I checked and I never received anything like a debt validation letter via email. He said he would send me an email. After I hung up I received an email, with just an amount and way to contact them through their website. I logged in and was able to contact them through their website. I sent an email asking them for a debt validation letter with and they replied saying it was passed the 30 days and they dont have to send a debt validation letter.

On XX/XX/XXXX I submitted a dispute for a {XXXX} medical debt through XXXX. The collection agency was mid america accounts control bureau and the original creditor was XXXX XXXX.. the original assignment date was XX/XX/XXXX with original date of last delinquency XX/XX/XXXX. On XX/XX/XXXX the dispute was complete and came back verified as mine and other information added to my report. I got an alert from my credit service that a collection account had been removed from my report and a new one added on XX/XX/XXXX. It is the exact same account with the exception that they changed the assignment date to my dispute date so it shows as a new account on my report. On XX/XX/XXXX I disputed again and the next day I called XXXX and given the original creditor number. I called XXXX and finally confirmed what is one. I did have insurance but for unknown reasons it was not paid. I spoke with XXXX XXXX. And she said if I paid in full it would come off my report. I paid in full immediately and she confirmed mid america would remove off report. I then emailed mid america advising I paid in full and could you please remove account from report. The next day I received response stating she would need receipt of payment, how paid and when paid first. I sent my confirmation number along with receipt. And I also called XXXX again to confirm that they had indeed sent the information to mid america. They confirmed. I immediately emailed mid america of this and they provided my account number and it does indeed show paid in full.. I Emailed the vice president of the situation as it's still on my report with new open date, unpaid. My response from him was please don't use this email!. This should not be on my report. It looks like new collection account and it has ruined my credit report.

In XXXX of XXXX MID-AMER ACCOU NTS CO XXXX , MO XXXX ( XXXX ) XXXX Contacted me and said I owed {$800.00}. I asked them to mail me out what I owed and to whom, " XXXX '' said he would. I called b ack 2 week s later and someone else said I would need to login to the website first. They would mail me the account number to setup the account. They did n't. I called back a couple weeks after that and spoke to the owner. He told me that no one would tell me that and I was a liar and I needed to pay the money. I finally got the amounts and dates from someone there. They will not let me pay current owed amounts until I pay bills they allege I owe from XXXX , 14 years ago and told me there is no limitations on collection. I am paying the original creditors directly a nd Mid-America is reporting derogatory remarks to my credit history before they remove them as paid. I believe they are doing that to ruin my credit score and it is working. All because they refuse to mail me anything in writing or let me pay them the accounts they hold. They are horrible people. I have been working with other agencies this year and have not had any issues.

I never received any statement regarding a collection account. There was never any communication from the collection agency notifying me that they were placing an account for collection, or about my right to dispute the validity of the debt. It was discovered when I found it on my credit report XX/XX/XXXX. I did not recognize this account so a Request for validation was sent. The company did not respond. A credit reporting agency confirmed to me today that collection agency contacted them with validation on XX/XX/XXXX but has still not sent me anything and credit reporting agency never notified me. I have had zero communication from this company although I have contacted them for validation, and they have failed to validate that this debt is actually owed by me. The status of this account is still in dispute and " reinvestigation in process ''. This has been in investigation since XX/XX/XXXX. Furthermore, the collection agency is reporting the same account twice on my credit report. The only difference is one says " reinvestigation in process '' and one has a XXXX added between XXXX numbers on the account number.

The company originally contacted me via phone in early XXXX attempting to collect a debt for XXXX XXXX in XXXX, MO. I requested they verify the debt to me and to provide documentation. They provided no verification or documentation, and I heard nothing from the company until I found the alleged debt on my credit report in early XXXX. In early XXXX, I again contacted the company requesting verification of the debt. The first person I spoke to there told me they weren't required to provide any documentation or verification. I then contacted the state attorney general who confirmed for me that, in fact, the company was required to verify the debt and provide documentation. I contacted them again requesting verification of the debt. They told me they had no documentation of the debt, not even a copy of a bill, to show the debt was real. I asked for the collections statement to be removed from my credit report, but they would not do that.

Collection agency was notified twice by XXXX of a dispute that was reported. Collection agency did not verify debt, but returned the report to XXXX as still owing the debt. However, it was paid in full. I called the Collection Agency to resolve the problem, but was told that they wo n't verify any information when they are notified of a dispute. Apparently, they will allow false information to remain on the credit report indefinitely, because they " would get nothing else done '' if they spent time correcting disputes. They also report every late or non-payment as a separate issue and debt instead of all with the same company to make as many negatives on the credit report as possible. For example, if there is a total owed to a company, they report as many separate negatives as days that the debt was owed.

Medical debt was put in my name somehow, it belongs to my ex-wife, she called asked repeatedly for them to put it in her name and she is paying on it. They are still reporting it as my debt, when she called and assumed the debt, made payment arrangements, and they said they would remove it from my credit but they haven't and won't. I disputed it through the credit agency it's still there. I called Mid-America collections they were rude and hateful told me to dispute it again, what more can I do. I asked if my divorce attorney could show them that it isn't mine and it needs to be reported on hers, they were rude and extremely hateful. They won't even tell you who they are when you call unless you tell them you have an account with them.

I have asked for but have not received any sort of statement showing what I owe and to whom. I have also asked that they not call me at work but yet they continue to do so. They refused to accept any sort of payment unless it was {$250.00} or more a month.
