My fianc and I have an FHA 203K ( Limited ) loan with Michigan Mutual. We closed on our home XX/XX/XXXX. When we closed we had a total renovation budget of XXXX which consisted of {$15000.00} for materials and {$14.00}, XXXX for labor to the contractor. The contractor was given a check for XXXX ( half of the reno budget ) to get renovations started and purchase all our materials. Per 203K guidelines all renovations must be completed within 6 months time ( which would put the completion date at no later than XX/XX/XXXX ) however this did not happen. The contractor requested a 2 week extension which was granted and extended his completion date to XX/XX/XXXX and he did not meet that deadline either. The majority of the work was not completed, what little bit was completed was shoddy at best and we do not have all our materials ordered therefore we decided to terminate him. In the week before the extension deadline ( XX/XX/XXXX ) we reached out to the 203K department at Michigan Mutual and explained the situation and that we no longer wanted to do business with this contractor and asked for guidelines on the proper procedures to move forward with terminating him and we were met with resistance. In fact it was not until XX/XX/XXXX of me going back and forth with them that we wanted to fire him and not until we started speaking of our rights did they finally agree to let us terminate him. At this moment it felt as if their only concern was what was easier and less paperwork for them rather than actually listening to us and what we wanted to do with our own home. It was like they were trying to force us to continue to work with a contractor we explained to them is incompetent. Michigan Mutual explained to us the following process that is supposed to happen once you terminate your 203K Contractor. 1. They reach out to the old contractor and request a final invoice for any money they feel like they are owed, if any, and the close out paperwork. 2. They order an inspection/appraisal as a neutral third party to inspect the house and report on the properties current condition and what work has or has not been finished 3. Once they have the appraisal and the final invoice from the original contractor they compare the two to make sure that what the contractor is saying he has done and should be paid is actually what has been done and what he should be paid. 4. Once this happens should everything check out you now know what remaining funds you have to hire the new contractor and finish you renovations. All of this did not happen. In a phone conversation my fianc and I had with the two 203K department representatives we brought up the fact that there is an extensive list of materials that have not been purchased and asked how that would be handled. The underwriting supervisor then told us that they do ask for invoice/receipts from the contractor and that they also verify with us what he says that they purchased and that we actually have those materials in the house, this also did not happen. And if they do not match up they send out an appraiser again to do a materials inventory. This did not happen. The appraisal was completed and submitted to the bank XX/XX/XXXX and the invoice was not submitted to the bank by the old contractor until XX/XX/XXXX ( almost a month after termination ). Once the invoice was received there was supposed " back and forth '' between MiMutual and the contractor on some things he was charging on the invoice that according to the appraisal was not complete and we were told we would be informed when that matter was resolved. While this was taking place we did some research into the contractor and his business because we read about the Guaranty Fund that Maryland Home Improvement Commission has for all its licensed home improvement contractors ( which he should be ) that would protect us and give us our money back in situations such as ours. This fund is set up to protect home owners in the event of shoddy work and/or wrong doing of the contractor and is paid for by the contractors when they receive and renew their licenses. While looking into this matter we discovered that the contractor that had been working on our home and his business are not MHIC licensed and have never been. ALL contractors in the state of Maryland who are doing home improvement are REQUIRED to be licensed by the MHIC ( Maryland Home Improvement Commission ) When we brought our findings up to Michigan Mutual, along with the proof, and letting them know that they are liable for this because it was their responsibility to vet the contractor and had they done their job we would have never been in this situation instead of owning it they tried to tell us that we were wrong. A direct quote from an email the Underwriting supervisor sent to us is that " they checked with the city of XXXX and the city of XXXX follows the county of XXXX XXXX and that in the county of XXXX XXXX 's if a permit does not need to be pulled then the person preforming the work does not have to be licensed. '' This is incorrect because regulations state every contractor performing Home Improvement in the State of Maryland is REQUIRED to be MHIC licensed. The Underwriting supervisor then sent us a copy of the contractor 's license. Once we looked at the license we discovered it is a Construction Firm license. A Construction Firm License is strictly for 100 % new build or Commercial properties ( which our house is neither of ) if you are doing home improvement on an existing RESIDENTAL property then you are required to be MHIC licensed. When we brought this to the attention of Michigan Mutual and also that the license they sent over has been altered as well to cover up the writing under Construction Firm that should read " NOT FOR HOME IMPROVEMENT and that once again they should have caught this they ignored us once again. Per HUD guidelines and Michigan Mutual guidelines as well all contractors are required to be licensed unless the local jurisdiction does not require it and the State of Maryland does therefore he should have been. When the " final invoice '' was submitted by the old contractor it was for {$15.00}, XXXX there were inconsistencies and we pointed out those inconsistencies. We also pointed out that they have an appraisal that says that he did nothing, the fact once again he is unlicensed, that he is trying to find a way to keep the XXXX check that he was given in the beginning and that they ( as in Michigan Mutual ) were just about to pay him that extra money and not ask any questions. When we asked them for the receipts they informed us that they do not ask the contractors for individual receipts and that was mind boggling as well. We have never seen a FINANCIAL INSTITUTION not ask someone requesting money be paid to them for receipts. Especially after the customer is telling you that they are not telling the truth. Michigan Mutual has not only ignored our rights but is assisting a contractor who was working illegally to take money from us. They did not do the job they were required to do. Per HUD 's guidelines it is the Mortgagee ( Lender ) responsibility for vetting the contractor. This contractor should have never passed their approval process because he provided them with a license that was altered and unrelated to what we he was contracted to do. We did not sign up to have an unlicensed contractor work in our home and had we know this we would have never gone into business with him. It is now XX/XX/XXXX and our house is sitting uncompleted and uninhabitable just like it was when we closed 8 months ago on XX/XX/XXXX. Michigan Mutual has dropped the ball on this and if the guidelines they state that they have were followed from the beginning we would not be in the situation we are in today and not living in a home that is supposed to be our primary residence that we pay the bills and mortgage for every month.

XXXX XXXX loan officer NMLS # XXXX, AZ # XXXX MiMutual Mortgage AZ BK # XXXX XX/XX/2019 is the first time we contact her on XX/XX/XXXX we had our first appointment where she provide us with the information we needed to buy a house for the first time. We proceed to give her our information that she requested my wife and i. as soon as she enter all our information in her system she immediately confirm to us that we are approved to buy a house, and during this process she said she will tell us what to do in order to get the house. some of her advises include to have a 1099 signed by my wifes employer, clean our credit, and change my wifes payroll from am XXXX XXXX to be in a regular employee with payroll in which she said we needed to raise the amount made weekly from {$500.00} a week to {$1.00} per week to this action my wife responded to her ( XXXX XXXX ) if this was legal to do, her answer was that this was her way to get the house and that it wont be any problem. We did what she asked for and she also mentioned that we will only need to be in this high payroll for only two weeks. As soon she got the pay stuff she reached out to a Realtor to start showing us properties because we were already approved to which situation we were very exited since it was gon na be our first time to get a house 6 weeks later XX/XX/XXXX to be exact she asked us to be back in the high {$1400.00} payroll again which we did and we went ahead and gave her 2 more pay stuffs. she also told us that we needed to give a downpayment of {$3000.00} dollars only to which we asked how she got that exact amount, she said thats the way she does her job We finally found a house we liked the price for the property was {$290000.00} and this is located at XXXX XXXX XXXX XXXX XXXX, Az XXXX. She suggested to offer more for the house to make sure we get it, She suggested to offer {$20000.00} more for the house a few days later she said that our offer was accepted and that the final price for the house was {$300000.00} We proceed and paid {$250.00} for an appraisal of that house, we also went to the tittle company and paid the amound of {$1500.00} to XXXX XXXX XXXX XXXX. At this point we were already exited for the new house and put our 60 day notice in the apartments we used to live beacuse she told us that no later than XX/XX/2019 we should be ready to move in. We did told her that we needed to be out of our apartment by the XXXX of that month. In XX/XX/XXXX she called us and told us that we are no longer approved that the only way to be approve now was finding a cosigner, We literally cried for days because of the frustration and because we were played by this person it was devastating for us still is our dream is to have a house for our kids for our family and she just did this to us and we feel she needs to be sanctioned punish whatever it takes so no more families go thru this horrible deceive The realtor that helped us ( XXXX XXXX XXXX XXXX XXXX ) was very good and when he found out about this he was also XXXX off with her and her boss Cuz her boss was covering her too his name is XXXX XXXX If any questions you can reach us anytime thru email or phone XXXX XXXX XXXX XXXX XXXX XXXX Please help us help other people not to go thru this we would really appreciate if we can get updates on all this case thank you very much.

On XX/XX/XXXX I closed on my home with MI Mutual Mortgage Company. I requested not to escrow my homeowners and flood insurance. At the day of closing MI Mutual informed me that it was mandatory to escrow the flood insurance but the homeowners were not being escrowed. I had no choice but to escrow the flood insurance as this was the day I was closing. I have been paying my mortgage on time every month, principal, interest and flood escrow. In XXXX, XXXX I decided to submit an extra payment of {$100.00} per month in order to bring down my balance. Mi Mutual on its mortgage statement advises any extra payment will automatically be applied to the principal balance. In XXXX, XXXX when my flood insurance came up for renewal Mi Mutual paid the policy incurring a shortfall in my escrow payments. I was never informed that my escrow was short and could not cover the flood payment. Mi Mutual without any communication applied my extra payment to the escrow. On checking my account I realized my extra payment was not applied to my principal so I contacted MI Mutual. This I when I was informed that my escrow was short. I requested an escrow breakdown so I can ascertain how this shortage occurred and why I was never informed prior to the renewal of my flood insurance that there was a shortage. Mi Mutual then reversed the extra payment from the escrow to credit the principal and subsequently again reversed the amount to the escrow. Again without any notification. On XX/XX/XXXX I received an email from MI Mutual advising that on XX/XX/XXXX without any prior notice my account was debited with {$2000.00} in order for MI Mutual to pay my homeowners insurance, which was not escrowed. I immediately called Mi Mutual and requested that the payment be reversed as my homeowners is not escrowed and I have been paying my homeowners directly. I was assured that this would be done. To date this is still an issue with Mi Mutual. On XX/XX/XXXX I wrote to the CEO and CFO of Mi Mutual to rectify this situation. On XX/XX/XXXX I received through the mail a note without a signature that the matter is being investigated. No communication whatsoever from Corporate management to address the errors made by its employees. Since then I have had no communication from anyone in MI Mutual except a notice advising that my request to waive the flood insurance escrow was denied due to the balance owed to my escrow account, which has been created by their errors in handling my mortgage. I would appreciate your assistance in rectifying this situation as I have no confidence in this company and no one seems to care, not even its CEO or CFO and its employees. I need for MI Mutual to correct its errors regarding my homeowners, and to waive the requirement for the flood insurance escrow which should never had been done. Typical of this company you are only advised after the fact. They chose to put me in flood escrow while I was at the Title Company closing, when all before the closing I insisted that I was not going to escrow any funds. My Last statement dated XX/XX/XXXX shows that I now have a balance due of {$1400.00}. Your kind attention to this matter is greatly appreciated.

My loan was sent to underwriting several times and they waited to the last minute to catch that XXXX was a community state In XXXX I received an call from an inquiry to apply for an FHA mortgage. I spoke with XXXX XXXX. I explained to XXXX my situation and income. My income is ssdi, ssdi family allowance for my children, spousal support, and child support. My documents has not changed during the entire time. When I explained to XXXX the ssdi family allowance. She told me that fine, we may just have to research it together and show the underwriters but we will cross that bridge when we get there. XXXX also expressed her concern regarding my income and situation and told me that she wanted to submit my file to underwriting to make sure we know exactly what they would accept and what they need in order to approve the income documents prior to sending me an pre approval to shop for a home. I was confident in what she was telling me and it made sense. I knew my income was not traditional so I was happy to know that when I actually get an pre approval that we wouldn't have problems with that part. I went through underwriting 3 times prior to getting a pre approval letter. Facts : they knew I was still legally married and not divorced from day one. Fact : they knew I was looking to move to XXXX and was selling my place in XXXX Facts : they knew my XXXX income and that one of my dependents will be turning XXXX in less than 3 years. These things didn't change! XXXX goes by still working out the kinks and but no issues or questions concerning the documents I sent. My credit has to be pulled again. I'm still being sold on the fact that underwriting is reviewing the income documents and credit. I had to remove disputes of my credit. I had no conversation with XXXX XXXX but was speaking to XXXX. XXXX I resolved the credit issues and now underwriting has revied my documents and sent me new conditions. I thought all was good. I started looking at homes with my pre approval and new conditions. Fact : they knew from the XXXX I was not legally separated. Fact : they knew from XXXX that I was moving to XXXX a community property state. Issues : they didn't mention the my spouse debt having to be included in mine. Had they done this in the beginning I wouldn't have been able to move forward. His debt increased my debt to income ratio and place me in an unqualifing state. I asked several times if they were going to deny me to send me a letter so that I can at least recover my earnest money deposit. When I finally receive an email for my letter and logged on I noticed the reason stated was customer withdrawal. Not only did they drop the ball, give me the run around, but had intentionally jeopardize my opportunity to receive my earnest money. Making it look as if I withdrew my loan instead of a denial due to the real reasons. My dti and or income because my spouse debt had to be added to the loan. Please see attached screenshot from XXXX XXXX basically stating to me that they couldn't do the loan. This was also unethical of XXXX to deliberately change the reason for the withdrawal.

I purchased my home in XX/XX/XXXX. I was let go from the company I was working for then I found another job but was making less money. I was still making my mortgage payments until I was laid off from that job. I was collecting unemployment then I contacted an organization called XXXX XXXX to assist me with getting the my mortgage lowered. The person I was working with was XXXX XXXX at XXXX XXXX in XXXX, Indiana. My mortgage is with MiMutual ( Michigan Mutual ) and they had XXXX XXXX constantly having me to complete paperwork which I did. MiMutual would contact me to complete paperwork and I would complete it and send it back. All of this was done and still no lowered payment. I was forced to file a chapter XXXX so that I wouldn't lose my house. I have XXXX degrees and I knew I would find another job which I did. I had several jobs working as a XXXX employee through XXXX XXXX, XXXX and XXXX XXXX. I was making less money but I was consistently employed. I filed a chapter XXXX with XXXX XXXX. I wasn't making enough money to catch up on the past due amounts owed to MiMutual. I knew that there was a program that was through XXXX XXXX that MiMutual was one of the banks on the list of various banks that participated. The program would allow {$30000.00} to the homeowner for past due as well as future payments. I thought great this will help plus get the mortgage reduced at least by half and I would be able to be current. In XXXX there was still no resolution in lowering the payment. I hired a real estate Attorney ( XXXX XXXX ) to help me communicate with MiMutual. Even my bankruptcy attorney that why is it taking them so long to lower my mortgage payment because I filed the Chapter XXXX in XXXX. I am not forced to file a Chapter XXXX BUT I want to KEEP my house. Here we are in XXXX and MiMutual has not lowered the payment. I feel as if they are purposely doing this. It has been extremely stressful. I have XXXX daily and because of that XXXX I developed XXXX. My physician said it could be from an XXXX XXXX XXXX which I do not have or XXXX. Which is something I have been experiencing since XXXX. I am XXXX on a daily basis and XXXX daily trying to get MiMutual to lower my mortgage payment. I can make the payments but not the payments I was making when I first purchased my home. I had a reduction in income and I just need it lowered to what I can afford. I do not want to move, sell or have my home foreclosed on. I am still working with my attorney at XXXX XXXX but I am filing this complaint because I need resolution. I even went back to college to obtain a XXXX degree in XXXX. I have about year to go and I will not ever have to worry about not making my payments plus I am employed. I just need MiMutual to cooperate in lowering my mortgage payments to what I can afford. I have kept my home in great condition. The basement flooded and I got that fixed, the humidifer started to leak and I got that fixed and the garage door wire snapped and I paid to get that fixed. I just want to keep my home for myself and my daughter. I just need them to cooperate with my attorney.

I applied for a loan to purchase a home in XXXX XXXX. I was a pre-approved $ XXXX with XXXX XXXX, Mi Mutual Mortgages. We moved on with the purchase, did the inspection and they were working on the loan. They kept on asking me for documents over and over and I provided them with everything requested. I was told that everything is ok that the loan is just processing and we are waiting for the appraisal. The whole process was longer that usual and the communication very poor. At one point right after the appraisal was done my lender completely stopped communicating with me. He never answered my calls, e-mails or text messages. Just to find out from my realtor right before closing that the loan was not approved and they need more documentation. Now the file got moved to the company 's branch manager, XXXX XXXX, who took over from here. He was as bad in communication as his employees. The only updates I got were from my realtor and she was trying really hard to keep this communication going. They kept promising us that they would review the file at a higher level in the company. All the emails that my realtor shared with me clearly stated that they would n't approve us, but XXXX kept saying that they were working on it. They even pushed us to get an extension where my earnest money would have been jeopardized. Luckly my realtor did not let this happen, knowing that all we have in hand is a promise. At that point the listing agent got involved and he had his wife, who happens to be a lender try to look at this loan and see if anything can be done. XXXX completely refused this. This is when we found out that Mi Mutual had not even done a verification of employment, almost two months into this transaction, although they had all the necessary information from the beginning. Now if they knew so long ago that this loan wo n't get approved then why did they do appraisal? I spent {$700.00} out of my pocket and an additional {$350.00} on inspection just to tell us two months later that they ca n't approve the loan. This is outrageous! I tried contacting them several times requesting at least my appraisal money back. It was their mistake from the beginning. I felt like they overlooked and ignored my file until later in the transaction and they were trying to save it all at the end. Now when I asked for a resolution and my appraisal money back, I got no answer, no response to my emails or calls. I have received no communication from the mortgage company whatsoever. More so, going through another lender afterwards, they would only approve me for max $ XXXX. This is almost $ XXXX difference!!! How can they be so off in their calculations if they had many sets of eyes going over my loan? This is unethical and Mi Mutual Mortgages need to be held accountable.

I don't know how to even begin this other than the fact I am extremely frustrated and am dealing with brick walls at this point in terms of resolutions. I was awarded from the XXXX XXXX back in lateXXXX, for a full mortgage assistance for XXXX XXXX, at XXXX application number is XXXX. With the XXXX, payments go out on the XXXX of each XXXX The first payment went out on the XXXX of XXXX. I called around XX/XX/XXXX after not receiving anything and they said the payment was sent and should have been received by then. It is now XXXX the XXXX and still NOTHING from the mortgage company. At this point, I know for a fact Michigan Mutual have the payments and I am requesting they be found and applied. My electric company, XXXX are receiving the payments just fine. At this point, XXXX have sent MiMutual {$6100.00} and this needs to be found and applied. I also demand that MiMutual apply these payments to the FORWARD XXXX balance and NOT the principle. I have called XXXX and MI no less than XXXX times and am getting nowhere between the both of them. XXXX, are just a call center and are unable to provide check numbers, not even the supervisor ( I tried ) can. XXXX are blaming " the mortgage companies '' at this point. So here I am, writing a CFPB complaint in hopes that this gets resolved and fairly quickly AND is not an issue for the remainder of the XXXX XXXX award. Also checked, many times, the loan number and the address ( XXXX XXXX XXXX XXXXXXXX XXXX ) were verified to be correct. I want someone with significant rank at MI to look into this and find our payments! Thank XXXX we are not in a foreclosure situation, because thanks to THEIR negligence, we would lose the house! Recently : MiMutual says they are " reaching out to XXXX to determine my participation in the program '' this is fruitless and baseless. The problem is the fact MiMutual is sitting on checks they have received and not posting them. My " participation '' is nothing to do with them. However, I provided them the application number and the phone number for XXXX and they have obviously done nothing. Terrible mortgage company.

This all began in early XXXX when I received the letter concerning my Mortgage increase. They included my water bill in which I had explained that I had paid and wanted them to review it without out the water bill on my taxes. They requested for me to email them the information in which I had done. I had called 3 times prior to XX/XX/XXXX concerning not receiving my bill. They promised that they sent it, I explained that I was leaving on vacation and wanted to pay my mortgage prior to leaving on the XXXX. Finally they sent me my bill on XX/XX/XXXX. Mind you I was out of town and now my payment was late. When I came back I notice the bill and called right away. We mailed the check out that same day. They stated that there is nothing that they can do as the XXXX was the deadline. I kindly reminded them of all the calls that I had prior and needed for this to be reviewed. I was asked to call back and that they will only waive 1 late fee for the entirety of my loan in which they stated I can ask for this to be reviewed. Mind you I had been waiting now since the beginning of XXXX for them to review my taxes. I asked about this and was told that oh I see the email, but nothing has been done I would need to call back. I have a job! I have spent more time on the phone with the mortgage company than I do my own husband. I called the next day and they never ordered for the review and now it will take another 15 days. So I call on XX/XX/XXXX to make my payment for XXXX as they still had not processed my check from XXXX. They asked for me to cancel the check and call back to make the payment. I call today on XX/XX/XXXX to find out that they applied my XXXX payment to XXXX making me now 2 months late on my mortgage. This is all their issue and I want this all to be rectified and for me to now be compensated for doing their JOB. This has been the worst company that I have ever dealt with!

I have never been late on a mortgage payment. While going through the bankruptcy process I was never informed I would need to complete a reaffirmation agreement so I am no longer allowed online access to my mortgage/online account. For the last few months each time I contact this company they transfer me to the Bankruptcy/collections department which usually ends up in a voicemail that is not returned or long hold times. As of today I have called this company 3 times already just trying to make a payment by phone. I first called this company at XXXX, was on hold for 12 minutes before being put into someone's voicemail. I called again at XXXX and was on hold this time for 15 minutes. The receptionist who picks up the line after 15 minutes starts discussing how that department is short staffed and I can either leave a voice message or wait on hold. After telling her I would hold she disconnects the phone call. I am currently on hold for a 3rd time today since XXXX ( over 15 minutes now ). As I am writing this complaint I am on hold ... to make a payment. The receptionist that picked up on my 2nd phone call asked me to call back on Monday. I explained to her my payment is due by the XX/XX/XXXX, so if I call back on Monday to make the payment it will then be late and therefore I would prefer to hold and not leave a message ( to make my payment, on time ). Since I was disconnected I have had to call back to attempt to make my payment on time today. I would ask that this company allows me online access to my account to at least make an online payment before my due date. If I can not reach someone by phone to make a payment on time I should have an alternative option to make a timely payment.

This is time sensitive as I may not have a home in a few weeks, please have someone follow up with us as soon as possible. In XXXX we have requested forbearance due to COVID. Since the beginning of XXXX we have been trying to get our packet from the mortgage company to re-install payments corrected, as initially they were trying to list our house as a foreclosure. We were advised by phone in XXXX that the loss mitigation was not needed ( although we have turned in the required paperwork anyways ) and that the payments due would be applied to the end of our loan or our payments would adjusted to repay over the next ten years. We have been calling weekly since then and keep getting advise we are waiting on the packet. On Friday, XX/XX/XXXX we received a notice that our property would be sold for auction on XX/XX/XXXX and on Sunday XX/XX/XXXX we have an inspector arrive to our property. I called again today on XX/XX/XXXX and advised of the notice, the inspector, and our current situation. Once again we were advised that the loss mitigation has been escalated and we should be receiving our paperwork to continue our payments. I am aware that a payment is due. I do not know how much to pay as I was told I may have to pay the past due amount since XXXX or continue payments as they were prior to COVID. I do not trust that I will get this taken care of in the promised next 5 days. I do not know if I need to find a place for us and our children. Please help.

I purchased my home almost two years ago now. My payment amount has fluctuated due to escrow changes, but in XXXX, my escrow amount increased by almost {$200.00} more per month than it has been in the past ( prior monthly payment amount was {$700.00} and in XXXX it was {$890.00} ). My actual taxes owed for the year is a total of {$1200.00} and homeowners insurance is {$680.00}, for a total for the year of {$1900.00}. The mortgage company is charging me {$3700.00} for the year ( based on the {$300.00} per month shown on my statements ), which is more than the 1/6th total allowed by section 6 of the RESPA. In contacting the mortgage company, I was told they had made a mistake in estimating my property value, and that as long as I sent in copies of my property tax statements, they would fix it immediately. These statements have now been sent in multiple times by myself via email, fax and now certified letter, and by the township treasurer where I reside. I have also called almost half of every business day in both XXXX and XXXX, and answered calls from their collections department when they have called me. The individuals in the collections department have either mimicked me when I have answered ( I always answer with " hello? '' and one individual has just repeated me without saying anything else ), or they just sit in silence instead of responding. It has now been 4 months and my account still has not been corrected.

This is the second complaint for the same issue. The previous complaint number is XXXX XXXX. You closed the complaint because Michigan Mutual " claimed '' to have refunded the duplicate payment of {$1200.00} on or about XX/XX/XXXX via direct deposit. I spent an hour on the phone with the bank and they have no record of any refund, deposit or any activity from Michigan Mutual or for the amount of {$1200.00} for the entire month of XXXX OR XXXX. So now, the mail doesn't work nor does direct deposit. Unbelievable! ' Here is the response I sent to them : I contacted my bank and spoke to the head of the accounting department. She went through all of the records for the month of XXXX and there was nothing from Michigan Mutual and nothing for {$1200.00}. So, now you have " apparently '' attempted to refund my duplicate payment twice with no success. Since the United States Post Office and my bank are not sufficient enough to handle this " refund '' I am now DEMANDING that you apply the {$1200.00} to account for the XXXX payment. I have absolutely had it with this situation. I want an immediate response to this email and notification that the payment has been credited to my account.If I do not get immediate results my next step is to hire a lawyer, contact the news and sue this company for false claims and lies. This is a new mortgage and the problem occurred when I accidentally made a duplicate payment for XXXX. I did not realize that the automatic payment would begin so quickly as I had not received confirmation, so on XX/XX/XXXX I made an electronic payment. On XX/XX/XXXX, the automatic payment went through for a second payment. I immediately called customer service and was told I could submit the request on line via the customer service portal. I did that on XXXX but did not receive an email confirmation until XX/XX/XXXX. I called the company and was told the check was cut XX/XX/XXXX and to give it a few days due to the holiday. It is now XX/XX/XXXX and still no check. I have called, emailed and called every day to be told the check was mailed XX/XX/XXXX and to wait a few more days. I have been transferred, cut off, hung up on, ignored and lied to with every call. No one will provide their name, telephone number or any other information other than we are checking on this and will call or email you. In the meantime I have continued to make the payments and have experienced financial hardships, paid late fees and dealt with incredible frustration just trying to get the duplicate payment reversed or I'll even live with the duplicate payment being applied to the account. Please help

We were told at that time that XXXX XXXX XXXX XXXX / XXXX XXXX would work with XXXX XXXX ( XXXX ) to finalize the paperwork on XX/XX/XXXX so that I would receive the remaining {$110000.00} funds from the construction loan before XX/XX/XXXX. Now, in working with XXXX XXXX it doesn't appear I will be getting the funds - I must note, I have a mortgage that includes the full XXXX of which XXXX is still not been distributed to me. On XXXX XXXX 2017 underwriters at Michigan Mutual and an underwriter at XXXX XXXX interpreted guideline B3-6.06 of the XXXX XXXX selling Guide, under the heading " Property Settlement Buyout '' to imply that the buyout must be " court ordered ''. Because it would be illegal for any government agency to order an American to buy something, by definition, a settlement buyout can not be court ordered. I have tried many times to speak with someone with authority at XXXX XXXX but apparently the public does not have the right to do so. I have only been able to speak with representatives at XXXX XXXX that tell me they have no authority, and they insist there is no way that i would be allowed to speak with anyone who does.

We have a mortgage in California. We are in a flood zone and do have a flood insurance policy that we have always paid on time. We recently refinanced our mortgage and it funded without issue. 3 months later, our mortgage company is claiming that we have to have our food insurance impounded with our mortgage payment, that it 's the law in California and this law went into effect XXXX/XXXX/16. We had a mortgage through another lender and have never been told that we had to have our flood insurance impounded, nor did we. We have current flood insurance that is fully paid for the year and we do not want to have our current mortgage holder try to charge us late fees or ruin our credit over this. How do we proceed?

I am currently one month behind and have been sending in extra on each payment to get myself caught up. Their loss mitigation department would only offer a 40 year loan modification raising my interest rate from 2.5 % to almost 8 %. I don't see where one month behind in payments constitutes the mortgage company making hundreds of thousands on a XXXX payment.
