Approximately one month ago I was mailed a pre-approved offer to consolidate my debt for a lower interest rate and pay one monthly fee. After applying for the service over the phone I was informed I did not qualify for the debt consolidation loan but did qualify for a debt settlement service offer through a company called Level One Law. The representative told me they could negotiate with my credit card companies and help settle/pay off all of my debt in a short period of time. I would deposit {$530.00} twice a month into a third-party savings account managed by XXXX Holdings XXXX The money would be safe and accrue and only be used to settle my debt. I was informed money would not be taken from the account without my approval and agreement of each settlement offer. I was told there would be a service fee but would be prorated equally throughout the duration of the program. A total of Three ( 3 ) payments were drafted from my checking account into the dedicated savings account for a balance of {$1600.00}. Shortly after I set up my online account with XXXX XXXX I discovered Level One Law deducted the following upfront fees each time I made a {$530.00} deposit : {$340.00} Service fee + {$49.00} Admin Fee + {$75.00} Retainer fee. The total upfront fees deducted from my account by Level One Law were {$1400.00}. XXXX XXXX, in charge of the independent savings account, charged a {$10.00} month service fee. I was left with {$180.00}. As soon as I discovered what was happening, I called the debt consolidation company to explain what and why they were charging such excess upfront fees. The representative informed me that the process would continue for the next twenty payments while they waited approximately 7-9 months to begin negotiating with my creditors. They instructed me to stop paying my creditors and let my accounts go into default which would help them negotiate a settlement offer. I was never willing to stop paying my creditors and anticipated they would simply help negotiate a settlement offer while I continued to make the minimum payments and add money into my third party savings account. I was told upfront I could cancel without any penalty and did so after one month into the program. However, the representative told me that all service fees are non-refundable and the only money that would be returned to me was my remaining balance of {$180.00}. This is a complete scam, there was no meeting of the minds regarding payment of upfront fees, which is illegal for debt settlement companies to do, and there was no consideration given in exchange for service. Currently, I am waiting for their escalation department to hear my appeal and refund my money but was told there is no guarantee they will release the {$1400.00} they took from me in excess fees.

On XX/XX/2023, I contacted XXXX XXXX in response to a direct mailing that I was pre-approved for a debt consolidation loan. I was told that the company assists not by giving you a loan but by contacting your creditors and settling your debts for less than you owe using Level One Law law firm. I was told to stop paying my creditors because an account with a company called XXXX XXXX would be opened for me. I would make payments of {$400.00} on the XXXX and XXXX of each month, which would be used to pay off my creditors and applicable fees. I was told about the fees and costs associated with the program. I inquired if these fees are charged upfront and were told no, these fees are collected once my debts are settled. I made my first payment on XX/XX/2023. ACH debits were also made on XX/XX/2023, XX/XX/2023, XX/XX/2023, and XX/XX/2023. On XX/XX/2023, I checked my XXXX XXXX account and was shocked to see that my account only had {$100.00}. All the money I have paid thus far was not saved to pay my creditors ; nearly all the money was being applied to fees. I emailed the company on XX/XX/2023 requesting to cancel and get a full refund of the {$2000.00} paid thus far. I only received an automated response that someone would reply in XXXX business days. I called on XX/XX/2023 to make my request and was told I could do it over the phone or in writing using the form in my welcome packet. No such cancelation form was given to me, so I canceled over the phone. I was told by the agent that once I canceled, I was only entitled to the balance left in my account. My only recourse was to wait until I got the {$100.00}, call back, and see if a supervisor could do anything for me.

On XXXX I called to close my account from XXXX XXXX or XXXX XXXX XXXX XXXX. After several weeks waiting to receive my refund, I called again on XX/XX/XXXX the customer office said that they have to do something manually, so they closed the account. In that time, they said my refund will be send directly as a transfer to my check account no by check. Again, I wait almost two weeks and nothing I called again they said that I will receive my refund of XXXX by check. I told them that is impossible because I paid almost XXXX dollars for 9 months. I requested who was the accreditors that they paid, and which was the honorary that they took. The customer officer says : " is in the contract ''. I asked for the contract again and nothing. I sent two emails with my frustration ; they said that I have to call because they can not resolve the issue through email, so I called again yesterday XX/XX/XXXX. I requested again to the customer officer which was the accreditors that they paid. The customer officer said : " the name of the company and was XXXX. So, I responded and the rest of the money? which was the amount of the honorary : the customer office said : " I don't know is in the contract that you signed '' " but I saw these 4 charges : XXXX, XXXX, XXXX, XXXX ''. This still unacceptable and XXXX XXXX didn't respond to me in a fair and accurate manner. For at least 9 months they deducted at least XXXX dollars from my account. Im very dissatisfied and disappointed about this service from XXXX and Im requesting the fair and accurate reimbursement from my money that I put with a lot of sacrifice.
