My wife paid off a debt in XXXX XXXX to XXXX XXXX regarding a XXXX XXXX card she took out in my name. She had proof the debt was paid and after dealings with a collection agency in Ohio ( XXXX XXXX XXXX ). The payment was confirmed by both XXXX and by XXXX. At that time ( XX/XX/XXXX ) this matter was closed and the debt was paid in full. she had previously filed a complaint with CFPB to help resolve this matter and your file show case closed. Then in XX/XX/XXXX I began to receive advertisements from local attorneys regarding a lawsuit against me from XXXX XXXX in the amount of {$1900.00} in XXXX County IL. Not knowing what this is about I called XXXX and got nowhere. ( I have also filed a complaint with your office against XXXX and their tactics ). Finally I was referred to a XXXX attorney Meyer & Nju, XXXX advised that they could help me with my questions. I tried calling their office and was told they did n't know who I was or had anything on file. Then I mailed a letter to XXXX XXXX XXXX in XX/XX/XXXX and received no response from them. Then in XX/XX/XXXX I receive a notice that they are filing a lawsuit against me. I have contacted them to advise that this debt was paid, what do you need to resolve this and those emails have gone unanswered. Should I have not received something from Meyer & Nju prior to getting notices form XXXX XXXX XXXX 's advertising mailings??? I would have been more that happy to address this matter way before we arrived at this point. There were no collection inferences on my credit so I had no idea this was coming. My wife got this card in my name which was part of the problem.

The company is passed validation period of 30 days to validate debt. Consumer reserves the right to dispute any portion of the debt by law of the Fair Debt Collections Practice Act and Fair Credit Reporting Act. The company is reporting late payments to credit bureaus where no way have I agreed are acknowledged the debt is mine. I have disputed this debt several times and am being sued for this debt and asked for an original signed contract with the original terms and interest which the collector is not supplying. The collector is using statements only for its course of validation. I do not remember this debt are agreeing to an open account yet alone having the account with the original creditor and do not remember are acknowledging going into any contractual account with either the original creditor are the debt collector. By law it is the burden of the Collector to show I legally owe the debt and I demand proof by way of contract and this complaint is my dispute and Validation notice to the debt collector to provide that proof within 30 days of receiving this dispute and if it can not provide the original contact it must be removed from my credit reports and all attempts to collect the debt must stop. I also have letters attached from my attempts to have this debt verified and my verification letter dated XX/XX/2020, again.

I. Meyer & Njus P.A. sent me a letter stating 1 ) they had been retained by XXXX, 2 ) notice of opportunity to contact within 30 days to dispute the debt, and 3 ) a statement they are a debt collector. The letter was delivered uncertified.
II. I responded on XXXX/XXXX/2015. In that letter, I asked Meyer & Njus, P.A. to validate the debt. The letter stated to respond to a specific Notary Public ( who would verify and validate receipt of said validation ) within 30 days. The letter was sent by certified mail and received by Meyer & Njus, P.A.
III. I also pulled down my credit report and saw that this debt had been charged off.
IV. I was served with a lawsuit on XXXX/XXXX/2015 by Meyer Njus, P.A. regarding this matter.
This firm stated they were retained by XXXX. That claim is patently false, since the debt was charged off. If XXXX was still pursuing this debt, it would not be at that status, so this firm has made a false statement regarding its disposition on this matter. Further, this firm has stated they are a debt collector further down in the letter. This indicates that they obtained this debt as third party debt collector.
The statements made by Meyer & Njus P.A. in the letter are fraudulent and misleading, and intended to intimidate. Further, Meyer & Njus P.A. has extended this fraud into court.

Attorney XXXX XXXX XXXX XXXX debt collector for XXXX XXXX is on violation of the Fair Credit Reporting Act ( FCRA ) and Fair Debt collection Practice act ( FDCPA ) also Michigan laws of the ( FCRA ) and ( FDCPA ) and consumer protection laws has taken action and suing for a debt they did not verify in time with a valid original ( wet ink ) contract that is written documentation. The XXXX letter is a 609 letter under the ( FCRA ) which requires that the credit agencies investigate and validate all accounts including the alleged owed account from XXXX XXXX from a XXXX ending in XXXX for an amount of {$1000.00}. Attached is the letters sent in for verification to the Credit Bureaus. The debt collector had 30 days from around XX/XX/XXXX and XX/XX/XXXX ( 2019 ) to verify the debt through the dispute process of the ( FCRA ) form all three credit bureaus that are XXXX, XXXX, and XXXX. Instead of verifying they took legal action and decided to sue with insufficient evidence and still reporting this unverified debt which is way past the 30 days which must be removed from all three credit reports and to cease any collection attempts. The collector is committing defamation of character and attempting to collect this expired debt and other applicable laws.

XXXX XXXX XXXX employed Njus Myeres who constaly called at odd hours and threatned to put a lien on my house when I paid XXXX. IT is documented that I paid and noone wants to provide my statements! XXXX XXXX XXXX XXXX or this Njus Myers. The judge did not get proof of my statements and the ignored my letter that was sent before the summoned date since the debt was under XXXX. What kind of practice is this!? And when you are in front of a judge you can not even speak because they are in cahoots with the debt collectors.This debt has been paid. Back in XX/XX/XXXX, I was contacted by a Law Firm Collection Agency ( XXXX XXXX XXXX ) regarding a XXXX Account, with an assumed balance of {$1200.00} (??? ) and I stated to the Agency above, that " I do not owe, this amount of money to XXXX and willing to settle the debt for 70 % of the original amount owed.I know the original amount because I was trying to file Bankruptcy in XX/XX/XXXX, so I had the original balance in the paperwork and I explained this to the Representative.
On XX/XX/XXXX, I received the attached letter for XXXX XXXX XXXX ( Attorney at Law ), with the attached credit application, just stating " this is an attempt to collect ''. I have been trying to work with this credit for a settlement of the original debt, but was told I need to agree to the {$1200.00} before they can agree to an settlement. I stated that this doesn't sound legal and asked that they return the debt to XXXX and was told they can not do this. The attached letter is what I received and that is all, no other communication.

XXXX XXXX XXXX has sent a debt collector after me for a debt That is not mine. They are stating that I opened an account back in 2013 in which I have never been into a XXXX store. I have filed complaints with the debt collector and with XXXX and nothing is being done. They have been garnishing my wages and so far I have paid {$2000.00}. The debt collector that has garnished my wages for XXXX XXXX is XXXX XXXX XXXX, XXXX XXXX.
Originally they said that I owe {$2800.00} and the number that I owe continues to change and go up even though I have records of my paystubs where they are taking out money every week. XXXX XXXX XXXX or XXXX XXXX does not show up on my credit account because I have never had any type of account or opened up any credit card and nobody will help me and they are taking all of my money. They said that there is a judgment against me and that I was served in which I have never been served by anybody.

On XXXX XXXX, 2016. I received three phone calls at XXXX, XXXX and XXXX. The phone number being called is my work phone number. The voicemail for this number clearly indicates this is a business line. No messages were left, no indication of who or why these calls were being made. I had to place a business conversation on hold and called XXXX at XXXX to ask them to stop. I spoke with someone named XXXX and advised him the calls they were making were interfering with my ability to do my job. XXXX said he understood the importance of being able to work and said he would ensure they calls would stop. The calls did n't stop. The next call I received was at XXXX. I believe this is a direct violation of the TCPA which should result in a penalty paid to me in the amount of {$1500.00} for knowingly violating.

XXXX XXXX had recently filed a judgement against me in 2015 and by the time it had reached me it had went to an attorney and they had issued a writ against me. I tried on numerous occasions to rectify the situation and I took my case took court and the attorney admitted this was not my account so the attorney and the court located in the state of Michigan vacated the judgement but yet and still XXXX has refused to delete this item from my credit report.I would also like to recieve a deletion report within 24 hours of the resolution.

On XX/XX/XXXX I contacted Meyer and Njus about my monthly payments of {$250.00} to put a stop payment on the month of XXXX. The Man I spoke with XXXX said they can do that and hold off until XXXX. The following week that payment was still taken out and my bank account overdrafted.
