The proceeds of the sale of my deceased mothers home are held in Escrow at Metropolitan Title , LLC [ XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, VA XXXX ] since the close of the sale on XX/XX/XXXX. At that time I was given a settlement statement. Issue # 1 : The estate is still in probate and has not been closed. Because the money in escrow belongs to the estate there are accounting 's that are filed with the Commissioner of Accounts. Prior to the first accounting which was due on XX/XX/XXXX, XXXX XXXX had been contacted by both myself and the estate attorney on multiple occasions asking for an updated statement with a current balance. Such statement was never produced and the accounting was filed to the Commissioner of Accounts without the necessary paperwork. A second accounting is due to the Commissioner of Accounts on XX/XX/XXXX. I have both emailed and spoken with XXXX XXXX XXXX and his staff. He agreed over the phone to send a statement to the Estate Attorney. The contact information to do so was emailed to him immediately after the phone call. Two weeks have passed since, and to date no such document has been received. Issue # 2 : The proceeds of the sale of the decedents property have been held with Metropolitan Title for a considerable time. There are three joint administrators of the Estate who could not reach an agreement on how to disperse the funds. From my very first phone call with XXXX XXXX back in XX/XX/XXXX he has stated that if the money had not been taken out of Escrow within 1-2 months he would inter-plead the case and it would go to court for a judge to decide. This threat of the case to go before a judge has been reiterated numerous times over the past 18 months with no action taken. On XX/XX/XXXX the estates 3 administrators reached an agreement regarding the release of the funds. XXXX XXXX was immediately notified and by email given names, addresses and phone number of each of the three administrators. Two weeks have passed since this time with no word from Metropolitan Title.
