Debt occurred XXXX, Charge off amount XXXX XXXX XXXX XXXX {$8900.00}. On my credit report shows charged off account closed. Have not heard from them or this debt since XXXX XXXX XXXX Served Papers at my home ( 20 days to respond to court ) Amount owed {$15000.00} XXXX/XXXX/XXXX I called Merchants asking if they would work with me to settle this debt.Collection agent stated to submit in writing my settlement offer Submitted settlement offer XXXX/XXXX/XXXX ( {$4000.00} one lump sum ) No response XXXX/XXXX/XXXX submitted a second time offer {$4000.00} settlement offer Received a call that night from collection agent XXXX XXXX stating client rejected the offer and no counter offer was given XXXX/XXXX/XXXX received letter from Merchants legal department requesting a call to set up payments with a stipulation for judgment XXXX/XXXX/XXXX Received motion for court hearing for XXXX/XXXX/XXXX. XXXX/XXXX/XXXX Called Merchants spoke to XXXX XXXX he told me to submit best offer that included payments as long as I could, and to state I was a single mother and this was all that I could do. He stated that they do n't negotiate amounts ; so I have to guess the correct settlement amount for it to be accepted, which they always accept principle + legal fees, but only offer what I can afford. If I submitted it by Monday XXXX/XXXX/XXXX he would speak to their legal team and try to get this settled prior to court. XXXX/XXXX/XXXX Submitted settlement offer of {$4000.00} cash, pmts {$160.00} over 2 years = total settlement offer of {$8000.00} XXXX/XXXX/XXXX called Merchants to check on settlement offer, spoke to XXXX XXXX . XXXX XXXX stated the settlement was not rejected and XXXX ( attorney ) wanted to discuss amount with me before court on XXXX. XXXX XXXX told me they do settle with clients and to go to court XXXX and everything would be taken care of prior to the court hearing. XX/XX/XXXX-I took 3 hours off of work unpaid to go to court. Someone else representing Merchants was there not XXXX. I stopped him in the hall before going into court and he told me they do n't settle before a judgment and Merchants does not do stipulations for judgments that after a judgment is against me ( that day ) then I can call their office and set up payment arraignments. This was not what the letter stated and not what I had been told on the phone, which I had been trying to work with them for almost 3 months now with little communication. XXXX/XXXX/XXXX called the office to try to settle this and start payments as I was then told in court to do, left a message to XXXX XXXX, still have not heard back from the office. XXXX/XXXX/XXXX submitted to their office exactly what I was told to submit, full principle of the credit card debt + all legal fees ( {$9800.00} ) I would pay {$4000.00} by XXXX and pay in equal payments until XXXX/XXXX/XXXX which this debt will be paid in full. I was requesting that if paid on time they have my judgment vacated since this was preventable and I have letters to support that. I asked all correspondence needed to be in writing since I had been lied to by their company several times. XXXX The office has called me twice once on XXXX and once today without ever leaving a message. I decided to call back to find out what was going on. XXXX/XXXX/XXXX I called the office and again XXXX XXXX was the one who had been calling me to tell me that the legal department did not have my file anymore he did and he can set me up on payment arraignments, instead of garnishing my wages. I told him that I did what he told me to do and submitted a settlement offer of full principle + all legal fees, which he told me they always accept because they do n't care about interest. XXXX XXXX today told me that XXXX XXXX union rejected my offer and will not settle with me now. I owe more than what the judgment was for because they are adding more legal fees which are now over {$15000.00}. I told him that they violated my rights and

The debtor utilized the billings and/or credit reports that she had in her possession at the time she prepared her XXXX Chapter XXXX bankruptcy. A medical facility was listed individually for debts to be discharged and a Collection Company that the medical provider assigned some debts to was also listed. After the bankruptcy was discharged in XX/XX/XXXX the debtor noted that the collection agency had listed 60 individual collection accounts on the credit bureau. The medical provider assigns XXXX account number on a bill. Though invoice numbers XXXX be generated for a date and time certain there is only one creditor. The Collection Company listed 60 individual bills on the creditors report. These showed various dates and times that the debtor saw the medical provider which was prejudicial and capricious and audacious. After sending a letter to the medical provider and Collection Company stating that she would seek sanctions from the bankruptcy court for violating the rules with regard to trying to collect a debt after it was discharged I bankruptcy. The Collection Company only listed XXXX debts. Of those debts, the debtor had provided insurance information for the Medical Provider to forward their billing. The Medical Provider failed to submit their bills to the XXXX insurance company has one account number. Showing individual dates is a violation of HIPPA which is prejudicial and allows a prospective employer to presume that the debtor is sick on innumerable occasions. When a debtor lists a creditor on a bankruptcy petition the Creditor is listed once with a total amount owing. When a lawsuit is filed against a creditor there is only one amount listed and not 60 individual amounts. After the debtor filed sent the Collection Company they removed 29 individual accounts. Showing only 49 collection accounts listed on the debtor 's credit report. The medical provider failed to submit the billings that were as a result of her XXXX and XXXX motor vehicle accident to the ( Insurance Co. # 1 and Insurance Company @ ). Further, Insurance Company 1 requested on innumerable occasions that Medical Provider to submit billing and records in order to receive payment. In the interim, the Medical Provider violated HIPPA rules even though the debtor had provided a letter to them that she revoked any release of information. It was later discovered that a third party medical copier company had signed a statement on XX/XX/XXXX that they had received protected health information that was not intended for them. The third party copier company further stated that they had not disclosed the protected health information and they further stated that they had deleted the same from their computer system on XX/XX/XXXX. The medical provider allowed protected medical information to be disclosed to an entity without her permission even though there was a letter from the debtor stating that she forbade, revoked, and requested that no information be released. The medical provider is the 'captain '' of their records. They have control who they release medical information to, they certify third parties to pull records and access their records. The debtor was damaged by the disclosure of her protected medical records. The Medical Provider 's Supervisor of Medical Records forwarded an assurance form from a third party agency who admitted obtaining protected health information on XX/XX/XXXX and asserted that those protected medical records were destroyed on XX/XX/XXXX. But that proved to be untrue. The debtor was then refused medical service by the Medical Provider even though she prsented a card for payment. This is retalatory.

XXXX XXXX XXXX is attempting to collect a debt on behalf of XXXX XXXX for a services related to covid-19 testing on behalf of both myself and my wife. In addition, they are trying to collect for an additional medical appointment for which I have no record. Both my wife and I where tested for Covid-19 on XX/XX/XXXX. My spouse had been into a doctor 's appointment earlier in the week and the doctor suspected that she had Covid-19, but no test were available in the area where we lived. The clinic then called my spouse several days later and requested that we both come to the clinic for testing. To be clear, there was no appointment or examination on XX/XX/XXXX. Instead, we were tested for XXXX and XXXX. We were told that we were required to be tested for XXXX as part of the testing protocol. I had insurance, but my spouse did not. Shortly thereafter, we started receiving bills for the testing even though we were told that the test would be covered. I called XXXX about both my bill and my spouse 's bill, and I was told that the bill was in error, and not to pay it. We received many more bills over the last two years, and each time I called, the representative apologized and told me that the bill would be resolved. We received our first dunning letter, addressed to my spouse, from Merchants Credit in the amount of {$200.00}. My spouse and I called the collection agency and informed the representative that the bill was for covid-19 testing, that collection was barred, and that no additional examination had been done. We were told by the representative that Merchants Credit would still consider the debt collectable. As a result, we wrote a letter to the collection company on XX/XX/XXXX, disputing the debt, stating that no appointment took place, and that all services and tests were related to covid-19 testing. In response, we simply received another latter claiming to " verify '' the debt, I also received a dunning letter on or around XX/XX/XXXX, from Merchants Credit, in the amount of {$230.00}. In addition to the testing, I am also being billed for an appointment on XX/XX/XXXX, for which I have no record of attending. I sent a letter response on XX/XX/XXXX, stating that the charges are barred by the section 6001 of the XXXX XXXX XXXX XXXX XXXX. All of the services being billed related to a clinic visit for the sole purpose of receiving a Covid-19 test. The test took place on or about XX/XX/XXXX, which was during the emergency period, which was declared on XX/XX/XXXX, by XXXX XXXX XXXX XXXX XXXX XXXX to be in effect as of XX/XX/XXXX, and that no appointment occurred on XX/XX/XXXX. I have also searched my emails, text messages, and XXXX timeline, and I have been unable to find any record of an appointment on XX/XX/XXXX. In response, I received another dunning letter from Merchants Credit today, XX/XX/XXXX, which was addressed to my spouse, but contained an itemization for charges in my name. I did not request verification of the debt. I sent a letter disputing the debt. Therefore, I should have received no further communications from Merchants Credit. XXXX XXXX violations aside, sending a letter with " verification '' when I disputed the debt appears to be a violation of the FDCPA on its own.

I had several XXXX XXXX appointments in XX/XX/XXXX- XX/XX/XXXX and my insurance company ( XXXX ) processed all of the claims to my deductible, which was incorrect. Because this was incorrect, I did not pay the amounts I was being told I owed, and eventually amounts went to Merchants Credit Association. My health plan documentation clearly stated that ALL physical therapy services would be 100 % covered by XXXX after the member pays a {$20.00} co-pay. When I contacted XXXX to ask why my claims were processed toward deductible instead of co-pay, they stated that in order for me to have had my claims processed toward co-pay I would have needed to have had my appointments at a doctor 's office or a free-standing physical therapy facility, rather than at an outpatient department of a hospital, which is where I had my services done. However, there was no language in the schedule of benefits that mentioned place of service as a determining factor in how benefits are applied for physical therapy services, whereas other short-term rehabilitation services such as occupational therapy actually specified that benefits were dependent on place of service. My husband appealed XXXX 's decision explaining all of the above and provided PDFs of the language used in the schedule of benefits. While we waited for the outcome of the appeal, I also appealed the amount owed with Merchants Credit Association ( MCA ). Shortly after that, XXXX sent us notice that they denied our appeal. On XX/XX/XXXX, my husband contacted the Washington State Office of the Insurance Commissioner ( OIC ) to request that they act on my behalf to complain to XXXX about their claim decisions and the denial of my appeal. On XX/XX/XXXX, the OIC contacted me to inform me that XXXX had reversed their claims decisions and had reprocessed all of the appealed physical therapy claims to {$20.00} co-pays for each visit. That same week, I received new EOBs from the hospital where I had the services completed which showed the new processed amounts. Because my hospital printed out new EOBs, my assumption would be that they would either contact MCA to stop the collection of a debt that was no longer valid, or that MCA would send me a new collections notice with the corrected amount owed. Neither of these things have happened, and I was recently informed that sometime between XX/XX/XXXX and XX/XX/XXXX, MCA reported my collections amount on my credit report. I was never given the opportunity to pay the amount I truly owed before they put the collections amount on my credit report and I believe this to be wrong because MCA is required by law to send me notice of the valid amount, but the last notice I received from them was no longer valid.

XX/XX/2023 - Merchants Credit Association - XXXX XXXX called me at work, when I informed her that she reached me at work and needed to call my cell phone at XXXX. She became defensive and angry. I said thank you and hung up I called and left several messages over the weekend as I had tried to begin making payments on their website the amount of my statement XXXX on the paper statement I found was for XXXX some odd dollars. I explained in my voicemail I was not to be contacted at work and could be reached between XXXXXXXX XXXX XX/XX/2023 - I received a call from XXXX XXXX and was unable to answer but called back within XXXX minutes. When connected I explained that I had tried to pay online but my packet number wouldn't work. XXXX XXXX looked up my account, stated it was a debt collection and that I owed XXXX some odd dollars immediately becoming combative. and aske what he could help with. I stated that what he could help with is not having his collegue XXXX XXXX call and be so innapropriate and to give to please give me the packet number. He stated that the bills were from XXXX accounts from XXXX hospital and asked if XXXX and XXXX were my children, I asked for the dates of visits or to be sent a detailed statement. He asked again for my children 's names and said I wouldn't answer his question so he wouldn't answer mine. I told him I didn't have to and again asked for the dates and/or packet number. He finally gave me the packet number I explained to him that is the same one I had which didn't work. He told me it is because it's been referred to the legal department and that was the hold up. I asked that he unlock it so that I could make payments and not have to deal with anyone on the phone at his company. He said the decision had been made. After a few more words I mistakenly said I would report him to the XXXX meaning the XXXX. He stated " oh the XXXX, I just want to make sure I'm hearing you correctly ''. On the recording you can tell I start out nicely. This is the XXXX humiliating and horrifying incident with this company. I would like to pay my bill, I am escaping a very bad relationship the bills are from my daughter being treated for XXXX from it I believe. In the drama and shuffle of her intensive XXXX XXXX etc. bills slipped by the wayside. I'm slightly crushed and at a loss of what to do.

I had a medical bill of {$1000.00} with XXXX XXXX XXXX that was getting auto-paid based on a payment plan of {$91.00} per month for 12 months from my XXXX Account. The plan was set from XX/XX/XXXX to XX/XX/XXXX. I don't check my XXXX Account regularly to see if the payment went through because there is enough money in the account and assuming that if there was any issue then XXXX would contact me. In XX/XX/XXXX, I received a letter from Merchants Credit Association ( MCA ) asking me to pay the remaining principal of {$530.00} + collection cost of {$77.00}. I contacted XXXX right away, they claimed that they tried to collect a payment from my XXXX on XX/XX/XXXX but it failed. I asked them if there is a proof that they tried so that I can contact XXXX and ask why, they said there is no proof. I asked why they didn't contact me before sending the bill to a collection agency, they said they tried but couldn't get hold of me, but again there is no proof that they tried and my phone number and address never changed. I contacted XXXX and they said there is no evidence that a payment was rejected. I went back to XXXX and asked if I can pay the principle amount in total, they refused and told me the case is not with them anymore, it is with MCA and I need to sort it out with them. I called MCA numerous times and explained to them but they seem to be always focused on collecting their collection money. MCA also claimed that they reached out to XXXX and asked them to take the case back but XXXX refused. I have been receiving multiple letters from MCA demanding that I pay the principle + collection cost. Today on XX/XX/XXXX, I called MCA one last time and asked them if they can waive the collection cost, make it less, send the case back to XXXX but the agent told me am just wasting time to save {$77.00} and advised that I should pay the entire amount to MCA or make multiple payments BUT pay interest. I gave up on all and paid the entire amount ( {$450.00} principal + {$77.00} collection cost ). I am writing to you because I feel that what XXXX did was not fair at all.

XXXX XXXX I checked my XXXX XXXX account when I noticed a 16 point drop, said I had a negative inquiry, I have Immaculate credit no Collections and I pay my bills on time, I was very surprised, their was a radiology bill in the derogatory marks section of my XXXX report. I immediately called XXXX to find out more information about it I was told that it posted on XX/XX/XXXX it did not become available to me and till XX/XX/XXXX, I filed a dispute and called XXXX XXXX to find out why I had a bill and why I was not notified, apparently they sent it to the wrong insurance company, had my address as the insurance company it was for XXXX dollars from XXXX, I asked the quickest way to resolve this that I had insurance and they should have paid it, they said the quickest way to resolve was to pay the bill but I couldn't pay them I had to pay Merchant collection agency in XXXX Washington I immediately got off the phone and called Merchants collection agency the lady that I spoke to told me that the good news was that as long as I paid the now {$46.00} collection day that it would be reported and taken off so I went ahead and immediately paid the {$46.00} and that was that XX/XX/XXXX I got on my XXXX XXXX account first thing in the morning to check and noticed that the collection was still showing unpaid and their, I immediately called XXXX they said it was still showing unpaid, I called Merchant credit agency and told them I had paid bill and what I was told they basically told me that they will report it when they want and that they have thousands of people with debt and their not going to report one debt paid, im very frustrated, this was a bill that was to be paid by my insurance, but to resolve the issue it only being XXXX dollars I paid it, I want the bill showed as paid and to be removed, I had excellent credit, now it shows good, I dont want it to catch on to my XXXX and XXXX as it has not yet happened, this does not sound right to me, if a bill is paid it should be reported as paid

Hospital debt from XXXX XXXX - charged off to Merchants Credit Association. Ongoing garnishment through employer for many years - it seemed cyclical - every 6 weeks or so. Thought nothing when the employer began taking $ from check but this time I did not receive paperwork. Found out from the creditor $ was not given to them and employer did not send any {$.00} Creditor informed me that they had sent the usual writ of garnishment but they employer did not respond. Creditor informed me that the debt was now the employers responsibility. One year later creditor performed a bank levy - when asked about the employer they stated 'it was easier to clean out your account than to get him to respond '. When I told them they said it was the employers responsibility I was told it was up to them to decide who to go after and to 'call back when I was more informed of what the laws were ' When I asked how much $ was left on the debt I was informed I only owed approx {$250.00} I was told they would call me with an exact amount once the levy went through so I could pay it off. XXXX {$510.00} cleaned out of my account again. They said they did n't have to call me if they did not want to. I asked for proof that they even contacted the employer - was informed as the debtor I do not have access to that I would have to get a court order. I can not prove that funds were taken from my paychecks since my employer never gave me check stubs - currently working with XXXX on that. Merchant Credit Association Collection Agency was assigned my charged off debt amount {$36000.00} on XX/XX/2011. Since Merchant Credit did not own the charged off debt amount, they had to work XXXX XXXX XXXX to report false monthly growing debt amounts to the credit bureaus for over 6 years!! I did not find out about their illegal credit reporting until I requested my credit reports from the credit bureaus. Here is what I found & tried to disputed them and have the incorrect debt accounts deleted immediately. 1 ) I do not have a written contract with Merchant Credit Collection Agency, nor did I promised to pay them and, I never sent them any payments. 2 ) Merchant Credit Collection never sued me and won a court ordered Judgment against me. 3 ) Merchant Credit Collection along with XXXX XXXX XXXX secretly and willingly charge my charged off debt account/s 12 % compound annual interest rates for over 6 years even now. When they knew XXXX XXXX XXXX had a written contract with me for 6.49 % annual interest rate. 4 ) Merchant Credit Collection never bother to send me any monthly billing statements over the years and even now, but they see fit to charge and falsely report monthly growing debt amounts information on me for years and now too. ( Truth In Lending Act ) 5 ) While I started my credit bureaus, creditor and Merchant Credit disputes, my credit scores mysteriously took a sharp dive from XXXX to XXXX. I guess to retaliate against me for requesting written proof of the higher debt amount/s. 6 ) Merchant Credit Collection was only reported on XXXX credit bureau, and the charged off debt was and still growing every month for years. *** Time barred debt.

In XXXX I received a summons from merchants credit associates with 20 days to respond to XXXXXXXX XXXX XXXX before I could respond. They reported it to all of the credit bureaus and had three of my credit cards closed on me upon contacting the hospital and contesting the debt it was discovered that I was paying these things and they should not have gone to collections our direct contact was with XXXX XXXX at XXXX. And once we got the debt resolved, we asked both the XXXX and XXXX for a letter that I could send to XXXXXXXX XXXX credit card services, and to the credit bureaus, stating that this was a mistake. I have not received contact or any communication from either party ever since this was resolved on the debt collection end. However, my credit cards are still closed and the bank associated will not help me without evidence that this adverse action on my credit was in fact a mistake. I opened a complaint already with XXXX and they refuse to reinstate my credit cards without some sort of evidence that this is incorrect and I cant get merchant credit associates or XXXX XXXX to contact me back. I am incredibly disgusted by this practice you have completely put a wrecking ball through my credit, when inflation is at an all-time high, and people are already penny-pinching, and you put me in a position where I now owe an entirely separate debt plus interest upfront with a company that I was also paying consistently. Its like you guys caused me all of this grief and intend to just let me sit with it. I was approved by my insurance company for several XXXX. The XXXX were to be done every 90 days for 1 year. After the XXXX XXXX I inquired on whether the insurance company paid for it, I was told they had. Merchants Credit Association ( MCA ) did not provide me with the updated amount of debt that I owed prior to reporting my debt to a credit reporting company. My previous medical debt was {$2500.00} but after my husband and I contacted the WA State Office of the Insurance Commissioner ( XXXX ), the total amount of debt I owed went down to {$100.00}. Considering the vast difference between the original amount I owed and the actual amount owed, I expected MCA to contact me about this corrected debt. MCA did not attempt to speak with me in person about the updated debt, they did not attempt to speak with me over the phone about the updated debt, they did not mail me a letter about the updated debt, nor did the send me electronic communications about the updated debt. Had they done any of these acts, which they are required to do prior to reporting a debt to a credit reporting company, I would have paid the updated debt amount immediately. I simply needed to know exactly how much I owed and who to pay. I previously submitted a complaint to the CFPB about this issue but it went unresolved. While MCA did finally contact me with the information I needed, this entire situation was mishandled by MCA and XXXX XXXX as no one kept me in the loop of what to pay once XXXX resolved the claims issues I have fought for the last year and a half. The original creditor is a real estate agency called XXXX XXXX XXXX XXXX of an apartment I rented, where prior to move in I paid a security deposit via money order, the protocol was that in order to receive keys on move in date I had to bring a deposit, so I did. Upon move out, the company stated I didn't provide a long enough notice and also stated that I did not pay a deposit when I moved in so therefore the balance owed was for a one month rent plus several hundred for any damages and cleaning that accrued while I occupied the apartment. Which is absolutely false, I paid a deposit upon move in. Later, I found out from other neighbors that the previous manager fraudulently cashed the deposits and did not apply the money to accounts, as far as giving the notice to apartment according to State Law if the apartment remains unrented they are supposed to charge me the amount of days that it remains unoccupied, while I tried to resolve and paid for the amount of days it was unoccupied the balance still grew at an awfully high interest rate of 12 % with now a collections company, which also made zero attempts to inform me of the debt and the interest rate they go for. In conclusion, the original debtor received a payment of {$400.00} which I believed was what I owed for not providing enough of an advance notice prior to move out, which could also be argued since the apartment manager was never on duty, she later go fired.

I have just received a letter from " Merchants Credit Association '' regarding a bill that I apparently owe a medical institution in XXXX called " XXXX Hospital XXXX XXXX ''. I have certainly never stepped inside this medical center, let alone been anywhere the company they claim to represent ( I have been to XXXX once in my life ). This so-called collection agency has sent me a letter saying my " account '' is in arrears, yet I have obviously never had such a letter from any medical establishment. It 's all incredible vague and suspicious. A few weeks ago I started XXXX, and of course registered for XXXX LLC. I set my home address as the public domain address on file, and I assume these guys are trawling the Washington State XXXX database and looking for victims to extort money from. The letter is very vague, and I ca n't find out much about the collection agency, so I 'm not sure what the correct course of action is. I do *not* want to invoke correspondence from these guys, as many reviews online states that this is used to be able to ascertain your telephone number in order to constantly harass you. Again, having this absurd demand and have never even stepping foot inside this medical center, or even hearing about them makes me think that they are purely looking for victims using Washington 's online small business database. I contacted XXXX in XXXX when I got a credit card bill. I called and told them it was identity theft and that I never opened a card with them. They told me they would take care of it and not worry. In XXXX, I checked my credit report, and they put on the credit report that I owed money. I called and tried to resolve the matter, but they told me they no longer had access to the fraud account under my name ( which wasn't mine. It was fraud ) and that they couldn't close it even though I had documentation to prove that it wasn't me including a police report for fraud and identity theft. XX/XX/2015 my XXXX store credit card was declined at a XXXX. It turned out that I had missed my XX/XX/2015 payment by accident because I never received my bill. I received a couple of calls that I owe money for two appts at different health agencies, I asked for proof the debts are mine. I was then hospitalized and when discharged was served a summons to appear to a " Request for default '' hearing. I called Merchant 's Association and said I would pay the debt but I wanted them to send me proof that I owe the debt because I do not recognize the name of the XXXX clinics they say I owe the debt for. Merchants Credit Association routinely contacts me regarding medical debts that the fail to prove are mine. I've routinely asked them to provide itemized lists of the debts, the original biller, and proof that debt is mine. They never provide these proof documents. When these debts are disputed with the credit agencies, they agree to remove them, and then attempt to put them back on my credit reports. Now I have learned they are trying to file a civil lawsuit for some of these debts. I now believe they may have sent someone to my house who demanded my teens, who were home alone, answer the front door. I have filed a police report and am waiting to hear back more on this. This company would harass me by calling back to back up to 6 or more time daily and even called me at work, which is also against the law.
