HIPAA LAW VIOLATIONS Improper disposal of patient records - Shredding is necessary before disposing of patients record. 10. HIPAA LAW VIOLATIONS : Missing patient signature Any HIPAA forms without the patients signature is invalid, so releasing information would be a violation. Missing any HIPAA form. 11. HIPAA LAW VIOLATIONS : Releasing information to an undesignated party - Only the exact person listed on the authorization form may receive patient information. 12. HIPAA LAW VIOLATIONS : Releasing unauthorized health information - This refers to releasing the wrong document that has not been approved for release. A patient has the right to release only parts of their medical record. 13. HIPAA LAW VIOLATIONS : Right to revoke clause - Any forms a patient signs need to have a Right to Revoke clause or the form is invalid. Therefore, any information released to a third party would be in violation of HIPAA regulations. Be advised that the description of the procedure used to determine the accuracy and completeness of the information is included. MERCHANTS AND PROFESSIONALS, XXXX XXXX XXXX, XXXX on behalf of XXXX XXXX XXXX, who is collecting on behalf of XXXX XXXX XXXXwas required to notify me prior to XXXX XXXX XXXX, or no later than 30 days after XX/XX/2017 failed to notify me about reporting derogatory info. to Equifax, Experian, and Transunion In section 603 ( p ) 15 U.S.C. ss 168s-2 ( a ) ( 7 ) ( A ) ( I ) ; The notice required under subparagraph ( A ) shall be provided to the customer prior to, or no later than 30 days after XXXX XXXX XXXX, furnishing the negative derogatory information to a consumer reporting agency described in section 603 ( p ), 15 U.S.C. ss 1681s-2 ( a ) ( 7 ) ( B ) ( I ). Plus broke commercial law under UCC? 9.501 that all notices were timely and properly given by dated certified mail receipt. They were not met. First, I never received any correspondence from MERCHANTS AND PROFESSIONALS, XXXX XXXX XXXX, XXXX. A strong presumption of receipt applies when notice is sent by certified mail, because it creates actual evidence of delivery in the form of a receipt. XXXX XXXX v. Atty Gen., 506 F.3d 274, 279 ( 3d Cir. 2007 ) ( emphasis added ). A weaker presumption arises where delivery is sent via regular mail, for which no receipt, or other proof of delivery, is generated. Id. In the absence of actual proof of delivery, receipt can be proven circumstantially by introducing evidence of business practices or office customs pertaining to mail. United States XXXX XXXX, 27 F.3d 890, 893 ( 3d Cir. 1994 ). This evidence may be in the form of a sw orn statement. Id. at 895 ; XXXX XXXX XXXX XXXX XXXX XXXX XXXX, 503 F.3d 415, 420 ( 5th Cir. 2007 ) ( a sworn statement is credible evidence of mailing for the purposes of the mailbox rule. ). However, because the presumption is weak where proof of receipt is attempted solely by circumstantial evidence, we require the affiant to have personal knowledge of the procedures in place at the time of the mailing. In XXXX of XXXX MERCHANTS & PROFESSIONAL inaccurately and irresponsibly reported multiple debts in collections to my XXXX, XXXX, and XXXX credit reports. I learned that MERCHANTS & PROFESSIONAL has been furnishing debts bought from XXXX XXXX XXXX and attempting to collect these invalid debts from me. I responded to MERCHANTS & PROFESSIONAL on XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX via certified online mail with a cease and desist for violating HIPPA and asking them to furnish proof of standing. They have failed to respond to either of my requests. Due to their negligence and inability to accurately respond to my requests, I will be pursuing legal action against MERCHANTS & PROFESSIONAL. My family and I are in the middle of purchasing a home. This behavior is unacceptable. The failure on behalf of the MERCHANTS & PROFESSIONAL have cause great pain for my family and I. Merchants and Professionals has been unable to provide proper documentation validating this account. I am seeking immediate action and to remove this negative information permanently from my credit reports. Merchants and Professionals is in violation of the HIPPA laws. I have sent multiple letters on XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX, asking this company to verify this account and I have not recieved a satisfactory response. The only response I have received is a general bill asking for a payment of {$140.00}. This is the letter sent for validation of the account. This letter is being sent to you in response to an entry made on my Credit Report dated XX/XX/XXXX. I, XXXX XXXX, is filing the complaint on behalf of my son, XXXX XXXX, presently not in the country. And, was not in the country at the origination of the debt during XX/XX/2019. The original bill is via a company named XXXX, where the only communication began with the billing of the amount {$300.00}. The origin of this bill began with an application named " XXXX. '' " XXXX '' began texting XXXX during XX/XX/2019 about monthly savings on bills. I have never solicited any service from " XXXX ''. At no time was there a live individual. Everything was via text messaging. The people or customer service representative was unknown. " XXXX, '' and those behind the scene, strangely reviewed my bills and stated that they could save me money. I was curious but there was no agreement for services or fees. Eventually " XXXX '' text that they could save money by lowering my cell phone monthly bill. At no time was the other party, XXXX, ever introduced through the various text messages. " XXXX '' had access to all of my accounts. It is uncleared as to where this company extracted the information ; i.e. banking, credit report, etc. Even up to this point, XXXX was not introduced. They were the " invisible '' partner of this scam. Keep in mind, as a customer of XXXX, I could have easily called to discussed lowering the bill. On XX/XX/2019, I received a text invoice from XXXX for a fee of {$300.00}. Was my bill lowered, no! I emailed " hiCharlie '' with my protest at XXXX. Who is XXXX? The entire scenario is suspicious and it is probable that " XXXX '' was actually a separate entity or application of the organization XXXX. Now, XXXX is on the scene. I disputed this charge and communicated with XXXX. XXXX stated it had to be handled through " XXXX ''. Now, XXXX is stating there is nothing that they can do. XXXX does not have any agreement from me or my son for their services. I, XXXX XXXX, never ever granted permission for a {$300.00} billing for something that I could have done. A complaint was filed with your agency, CFPB, XX/XX/2019 regarding these fraudulent practices of the owner of " XXXX '' and association with BillShark. XXXX is fully aware of the bait and switch tactics used through this application, " XXXX. '' I honestly believed that they worked together.. Let it be cleared that " XXXX '' appeared via the phone number XXXX, which I, XXXX XXXX, is the owner. This verifies the fraud practices of XXXX. The XXXX bill has three ( 3 ) numbers associated on it and one owner. I, XXXX XXXX, is an authorized user on that account. However, I, did not authorized nor agree to the billing of any services via " XXXX '' or XXXX. And, since XXXX XXXX was not in the United States, neither did he. The original associate of XXXX that began billing was XXXX. Now XXXX has sent this bill to Merchants & Professional Collection Bureau.

I again have included the actual total documented twenty eight ( 28 ) medical pages they have on record and prove they distributed my medical information on XX/XX/XXXX at XXXXCDT. I was shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. I am a XXXX Senior Citizen and I also suffer from a Severe XXXX XXXX. On XX/XX/XXXX I received a bill from XXXX XXXX XXXX with a due date of XX/XX/XXXX. This bill showed an amount due for lab services performed on XX/XX/XXXX and XX/XX/XXXX. I had no idea what this was for. I attempted to contact them by phone, left numerous messages, and never received any response. I did look at my insurance explanation of benefits and found this was for lab tests, which I get done every 3 months at my physicians office, XXXX XXXX. I have gone to this doctor for at least 6 years and have never had any issues with lab bills. I emailed and spoke with my Doctors office and was instructed not to pay the bills. Apparently the Doctor 's office and XXXX XXXX were in a dispute and also Merchants Collection was harrassing their patients. In the past with other lab companies through this doctors office, I have never paid anything out of my pocket for lab tests. Had I been made aware before I had the tests done that I would owe a balance I would have never had the tests done. I never signed any document and I was completely unaware of these charges. On XX/XX/XXXX I received a collection letter from Merchants & Professional Collection Bureau. I disputed the bill. I even called and left a message for the owner of XXXX XXXX to call him to discuss this. No response. Also, my doctors office told me that these bills were filed as Out of Network through Insurance. Their website page clearly states this : If an EOB states that XXXX XXXX XXXX is an Out-of-Network Provider, then they will make all attempts possible to ensure that the patient is only responsible for the amount owed as if XXXX was an In-Network Provider. I have asked this collection agency for proof in writing from all parties of the contract between the doctor and the lab company. They told me the agreement was done by XXXX XXXX XXXX and no contract in writing. I am asking that the CFPB investigate this. I just received another collection letter dated XX/XX/XXXX. I am a nervous wreck about being harassed as I continue to receive letters from this collection agency. They also reported it to all 3 credit reporting agencies and I have been rejected for credit because of this lab bill that I do not owe. Thank you

XX/XX/XXXX I was hospitalized I the XXXX due to XXXX. My insurance as an XXXX XXXX member ( civilian ) of 14 years covers my hospital care minus my copay. Everything else is paid including who sees me in the hospital during my stay. XXXX XXXX XXXX ( XXXX XXXX XXXX ) saw me while in the hospital for a total of 5 min each time. XXXX XXXX paid my hospital claim months before the very same amounts were fraudulently billed twice ( Dates of service XXXX ) but this time XXXX billed and coded them as office visits as if I went to his office when we know that to be false because I was half dead in my hospital bed. Now his office is committing insurance fraud and billing the insurance with duplicate claims knowing any insurance with a conscious would reject them. Once rejected and reprimanded by XXXX they chose to bill me for services that were already paid for by XXXX. Again, insurance fraud. On XX/XX/XXXX they assigned a collection agency Merchant & Prof for claims that were settled by XXXX in XXXX. I have tried to tell both them and XXXX office that Im stuck in the middle of this and I do not have a patient balance. The collection agency rep XXXX was condescending and rude. He hung up every time I called them. Even after being sent the Explanation of Benefits from XXXX inXX/XX/XXXX showing a XXXX patient responsibility to their client, the agency is still falsely reporting this debt. They continue to defame my name and financial integrity. The issue isnt payment history as my track record is excellent. The issue is that XXXX XXXX XXXX, XXXX XXXX XXXX, and their collection agency Merchant & Prof are committing the crimes of Insurance Fraud and extorting consumers into paying claims theyve illegally duplicated. Which is why the duplicates were rejected by the insurance. Ive disputed on all 3 credit bureaus but XXXX and XXXX are still under investigation. The fact that this level of fraud is allowed by the credit bureaus is a clear indication that consumer protection and security dont exist. On XX/XX/2018 I visited XXXX XXXX XXXX, XXXX for an in office procedure. I used no insurance and signed paperwork that all debts were paid in the office at the time of the procedure. The agreed price was {$180.00}. This was paid in person at the time. There was no later billing option, the price was established, paid in full at the time of the procedure, a receipt given, paperwork signed that all debts were to be paid at that time ( unless insurance was involved ), and the office billing person confirmed in person that everything was paid and nothing new would be charged. About a month later XXXX XXXX XXXX sent a bill for the procedure for which I had already paid. I attempted calling XXXX XXXX XXXX but were only able to leave a voicemail. To to best of my knowledge, no response from them was received. I continued to try to call, but only was able to get to voicemail, there was no person to whom to speak. The debt was then " assigned '' to Merchants & Professional Collection Bureau who attempted to collect on this falsified debt. We contact MPCB and explained that the debt was false and submitted a dispute to XXXX XXXX XXXX who provided the original paperwork that stated that all debt was to be paid at the time of the visit, along with a bill for the service again. MPCB decided that even though the paperwork showed that we were not a customer at the time of the latter, false bill, and had no debt to XXXX XXXX XXXX, refused to clear the debt. We called today to MPCB to discuss why they were continuing to pursue a bill now that they were aware that it was fraudulent and they hung up on us and provided no recourse for their pursuance of a debt that they knew did not exist. Even though XXXX XXXX XXXX provided no supporting documentation as to the debt attempting to be collected, and even though they had provided paperwork showing no debt could exist!

Merchants and Professionals is constantly reporting to national credit bureaus negative on accounts that i have a current payment plan and is satisfactory paying with on time payments to the original company ( XXXX ) Both companies are getting money from me for the same bills. In 2016 I contact a company by the name of XXXX after hearing a radio ad that this service could help negotiate lower rates on utility services/phone bills, etc. I was struggling financially at the time and filled out my information online to see if they could help reduce my bills. It was not disclosed to me ( or hidden in small print ) that they could arbitrarily make decisions on my behalf and charge me an undisclosed amount for doing so, with no opportunity to accept or reject the offer. XXXX supposedly negotiated a discount with XXXX XXXX XXXX that I never actually received, or only received temporarily and then it stopped - yet XXXX arbitrarily charged me almost {$400.00} for this " service, '' with no opportunity to decide whether or not I wanted to proceed. XXXX repeatedly asked me for passwords, and continued to contact XXXX XXXX XXXX after I asked them not to. I ended up having to cancel my XXXX XXXX XXXX service altogether because of this repeated headache and received no benefit from XXXXXXXX XXXX deceptive service, which in every way is a UDAAP violation. I received no clear disclosure about what I was to be charged and did not agree to any terms ; there is no signed agreement. Now, years later, a collection agency by the name of Merchants & Professional Collections has put this account on my credit report. I have disputed the account and was provided no validation of the " debt. '' They just continue to validate it with no basis. I do not owe this company anything and placing this account on my credit bureau 6 years after any interaction with this company in an attempt to collect ( even if I owed it, which I do not ) is not legal as a debt buyer as the statute of limitations is up. I have been sent to collections, Merchants and Professional Collections Bureau , Inc., over a {$300.00} bill that XXXX has denied three times. The reason for the denial, according to XXXX, is due to the XXXX XXXX not being certified with XXXX. I was not advised of the potential of having a XXXX XXXX and therefore was not given the opportunity to allow or deny this part of the XXXX. After thorough examination of the records I have received regarding my case, I can find no consent form for the XXXX XXXX from XXXX XXXX XXXX XXXX in my records. I spoke with XXXX, XXXX Billing Director, regarding this case and she stated that I received all paperwork corresponding to this XXXX. She also stated that since the XXXX XXXX was not covered by XXXX that the XXXX XXXX should have been paid through XXXX XXXX XXXX agreement for payment from XXXX. I take any financial issues seriously and I have spoken to and been advised by a lawyer who stated I should not have been billed as the XXXX should have been vetted through XXXX XXXX prior to the XXXX. The failure of XXXX XXXX and your company to verify coverage before the XXXX XXXX took part in my XXXX has further complicated by the fact that there is no record of my consent to this part of the XXXX. I am a veteran of the XXXX. As a benefit to me for my service, I receive free healthcare. The VA was my insurance for my prenatal care and labor and delivery. My son was born XX/XX/XXXX and the doctor that I chose for him made the initial doctors visit while we were still in the hospital. I received the bill from the doctor some time later and gave the doctor office the VA 's information so that they could process the claim. What I was unaware of was that the VA needed my son 's SSN in order to process the payment. I had no idea that the doctor 's bill was still deliquent until XX/XX/XXXX, 16 months after my son was born, until I received a letter from the collection company. I made contact with the collection agency more than twice and told them that I contacted the VA and gave them all the information they needed so that they could process the claim. I also told the VA that the debt was in collections and I was told that they " always do that, '' meaning the collection agency will continuously go after the patient until they receive payment, even though the patient has insurance. I got tired of letters and phone calls from the collection agency so I contacted the XXXX and made them aware. The final result was the collection agency not contacting me anymore. This issue has knocked off XXXX points from my credit score and the note says, " individual responsible. '' I am not responsible. The VA is responsible and the doctor will not get paid until the VA finishes processing the claim, however long it will take. I would like this issue to be removed from my credit report.

In XX/XX/2016, I called and spoke to XXXX and then to XXXX at Merchant Professional Bureau regarding my complaint of their agencies reporting tactics. More importantly, the incorrect information that has been on record from the original medical provider. First off, there was the issue of duplicate bad debt reporting from MPB for same date of service, same amount, etc. This was acknowledged and then recognized by XXXX and removed as promised. However, it still left the one debt and I raised issue with the fact that I felt certain the provider was 'punishing ' me for refusal to pay their charges. This is unethical. On the date of service, I went in to the XXXX clinic after I had set the appointment and insured that when I set the appointment, I did not want to pay for unnecessary XXXX or XXXX testing or diagnostic procedures since I already knew my condition and what I was suffering with. I simply needed meds to alleviate the discomfort of severe XXXX and XXXX. I have been tested many times over the years. Once there, I was given an XXXX and again stated to them that " I did not want anything done that the insurance would not pay at 100 %. Well, I got a bill two months later stating that I owed {$340.00} for services rendered. On XX/XX/2016, I sent a formal dispute to MPB and to the attention of XXXX. I have since not heard anything form them but that this debt was removed from XXXX of the XXXX bureaus. I need for the collection agency to remove this entirely and in good faith instead of digging in and appeasing the service provider for unethical business practices.

I was never informed that negotiation was an option. I tried contacting them at least 8 times over a 2 month period and was never able to reach anyone ; when I left messages, no one contacted me back. I only received a first notice, then another bill labeled first notice, but never a final notice. Then suddenly I was being reported to collections. The collections letter mentioned nothing about a " grace period '' before it was reported to my credit report, but on the phone, after informing the operator I can only afford to pay $ XXXX/month, at the very end of the conversation she informs me that I have until the XXXX of this month ( about 3 weeks ) to pay the full amount or else it goes on my credit report. Even if I am actively paying toward my balance, it will still be on my report. Nowhere in writing was this grace period stated. The communication has been evasive, misleading, and omitted details, and the operators were not only rude but also evasive and did not properly disclose the information until I dragged it out of her by asking repeatedly if there is anything else I need to know. If I had n't asked her that repeatedly, there is no way whatsoever that I would have known I could negotiate, that there was a mysterious " grace period '' that I had to pay off the full amount ( less than 1 month is not remotely enough time to be called a " grace period '' ), or that I will still be reported to collections even though I am actively paying off my debt.

This is a formal complaint against Merchants and Professional located in XXXX, TX. This company has repeatedly violated my consumer rights under the Fair Credit Reporting Act as well as the Fair Credit Billing Act and has caused me much unnecessary financial AND mental distress. After reviewing my credit profile on XX/XX/XXXX I identified a discrepancy with an account listed under Merchants & Professionals. I requested a validation on XX/XX/XXXX as this was an account that I did not recognize. On XX/XX/XXXX the company sent a statement reflecting a balance owed for my daughter XXXX XXXX who was covered under XXXX and therefore charges should have already been paid. I reviewed my credit report again on XX/XX/XXXX and the account continues to reflect on my credit report and therefore a 2nd validation letter was sent, along with a copy of letter sent by the agency as well as a copy of my daughter 's XXXX card requesting further review as the account should have been covered in full. As of today I have not received any further correspondence from creditor to validate these accounts as not having been paid tand furthermore I do not believe that the creditor has HIPAA authorization to access the account nor authorization to attempt to collect on the account and the account continues to negatively affect me. Also, the communication appears to contain a " threat '' to report a debt that does not exist to the three credit reporting bureaus even though the amount in question is below a dollar threshold that would actually be relevant to those bureaus. Back in XXXX XXXX I was involved in a major car accident that resulted in serious medical attention, all of this was ruled in my favor as NOT AT FAULT. XXXX has continued there brazen disregard of the law by failing to properly investigate a recent collection account that has appeared on my credit report. Merchants and Professionals Collection Bureau is trying to collect a medical debt incurred by my former domestic partner. On the phone in XXXX, they said the debt was for my XXXX ; however, I have never been sent an addressed, itemized statement of charges from the reporting clinic or the collections agency. I told them I would not pay until I was sent statements addressed to me showing responsibility for the debt ; that is, a list of services and who they were provided to. After the call, they put a number of collections debts on my credit report, XXXX to be exact, that I had no knowledge of, claiming that I was jointly responsible. When I disputed the items on my credit report, they removed all debts except XXXX for an amount of {$260.00}. My insurance was XXXX and they stated that XXXX XXXX XXXX screwed up and didn't submit the claim. The merchant then tried to send me a bill over a year after ( fair debt violation ). Lost my tooth anyway entirely. My regular dentist stated they should have given me a complete refund for the loss. The date the debt collector put on my credit was also way after it happened. I keep filing a dispute on the credit report as inaccurate and sent a letter to the merchant and debt collector asking for proof of claim and debt with no response. There is zero verification of debt. I had a fixed dental insurance amount and I paid and was covered under my insurance. Then they try to bill later because of their XXXX up. On top of it. In XX/XX/2015, I was referred by my Primary Care Physician to XXXX XXXX XXXX XXXX, and a XXXX. XXXX XXXX. When I filled out the new patient information sheet, I marked that my insurance required me to use XXXX XXXX XXXX for all lab work. In XXXX I get a collection notice from Merchants and Professional Collection Bureau saying I owe {$330.00}. I called them saying I paid and asked for the back up. XXXX XXXX said she would not send me anything. I mailed the form back saying I paid and dispute any debt. I called XXXX XXXXs in XXXX XXXX. XXXX and XXXX were surprised I got a bill and both said don't pay it. XXXX sent me the ledger showing a column with Patient Balance at XXXX. In XXXX I get a letter from Merchants saying they have verified the debt and enclose a redacted copy of the letter. The column showing Patient Balance was whited out. I tried to explain this to XXXX but she wouldn't listen. I emailed XXXX and XXXX XXXX at XXXX XXXX enclosing the actual ledger showing I owed nothing. I have not heard from them. They probably have violated Sec. 807 of the FDCA by making a false representation of the amount of a debt.

45 days after my XXXX XXXX Bankruptcy was discharged I checked my XXXX XXXX Credit Report to ensure all accounts were being reported correctly. I discovered that Merchants & Professional Collection Bureau , Inc. was reporting and old medical debt of XXXX that was discharged in the bankruptcy as a current and open debt. However they are showing a XXXX balance and that it was discharged. Showing a XXXX balance, they have lost permissible purpose and should remove this collection account from my credit file but have refused to do so. My Attorney has also sent them a cease and desist letter demanding the removal of the item, yet they have still refused to remove the item and continue to report as an open account with a XXXX balance. After reviewing my credit profile on XX/XX/2020 I identified a discrepancy with accounts listed under Merchants & Professional. I requested a validation on XX/XX/2020 as these were accounts that I did not recognize. I reviewed my credit report again on XX/XX/2020 and the accounts continue to reflect on my credit report and I have not received any correspondence from creditor to validate these accounts as correctly belonging to me despite my credit report nor any updates to reflect that the accounts are disputed and therefore a 2nd validation letter was sent out on this day. I do not answer telephone calls from numbers I do not recognize. I received a telephone call from XXXX today. When I did not answer the call, my front desk receptionist called me a few minutes later telling me she had received a call from the same number, and said the caller identified himself as a XXXX XXXX with Merchants & Professional Bureau of XXXX. He told her he needed to speak with me about an outstanding debt. He said he needed to speak with me to discuss this personal situation and the receptionist told him we are not allowed to receive personal calls at work. This was VERY disturbing. A couple of weeks ago I discovered my credit report in XXXX showed an unpaid balance of {$250.00} due to a company called XXXX XXXX XXXX. In late 2014, I was involuntarily transported to the hospital against my will by 2 police officers. I was not under arrest, and I was not committing a crime. I did not threaten to harm or injure myself. When I was dropped off at the hospital, I did not receive any medical attention, or even check in at the front desk. Merchants called me in order to settle a collection account that was referred to them from my medical provider. When they called, they refer to themselves as a CREDIT BUREAU. As far as I know there are only XXXX national credit bureaus ( XXXX, XXXX, XXXX and XXXX ). When I questioned them about who they really are, they insisted that they are a credit bureau when in fact they are a credit collection agency. Their name is misleading and so is their representation to people they speak to. They try to intimidate me even when I kept questioning them. No attempt was made to verify the collections disputed. I do not recall seeing the original dispute or anything from the company that they claim contacted me. There was nothing done to confirm the debt which I do not owe. It is a medical debt that was sent to a charity organization at the hospital and paid by them. XXXX XXXX is lying when they say they tried to check it out, they made no attempt to remedy the issue and just stamped it as good and put it on my report. I mailed the attached enclosures to the three major credit reporting agencies disputing the negative report on my credit record.
