Legal Department, I am a victim of identity-theft. I am writing to request that you block all the following fraudulent accounts in my files with XXXX, XXXX, and XXXX. This information does not relate to any transactions I made. I did not authorize anyone to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim files an affidavit it shall be honored by all credit bureaus and all fraudulent information must be blocked within 4 days and proper notification shall be given to all furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The Better Business Bureau, Consumer Financial Protection Bureau, and Attorney General with legal action of your companys unlawful collection practices, misrepresentation of reporting inaccurate debts, and noncompliance to adhere to laws enacted to help who are victims of identity-theft. I request that an extend fraud alert be placed in my file explaining that fraudulent applications may be submitted in my name. Do not extend credit without first contacting me personally and verifying all applications. Furthermore, as victim of identity-theft I received notification that my personal information was compromise in the several different data breaches. It has made it difficult to resolve this matter in a timely fashion. I have made several attempts to resolve this. If action is not taken to properly assist me with this matter within 15 days. I shall file a class action lawsuit for violating the FCRA and FDCPA violations are as follows not limited to reporting inaccurate information, reporting information that resulted from crime ( s ) and/or crime ( s ) of identity-theft, unlawfully collections of debt, calling after designated hours by law, defamation of character, and misrepresentation of true credit worthiness. I ask that all fraudulent information listed below be removed without question. I have fraudulent accounts, employers, misspellings of my name, and address that are associated with crimes that were committed against me. Once deleting all fraudulent information, you acknowledge that it is indeed fraudulent and resulted from crimes of identity-theft. By doing so you adhere to the FCRA that make it unlawful of any, some, or all information to be transferred, sold to another collection agency or reinserted one 's credit report once it is deemed as fraudulent. You also understand in order to reinsert information to a consumers credit report notification must be given 5 days prior to reinsertion. Failure to comply will also be a violation of the Federal Fair Credit Reporting Act and Fair Debt Collection Practice. The below-listed accounts by the Original Creditors, who have reported these accounts within my credit reports, were not opened by me. I also did not give my authorization for anyone else to open these accounts. Someone else of who did these that I did not know. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of a such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. Finally, you are reporting the INQUIRIES that are the result of the same type of fraudulent activities. It must be noted that I did not apply for credit accounts with the below-listed companies and creditors, some of these are the result of attempts to open accounts, but the companies did not approve the accounts. Therefore, these inquiries must be deleted from within my credit file. You can not delete the fraudulently opened accounts without also deleting the fraudulent inquiries. It should be noted that an inquiry that was not made by me is not a factual record, just as a fraudulently opened account is not a factual record and not referred to the creditor to be disputed directly with them. The credit reporting agencies have attempted to address an inquiry as a factual record of file access, but if it was done through fraudulent means, it is not a factual record. As a consumer I should not be required to dispute each fraudulent inquiry directly with each company. These inquiries are the result of fraudulent activity and therefore, inaccurate in which the credit reporting agencies or the creditors can not verify, meaning that these inquiries are unverifiable information and must be deleted from out go my credit files. XXXX. MERCHANTS ADJUSTMENT bal. {$420.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity-theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity-theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. This is not a refusal to pay, but a notice that your claim is disputed. I am requesting assistance with a collection agency out of XXXX, AL, Merchants Adjustment Services, who has refused to send me information regarding an alleged debt and has refused to mark this debt as disputed, despite multiple requests to do so. Towards the beginning of XXXX I started to get calls on my personal cell phone from a number my phone listed as " spam ''. As per all spam calls, I ignored them. No voicemails were left. One day I recognized the spam number as a repetitive caller, so I answered. The person on the other end had incredibly broken XXXX ( I work for a government call center. We have foreign callers often. That being said, I was STILL struggling to understand this person on the line. They sounded XXXX, which further supported my assumption this was spam ). The person on the line said something to the effect of " This is ( unintelligible ) with ( unintelligible ), trying to collect a debt of ( unintelligible ) from you. How would you like to pay today? '' I responded, " I'm sorry, WHO is this? You're with WHO? ". Again, his response was unintelligible. I truly could not tell you the caller 's name or the company he worked for- incredibly broken English. This communication effort violated Code 12 CFR 1006.34, which states that oral disclosures must be given at a volume and speed sufficient for the consumer to hear and comprehend them. A reverse phone number lookup on the website indicated the phone number was tied to Merchants Adjustment Services. However, to my knowledge, I owe no debts. I hung up the phone and blocked the spam number. I assumed that matter was settled. However, in XXXX of XXXX I checked my credit report and noticed a negative account. I've never had a negative account on my credit report before. " Merchants Adj Service- {$570.00} '' was the delinquent activity. I immediately wrote the company a written request for more information, as well as the specific request to classify the debt as " disputed '' by myself. I received a written response from the company a few days later, within the time frame allotted by the US Code. The written response ( attached ) was incredibly insufficient and hardly contained any of the information about the debt I requested. I specifically requested a copy of the bill I signed, because the {$570.00} procedure in question I do not even remember taking place. My second letter was received by the company via certified mail on XX/XX/2023 and as of XX/XX/2023 I have not received a response. Additionally, as of XX/XX/2023 my debt is still listed as " negative '' rather than " in dispute '', which is actively harming my credit score and affecting my purchasing abilities. This is a direct violation of Code 12 CFR 1006.38.

I am having a problem with MERCHANT ADJUSTMENTS. I HAVE REACHED OUT TO THEM ABOUT 120 DAYS NOW REQUESTING VALIDATION THAT ANYONE AUTHORIZED THEIR COMPANY TO RETRIEVE MY MEDICAL INFORMATION AND PROOF OF THE ACCOUNT NOT JUST A BILL THEY CREATED. THEY ONLY TOLD ME THAT SOMEONE AT THE ALLEDGED HOSPITAL TOLD THEM I AUTHORIZE ANY PROVIDER TO SEE THEIR MEDICAL INFORMATION. IF THIS WAS THE CASE, THEY STILL WOULD NOT BE ABLE TO ACCESS ANY OF MY MEDICAL INFORMATION BECAUSE THEY ARE NOT A PROVIDER THEY ARE A COLLECTION AGENCY.I ASKED FOR THAT LETTER, AND THEY REFUSED TO SEND IT TO ME. THIS IS A IDEA OF THE LETTER I SENT THEM AND THEY SENT NOTHING Validation of Debt and HIPAA authorization - Please provide a breakdown of fees including any and all collection costs and medical charges- Please provide a copy of my signature with the provider of service to release my medical information to you - Immediately cease any credit bureau reporting until the debt has been validated by me Please note that withholding the information you received from any medical provider in an attempt to be HIPAA compliant will be a violation of the FDCPA because you Will be deceiving me after my written request. I am requesting full documentation of what you received from the provider of service in connection with this alleged debt. Furthermore, any reporting of this debt to the credit bureaus prior to allowing me to validate it may be a violation of the Fair Credit Reporting Act, which can allow me to seek damages from a collection agent. I went XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX, AL XXXX to seek treatment for a XXXX XXXX. I paid my required copayment and they filed the claim with my health insurance. I was under the impression that I have complied with the requirement for a health insurance claim. Nearly two years later, I now have a {$230.00} collection account on my credit report and will remain on my credit report for seven years unless the claim is paid by my insurance. When I contacted XXXX XXXX XXXX XXXX XXXX onXX/XX/2019, I was told the claim was denied because XXXX XXXX XXXX XXXX XXXX did not file claim within 12 months from the date of service. I file an appeal with XXXX XXXX XXXX XXXX XXXX of MS but my claim was denied stating it was not filed timely. I did not receive any correspondence from the creditors giving me an opportunity to pay for the bill before it was placed in collection and on my credit report. According to the Medical Debt Act of 2016, The bill amends the Fair Debt Collection Practices Act to require a debt collector, before informing a consumer reporting agency regarding a medical debt, to notify the consumer in writing that : ( 1 ) the debt collector could report the debt to a consumer reporting agency 180 days after the notification is sent, specifying the precise end date of the period ; ( 2 ) the debt will not be reported if it is settled or paid during the 180-day period. I never received any documentation in writing about an unpaid medical bill. The account was reported to all three credit bureaus before 180 day after being delinquent. The date opened on the account is also incorrect. The date of service was XX/XX/2017, it is being reported on my credit reports as XX/XX/2018. I have disputed this debt with XXXX and XXXX and the debt was verified as accurate. I have contacted the original credit and collection agency to pay the bill in full to have the item deleted, since this is clearly a clerical error for untimely processing. I had health insurance at the time of office visit. The original creditor stated they will call or email me back but I never heard from them. I recently received updated copies of my XXXX and XXXX credit reports. I noticed a collection account on both of them upon review. I filed a response with the CFPB about the issue and immediately received a response from the collection agency. Merchant Adjustment Services continue to violate my consumer rights. Under 15 USC 1692 ( c ) Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt. For starters I do not owe this company any money nor have I ever done business with this company. For two how is this company attempting to collect dent on behalf of another company? Merchant contacted many times. See prev complaint XXXX where merchant failed to acknowledge previous contact attempts. Merchant advised does not have a contract of service where service was to be performed. Merchant is attempting to collect a debt for services not contracted/requested. I am in XXXX from XXXX XXXX and am still in college under my parents insurance. I had a XXXX done and went by myself and accidentally gave the hospital the wrong insurance card. Needless to say, the scan was not payed for by insurance and I was liable for it. It has gone into collections and I was contacted by Merchants Adjustment Services. I tried explaining what happened and gave the caller my dad 's number because I am still under his insurance. A few years have gone by and I recently noticed it was still on my credit report. I called and asked if they could send me a bill in the mail so that I could take it to my insurance company just to see if there was a shot in the dark that they would pay for it, but the MAS rep was extremely rude saying they would not pay for it and refused to send me anything in writing eventually hanging up on me. MAS is not my insurance provider and they do not make the decision as to if my insurance will help or not. I do not understand why they will not send a bill if I owe them money. If insurance can not help, that is fine I will make payments as I can, but I would like to at least explore that option.

The VA does not have this service for women Veterans, so an appointment was made for me to get it done as an outsource service. Sometime XX/XX/XXXX, I received a bill from XXXX XXXX ref this appt. I called the financial service to inquire about this and was told it was an error my insurance would be billed. I then received another bill in XXXX and again in XX/XX/XXXX at this time I was in full XXXX treatment and honestly did not make this a priority. On XX/XX/2020, I received a call from Mr . XXXX with Merchants Adjustment Services ( XXXX ) stating that I had 2 open accounts with XXXX XXXX XXXX and that if I did not pay it immediately, he would be filing that day to sue. I told him then that he could not threaten me unless he absolutely intended to take that action. After ending the call with him, I called back and spoke with XXXX, the receptionist. I told her that I was not to he contacted AT ALL via mail, email, or phone after that date. I then left a voicemail for the manager, XXXX XXXX which was never returned. I recently checked my credit and discovered that this account had been reported. I did not receive notification that I even owed this debt. In XX/XX/2018, I contacted Merchants ADJ Service to dispute the medical bill on my credit report. The person I spoke to would not verify the debt in writing.I then contacted the original creditor, XXXX Hospital, and asked the billing department to verify the debt. They had no record of outstanding debt in connection to my name, birthday, or social security number. On XX/XX/2018 I filed a dispute, online, with XXXX. The investigation determined the debt to be valid. On XX/XX/2018 Merchant ADJ Service reported a second medical bill, from a different facility, to my credit report. On XX/XX/2018, I contacted the XXXX XXXX XXXX XXXX, and they had no outstanding bills in my name. I was then transferred to XXXX in the billing department of the XXXX Hospital. I have reached out to this company Merchants Adjustment Service pretty much every since this collection has showed up on my credit report via mail and I have not received any feedback whatsoever. I have never received a " debt validation '' letter from them nor have they responded back to me to " verify '' that the debt is actually mine. I have disputed with the Credit Bureaus about this also and they always come back with that the debt is " verified '' without any proof. I have requested documents that include my signature, verifying the debt is mine. The last attempt I made with this company was back in XXXX of 2021 where i sent them a letter via " certified mail '', it was returned signed by someone who i assumes works there but they " neglected '' to put the date that they signed it when clearly they have 30 days to respond. They never responded and today is XX/XX/2021. This collection is damaging to my credit.

I received a call for merchant adjustment service around XXXX XXXX XX/XX/XXXX about a medical debt. I didn't consent to this debt collector to my personal. The lady that called me threatened me that if I didn't pay the debt, they were going to pursue legal action and offered me to pay only 20 %. Under 15 USC 1692 ( I ) Nothing in this subchapter shall be construed to authorize the bringing of legal actions by debt collectors. Merchant adjustment service is also in violation of 18 USC 894 for using my consumer report with extortionate means as a way to coerce and swindle me into making payments on an alleged debt not owned. On XX/XX/XXXX my daughter had dental work done we have dental insurance at the time so some of it was paid. On XX/XX/XXXX I paid last payment and got a receipt saying patient balance XXXX. I call the insurance company today and got them to look into the account and see if they have proof that the insurance paid their part and they did. I called the collection company today and the lady kept saying I owed it and that that receipt was old and that I owed it. I told her it clearly says patient balance zero. She was not making since. If you see a statement that says the patient balance is zero how can you argue that. I told her do not contact me again about this no more letters which the only letter I have is the one I got today. From the company 's CFPB response I have concluded that they are still presenting false information about my complaint and as a side note this company is openly violating The HIPPA Law. Under the FCRA, unverifiable accounts must be removed within 30 days and if you are unable to provide me a copy of verifiable proof ( i.e proof of the alleged items, specifically the contract, note or other instrument bearing my signature ), you must remove the fraudulent account. I received a response to the complaint I initially filed with the CFPB today ( XX/XX/2022 ). I did not receive the items I specifically requested in my initial letter to the collection agency ( XXXX XXXX XXXX ). The collection agency merely forwarded a letter summarizing charges they claim are due. On XX/XX/2023, Merchants Adjustment Services indicated in complaint XXXX XXXXXXXX they are in BILLING stages and not COLLECTIONS yet they advertise themselves as a 3rd party COLLECTIONS company. Merchants Adjustment Services therefore FALSIFIED their status, holding, and intention of this alleged debt in my name. Based on their FALSIFIED response to CFPB, this company needs to be investigated and held in contempt of federal laws. In my previous complaint, I also referenced the debt is related to identity theft and to cease and desist all communications. Merchant Adjustment Services failed to address those two issues in my original complaint. My FTC Identity Theft Affidavit was attached to the original complaint and in violation of federal laws has disregarded this affidavit.

I sent a letter to Merchants Adjustment Service to validate an account they are reporting on my credit report with XXXX XXXX XXXX XXXX. The certified mail letter was received by Merchants Adjustment Service on XXXX via USPS tracking number XXXX. I have notified Merchants Adjustment Service that the referenced debt they are attempting to collect is the result of identity theft. I requested proof that the debt is mine, including proof of the identity document ( s ) provided to the original creditor as well as a SIGNED contract of agreement to pay to the original creditor. MAS only provided a printed sheet from their database with generic information. MAS did not provide any proof that the debt belongs to me. Merchants Adj Service has willingly reported to the three credit bureaus a debt of {$91.00} XXXX XXXX XXXX XXXX. I never received a notice of right to dispute by mail from them at my Current address. I have contacted them several times demanding they remove the reporting and resend the file to my medical insurance provider as my claims are covered 100 % by either Medicare or Medicaid in the state of KY. They have ignored all attempts to comply to the FCRA on reporting and the FDCPA on the proper procedure of rights to disputing. I was told that if I didnt pay the balance in full to them on behalf of XXXX XXXX XXXX XXXX that they would begin to report on my credit.
