I am concerned about possible collusion and did not contact them : My Lender Member First Mortgage , LLC XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, TX XXXX Phone : ( XXXX ) XXXX XXXX Tile and Escrow Companies and Settlement Agents XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, NM XXXX Settlement Agent : XXXX XXXX XXXX ( XXXX ) XXXX XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, NM XXXX Settlement Agent : XXXX XXXX XXXX ( XXXX ) XXXX XX/XX/XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, NM XXXX Settlement Agent : XXXX XXXX XXXX ( XXXX ) XXXX As I understand it is my privilege, I chose the title company for my refinance, closing on XX/XX/XXXX. I also chose the location of that company 's office that was most convenient to me, and I knew its location. When I arrived for my closing appointment with XXXX XXXX, on Academy with XXXX XXXX, I was informed that XXXX XXXX was no longer with the company and had taken my documents to her new company. Attachment : A. Original Closing Disclosure XX/XX/XXXX, XXXX XXXX XXXX XXXX with XXXX XXXX. **How is it possible that the title company I chose was changed to an entirely different company and my documents were taken there? - without my knowledge or permission. I was distraught and called my lender, who claimed to know nothing about this. He and his assistant had told me they had known the XXXX for a long time, had closed with them multiple times, and were highly respected. I need clarification about how my lender could have been discussing and processing my closing without knowing that XXXX XXXX was no longer with XXXX XXXX and had illegally taken my file to her new company, XXXX XXXX, and Escrow. ** How could my lender complete my closing documents without knowing that XXXX XXXX was no longer with XXXX XXXX and had taken my documents to her new company? **Was this arranged to assure XXXX XXXX received another closing for her young company 's year-end? I panicked. I agreed to take my closing to the new company to preserve my closing date. This was the first I had heard of this company ; it was located in a part of XXXX I was unfamiliar with, and I had to stop to get help finding the office. When I received my original closing documents, it was required that I receive and sign them three days before my closing date. The Closing Disclosure for the new company was generated in less than two hours, and I closed on the same day with XXXX XXXX and XXXX. I had never seen the documents, let alone three days before my arrival. Many of the totals and charges were different, Attachment : B. Second Closing Disclosure XX/XX/XXXX, at XXXX XXXX and Escrow on Sun XXXX with XXXX XXXX. XXXXWhy wasn't the required three days before closing applicable in this situation? When I closed with the new company that afternoon, I never met with XXXX XXXX. She only stopped briefly in the hallway to say, " we will do better in the future. '' This was the first time I had seen these closing documents. It was challenging and painful that the Notary was exasperated and impatient because I wanted to read through the entire packet! I had asked for XXXXhirty minutes. Instead, she returned every 5 minutes, asking me to sign the documents. I was repeatedly forced to ask for additional time, bullied, shamed, and begging for each additional 5 minutes. **Why wasn't I given the time I needed to review the new documents? The following day I continued to be distressed and angry about all that had transpired. ( I was in a 5 hours XXXX XXXX assisting my brother ). I was furious that a company I had not chosen stole my documents, wreaked untold havoc in my life, AND made money from my closing! Then I remembered my " right to cancel '' option. I canceled. My new closing was delayed for another month into the following year ( XXXX ), destroying my holidays and ability to follow through on my year-end financial commitments. I had withdrawn and canceled the closing with XXXX XXXX and XXXX. That is the equivalent of it not having happened at all. I should've been able to close in XXXX. Inexplicably, my lender said all my documents had to be re-reviewed by their company. Over a month later, my third attempt at closing was with the company I had initially selected, XXXX XXXX. They chose not to honor my location request. I was told I would go to their other office if I wanted to close with them. I was forced to travel to the west side of XXXX, thirty minutes one way from my home, and became lost. Attachment : C. Third Closing Disclosure XX/XX/XXXX, at XXXX XXXX on XXXX XXXX with XXXX XXXX. I was treated like a pariah at this meeting. When I entered the building, no one from XXXX XXXX was present. The XXXX XXXX, XXXX XXXX, did not attend my closing. The only individual present was a Notary waiting for me in the lobby. He went through the documents with me, and my signatures were notarized. I left without having seen anyone from XXXX XXXX. On their website, there had been a joyous photo of a client after their closing. I had dressed for the occasion as I had in XXXX. Needless to say, no photo was taken. I am elderly, XXXX, and have a complicated financial history. I had gotten through almost everything before closing on this refinance in XXXX and again in XXXX, only for my lender to discover some anomaly preventing closing. Finally, I made it to my third closing in XXXX, only to be greeted with this devastating and unimaginable event. The Settlement Agent at the office had left the company and stolen my documents. I regret that I wasn't able to enquire about this event earlier. I have been on Federal XXXX XXXX XXXX, XXXX, and XXXX for the last twelve years. I have been caring for my XXXX XXXX brother since XXXX. Because of being treated this way, my emotional distress significantly affected my ability to care for my brother. The subsequent delay of my refinance funding caused me great embarrassment, humiliation, indignity, emotional vulnerability, and shame. My brother died recently, and I am beginning to take care of my personal commitments and paperwork as I struggle to recover from his loss. For these crippling and devasting events, I want to receive the maximum compensation RESPA allows from my lender, both title companies and settlement agents. Do NOT DEAL WITH MEMBER FIRST MORTGAGE EVER! This mortgage company was dumped on my lap by XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX when I applied for mortgage. It was. a HUGE mistake to get TWO TEN years mortgages from this company. This place has a huge training and staff turn over problems. They get most of their business indirectly so there is need for good customer service. I have two CLOSED mortgage accounts with Member First. Account number XXXX was PAID SATICFACTORLY & CLOSED in XX/XX/XXXX and account number XXXX was PAID SATICFACTORLY & CLOSED in XX/XX/XXXX. For the past NINE years I been trying to resolve a simple debt collection with XXXX XXXX XXXX XXXX, that slowly spun into a XXXX XXXX case through legal loop holes use - complain number XXXX. Member First Mortgage took secondary part in this collection SCAM by unnecessary inquires to drop my credit score DOWN, false credit reporting, sharing my financial information and creating difficult financial situation for me. Both companies assumed ownership of my credit report and were determined to destroy my credit. It was a fun game for them that last NINE years. I was busy trying to survive sustaining their XXXX I did not have the time to XXXX back. My lack or response kept them at it non stop, digging them selves into a DEEP hole. I was hoping this nightmare to END. but it did not. They took me for a XXXX Only a XXXX thinks all others are XXXX. Earlier this year after complaining about XXXX XXXX XXXX XXXX FRADULENT continuous HARD inquiries on my XXXX report. All XXXX broke loose. After NINE years, the only thing they have to hurt me with is my TWO mortgage accounts with Member First company. My mortgage accounts credit reporting is completely destroyed. it is taking a lot of time and money to fight back. Non Stop daily FRADULENT credit report updates. I print my credit reports daily. These XXXX are determined to break the law and violate my consumer rights With such ABNORMAL behavior they should not continue as financial institutions. For the past two months Member First Mortgage is leading an all out assault on behave of XXXX XXXX XXXX XXXX against me. Here is what is taking place with my credit report. XXXX FRADULENT updates : Account XXXX great focus on NEGATIVE account and payment comments. Payment history no accurate. Payment status reporting PAST DUE 60 DAYs instead of PAID SATISFACTORILY. My wife contacted Member First Mortgage around XX/XX/2020 to start the process to apply for re-financing of the existing mortgage on our house at XXXX XXXX XXXX, XXXX XXXX, Florida XXXX. The application was submitted on or about XX/XX/2020. The house has a solar panel array, which is subject to a lease with a company known as XXXX XXXX. In order to process the re-finance application, XXXX was required to subordinate its lease to the expected new mortgage with Member First. Member First informed my wife and I, that XXXX had not submitted a subordination agreement to them, and was not responding to their efforts to contact Member First to complete this process. We were also informed that, but for XXXX 's failure to provide a subordination agreement, we would have been able to close on the re-financing. My wife received a communication to that effect around XX/XX/2020, and this was a continuous excuse throughout XXXX, XXXX, and into XXXX Blaming the delay on XXXX was convenient, and it worked on us for a time, but it was false. While it was difficult to get in touch with Sunstreet ( nobody would return my wife 's calls XXXX, I did receive a response to an email I sent on XX/XX/2020. In that response, XXXX confirmed that it had delivered a subordination agreement to Member First ( or the title company preparing the closing documents for the re-finance ) on XX/XX/2020. When I informed Member First of this information from XXXX, I received confirmation that the title company had in fact received the subordination agreement on XX/XX/2020. Member First then told me that XXXX had to sign a new subordination agreement because the " loan amount was increased. '' I never authorized an increase to my loan amount, and, indeed, had not made or authorized any changes to the loan amount. A few days later, Member First sent me another email stating that XXXX had not signed the subordination agreement. I do not think this is a true statement either because I have not been provided with any confirmation that this true. Even so, that was on XX/XX/2020 XXXX and Member First also suggested that they were working diligently on processing the application, even though the most recent attempt ( allegedly XXXX at communicating with XXXX prior to that was on XX/XX/2020 ). In addition to the falsehoods, it appears that Member First has abandoned the re-finance application, after we have spent {$550.00} on an appraisal ( which was not consistent with proper appraisal practices, and merely assessed the house at the rate of inflation, rather than taking into account at least 2 sales of homes in the same neighborhood ). We also had to pay a " subordination fee '' of {$250.00} to XXXX, which also seems to have been a waste of money XXXX XXXX is not subject to CPFB jurisdiction -- as far as I am aware -- so this complaint is not necessarily directed at that entity. ) I definitely would like to re-finance my mortgage, but Member First does not appear to be competent to handle that. If a re-finance is not possible, I need to have the expenses I have paid reimbursed to me. The expenses include the two items referenced above, but there may be more ; I am waiting for confirmation of that from my wife.

In XXXX I went into XXXX XXXX XXXX XXXX to apply for a mortgage. At that time I supplied all requested documents including the last 2 years of my taxes. I was quickly approved for {$60000.00} which I asked for then after three months of looking I was approved for {$65.00} because I found a home for that amount. It was okay that someone else 's offer was taken. I found a home and that's when I was approved a second time at the {$65000.00} price point. The home I found was listed at {$59000.00}. I offered an additional {$2000.00}. I was moving towards closing and Member first Mortgage begin asking me for documents which were already submitted. Then after submitting them they ask again for the same documents, over and over again even after sending me an email stating they had all the documents. As time passed and I heard nothing regarding closing I begin to inquire as to the status of closing. I had previously been given an expected closing date of XX/XX/XXXX. However, I was told on XXXX that the underwriters had suspended my loan and no one knew why. I called the bank and was told there was no problem and I should be closing. I called the bank and was informed by the new Bide Pres. of banking XXXX XXXX that the Vice president of banking XXXX was let go a And he was brought in to correct the many mortgages that were messed up. XXXX at Member First Mortgage who was coy told me my income to debt ratio was 84 %. My challenge is they had my taxes w-2 and 1099'since XX/XX/XXXX and no one ever said a word. I have gone from looking to the appraisal process I knew nothing of this and the underwriters looked at a home I had turned down and even sent me the truth in lending papers. The whole process was botched from lost papers over and over again to not properly reviewing the papers to being told by XXXX that " You are approved to close. We will be closing on the XXXX. They refunded my {$520.00} appraisal fee because they admitted the debacle Stinked. I am expected to move out of my place. Where am I going until my loan closes WITH ANOTHER LENDER? '' The complete process was unprofessional and deceptive, unorganized and disingenuous. Needless to say, I called XXXX XXXX who assured me that he would handle it and call me back. Neither of the promises was kept. It is my sincerest hope that NO ONE is made subject to this type of treatment from XXXX XXXX XXXX XXXX or Member First Mortgage.

I am a XXXX with XXXX XXXX XXXX in XXXX MI. I am writing a formal complaint against Members First Mortgage out of XXXX XXXX Michigan. They are by far the worst mortgage company I have ever worked with. They are sloppy in their paperwork, nobody returns phone calls, they say they send out documents when they never do. They don't have universal underwriting standards. In the 10+ loans I have closed with them, not one has closed on time, one took nearly 6 months for no good reason. I have had several clients switch lenders because of how poorly they were treated. I am working on a current loan where they are requesting receipts for repairs that were not part of the appraisal and were personal things asked for between the buyer and seller. The seller was able to fix many of the issues himself and therefore doesn't have receipts, this is the first time in my 5 years of working with them that they have ever requested receipts of repairs. They are extremely rude and have had issues with processors making my clients cry due to frustration with their questioning. Very accusatory and not customer oriented. They have already had to remove one processor XXXX XXXX due to her lack of customer service skills and the person they replaced her with is no better. I have attempted to contact XXXX XXXX who is the mortgage originator several times and have only received a return phone call once. They demonstrate gross negligence and general inconsistency with their practices. I am starting to feel like they are singling me out personally and giving me a hard time on purpose. I am feeling discriminated against and would like my complaint to be on file against them.

Problem # 1 - My husband and I applied for, and obtained a mortgage thru Member First Mortgage ( XXXX ), on our joint account, at XXXX XXXX XXXX XXXX XXXX XXXX ), on XX/XX/2021. Months later, we discovered that XXXX had changed our mortgage loan, from our joint account, to an account that I had with my daughter, without our permission, and my husband is not on that account. See attached documents ; Current monthly statements. Problem # 2 - My husband and I began paying our mortgage, on XX/XX/2021, with each check clearly label ( i.e. check XXXX 1st payment, etc. ), as it was due on XXXXThis would reflect current monthly statements a month ahead, but it does not. See attached documents ; Check numbers XXXX thru current checks. Problem # 3 - Written documents from Member First Mortgage are inaccurate, See " Loan Activity Report '', dated XXXX/XXXXXXXX and XX/XX/2021, which does not show the same dates the checks were cashed, per XXXX XXXX XXXX XXXX records.. Telephone contacts with several Member First Mortgage representatives, during this time, remained definitely unclear and did not provide me with the Check # ; Date Cashed ; Principal Amount ; Interest Amount ; and Remaining Balance.

The loan was all set to close. On XX/XX/2021, we received an email from XXXX XXXX of Member First Mortgage, regarding the closing disclosure which included a fee of {$33.00} for an employment verification. We request information on this transaction and received no response from XXXX XXXX We had submitted check stubs up to the finial time of the closing, which the employers name and phone number was available. Please review the receipt from the XXXX XXXX XXXX order by XXXX XXXX of Members First Mortgage. If XXXX wanted to verify employment she could have contacted the employer or addressed in concerns with my husband. At one time she was questioning the hours he worked being shorten. He hauls gasoline which the pandemic we are going through all over the world caused his company to shut down this year, as well as reduce the number of work hours for all drivers in the company. We have asked everyone about this charge no one seems to know why the charged is placed on us or should it be the responsibility of Members First Mortgage? Members First Mortgage would not provide us with the attached receipt we had to obtain it from another source.

I applied to refinance my FHA loan to a conventional loan because of the cost of mortgage insurance. At first I was told by the new bank doing the refinance that they could get rid of my mortgage insurance to lower my monthly payments from XXXX to about 1600.00. That did not work out for some reason. About a week ago I spoke to the representative of The lender broker of XXXX XXXX XXXX XXXX and she assured me I will be able to save XXXX a nd that will increased to XXXX because my mortgage interest will disappear. On Friday evening (XX/XX/XXXX), I received the final figures for closing on Wednesday XX/XX/XXXX. This is what I found: 1) my interest rate is gone from 4.750% to 4.875%. 2) My principal has jumped from $XXXX to $XXXX 3) Instead of the XXXX dollars I was promised to save XXXX I will save XXXX. When I factor in my new interest rate and the new principal I gain nothing. I am therefore not going to sign any documents to finalize the refinancing.

Member first mortgage continues to report an incorrect balance due to the credit bureaus. XXXX XXXX XXXX reported an increase to the balance due of XXXX. XX/XX/XXXX reported an increase of XXXX to the balance due. XX/XX/XXXX reported an increase of XXXX to the balance due. So, they reported a balance due to the bureaus of XXXX But if I login to my account, the actual balance due is XXXX approximately. I have asked them multiple times to fix it starting XX/XX/XXXX. Instead of fixing it, they added more to the balance XX/XX/XXXX. I keep getting excuses from them that they are working on it, it's a system error, blah blah blah. A dispute has been filed with XXXX and also a complaint with the local XXXX. Nothing has been done.

New hazard insurance in force XXXX XXXX. This premium was paid by mortgage company. A letter to me was sent on XX/XX/XXXXXXXX explaining that lower taxes and insurance amounts have resulted in a lower payment and that they know I have an escrow overage. They won't allow the lower payment to take effect until XXXX even though they've sent in writing that my payment is {$490.00} a month lower. The letter said a check refunding the excess would be attached. It was not. I try to call them and they're constantly on voice mail. No one ever answers live. I am also filing with the XXXX and the Texas State Attorneys General.

Member First Mortgage ( through an " error '' ) released all of my credit report to my ex-husband without my consent. He is refinancing the mortgage on our marital home to buy me out of my share. My name is NOT on the application, and we are no longer married, but they provided my entire credit report to him without my consent or knowledge.
