I believe the Banking Institution from which I have an Auto Loan, is violating Consumer Protection Laws such as the E-sign Act as well as general negligence and fraudulent activity. I logged into my account back in XXXX and noticed I was being asked to opt into E-statements. I then realized I had only been receiving e-statements for the life of the loan. They never actually sent me a physical statement in the mail. I called their customer support and told them this. The first agent I spoke to told me that I should have been receiving statements in the mail if I never opted in and put me on hold. She came back and told me that if I wanted to start receiving statements in the mail, I needed to opt into e-statements and then opt back out and they would start sending statements in the mail. I told her that didn't make any sense and that I shouldn't have to opt-in then opt-out to receive a statement in the mail. She said that was the only way they were going to be able to send statements in the mail. I hung up and called back to speak to someone else. I told this next person the same thing and again, they said that if I never opted in I should have been getting my statements in the mail and it looks to be an error on their end. I asked to speak to a supervisor. I was forwarded to XXXX XXXX and told him the situation, he agreed that I should have been getting statements in the mail if that was the case. I told him that I wasn't, and I have proof that I wasn't because I opted into USPS Informed Delivery and got an email sent to me every day with an image of all the pieces of mail that were delivered on that day for the past 4 years. He then changed his stance and stated that they did actually have a record of me opting into e-statements. I then asked him to provide me with proof. He emailed me a blank attachment, which I can provide as supported documentation. I told him the attachment didn't have anything and he acted like he didn't know why that was, but they have a record of me signing. I told them if they do have a record then I'm not the one that signed it and want to investigate fraud on my account. He said he would do so and have their team look into the matter. I received a letter in the mail on XX/XX/XXXX from their XXXX XXXX department from XXXX XXXX detailing that they were informed of my call with XXXX and they are responding to my demand for proof. I can provide the letter sent to me as supporting documentation. They stated that their records show that I signed up for e-statements on XX/XX/XXXX with an IP address of where I registered and considers this matter closed. I looked up the XXXX address 's location online. It pinged to the building I currently live in now. However, I didn't start living in this building until XX/XX/XXXX. I can provide the first page of my rental agreement as proof. It is impossible that they have a record of me opting in for e-statements on that date in XXXX with the location of the IP address they provided. I have reason to believe that this isn't just a technicality with my account. I believe this is systematic and probably how they normally conduct loans with their customers. I don't believe they have any records of their customers opting into e-statements. I think they send e-statements by default, regardless of whether a customer opts in. However, I don't think it's due to any environmental effort to save on the use of paper. I think they are systematically and fraudulently depriving people of the ability to properly pay their remittance under the terms of the loan. I wish to file a complaint to see if this banking Institution is violating the E-sign Act by not having a customer 's explicit consent in receiving electronic statements in lieu of paper statements sent via mail.

Today I have been trying to log into my bank account because of another issue from my other credit card, who has been very patient with me though this. I have not been able to log in and when I try to change my password or user name I receive a message stating that they are unable to validate my information. I havent had any problem logging in, after they showed me how when mechanics took over my bank, ( b**** c******** b*** ) until now. The problem is explained and so is the solution. I also received a letter today from XXXX services stating that they raised my APR because of what they call serious delinquencies among other issues. After receiving this disturbing news I called the local branch and found out that XXXX no longer works there, so the issue is all my fault because they do not believe me. All one has to do is look at the history of my banking and they will find that I have never missed a payment for the past XXXX years. The damage this has caused me is beyond my ability to fix. My credit score just bottomed out from high of XXXX. I had just received a 0 % credit card, which I take full advantage of, offered me XXXX line of credit, which after signing up and getting approved was reduced to XXXX for this reason. I need that XXXX line to pay off XXXX of my other cards. I should have been a banker, because I do all this in my head. This is a violation to SCRA by Mechanics Bank, who did not obtain a court order for repossession. I informed Mechanics Bank via usps certified mail on several occasions, that there is a billing error on ( t ) he account, ( which is subrogating me as the representative to my Federal agency, assigned social security number account ) and to provide me with evidence confirming that the CAR ( Certificate of Automobile ReceivablesCapital Adequacy Ratio ) was sold over the counter, and why the balance on the automobile/motor vehicle has not been cleared. For the fact that a promissory note security was issued and granted a security interest to which Mechanics Bank, who sold the CAR ( Certificate of Automobile ReceivablesCapital Adequacy Ratio ), however the balance was not cleared, nor have I received any dividend payments, from the non-transfer of ownership interest, whereas Mechanics Bank have not perfected a security interest from a promissory note signed by me, being the authorized representative signatory on behalf of Federal agencies, Social Security Number account, for which it seems Mechanics Bank has misrepresented my assigned SSN account for my identity, and has committed consumer fraud by legal fraud of contract. I also requested that Mechanics Bank validate the debt. I requested the actual accounting showing Mechanics Banks real losses, Verification of claim against me ( a sworn affidavit or a hand signed invoice in accordance with The Bills of Exchange Act 1882 ) A copy of the formal contract signed by both parties and therefore binding both parties to the agreement. Proof that Mechanics Bank is the real Holder in Due Course to security interest that is beneficially owned through Federal agencies. After no response, I provided another tender of payment in good faith, via registered mail, which was not applied to the Mechanics Bank custodian account on behalf of my assigned Social Security Number account, in order for Federal agencies to keep a record of interest-bearing debt securities and credit liabilities. Mechanics Bank being the servicer to security interest beneficially owned by Federal agencies, made no attempt to communicate with me in writing despite my several attempts in good faith to set off Mechanics Bank custodian account balance, for Federal agencies, Social Security Number account. After still no response, Mechanics Bank stole my automobile/motor vehicle off of private property without answering my billing error letter or giving a response pertaining to a non-cash item delivered. The address listed as the " towed from '' address was falsified. It was stolen from the private driveway XXXX XXXX, Nevada, XXXX. The certified copy of the UCC 11 confirms there is no other valid lien on my automobile/motor vehicle. My legal person is protected under SCRA and I demand for my vehicle to be returned, because a court order was not obtained, therefore my automobile was stolen, not repossessed by the servicer, who is liable to collect payment and record the financial public revenue unit transaction with Federal agencies, on behalf of my assigned Social Security Number Account, for which Mechanics Bank fraudulently claims is my identification.

When I contacted the collection company, I was told the account was sold to : XXXX XXXX : This collection company never sent me a notice that they had this account in their office. He informed me that if he was to accept a settlement offer from a charged off account that was already closed, they were adding interest to this loan. The account is charged-off and closed, but they wanted to collect an additional {$4300.00} on a debt that is uncollectible due to the statues being up on this account. The vehicle was repossessed in XX/XX/XXXXXXXX ... Charged-off, and then sold many time to different collection companies, from one collection company to another collection company. Because no collection company kept the debt, and the original creditor Mechanics Bank sold it, they decided to say they now had the debt back in their office, when just the day before, XXXX was working on helping me locate the collection company that had bought the debt. Therefore, the debt was paid when the collection company purchased the debt from Mechanics Bank back in XXXX. I am playing catch-up with my escrow account because of Mechanics Bank incompetence . I relied on them to be truthful and accurate. Mortgage Loan was transferred to this servicer in XX/XX/XXXX. No welcome Letter, no introduction. One bill from their XXXX XXXX site. XXXX ... There is no internet site to review mortgage information. All correspondence is email or mail. I have contacted them via phone but they don't have a Mortgage Loan specialist... The people I talk to are only interested in Auto or Banking transactions. It takes 25 mins to find someone who understand mortgage loans. I have to send payment by USPS mail because they do not have Bill Pay. Payments sent via mail sometimes get lost. I had to wire money into the account so it would not occur late fees. Terms and conditions for ACH are unacceptable to me. The ACH form says they can withdraw any amount from my account they deem fit. I refused to sign that ACH form. My refusal to sign the ACH form has saved me many times from their mistakes. Some other issues I have experienced with Mechanics Bank in the last 3 years : 1 ) Mechanics Bank tried to make me pay for my HOA insurance changing. They sent a demand letter for it. They admitted their mistake but it could have put me in a hardship. 2 ) Wire mortgage payments because they were losing mail. Had to resort to sending certified mail to get tracking. 3 ) Escrow account mistakes causing me a undue hardship. In response to Consumer Financial Protection Bureau Complaint XXXX Revised Letter On XX/XX/2023, I went into XXXX XXXX XXXX XXXX to see about the possibility of purchasing a vehicle. My father and I went to XXXX XXXX XXXX on XX/XX/XXXX to trade in my XXXX XXXX for a XXXX XXXX XXXX. We told our salesman as well as the sales manager, XXXX that we were starting a new business and this vehicle is for the business. We made it clear to them that we were using my fathers credit and my income in order to try and secure the loan. They ensured us that wouldn't be a problem. During the financing process XXXX explained to us that we were going to receive a call from XXXX XXXX for a phone interview. He told us we need to lie to the interviewer and tell them the truck is only for my father. We told the banker that this was going to be a company vehicle and we explained to him the same situation we explained to XXXX. We did not secure the loan from XXXX XXXX. XXXX told us that he had us approved by another lender. We signed all of the paperwork, cleaned out our car and left with the new truck. Two days later XXXX called and told us that the new lender was calling for an interview. This was obviously confusing because we had already signed and been in our new truck. He told us that we made exceptions with the bank and we wouldn't need to verify our income through documentation but we needed to lie to the bank and tell them that my father made {$4400.00} in cash as well as $ XXXX monthly in Social Security benefits. All of this was untrue and we made it crystal clear to them that my father had no income. When XXXX with XXXX XXXX called we explained to him the situation and told him that the XXXX dealership was asking us to lie to him about our income and we refused to do so. We told them that we would only be speaking to them through text or email since they have proven themselves to be untrustworthy. I have not received a Loan Statement from my Second Trust Deed account from Mechanics Bank ( formerly Rabobank ) since XX/XX/XXXX. Nor do I have access to an electronic statement account record on my online banking profile. I continue to pay this account on time monthly as agreed. On XX/XX/XXXX I contacted online banking customer service and was advised by XXXX XXXX in customer service the account status was preventing the account from showing up on my online banking profile. I was directed to call the mortgage department at XXXX a non-working number for assistance. Thursday XX/XX/XXXX I contacted Mechanics Bank main Customer Service number and was directed to the voicemail of XXXX XXXX Loan Collection Specialist. I received a return call from Ms. XXXX on XX/XX/XXXX stating the issue was resolved and I should have access to my Loan account online ( this issue remains unresolved as of XX/XX/XXXX ). Approximately XX/XX/XXXX I went in person to my local Mechanics Bank at XXXX XXXX XXXX XXXX, CA. I was advised they could not help me, and redirected me back to Ms. XXXX. I emailed MsXXXX XXXX on XX/XX/XXXX, XX/XX/XXXX. Last Ms. XXXX noted was the account was escalated to her manager. I have yet to receive a response from Ms. XXXX or her managXXXX. The representative stated as I had paid the account early, no statement was sent as there was no payment due. I then adjusted my payment to be paid on time. And still, have yet to receive a paper statement. On XX/XX/XXXX, I again inquired with online customer service requesting electronic access to a statement of this account on my online banking profile. I received a response from XXXX XXXX who stated the account was not available because it is managed by the Special assets group and " Only Special Assets can release that restriction. '' I was advised to contact Special Assets directly, however was given no direction on how to contact Special Assets. My aunt passed away in XXXX of XXXX and left me as the the executor to her estate. Being unfamiliar with the process of obtaining her possessions, I hired a probate attorney to handle the estate and am still waiting for the orders to be signed by the judge. On XX/XX/XXXX, I received my first phone call from XXXX XXXX, an employee of Mechanics Bank. He was trying to obtain information regarding the auto loan balance on my aunt 's vehicle. He called both me and my brother multiple times in the following two weeks. Our lawyer advised us not to communicate with him as everything was still in the probate process, however, my wife decided to call him back on Wednesday, XX/XX/XXXX to access the situation. XXXX asked her what our intentions were with the car. My wife communicated that we would like to pay off the balance and keep the car. He said that she needed to send him the death certificate and will, stating me as the executor to her estate, and then he would be able to disclose how much is owed and we could pay off the balance. My wife immediately sent an email with requested documents and we waited to hear back. Two days later, the car was repossessed in XXXX, IL, either late Thursday, XX/XX/XXXX or early Friday, XX/XX/XXXX. Upon discovery of missing vehicle, we contacted XXXX XXXX who informed us that, yes, the car was repossessed. Both me and my wife spent the entire day on Friday, XX/XX/XXXX, communicating with different employees, managers, and supervisors of Mechanics Bank. We received multiple different explanations as to why this happened and heard a lot of " our hands are tied ''. They would not disclose where the car was, or how we could obtain our possessions from the vehicle, or how we could pay off the balance and get the car back in our possession. They lied and screened our calls and bounced us from one person to the next, up until the office closed and it was the weekend. This continued on Monday morning, XX/XX/XXXX, with the same result - nothing. We have requested a release to be sent to the company where the car is being stored so we can at least go and obtain personal belongings from the car. The company will not comply. We have requested to pay off the balance and get the car back. The company will not comply. They have both the death certificate and the will, yet will not allow me to move forward. We are worried that they will sell the car or have already sold the car. We need answers and honesty and we are getting neither.

I obtained a car loan with Mechanics Bank in XXXX of XXXX. In XXXX of XXXX, I refinanced with XXXX XXXX whom paid off Mechanics Bank in full and the account with Mechanics Bank was closed. Mechanics bank also released the lien and transferred title to XXXX XXXX. XXXX XXXX obtained the payoff amount of {$22000.00} through their automated system which was good until XX/XX/XXXX. This payoff amount/good thru date is also on the XXXX statement I received from mechanics bank. The payoff was received by mechanics bank and processed on XX/XX/XXXX, XXXX payment for {$20000.00} and another on XX/XX/XXXX for {$2200.00} which totals {$22000.00}. As of XX/XX/XXXX it was reported to the credit bureau that the account was paid off and closed. On XX/XX/XXXX I checked my credit report and seen Mechanics Bank reported that the account was open again and there was a {$2600.00} balance. I called Mechanics and spoke with XXXX on XX/XX/XXXX. He said that the payoff made in XX/XX/XXXX was short by {$2600.00}. I asked how it could be short so much, especially when we have proof of the payoff amount they gave us. Not only that, if it was short, why am I finding out about this 5 months later. He said on XX/XX/XXXX there was a payment of {$2500.00} made to my account in error by Mechanics Bank themselves. They didnt realize this error until XXXX of XXXX. Now they have fraudently re-opened this account after already closing it and marking it as paid in full. Aside from this, they released the lien on my XXXX XXXX and transferred title to XXXX XXXX. This HUGE error is not my fault nor should I be responsible for it. No one notified me of this error either. They just re-opened the account and reported this balance to the credit bureau. XXXX XXXX isnt able to absorb this {$2600.00} balance as that would require me to re-finance my loan with them which XXXX XXXX does NOT offer. Now Im expected to make two separate car payments. One to mechanics bank at a 9 % interest rate for {$450.00} until this {$2600.00} balance is paid off. Another with XXXX XXXX at a 5 % interest rate for {$370.00} a month. This is not something I can do nor should I be liable for their mistake. This {$2600.00} wouldve been paid if it was included in the payoff amount we obtained, which it was not. Due to their mistake of applying this {$2500.00} payment to my account, they gave the wrong payoff amount and should be fully liable for this balance.

On XX/XX/XXXX, I purchased a XXXX XXXX from XXXX XXXX XXXX with Mechanics Bank who financed the vehicle. From the very beginning, the car had major problems that I was unaware of and could not have known. In the first week after purchasing the car I was forced to return it back to XXXX XXXX while driving it the warning light came on " XXXX XXXX '' the air suspension went out and the car lowered to an unsafe distance from the ground. XXXX XXXX XXXX sent the car out for repairs, however, two weeks after the repairs, the car lowered again to an unsafe distance to the ground. I had it towed to my local XXXX dealer, XXXX XXXX XXXX. When the tow truck arrived he was unable to line up the towlines on the front bumper, which appeared to be replaced and put on incorrectly. After the car was towed I reviewed the XXXX, though it had no accidents reported, there appeared to be a lot of work done on the car. As I called each company that had did repairs, this became a horror show, which each company stating that the car was not safe to drive, both bumpers had been painted over which rendered the sensors located in them useless. The previous technicians indicated that the car had been in an accident and appeared to be salvage. XXXX XXXX insisted I purchase an extended warranty which I did, however, I refused to use it to make repairs, as I felt they were preexisitiing and they would be made on my dime. Mechanics Bank is where the VA has placed disibility compensation due to congress granting VA the authority to appoint a fiduciary for a VA beneficiary who is rated unable to control or manage his or own affairs or under a legal XXXX and incapable of managing VA benefits in an appropriate manner. In some instances, the appointment of a fiduciary may necessitate the allowance of a fee from the benefits payable to me as payment for the fiduciary services provided. The XXXX has been requested to be removed due to incompetence of managing comepensation through the VA to contest their orginal decision, which by the way was denied according to the decision letter that was mailed to my residence. Also the VA failed to acknowledge the medical providers note to remove the fiduciary and overwhelming evidence displaying incompetence by the assigned fiduciary. In XX/XX/XXXX of this year a blocked ( needing an order from the court to withdraw monies ) savings account was opened at the XXXX XXXX XXXX XXXX XXXX Rabo Bank - now Mechanics Bank. A large sum was deposited ( proceeds from the sale of a residence ). On XX/XX/XXXX I contacted XXXX XXXX ( she was the person involved when the account was opened ) notifying her that a settlement had been completed and that the entire account that was opened was awarded to me and that I wanted to withdraw the money to deposit it in my own bank. She stated that I needed to send her the settlement agreement in its entirety ( 24 pages ). I did so that same days to her email address. I made a few calls early the next week and left messages that were never returned. I was able to contacted XXXX Wednesday of that week ( XX/XX/XXXX ) and she informed me that she had forwarded the paperwork to " legal '' and that they would be issuing a check later that week. Was contacted by XXXX by phone with apology stating that it had been busy. No email with tracking number. Checked account status ( Thurs XX/XX/XXXX ). No withdrawal or check had been made. It has now been 2 full weeks since my withdrawal request was made! Contacted call center again. Spoke to Supervisor XXXX ( direct # XXXX ). He assured me that he would look into this personally. 6 hours later XXXX informed me that the check had been made and would be sent out that day along with a tracking number. My complaint is that I believe that there is a timeframe that the bank has to release funds. It is not 2 weeks! On XX/XX/XXXX I submitted a complaint about Mechanics Bank wrongfully withholding my funds that were fraudulently taken from my account in XX/XX/XXXX. Mechanics Bank had informed me it would not credit back my funds for 6-8 months in spite of my demand for return of my funds. '' Firstly, if in fact Mechanics Bank had saw fit to do the right thing and return my {$4000.00} I never would have had to hire an attorney and incur the {$500.00} expense. Secondly, Mechanics Bank employees have never saw fit to ever contact me in writing or otherwise. Therefore I NEVER received any type of letter, " Honor, '' or investigative report result or telephonic contact to advise of any type of result or return of my funds. Had Mechanics Bank personnel saw fit to return my funds and advise of doing so I NEVER would have had to contact the CFPB. Mechanics Bank Auto Finance claims an installment contract with my alleged signature was purchased by them. This installment contract contained a questionable VIN number. I requested validation, investigation, and reinvestigation, but Mechanics Bank failed to provide actual proof of their claim. As they have failed to produce results time and time again, I have been left with ruined credit and financial turmoil. After I revealed to Mechanics Bank that the VIN number was indeed inaccurate, Mechanics just updated their account information to reflect the correct VIN description as : XXXX, to match the contract. I called the DMV several times and requested a lookup of this VIN and my suspicion was confirmed that the number is not registered. My next question naturally is how could they have allegedly sold me a vehicle if the VIN isn't registered? Please see the attached documents from the DMV of XXXX. The attached form provides a description of the vehicle ( VIN ) that XXXX XXXX ( XXXX XXXX XXXX, XXXX, XXXX ) and Mechanics Bank Auto Finance have claimed to be correct. The DMV has verified my suspicion that this VIN is in fact not real and XXXX XXXX and Mechanics are tying me to a FRAUDULENT contract. A 30 day late was incorrectly placed on my credit report and I have placed countless calls to Mechanics Bank to try and rectify this error. They continue to lie and cover up their mistakes and not letting me speak to a supervisor who the customer service agents say that is the only way to fix the issue but they are never available. I've asked them to " run their tapes back for quality assurance '' but that request is also ignored. Call was made to Mechanics Bank to inform that I would be making a payoff to complete the loan debt on XX/XX/23 and I was informed that not only would the account be noted but it would not be reported. Proceeded as such and made the payment online as I was instructed and informed that I can do without issue. Soon after I get a notification from my credit reporting application and when I checked it thats when I noticed my credit suffered a drastic hit albeit the debt was fully paid. Called my contact to inform her of what happened and she was shocked to why it happened especially with my account showing paid in full and account was closed, yet at that time it was reported as 47 days late at the time and again hit my credit report. She advised that a supervisor would contact me which never happened. This led to yet an email to customer service and a cc : to the CEO including documentation showing and establishing that I held my end of the bargain and needed my title finally released. Late fees of {$15.00} per month on the account summary portion of the Mechanics Bank Auto statement, but on the payment coupon further down the statement shows late fees ranging from {$15.00} ( correct late payment fee ) on XX/XX/2022 statement, but each statement after XX/XX/2022 having overcharged with the highest amount being {$75.00} on the XX/XX/2022 statement. I've been trying to catch up on payments on my account but the varying fee amounts are making me fall further behind. On the XX/XX/XXXX payment due date coupon, it shows {$75.00} in late fees. On the XX/XX/XXXX payment due date coupon, it shows {$60.00} in late fees. Then again in XX/XX/XXXX, it shows {$60.00} in late fees as well. On XX/XX/XXXX it shows {$45.00} in late fees. XX/XX/XXXX shows {$30.00} in late fees. XX/XX/XXXX shows {$15.00} in late fees which is the only month where it seems correct. Every other month it seems like it was being duplicated two to five times what it should've been. From what I understand, late fees are {$15.00} per month according to the account summary on the estatements but I've been overcharged by quite a bit for the last five months. So bluntly, on XX/XX/XXXX we officially did not own the vehicle. At the time of the deal, the representative at XXXX advised us to make our upcoming car payment ( due on the XXXX ) to avoid any delay in paperwork processing. The representative assured us that we would be reimbursed for this payment. So fast forward to XXXX ; when we called Mechanics Bank on XX/XX/XXXX, they informed us that we would receive a reimbursement check by XX/XX/XXXX. So, on XX/XX/XXXX, we called Mechanics Bank and told them we had not received our reimbursement check. The Mechanics Bank representative told us they would have to check with another department and they would call us back. Before I filed bankruptcy in XXXX, I called Rabobank ( name at the time ) now has changed to Mechanics Bank accounts department, to let them know I was filing bankruptcy. At the time I had a credit line overdraft on my checking account which I owed around {$500.00}, never paid late always on time. I asked them what was going to happen with the credit line would I loose it with filing bankruptcy they indicated that I wouldnt loose because it was a part of my checking account. I then never added it to my bankruptcy which discharged in XXXX. I had no problem after paying on overdraft and it still remained open then in XXXX I got a letter in mail from Rabobank at the time telling me they closed my overdraft and said it is a account added it to right then in XXXX to my bankruptcy. I went in to bank and called several times talking to managers and account specialists trying for them to tell me how they can add my overdraft account to a already XXXX discharged bankruptcy for which was not a added account to it and they couldnt give me any answer. On XX/XX/2023, I went into XXXX XXXX of XXXX to see about the possibility of purchasing a vehicle. I did sign a piece of paper that XXXX XXXX XXXX will ask for identification to confirm how I am and that is all I signed, once. This is in regards to my account with Mechanics Bank : Within the calendar year of XX/XX/XXXX, I was charged a total of {$4400.00} in NSF fees, and have already incurred {$260.00} so far in XXXX of XXXX ( and today is only XX/XX/XXXX ... ) Last year, I think my taxable gross income was only around {$50000.00}, so I have been drowning beneath these fees, and I can't seem to climb out of this cycle. I have had to continuously resort to high-interest payroll loans in order to try to keep my head above water, which obviously only results in more money lost. Every time I try to keep a safe cushion of money in my account, I end up falling behind and incurring more fees because I never seem to be able to catch up. On XXXX 2020. I went inside Mechanics Bank XXXX XXXX in XXXX California to withdraw XXXX dollars out my pre paid XXXX XXXX XXXX card from unemployment benefits. The teller asked me to give her my card for the transaction, so I did as she asked. She came back to the window and explain to me the transaction for the withdrawal was approved but she couldnt issue me my money due to a bank code my bank card did not issue. She explained to me that the money came off my card, but she could not release the funds to me. She said that the problem had happened to a fair amount of other people. But it was nothing they could do, that I would have to wait for it to be returned to my card. I have been financing my vehicle through CRB auto for two years. I have proof of all payments made each month from the beginning of my loan with the confirmation numbers. There has been at least one, what they claim, to " accounting error '' each month with my bill. Online payments made are not applied to accounts correctly and the interest assessed on each payment far exceeds a compounded break down throughout the calendar year, according to the yearly APR signed and agreed to in the financing contract when the car was purchased. I purchased the vehicle in XXXX of XXXX, for {$16000.00}. To date, I have paid a total of $ XXXX in payments and still owe {$14.00}, XXXX according to my last statement as of XX/XX/XXXX. This company is criminally mishandling payments and illegally compounding interest rates weekly/monthly. My payment due date changed four times with no communication of the change or consent from the borrower, in the first eight months of the loan ( all of which is documented ). CRB auto has claimed missed monthly payments on billing statements online, and charged interest and penalties accordingly even though the payment was made ( confirmation numbers available to confirm and prove payment ). I previously signed up to take a course. With XXXX XXXX XXXX. However this class meetings would not allow me to enter the XXXX lessons although they kept sending me text messages. I sent Correspondence to the instructor via text and he or she never responded to my texts after the site red flagged a warning at this time I contacted Mechanics Bank and informed them to please return the fees they had taken out of my account. As executor of my brother 's estate I sold a piece of property securing a mortgage from Mechanics Bank. My late brother and a woman not his wife were co-borrowers on the mortgage ; her interest in the property was extinguished by court action in XX/XX/XXXX. In 2017, due to hurricane Harvey a declared natural disaster here in XXXX, Texas, My vehicle was totaled due to extensive water. My insurance company XXXX at the time, had me get a payoff amount from Mechanics Bank Auto ( account # XXXX ). Once received My insurance company paid out the vehicle in full to mechanics bank auto, and the account was closed. After this transaction I never heard from mechanics bank again. I have never received any bill or paperwork that stated that I owe {$81.00} which was later charged off by Mechanics Bank Auto. There is no way mechanics bank should be able to verify that to the credit bureaus and I questioning what investigative means was used to gather such info. The account should be paid in full. After I disputed the info, the creditor placed a derogatory remark on XXXX and XXXX causing my score to drop from an already closed account. Mechanics Bank formerly Rabobank consistently and constantly applies our monthly payments incorrectly. Causing us stress as well as unnecessary late fees & penalties. We are continually on time monthly with our payments. We recently submitted a complaint and got a very professional letter and phone call of apologies ; expressing that it was done in error on their part and that it would be corrected and NOT happen again. That was incorrect. They continue to apply our monthly payments incorrect, assess fees and penalties to our account and report us negatively to all the credit bureaus. This has been in fact happening since 2011 at which point they put us into foreclosure did not rectify the situation we ended up paying XXXX for their errors/mistakes to get our home out of the foreclosure process. XXXX XXXX ( Mechanics Bank ) uses an app for loan payments. There is no way to adjust the payment amount to pay more than the minimum amount. If you want to pay extra, you have to send multiple payments. Quite often, if I send two identical payment amounts, the second is ignored. They make it super difficult to payoff the loan early by also limiting monthly payments to {$2500.00} dollars a month. I wasnt told that extra payments dont just go to Principal. I had to figure that out myself because there is no way to mark a payment as principal only on their app. When I asked how to get my extra payments credited to principal only, I was told I had to email every time after the payment and ask for it to be credited to principal. I started doing that in XXXX. The loan was initiated in XXXX this year. Over half the time, my payment still has not been credited to principal. My next loan payment currently isnt due until XXXX of XXXX because of these errors. I emailed multiple times to get this fixed. I was finally told to call customer service which I did on XX/XX/XXXX. They told me I have to email after every payment again and refused to fix my loan payment history to credit the extra payments to principal only.

I was part of a fraud scheme where I was hired for a job, instructed to make purchases on my credit card to be reimbursed by the company I was hired at, I was reimbursed, then two months later the reimbursement payments were flagged as unauthorized and returned to the company 's bank leaving me with an unpaid bill. I am not happy with Mechanics Bank. I tried to use my debit card at XXXX gas station in XXXX, CA on XX/XX/XXXX. It kept saying declined. I finally got authorization, only for there to be a permanent hold placed on my card. I went to two other locations to fill up my other car. There was still a hold. I spoke to customer service on XX/XX/XXXX. They were very rude. Talked over me and wouldn't let me get a word in. I also was told the fraud department called and text me. On XX/XX/2021 a letter of account closure was written, I received the letter around XX/XX/XXXX. The letter mentioned no reason to why they elected to discontinue providing me with financial services. It said that by XX/XX/2021 they will disable any debit card, online banking or bill payment access. It also mentioned that the account will be closed formally on XX/XX/2021. I made a payment, to CRB Auto/Mechanics Bank, on XX/XX/2021 for {$230.00}. When I went to pay my bill for XXXX, I noticed a late fee for {$11.00}. I had missed one payment and she repeatedly left messages, texting about my auto loan, when I had left her a voice message for her to stop searching and calling different numbers leaving messages and texts. On XX/XX/XXXX i called my auto loan bank and was told that due to principal balance low i would have to pay it off so it will not go against my credit. I agreed but I had late fees of {$840.00}. I had an auto loan with Mechanics Bank. I refinanced with XXXX XXXX. The day after XXXX XXXX paid the loan off with Mechanic Bank, on XX/XX/XXXX, Mechanic bank drafted my regular payment on XX/XX/XXXX. I was told this would be returned within 30 days, no sooner. It has not been returned. I have sent several emails. I have made several phone calls. Customer service is vague and unhelpful. They don't know anything and apparently lack the ability to find out. Mechanics Bank XXXX XXXX first called me to collect on an auto loan payment that was missed in around XXXX. When the agent called he did not properly verify who he was speaking to and gave all my information to someone who was not me. I spoke with two managers XXXX and XXXX about this issue. I was going to open a savings account, however, I did not open an account, because the employee tried to persuade me to open it and maintain it online and to receive e-statements, instead of paper statements. This has been an ongoing problem with end in sight. I was involved in a car accident, where I was rear ended and my vehicle was a total lost. The insurance company paid off my car loan and everything was clear. After the car paid, I see this charge on my credit report. I contacted the loan company, they informed me that the charge was sent to collection and they had no information about the loan. My car was totaled in an accident.The insurance company was in communication with Mechanics bank. Mechanics bank car loan accounts are being charged late fees and applying payments to the wrong accounts when utilizing their mobile app. Picture of XXXX accounts show that they are in the same mobile app. But you can only choose the XXXX XXXX because its the one with the oldest due date. I have had a HELOC with 3 consecutive banks, it keeps changing hands. The first didn't charge a yearly fee. The second did and took it out of my saving account. CRB Auto recently changed to Mechanics Bank, and now their website doesn't work. My car payment is due in 4 days and I've never had a problem paying my bill. Today I tried to log in but got an error message saying my user name or password was incorrect. A fiduciary account was closed with Mechanics Bank. A request for bank statements was requested but not provided when requested. At one branch location a request for a court order was required before bank statements. At another branch location the employee was unable to locate the account in banks computer. No record of a closed or a previously opened account was found. A request was sent by the employee to the research department with no record found of the account. The customer service center advised that statements can be requested with in the branch for a {$5.00} per statements. This is a violation of consumer rights for bank statements to be provided for customer own records. A complaint will be filed with the FDIC.

We are in the middle of purchasing a new home and need the mortgage statement of our current primary home.
