THIS IS NOT A DUPLICATE COMPLAINT. As stated previously, I do not have an account with this company. I have not given this company permission to share my information with any third party debt collector either. The creditor, XXXX XXXX, did not address the concerns in my first complaint, but rather provided an unprofessional letter of opinion about my character. Opinions can not be enforced by law but debt validation can. XXXX XXXX has provided conflicting information stating {$700.00} is past due, while Mcphail Sanchez is trying to collect an amount of {$3800.00}. Since you are certain this loan belongs to me, you should have no problem providing the requested information, or forwarding to the appropriate department for handling. It is illegal to continue to try to collect amounts not owed. As stated previously, I received a collection notice from Mcphail Sanchez LLC in association with XXXX XXXX XXXX XXXX claiming that I owe a debt in the amount of {$3800.00}. However, I have never had any business or financial relationship with this creditor, and I do not recognize the debt that they claim I owe. Despite my attempts to dispute the debt and request validation from the creditor, they continue to harass me with numerous phone calls, voicemails, and letters demanding payment for the alleged debt. The creditor has also threatened legal action and made false statements to me regarding the consequences of not paying the alleged debt. I believe that XXXX XXXX and McPhail Sanchez has violated the Fair Debt Collection Practices Act ( FDCPA ) by engaging in harassing and abusive behavior and making false statements regarding the alleged debt. As a third-party debt collector, you are required by law to provide me with certain information in order to validate the debt. This information includes the name and address of the original creditor, the amount of the debt, and a statement indicating that I have 30 days to dispute the debt. I have not received any of this information from you, and therefore can not verify the accuracy of the debt. I am exercising my rights under the Fair Debt Collection Practices Act ( FDCPA ) to request that you provide me with proper validation of this debt. I ask that you provide me with the information required by law within 30 days of your receipt of this letter. If you are unable to provide me with the requested information, please inform me in writing that the debt is not valid. Furthermore, their failure to provide proper validation of the alleged debt is a violation of my rights as a consumer. I am requesting that the Consumer Financial Protection Bureau investigate this matter and take appropriate action to rectify any unlawful actions taken by the creditor. Until such time as you have provided me with proper validation of this debt, I request that you cease all collection activities. This includes contacting me by phone or mail regarding this debt, reporting this debt to credit bureaus, or taking any legal action against me.
