XXXX XXXX have sold the debt to a third party orgination Called McNeil & Meyers with a charge off I have never received a 1099 - C for the cancellation of that debt, So there fore I will complete the IRS form 3949 A and send it to the CID. There is no Validation of debt. McNeil & Meyers have harrased me by calling my phone sent me mail, emailed me several times, and called my friend XXXX, How they got her number I don't know. all of this is a violation and will cost your company XXXX per occurrence. Every time you call my phone, call my friends phone, email me or write me letters in the mail. CEASE & DESIST. only mail me proof of Validation of the following request below. I need a Audit trail, Foward follow motion. A full disclosure. I. NOTICE OF VALIDATION REQUEST You are hereby in receipt of notice, per 15 U.S. Code 1692, that the above referenced file number and alleged debt, in part, or in whole, is now officially disputed. By the authority of the Fair Debt Collections Practices Act ( FDCPA ), all collection activities must cease until resolved. I affirm that said account ( s ) contain fraudulent or incorrect information. Transactions were not incurred by me nor any person with my authority, either expressed, implied, or apparent. You are obligated by 15 U.S. Code 1681i and 1692e ( 8 ) to inform all credit reporting agencies ( CRA ) or Credit Bureaus ( CB ) of the dispute. Further, verification, as of today, with the CBs or non-action of these requests is in violation of the FCRA and the FDCPA and is subject to fines. Verification and validation are demanded. Verification and validation are very different terms and ideas. Verification is making sure one actually owes the debt, see Chaudhry v. Gallerizzo, 174 F.3d 394 ( 4th Cir. 1999 ). The definition of verification according to Black 's Law Dictionary is... averment that the party pleading is ready to establish the truth of what he has set forth. ... The examination of a writing for the purpose of ascertaining its truth ; or a certificate or affidavit that it is true.. The court said Confirmation of the correctness, truth, or authenticity of a pleading, account, or other paper, by an affidavit, oath, or deposition. McDonald v. Rosengarten, 134 Ill. 126, 25 N.E. ( 1890 ) ; and Summerfield v. Phoenix Assur. Co. ( C. C. ) 65 Fed. 296 ( 1922 ) ; and Patterson v. Brooklyn, 6 App. Div. 127, 40 N.Y. Supp. 581 ( 1898 ). Validation is for disputing a debt, stopping collection activities until the debt has been confirmed, see Spears v. Brennan, 745 N.E. 2d 862 Ind. App. ( 2001 ). The definition of validation according to Black 's Law Dictionary is assessing an action to determine it is complete, correct, implemented and delivering the correct outcome. ; Oxford states it as to check or prove the validity or accuracy of something ; Merriam-Webster says , to show the existence or truth of, by evidence. II. VERIFICATION AND VALIDATION REQUIREMENTS The demands are, but not be limited to : 1 ) I invoke the Truth in Lending Act per 15 U.S. Code 1601-1667f, and thereby demand the afforded right to know who the true party of interest [ original creditor ] in this transaction is. 2 ) An authentic contract with wet-ink signatures, signed by both parties. Only a certified copy ( before trial ) and then the original ( demanded during trial ) of the said note will be acceptable. An affidavit of loss or any other form will not be accepted. If located in an off-site location, send information on where the original contract is and when it can be viewed in person. The maxim of contract law is, The basic elements required for the agreement to be a legally enforceable contract are : mutual assent ( agreement by both parties to a contract ), expressed by a valid offer and acceptance ; adequate consideration ; capacity ; and legality. XXXX ) Disclose what the money of the alleged debt is for, and explain how your organization calculated the total for the alleged debt ; including supporting documentation that gave rise to the alleged obligation that is claimed as owed per 15 U.S. Code 1692g ( a ) and 1692g ( b ). 4 ) Production of account and general ledger statement ( s ) showing the full accounting of alleged obligation. To be admissible as evidence ( sufficiency of pleadings by a fact-witness ), a signed affidavit by the person responsible for maintaining these records and having first-hand knowledge as to its accuracy and authenticity, able to testify under oath to that effect, is required. 5 ) Deliver proof your organization is a party to the transaction. You seem to think there is a right to collect when your organization never lent money to me. I have never signed any contract with you. You may have bought a note, but it was not assigned. American Jurisprudence 2d 73 states that The right of subrogation does not exist for a stranger to the transaction. Subrogation means to substitute and stranger to the transaction means a party that is not on the original contract. So, the right to substitute a third-party collector [ you ] into a contract, does not exist. The third-party has no rights if they did not give consideration in the original contract and were not mentioned on the contract or were any part of the contract; including loans transferred, assigned, sold, or changed hands in one manner or another. 6 ) Proof that the alleged account is not out of the states statute of limitations. 7 ) A copy of your license numbers and registered agent information to operate as a collection agency in this state [, save if in NC. 8 ) Stipulate for the record whether or not the alleged loan has been securitized, and if so, the name and all other information of the financial instrument the alleged loan is bundled with. 9 ) Where did the money or credit supposedly loaned or issued to me come from?

The following rule should be in the contract, if not that is a violation. The proceeds were supposed to pay for the debt but your company took the proceeds. When the obligation of this contract is fully met then the debt should have been fully paid by the proceeds. 1. According to the Holder in Due course Rule 6000 Consumer Protection states that 433.2Preservation of Consumers ' Claims and Defenses, Unfair or Deceptive Acts or Practices In connection with any sale or lease of goods or services to consumers, in or affecting commerce as " commerce '' is defined in the Federal Trade Commission Act, it is an unfair or deceptive act or practice within the meaning of Section 5 of that Act for a seller, directly or indirectly, to : ( a ) Take or receive a consumer credit contract which fails to contain the following provision in at least ten point, bold face, type : NOTICE ANY HOLDER OF THIS CONSUMER CREDIT CONTRACT IS SUBJECT TO ALL CLAIMS AND DEFENSES WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED PURSUANT HERETO OR WITH THE PROCEEDS HEREOF. If the seller fails to deliver what was promised, the consumer 's obligation to pay may be reduced or even eliminated. However, it is possible for a seller to arrange credit terms for buyers which separate the consumer 's legal duty to pay from the seller 's legal duty to keep his promises. 2. In XXXX I co-signed a bail bond contract with XXXX XXXX XXXX. There was a mis communication with the person I bailed out, they were to finish paying off the loan and they did not. XXXX XXXX I was contacted by XXXX XXXX XXXX XXXX XXXX XXXX XXXX. He told me that XXXX XXXX XXXX XXXX will be serving me with papers by the end of the day and I was being sued for the amount of XXXX but I could pay XXXX to be released of all claims and liabilities. So I paid over the phone and they sent over a letter via DocuSign stating I paid in full and I would be released of all liabilities. I also want to mention the bond number associated to the contract I signed with XXXX XXXX XXXX XXXX in XXXX is XXXX. On XX/XX/XXXX I receive a txt msg stating to contact law firm XXXX XXXX XXXX and if I fail to contact them I will be served at my place of employment without my consent. I did contact them they told me I was being sued by XXXX XXXX XXXX XXXX for a sum of XXXX $ or I could settle for XXXX but that is only if I set up payments by the end of the day. Also they told me they saw my payment of {$450.00} and they will put that towards my balance. Immediately I reached out to the finance department for XXXX XXXX XXXX XXXX, where I spoke with XXXX. XXXX told me I wasnt being sued by XXXX XXXX XXXX XXXX and my account went to collections agency Mc Neil & Myer. She also told me to ask the law firm what bond number was on my account on there end. So I called back XXXX XXXX asked for the bond number they told me it was XXXX, which was different from the contract I signed originally with XXXX XXXX XXXX XXXX. Also they told me the payment I made of {$450.00} I am not the co-signer of that bond. I then asked to speak with the supervisor at XXXX XXXX his name was XXXX. I politely asked XXXX if possible could he send proof that I was the co-signer for the contract they had on file? This is when the supervisor proceeded to yell and tell me he is not sending me anything and he doesnt have to answer any of my questions for I am the one who needs help from him and I should be answering all of his questions. XXXX was being very rude and disrespectful and he repeatedly kept calling me a young lady so I decided to end the call. On XX/XX/XXXX I decided to call the original collections agency Mc Neil and Myer whom XXXX XXXX XXXX XXXX passed my account to. I finally got in touch with someone from Mc Neil who stated they sold my account to XXXX XXXX and the balance I had was XXXX $ and the bond number was XXXX and not XXXX. My wife and I filed for Chapter XXXX bankruptcy on XX/XX/XXXX. The bankruptcy was discharged on XX/XX/XXXX with the final distribution signed by the judge on XXXX ( attachments provided ). One of the creditors listed was XXXX XXXX. The debt owed to that company was discharged with our other debts on XX/XX/XXXX. Fast forward to XXXX when we tried to refinance our home and found an adverse credit mark on our credit from a company called : MCNEIL & MEYERS RECEIVABLES MANAGEMENT XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, LA XXXX ( XXXX ) XXXX. According to our credit reports, the debt was placed for collection on XX/XX/XXXX. This date is 6 months after our bankruptcy was discharged and nearly a month after the final distribution. We had opened no new account with XXXX XXXX. I contacted McNeil & Meyers and sent a copy of the bankruptcy discharge paperwork showing XXXX XXXX had been included in our XXXX bankruptcy. They refused to take it off our credit report and said they could only comment it as a bankruptcy. We then disputed the debt through XX/XX/XXXX and XX/XX/XXXX ( XX/XX/XXXXdid not show it ). This what we received fromXX/XX/XXXX which is how we started the dispute : Direct Dispute Past Dispute XX/XX/XXXX Completed MCNEILMYERS Reported on XX/XX/XXXX {$0.00} Item Results Result : Deleted - XX/XX/XXXXhas deleted the account or record from your XX/XX/XXXX credit report. Dispute Reasons Accuracy : This account is not a collection or charge-off. This account is included in bankruptcy. Dispute Results From XX/XX/XXXX XX/XX/XXXX received your request on XX/XX/XXXX and completed their investigation on XX/XX/XXXX. I just got a message today about a new adverse mark on my credit report and this same debt collector has entered this same incorrect information on my and my ex-wife 's credit reports, showing that it was closed on XX/XX/XXXX and our account updated on XX/XX/XXXX. My ex-wife checked her report and it is back on hers as well. My wife and I have since divorced and both of us are getting ready to buy new homes and this will obviously affect our ability to do so or to get a better interest rate. I want this entry removed from my credit and this company advised to stop adding it to my credit. It was not a charge off, it was discharged in bankruptcy and this company knows full well that is the case.

This debt was placed for collection on my credit report. I never received communication from the company or collection agency. I became aware of the debt through my credit report and was not aware of either business. I filed disputes to remove the information from my report. I contacted the collection agency to obtain the documents. The documents held multiple handwriting samples. The information was not completely accurate. I have been victim of multiple data breeches. The documents do not hold my signature. I was not sure what to really do about it. I keep filing disputes on XXXX. XX/XX/2019 two collection accounts now appear for different amounts from the same company. I research find the FTC. I file a report with the FTC and follow the instructions. I have now had other issues affecting my accounts not just McNeil and Meyers. My first contact with McNeil and Meyers was good. I was advised to file a police report. I attempted to file the police report and the officer was not very helpful. I called and spoke with a different office the police officer spoke to and was treated unkindly. The representative XXXX XXXX would threaten me knowing I filed a police report for Identity theft - it is a felony and I only have to call the officer and let him know. It is not my signature on the document. XXXX XXXX would later agree it is not my signature ; want me to commit fraud by paying {$1200.00} and she would write it up I paid over {$3000.00} so I could sue the individual who signed the document. I had until XXXX to pay or she would send it to processing. They would review my assets and go after my house. I called back on XX/XX/XXXX at noon. I would not do this. XXXX XXXX was very angry and became more threatening to me on the phone. She would hang up. Before she did I would request information she stated she had and she denied giving it to me. I stated it was my right to have a copy of this and she stated I would see it when it was in processing. I called back and she put her supervisor on the phone. I told him about what she wanted me to do. The supervisor told me it would not ever come off my credit report and never call them again. I recorded all phone calls with McNeil and Meyers to demonstrate the accuracy of what was actually stated.

I had previously reached out to this company on or about XX/XX/XXXX, because I had something placed on my credit report, In the amount of {$700.00} dollars. I had no knowledge of where this account came from, they instantly removed the account from my credit report after speaking with them on the phone. Someone called on or about XX/XX/XXXX to speak to me about a debt that they had tried to collect, in that conversation I let them know that I only wanted mail correspondence and to stop calling me. A week later, I received another call from the same company, I stated on their recorded line that I only wanted to have a mail correspondence for my records. This company has called me every week and has yet to send mail correspondence. On XX/XX/XXXX, I was called again, I attempted to set up and arrangement with the company in order to pay back said debt although the debt had not been verified, after asking them how much they had paid for the debt, I was offered a payment plan for {$350.00} dollars, I was sent an email with a portal to pay but with no set amount and with no account information. XXXX XXXX then told me that this account would be added to my credit report and that I had to pay it or it was destroy whatever I had planned for the future, I was also told that they were not a debt collection agency and that they were lawyers hired to get their clients money back. On XXXX XXXX, the same company called my mother in law and then myself about the same debt and again on XX/XX/XXXX and XXXX. On XXXX XXXX, I was called in the middle of a job interview and was immediately dismissed. These calls have gone from down right annoying to straight up harmful.

I noticed the collection agency reporting negatively on my credit report. I reached out to them to verify the debt and once it was verified I was offered a settlement offer to remove all of the three bail bond accounts from my credit report. I informed the collection agency that I would have to forward the settlement offer to my attorneys to see if they can assist me financially with the debt because I am in litigation with the client of the bail bonds accounts. Unfortunately, my attorneys could not assist me with this debt. So, I reached out with an update to the collection agency and was offered a lower settlement offer to remove all three of the accounts from my credit report. However, there are two other cosigners on the bail bonds accounts who were not sought after and the settlement offer was not divided amongst three people. I feel that it is an unfair amount of money that the collection agency is expecting me to pay without seeking any payments from the other cosigners who will benefit off of me paying the settlement offer myself. I informed the collection agency that I am a single mother on welfare, a fixed income, unemployed, and just had an additional child, and that I was ordered not to work by my doctor. The settlement offer has a deadline to be paid by XX/XX/2021 and I can not afford to pay that due to my situation and the unfairness of the other cosigners not being held responsible to pay their portion of the debt as well.

In XX/XX/XXXX, I was admitted to an XXXX XXXX XXXX XXXX XXXX and I began seeing the XXXX XXXX XXXX at that facility. XXXX XXXX and I did not have a standing, recurring appointment arrangement. Every time I visited for an appointment, we would schedule the next appointment before I left the office. I cancelled my XX/XX/XXXX appointment because I was in rehab and seeing a XXXX XXXX. XXXX XXXX then booked ongoing appointments every 3 months for me in XXXX without my knowledge or consent. The {$220.00} debt, which has now been sold to a debt collection agency ( XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, LA XXXX Phone : ( XXXX ) XXXX ), is related to the appointments booked for me without my consent. I can not be charged fees for missing appointments that I did not schedule. I originally attempted to settle the issue with XXXX XXXX in XXXX, but the office refused to accept that I did not schedule the appointments and I do not owe the debts. I have since made 2 attempts to dispute XXXX 's report on my XXXX credit report, but XXXX and XXXX refuse to accept that I did not schedule the appointments and I do not owe the debt.

This company, McNeil & Meyers Receivables Management Group LLC of XXXX LA alleges I owe a company {$2000.00} for some service that was never rendered to me. They were representing a creditor who I have worked with in the past but due to them not actually performing their obligations to me, stopped paying. The collection company refuses to prove how they actually acquired this debt or how they came up with the number owed. Today on XX/XX/2023, I wrote to the company and their managing partner XXXX XXXX as above explaining that I do not owe anything to the creditor they are servicing on until they actually get the documentation proving that I am the signatory on the debt and a clear accounting of the debt. They refuse to give me anything as they said " we are merely a servicer '' which is vague. In the last email, the person who I was communicating with, I offered a settlement of {$100.00} even though I owe XXXX to the creditor to get them off my back and they refuse to discuss anything other than they will continue to report erroneous information to the credit bureaus and deliberately harm my reputation. I sent a debt validation letter to the collection agency XXXX XXXX XXXX regarding three collections accounts from them that are on my XXXX credit report and received no response. I requested debt validation because I have no knowledge of these accounts nor have I ever been contacted by this agency regarding them. Two of the collections are actually for the same amount of {$2500.00}, which seem to be a duplicate of one that is being reported twice. The third collections from them is for {$1500.00}. It shows opened accounts XX/XX/XXXX. I have no knowledge of the opening of these accounts and have no idea for what these bills are even for. A debt validation letter was sent to them around XXXX XXXX and I have not received any response from this company. They have failed to provide me the information I requested to validate the alleged debts they are reporting. This company is unethical and possibly fraud for ignoring my letter which requested them to provide the validation of these alleged debts. I have also filed a complaint with the XXXX. I had an account through XXXX XXXX I called XXXX On Wednesday XX/XX/2020 at XXXX I tried calling to make a payment. But they would not allow me to make that payment. Because they tried telling me that was a month behind. But i have proof of all the payments. They refused to take my payment unless I made a double payment to them. I have paid off all my creditors but there are 3 items that are inaccurately on my report that needs to be taken off. All three bureaus said over the phone and online that the account has been verified. I received a copy of a contract that had another address on it so they blacked it out with a marker, it shows a electronic signature that isn't my original signature. Since 2017, McNeil & Meyer has been trying to collect a debt for XXXX XXXX. Throughout that time I have denied the validity of that debt and have asked for debt verification. After I had made an initial payment another collection popped up on my XXXX report. An employee of McNeil & Meyers left a voicemail saying that they would be moving forward against me in my county and if I wanted to avoid litigation I needed to call their office and take care of my debt.
