XX/XX/2018 I obtained a pre approval for a conventional mortgage on a new build home in XXXX WV. The pre approval was obtained at behest of the realtor who unbeknown to me was NOT licensed for real estate in West Virginia at the time. When I first called the Realtor her website and she stated she was licensed in Virginia and West Virginia. She referred me to McClean Mortgage to obtain a pre- approval. She did not at the time disclose that they shared office space and financial affiliation with this lender and lender representative by Name of XXXX XXXX. The weekend of XX/XX/2018 I met the realtor at a new home build that I requested to see. The realtor was XXXX XXXX. Ms. XXXX arrived with a gentleman she introduced as her husband. We met with Builders representative and went over details of home and build information. The Next day we again met with builders representative and when I was asked about financing the Realtors husband XXXX XXXX interrupted me as I was beginning to answer the question and informed the builders representative that I had already gotten approval for financing through another company. As this was first time I was building a home I was taken aback and was not sure how to respond. I felt a little railroaded. They would not allow me to speak with another lender and threw paperwork in front of me to sign immediately using their lender. Again this was happening very fast and I was taken off guard. I then spoke with the Lender Rep XXXX XXXX of McClean Mortgage and was I feel I was bullied into a RATE LOCK. It was not explained well and I made multiple attempts by phone and email to get more explanation but was told I had to send check for XXXX immediately to the realtor by certified mail the next day. I did this and then was told that 60 days that rate would be locked. This was last communication I had with the Lender McClean Mortgage and XXXX XXXX until XX/XX/2018 when I continued to complain by email as to when rate would be looked at and locked and received no answers. Again heard nothing until the builders representative and myself both attempted to reach the lender, XXXX at the end of XXXX and after multiple conversations found that the rate lock was never done and lender took my money and never monitored the rates as they are supposed to do. They then wanted additional money to extend the rate lock but the builders representative spoke to them and they backed off of that. Also We then got the loan disclosure statement which the numbers were way off many numerical mistakes were made and the transfer taxes were not listed either. She acknowledged the mistakes and tried to fix them but by now I was very uncomfortable with the lack of communication and mistakes made. The stress it caused was immense and not necessary. They could not even get right numbers on disclosure statements. I could no longer trust them so I went with a different lender. Emails and financial forms and text messages attached.

I live in Florida and my mortgage company is located in Virginia. I have a construction loan that is at the end of the final draw. {$45000.00} is 10 % of the {$450000.00} loan that's being held. Every time I have had a concern or issue with the builder I have addressed it with my lender. It got to a point where they got fed up with me always complaining about the suspected fraud and concerns for the third party company they hired to inspect my home. I have brought up my concerns about this company and not in agreeance with them approving certain draws but they told me that it doesn't matter that at the end I will have the final say and 10 % will be held and to let the builder do his job. It's been two years of dealing with this nightmare. I confided in them, trusted them to act in my best interest but they have completely disregarded everything I have told them -- like the builder defrauding them, misallocation of construction funds, plans submitted to them do not reflect draws they have authorized, draws that their inspector approved as 100 % complete, not complete. I was advised that 10 % would be held until CO, lien waivers, final walkthrough, and all final inspections pass by the county but I recently received an e-mail from them advising that the house is 100 % complete when none of the inspections have passed, CO not complete, and survey not done. The construction loan matured several months ago but its no fault of mine. They granted extensions due to the significant issues at hand but refuse to talk with me over the phone. I am concerned that they are maliciously trying to approve my final loan without getting lien waivers ... another concern I brought up on multiple occasions.. subcontractors not paid for the work they did on my house. I just want answers. I've never been through this process and completely trusted that they would act in my best interest to guide me through it all and they have done nothing to help get this loan closed. I have paid interest totaling over $ XXXX! The last e-mail I sent was on XX/XX/2020 requesting information about closing, releases of liens, a phone call to me, requested to be the point of contact for the appraiser but to date, no one has reached out to me. Am I not entitled to call? Am I not entitled to have my loan transferred? Am I not entitled to exercise my legal right and demand answers? How can they just refuse to talk on the phone? It's a shame that I have to specifically indicate in each e-mail that my conversations are to be kept in confidence. Because if I don't then they run off and call my builder letting him know I've complained once again which worsens things between me and the builder. I can't even keep a conversation between myself and the lender in confidence. The biggest mistake I made was trusting a company not located in Florida.

We closed on our place recently. The closing documents we received from the title company contain blank forms with only a signature, missing notarization, and lastly with regard to the termite inspection is inaccurately completed. E.g. the name of the pest control company on the form is completed with the mortgage companies name. We've asked the lender multiple time for an explanation and none has been provided. The lender claims " the loan is closed '' and there's nothing to do. We've asked the lender to resolve these errors and they are refusing. They've asked us " what's your motivation? '' " what answer are you looking for '' via a phone call last Friday. I response that I would like them to respond one of two ways : 1 ) There was a clerical error and we will correct it. 2 ) There is no error. The latter of which, seems suspicious since other council to us has advised that these forms are required for a VA loan and certify appropriate housing conditions & new home warranty. If the lender will not provide the completed documentation, this seems fraudulent - we would like this resolved by having the errors corrected and new completed documentation sent to us. We are also asking for the completed closing package that the bank has for us to make sure those documents match what we returned to the title company.

On recommendation of my realtor, my wife and I approached McLean Mortgage Corporation based in XXXX, VA, and loan officer XXXX XXXX, in XXXX Virginia, about obtaining a preliminary estimate ( Loan Scenario Worksheet ) for a lot/construction loan for a potential future purchase. Our initial conference call was on XXXX/XXXX/15. No specific land or dwelling was specified, and we did not formally apply for a loan, nor did we sign any documents with McLean. On this call, I clearly stated, as my wife can verify, this was to understand estimates for closing costs, and NO credit report should be pulled, as it could impact our credit score adversely if we went with another lender. In a subsequent face-to-face meeting on XXXX, XXXX XXXX admitted she HAD pulled our credit, without written, email or verbal approval. Subsequently, we determined we were not going to pursue new construction at this time. Unannounced, I was very disturbed by a letter from McLean in the mail XXXX/XXXX/15 titled " Statement of Credit Denial '' with a loan number for purchase of property NA. Since we did not formally apply for a loan, there should not have been any loan tracking number, amount or interest rate!

We dealt with McLean Mortgage and XXXX XXXX was our loan officer. We had to pull out of our contract and loan to buy a home due to personal emergency reasons and with that being said, instead of respecting our decision, she took the matter into her own hands by calling my husband 's Human Resource department multiple times asking about his job security. XXXX XXXX was in no position to do this. This was not her place to do that. By her doing this, she made my husband 's life at work a lot tougher and much much worse than it was. XXXX yelled at my husband and cursed at him and told him that he was full of XXXX and that we were both acting childish. This is not how you speak to another human being, let alone a XXXX woman. She also said, '' why do n't you just get the house, and if your husband loses his job, after a month or so, just get a new one! '' By her telling us this, this lady should not be a loan officer anymore because this tells us that she has written up many loan applications to people that ca n't necessarily afford it, has no integrity and she degrades people and is absolutely awful to the clients.

I have been notified by the City of XXXX Department of Finance that McClean Mortgage ( XXXX ) my mortgage servicer failed to pay the following expenses from my escrow account : Property taxes : {$4500.00} - due XX/XX/XXXX My account indicates that a city tax payment was removed from my escrow account on XX/XX/XXXX, however the funds were never received by the City of XXXX, and the website has no evidence of where the funds were actually disbursed to. When I attempted to contact the company on XX/XX/XXXX I was put on hold and sent through a phone tree before finally being brought to a voicemail box with no response. I've also submitted several contact forms via their website with no response. The city is now charging a penalty of {$450.00} and {$100.00} interest, for a total of {$5100.00} due by XX/XX/XXXX. We feel McClean Mortgage should be responsible for these fees and interest based on the non-payment of taxes despite removing the funds from our escrow account. And, we have no update on the location of the {$4500.00} that was removed from our escrow account that did not make it to the tax office.

I recently applied for a mortgage with Mclean Mortgage Corporation. Although still married, I was fully qualified for the loan on my own and provided them with all information required for settlement. I was scheduled to close on the property on XXXX XXXX and on XXXX XXXX I was told by the mortgage company that unless I provided the underwriter with a detailed statement outlining the status of my marital situation and a signed statement saying that neither of us would seek child support or alimony in the event of a formal separation agreement or XXXX they would not approve my loan. My husband only XXXX month secured his own mortgage through another mortgage company ( same salary, same assets and same access to joint accounts ) was not required to provide the level of documentation I was nor was he required to provide a similar statement regarding alimony or child support. I did not feel their ask was fair or relevant to my qualifying the loan. Needless to say, I had to sign a letter, along with my husband, stating what they asked in order to close on the property on XXXX XXXX.

I was denied a mortgage refinance for a lower interest rate, VA guaranteed for my personnel property. The decision to deny the loan was based on my credit report. At that time my credit report carried XXXX negative items. XXXX items were paid off XXXX XXXX and the third items should not have been on the report. Currently, all negative items have been removed from the credit report. We dealt with the mortgage company five months ( XXXX XXXX thru XXXX XXXX ). During that period they ran my credit report four times. Bringing my credit score done even more. The appraisal expired, the appraisal fee {$450.00} was non refundable and the low interest rate also expired. A written request was mailed to the mortgage company, recently asking that the inquiries be removed and there has been no response. First, I did not give them permission to run my credit report four times and second because the numerous inquiries lower my credit score, it prevented me from acquiring financing from another institution

On XXXX XX/XX/XXXX we officially closed on the sale of our house ( statement of satisfaction received, funds transferred etc.. ). The buyers took over our loan under the VA assumption program. The VA assumption process has not been finalized as of XXXX XX/XX/XXXX and the loan is still under our name even though we no longer own the home. The mortgage company ( McLean Mortage Corporation ) is now harassing us with letters and phone calls stating we are in delinquency, even though they are working daily with the VA to get the assumption process completed. The mortgage company did not get the assumption paperwork to the VA until XXXX XXXX ( 2 weeks after we closed on the home ) and the VA has had to go back to them several times to get additional documentation because they failed to send the correct documentation multiple times. This has caused us severe emotional stress and anxiety and we feel there is no one that has our best interest in mind.

My XXXX XXXX agent referred mi to a guy named XXXX with Mclean Mortgage and I told him that I was out of state & not to pull my credit until I meet him in person. Since he never returned any of my calls I assumed he wasnt interested until I recieved a credit monitor alert that Mclean Mortgage used XXXX XXXX different times to access my credit report I disputed with XXXX that they were impermissable and contacted his boss CEO XXXX XXXX to addressed my complaints. I asked him by phone to remove any reference of affliation with his company. He agreed according to these enclosed responses but has not gave XXXX XXXX manager XXXX XXXX the formal release on letterhead by fax or email as he promised XXXX XXXX.
