I am under contract for a property located at XXXX XXXX XXXX XXXX, XXXX, Maryland XXXX effective as of Friday, XX/XX/2022. As part of the mortgage process and due to the volatility of interest rates, I interviewed multiple mortgage lenders one of which was Equity Mortgage Lending and their agent or representative XXXX XXXX. On Tuesday, XX/XX/2022, I made a decision to proceed with an alternate lender and executed their initial disclosures and locked my interest rate. I had no further communication with Equity Mortgage Lending and did not execute disclosures or any other documentation implying that they were the agent I had chosen. Shortly thereafter, I had a home inspection done and continue to proceed towards closing. I believe on XX/XX/2022, my current lender attempted to order an appraisal and became aware that the FHA Loan # was being HELD by Equity Mortgage Lending and requested an immediate transfer. They appeared to respond promptly and indicated that they transferred it to another company in error which we now find to be false. Apparently, they have gone back and forth and received multiple excuses until I became aware of the situation yesterday, XX/XX/2022. Because of the holiday, I waiting until this morning to again ask XXXX XXXX XXXX and Equity Mortgage Lending to release the FHA Loan #. He was clearly upset and verbally berated me for not proceeding to close the loan with his company and said that he " will get to it when he can. '' This is beyond unacceptable and clearly in violation of my rights as a consumer. In my opinion, this is not only unprofessional but I am at risk of not only losing my contract, but also losing the earnest money deposit and the advance fees I have paid to close on my home. Further, as interest rates continue to rise, I may also fall outside of the lock period and suffer additional damages which I will seek to recover if the FHA Loan # is not properly released today, XX/XX/2022. I am asking for your assistance in forcing this transaction and the re-assignment of my FHA XXXX # to XXXX XXXX Mortgage.
