Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficient of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT METRO 2 data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX , XXXX , and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The XXXX XXXX XXXX, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. MARKONEFIN bal. {$0.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. XX/XX/XXXX I accepted a new job with the State of Maryland. Since I had a prior state debt my wages had to be garnished. This caused me to fall behind in my car payment to MarkOne. I have numerous email back and forth keeping them in the loop as to what was going on. I even had to move and provided them with the updated information. Even after making a agreement to bring my account current in XX/XX/XXXX the exact same day I communicated with someone by email my car was repossessed days before XX/XX/XXXX. I was so angry I called and forward all of my communication with a supervisor to MarkOne. They realized their mistake and instead of making me pay the storage fee and late charges to get my car out the nice supervisor instructed me to make the payment of the missed car payments totaling over {$1100.00}. She advised me that she would place all the other charges on the end of my loan note. I did just that and was able to get my car back days later. Now I am being harassed EVER SINGLE DAY AND NIGHT for the late fee amount. Not even my car payment amount. They are calling my job several time a day threaten to turn my account over to the recovery team. My payment is {$390.00} for a XXXX Honda Accord with over XXXX miles. Because of everything I went through financially I am still trying to recover so when I send them {$300.00} in a payment they still call and harass me saying they payment wo n't post because it 's not the full payment so its still as if I have n't made a payment at all. This is ridiculous. I need my car to get back and forth to work however I do n't need this emotion stress of trying to pay my bill and still looking out my window wondering did someone get it wrong again and send someone to get my car. I have had it. I am a single mother. My income is the only income in my household. I ca n't afford to make a payment every two weeks I make a payment once a month and I should not be harassed in doing that. I received another letter on Friday stating the late fee and charges have totaled over {$1300.00} is this is the case why is it not on the end of my loan agreement as agreed when I got my car back? This was even stated on my repo recovery sheet when I went to pick my car up so why am I still being harassed to pay this amount. If I had it I would have paid it by now. I have even tried to refinance this through my bank and was told I could n't because the car was sold with over XXXX miles on it. Then I tried to trade it in. When the dealer called Markone they said the pay out on my vehicle was over {$8000.00}. This car not even work {$3000.00}.

I received my 3 credit report and there are some inquires that are listed on it that NOT mine.. I contacted XXXX several of times. With contacting them they told me that I needed to contact every creditor on my report and obtain a letter of the deletion. Everyone that I contact advised me to dispute with XXXX repeatedly. In XXXX 2015 I sent {$1500.00} along with my regular car payment of {$300.00} for XXXX, 2015 to my car loan company ( Mark One Financial ). Along with the {$1500.00} check, I wrote a letter stating that the {$1500.00} was to go toward my principle. I had also written that in the memo of the check. Today I get a statement stating that my next payment is due XXXX 2015 and my payment only {$31.00}. I called Mark One Financial and spoke with XXXX, who would not give a last name. I asked her why my {$1500.00} had not gone to my principle. She stated that all payments would pay the interest XXXX. I told her it was not a regular payment and that I had sent a letter with that check stating that it was to go toward my principle. She then stated that their system did not work like that. I became upset so she put me through to her manager XXXX XXXX, who has no XXXX name, she stated the same thing. She brought up the contract, so I asked her where in my contract does it state that. She said she did n't know she would have to look at it. She then asked me if I was going to get upset over {$17.00}? Now I 'm furious, no where in my contract does it state that any principle or prepayment would go to pay interest XXXX I then told her that I would be filing a complaint, to which she stated she would be contacting her attorney. I told her good and hung up.

I purchased a vehicle about one year ago around XXXX ... .. I was sold a vehicle from a used car dealer named XXXX ... .. I gave them XXXX down for a 2008 XXXX XXXX .... What XXXX XXXX did not disclose was he had obtained an title loan on the vehicle ( FRAUD ) ... .... To make this long story shorter ... .. He never paid the title loan back & the car has a lien on the title but yet he was able to get me financed through Mark 1 Finincial ... .. Now from what I know now mark 1 should have did a title search to make sure title was free & clear ... .. I do n't know what they did but I am now paying a car note on a car that has a lien on it ... .. Mark 1 told me they would take care of the problem and to continue too make my payments on time ... ... That 's was about 4 or 5 months ago ... ... Last Tuesday they told me they would not be able to help me & that I would have to figure it out on my own ... ... It 's to my understanding now that whoever has the first lien on the car has all rights to the vehicle ... .. So that would mean the title loan company has the rights to the vehicle & mark 1 has none ... ... So I would like a full refund of my money I 've been paying the last 11 months ... ... They want me to pay off a loan for nothing ... ... They ca n't produce clear title if I pay off the vehicle

Well, in XXXX of 2016, I had an automobile financed with MarkOne Financial Services located in XXXX, FL. Here in Ohio, the customer never holds the actual vehicle title. After realizing that I never received a paper lien release in the mail or notification that the lien was released electronically, I called MarkOne Financial. On or about XX/XX/2016, I called and explained to XXXX XXXX that information. She in turn advised me that there was a small balance of {$150.00} and that in exchange for the balance in full, she, on behalf of MarkOne, would remove any and all prior delinquency of my payment history because of this unknown small balance. On XX/XX/2016, I authorized payment to clear out the balance. Additionally, I have the dated email from XX/XX/2016, from XXXX XXXX stating the above facts. I sent MarkOne XXXX certified letters. XXXX to the physical address and the other to the address on my actual credit report. The physical address was returned as being undelivered, but the POB letter was signed for. I call the USPS and was told that the POB was NOT assigned to MarkOne Financial, BUT they could not tell me the current owner of that particular box.

Markone/XXXX is maliciously and intentionally reporting inaccurate information on my credit report. I have disputed this account numerous times and it has been illegally verified as accurate. Every month they have update my credit report with a balance that in no way shape of form matches the information that they have sent me. Every time that I dispute the account, XXXX comes back as verified as accurate while XXXX and XXXX have both deleted this account in 2017. I had provided the same documentation to all three credit bureaus however, XXXX will not remove the account for inaccurate reporting. I have also sent XXXX additional documentation that I have received from the creditor stating the balance, however they informed me that it doesnt matter what I send them, they go with what the creditor tells them. I want this inaccurate, injurious, erroneous information removed immediately from my credit report. I have attached the backup for my claim and I would greatly appreciate it if you would help me get this remove immediately.

This company is trying to collect {$12000.00} from me for a debt they claim I owe. I have written them several letters since XXXX 2016 demanding that they comply with the Fair Dept Collection Practices Act and the Fair Credit Reporting Act by ( 1 ) providing me a contract or bill with my signature on it as follows : " I am requesting validation, made pursuant to the Fair Debt Collection Practices Act. Please note that I am requesting validation ; that is competent evidence bearing my signature, showing that I have ( or ever had ) some contractual obligation to pay you. '' They sent me a computer printout of a bill, but nothing with my signature on it. They are in violation of the Fair Dept Collection Practices Act and the Fair Credit Reporting Act by claiming I owe money and they have no document bearing my signature wherein I allegedly authorized these charges. I got a loan for a vehicle with my son as a co-signer. He moved out shortly afterwards so I had no other income other than the petty cash salary I was making. I notified the loan company via letter that I could not make the one lump sum monthly payment and will need to make two payments per month. They have been calling me, family, and friends ( references ), ( 6 ) six times a day, ( 6 ) six days a week since XXXX 2015. I spoke to them and asked them not to use my references to contact me ( some of which is in other states ). They have ignored my request. I told them if they are not satisfied with how they are receiving the payments come get the vehicle otherwise top calling me about late payments every single day, all day when I work overnight shifts. My mother was returning calls and taking messages for me letting people who were contacting me know that I have been XXXX A call came through to my phone ( that I now believe was a cell phone, not business ) from a lady named XXXX and my mother immediately called the number back and spoke w/ her. She proceeded to tell my mother where she was calling from, what she was calling about, the status of my account, how many days past due I was ( which was 33 at the time and was said to be almost 60 ), and that I was in jeopardy of being sent to recovery. She then proceeded to get bank account information from her. There is no one authorized on my account but me and not only did this embarass me but caused an verbal altercation between me and my mother.

During 2013, I was leasing to own a vehicle with Mark One Financial and one time I was late between 30-59 days. I was paying on-time and up to that point and every single month afterwards I was never late. I asked while I was still under contract with them if I could have the late removed they said no. I asked again with a goodwill letter if it could be removed and again was told that the decision to be made was it would stay. It has been my only late with a vehicle and the only one listed on my credit report. If you could please assist me in getting this XXXX late removed on my credit report it would help me. Thank you

MarkOne Financial company continues to report inaccurate information on my credit report. They are reporting a repossession but after several attempts MarkOne Financial have failed to show me any written documentation of a signed agreement/contract with my signature, right to collect in my state, and documentation of balances and how they were calculated. I have been a victim of fraud and have expressed this to them several times in writing and they are still refusing to remove this inaccurate account from my credit report. This is my last step before I have to move forward with litigation.

I disputed the account and ask that they validate this account, and they fail to respond to the action. The law states they have 30 days to do so if not or over the 30 days this account must be removed from the credit file and in this case, they fail to respond to the matter. It has been over 30 days with no response, and I did not open or authorize this account, and I therefore request that it be closed immediately. On XX/XX/2017 I have been getting repeated calls all day long from MarkOne Financial. I was at work all day and was not able to pick up my phone. They have also contacted other friends and family members of mine and I know that it 's against the law to get repeated calls back to back from a debt collector and I 'm really upset at this point. I have sent debt validation letters to the company asking for proof of debt and have yet to receive a reply from any of the letters that I have sent via certified mailed. I first contacted them back in XXXX and recently I have found that they are not authorized to Collect Debt in the STATE OF FLORIDA WHICH REQUIRES THEM TO BE LICENSED, BONDED AND INSURED.
