I was " served '' last night with a " Writ of Continuing Garnishment '' that I never knew about a hearing being set nor did I ever receive any communication from this " attorney '' or company they represent showing I owed a debt. XXXX XXXX Courts nor the " attorney '' have ever sent me any notices about a hearing date. The only communication I have received is in the form of a " writ '' last night showing " judgement '' has already been made. I tried to call the attorney Mr. Mark Leachman as well as XXXX XXXX Courts to get written validation of this supposed debt. The original " filing '' shows 2016 but I never received any notice of that either. When I tried the courts, I was hung up on for asking why I never received notice of a hearing, only the " judgement ''. XXXX at XXXX XXXX XXXX said they didn't have to notify me and I needed to call the attorney on the case. She also told me that they can bring up cases from years ago to start the process again and don't have to notify me of the new filing. I can not reach anyone at Mr. Leachman 's office to get any information on this matter. I have submitted letters to both XXXX XXXX as well as Mr. Leachman to request written validation of the supposed debt as well as asked XXXX XXXX Clerk to set a new hearing. I can not find any judge name on the " writ '' to refer to, just a case number. Until I get a written validation of the debt, I will not be paying anything because I can not verify it is valid.

In XXXX I took out a payday loan for {$400.00}. Over the next four months I had to make payments of XXXX $ XXXX/month to satisfy paying off the loan without additional fees. I did pay off the loan but in XXXX I was notified by the law office of XXXX XXXX XXXX in Colorado that my debt now totalled > {$1800.00} with fees. Until XXXX I had not been notified that this original payday loan was unpaid. When I asked the law office for proof of non-payment they stated they did not have access to these documents. I was unable to find previous email correspondence showing my receipt of payments from XXXX due to the the email account had been deactivated years prior. In trying to find a resolution the law office refused to negotiate and then served me notice at my home in XXXX. In short the law office of XXXX XXXX XXXX has not been able to prove my loan was not paid and has added over {$1500.00} in fees and penalties as they say my new balance owed is in excess of {$2000.00}.

I called up the collection attorney that has my file asked them to let me set up a payment plan. they told me I have to send over my pay stub that they will take 20 % of my wages I told them I am a single mother of XXXX I can not afford to do that I can pay them XXXX on the XX/XX/XXXX and the XX/XX/XXXX. they said that is not acceptable they just will get a judgment against me and see how I like it when they garn my paycheck. I really do n't believe this is fair the debt turn form owing XXXX to XXXX. I was told that they do not care how many kids I have of who I have to pay in bills. they just need there money. I told them im willing to pay how come they can not work with me on my terms. XXXX said because we do n't have to we do not care about your terms only to get out money.

Hello so the original amount of the debt is for {$870.00} and the collection agency is saying I owe XXXX for interest fees on an old debt, the original case was opened XX/XX/2013.
