I recently received a letter of foreclosure related to a {$4100.00} from a XXXX line of credit from XXXXXXXX XXXX ( out of business since XXXX ) secured by my primary residence located at XXXX XXXX XXXX, XXXX, NC. I have paid the requested pay-off amount in full on XX/XX/XXXX but the representing attorney has not communicated with the courts to stop the foreclosure sale scheduled for XX/XX/XXXX. Facts regarding the case : XXXX XXXXXXXX XXXX # XXXX XXXX was listed as XXXX XXXX XXXX ( XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, XXXX XXXXXXXX ) and the loan servicing company was listed as XXXX XXXX XXXX ( XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX ). Attorney XXXX XXXX and trustee, XXXX XXXX ( XXXX XXXX XXXX XXXX, # XXXX, XXXX, XXXX XXXXXXXX ) represented the plaintiff. Although I responded to Attorney XXXX that the loan was beyond the statues of limitation for the state of NC, I went to my hearing scheduled for XX/XX/XXXX, prepared to pay the requested amount. Attorney XXXX XXXX XXXX ( XXXX XXXX XXXX # XXXX, XXXXXXXX XXXX XXXXXXXX, phone XXXX XXXX ) presented as substitute attorney and provided a redacted bank statement ( missing the banks name, my name, and the date ) which Judge XXXX XXXX XXXX XXXX as proof of valid debt. A foreclosure sale is scheduled for XX/XX/XXXX. I requested to pay off the debt on that day, but Attorney XXXX refused to give me an official pay-off amount. He stated that the pay-off amount would be approximately {$7500.00} and that I would receive an official statement within XXXX business days of the court proceedings. Despite numerous requests over the next few days, I did not receive a pay-off amount. Because I did not receive the pay-off amount, I filed an appeal. My next court date was scheduled for XX/XX/XXXX. In the interim, I contacted all parties ( Attorney XXXX XXXX, Attorney XXXX XXXX, Trustee XXXX XXXX, Judge XXXX XXXX, XXXX XXXX XXXX of XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX in efforts to obtain a pay-off amount and pay the debt but to no avail. I presented to XXXX XXXX on XX/XX/XXXX, simply to request a pay-off amount. Attorney XXXX XXXX presented to XXXX XXXX XXXX, the same redacted bank statement as proof of debt and falsely stated that he had sent a pay-off amount via email. Attorney XXXX stated that the amount had since increased to roughly {$15000.00} ( approximately {$7500.00} more than previously stated ). I requested an official pay-off amount during court proceedings so that I could pay it on the same day. Attorney XXXX XXXX would not provide me with an official pay-off amount. He stated that I would receive it within XXXX hours. When I did not receive it, I contacted Attorney XXXX who stated that he was no longer involved in the matter and did not send the pay-off amount as promised in court. Several days later after copying the Federal Trade Commission and the XXXX XXXX XXXX XXXX in on my emails, Attorney XXXX XXXX emailed a pay-off amount of {$15000.00} ( principal {$4100.00}, interest {$1500.00}, {$52.00} late charges, and {$9300.00} attorney fees to be paid by XX/XX/XXXX to end this case. I followed the instructions sending a certified check from XXXX bank in the amount of {$15000.00} to XXXX XXXX XXXX, Trust account to XXXX XXXX XXXX via XXXX XXXX mail, Tracking number XXXX which XXXX office personnel verified was delivered on XX/XX/XXXX. I sent the tracking number to XXXX XXXX XXXX but for several days, he stated that he did not receive it despite post office personnel verifying that they left several notices in his box. On XX/XX/XXXX I contacted Judge XXXX XXXX XXXX about the matter and shortly thereafter XXXX XXXX signed for the package. It has been more than 25 days since I sent the requested funds and more than 14 days since Attorney XXXX XXXX signed the package. I have heard nothing else regarding this case or given any information regarding cancellation of the foreclosure sale which is scheduled for XX/XX/XXXX. I am requesting assistance in obtaining verification from Attorney XXXX XXXX XXXX that the debt has been satisfied and ending this case. I request that the XXXX XXXX XXXX ( the loan servicing company ) provide me with a release of XXXX from my property located at XXXX XXXX XXXX, XXXX, NC to bring this case to an official end. I have been going through the foreclosure process since XX/XX/XXXX. When we first obtained the loan the lender reassured me I would be able to refinance my loan after one year of making the original payment which was {$5600.00}. They told me that I would need to do this in order for me to get a better rate which would bring down my payment dramatically. When the time came to refinance they told me I could n't and soon after I found out they filed bankruptcy and sold my loan to another company. I stopped making payments because I found a company who said they would help me with a loan modification and they told me in order for me to qualify for a modification I would need to stop making payments because the lender said there was no reason for the modification because I was not delinquent. We were having a difficult time making the payments of {$5600.00} and thought this would be a good idea to help us alleviate some of the burden. After 3 months of non-payment we found out that the company we paid to help with the modification was a fraud and the lender will not help us with the modification. That then put us into panic mode. I tried calling the lender and they told me they will not accept any payments and sent back my check. We searched the web looking for help then we came across a company, known as XXXX XXXX, owned by XXXX XXXX, who said they would buy my house and rent it back to, we paid them {$12000.00} and soon found out they were also scammers. Then we met up with XXXX XXXX and paid her XXXX to help us fight our mortgage company because they believed the company trying to foreclose on us did not own the loan and no one has the original papers to foreclose on us. My loan has been transferred 4 times within a 6 month period. I have tried to apply for a loan modification with each lender but each time my loan documents was always getting lost. Finally, with the current servicer Maddision Management they received all my documents but I was recently denied saying my income will not be sufficient and my arrears was way to high and they could n't come up with a payment affordable for us, which I will appeal. The bank that was originally foreclosing on us was XXXX XXXX and now we found out that the investors have changed and we do not know who the rightful owners of the loan are. The companys who are involved now are XXXX XXXX, XXXX, XXXX and Maddision Management Services. I have not received any Statements from anyone but Madison Management Company since my loan was owned by XXXX Mortgage. The statements I receive are dated for today but they are asking for payment in year XX/XX/XXXX. Statements are not current. Also year ending XX/XX/XXXX XXXX XXXX sent me a Cancellation of Debt form which I have attached for your viewing. They are still making me liable for that amount. I feel harassed by my lender, they send people to my house to take pictures of the house. They enter my property without permission. Two weeks ago someone entered our property and my children were home. They were scared because they did not know who was walking around. My son went out to ask who they were and they did n't answer. They just kept taking pictures of the house and walking around. Even though I am in foreclosure they should still respect us as human beings and not freak my kids out. They come to my house at least once a month and take pictures, not only from the street but up close and on my property. My kids called my crying and saying there 's people here mom, what do we do? This is totally unfair and disrespectful.

I want to report the following mortgage investor and collection agency companies for unwilling to negotiate 2nd lien that was filed in a bankruptcy in XX/XX/2009 and they have bought this paper and forecing me to pay them by putting my home in foreclosure. my home is still underwater and currently is not behind on the 1st lien mortgage due to a loan modification completed in bk under the HARP program ; The two companies are the following : " XXXX XXXX XXXX XXXX '' and " Madison Mortgage '' I filed BK XXXX in XX/XX/2009 and during that period the 2nd lien was with " XXXX ''. XXXX during the BK process was showing on credit report as the debt being charged off. For this reason this debt was not " reaffirmed '' for the option to do a loan modification. Also due to the home severely under water. Since then this loan was sold to several investors and the latest investor ; XXXX XXXX XXXX '' has bought loan and started to send out demand letters for me to pay them. Since the Lien is still tied to the property and never was Stripped my BK Attorney only option was to try and negotiate with the the investors. The investors is using : Madison Management '' as the the third party collection agency to try and collect. we have tried to offer several amounts to pay this lien so they could remove it from title. All offers were denied.They want me to pay the full balance that was due at time of BK filing, all late fees and attorney fees. They also want me to pay a 9.50 % interest rate which is to me predatory. I Have sense hired a different attorney who has been trying to negotiate this lien and have been very unsuccessful as well. They have denied every offer the attorney has offered. The investor has scheduled my house to be foreclosed as a way to strong arm me into paying them what they want me to pay them. this practice is unlawful and i know i have some sort of rights to protect and save my home. Since filing BK i have been currently with the first lien with no late and do not want to file BK again just to stop them for foreclosing They have also violated my privacy by researching me online on XXXX to discover I have a business and is married. So the feel I have the means and capital to pay them what they want me to pay them. This has been a very stressful situation and now is affecting my health as I need help stopping this investor from violating my rights

I would like to file an official complaint for misuse of escrow funds related to this a land contract that is serviced by Madison Management Services I have attached all relevant documents related to the land contract I entered, schedule of payments, and payment breakdown. I became aware of several issues related to this account managed by your company Madison Management, upon the receipt of the attached letter : Escrow Impound Sortage Notification. Please Reference the following excerpts from the attached contract for land that was agreed to and purchased by the landowner. This clearly spells out the provision that the Seller shall maintain timely payments for all taxes, insurance, and HOA dues. Item 7. Annual Property Taxes, HOA dues, and Insurance Premiums. Until the deed to Buyer is recorded, Seller shall timely pay all real estate taxes, HOA dues, and insurance premiums. After the deed is recorded, the Buyer shall be responsible for all such items. Provided, however, that all such items shall be prorated so that each party pays for its share of the period covered by such items. Current real estate taxes due : $ XXXX XXXX Delinquent real estate taxes : $ XXXX Current homeowner association dues : $ XXXX XXXX Delinquent homeowner association dues : $ XXXX Current special assessments : $ XXXX Delinquent special assessments : $ XXXX Item XXXX. Liability Insurance. Liability insurance may be kept in force by Seller for such coverage as Seller deems appropriate, including ( but not limited to ) coverage of {>= $1,000,000} per person and {>= $1,000,000} per incident. The cost of such insurance shall be paid ( as specified above ) by Buyer. Earlier in the year, I contacted Madison Management several times regarding a discrepancy in the number of payments and the payment amounts changed from the contract. According to the contract, at the time of purchase, there were 43 payments due at XXXX per payment. I have made all payments on time plus additional funds to be applied to principle. As of the XXXX Payment, there should be a balance of 35 payments due.

I currently own my home at XXXX XXXX XXXX XXXX, XXXX, AZ XXXXIn 2010 I filed Chapter XXXX and choose to keep my house. I had a XXXX and XXXX mortgage which I choose to service at the time and attempt to modify. My XXXX mortgage was successfully modified but the XXXX with XXXX XXXX Mortgage was not. They sold the loan during this process to XXXX XXXX. I could not come to terms with XXXX XXXX and as I understood it was discharged in my Chapter XXXX bankruptcy as shown on my XXXX credit report. That was in 2010. Recently, Madison Management LLC, from my understanding has purchased this old debt and is now trying to collect. They are doing so by foreclosing on my home. My research has brought me to the conclusion that this debt was purchased for pennies on the dollar. So not only is Madison Management, in my opinion harassing me on a Chapter XXXX discharged debt, but also have exuberantly inflated the amount owed. I 'm not sure if these strong arm tactics are legal because of my Chapter XXXX bankruptcy, and if it is legal, im not sure if this inflated debt owed is legal. In a settlement letter from Madison Management, they openly admitted that this debt was purchased at a discount and then a few sentences later say I owe approximately {$55000.00} when the original debt from XXXX XXXX was only {$36000.00}. Please help! Please let me know if I have a valid reason to stop these foreclosure proceedings. I am in good standing with my first mortgage company and also so you know, my home is still " underwater '' in value. Thank you.

Shortly after I purchased my home, I had to have the windows replaced. The contractor I hired to do the work financed the windows and I was making payments on the loan. Then they sold the loan off and I was paying a different company. Then the loan moved over to another company and they stopped sending me statements and disappeared. I could not find out who I owed the money to and thus I had no one to pay. I tried for over three years to find who is holding the mortgage on my home and was unable to find them. A few years later I tried getting a loan on my home through XXXX XXXX, but they said I had a lien on the property for the loan on the windows. I was floored and now my property apparently is in foreclosure with a new company, Madison Management Services. I was getting help from them, but the lady who was helping me quit and the person who took over for her is incompetent. I can not get any traction on getting into a repayment plan and they have my home in foreclosure. My current income is sufficient enough to make payments on the loan and I want Madison Management Services to take a step back from foreclosure proceedings and initiate a proper review to resolve my mortgage issues. I was hoping that your agency would reach out to them to get them to work with me.

I was recently offered a loan modification by my second mortgage, Madison Management Services which threatened me with foreclosure last year. In order to avoid foreclosure, I was put into a forbearance agreement for a year starting XX/XX/2016. After fulfilling the agreement with a timely payment of {$300.00} per month, Madison asked me to keep paying the same amount without any modification in sight. I immediately replied asking them to reconsider their decision and offer me a more attainable and sensible loan. Now they came up with a very questionable loan modification where the original amount went from {$45000.00} to {$100000.00} due to some very questionable fees. So now I owe as much as my first mortgage. It does n't make any sense. What about all the payments I did submit? Do n't they count for something? My concern is the legality of those fees and the legality of Madison Management Services itself in collecting those payments. I ca n't afford paying XXXX mortgages as it is.

I have been in foreclosure since XX/XX/XXXX and I have been in and out of court. I am trying my hardest to keep my home. At that time my mortgage was being serviced by XXXX XXXX and the owners were XXXX XXXX. During XX/XX/XXXX my loan was transferred to XXXX then to XXXX, then XXXX XXXX XXXX, to XXXX, and now its at Madison Management Services. I am currently working with XXXX, a HUD approved counseling center. I have applied for a loan modification and each time they say they have not recieved my modification packet. My case worker at XXXX is trying to get in touch with Madison Managment but she is being told she needs to contact XXXX XXXX XXXX but we were told that it was transferred. I dont quite know whats going on. I am not sure if mortgage companies can keep transferring. I also do n't know who owns my loan. I have been submitting my personal information to all these companies and I 'm not sure if I should be. Can someone please call me to advice me.

Some company purchased note of my property of second lien. I had struggled financially and could not paid equity line and the note after almost a seven eight years was purchased by some one. They started threatening me to foreclose my property. Last year i have complained about them. They told me to apply for modification and they have added {$5300.00} of accrued interest and {$1400.00} in unpaid charges. making my principal go from {$47000.00} to {$54000.00} I have agreed to it thinking now i will have to pay $ XXXX monthly and they will be back off. Surprisingly, they came after me again after a year stating that forbearance agreement was only for a year and started threatening me again. Why i have agreed to pay them almost {$7000.00} in additionally. This is nothing but scam. This kind of practice must been stopped or looked. i am ready to pay whatever i have agreed to of {$250.00} a month for rest of life.

I have recently received statements from this Madison Managment Services with due amounts. I have never done business with such company and my mortgage company also denies having any business with this company. On their billing statement its unclear what debt they are collecting. It includes a past due amount of {$420.00} and a current payment amount of {$410.00} statement closing date of XX/XX/2023. In the statement summary I find available credit ( {$47000.00} ) and average daily balance of {$47000.00}. I have never conducted business with this company and therefore I dont feel safe contacting this company. There is no record of them in my credit report on any of the major credit report agencies. I believe they are committing fraud.

Loan was transferred XXXX ( SEE PROOF ) was behind, mortgage statement showed {$970.00} as you can see then {$2000.00} which is correct mortgage, said was {$8000.00} behind i paid it! I have reported this Mortgage company before under my previous complaint number of XXXX Note resolution was my note holder for second mortgage. Madison management is account management company. Managing compay had agreed to lower my monthly payment to {$250.00} and i was paying timely, when Note resolution wanted me to pay {$1100.00} + when they found out XXXX XXXX had lowered my payment. Now loan has been modfied and my payments are lowered to {$250.00} Last year, Madison Management - Note resolution have reported negatively to credit buorou, even thou I was paying timely but negotiated amount of {$250.00}.

There are serious errors in how this company tracks its accounting. Several of my payments going back to XX/XX/2016have not been factored in to the current balance. I have not had any of my payments applied to the principal balance in 7 months. There are no associates that understand the data presented on the website and I can not get a copy proof of what the new fees are that I am being charged. My entire account needs to be audited for errors going back 3 years and Im looking for someone who has the authority. If this is not resolved I will take it to a lawyer.

I hereby file a complaint against XXXX XXXX XXXX the current holder of a second priority security interest on our residence ( the Mortgage ), and Madison Management Services , LLC, the company currently servicing the Mortgage, collectively hereinafter referred to as XXXX XXXX XXXX XXXX XXXX XXXX has added an improper charge to our account balance causing it to double.
