I cosigned with a ex- girlfriend back in 1999 for a XXXX XXXX at XXXX XXXX XXXX XXXX XXXX XXXX, Ala . Within 2-3 months, I had to take the car back from her and return it to dealership. I didn't hear anything about me owing anything after that, Until My Ex had passed away, Then I started to get a lot of threatening phone calls and letters, At home and work! The law firm Macdowell & Associates in XXXX, XXXX told me that because they could not collect anything from my ex-girlfriend, That I had to pay something like XXXX to XXXX XXXX dollars, Plus around XXXX in Interest!!! So I tried to pay around 200 - 250 a month! And I have been paying at least 100 a month since they said they were going to sue me a few years ago! I have requested numerous times for them to send me a correct balance, And a running log of what I have paid them, And what is actually owed on my account!!!! They have never responded to my request! They have filed a garnishment of my wages in the XXXX County Courts ( XXXX, Alabama ) I was never served court papers, And I found out only by getting a simple letter from the court in my P.O. Box, After the courts had the garnishment approved. So, I never had a chance to to court And present my case in front of Judge or Jury! I believe this was simply some old debt, That they bought from another company, And threatened me to pay, Without me even speaking to the original creditors, ( XXXX XXXX, dba XXXX XXXX XXXX ) I truly think this is " Unjust '', And I have asked them a number of times, Just to take me court, And let 's see what a Judge says about this old debt! That I believe was charged off by XXXX XXXX, dba XXXX XXXX XXXX years ago!!! I have other means to resolve this issue, without your help!!! I was mislead about this car loan debt, From the very beginning. The sticker price on this car was only XXXX to XXXX dollars, Brand New car, Back in 1999! I have never got a statement, or running balance from Macdowell & Associaties, After many requests for one!!!!! On the evening of XX/XX/XXXX, i received a letter that was not certified by my employer payroll department that i had a notice of wage garnishment from MacDowell & Associates, Ltd on behalf of XXXX XXXX XXXX XXXX. I did a voluntary repossesion in XX/XX/XXXX, the car in question was never reported on my credit report. Per speaking to a rep from XXXX XXXX XXXX, by the name of XXXX, ext. XXXX there will correspondence from his company that were sent to me stating this car was never on my credit report on multiple different occasions, and they were going to " make the necessary corrections due to the error they caused ''. The vehicle in question was charged off on my account for $ XXXX, MacDowell & Associates claim that they are garnishing my check for {$12000.00} which is by far not the same amount. MacDowell & Associates then claimed i was served a court notice in XX/XX/XXXX, which was false. There is no file of service listed for the case number that is assigned to this. In XXXX of XXXX, nobody including myself was at this residence or in the state at this time. The process server who attempted to serve me, claimed a person who was at my residence did not provide their information to them and was " penalized for perjury '', and may i add the person they described they supposedly " served '' this notice to would have been an officer of law which would have then made him question this person further if that was the case. Per my then conversation that i had with a Mr. XXXX who is a representative of MacDowell & Associates rudely told me that the person who attempted to serve was going to get paid regardless if i was served or not which is not the correct process in the state that i reside in ( California ). As i then continued to try and stop this attempt to garnish my paycheck, per MacDowell & Associates i had to overnight a down payment of {$500.00} via XXXX XXXX, which would then start my monthly payment of {$150.00}. But there is a possibility the garnishment would have not stopped, but i need to hurry up and get the payment in because the person who is handling this " case '' Mr. XXXX would be out of town for a week and there would be nobody there to handle this situation in a timely manner. I also explained to Mr. XXXX my current situation of being a XXXX XXXX full time in school, and that i was an on call employee with my employer. He still felt that was not enough information to rectify the issue at hand. I provided an itemization list of my bills and copies of my pay stubs that also showed that my income was not stable, and according to XXXX, that was not enough for him to budge.

XXXX XXXX XXXX had a valid claim to a debt that I owed. However, they decided to initiate action during a federally declared state of emergency and disaster. Businesses were closed, communication and travel were extremely restricted. And, I, being self-employed, had no relief or any type of compensation. Whereas the rest of America seem to be getting triple unemployment benefits, I had to suffer. I communicated with XXXX XXXX about the debt and my intentions to pay and stay in good standings. I contacted them in XXXX at least once and XXXX on two occasions also called them in XXXX I believe it was on the XXXX to explain that I would have payment by XX/XX/XXXX. They explained that they were happy that I was able to make that payment and just to give them a call when I made it so that they could be on the lookout. They then arrived at my home and in the wee hours of the morning. Embarrassed me in front of my neighbors and calls me great stress in the fact that I had to stand in the cold and clean out the truck on the spot. I would have had it cleaned out had they told me that they were coming to get it. At this point they knew that trucks were bringing a premium price and that they could get as much as they wanted to for it and I believe this is the reason that they repossessed. However this is not truly the issue, though it does pertain to the issue as a whole. XXXX XXXX XXXX declared my account as a charge off and therefore XXXX was able to negotiate this item on the p & l tax documents. They were compensated. The dead then became what could be declared as income to me however XXXX decided to send it to a lawyer 's office and he has steadily increased the debt months by month over 3 years of holding the debt. From everything I've read and everything I understand this is not fair nor is this legal. If I'm wrong, please show me how I am wrong. I have screenshots of the emails The lawyer has sent to me and even offered to settle the account for {$1000.00} as he refused. I believe that this taking place during a federally declared state of emergency and disaster and the fact that XXXX sold the truck for a premium at auction should negate any debt that I owe or have owed. Please help resolve this situation and help me remove this from my consumer report as I believe this is not covered as a debt or a collection under the 15 USC FCRA.

I previously received a wage garnishment letter from my employer for XXXX XXXX XXXX for an auto repossession. This occurred for 6 months then I received a release of garnishment summons XXXX XXXX. When I was paid on XXXX/XXXX/XXXX and a garnishment amount was on my check, I received contact information from my HR department I knew my debt was paid based on what was owed. On XXXX/XXXX/XXXX, I contacted XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. I explained my check was garnished previously and was not notified and it started again. I was told they won a judgement against me and that my spouse was notified of it in XXXX. She gave me the name of my son And asked me if he told me. I told her that was not my spouse and i was not served. Then she advised me the judgement was XXXX which after 6 months garnishment has XXXX balance and interest which by law they can charge. I stated they never notified me, they garnished my check. I need the amount owed to avoid interest. She stated I could pay {$1200.00} to be put on a plan with them to come from under the settlement. I am learning this was a legal action that had a court date that I did not attend in XXXX. Then the amount she gave was XXXX with a balance of XXXX plus XXXX to pay them to set up a payment plan. Not only was I not notified or properly served on the initial Legal Action in XXXX XXXX, but this garnishment is from XXXX XXXX, and I was not notified again.I provided them my address and then was told I Will be notified they garnished my check XXXX/XXXX/XXXX and the balance is XXXX for " now ''. I was not aware how garnishment occur. I did not know it was a court hearing. I was never properly notified or served concerning a legal action. They disclosed my information concerning my debt without my consent. My FDCPA rights was clearly violated my this company.

I don't know why they would place a different amount on my credit report then when I call in the amount is totally different then what is stated on my credit report. I never received any communications about this debt and the only way I found out due to its income tax season and I usually pay my debt off around this time. XXXX seems rude and unethical remarks makes it no better I am not the first to complain about this due to she has her name posted in XXXX review from a complaint another consumer posted that was also trying to settle their debt but could not due to XXXX was very rude and uncanny and hung up the phone on me and the other consumer when I was simply trying to see if we could settle. she began to state that all of her bills were paid and she did not have anything to worry about. okay where did that come from I just want to see If we can meet in the middle somewhere then she began to be very harsh and say what are you offering to pay I gave her a figure and she proceeded to keep telling me repetitive but in a sarcastic way no that's not good enough and she hung the phone up on me when I attempted to call back they would not answer the phone. On XX/XX/XXXX, I received notice from an employer that I work temporary for from time to time ; pertaining information from XXXX XXXX, MacDowell * Associates , Ltd., XXXX, Georgia, about Garnishment of wages. When at this time, I am not even working for the company. MacDowell & Associates is claiming I owe XXXX XXXX XXXX, for payment after returning a lease, for what I have no idea because I never received a bill from XXXX XXXX XXXX after the lease obligation was fulfilled without any debt owed. The lease was purchased in the State of South Carolina from a XXXX dealer ; it was a 3 year lease from XX/XX/XXXX to XX/XX/XXXX ; in XX/XX/XXXX the vehicle was return, and I thought that was the end of it. After, almost 2 decades ( seventeen years ), MacDowell & Associates is still harassing me at whatever employment opportunity I get. Last year, they filed a complaint with another employer that I had a temporary job with. The continuous harassment and defamation of my character over what they claim is a debt from XX/XX/XXXX is unfair, I contacted them and told them to stop harassing me over this untrue debt. They are quoting the principal amount for {$1400.00} and total amount due {$5300.00}. I never received a bill for anything in XX/XX/XXXXfor XXXX XXXX XXXX saying I owe for anything after the lease was fulfilled. MacDowell * Associates , Ltd. is the company sending the garnishment notice 2 decades later. I have never received a copy of a bill of anything from MacDowell & Associates other than, garnishment notice ; no bill statement, etc. since XX/XX/XXXX, seventeen years ago.

This debt collection has been going on for XXXX ( XXXX ) years. I have repeatly ask them to stop filing garnishments on me for a debt that I do not owe, and for XXXX that they never sent or produce a bill pertaining to the date. Instead, every 5 to 7 years they continue to file this in the courts. This is causing problems with my employment and adding stress to my life. In XXXX I received notice that they would not file the case was dismissed, also in XXXX ; however, now in XXXX here we go again with the same fradulent file. As of this date, they still have not produce a copy of a bill as I have repeatedly ask them to forward to me. This is a problem that I will differently take to every level I can to stop these types of actions against me, for 20 years of harassment and never producing proof of a debt is just totally illegal practices and I have repeatedly ask them to stop of provide proof of a bill and a letter of intent that I received concerning the so call debt. Why would you mail someone a letter saying you dismiss it and then you do the same thing in a few years.This is obvisously, some lawyer debt firm that buy someone name and then harrass them pertaining they are working for the company. On XXXX XXXX, 2016, I attempted to call MacDowell & Associates LTD to discuss a possible settlement with regards to a lien against my property. We are in the process of selling this property. When I first called, the women ( who refused to give me her name ) I spoke with on the phone was initially cordial on the phone and provided me with the information I requested. When I call back a second time, she was noticeably more aggressive and agitated on the phone. The purpose of me calling back a second time was to initiate a discussion about a settlement amount. The woman on the phone became irate and began yelling at me on the phone, saying that I " better pay dat debt '' over and over again. I stated that she was yelling at me and she said that was her normal tone of voice, then she hung up the phone. I call back to try to get some conclusion to my intent for calling and she called me a " racist '' over the phone, then hung up again. I have attempted to call back many times and now there is no answer. I felt threatened and severely offended by her calling me a racist, especially since I said nothing racial over the phone. And now a high level of emotional distress for me and my wife. This type of language is unnecessary, unprofessional and was used in a way to attempt to threaten me and my family.

McDowell and Associates, a law firm in XXXX XXXX, CA has been contacting and harassing me for TWENTY plus years over a car loan that I never had, The loan was initiated due to identity theft when I was in college and lived in Washington State. They have continued to pursue me throughout the years, and claim they served me with a court summons in the year XX/XX/2000. In that year I did not live in California, and did not have the PO Box that they claim they served me at as I had used it years before and did not live in XXXX XXXX, anyways. Fast forward, I just received a judgement for XXXX for a debt that is not valid. They did not serve me legally, so I had no way to defend myself. Had I been served legally, I would have shown up with my police report, letter from City Attorneys office, Affadavit of Fraud from the FTC which is notartized, and it would have been taken care of. Now I have a judgement and have to deal with it. I am a XXXX person, and can not even drive to this courthouse which is far away. I intend to file a restraining order for harassment, sue them, and deal with XXXX XXXX XXXX and the court directly. Even if this was a valid debt, which it is not, the statute of limitations expired 18 years ago. I saw very bad reviews about this firms ethics and I can certainly see why.

I received a collection letter and sent debt validation letter within 30 day period. company continued collection activity by calling me twice before verifying debt attempting to collect asking if i wanted to make arrangements to avoid litigation. they lied and said that they sent verification but they did not. they " claimed '' they sent to the incorrect address. both times i told them that i did not want to discuss until i received verification. they finally sent the verification and when i opened their letter, it was dated 3 days after their last phone call to me where i told them i would not discuss this until i receive proper verification. i was called again last week and told them i was researching what they sent me and they gave me a deadline and threatened to sue me again. the information they sent me was fabricated and unauthenticated. also per XXXX not only did the oc lie about the sale of the vehicle, they failed to send proper legal notices and is not due a deficiency judgement. and they better not lie in their response because i have every single detail well researched and documented. this has stressed me out completely and i have spent hours of my time researching this issue when i should not have to.

After a repo, the lawyers doing collectios for the car company coerced me into signing a very vague Entry of Judgement by Stipulation by threatening to garnish our wages and which didn't disclose rates, or other important credit info. After 5 years of payments, ( {$150.00} a month ) I tried to contact them because I needed an extension of time due to being laid off. Instead they refused to talk, and then sent a letter of default which I never received. They immediately filed the entry of judgement by stipulation and assessed an additional XXXX to the account without even telling me this had been done or more importantly how it was done, or even explaining my rights. When we were notified of the judgement, we called and asked what we needed to do, and they asked for {$1000.00} in order to bring the amount current, and provided no disclosures of the extension of the term, additional charges, etc. When we asked for documentation to figure out when would this payment plan be done, the company repeatedly failed to comply on explanations of fees, checked our credit again, removed notes from credit report, and made not attempt to adjust the balance, that had been inflated by the filing of the judgement.

My son and daughter in law live in XXXX. My son and I have the same name. A number of years ago my son and his wife bought a car through XXXX. XXXX XXXX XXXX. XXXX XXXX XXXX. XXXX, XXXX. XXXX. I was in now way involved with this loan. I did not co-sign on this loan. My son also assures me that this loan has ben satisfied. My complaint is with MacDowell and Assts. Ltd. Inc. XXXX XXXX XXXX XXXX , XXXX. XXXX. Thursday of last week My employer XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, informed me that my wages have been garnished by order of the circuit court of XXXX County XXXX. This was done through the action of MacDowell & Assts. Again I was not involved with the original transaction in any way. My best guess is that MacDowell did some sort of skip trace procedure and came up with my name. MacDowell never contacted me. They just filed the garnishment. Of course this was done under the wrong social security number. Is it right for companies like MacDowell to through information against the wall and to see what sticks regardless of the time, money, and embarrassment it may unjustly cause? I have also left the voice mail messages and they have not returned my calls.

After being discharged from bankruptcy on XX/XX/XXXX. This particular law firm that harassed me all through the process was able to go back to the courts and claim that they have tried to reach me through mail and had sent the marshals to serve me all in the months of XX/XX/XXXX thru XX/XX/XXXX. None of which is true. I have lived in the same complex since XX/XX/XXXX. They claim is I owe {$1400.00} for a apartment where I once lived. This was in my bankruptcy. They have contacted me back then through different agencies. So since they made claim that they tried to contact me, they were able to have a Judge place a judgment lien on me. I only learned of these actions through a credit monitoring account I have. By the time I found this out it was too late. How ever I did reach out to the firm that represented me before and was told that he would try an get to the bottom of this and get it straightened out. But I have had no response from him. My rights have been so violated. I went thru all the steps required in my bankruptcy, and still this firm who has no regard for my rights have gone after me under cover and won..!!! What do I do..??

I recently discovered an alleged judgement filed against me from The Law Office of Macdowell and Associates on behalf of XXXX XXXX XXXX XXXX. This is very frustrating and concerning because according to the law office they sued me in XX/XX/2011. I have never ever been served with legal paperwork or notified about this legal matter. They are now more than doubling the alleged debt and attempting to collect {$25000.00} from me for a vehicle I never even had. This vehicle was my brothers truck whom I lost communication with years ago. I can help them find the truck if they wish or if they would have reached out to me, but to file a lawsuit against me and not even notify me is extremely abusive and seems like an attempt to inflate the debt. I contacted both XXXX XXXX XXXX and the Law Office of MacDowell to try to get a reasonable explanation as to why I was never personally served. I was met with an extremely disrespectful debt collector who belittled me and attempted to insult me for having such a large debt. Well I certainly would not have a large debt if they didnt sue me in secrecy and allow it to accrue interest for 8 years!

I had to fill in a wrong reason. I was a victim of a crime which has now passed the statue of limitations for collection the XXXX XXXX XXXX has ignored this and turned me over to a very disreputable company which has many complaints on your site the company is MacDowell and Associates, which are collection Attorneys at work for XXXX. The statue of limitations here in California is XXXX years that has passed and at XXXX years or a month or XXXX short of that. And researching the company I see they used tactics like getting judgments and the person never knew they were sued that sort of thing since the statue of limitation is being ignored I'd like this company to stop contacting me and never put anything on my credit they never contacted me about the debt and I see they have access my credit report and put on a hard inquiry and of course no lawsuit filed since after XXXX years a lawsuit is not permitted

I move out of an apartment in XXXX on my own accord. This law firm is coming after me for the alleged debt. I do not have a contract with the stated/listed agency. They claim they have a default judgment ( in XXXX ) but I haven't seen one yet. I filed a motion with the court to set aside because I am paying child support and the judge ordered a 60 day STAY on the case. 3 days later the attorney filed a dismissal in XXXX of XXXX. XXXX of XXXX they filed a continuing garnishment order in another county. I filed a traverse and upon the hearing the judge stated he didn't want to go against another judges order and wanted me to take back to the court of original jurisdiction. Upon getting copies of the Document I realized the Affidavits/ complaints are filled out by the attorneys in which they cant attest to any of the facts because they are a 3rd party. Actually a 4th party to the matter at hand.

On XX/XX/XXXX I received a letter from MAC DOWELL & Associates LTD representing XXXX XXXX XXXX XXXX stating that I the consumer owed a debt of {$51000.00} violating Truth In Lending Act, Fair Debt Collection Practices Act and Fair Credit Reporting Act among others. On XX/XX/XXXX I pulled my consumer report and saw that they have the alleged debt reporting to the credit reporting agencies starting on XX/XX/XXXX falsely stating that I have a debt violating TILA, FDCPA, FCRA and it is defamation and is impeding on my ability to utilize my open consumer credit line. On XX/XX/XXXX I responded via certified mail with a Cease & Desist, Affidavit of Truth with Exhibits and a Bill of Particulars to settle these violations and to grant relief. I have attached all evidence and supporting documentation to settle this matter immediately.

I am writing to complain about a company MacDowell & Associates, LTD- XXXX XXXX XXXX . I have recently received documents that I am being sued by them without even notified. For a vehicle that was released to their client XXXX XXXX XXXX, XXXX. Since then the amount owed has made its on my credit report and has affected my credit score negatively. MacDowell & Associates have harassed me by relentlessly calling my mobile phone, calling my job. Ive changed my number because they would reach out on the hour, every hour trying to get me to pay back XXXX ( as if a guy working a retail job has that kind of money laying under a rock. I never opened this account. Nor have I ever tried opening an account with this company.You need to remove this from my credit report : it is effecting my credit in a negative way.. Corrupt company. violates all sorts of laws. They filed lawsuit against me but I was never served. Thus they obtained defaulted judgement against me. Garnished my wages .I Filed claim of exemption. judge granted it due to low wages. They disregarded the court order and took 25 % of wages anyway. Then went through another county to do it and claim I switched employers which is not the case. A $ XXXX debt turned to $ XXXX the debt is over 13 years old now they renewd judgement. Help! May have to file bankruptcy. They damage everbody.

The amount that was sent to me by the company after I turned my lease in early was for {$8000.00} and Ive paid them at least {$2000.00}. My mother was the co signer and she included them in her bankruptcy so there are 5 more years left before I owe them if the statute of limitations are not up on it. They have called and threatened to sue, they placed an illegal lean on my mothers house before her bankruptcy that had to be removed by our lawyers and now they are contact me again and dinged my credit for being late.

I have received multiple phone calls and letters from an attorneys office that reports that they are acting on behalf of XXXX XXXX XXXX. The letter from XXXX XXXX XXXX/MacDowell & Associates is very threatening and intimidating as they are stating Under Georgia Law I must pay this debt within a certain amount of days and will be responsible for attorney fees and interest if not paid. On XX/XX/XXXX, I received a letter from Mcdowell & Associates demanding a debt that was owed to the XXXX XXXX XXXX. This debt shows as paid on my credit report. 10 years later, MacDowell & Associates sends a wage garnishment for the exact same amount that was already paid to them. This debt has been paid.
