I was in the XXXX XXXX XXXX until XXXX. We were XXXX and called to XXXX XXXX @ XXXX. I purchased a cell phone and plan from XXXX XXXX XXXX to stay in contact with my family, however after having billing issues with {$1000.00} a month in roaming charges alone. They would adjust it each cycle and remove the charges but I would have to wait for my payment to be credited. Finally disgusted with this I contacted XXXX XXXX XXXX and explained my situation and was informed by them that being on XXXX XXXX they would cancel my contract and close my account. I never thought about it again until I received my paycheck in XX/XX/XXXX that had {$150.00} missing to garnishment on my weekly pay. My company never informed me of this and this collections company would not even speak to me. They gave me the name of their attorney Love, Beal, Nixon. I was informed by them that I owed over {$6000.00} and could not tell me who or where the original debt came from. I searched my credit report and this collections was not on my report. I called their attorney again and asked for the information and all they gave me was a judgement number. After days of searching I finally found out that the the debt was from XXXX XXXX XXXX for the contract that was supposed to be taken care of due to my XXXX XXXX status at the time and found out that the only paperwork they served for me to appear in court to challenge this at the time was served to my father. I love my father but he doesn't speak on my behalf. I reached out to XXXX XXXX XXXX and was told they showed the account closed and settled and they didn't understand how it was in collections and we're shocked when I explained they received a {$6000.00} judgement for this. I have attempted to get all information regarding the math, charges, paperwork and legality on this matter. I have submitted this request in writing, verbally and through emails and to date I have not received any information or response. I have tried to reach out to attempt to settle. I have seen many many cases of the same issues with this company regarding fraud, misrepresentation, unprofessionalism and unwillingness to provide documentation the law requires they provide. There have been several law suits and debts overturned. I have contacted legal advice and been told since my debt is so old and changed hands it would be nearly impossible to win in court without paying more in representation then the debt cost. They have informed me I should file bankruptcy but that seems a drastic measure when I should not owe this at all. I am afraid to open my check every week worrying it will not be whole. I have filed a dispute with the company and the better business bureau. I don't understand how something that happened while I was serving my country and had safeguards in place for just this type of circumstance could be allowed to haunt me 15 years later, how charges are still being added, and this company does not feel obligated to work with me to rectify this. I was XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX when I signed this initial contract and still on XXXX XXXX when XXXX XXXX XXXX agreed to cancel my contract and release me of any further obligation. I was assured this was closed under the service member protection act. Please help

Hello! An employee of Love, Beal & Nixon, P.C fraudulently charging my debit card for his insurance plus he tried to spend {$470.00} at XXXX online when my bank called and shut down my card because of abnormal activity on XX/XX/XXXX. An employee of Love, Beal & Nixon, XXXX XXXX XXXX, called me from a different number ( his cell phone ) at XXXX XXXX to tell me my card number was invalid. I then explained to him that yes it is because I had some fraudulent charges on it. He seemed sympathetic etc and I told him that I would be getting a new card and would call him with that information. I called his office the next day, because I thought it was odd that he was calling me at XXXX and asked to speak to a supervisor. The man that answered the phone said he no longer works there. XXXX called me the next day while I was on a lunch break to ask if I had received a new card. I said Im a little confused because originally you told me that Love, Beal & Nixon does not accept debit cards and if you dont accept them why would you need it? He said because it would be a backup in case I didnt pay. I then informed him that I called the office and they said he no longer worked there. He denied it and asked who said that? I told him I didnt catch his name. I told him to call me back around XXXX and I would get the card and give him the number. He never called and Im assuming he knew that I knew it was him that did the fraudulent charges. I called Love, Beal & Nixon because I never got a call back, and asked to speak to a supervisor. The lady said she could help so I told her the story. She said you need more than a supervisor and placed me on hold. I spoke with XXXX XXXX, General Manager and told him my story again. He said XXXX no longer works there and that the XXXX had done this to another lady and she was filing a police report and that they, XXXX, XXXX XXXX XXXX, were filing something also. He asked me to fax him a copy of the police report when I got it. Love, Beal & Nixon P.C. took me to court over an old credit card debt. The credit limit was {$300.00} or {$400.00} and now is {$2600.00} that Love Beal & Nixon bought from XXXX XXXX XXXX XXXX. I asked if they would drop the interest off and I was told that he would fight it and so I agreed to pay {$50.00} a month. I would think that Love, Beal & Nixon would have some type of responsibility for their employees. I have written an email to XXXX XXXX on XX/XX/XXXX and as of today XX/XX/XXXX I never received a response to that email. I did receive a letter dated XX/XX/XXXX saying they have n't received my payment. I do not think that I should owe anything on this debt after an employee of their company wrongfully used my debit card. That person would have never had my debit card number if he was not a collector on an account of Love, Beal & Nixon. They have some liability for this/his action.

In XX/XX/XXXX -XXXX a credit card was taken out in my name with XXXX, I did n't find out about this till after I was going through divorce, and had moved out of where I was. I disputed it once i fou d out. I heard nothing back until i got the collection letter from XXXX. I again disputed and requested verification from them. I also coated XXXX myself with them having no information to provide aside account number, and address. A place I had n't been in over 4 years at this time. When asked to prOvid proof of debt, I was mailed a statement with the address I had n't lived at since XX/XX/XXXX. I was then served with a summons from love bealXXXX and Nixon out of XXXX, represented by attorney XXXX in XXXX oklahoma in XX/XX/XXXX. I disputed again, and my dispute was ignored, no verification of debt was given, no signed contract, not so much as a signed credit card receipt. I filed my dispute with court and explained that they have provided nothing to sustaniate the debt. It had to go to court in XX/XX/XXXX, I filed my dispute with the court. No proof was given on court either. A letter from a third party who swears by XXXX business practices says it 's verified, but no evidence was ever or has ever been given. LOVE BEALXXXX AND NIXON CONTINUE to filed motions with the court and a bill that was once {$1100.00}, is now {$2300.00}. They continually try to garnish my check even though my child support was already taking out half of my check. This is XX/XX/XXXX, and they are still causing my life XXXX, trying to garnish bank accounts, and paychecks and have never been required to show one bit of evidence that this is me. They rely on the fact that I am ignorant of the law, and do jot have enough money to hire attorney to fight. I have repeatedly told them this is not me. They will not show any proof, and tells me I have to prove it 's not me. How are they allowed to just take money frim me, and my family with no evidence aside a credit card bill sent to address I was not at any further, and a letter from a third party that neither works for the bank, nor provided any evidence. Please help, they are driving me crazy, I have even offered them XXXX to settle, because I thought there was no other way to deal with this. but they refuse because they can get more through XXXX corrupt court system.and garnishing my bank accounts. I am not able to open an account now, because the levy on my bank accounts made the bank charge me even more fees that I could n't afford resulting in another bad debt., this is causing tremendous stress with my homelife. Please help me. This can not be fair, or legal. If they garnish my check it will not allow me to pay my rent. Which will mean eviction and another bad debt. Please help!!

XXXX XXXX thru Love, Beal and Nixon has been garnishing my wages for a debt that is well over 7 years old. They have violated my rights under the FDCPA Fair debt collection act. In XXXX XXXX, XXXX XXXX XXXX had a Civil Action against me. Love, Beal and Nixon filed it on XXXX XXXX 's behalf of a credit card debt of around {$1000.00} ( I dont know the true balance ) in XXXX XXXX Oklahoma. I was never informed of this court hearing. I found out when on XXXX/XXXX/XXXX when XXXX XXXX started garnishing my wages at 25 % per paycheck. The paperwork was supplied by my employers, not XXXX XXXX or Love, Beal and Nixon. That was when I contacted XXXX Co Courthouse for documents of the Civil Action. The balace of the bill was {$4800.00}. That was about five times the accual amount of the bill. Then I moved from Oklahoma to Florida in XXXX XXXX due to the tornadoes destorying my home. In a new job in Florida I was yet again getting my wages garnished on XXXX/XXXX/XXXX. XXXX XXXX again thru Love, Beal and Nixon was garnishing wages at 25 %. I called XXXX XXXX and they told me I would have to contact the lawer firm handleing the case. I called Love, Beal and Nixon and tried to settle the case due to financially difficulties I was having. I was informed that they would not settle and if I didnt pay the full amount they could go to court and get me to pay more money than I owed. Love, Beal and Nixon didnt record my phone call and the woman I was speaking with refuse to tell me her name. She was cussing at me and telling me the firm and XXXX XXXX owned me and they could do what ever they wanted to get payment, the court was on thier side. About 4 months later I was contacted by Love, Beal and Nixon about settleing the debt. The man stated he was authrized to allow the amount garnished to be enough to settle the debt. He would be sending me a letter in the mail stating the debt was settled and considered paid in full. The letter never came. I tried to contact Love, Beal and Nixon at the phone number he provided and it was disconnected. Then called the phone number on all the papwork and was hung up on. Then on XXXX/XXXX/XXXX XXXX XXXX allowed Love, Beal and Nixon to garnish my bank account. They took {$1000.00}. XXXX XXXX and Love, Beal and Nixon has never once contacted me on any of the court cases against me. Niether has XXXX XXXX XXXX house where the judgements are coming from. The debt is well over 7 years old and doesnt even show up on my credit report anymore. Plus the fact that they settled with me and yet still coming for money and the XXXX Co Court is letting them. I know now that XXXX Once and Love, Beal and Nixon lied to me about the settlement as I have never gotten the promised settlement letter.

Company Love, Beal, and Nixon, made a false statement that I had been properly notified about a court action regarding a debt they claimed I owed. ( It stemmed from XXXX XXXX for my granddaughter, XXXX XXXX ; they claimed that I co-signed. I did not ) They said I had been properly served. I had not been. Since I had not been notified, I did not appear in my own defense, so they won a judgment XXXX XXXX XXXX ) and placed a lien on my property without my knowledge. They did not notify me in any manner. I did not find out about it until I applied for a property loan in XXXX of XXXX. Love, Beal, and Nixon is the company who won the judgement against me, stated that I had been lawfully served, and filed a lien on my property. Part of the troublesome path I have been through is that three companies stall and waste time by blaming the other. All three are involved. I first filed this complaint against XXXX, XXXX, XXXX, XXXX XXXX XXXX. XXXX because they were the ones who finally notified me that I was being help liable for anything. I named them because your question asks who notified me of this debt. I got a lawyer in XXXX of XXXX, who won for me, Order Vacating, Voiding, and Holding for Naught Judgement Lien that has been filed with Registrar of Deeds. Also a judgement for lawyers fees. The court minutes awarding lawyer 's fees in the amount f {$1900.00} and signed by XXXX XXXX, is against XXXX XXXX XXXX , XXXX with XXXX attorneys named, Love, Beal, and Nixon, and XXXX, XXXX, XXXX, XXXX, & XXXX. I can not afford to pursue collection. Now a lawyer tells me there is a two/three year statute of limitations to sue them. And I ca n't collect the judgement because the cost is prohibitive. Love, Beal and Nixon won in court without proper serving. ( They said I had been served by leaving information with my granddaughter, XXXX XXXX, at her house in which I had never lived. ) Love, Beal and Nixon filed a lien for {$7100.00}. I was never notified. Love, Beal, and Nixon ( or XXXX XXXX XXXX for whom they acted ) owes me {$1900.00} as awarded by XXXX County judge, XXXX XXXX. I have suffered other financial damage because of being denied a loan from my bank. I have suffered other damage because of the time and stress in tying to deal with this series of events. I have documentation for all these activities, but I do not know how to attach them. It is all on hard copy because my computer blew last fall and this electronic file went with it! The company has received all the material either from me or from my lawyer. I have 43 pages of documentation, if the company wants to see any of it, I can mail hard copies to them.

This a new complaint about the following complaint XXXX. On XX/XX/XXXX, I received a letter from the law firm of Love, Beal, and Nixon, P.C. stating that I owe XXXX XXXXXXXX XXXX XXXX with the original creditor being XXXX XXXX, XXXX. The letter stated that I owe XXXX XXXX XXXX XXXX {$7600.00}, which is no longer valid. I listed this debt on my Chapter XXXX Bankruptcy on XX/XX/XXXX, and my Chapter XXXX Bankruptcy was discharged on XX/XX/XXXX. I responded with a letter stating that this debt is no longer valid due to Chapter XXXX Bankruptcy and to contact my attorney XXXX XXXX. I received another on XX/XX/XXXX from Love, Beal, Nixon, P.C. stating the debt is valid and still trying to collect money for the debt. I called Love, Beal, Nixon, P.C. to tell them to stop contacting me. I spoke with a male account manager who was very rude and would over talk to me. He kept stating that debt was valid because it is a student loan. I explained to him that it was a credit-based private student loan and NOT a federal student loan. The account manager said that he would contact my attorney. I feel like this debt collector is trying to take advantage of me and violating the Fair Credit Reporting Act. The credit-based private student loan even shows discharged from Chapter XXXX Bankruptcy on all three credit bureaus. I believe Love , Beal & Nixon , P.C . is being dishonest and withholding information or documentation. Also, I believe the law for violating federal law by harassing and contacting the consumer. The law firm stated that they checked and my private student loan was not discharged in my chapter XXXX bankruptcy? What did they check? Company 's Response : Love , Beal & Nixon , P.C . ( LBN ) represents XXXX XXXX XXXX XXXX XXXX XXXX, A Delaware Statutory Trust in a civil action filed against XXXX XXXX XXXX on a defaulted student loan obligation. LBN acknowledges the bankruptcy filing by XXXX XXXX XXXX. However, LBN has confirmed there was no adversary action filed within the bankruptcy proceeding. As a result, the student loan obligation has not been discharged by the bankruptcy proceeding and our client has given us authorization to proceed.

Dear Sirs My wages are being garnished illegally by Love, Beal, and Nixon representing XXXX XXXX. They began harassing me for debts that was charged off at XXXX department stores. One of their representatives came to my job and left a note with the receptionist about the garnishment trying to intimidate me while working at XXXX college in XXXX. I called the company to explained that I could afford to pay the debt and do not approve of them coming to my job.. They ignored this and sent a representative to my home and let a paper with my sister about paying the debt but did not provide any information about a court date. The situation concerning this garnishment was canceled and appeared on my credit report as paid by XXXX.with a XXXX balance. The Love, Beal, and Nixon debt collection agency representing XXXX XXXX proceeded with another garnishment from a credit card company named XXXX XXXX XXXX which was charge off in XXXX. They began this harassment in XXXX with calls and letters and got a court order to garnished my wages wherever I worked. They began a garnishment at XXXX XXXX in XX/XX/XXXX, where currently work. They did not send a notice to me but sent to the job in XXXX and the XXXX XXXX did not notify me until 3 days before my payday XX/XX/XXXX, from the payroll office. The XXXX XXXX company did give the information so I could file an exemption. They garnished my bank in XX/XX/XXXX for {$17.00} dollars. I sent an exemption letter to them because they requested this information. I did not have the opportunity to contact the court concerning the latest filing of the garnishment. I make XXXX a hour and taking 25 % per pay period, and I cant afford to pay my bills. I have a shared debt with my ex to XXXX XXXX XXXX XXXX XXXX. that was escalated to a debt collector ( Love Beal & Nixon ) in XXXX. First of all, I tried refinancing with XXXX XXXX XXXX and told them that if they couldn't refinance with me I wouldn't be able to make my payments, as my ex ( the co-owner on the car ) backed out of his share on payments when we broke up. They would not even consider it. So I had to voluntarily surrender my car. Secondly, I was never served ( I never received a summons! ), yet somehow I ended up sued. Apparently the summons went to my ex 's address and I didn't know about it until my ex told me what happened after the fact. Nevertheless, I made a payment arrangement with Love Beal & Nixon, the debt collector. I had been making automatic monthly payments of {$50.00} to Love Beal & Nixon since then ( XX/XX/XXXX ) until XX/XX/XXXX, when I changed banks and forgot to update my payment method with Love Beal & Nixon, and my payments to them stopped. The last payment was on XX/XX/XXXX. Nobody ever contacted me in any way to try and collect the debt again, but my boss got a letter in the mail yesterday ( XX/XX/XXXX ), stamp dated XX/XX/XXXX, from the state to garnish my wages. I called Love Beal & Nixon this morning at XXXX XXXX and asked if I could continue making my payments and they told me no, it was too late. Then the lady I was speaking with told me the state already took over {$500.00} out of my check on XX/XX/XXXX, which isn't true. I got paid my regular amounts on the XXXX and the XXXX, and I verified with my boss that nothing has been garnished. She flat out lied to me, giving me false information that wouldn't even be Love Beal & Nixon 's concern anymore. I also have call recording on my phone, but somehow they blocked recording, which makes them even more shady.

Love, Beal & Nixon got a wage garnishment against me for {$10000.00} for a debt that is not mine from XXXX. LB & N claim that I owe this debt. The debt is from a credit card company called XXXX. They went out of business in XXXX.XXXX, picked up the debt in XXXX and sued me then XXXX XXXX in XXXX. I have never heard of XXXX, nor have I ever been served with a Subpoena to appear in court. XXXX hired Love, Beal & Nixon a debt collector, I don't know when. I'm guessing in XXXX. LB & N say they served me a subpoena in XXXX, which is a bold face lie. I have NEVER been served with a subpoena of any kind, from anyone. Now zoom to XXXX LB & N have gotten a wage garnishment against me for almost. I called them to see if they would take less, or get some kind of payment just to get this over with. I first offered {$1000.00}, the {$2000.00}. She said that they want {$11000.00} now. What happening here, in order for me to get out of this debt, that is not mine, I'm being forced to file for bankruptcy. That's not right. I've spent the last 9 years building my credit, from a score of XXXX, to a score of XXXX. For 9 years I have never heard hide nor hair from Love, Beal & Nixon. Not a word. Now this. They want more money now, than what the garnishment is. At 29.99 % interest. There is absolutely no way for anyone to pay that off. I bring home {$1500.00} a month. And I am at my witts end. Nor do I want to file for bankruptcy. I don't know what else to do. They are trying to ruin my life. I'm XXXX, and I don't know who to turn to, but you. Please help.

We had to declare bankruptcy in about XXXX or XXXX. We were then told to try to build our credit back up a little at a time. So, we took out some preapproved credit cards. Not realizing that the finance charges were so unfair. Then my husband was badly hurt at work. At about the same time. He is on social security XXXX. I have XXXX and it is well documented. Anyway, that was a long time ago. And I told them we absolutely had no money. The man on the phone cussed at me, he called me a liar and he sounded like I had taken money from him personally. Anyway I refused to make any kind of payment plan as we did not know what was going to happen to my husband. He could not ever be fixed. He can not read. He only knows hard labor and he can not do that. I only got my card because it was preapproved. It was XXXX XXXX XXXX. I tried to make payments to XXXX XXXX but simply was not able. Now, a place called Love, Beal, and Nixon has a lien on our place for almost 3 times what was ever owed. The info I have on them is that they can not make a living as real lawyers so they pick up these old debts and they try to scare you or badger you until you pay it. They are based in XXXX XXXX OK, XXXX. XXXX XXXX, XXXX phone # XXXX XXXX XXXX XXXX filled out the lien. XXXX XXXX XXXX, XXXX, # XXXX, XXXX XXXX XXXX # XXXX are supposed to be the lawyers. It has been so long since I even had a credit card or a bank account. I just want answers. I want to talk to the original place, XXXX XXXX.

I received a demand letter from Love, Beal and Nixon P.C. in XXXX , regarding a auto loan with XXXX XXXX XXXX -I took out a auto loan with XXXX and was told by the dealership that it was a requirement from XXXX that I had to have an extend service contract. After finding out that this was wrong and a fraud loan, I sent back the car to XXXX -and I was working with them while they were suppose to be investigating the dealership. I sent them out a validation letter requesting : 1 ) since they are the law firm representing XXXX , what was the results of the investigation. 2 ) Per the contract, I signed with XXXX , I agreed that the contract will be governed by the laws of the state of Kansas-How were they able to sue or collect the debt under the laws of Oklahoma. They did not answer these questions-they just sent me back my contract with XXXX , and a letter stating what I owed. Also, I was looking at my credit today, and found an inquiry from this law firm, requesting my credit-I did n't sign ANYTHING, that allows them to checking my credit. At this point-I have tried to contact the law firm and I get nowhere-I would like them to send this account back to XXXX , where I can deal with the balance owe directly and get the answers that are owed to me. And I want the Inquiry and any credit reporting removed from credit report.

XXXX I was served a summons for payment on a debt. I signed and agreed. In XXXX of XXXX, I agreed to making payments to company. The judge agreed and signed off on payments. I paid every month. The company never responded to payments made online on their website and they did not give receipts. Court papers show payments were made in the amount of total {$300.00} on an {$1100.00} debt. XXXX the company started a garnishment on my wages stating I now owed XXXX. This was not reflecting the {$300.00} paid. They garnished my pay for the total amount including my bank account and job paycheck. The document states " Plantiff is NOT seeking continuous garnishment '' XXXX The company garnished again for {$540.00} XXXX after all debt was paid, the company garnished another {$570.00} with no explanation nor communication to me. They just took the money after the debt was settled and done. XX/XX/XXXX Now I have received a statement from my new job that they are garnishing again for another {$820.00}. They have no contacted me nor tried to settle any additional debt, but now this document reads " Plantiff is seeking continuing garnishment ''. The debt they have previously garnished has more than enough settled the original debt but they have not closed the debt or account and continue to garnish my accounts every year for the same debt.

XXXX XXXX bought from XXXX years ago I guess is trying to get money an just sued an put a judgement on me in which Ive never opened an account in XXXX of XXXX for XXXX an Ive told them.this company states that they sent letters to me but I never got anything in the mail from this company I didnt no anything about this account being opened until the end of XX/XX/XXXX when a guy showed up an gave me a paper. Ive tried numerous times to talk to these people but I get nowhere plus when they did finally send me the charges from a lawyer which was Saturday XX/XX/XXXX I dont recognize anything on those papers but yet its showing small amounts here an there on a few occasions that payments came from my checking account using my credit card in which that credit card was hacked into this is someone elses doing I even tried to login to XXXX Ive XXXX XXXX XXXX they told me I have never had an account with them an I never had I really dont no what to do an now theres charges an a lot of interest that has been added along with wreaking my credit. I was told if I dont have proof from these sorry lawyers then I cant prove anything an Ill have to pay everything an then some thing is is I dont have any proof to help at all.

Love Beal & Nixon PC out of XXXX XXXX, OK has been attempting to collect on a very old credit card debt from more than 10 years ago. I have moved addresses, moved states, changed phone numbers and jobs over the years so I guess they could not reach me. On XX/XX/2019 they seized my bank funds, totaling {$280.00} and reduced my balance to XXXX. I had no savings to pay a lump sum. Seizing my bank funds created undue hardship on my family. I couldn't pay my bills, get gas in my car to get to work, or buy groceries for my XXXX children. That is when I learned they had taken legal action against me for this very old debt. I don't know what to do. I am living pay check to pay check, I still have no savings. It takes every penny I earn to pay my monthly expenses. I just can't afford to pay another person. I called them in XX/XX/2019. They said they would settle for a ridiculously high amount. They already took every dollar I had, and that only amounted to {$280.00}. Why would they think I could suddenly pay {$4000.00}? I live in fear that they will garnish my wages or take more money out of my bank account. I will not be able to survive. My children and I will become homeless.

I was contacted by the debt collection agency in regards to the debt I owed on a credit card. I had closed the account with the company because I knew I could n't make payments because I had lost my job. After several phone calls I was forced to block the number they were calling from because they would not cease and desist. It was a few months later when I received a phone call from my brother informing me that they had called his wife 's parents in an attempt to get my information. I explained the situation to my brother and apologized to his wife 's parents. Since that transpired the company has filed in court against me and I 've responded with a request for line item detail of the debt. They sent me a copy of the old credit card bill, that is all. I offered to settle and make payments, but they would not compromise. When I notified the woman on the phone that I would be making a harassment complaint she became angry and hung up the phone. The debt collection firm is Love, Beal, and Nixon out of XXXX ; notorious for trying to get default judgements and using scare tactics on people.

Love , Beal & Nixon , P.C . Of XXXX XXXX, Oklahoma sent a process server to my home without any previous contact stating they have sued me for a debt collection from the past. I was sure I had paid this debt in the past but apparently not. This took place on XX/XX/2018. Since then I had made payment arrangements with them to pay {$50.00} a month towards a debt totaling {$1100.00}. I have made 7 payments to them so far. I checked my credit and it showed I had been making payments and it was down to {$810.00}. The last payment I made was on XX/XX/2018. A week later I received another notice in the mail stating I had not been making any payments and my balance was {$1100.00} and I needed to make payments or I would be garnished or sued again. I emailed them and told them I had made 7 payments and that my debt was down to {$810.00}. They also hit my credit report for being in collections and not paying which hurt my credit score badly. I have documented proof of my payments and dates and the original debt amount etc. they havent responded to my email in a month.

I was contacted by a debt collector in XX/XX/2016. I made an offer to repay loan. The representative told me he would submit my offer and get back to me. A week went by and I got no response so I called him back left a message. Waited another week called left another voicemail still no response. I was served with court proceedings regarding this student loan. I have been in negotiations with them. I made another offer to repay the loan. The same representative called me back and said the company wanted {$50.00} more a month than my offer. I explained I can not afford this at the moment. Once I pay some other debt off I could make higher payments. He wanted me to submit my personal checking info to his company. I do n't feel comfortable doing this. Love beal and Nixon illegally sued me and got a default judgement against me I never received a date of the hearing I called the court house several times they never gave me a date I even responded to the motion still never received a date.. I called and spoke to XXXX and was set up on a payment plan for XXXX accts I sent in payments for XXXX accts they accepted the payments. They then put a garnishment on my checking acct even though I am set up on a payment plan.. It is my understanding that they can only take up to 25 % of monies in my acct they have taken everything I was once again never notified by XXXX not the bake I still have not received anything from them. Love Beal and Nixon, a collection company is violating the discharge injunction by trying to collect on a debt that was discharged in bankruptcy. This is Civil Contempt. This loan was direct-to-consumer loan above the cost of attendance and was not a qualified education loan. OCU stated that I received refunds from my federal student loans. The private student loan was above the cost of attendance not used for education and is not a qualified education loan. It was discharged the same as any other common debt, just like credit cards. The creditor in question, Love, Beal & Nixon, PC ( hired by XXXX XXXX XXXX of XXXX, OK. ) continued to attempt collection from me on a credit card account I had no knowledge of AFTER I advised them I had secured an attorney. Company Love Beal and Nixon : Put a hold on our bank account and said they will take out what's in there. We owe them {$3300.00}. The original creditor is XXXX XXXX XXXX, and the credit card was closed by the creditor due to fraudulent/suspicious activity. I reached out to the original creditor to go over my credit card account. However, the customer service representative who was based out of XXXX wanted me to send him copies of my checking account bank statement. I told him that I did not feel comfortable sending him copies of my bank statements, so the customer care representative based out of XXXX would not help. I disputed the original creditor on all three of my credit bureaus, and the account was removed from all three credit bureaus. This issue took place back in the Fall of 2019.

Papers came in the mail today that i have court for a debt that's 6 years old. The last known action on this account was XX/XX/2017, according to the debt collector. That makes this debt past the statute of limitations, of 5 years, in Oklahoma. I'm unsure how they are still able to move forward in court if they're not following the law in Oklahoma. Yet they have a date set for court that I'm supposed to attend. I have not been given confirmation of the account or any debt account validation. A judgment was received by this company illegally. They stated that the served me with notice of this judgment, however, this is a lie. The date they say I was served I was in bed recovering a XXXX. in 2013 I was XXXX, XXXX, XXXX XXXX. I could not have been delivered papers regarding this and there was no one else at my home who could have accepted it at the time they are stating. I was in bed, on XXXX and could not have walked down the stairs to answer the door. I did not even know about the court date or I would have shown up in court. A garnishment hold was placed on a checking account of mine for a debt that is not mine. I have called several times this past year trying to ask who the alleged debt is for why they are continuing to garnish my wages when I have paid $ XXXX but last notice I received had the total a tad over {$4000.00} they can not find my name or SSN in thier system. My girlfriend at the time was served with court papers. She advised the person I did not live there at this time and she threw the papers at her.
