On XX/XX/2021, I was provided pricing information from Sage Title Group in XXXX, Maryland ( XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, MD XXXX ) for settlement services. XXXX XXXX, the Managing Attorney provided me the pricing information via email. The email did not state that purchasing an owners title insurance policy was required in order to rely upon Sage 's settlement services and specifically stated " There are no other hidden charges. '' The email also represented that I could rely upon Sage 's website for the pricing of an owners title policy. The email attached a " XXXX XXXX XXXX '' which stated, in part, " nothing mandates the prospective homebuyer to purchase an XXXX XXXX XXXX policy '' ( see page numbered 16 ). Neither the XXXX XXXX XXXX nor any other information provided to me by Sage at this time indicated that I would be forced to purchase an owners title policy or that I would not be able to place reliance on other professional services procured from Sage. On XX/XX/2021, I ratified a contract to purchase a property in the District of Columbia and chose Sage Title Group as the settlement agent. On XX/XX/2021, XXXX week before the closing date of XX/XX/XXXX approached, I informed Sage Title Group that I did not wish to acquire an owners ' title insurance policy. In response to that, Sage provided what appeared to me to be misleading information about title insurance ( e.g., a decade plus old article and misleading statistics about title insurance claims ) and informed me that if I did not purchase title insurance, then I would be required to " execute a hold harmless agreement absolving Sage Title Group, LLC of any liability arising out of our role as the settlement agent. '' Upon objecting to this new requirement on the basis that it was unfair inasmuch as it required me to either 1. ) purchase an expensive insurance product with a usuriously low payout ratio and on which Sage would likely earn a significant commission or 2. ) no longer be able to rely in good faith on the settlement services Sage represented to be the core of their business and experts in performing, I was told that Sage would not perform my closing unless I agreed to either 1 or 2 above ( also an untenable situation inasmuch as I would likely then not be able to close on time, potentially be in default on the contract, and potentially forfeit my earnest money deposit to the seller of the property ). This happened during a phone call on the evening of XX/XX/2021 - After which I emailed Sage stating that I would purchase the standard owners title policy because I did not believe I had a choice given the prior conversation with XXXX XXXX. As I attempted to work through this issue with Sage I was told I could rely on their website to provide me an accurate owners ' title insurance quote. Upon speaking to XXXX XXXX on XX/XX/2021 and attempting to confirm that the quote being generated from Sage 's website, which showed the cost of the owners ' title policy to be only a XXXX XXXXXXXX dollars, I was told that the quote was not correct and that I must be inputting data incorrectly. XXXX XXXX told me that he'd have his team send me a proper quote in due course. On Wednesday, XX/XX/2021, I received quotes from Sage Title ( XXXX XXXX ) stating that the cost of an enhanced owners ' title policy would be {$920.00} and that the cost of a standard owners policy would be {$570.00}. The day prior to closing ( XX/XX/2021 ), I received the XXXX stating that the cost of the standard owners title insurance policy would be {$820.00} ( not the {$570.00} previously disclosed ) When I questioned why the cost had increased from the quote provided just one day before, on XX/XX/2021, I was told that it was because I had changed the amount of my loan, which was not true as the loan amount did not change at any point after contract ratification. At closing, I was charged {$820.00} for the standard owners policy I was forced to buy by Sage ( by virtue of being given untenable other even less tenable options by Sage ). In short, I believe that Sage engaged in deceptive marketing practices by hiding the requirement that I purchase title insurance from them in order to rely on their other services AND FURTHER that Sage hid and/or misrepresented the cost of the owners title insurance policy from me until just one day prior to closing.

I am writing to submit a formal complaint against XXXX XXXX XXXX ( XXXX XXXX : XXXX ), a representative of Prosperity Home Mortgage , LLC ( XXXX : XXXX ) where, XXXX XXXX is employed under the title Senior Mortgage Consultant. I am the seller of a real estate transaction involving a XXXX XXXX unit located in XXXX XXXX ( hereinafter the Property ). The Property was placed under contact on XX/XX/XXXX. The Buyer elected to pursue a VA loan, and the transaction had the following dates set, as communicated to both parties on the Mutual Acceptance Date : Binding Agreement Date : XX/XX/XXXX Due Diligence Contingency Expiry Date : XX/XX/XXXX Financing Contingency Expiry Date : XX/XX/XXXX Appraisal Contingency Expiry Date : XXXX XXXX Closing Date : XXXX XXXX XXXX XXXX was the point person when it came to the Buyers mortgage. She handled communications with not only the buyer-side and seller-side realtors, but also the closing attorneys. Ergo, it is reasonable to presume that she directed, or otherwise oversaw and had direct detailed knowledge of, the Buyers VA loan application process. The Closing Date was pushed back twice first from XX/XX/XXXX to XX/XX/XXXX, then from XX/XX/XXXX to XX/XX/XXXX. The reason behind the delays on both occasions was the Buyers mortgage process was dragging out. Throughout these delays, XXXX XXXX falsely represented that the only thing holding back the mortgage ( and therefore the closing ) was the appraisal of the property. Indeed, an XXXX didnt even enter the Property until XX/XX/XXXX, the day before the initial closing date. Why there were seemingly no efforts to hire alternative appraisers, or otherwise try to speed up the process up to the day before the initial closing date, Ill never know but thats secondary. What matters for this case is that the appraisal delays were the quoted reason behind the closing date being pushed back twice, and through it all XXXX XXXX claimed this was the sole item of concern prior to closing. In fact, XXXX XXXX personally represented that the buyer was well-qualified, and had all the necessary pre-approval to proceed with the VA loan for this specific transaction. The appraisal report was received by XXXX XXXX on XX/XX/XXXX, and the purchase price was supported, clearing the way for closing on XX/XX/XXXX. However, the deal fell through on the day of closing when the Buyer defaulted on the contract by failing to secure a loan. To believe the buyer sides explanation, XXXX XXXX failed to identify whether the Property was VA approved or not. Needless to say, this is a critical first step to determine whether the Buyer can qualify for a VA loan for the deal, and certainly falls under the financing contingency. It is clear that XXXX XXXX either knowingly misrepresented the status of the Buyers mortgage application process, or was negligent in her duties to perform the most basic due diligence when processing the Buyers VA loan application. As a side note, the management of the Property clarified that the building was VA loan approved, and a simple building search on the VAs own Loan Guaranty website lists the Property as approved. The detrimental combination of XXXX XXXX actions and failures has caused significant harm to both sides of this transaction. As the Seller, I have incurred significant costs for speeding up the moving out process, paying for temporary housing arrangements, and a multitude of mortgage, HOA, and interest related financial charges.

I applied for a loan with XXXX XXXX # XXXX at XXXX Mortgage on or about XXXXXXXX XXXX. After submitting my tax documents, VA Benefits, ID, Social Security Number and other requested documents, I received a pre-approval letter. Yet after several bids for a home were unsuccessful, I decided to change my approach by getting a more seasoned real estate agent and utilizes the down payment assistant programs ( XXXX ) that XXXX offered which provided up to 4 % downpayment assistance and since I was using my VA loan ( 100 % financing ) I was told I could use the downpayment for my closing cost. Yet after having an extensive conversation with both my new agent and XXXX XXXX, to confirm I could use the XXXX downpayment assistance to cover my closing cost, I put an offer on a house on XX/XX/XXXX only to be told once the offer was accepted that Prosperity Mortgage no longer worked with XXXX as of XX/XX/XXXX, for various reasons but as a concession he could raise my interest rate to give me a credit that would cover my closing cost. While, I was very disappointed in XXXX XXXX 's lack of company knowledge, I merely voiced my concerns on how I didn't like surprises and given we had just had an extensive conversation on XX/XX/XXXX, to confirm I could use the program, I pushed through because after looking for a house for over 3 months and being outbid on multiple properties, I was overwhelmed and tired of looking. Here 's why I am reaching out, shortly after expressing my concerns to XXXX XXXX, our business relationship took a turn for the worst. My loan went to the underwriter, but prior to that I had some issues with the IRS, due to Covid-19, my amended taxes had not been processed, for which XXXX XXXX, instructed me to contact the IRS to set up a payment plan, because my amended taxes reflected a balance, but my transcripts reflected a XXXX balance. After many conversation with the IRS and XXXX XXXX, I was able to get a XXXX Installment agreement, yet after submitting the document to XXXX XXXX, he quit the company, and I was informed by his superiors that my loan was denied because they were not able to verify my income with the IRS. I was also told by his supervisor XXXX XXXX XXXX XXXX, that a payment plan would have never been sufficient if the IRS hadn't processed the amended taxes and updated it in their system. Subsequently, I lost earnest money, pool and home inspection money because XXXX XXXX was unethical in his XXXX XXXX to get a deal done. While, I would love to be a homeowner again, if XXXX XXXX would have been upfront and honest, like other loan officers I spoke to after being denied, I would have respectfully waited until the IRS had my amended taxes updated and reported on my transcript. While, I am not 100 percent sure, but given my first real estate agent who I fired due to her lack of experience, referred me to XXXX XXXX. I sincerely feel they were in XXXX and equally unethical by not advising me, my loan was never going to be approved without the IRS reflecting my amended income. Lastly, I would like to add, the home buying process is hard enough in this market but with unethical, uninformed, money hungry loan officers makes it even harder. I trust this message was detailed enough and will help you make the best decision in reprimanding XXXX XXXX, as I see it, anyone who would be as malicious and unprofessional as XXXX XXXX should not be licensed to work. In XX/XX/2021 our buying agent suggested we contact XXXX XXXX, Mortgage Consultant. We were in the process of purchasing a home in North Carolina. XXXX was very helpful in the preapproval process. He called to let me know that we were preapproved. We did not get a formal approval letter. At that time, I asked if we needed to sell our current home first. He said we did not. We had a set preapproved amount to stay under. In XXXX, we wanted to bid on a house which was higher than our preapproved amount. XXXX called me and asked if we were going to sell our current house. I said that was the plan. We werent planning on owning two houses. All he said was if we got that house, we would have to show our current house as being listed for sale. During the two months we were part of the house bidding wars, XXXX was very helpful. He was very reassuring and answered all my questions. Unfortunately, the morning after we signed a purchase agreement for a house in North Carolina, which include {$30000.00} for due diligence, all that changed. XXXX told me he miscalculated and we would need to close on our current house before closing on our NC house. I tried to share with him that that would be impossible because closings in our state were taking 8 weeks or more to happen. What this meant for us was that we could lose our {$30000.00} DD deposit and NC house if we couldnt close our current house first. There arent lots of appraisers and big banks in our small state. He said there wasnt anything he could do. When I asked him why he didnt tell us that sooner. He responded that I should have known that because he would ask how it was going listing our current house. At no point during the preapproval process did he share this very important piece of information. Our nightmare of working with XXXX began that day, went for 45 days, and didnt end until 2 hours before our closing. During those 45 days XXXX miscalculated multiple items. As a bookkeeper, I would create spreadsheets and share supporting information to show him how his calculations of some of his numbers was incorrect. He never responded, however, at the end of the 45 days he did use my corrected numbers for his final calculations. During that time, I came up with a way we could remove the need to close on our current house before closing on our NC house. XXXX approved it. Unfortunately, he didnt ask how I was going to do it until a few days before our closing. Then his referred to a XXXX XXXX ruling saying we couldnt do it, however, when I looked up the rules it clearly said we could. I sent it to XXXX, but he didnt response and admit he was wrong. The thing I dont understand is that in the end he ended up using the same numbers from our preapproval without saying we needed to close on our current house first. Of course, at no point during the 45 days, did he actually say he was wrong about anything. We started the process in XXXX. Because of his constant errors we didnt get final approval until 2 hours before our NC closing. It shouldnt have taken 3 months to get final approval. It was a living nightmare working with XXXX XXXX!!

My husband and I refinanced our mortgage on our primary residence in XXXX, reclosing on the new loan on XX/XX/XXXX. Our primary goal was to get rid of PMI on our loan, though we also sought a lower interest rate, lower monthly payment and would have liked to get some cash out to pay off a vehicle. We could have done a streamlined refinance through our existing lender to simply get rid of PMI at considerably lower cost. We live in the City of XXXX. Last spring, the City raised taxes exponentially. The notice of " proposed '' property tax increase was sent to all property owners, and well-publicized around XXXX ; it was covered in the mainstream media, and well known to industry professionals. We challenged the property valuation, and brought the valuation down by approximately {$25000.00}. Nonetheless, our property taxes increased by {$1000.00} between XXXX and XXXX. This was not a surprise. The lender was only able to offer a modest reduction in our interest rate, from XXXX with our previous lender to XXXX with the refinance. PMI would be removed, we could not get cash out. The representation in reduction in our monthly payment was largely due to an underestimation in our property taxes, which we did not realize were based on our XXXX property taxes. So while our total monthly payment, including principal, insurance and property taxes, would go from {$1400.00} to {$1100.00}, that was based on inaccurate information. Now, less than 6 months after we financed an additional {$6000.00} into this loan due to this refinance, we received notice that our escrow account is inadequate, and our new payment will be {$1200.00}. Had we simply done a streamlined refinance with the original lender, eliminating the PMI in the amount of {$100.00} per month, there was no reason to incur the additional debt for a half percent savings on the loan. I brought this complaint to the mortgage broker, Prosperity Home Mortgage. The Senior Mortgage Consultant, XXXX XXXX told me that, " by law we can only collect escrows for what is actual at the time and the only tax bill available was for XXXX since the XXXX tax bills don't come out until XX/XX/XXXX. '' She has since stopped returning my calls since I asked her to identify that law, since I do not believe there is any such law. Her statement is inconsistent with the law I found, which provides that escrow can provide a discretionary 20 % cushion for such increases, in addition to which WE HAD NOTICE of this increase. This industry is based on speculation. For something as certain as taxes, it is absurd and irresponsible that they would not request the data we had available, and rely upon it. We were misled, and now incurred a needless {$6000.00} of expense. I am requesting refund of the fees paid to this company, for either intentional or negligent misrepresentation.

On or around XX/XX/XXXX I engaged in a consumer credit transaction in regards to a mortgage loan with Prosperity Home Mortgage , LLC with XXXX XXXX as my Mortgage Consultant. On or around XX/XX/XXXX XXXX XXXX contacted me via email to inform me that she was unable to complete my application but had ran my credit scores stating " XXXX score is " XXXX '' and XXXX XXXX is " XXXX ''. Since XX/XX/XXXX I have tried to contact XXXX XXXX via phone and email I have not gotten a reply. The last time trying to contact XXXX XXXX was XX/XX/XXXX around XXXX pm after receiving an email from her minutes before understanding it was not a business day, to apply about moving forward with my application process. Nevertheless, I had concerns regarding my rights pursuant to title VII ( Equal Credit Opportunity Act ) ( 12 CFR 1002 ) of the Consumer Credit Protection Act, as amended ( 15 U.S.C. 1601 et seq. ). Even though XXXX practice appears neutral on its face, requiring that applicants have income in excess of a certain amount to qualify for an overdraft line of credit could mean that women and minority applicants will be rejected at a higher rate than men and nonminority applicants ( 1002.6 ) - Rules concerning evaluation of applications. However, a creditor may not consider in its evaluation of creditworthiness any information that it is barred by ( 1002.5 ) from obtaining or from using for any purpose other than to conduct a self-test under ( 1002.15 ). Except as otherwise provided in the Act and this part, a creditor may consider any information obtained, so long as the information is not used to " discriminate '' against an applicant on a prohibited basis. The legislative history of the Act indicates that the Congress intended an effects test concept, as outlined in the employment field by the Supreme Court in the cases of Griggs v. Duke Power Co., 401 U.S. 424 ( 1971 ), and Albemarle Paper Co. v. Moody, 422 U.S. 405 ( 1975 ), to be applicable to a creditor 's determination of creditworthiness. Also, I do not waive any rights under ; 1. 12 CFR Part 1002.15 - Incentives for self-testing and self-correction ; 2. 12 CFR Part 1007 - ( Regulation G ) - definitions ; 3. 12 CFR Part 1016 - Privacy of Consumer Financial Information ( Regulation P ) or any other consumer rights thereof.

To the CFPB : I am writing for help in getting Prosperity Home Mortgage of XXXXXXXX XXXX to stop sending me unwanted mortgage refinancing offers. I have asked them twice to stop, but I have already received XXXX offers in the last XXXX This is despite the fact that I have never heard of them, I have never expressed an interest in refinancing my current mortgage, I have previously contacted every single one of the many banks who have solicited me about refinancing my mortgage to opt out of further mailings, I have long ago permanently opted out of all credit offers from the XXXX XXXX XXXX, and the terms that Prosperity are offering are much worse than what I currently have, even if I were interested, which I am not. I got a mortgage refinancing offer from Prosperity on XXXX XXXXXXXX XXXX. I tried the phone number on their letter a couple times to tell them to stop soliciting me, but no one ever answered. The next day, at XXXX XXXX on a XXXX XXXX XXXXXX/XX/XXXX ), I got a callback from XXXX at Prosperity. When I returned his call, no one answered, but I left a voicemail saying I was not interested, and to stop sending me solicitations. On XX/XX/2023 I got a second identical unwanted Prosperity mortgage refinancing XXXX This time I went to the companys website, and sent an email to XXXX, the person it said to contact for complaints. On XX/XX/2023 and then again on XX/XX/2023 I got a third and fourth unwanted solicitation, even after I had told them once verbally and once in writing to stop contacting me. I know from past experience that some banks and the mass mailing companies they contract with will not stop until forced to do so. If I took no action, my tiny mailbox would soon be overflowing with nothing but unsolicited and unwanted mortgage refinancing offers. This imposes an unfair burden on me, a XXXX XXXX war veteran, who has to constantly empty his mailbox and bring this junk mail to the recycling bin behind my property. The response code that Prosperity wrote on their letters to me is XXXX.

XX/XX/XXXX I applied for a mortgage with Prosperity Home Mortgage ( XXXX, GA ). I provided all financial documents requested and received a pre-approval for XXXX ( XX/XX/XXXX ) which increased to {$180000.00} ( XX/XX/XXXX ) .The mortgage consultant XXXX XXXX NMLS # XXXX requested that I try and have a late payment removed to increase my buying power, but other than that my scores were good with a range between XXXX. Initially I was not finding any homes I liked. After about 2 months in that changed and my realtor XXXX XXXX began putting in offers with the pre-approval from XXXX. In the beginning of XXXX, XXXX began asking questions that he asked in the beginning about my income and adding my husband to the application. With me having stronger credit I told him no to keep the application with just me. My realtor asked me to contact someone else she knew and had confidence in to possibly submit an application. After speaking with this gentleman he said it didnt take an application for him to know my DTI was too high and he didnt understand how XXXX was able to get the pre-approvals in the first place. I contacted another lender who said the same thing. After months of having the pre-approval, XXXX says he couldnt get me approved. XXXX has done a credit check 13 times. There are 13 inquiries on my credit report because of his negligence and total disregard for my credit history. I reached out and he said there was nothing he could do. He said the inquiries would not affect me but that was another lie. I have been denied credit due to high inquiries. The company he used XXXX was all that appeared 13 times. I was told a supervisor would call and that never happened. I also filed a XXXX complaint and sent one in directly Prosperity and never got a response. These inquiries are unacceptable. There should be one at the beginning and one at the end of the process depending on how long it took to find a peppery to purchase. The entire process was negligent on his behalf and very misleading.

On Tuesday XX/XX/2023, I was connected with XXXX XXXX ( Licensed Loan Officer ( XXXX # XXXX ), Prosperity Home Mortgage Direct ( XXXX # XXXX ) ) through XXXX. I was looking on XXXX just to get an idea of rates. I was connected with XXXX within minutes. I informed her that I was interested in looking into a HELOAN for {$20000.00}. She confirmed she offered this product and proceeded to take my information. Approximately 20 minutes later she called me and said that she had good news, she had great refinance options for me. I told her I wasnt interested in a refinance ; I was only interested in a HELOAN. She said with the amount I wanted to borrow, she couldnt do a HELOAN and reiterated she could do a refinance. XXXX knowing that I was only looking into a {$20000.00} HELOAN and knowing that she COULD NOT help, still took my information and ran my credit. She intentionally misled me from the beginning and ran my credit knowing she didnt have the product I requested. I don't even think Prosperity Home Mortgage offer home equity loan/line of credit options ; however, she still took my information, processed an application and ran my credit. The first issue- XXXX should not have proceeded with the application or the credit pull because she didn't have the product/service I was interested in. Secondly- as a result of the credit pull, I have been inundated with calls and text messages from loan officers, brokers and mortgage companies that believe Im looking for a mortgage or a refinance. I received 67 CALLS on XX/XX/XXXX starting from XXXX XXXX to XXXXXXXX XXXX This was even with me turning my phone off periodically throughout the day. I ultimately turned my phone off at XXXXXXXX XXXX or who knows how late the calls wouldve gone. This also doesnt include the numerous text messages I received. The calls started again today ( XX/XX/XXXX ) at XXXXXXXX XXXX keeping pace with yesterday. This is maddening and absolutely ridiculous!

I had applied for a mortgage with Prosperity Home Mortgage LLC in XXXX of XXXX with Loan Officer XXXX XXXX NMLSR XXXX. I and my Real Estates Agent XXXX XXXX were told at the time everything was " a go '' and we could begin to look for properties. We found a property at XXXX XXXX XXXX XXXX, Tx. XXXX and put in an offer. Mr. XXXX said at that time all was good. I talked with him several times on the phone. I was concerned because I knew that there were issues with my credit being borderline, but he continued to say that " we're good. '' According to my credit report he checked my credit on XX/XX/XXXX. After the offer was accepted and Mr. XXXX told me " we're good '' I paid {$470.00} dollars for a Home Inspection with another {$50.00} for termite inspection. I then received a message from Mr. XXXX office that they need {$550.00} for appraisal. I sent that to them that day. During this time my realtor, the seller 's realtor, and myself ask Mr. XXXX to supply the loan letter to the seller 's agent. Each time he said he would get that to her that day. We were set to close XX/XX/XXXX. Title work was complete and all was ready. Mr. XXXX asked for a delay of 7 days. I then was bombared with request for the same paperwork over and over, He began to talk about issues with my credit to my agent, but still had not pulled it a second time. He would not talk to me directly during this time. He would not tell me directly that I wasn't getting the loan but told my agent she needed to find me a home to rent. XX/XX/XXXX came and the contract was not funded. I have never received the paperwork that denies the loan or shows why that is required by law. When my agent attempted to find out what was going on he stated only " I never gave you a loan letter. ''

After which, they did a hard pull against my wishes, did not send a pre-qual letter. The property I was interested when into contract in the mean time ( broker/agent were super slow ). So I found a new real estate agent in the mean time ( prior agent was also a scam/ghost artist and referred me to Prosperity ), he wanted to see the pre-qual letter and loan approval contract details, lots of details, he was skeptical. Prosperity Mortgage sent him a pre-qual letter and a flimsy cover letter on company letter head. No loan docs, no terms, no nothing. Then, Prosperity stopped taking my calls. They would also not return my emails. I went to other lenders to have them look at my situation and showed them the two pieces of paper I got from them. They all laughed and said no way did I qualify for a mortgage of any type, my DTI was WAY too high, that I got scammed, and the loan app would have bounced at time of closing. They all said Prosperity has a habit of doing this and ghosting clients. I did more research and found same was true. See the link. I simply want my credit restored and the hard pulled removed. That's all I asked. They refused to even get back to me, they just ignored me. I refinanced my XXXX ( just under {$700000.00} ) with XXXX XXXX, closing in XX/XX/2021. I made XXXX payments to Prosperity ( XXXX, XXXX, and XX/XX/2021 ) when I received information from XXXX XXXX XXXX XXXX ( XXXX ) that my loan had been sold to them. I registered on their website for automatic payments in mid-XXXX but noticed that my XX/XX/XXXX payment didn't appear on my bank website. When I checked my XXXX account on their website, it showed I was delinquent for XXXX, despite the fact that I paid XXXX in full to Prosperity. I called XXXX on XXXX XXXX and reported the problem. They said they would look into it. They said it looked like Prosperity had transferred the principal amount of my payment, but not the interest. I also reported this to XXXX XXXX the same day and received an email saying they would investigate. On XXXX XXXX, I received an email from XXXX XXXX ( with whom I have another loan ) reporting a negative report on my credit record. XXXX filed a delinquency for the full amount of the loan balance 12 days after I reported their error to them. I have been working with them since them but they have failed to remove the erroneous delinquency report from my credit record, causing my score to drop to very poor score. This seems to be a blatant violation of the Real Estate Settlement and Procedures Act, Section C ( 1 ), which provides for a 60-day grace period for reporting to credit bureaus. I have been in contact with XXXX XXXX from both Prosperity and XXXX but they have not removed this erroneous report from my credit record. I have made all payments timely. I am attaching email correspondence with XXXX XXXX showing that they acknowledge the error.

I purchased my home on XXXX with Prosperity Mortgage. My payments were listed on the following dates : XX/XX/XXXX {$1000.00} XX/XX/XXXX XXXX My mortgage was then transferred to XXXXXXXX on XXXX however the XXXX payment for XXXX was not posted nor the information shared with the new company. I have been receiving messages that my payment is late and this has impacted my credit score by 35+ points. My 1st payment with XXXX was authorized on XX/XX/XXXX and cleared my account on XXXX. When I contacted Prosperity I was placed on hold for more than 10 minutes. The second time I called I spoke with XXXX XXXX # XXXX Employee ID who informed me that no managers were available to respond because it was a Monday. The business hours indicate Monday to Friday on the website so I'm not clear as to why that was the response I received. I made XXXX aware of this situation and it now with their cashiering department but in the meantime my credit which I worked diligently to improve has been impacted and this has caused emotional distress. The response from Prosperity was unacceptable and did not meet the basic requirements for professional customer service. If this is an oversight on my part I intend to address the issue the expeditiously however is this error is on the part of Prosperity I would like their office to be accountable and investigated to determine if this is a pattern that can negatively impact the credit and lives of their customers unknowingly.

This is a nightmare. I am in tears when i wake up cause i know she is going to present me with lies, XXXX and unfairly lender practice. I am pushed me to XXXX. I dont care about the house anymore, waking it is sad cause I have to deal with the lenders bullying. I dont want to wake up or deal with this anymore. Nothing has been done fairly or legally. My lender does not ' talk to me she just drafts what she wants in the loan and we keep on and keep on changing it. not because of me but because she takes it on herself to set the loan up how she want. NO matter how many times I tell her not to. At that point I think she keeps doing this so I will not have a disclosure. and she will keep doing it until closing. Prosperity Home Mortgage XXXX " XXXX '' XXXX originated my loan. When I went to make my first payment in XXXX, I realized only after mailing the check that I had dated the check as " XXXX '' instead of " XXXX. '' I contacted XXXX to ask them if they would accept the payment. The indicated that could not and that I would need to make an online ACH payment. XXXX actually ended up cashing both the mailed check and accepting the online ACH payment, so they received and accepted XXXX mortgage payments in the month of XXXX. XXXX then sold both the mortgage and its servicing rights to XXXX XXXX. XXXX failed to credit both of these credits to my account upon receipt as required by of XXXX CFR XXXX ( c ) ( XXXX ), and failed to transfer accurate and timely information relating to the servicing of my account ( XXXX CFR XXXX ( b ) ( XXXX ) ). XXXX claimed to have wired the second payment to XXXX XXXX, but provided no documentation. XXXX denies receipt of either the payment or any information about the XXXX payment. On XX/XX/XXXX, I sent PHM a Notice of Error pursuant to XXXX CFR XXXX, which PHM acknowledge receipt of. Now, as of XX/XX/XXXX, PHM failed to respond to the Notice of Error in the time period required by XXXX CFR XXXX XXXX XXXX ) ( XXXX ) ( i ) ( c ). I am the seller of a home. The buyers did not qualify because of debt ratio on the day we were suppose to close. This process took 45 days. The loan officer missed ordering the appraisal and the buyers went over the required response after the home inspection of 5 days to counter. The buyers were pre-approved for XXXX. The sale of the house was XXXX. The loan officer updated an pre-approval letter to satisfy the contract. Now, the loan officer is saying that buyers lost their only income stream. The denial letter states Insufficient income, but in an email, she said they LOST their only source of income. Which would be Unable to verify employment ( if they lost their job ) OR, they were never qualified to begin with. Which means she didn't do her job correctly. There has to be something that protects sellers for buyers remorse and people easily backing out of a contract and receiving their earnest money back, by simply calling and saying I lost my job, or can you get me out of this deal to the loan officer. My house is in a popular area and was taken off the market for 45 days and had multiple offers turned down do to the contract. This defeats the whole purpose of earnest money! Also, I had a contract on house with contingency to closing on my house. Which, I may lose!

My name is XXXX XXXX XXXX, I filed for a loan with Prosperity Mortgage, my closing date was XX/XX/19. I was told they had the information they needed to meet closing but everyday they needed more.I talked to XXXX XXXX XXXX and XXXX XXXX the day before the closing and was told that nothing could be done with out all paperwork specified in the email. My parents gave me money for the closing and they said they needed a copy of the check and the statement showing it coming out of the account. I sent the information XX/XX/19 and they said they needed my parents 30 day transaction history ( I sent a letter to vacate on XX/XX/19 for my apartment ). My parents were not willing to give it to me. When I told him XXXX he said if I didn't get it he could not do anything because it was a federal loan and he didn't make the rules. All emails they sent said the loan was contingent on my parents statement that they would not give me. If I could not get it the loan would be denied. That being said I argued with my parents and gave them back the money. Now they call after I told them I gave the money back and talk about the seller suing me for being denied on the loan because they said I dropped out for personal reasons. On XX/XX/2020 my mortgage was sold from Prosperity Home Mortgage to XXXX XXXX. PHM never informed me of the sale by mail, email or telephone. Due to this, I made my first payment on XX/XX/XXXX using PHM 's online payment service. On XX/XX/XXXX, I received a letter in the mail from XXXX XXXX dated XXXX XXXX, 2020 stating that my mortgage had been sold and my payments effective XX/XX/XXXX were due to them. I immediately called PHM on the XXXX of XXXX and was assured that my payment was being transferred to XXXX XXXX. As of the time of my writing this on XX/XX/XXXX, the payment has still not been sent to XXXX XXXX. I have contacted PHM on XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. Each time I have been told they will look up my issue and get back to me with an update. They have not once followed up with an update despite taking down my phone number and email during each call. If I had been properly notified of this mortgage sale by Prosperity Home Mortgage I would be in this situation and would've made the payment on time to XXXX XXXX.

On XX/XX/XXXX, I was notified via email from XXXX XXXX that my XXXX mortgage payment was not made. I responded to that email indicating it was paid and I have receipt from their payment vendor that it was paid, however, I do not disclose sensitive information via email and asked for a callback. No response to my email. I then called the servicing department multiple times and the call is not answered. I left voicemails that went unreturned. I called another department with Prosperity Mortgage and got someone on the phone twice. The first person stated that there was no manager available and then hung up on me. The second person said no manager was available and tried to call servicing but no one answered for her either. Im trying to clear this matter with Prosperity before something is erroneously recorded on my credit but I am receiving no help from Prosperity in doing so.

I was contacted by Prosperity Home Mortgage while investigating HELOC rates and was willing to listen to their agent. As we were exchanging information I explicitly asked if this would be a hard credit pull and XXXX ( XXXX # XXXX ) stated " No, not until you apply for the mortgage ''. We continued with the process and he asked for my XXXX and XXXX for what I assumed was a soft pull regarding current rate levels, which is all I wanted. I had no intent at the time to apply for a loam through this lender. Once I saw the hard pull populate on my report, I asked him if that was a hard pull he just performed, and he confirmed that it was. This was not stated clearly prior to the pull and it was not clarified that I was in the midst of ANY application for a loan. He then told me " it's fine, it will fall of in 30 days ''.

This is a system-wide problem. It is impossible for a buyer to get a Loan Estimate from a lender- unless the buyer makes an application for a mortgage. Check it out. Go on-line - try to find rates on-line for a 30-year mortgage without making an application. When consumers make applications, the Loan Estimate in buried deep in a pile of other forms the lender forwards to the borrower. Everything must be e-signed, and the borrower has little idea what they are doing. The lender will not provide a XXXXoan Estimate without a full application, and the borrower can not " shop '' for a mortgage. The Loan Estimate invariably contains a " sample '' interest rate that is not locked, and that a buyer can not lock. With rates going up, borrowers will get hammered by lenders!

I closed on my new home on XXXX and over XXXX dollars was put in my escrow. I got my tax bill for 2019, which was XXXX. I sent this 2019 property tax bill over to XXXX at Prosperity Mortgage who closed on my loan. I was told by my contact at Prosperity that the bill was paid along with my homeowners insurance. She said the balance in my escrow was {$6900.00} after these items was paid as of XXXX. However, after my mortgage was transferred to the new servicer, XXXX XXXX XXXX, my escrow balance is showing {$1000.00}. I was told my XXXX that prosperity paid another tax bill of {$7100.00} which there is not such bill. The bill was actually XXXX can't get in touch with anyone at Prosperity to let me know what happened to all the money in my escrow.

I was approved for a very low amount. When I tried to ask the reason, the lender asked for more unnecessary information and documentation. I advised them that I have provided documentation and information you requested. Why my loan amount is low. They had no good reason. I had applied for mortgage elsewhere ( XXXX XXXX XXXX ). They had approved me for much more XXXX XXXX XXXX difference. They actually did this with out requesting this many information. I discovered that this is a discrimination against people of color. the appraisal for the home i bought on XX/XX/2021 had over XXXX incorrect entries. the appraiser inflated the value to match the loan and the mortgage company knew that. they with held the appraisal from me until less that 40 hours before closing so i would not have time to carefully look it over. they also charged me twice for the same fees. the home is structuraly not sound and they refused to look into it. due to this, i have lost my job, my credit is ruined and the home needs to be demolished. they have not looked into this and have offered no help in any way. the mortgage company also made my income appear to be more than what I reported.

After I closed on my home I noticed on my closing documents that my income was much more than it actually was. I had told the mortgage company that I got a {$500.00} bonus every XXXX, once a year. They added it to my income but instead of only at XXXX they added it as a monthly bonus. They also added {$100.00} as extra monthly income. I have told them many times about this and they wont address it. That's {$7200.00} a year they added to my income. I specifically remember telling them it was a XXXX bonus. I was with Prosperity Home Mortgage LLC and I had difficulty in the application process. I was not happy with the service or how I was being treated. During this time I was made to pay {$500.00} for an FHA appraisal before any underwriting began and I would like to have a copy of it as I was promised.
