***NOTE : This ISN'T a duplicate. The company goes by two names : colloquially as " Bread '' and formally as LON OPERATIONS LLC. I previously filed a complaint under the " Bread '' name, which wasn't in your system and thus was closed out. I'm now filing complaint under the LON OPERATIONS LLC name in the hopes it's in your system and can be routed for resolution. *** I wanted to buy a mattress from XXXX XXXX XXXX ( XXXX XXXX XXXX ). I wanted to finance my purchase, which financing XXXX XXXX offered on there website through " Bread, '' which is formally known as LON OPERATIONS LLC. Per LON OPERATIONS LLC 's own separate website ( XXXX XXXX XXXX ), " Loans offered through the Bread platform are made by XXXX XXXX XXXX , a New Jersey state-chartered bank , Member FDIC. XXXX Lon Operations LLC. '' So, on XX/XX/2020, I went to XXXX XXXX 's website, clicked the " Financing '' link in the navigation bar at the top, went through the initial credit-check process ( which again, goes through " Bread, '' which is formally known as LON OPERATIONS LLC, which again facilitates loans from/is underwritten by XXXX XXXX XXXX ). The initial credit-check process produced a message that reminded me I had placed a security hold on my credit file with XXXX, and that I needed to lift it before proceeding with the loan process. No problemI immediately called XXXX and lifted my hold temporarily for five days ( from XX/XX/2020 to XX/XX/2020 ). I then immediately returned to XXXX XXXX 's website and this time was able to complete the loan process, which qualified me for a loan of up to {$1500.00}. But then the " Bread '' /LON OPERATIONS LLC loan-process window on XXXX XXXX 's website ( via the " Financing '' link ) produced a message that I needed to upload copies of the front and back of my driver license. I promptly uploaded both as requested. Then the " Bread '' /LON OPERATIONS LLC loan-process window on XXXX XXXX 's website ( via the " Financing '' link ) produced another message saying I needed to call " Bread '' /LON OPERATIONS LLC to complete the identity-verification process. I immediately called as instructed and spoke with XXXX at " Bread '' /LON OPERATIONS LLC , who asked me a series of security questions, which I answered correctly. XXXX then said it would take another 13 business days to review my application. The next day, I received an email titled " ADVERSE ACTION NOTICE '' from XXXX at " Bread '' /LON OPERATIONS LLC . In this Adverse Action Notice, XXXX claimed " Bread '' /LON OPERATIONS LLC was denying my loan application because it was " Unable to verify [ my ] identity. '' XXXX 's notice also said, " Our decision was based in whole or in part on information provided by [ XXXX ]. '' Because there are no discrepancies between the personal information I provided to " Bread '' /LON OPERATIONS LLC and the personal information in my XXXX file, I phoned " Bread '' /LON OPERATIONS LLC and asked to speak with XXXX about the denial notice. I argued with the associate who answered ( XXXX ) because he persistently stonewalled me, as apparently XXXX refused to get on the phone with me whatsoever. XXXX eventually hung up on me. I made a digital audio recording of this conversation and uploaded it to my XXXX XXXX, which can be shared via link with anyone, including the CFPB, on request. I then phoned XXXX XXXX and spoke with XXXX ( woman ). I told her about all the above. She expressed astonishment that this was happening but said I should continue conversing via email with XXXX at XXXX XXXX ( which I'd already done ), because she's the/an owner of XXXX XXXX. I then got a call from XXXX ( woman ) at " Bread '' /LON OPERATIONS LLC and had yet another argument. I kept telling her to stop giving me conclusory statements like " we couldn't verify your identity '' and instead IDENTIFY SPECIFIC OBJECTIVE FACTUAL DISCREPANCIES between the personal info I provided to " Bread '' /LON OPERATIONS LLC and that in my XXXX file. She failed to identify even a single discrepancies. And when asked what else there is to do, as I'd complied with every single request from " Bread '' /LON OPERATIONS LLC , she said, " Nothing. '' She just kept repeating herself that they were unable to verify my identify despite my having established my identity per their own procedure. She wouldn't answer any of my direction questions. And then she, too, ultimately hung up on me. I also recorded and uploaded this conversation to my XXXX XXXX, which again, is available via link on request. I then replied via email to XXXX 's Adverse Action Notice ( from " Bread '' /LON OPERATIONS LLC ) and told him that because he was unwilling to get on the phone with me, and because there are no objective factual discrepancies between the personal info I provided and that contained in my XXXX credit file, his decision to deny me a loan that I already pre-qualified for was subjective and thus discriminatory and thus illegal. I provided him a link to my XXXX XXXX so he could listen to the phone conversations I had had ( mentioned above ). I then got an email from XXXX at XXXX XXXX telling me she had escalated the matter to their account manager at " Bread '' /LON OPERATIONS LLC . Ultimately, " Bread '' /LON OPERATIONS LLC has verifiably discriminated against me on a SUBJECTIVE, inexplicable, and illegal basis, not on any manifest objective verifiable factual and legal basis. I provided " Bread '' /LON OPERATIONS LLC all the information requested. That information was true and accurate. I provided them copies of the front and back of my driver license, as requested. Those were true and correct copies. I answered their security questions and did so accurately. I am who I say I am : I am XXXX XXXX XXXX. More to the point, I've proven it. I called " Bread '' /LON OPERATIONS LLC repeatedly from my home phone, the caller ID for which identifies me as XXXX XXXX . I even asked them if they wanted me to do anything else, but they said there's nothing else to dono way for me to prove I am who I say I am. And the information I did provided already matches the information in my XXXX file. Thus, there's no factual, evidentiary, or legal basis for their denial ( especially after already approving me ) or their claim they couldn't verify my identity. On my repeated demands, not one person at " Bread '' /LON OPERATIONS LLC could identify a single discrepancy in information. All they had were opinionated conclusion summary statements, which they just kept repeating like drones. Despite all this, " Bread '' /LON OPERATIONS LLC denied my loan claiming they were " unable to verify identity. '' This conclusion is unsupported by the objective verifiable facts. THUS, " Bread 's '' /LON OPERATIONS LLC 's DECISION, AS WELL AS IT'S CLAIM THAT THE DENIAL DECISION WAS BASED ON THEIR SO-CALLED INABILITY TO VERIFY MY IDENTITY, IS MERITLESS AND NOT OBJECTIVE BUT SUBJECTIVE AND THUS DISCRIMINATORY AND THUS ILLEGAL.

Account # XXXX is being listed as charged-off/collections on all three of my credit reports effective XX/XX/20. This account was included in a Chapter XXXX Bankruptcy filed on XX/XX/20. Bread was notified of the bankruptcy filing on the creditor matrix. The Chapter XXXX automatic stays prohibits any act to collect, assess, or recover a claim against the debtor that arose before the case filing. ( Section 362 ( a ) ( 6 ) ). I insist that BREAD/XXXX XXXX XXXX cease all collection activities and PROPERLY remove the account in question or correctly notate " Included in Chapter XXXX wage earner plan. '' You can not charge off an account in an active bankruptcy case. By placing the debt in charge-off status and attempting to collect on it, they have violated the automatic stay. This is their only warning before I get my attorney involved.
