Overview and Background In XXXX, my late grandmother, XXXX XXXX, took out a loan on my behalf so that she could provide financial assistance for college tuition and related expenses. Before my grandmother applied for the loan, she consulted with her youngest son on which financial product would be in our best interest. It came down to XXXX and Loan to Learn. Her son at the time was an employee at an affiliated company, XXXX, and advised her that this was the better option since it had a faster approval process even though it had a variable interest rate that was much higher than the 2.5 % fixed rate that was offered to her by XXXX XXXX XXXX XXXX My grandmother completed the combined application-promissory note in its entirety. Thus, my grandmother was the primary and only borrower on the loan with no cosigner. However, Loan To Learn required student information in order to verify that I was a fulltime student at XXXX. In XX/XX/XXXX, she unfortunately passed away from XXXX. Naturally, the family reached out to all her debtors where she may have had lines of credit or outstanding financial obligations. This also included XXXX XXXX, formerly known as Loan to Learn, where we were initially under the impression that the loan would cease to exist after providing my grandmothers death certificate. It was during XX/XX/XXXX when I found out this was not the case when XXXX reported me to the credit bureaus as 30 days past due. When I contacted their customer support team, I was told that my name was on the application as a cosigner and that payments would still be required. This struck me as very odd since I never had the opportunity to actually see or sign the application. During that conversation, I requested that they provide me with a copy of the promissory note and any other documentation thats associated with this loan since I had never seen it. I was shocked when I was told by the service representatives were unable to locate the original documentation since it had been 10 years since the loans origination date. I was left with the impression that they were being quite glib after the representative said, I suggest you go looking through your grandmothers files to get that information. I will never forget those seemingly cold words since I was still in the very beginning of grieving her loss. However, in XX/XX/XXXX, I took another shot at obtaining the documentation after threatening to contact the Consumer Financial Protection Bureau if they did not provide me with the information being sought after. I felt that this was appropriate given the fact that they used my XXXX data to assign an account under my name with an adverse credit remark. Documentation Review & Errors Combined Application and Promissory Note : Shortly after receiving the document via email, I reviewed and analyzed it to see what information was captured including terms and conditions as well. There were a few noteworthy takeaways : 1. ) My grandmothers name is listed as the primary applicant where she puts my name down as the student at the bottom of page 1. 2. ) In section 2, the student is not defined as the borrower or co-borrower. This loan was taken out on my behalf by my late grandmother who was the only primary borrower on this loan. After her passing, Loan to Learn erroneously assigned the remaining balance to me. Disbursement Notice : The very first thing I noticed was my name was listed as the one of the borrowers when rather than just the student. I found this to be particularly odd considering that I was the student and not the signing applicant or co-applicant. When looking at this, Im not sure if this was a clerical error or if it was done intentionally by the company to ensure continuous payments in case the primary borrower defaults or passes away. Truth In Lending Disclosure Statement : Once again, I see that both my grandmothers name and mine are listed here which is very weird granted that the check was sent to her XXXX XXXX checking account. Payments towards tuition and expenses were made by her as anticipated in the same manner as if this was a XXXX loan where the student does not actually receive the physical check. This further illustrates that this was her loan. Conclusion After reviewing the information and performing internal research, I have arrived at the conclusion that Loan To LearnXXXX has did not act in good faith and was negligent for the following reasons : 1. ) Use of students NPPI data to misassign a loon that was NOT signed by me. I also dont ever recall interfacing with Loan to Learn before, during, or after the application process in XXXX. XXXX. ) If the expectation is that I was the party responsible for paying back this loan, then there should have been a formal conversation with me and the lender. Since I was not able to review the terms and conditions, my ability to help make an informed decision was compromised. Furthermore, the household signing up for a questionable financial product from a less than reputable company could have been avoided. XXXX. ) Took advantage of a XXXX XXXX with early XXXX by employing the use of predatory lending practices through misrepresentation of key information regarding loan structure, costs, and terms. For example, I recall a brief conversation my grandmother and I had where explained the rationale for choosing Loan To Learn rather the XXXXXXXX XXXX XXXX It didnt make sense at the time, and I was told not to question the decision that had been vetted by her son.

I took out a loan XXXX in XXXX to attend XXXX, TN. The loan was for {$10000.00}. Once I graduated in XXXX, they started asking for their loan payments. All was ok at first, but shortly, things began to go awry. The co. turned into Loan to Learn. I 'd mail in payments, but they 'd " go missing, '' so the company said I was n't making payments, and I 'd get hit with late fees. So I started making my payments online. This worked well for awhile, but then every month when I went to login, the website told me my password was wrong, and I had to update something, which took time and the password reset had to be done over the phone, and the co. is only open during the day. My job requires me XXXX all day, so this was very difficult to work around. The website would n't work on my phone. Now, the website wo n't let me on. The pymts I was able to make felt useless - my balance kept rising. Feeling defeated by this process, I eventually gave up to concentrate on paying off other debts, falling quite far behind on payments to this company. Several months ago, after paying off the last of my non-student loan debts, I enrolled in a student loan debt rehab program. I thought ALL of my student loans were included in the program, and the payments I was making to rehab them and get them out of default were going to cover this loan too, but when I pulled my credit report recently, I found that this loan has been reporting no payments received all this time. The total I 'm paying on to the rehab company is the total I thought I owed on ALL student loan debt, and I have n't been receiving any mail, phone calls, or any sort of contact from Loan to Learn, so I started trying to call them. The # listed for them on my credit reports is disconnected. When I call the # on their website, it tells me " the call ca n't be completed as dialed, '' half the time, and half the time it connects, I hear their menu, then there 's just silence - no answer. I finally spoke to someone who told me my account was with an attorney 's office called XXXX XXXX XXXX, so I 'd have to speak to them. So, I called XXXX and spoke with someone named XXXX XXXX, who told me his notes said I 'd hired a lawyer, and so that 's why his office had n't called or mailed anything to me, because they were n't allowed to. He would n't discuss who 'd told them I 'd hired a lawyer. He said he could n't discuss my loan with me AT ALL, until I had the attorney fax him a letter saying that he was n't handling the matter for me. I called my former attorney ( who handled a matter for me in XXXX ), but their office had no idea what was going on. XXXX had n't made any attempt to contact them either. My former lawyer also told me that even if they HAD been handling this for me, XXXX were certainly authorized to speak to me about it. There was no reason why an attorney 's office should be telling someone they ca n't speak to her about her own loan. I called XXXX back yesterday and spoke to XXXX, employee ID XXXX, who told me I was n't in their system AT ALL. He tried to look me up in the system several ways, and finally assured me that there was no record of me at that office whatsoever. I hung up and called back and got XXXX, employee ID XXXX, who was able to find me in the system. He told me that my file was closed. That they COULD talk to me, but there was really nothing to talk ABOUT, because the file was definitely closed, and had been sent back to Loan to Learn. I called and left a VM XXXX, who has n't called back. Called main # at L2L today. Had to call over and over before I could get an answer. Spoke to XXXX who said loan was with XXXX and she could n't take a pymt or help me, but she transferred me to the legal dept VM. No one will talk to me, and the co. has been unprofessional from the start. My last statement ( or any mail ) from them is from XXXX XXXX.

Back in XXXX, I co-signed a non-federal private student loan for my ex-boyfriend with Loan to XXXX XXXX XXXX XXXX XXXX XXXX. Loan amount at the time was {$13000.00}. I have not spoken to him since XXXX and apparently he stopped making payments late last year. The XXXX I heard about this was around XXXX XXXX, XXXX when I received a letter from an attorney 's office in an attempt to collect the debt. Principal due in that letter was {$9700.00} plus interest and attorneys fees. Once I got that letter, I contacted them via email on XXXX XXXX and asked them to send me the loan paperwork. They did comply with that on XXXX XXXX and the letter they sent stated if you have an offer of settlement or would like to discuss a payment plan, to contact their office. On XXXX XXXX, I called the attorney 's office and I spoke to XXXX XXXX, I believe a paralegal at the firm, and made an offer of {$1500.00}, assuming they would be willing to negotiate. On XXXX XXXX, I left a voice message with XXXX XXXX at the attorney 's office for a status of the offer. On XXXX XXXX, I sent an email to the law firm asking for a status of the offer. On XXXX XXXX, XXXX called back and said her client would offer {$9600.00} to resolve it. They based their reasoning on the fact that there are XXXX defendants they could go after. I firmly believe my ex moved out of the country and told them that. XXXX told me to submit a hardship letter and to make another offer of settlement. I did that on the same day and offered {$2500.00} and in the letter requested a payment history. On XXXX XXXX, I left a voice message with XXXX regarding the status of the hardship letter. On XXXX XXXX, XXXX called back and said client would offer {$9600.00}. I then offered to pay monthly payments. I said I could maybe afford $ XXXX- {$100.00} a month and XXXX asked if I wanted to offer {$75.00} a month and I said yes. On XXXX XXXX, they came back and rejected my offer and offered {$170.00} a month. Unfortunately, I got verbally upset. I truly do n't believe I can add a {$170.00} a month payment to my monthly bills. I told XXXX I would pay what is due to date and then continue to make monthly payments, whatever the monthly payments were. She said I needed to make a monetary offer of what I would put down and what monthly payments would be. I told her I do n't have that information. I requested a payment history in my hardship letter and again to her on the phone. I told her I could n't make a monetary offer until I knew what payments had n't been made to date. She said she would get that together and get back to me on Monday, XXXX XXXX. At some point in the conversation, I apologized for raising my voice earlier in the conversation. I have not heard a thing since then. On XXXX XXXX, I emailed a letter to XXXX at the attorney 's office and copying Loan to Learn, requesting they rehabilitate the loan and provide payment history. On XXXX XXXX, I left a vm for XXXX to call me for a status update. On XXXX XXXX, I requested loan information via email again through XXXX at the attorney 's office, copying Loan to Learn. In the meantime, my credit score which was XXXX in the upper XXXX has plummeted. I 'm afraid to look at what it is now. Last time I checked in early XXXX, it was down to XXXX. I have had excellent credit until this and they keep reporting this debt during these " negotiations '' even though I have been trying to work to get this resolved since XXXX. I do n't know what my rights are but I want to get this resolved as soon as possible. I am willing to make a lump sum payment to get it resolved but I ca n't afford anywhere close to {$9600.00}.

Back in approximately XXXX I took a student loan from Loan to Learn ( aka Educap ) for approximately {$19000.00}. In early XXXX I filed for Chapter XXXX bankruptcy as my daughter was having severe medical issues and medical bills. In XXXX XXXX the Chapter XXXX was discharged by the judge. During the bankruptcy time frame needed by the judge for his due diligence to ultimately grant me a discharge, which he did in XXXX XXXX, he ordered me to not " pick and choose '' lenders I wanted to pay until his order was finalized. Once my bankruptcy was discharged in XXXX XXXX, I reached out to Loan to Learn ( aka Educap ) wanting to resume payments. They immediately shut the door on my face and began to harass me by being served by their attorney. I then hired XXXX separate attorneys to help me get back into payments with Loan to Learn ( Educap ) but they were also shut down. In XXXX XXXX I was severely injured at work that required immediate intervention by my Connecticut doctors to pull me out of my employer ( XXXX XXXX in XXXXXXXX ) of 24 years. In XXXX XXXX, XXXX my daughter ( a minor ) that I am full custodial parent of and I moved to XXXX, XXXX for cost saving reasons, the fact that XXXX, XXXX has the best medical care known as the XXXX and by the recommendation of my psychologist. In XXXX XXXX, XXXX XXXX, knowing about their actions and negligence caused me permanent damage leaving me no options to work, chose to pay me minimal punitive damages to help me at least with the massive medical bills accrued, basic living expenses and so forth. BUT, Loan to Learn ( Educap ) intercepted such funds to arrive to me and now is in the hands of my student loan attorney ( XXXX XXXX ) in XXXX with no where to go. Simply said, Loan to Learn ( Educap ) is trying EXTORTING from me knowing very well that I am permanently damaged mentally and physically and completely broke with ZERO income for nearly 2 years and counting. My daughter and I are destitute, living on food stamps and Medicaid. Loan to Learn ( Educap ) is EXTORTING from me adding a 70 % charge on top of what I originally owed, claiming I now owe them {$32000.00}? They know I 'm not able to protect myself, not mentally fit ( please see supporting document from my psychologist ), or have funds for my daughter and I to live on. Loan to Learn ( Educap ) is practically trying to steal the punitive damages that is owed to me to pay for my medical bills and have had to cancel most, if not all, of my medical visits, by their bullying and extortion. They have damaged my health even further and my doctors are furious. My daughter and I are being evicted and at the end of XXXX XXXX we will be seeking shelter at the XXXX all due to Loan to Learn ( Educap ) not wanting to accept me making monthly payments to them or simply pay off their original amount out of the punitive damages my former employer sent me, which Loan to Learn/Educap has frozen. So, end of they day, knowing very well that I 'm severely ill, not being able to properly think, concentrate and remember with all the prescribed drugs in my system, this bully and shady company is taking my lack of ability to fend for myself due to my medical conditions and financial state as a way to financial gain by STEALING money from me and EXTORTING. It 's gotten so out of control with this shady and immoral company that the XXXX office is now getting involved and advised me to contact your agency as well. Thank you in advance. XXXX XXXX

In 2006, I took out a {$5000.00} loan for school through a private loan company called Loan to Learn. I did not have a solid credit history so they ask for a co-signer. My mother agreed to co-sign the loan so that I could go to college. The interest rate was outrageous ( 30 % ) but at that time I did n't think I had any other options. I made regular monthly payments on the loan for about XXXX years. At that time, my mother was filing for bankruptcy and we were told to stop making payments on the account because it would be included in the bankruptcy. At the time I stopped making payments, I had been making payments to repay the loan for XXXX years and the balance was over what was originally borrowed. I was contacted many times by the company and was told by a man, supposedly in charge of repayments or something, that there was no way the debt would be discharged in the suit and that I needed to make a payment of I would be at risk of being sued. I started repayments again but at that time the account was in collections and being handed by a collection company whose name escapes me. Being a person of integrity, I set up a repayment plan with that company and had the payments automatically taken from my account so that I would n't run the risk of forgetting a payment. After about XXXX months, I started to get calls from another collection agency claiming I had n't been making payments on my Loan to Learn debt. Confused, I asked who I had been making payments to, since they were not going to the correct people. The collection agent said he did n't know but I needed to start paying now. I was frustrated and exhausted from trying to do the right thing and getting nowhere. After a little research into payments to the original collection agency, I discovered that that company had stopped taking payment after XXXX months and failed to let me know. I was again, behind on my payments to this company. I refused to start another payment plan with this new collection agency since there was no assurance my payments would be made or that I would ever get this debt paid off. Shortly after that, I received a statement from a company called XXXX who apparently bought Loan to Learn and all of it 's debtors. I have refused to pay them as well. On my credit report it shows the debtor 's name as Loan to Learn, not XXXX. So to whom do I owe my hard earned money? I went to talk to a lawyer about a possible bankruptcy and was told there was no guarantee that he would be able to eradicate my debt so he advised me to go a different route. It 's been almost XXXX years since I took out this loan to attend classes at a XXXX college and I now have an outstanding debt of over {$7000.00} with this company. The really surprising part is that I am almost positive that I have paid pretty close to the original amount borrowed at this point in my payment history with this company. With the interest rate and the fees, I feel like I will never be able to pay this debt and it 's ridiculous to think that companies like this are able to do business. I am a good person who pays her bills on time. My XXXX and I want to get married and we want to start a family but none of this can happen with this debt unresolved. I just want to move on with my life but this financial mistake has endlessly followed me. I do n't wish this experience on anyone and I hope my story helps the next XXXX.

My name is XXXX and I would like to share my story in dealing with my current student loan in default. I come from a single parent home and the idea of college was always out of the question. I am the XXXX out of XXXX kids. No sibling before me went to college. I decided that I wanted to be the first in my family to do so. I joined the AVID program in my junior year of high school and from day I was told that in order to stay in the program I had to be 'college bound. ' I alse kept being told that money should never be an issue. There is a financial aid I can apple for and most likely recive being that I came from a low income family. I was also told that there was student loans I can apply for. The day cam that I sent out my applications and was surprised to actually be admitted to XXXX XXXX XXXX XXXX. A school that was about a XXXX mile commute each way. I was approved for financial aid. However, I was hit with the realization that I would need more money. I was not working at the time. Had no transportstion. No money of any kind. I remember that I was told I could apply for a student loan. Went online and did a search for student loans. I ended up on XXXX XXXX XXXX 's website. I applied for and got approved for XXXX student loan. I had no idea what a 'promisarry note ' was. I had no idea what it meant that my mother was a co-borrower. As soon as i got the check i realized how expensive it was to actually be a XXXX XXXX XXXX. I still could not afford to live off the loan and financial aid. I did not want to borrow anymore money. I did not attend school and took a full time jod in reatil to help pay for living expenses at home. Working retail was tough and made just enough to pay rent and feed myself. There was no way i could start making payments. My mother who was co-borrower had at that point become XXXX and lives off her social securit. After about XXXX years we were evicted from the house i grew up in and was forced to move out. I moved in with my partner at the time. Im not sure if something got lost during the move something but I got a letter at my new place telling me that there had been an 'abstract judgement ' agains me. Having no knowledge of the legal reprucussion and having no money i did nothing. The total amount was for about {$10000.00}. The years passed and thing between me and that partner did not work. XXXX. I been on my own since 2012. Working to pay bills, rent, repairing my credit a little at a time and saving for retirenment. I did not look into the judgement being that the amount was so high and i did not have that much money to pay it off. I never filed for brankruptcy. Since i got the notice of the judgement i did not hear anything up until this last monday. I got a letter from my work 's payroll department telling me that my paychecks will be garnished at XXXX % after taxes to pay back the judgement. The total amount had ballooned up to over {$26000.00}. I have no idea how i will be able to support myself with that much missing from my check. I have mo clue what to do. I know i owe this money. XXXX has tried XXXX times to take me to court. XXXXThe XXXX time was in XXXX where the attorney for them was XXXX XXXX. XXXX XXXX hounded me and violated the FDCPA, and I sent him a cease and desist letter through an attorney. The attorney later left the case citing there was n't enough information to follow through on FDCPA claims ( I later found out I have a phone recording that verifies my statements and shows that the FDCPA was violated ). I went to the courthouse on XXXX/XXXX/XXXX at XXXX XXXX to no other parties and was told that the case was dismissed. XXXXThe XXXX time was in XXXX and the case number is XXXX. This was in XXXX after not following through with the lawsuit in XXXX, where I have stayed since XXXX. I was told by my father that a sherrif attempted to serve me papers at my parents house in XXXX of XXXX, my father told him that I do n't live in XXXX and the sherrif truned around and left. This time I recieved no notice in the mail about this lawsuit, aside from letters offering me representation from XXXX. When I called the letters back, I was told that since I live in XXXX, I ca n't be represented by them because they are in XXXX. XXXX XXXX of XXXX I recieve another letter in the mail from a lawyer offering me representation concerning a case against me. I was told a lawsuit was filed yet again by XXXX, but I had n't recieved anything in the mail. I look the case up ( again only off of information from mail that could be considered an ad ), and see the the hearing is scheduled for XXXX of XXXX. I start seeking representation to surmount a defense against this predatory lender, and while in the middle of this I recieve a letter on XXXX XXXX, XXXX saying that a judgement has been entered against me. 1. I was n't properly served papers at my house for the most recent case, despite recieving the notice for the other case at my house from the same lender two years ago. 2. This lender has used collectors that violate the FDCPA and have harrased me for years. 3. The co-borrower is my mother, who passed away in XXXX. While my mother 's estate was being settled, my father and I recieved an offer from XXXX to settle the loan for {$7000.00}. When we were willing to take the offer, XXXX pulled the offer back after having adknowledged the fact that they initiated the settlement talks. This led to my father saying he will not help me with my student loans and XXXX starting these predatory tactics. I do not have the money to settle this matter, nor do I make enough the satisy the minimum payment. Everytime I speak to them and tell them my finances, I am told that I am lying about my finances and that I am living in poverty. If I am in poverty and I am telling you this, how am I lying? I do plan on paying these loans back, however I am not able to at the time. The job market is rough and dealing with these lenders are preventing me from devoting my energies on finding a job.

School : XXXX UniversityLocation : XXXX, NCMy father was paying off XXXX of my Loan To Learn student loans until his passing in 2012. I have another Loan To Learn account that I pay monthly and that is still in good standing. Loan To Learn sent the loan my father had been paying into default and sold the loan to a lawyer in XXXX, NC without my knowledge. I was never made aware of this in any way until I ordered a free credit report and discovered a delinquent loan on my record. I called Loan To Learn thinking it was a mistake. It was n't. I told the customer service rep that the lawyer who Loan To Learn sold my loan to had never contacted me and I did not understand how this was legal. She said I could try sending my dad 's death certificate to the lawyer to see if he would " work with me ''. The customer service rep then gave me the lawyer 's contact information ( XXXX in XXXX, NC ). I called XXXX XXXX XXXX and explained my situation to the man on the phone, and then asked how much I would need to pay monthly. He laughed and replied, " Make me an offer. '' I offered to pay {$350.00} a month. He replied saying " they '' originally wanted {$500.00} a month. I asked him who " they '' were and he said XXXX. I said I could n't afford to pay {$500.00} a month on top of my other student loan bills, and he said to email his office my father 's death certificate to see if that would help. I obtained my father 's death certificate and emailed it to XXXX XXXX XXXX. A woman named XXXX responded to my email writing that the client declines my offer and requests {$400.00} a month, and asked if I could accept the counteroffer. I responded that I could not pay that amount each month. I then requested a written validation of the debt for my records. XXXX XXXX XXXX then sent me a letter saying that they will recommend that their client file suit if payment is not received within the next 30 days. The letter stated that " every legal step necessary will be exercised in order to collect this debt, including execution by the sheriff should judgement be rendered. '' They also began calling me at work. I replied again via email and said I could not pay {$400.00} a month, and have not heard from XXXX XXXX XXXX since then. I just want to pay my student loan at a reasonable monthly rate. This situation has wrecked my credit score, and I did n't even realize it was happening until I ordered a credit report. I do n't think asking for a monthly payment lower than {$400.00} is unreasonable. If I had never ordered a credit report and consequently reached out to Loan To Learn, I would have never known they sold my loan to XXXX XXXX XXXX. I 've made every effort to be proactive and pay my loan to no avail.

In XXXX I realized that I had negative credit reporting from Loan to Learn. I called the number on the credit report which lead me to XXXX XXXX ( collector for loan to learn ) I asked what I owed and why I had not received notification that I owed a debt. XXXX XXXX stated they did not have an account on me and gave me the number to Loan to Learn ( XXXX ). I called Loan to Learn and spoke to the rep and was told that I have one outstanding loan balance and that the law firm was collecting on it not XXXX XXXXXXXX and that is why I had not heard from them. I contracted the law firm ( XXXX ) and was told that they do not have access to the account to collect. I stated that this was being reported to the credit bureau and that I needed a resolution. When I did not hear something, I called back on XX/XX/XXXX. I requested to know a status he said if they dont call you back tomorrow I will. I asked about my credit report he stated well you signed the loan documents we have the right to report. I stated I have never received so much as a bill he stated they did not have to give me one I know I owe the money. I asked when the last communication was sent out he stated that it was sent out in XXXX I stated I was under bankruptcy then and did not have to pay since they were included In the bankruptcy. I stated that I have not received anything since. He stated that they may not have the documents to show they have contacted me because things get purged but I knew I took out the loan. I asked for the most recent notice he stated they have not sent one but they still have the right to collect because I signed the loan docs. To date I have not received anything, I know they know my address because it was public record during the bankruptcy. I also know that they have my phone number I called everyone involved in XXXX. In 2007 I took out a student loan with Loan to Learn to help with my attendance at XXXX University XXXX. The loan required me to obtain cosigners and my grandparents agreed to do so ... never did we expect the scenario to turn into the nightmare that it has been. My loan is currently in a delinquency status with Loan to Learn and was passed to a debt collection agency called XXXX XXXX XXXX. I have been trying to reach an affordable amount of money that I would be able to pay toward this debt and the debt collection agency has been dictating to me what amount of money they will accept which is XXXX per month which is unfeasible for me. I did more research as to how my account became this way and it was due to the fact that my account was placed into collections as of 2007 ( which is we signed for the loan ). This information was shared with me from XXXX as well as XXXX XXXX XXXX. My grandparents ( the cosigners ) have been harassed countless times and most recently have been hung up on when speaking to representatives from Loan to Learn. The original contract/agreement states that payment is to be remitted until graduation and that after graduation my cosigners are to be removed. I have made countless calls ( and have kept the logs ) in which we ( we being Loan to Learn and XXXX XXXX XXXX ) spoke specifically about how to attack this situation so that I Can afford the payments and get this delinquency status off of the loan. I am NOT trying to escape making payments ... I am trying to make an affordable payment and that it in turn release my grandparents of this agony and stress as well as reflect as an account that is being paid on time. This loan and its company has been nothing but a headache. Neither Loan to Learn nor XXXX XXXX XXXX are willing to work with you to make repaying a debt feasible. Loan To Learn, an EduCap Inc company, is reporting inaccurate information to XXXX. I have disputed this account 6 times with XXXX ( 5 denied, 1 ongoing ). When I reached out to XXXX to get details as to how their conclusion was reached in each dispute, they advised that it was electronically, they depend on the lender to do the research not themselves and to refer to the dispute results. The dispute results provide a VA address and a disconnected XXXX phone number. After sending a certified letter to the address provided, I was finally able to reach Loan to Learn and started email correspondence with XXXX. I was referred to a 3rd party collection group when I asked for account ownership verification ( a certified letter was also sent to the group that has not responded ). During the correspondence, I learned that Loan To Learn transferred their loans to XXXX XXXX XXXX who sold the account to XXXX XXXX XXXX. After advising that Loan To Learn is violating FCRA policies by not verify account ownership, reporting false account details, re-aging old debt as new, sending info for debt greater than 7yrs, I was again referred to the 3rd party collection group. My loan with Educap/Loan to Learn was paid in full in a Chapter XXXX bankruptcy. Subsequently thereafter, on or about XXXX XXXX, I received a delinquency letter in the mail from XXXX XXXX regarding a past due amount on the Loan to Learn/EduCap loan which I thought was paid off in the BK ( I am a cosigner ). The next day, I called XXXX and was told if I didnt make a payment that day, they would report me to the credit bureaus. Knowing how hard it is to remove something from your credit report, I went ahead and paid the past due amount. Luckily, I was able to request a 3 month forbearance thereafter in order to figure out why this loan still has a balance. Since that time, Ive been trying to request loan documents and payment history to no avail. You cant even call the original loan servicer, Loan to Learn/EduCap. They only have a mailing address and email listed on their website. I was told by a manager at XXXX that XXXX doesnt retain copies of correspondence mailed out. However, she said she would request a copy of the full payment history of the loan as well as the letter advising the loan was now being serviced by XXXX. I have yet to receive these documents and that was over a month ago. The only documents Ive received are attached. They say nothing about the relationship between XXXX and Loan to Learn/EduCap. I 've made repeated phone calls following up on the documents but they keep telling me they 're being reviewed. They will not provide me any information for people to contact at Loan to Learn/EduCap.

In XXXX, I was notified that I no longer qualified for a rate reduction that had been applied to my student loan since XXXX. I inquired to the loan servicer, XXXX, and originally restored the rate. Then the rate was reduced again and they said the loan originator verified that the rate reduction was for on-time payments and I did not qualify. I checked my credit report and there are no late payments reported. The loan servicer said I had to follow-up directly with the loan originator, who could be reached by email or phone. I spoke to XXXX from Loan to Learn on XX/XX/XXXX. I requested payment history, which was emailed to me. There are two spreadsheets that were emailed to me Friday XX/XX/XXXX. The first spreadsheet was when Loan to Learn, the loan Originator was also servicing the loan. The second spreadsheet was after the loan began being serviced by XXXX XXXX. This opened my eyes to a larger potential problem that has not been answered since that point in time. For the period of time, XXXX payments totalling {$14000.00} were apparently not applied to principal nor interest. The balance remained at {$42000.00} from XX/XX/XXXX ( the date of disbursement ) until XX/XX/XXXX. I have requested, in writing and by phone, an explanation from Loan to Learn and XXXX. This loan provider continues to report negatively on my credit report. All of my other loans have been able to be deferred when I was in school, apply for a income driven repayment planned and or have a forbearance. This company has made it increasingly hard for me to reach anyone with regard to my account and making it become available. In around XXXX I came to find out that my father took out a loan with EduCap in the amount of {$12000.00} and used my information to obtain it. I used federal financial aid to fund my education and never used a private loan so I was surprised to learn this information. I filed a police report and my father who has now passed wrote a letter explaining the situation to the lender. As a young kid out of school in my first job I decided to take a loan out for an XXXX program I was accepted to. The amount of the original debt was {$5000.00} from LoantoLearn.com operated by Educap, Inc back in 2005. Everything was fine until I ran into financial troubles from not having a job. I could n't keep up with the payments and have n't been current. After landing a job again and trying to get back into financial shape I reached out to settle my debt but Educap , Inc. was very predatory about it. They wanted 2X the loan amount even after several payments which reduced the actual amount. I felt it was unfair and agreed to the principal amount to make them whole and they disagreed. When selling a home in 2014 I learned a judgement was obtained against me and would take the amount owed from the sale of our home. The name of the institution that has my student loan is Loantolearn.com, which I found through XXXX XXXX. I received a XXXX or Loan to Learn private student loan for 8000 approximately. I was paying out of state tuition at the time and had to get. Private student Loan. Private Student Loan Account has been disputed with XXXX Credit Bureau. It continues to update monthly showing as over 120 days late. The Loan was originally with Loan to Learn. The account was included in a bankruptcy and is not backed by the government. Each time I dispute the information and submit proof from my Bankruptcy it shows that it was verified with the lender. I am out of the US and need my IRS XXXX tax form. My loan with Loan to Learn was paid off in XXXX XXXX and this tax form is the last thing I need from them. I called and spoke with XXXX reps and a supervisor and was informed that their company does not have the appropriate security measures in place to send me the form electronically or even by fax. Also due to the cost they are not able to mail me the form in XXXX. I was given the information verbally which is useless being that my taxes are being prepared by a 3rd party, again because I am not in the US, or I could send an email with a letter stating I approve my SSN to be mailed along with a pre-paid shipping label. Upon checking my credit score I noticed a school loan appeared on my report from a company named Loan to Learn ; However this is not my account I did not co- sign for this and garnishments are being taken out of my paycheck. There 's been a 20 % garnishment that has been taken out of my paycheck each month for the past year, not even a 15 % garnishment which is the legal amount for Florida. I have tried to contact this company several times and now the company is no longer in service. Several complaints have been brought up against this company for fraud and I 'm afraid I am a victim in this matter. I filed bankruptcy years ago and included a XXXX XXXX XXXXXXXX student loan that was discharged. I have spent too much time getting XXXX to finally remove it because it was in the BK and past the statute of limitations. Now there is a company reporting the loan to my credit called XXXX XXXX XXXX which doesn't have a working phone number to be able to contact them. I called this Loan to Learn this morning to inquire about a forebearance and yo discuss past due amount. They transferred me to their loan servicing department at XXXX. The rep there was able to tell me how much was past due and how long, etc. However, she did not provide a lot of information about how we could work together. I asked about a payment plan and if they could work with me, the rep kept asking me how much I could pay. I told her the issues I was having and I would n't really know until XXXX. No payment plan was offered, the rep said it was ultimately up to me how much I wanted to pay and that I would still be reported to the credit bureau for delinquency. I am not sure how to get them to work with me, other then have them send me forebearance paperwork.

Years ago this loan company deceived into thinking I had a lower interest rate than what I really did. They " compared '' federal rate with their rate when in reality they were compiling them. Months later after paying every month on time and more than required I looked at the balance and saw it was not going anywhere. I called to see what had happened and they said they applied the money to interest that had not yet even been accumulated. This is when I realized all they had done. I tried to change their rate and fix the payments and they would not budge despite deceiving me. So I stopped paying and they sent me to a collection lawyer. They refuse to close the account and settle up with me.

Loan to Learn has reported negative information on my credit report that is not true and will not respond to correspondence to remove from my credit bureau reports. I requested a deferment on payments since the student was still in school. We showed proper documentation however they sent our loan into collection with a private group located in California. We have been making payments to this law firm for 2.5 years on time yet Loan to Learn is still showing that we have not made any payments on my credit bureau 's thereby hurting my credit score and impacting my ability to acquire credit and hurting my employment opportunities.
