I refinanced my loan with Loan Simple in XX/XX/XXXX with a mortgage and escrow account, as I had previously. There was {$3600.00} dedicated to the initial escrow payment based on the final disclosures. Loan Simple kept the loan after financing ( instead of transfer right away ) and my first mortgage payment of {$1100.00} was due on XX/XX/XXXX with {$370.00} going into my escrow account monthly for taxes and insurance. My solid waste , county, and city property taxes were due XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX respectively. I then received a letter dated XX/XX/XXXX from Loan Simple, stating that my loan would be transferred from Loan Simple to XXXX XXXX XXXX effective XX/XX/XXXX, with a corroborating letter from the new bank, XXXX XXXX, stating the same. My final escrow account with Loan Simple should have contained {$4300.00} ( initial +monthly deposits ) prior to any tax payments. On XX/XX/XXXX, I went to the XXXX county tax assessor 's website to print tax documents to send to my tax accountant. I was surprised to find that per the website, my city taxes ( {$2600.00} ) and solid waste taxes ( {$520.00} ) were delinquent and at risk for a lien to be placed on my home as of XX/XX/XXXX. I assumed it was a mistake, and then called the tax assessors office to verify. The automated system confirmed that my taxes were indeed late and had incurred multiple penalties as a result. The only taxes that were paid, were for the county taxes, {$840.00} and came from XXXX XXXX XXXX in XXXX. All of the taxes due prior remained unpaid. That same day XX/XX/XXXX, I called XXXX XXXX XXXX to find out why the other taxes had not been paid. They informed/reminded me that they were not my mortgage servicer at the time that the other taxes were due and that when they received my mortgage, there was only {$54.00} in the escrow account. I immediately contacted my previous loan officer to see if he could assist. He informed me that he no longer worked for Loan Simple, so I called the customer service line directly listed on my old bill statements ( XXXX ) which goes to an unidentified voicemail ( no organization or person named ). I was concerned and didn't want to leave personal information on the line, so i searched until i found another number online ( XXXX ). This number identified that it was Loan Simple, but also went to a voicemail. So I tried again several times, hoping someone would eventually answer. I left a message requesting that someone call me back, and 1 hour later I received a call. I notified the representative, XXXX, that my property taxes had not been paid prior to my loan being transferred and I was unsure where the remaining balance of my escrow account had gone. I told her that it was urgent, as my county was threatening to place a lien She listened, told me that she would look into into it to verify that Loan Simple was in fact responsible, and get back to me that day. 3 hours later, i had not heard back so I called again. I spoke to XXXX, and asked for an update. She told me that she still needed to speak to someone at XXXX XXXX XXXX to see when the transfer happened and to contact someone at my county to see how much the taxes were. It was unclear why this she had not already obtained that information ( as it was already XXXX in XXXX, nearing the end of business day ). I told her that i was very concerned about a possible lien and that I could email her both the transfer letter and the tax bills. She agreed that would be helpful and that she would review them and get back to me that day ( as they are in XXXX ). I sent the scanned documents to her at XXXX. She responded quickly, thanking me for getting the documents to her so quickly. Then I did not hear back. I followed up to with another email on XX/XX/XXXX, asking if any progress had been made in finding out who is responsible and how to get my taxes paid. I did not get a response. I also called again, but XXXX was " unavailable '' and I was sent to her voicemail system. I left a message. When I did not get a response, I tried to call again, and this time asked to speak to a manager/supervisor as this issue was urgent. I was transferred to the voicemail system of XXXX XXXX, Controller. I left a detailed message and asked for a call back to resolve this urgent matter. I did not receive a call back. On XX/XX/XXXX, I again emailed the " paymentinfo '' address again, asking for follow-up and left an additional message for XXXX XXXX. On XX/XX/XXXX, I spoke to a representative from my county assessor 's office who stated that the county was planning to request liens that day and that he was unsure if there was any way to stop the process. He recommended that I pay the bill immediately, but that the lien could still be requested. That day, in an attempt to protect my home and credit, I paid the bill, and due to fees and penalties it totaled {$3500.00}. As of today, XX/XX/XXXX, I still have not received any return phone calls or email responses regarding my matter. I am disappointed and frustrated. I have not only had to pay a bill that I had already paid previously into escrow, but I am unsure where the balance of my previous escrow is, and I have to still be worried about whether or not a lien will be placed on my home and will affect my credit, which I work hard to maintain. I was a loyal customer to Loan Simple, as I had purchased my home through them and went back to refinance through them because of the service and efficiency they provided. I now see that their efficiency was likely due to my loan representative there and less to the company as a whole. As a paying customer, who has never been late with her mortgages in over 12 years, I am appalled at how my situation has been handled by Loan Simple. The lack of communication is beyond unprofessional.

I recently attempted to purchase a home using Loan Simple as the lender. I was approved for a {$14000.00} down payment assistance with a XXXX XXXX interest with the terms that it would be forgiven as long as I lived in the home for XXXX years. This was in addition to the mortgage loan for {$270000.00} with an interest rate of XXXX XXXX. I was advised by the loan officer that due to using the down payment assistance program my interest rate would be approximately XXXX XXXX higher as compared to the currentmarket rates at that time. My loan officer at the time was XXXX XXXX. At some point during the escrow process, XXXX XXXX contacted me and advised me that he was now my loan officer instead of XXXX XXXX. On XX/XX/XXXX, I went to the title company to sign closing documents as my escrow was to close the next day. I was then presentedwith documents to sign regarding a second lien on the home in the amount of {$14000.00} with a XXXX XXXX interest rate with a monthly payment of {$170.00} on top of the {$2200.00} I was already expected to pay for the mortgage. I immediately reached out to XXXX XXXX as this was something I had not been previously advised of and assumed it was an error. However, XXXX advised me that it was not an error and that there was nothing further he could do for me. I requested to speak to his boss and was directed to XXXX XXXX XXXX. XXXX XXXX advised me that I could either stick with the changed loan program and he would offer free refinancing at a later date or I could go with the original loan program, but at an XXXX XXXX interest rate instead of the XXXX XXXX interest rate. However, they would not offer the originalloan program. Due to the suboptimal loan conditions, as compared to what had been previously discussed and agreed to, I did not sign. I was devastated to say the least. I had put {$2500.00} earnest money down, paid {$750.00} for the appraisal, and an additional {$250.00} for an appraisal reinspection fee. The XXXX 's real estate agent issued a cure notice that I was unable to perform as the loan I had applied for had changed somehow in the process. During the escrow period, no one at Loan Simple bothered to contact me to explain what had happened, and why the program I was approved for had changed. The first time I had heard about a change in the loan program was at the signing table. When attempting to find any information aboutthis change in the loan program on the day of signing, I did find a closing disclosure in another part of my online Loan Simple portal. However, this closing disclosure was not signed or agreed to. To note this part of the portal, XXXX XXXX had previously advised me to not " worry about ''. I have attached a screenshot of the unsigned closing disclosure that states " Signature Required ''. It will not let me print out this disclosure without it being signed. If I had been notified of this during escrow, I would have further clarified with the loan officer and been able to make an informed decision. The title company ruled in favor of the seller and I lost my earnest money and the inspection fees previously mentioned. Had I known this information prior to the start of escrow, I would not have made an offer or got under contract with this home. However, instead, I was forced to either forfeit my earnest money or enter into a loan with suboptimal conditions. On XX/XX/XXXX, my realtor, XXXX XXXX XXXX, and I sent a letter with all of our attached documentation to Loan Simple requesting that they bring attention to the issue and financially compensate me for damages lost in the transaction totalling {$3500.00}. However, as of the day I am submitting this request, XX/XX/XXXX, no response has been received from Loan Simple. I have attached the letter sent to Loan Simple, the signed contract, the preapproval certificate, the loan estimate for the down payment assistance, my signed closing disclosure ( which does indicate the amounts I paid for the inspection and reinspection ), the unsigned closing disclosure that I did not find until after the day of signing, the cure notice, and a notice of cancellation indicating that the earnest money was returned to the seller.

I started working with XXXX XXXX in late XXXX while I was XXXX. At the time he was working at Loan Simple and told me to go find a house I liked quick so I could bring my XXXX to a new home ( XXXX ) and did n't give me any numbers for the loan. Just said " I 'll make it work ''. Well after finding a home, which was {$160000.00} I was told that the taxes were too high so get my {$1000.00} earnest money back. So I started looking again and I was told he could get me a XXXX county DPA for {$10000.00} so just do n't go over XXXX with taxes at 1 %. So we looked again and I found a house in XXXX county that I loved. I asked him on several occasions to give me my limit and he never would. Always disappearing and would n't get back to me with answers to my question because I did n't want to put my money down AGAIN to have to fight to get it back. He assured me it would close so I paid {$1000.00} earnest money, {$300.00} inspection and {$490.00} appraisal on a {$170000.00} home!! I told him from my calculation at XXXX salary I was n't comfortable with this price. He said ok refinance your car and I did. We were set to close on XXXX/XXXX/XXXX. The weekend prior to close, he called me and said to meet him asap at XXXX because their was a problem. When I got there I was told, he had left Loan Simple in XXXX!!! And forgot to tell me so his new job at XXXX XXXX did n't have the XXXX HOP program so he 'd given my loan to XXXX XXXX at Loan Simple! I said why did you move my personal info without telling me! After more lies we parted ways and XXXX started calling for more info so basically the loan had to go back through another 30 day process. XXXX told me my loan was approved but underwriter wants the promissory letter from my student loans. I sent it. Then said ok you 're good. Then came back the next day and said you need a cosigner! I said why when I 'm approved. She went on lying until 3 days before the close ( XXXX/XXXX/XXXX ) and said she 's sorry but I was " dead in the water from the beginning '' the loan would never close! I cried and begged her to try to fix it because I did everything right and now I 'm stuck with a new XXXX, no where to live and I paid my {$1800.00}. She was no help and just said its not going to work, find something XXXX and discounted the call. I 'm devastated!

There are two separate concerns with the sale of our home. 1 ) It was never disclosed that the real estate agent and the lender for the buyers, where related at the time of signing of our real estate contract back on XX/XX/2019. 2. ) We than received notice from our realtor XXXX XXXX with XXXX XXXX-XXXX XXXX XXXX that the appraisal came in at {$440000.00}. I requested to see a copy of the appraisal and was told they would email it to us after we signed the agreement to amend/extend contract as we were under duress to get the contract sign as we were closing on Tuesday ( 9/3 ) and this was a Thursday night with 15 minutes to spare and it being a holiday weekend. ( Monday was XXXX XXXX ). The counter offer of the property was never sent to the appraiser, so the appraiser based his findings off the original offer which was {$20000.00} less than the contract price. So the appraisal of the property came in at {$440000.00}. The amendment to contract for a sell price based off the appraisal was sent to us Thu, XX/XX/2019 XXXX XXXX and the appraisal was sent to us at Thu, XX/XX/2019 XXXX XXXX, which is when I saw the contract to sell price was wrong. It was showing a sell price of {$430000.00} not {$450000.00}. I then said we wanted to cancel our amend/extend contract and wanted a reconsideration of value done of the appraisal. The appraiser said he never received the counter offer and that he would email the lender ( Loan Simple ) XXXX XXXX XXXX NMLS:XXXX to get the correct contract and send them a reconsider form to his appraisal since he didn't have a signed contract. They refused and said that we had already signed the amendment/extend form and would sue us for specific performance if we didn't close. I feel that we were fraudulently mistreated by the Buyers broker and lender. I believe the lender and him acted together. We ended up losing {$10000.00} after all is said and done. We contacted an attorney and he said we had a good case but would spend {$5000.00} chasing {$10000.00} which we are unable to spend at this time since we are in the process of building our future home. Please investigate this matter in fear of this happening to future clients.

Following the closing of my new home with a Conventional Renovation Loan on XXXX, construction on the interior, in accordance with the work write up, began. Several line items have been complete and some are partially complete. When the appointed General Contractor contacted Loan Simple on XXXX in order to schedule the inspection in order for her to access her first draw, Loan Simple told my GC on XXXX she was unable to do so, as they had not yet completed the purchase of the loan from the originating lender ( see attachment 1 ). On XXXX, I was contacted by XXXX XXXX at Loan Simple and she explained to me that the loan amount I closed with was less that what I should have been approved for. I was told that as a result, I did not bring enough cash to the closing table ( see attachment 2 ). The difference I am being told I have to now still pay is {$1800.00}. I am also told that if I can provide evidence that I also paid for the Consultant Fee and the Appraisal Fee ( which I already paid ), they will be generous enough to not double charge me and demand only {$510.00} ( see attachment 3-4 ). Now that I am XXXX to the XXXX XXXX for the forseeable future, and demolition having already begun in my home back in the United States, this situation is that much more aggrevating. This situation is the result of gross negligence on the side of the lender, as any of these issues could have been addressed prior to coming to an agreement at the closing table for whats required as far as my minimum contribution, and prior to me deploying.

Greetings, Loan Simple Inc. is the mortgage lender that I use to refinance my home last XXXX, everything went well and the 1st payment was set up to be made onXX/XX/XXXX, but on XX/XX/XXXX I received a letter saying that my loan was transferred to XXXX and they will start collecting my payments on XX/XX/XXXX, accidentally I made the XX/XX/XXXX payment to XXXX instead of LoanSimple, after a few calls XXXX made me regarding this payment, I contacted XXXX to reverse that payment to LoanSimple, they agreed and sent a check to LoanSimple on XX/XX/XXXX, it looks like it was cashed on XX/XX/XXXX but LoanSimple keeps denying they have received this check and now they are sending me letters about foreclosing my house stating that I haven't made my mortgage payments, that my loan has never been transferred and that my house could be foreclosed if I don't make my mortgage payment.
