When we purchased the first contract from XXXX in XXXX 2013 at XXXX XXXX, SC, points were XXXX and we were promised a cruise that was to be honored by XXXX but never given. A copy of that agreement referencing the cruise is in my possession. The XXXX salesperson told us about the cruise and XXXX added bonus week, not to be used with the cruise. When XXXX Representative XXXX XXXX began talking with us on XXXX XXXX, 2013 about upgrading or purchasing ( blending ) another contract in XXXX XXXX with XXXX XXXX XXXX XXXX XXXX XXXX, we told him right away about the free cruise and 1 week. He said that would be no problem and that we were still going to receive them. We have since phoned XXXX a couple of times in which we discussed the cruise and the weeks ' vacation. When we called to firm up the plans to take the cruise, we could n't get an answer. We left messages for him to call us but we have not had XXXX call returned. We then called XXXX XXXX and she did return our call but informed us that she could not give us any relief regarding our contract. We were told that we had gone beyond the rescission date and they were very sorry but they could n't help us. She did however tell us that she would send us an application for " hardship '' but told us that the cruise issue has been assigned to some other XXXX employee in that office to work on. After returning home from our vacation, XXXX of those days being completely lost at XXXX and explained hereafter, we were reviewing our documents and found that our monthly payment was going to be {$930.00}. We 're both retired and on fixed incomes. Our sales rep, XXXX XXXX, asked how much we would " feel good '' about paying per month. I told him between XXXX and five hundred dollars. The number of points that we purchased were never discussed until the signing because on that day, we were informed that a computer outage had occurred and had caused them not to be able to give us certain items of information that were critical to our signing the contract. We questioned how XXXX arrived at the number of points that were presented, and he replied that he thought that we could afford that amount. We had previously bought and paid in full for XXXX points for a total of XXXX dollars as we entered into this " deal ''. We did n't know for the majority of the work day about the number of points that XXXX was trying to get for us until computer connections had been restored late in the work day. We had been there for approximately XXXXXXXX hours, and although we were furnished a mid-morning breakfast, that began to fade into the middle of the afternoon. We were growing very tired and hungry toward the end of the day. During that extended stay, our only chance to go to XXXX XXXX ( which was supposed to have been our focus for that day ) was dashed because we were discontentedly grounded at the XXXX offices all day due to the computer system outage. I have a documented account of the extreme weather experienced that day. At the close of the day, XXXX brought the papers in for our signatures, and very apologetically gave us {$100.00} dollars cash for our troubles and to purchase our evening meal. On the contract, it was stated that " owner had been given a satisfactory opportunity to read this agreement. '' When they finally came to us with XXXX pages, we did not have sufficient time to comprehensively read all of the " legalese '' in the papers. They made some very condensed statements after our short perusal, and then showed us where to sign and date. By that time, we were already very tired and disheartened about missing XXXX XXXX, having had so much paperwork to digest and compounding our confused and exhausted state of mind. XXXX Bank Bank hired Lloyd & McDaniel , PLC to collect on a debt allegedly owed by a Mississippi resident. Lloyd & McDaniel , PLC became an agent and third party vendor of XXXX Bank at that time. XXXX XXXX XXXX is a XXXX law firm with no physical office in Mississippi. XXXX XXXX XXXX issued form letters, which were not signed by an attorney and/or anyone in the XXXX. This practice likely results from no attorney review and/or oversight prior to the form correspondence being sent. This suspicion is supported by the fact that numbers and/or amount owed and/or settlement offers varied up and down depending upon them being sent via form correspondence or later in the case by email from an actual attorney. XXXX XXXX XXXX failed to issue the required validation notice. XXXX XXXX XXXX filed a one-page form Complaint, which was deficient as it failed to incorporate necessary attachments. When the deficiency was pointed out, XXXX XXXX XXXX continued to push for a default judgment instead of amending and correcting the Complaint. At hearing, XXXX XXXX XXXX hired local counsel, who stated to the XXXX he did not have settlement authority. Upon information and belief, XXXX XXXX XXXX does not ever attend hearings- they practice in Mississippi via remote representation using local attorneys who are not given settlement authority. When XXXX XXXX XXXX 's failure to send the required validation notice was raised, XXXX XXXX XXXX did not provide a copy of the notice but continued using the XXXX system to try to obtain default and/or summary judgment - all while the original Complaint remains deficient and never amended. This action supports the XXXX 's failure to have timely sent the letter ( otherwise, why not simply provide a copy? ). XXXX XXXX XXXX 's use of form letters, form pleadings, and bullying tactics to obtain default and/or summary judgment through remote representation is tantamount to abuse of process. XXXX XXXX XXXX 's actions and/or inactions since being hired by XXXX Bank are collectively illegal collection practices geared towards obtaining the highest number of default judgments with the highest balance possible but with the least amount of work per case. XXXX XXXX XXXX 's actions and/or inactions since being hired by XXXX Bank are unfair, deceptive, and abusive. XXXX XXXX XXXX 's actions and/or inactions since being hired by XXXX Bank are designed to confuse the least sophisticated consumer, including many consumers who are unable to hire counsel to represent them. It is probable that the form correspondence and pleadings being used by XXXX XXXX XXXX are being used across Mississippi and Kentucky against unbanked consumers who ( i ) can not afford representation, ( ii ) would not realize what the validation requirement is, ( iii ) and/or recognize a deficient Complaint. XXXX Bank is responsible for XXXX XXXX XXXX 's actions and/or inactions as XXXX & XXXX XXXX XXXX Bank XXXX XXXX and third-party vendor.

I moved into XXXX XXXX XXXX in XX/XX/XXXX, or towards the end in XX/XX/XXXX. When moved in they seem to be nice, but the apartment was not completely clean. I have a witness that can state it still smelled like animals when I moved in the kitchen draws we're not fixed, stove and fridge was not clean. They did take care of it eventually. They made us get renters insurance for XXXX dollars a month which I was glad of because it was a malfunction on the stove and it caught a fire I made the claim and told insurance company my personal belongings were ok, and that they could fix their equipment if they filed a claim because there is a XXXX deductible. I then told XXXX XXXX and their response was Did we charge for anything? And dismiss it, but I did not because I felt that was strange. I told the insurance person that they would be in touch. When it got close to the end of my lease they started to pressure me to sign a new lease, when I did not I was late on my last month which was XX/XX/XXXX and they kicked me out immediately and would not work me. As a matter of fact we had to pay utilities through them and they let my toilet run water for two weeks without fixing it, another reason why I was not reluctant to pay my full rent. They kicked me out and told me I had to leave to save them costs on an eviction process which I did not understand how that worked. The day they told me that I moved out. They are trying to get 2-3 thousand dollars out of me which they know I do not have, I do not owe, and out of spite. What makes matters worst they were so underhanded when I asked what it was for they asked was they v being recorded and come in and talk about it. This matter is not on my credit report, but they have it posted on my rental history to keep me from getting a new place. They reported to a lawyer for collection, but yet in still it was not posted on my credit report to dispute. XXXX XXXX is not a good place to live because it is some underhanded activities going on. When you do not sign a new lease it is a problem and they definitely will try and over charge you. I feel like there is some defamation of character going on because I stayed there a year and now in the end it was a problem. It is also conflict of interest because it should have been on my credit to dispute it has been over a year and they would not mind talking on the phone about the dilemma even if I was on a recorded line and they have nothing to hide. I am currently pregnant and this situation has put unnecessary stress on me, and caused undue hardship because instead of working with me on the rest of the last month rent, I had to move my stuff, find another place, and making it difficult for me to find somewhere decent and affordable to stay. I would not give them a recommendation for future tenants.

I enrolled with a debt settlement company XXXX . One of the accounts was a Bank of America ( BofA ) credit card debt. Al of the other credit cards and debts have been successfully paid off or are still in a repayment program. Payments to XXXX were initiated XX/XX/XXXX and followed on XXXX , XXXX , and XXXX . I received a piece of mail from a law firm in XXXX XXXX AR, offering their services for representation regarding a lawsuit filed against me by XXXX and XXXX law firm on behalf of XXXX . I was unaware of this at the time. My name was also in the Sunday, XXXX XXXX , newspaper noting said lawsuit. I contacted my debt settlement company, XXXX XXXX , Thursday XXXX XXXX inquiring why I was being sued. They had informed me at that time that XXXX had already received payments for the debt and would check into this matter. After further communication with XXXX , they informed me they were in process of negotiating a new settlement with XXXX and could not explain why I was being sued. I informed XXXX I would contact XXXX and XXXX and attempt to settle this debt without their assistance. I was formally served the lawsuit papers the evening of Tuesday, XXXX XXXX at my home. I contacted XXXX and XXXX Wednesday XXXX XXXX and spoke with XXXX XXXX ( spelling? ) and negotiated a settlement with her that same day. Subsequent papers were sent out which I received the following Tuesday, XXXX XXXX . I spoke with XXXX XXXX the following day and she informed me the papers I received were null and void and would n't be honored. She asked me to mail them back to her and then later in the conversation advised me to shred them. I still have these papers in my possession. I then attempted to negotiated a second settlement with XXXX and was advised to call her back if I did not hear from her. I attempted contact again Monday, XXXX XXXX , left message and again Friday XXXX , XXXX . XXXX left me a message Monday XXXX XXXX and I attempted return call approximately XXXX min after and have not had return call from her through end of business day today, XXXX XXXX . I feel I have been diligent in trying to reconcile this debt and I was unjustly sued by XXXX , through XXXX and XXXX . L I have spoke with, although have not retained an attorney at this time and have concerns there XXXX be Fair Debt Collection Practices Act violations with this manner. Lloyd & McDaniel, a collection agency, filed a lawsuit against me in XXXX. XXXX in XXXX XXXX. At that time, I contacted them via phone and made a verbal agreement to pay a specific amount. I made every payment ( sometimes more than required ) monthly. They sent me a document in the mail stating that I was required to sign, but the language used in the document indicated that I was agreeing to a court judgement, which had not been made as we had not gone to court. It also added court costs to the payment schedule, which I do not recall agreeing to. I was informed by a legal advisor through my job to not sign, as no court judgement had actually been made, and in signing the documents I would be agreeing to tactics that would not normally be used without a court order. As stated, I made payments monthly. Recently, I found out I would have to have XXXX for XXXX, and have to take time off work. While out on XXXX XXXX XXXX, my pay would be significantly less. I asked if I could take a hiatus from payments. This request, made through multiple calls, as I could not reach the correct person for several attempts, was made XXXX XXXX. The response was 'no '. They said they would delete the payment schedule, instead. In the meantime, my local court sent a notice to dismiss the lawsuit due to lack of prosecution. In response, the company then sent a notice ordering the case stay active in the docket. In this notice, it claims that the " Plaintiff has not received any response from the Defendant to the Complaint filed in this action. '' This is absolutely incorrect. I have made payments regularly through their telephone system, often communicating with a person to make the payment. I called in late XXXX to discuss the financial situation. Essentially, they appear to be lying to get the case to remain active. They are requesting a default judgement, according to the document. Again, I have been making payments, and communicated with them. There is no default. In essence, the company has tried to get me to agree to a judgement that would give them powers only a court can give, and has sent a false statement to the court. I have screenshots of the dates, times, and lengths of my calls to them in XXXX. I can retrieve earlier call records, if needed. I have taken photos of the documents in question. I am unable to load them at this time, my phone does not want to upload. Will attempt again later.

I had a market and owed XXXX XXXX around XXXX when I had to close the market in XXXX XXXX. I had paid the original invoice down from XXXX XXXX. In XXXX an attorney started threatening me, and took me to court for the debt. I called XXXX, but they had went out of business and XXXX bought their inventory. XXXX is the company trying to collect my old debt to XXXX. Their attorney LLoyd McDaniel took me to court, but could not produce an invoice. I agreed to settle out of court, and pay XXXX to XXXX within one year. I sent XXXX check to them and they cashed it but would n't adjust the amount, and send a receipt, or stay in contact with me. The attorney filed a garnishment on my old bank, but I have XXXX assets, have a small XXXX pension in ky of XXXX monthly and the bank put XXXX. They have now contacted XXXX XXXX Bank after filing another garnishment, and attached XXXX to my wife 's cd, which is her back pay for ss XXXX. Teller XXXX XXXX attached the lien without checking the cd to see that her money is exempt, she had no ownership in my business and they can not legally garnish me on her money. I filled all this information in a few minutes ago, but the computer went down, so you might be able to pull up the completed form. I have asked for a receipt, and tried to send them another XXXX dollars but they refused it because it was on my wife 's checking, but my wife gave me permission, I am her representative, and have to monitor the account for the ss administration so my name is on all our accounts as rep. We need help, we are both very sick, she has numerous XXXX issues, and is now close to XXXX due to having our little amount of ss benefits attached. I am suffering from XXXX, and a XXXX we XXXX stay in the hospital with health problems..This company has been ruthless and has been using the district clerk in XXXX XXXX Ky. as their enforcement arm, even though we had a court signed agreement that I had until XXXX XXXX to pay the money. They are claiming several XXXX more, did n't give me credit for my payment and I have the check where it was cashed by XXXX 's. I only gave in on this because I have XXXX when I leave the house, and I have to monitor my wife constantly because of her XXXX state.

I need to report violations of the FDCPA by XXXX and XXXX XXXX XXXX in regards to an alleged debt in my name. XXXX is attempting to collect a debt that doesn't exist. They claim it is a XXXX credit card debt I had from XX/XX/XXXX-XX/XX/XXXX and even filed a lawsuit in the XXXX XXXX courts which honestly prompted me to make a few payments to avoid the lawsuit. I finally looked into the debt because I didn't remember ever having a credit card that long and I noticed the paperwork XXXX sent me was stating an APR of 29.99 % which immediately told me something was wrong. I was in the XXXX XXXX on XXXX XXXX during that entire time period and never had anything with an APR that high because thanks to the Servicemembers Civil Relief Act I was entitled to a 6 % APR on all my credit lines. I must assume this paperwork is modified or not real at all so I begin to do some research and I don't find anything anywhere showing I had a XXXX credit card during those times. I did however find a XXXX credit card debt that was closed satisfactorily in XX/XX/XXXX7. The chances of me closing a credit card and then opening the same exact card again 27 days later is very, very unlikely. This is clearly a fabricated debt with an unlawful APR, fabricated documents and a lawsuit that I just lost {$320.00} on trying to do the right thing. Although the debt doesn't exist XXXX filed suit anyway and collected 3 payments from me without ever attempting to mention anything. Even the document showing alleged account information shows the open and close date with an address I didn't live at during either of those times. All the information is wrong and yet they are reporting this account to the credit bureau 's and since I made those payments XXXX has re-aged the debt thus performing yet another illegal credit act. I have informed Cavalry about this, I have called XXXX and I have sent disputes through the credit agencies but they refuse to leave me alone. Please help me get this taken care and ensure all companies involved are punished accordingly. Thank you for your time.

XXXX XXXX said I owed a debt that was not my debt. I contacted them to let them know it was not my debt. This was in XXXX. They filed a lawsuit against me and I showed up in court. They did not show up, so the judge said to reschedule the court date. I did not receive notice of another court date. I did not receive any other correspondence from XXXX XXXX or from the court system. My employer received a letter from Lloyd and McDaniel in reference to XXXX XXXX with information to garnish my wages. I did not receive any information from XXXX XXXX or from Lloyd and McDaniel about this. The letter to my employer had the correct address, but the employer 's name was incorrect. It had a former employer of mine listed instead of my current employer. In the letter to my former employer ( that was sent to my current employer ), it had where there was a court case filed against me on XX/XX/XXXX. I had no knowledge of this at all. I was not served papers, I received nothing in the mail, and I received absolutely no notification of this action taken against me. I was not aware anything was filed in XXXX until I received a copy of the information Lloyd and McDaniel sent my employer on XX/XX/XXXX. The initial debt was not even my debt and I am still dealing with this 4 years later. Correspondence with the companies has been terrible. I have recently separated from my husband and I am in the process of getting a divorce. I went from a two income family to being a single parent of two children. Both children are beginning college in the fall. If XXXX XXXXLloyd and McDaniel garnish my wages, this will cause undue hardship on me. I do not have the ability to pay this debt, and it is not even my debt. XXXX XXXX and Lloyd & McDaniel have not followed the laws in that they have not had clear communication with me. They have gone behind my back and filed a lawsuit that I knew nothing about for 4 years. I would also like to know if the statute of limitations can go into effect with my case.

I had a credit card with XXXXXX/XX/XXXX that charged off XX/XX/XXXX for an amount of {$2000.00}. I had some health issues which caused me to fall behind. I wanted to make a " settlement offer '' and try to get my credit card balance cleared up. Recently I contacted XXXX trying to find out if they would settle for half of the charge off balance, and they told that I would have to speak to an attorney it had been assigned to in order to settle for that amount. I called Lloyd and McDaniel and they gave me an amount of {$2900.00} which means I was charged an 69 % in interest and fees after they charged off the debt. I had moved to a different temporary location, and did not receive any additional statements after the account charged off. I requested the statements on XX/XX/XXXX and they had them sent to me, and it does show on the statements that they continued to charge interest on the balance that was charged off. I was advising XXXX XXXX that I was trying to pay the " debt the I owe '', but he said that they had set a court date for XX/XX/XXXX. First off, I am wondering how there is a court day and I have not received any info or been served for that matter, secondly if I contacted them trying to pay why are they trying to sue me, and third he said he sent something to me, but XXXX advised he had to update my address because he had the wrong address for me. So, if you sent me something and to the wrong address there would not be a way that I would contact if I have no knowledge of it. I think that the entire situation is deceptive and unfair on both parties XXXXXX/XX/XXXX and Llyod McDaniel. I am more than willing to try and resolve this issue, but when I found out there were some questionable legal actions being taken and they did not contact me properly I wanted to report this and make sure that I am given a fair chance to settle this properly.

I have an account in collections on my credit report. Original credit was XXXX XXXX XXXX who turned it to collections thru XXXX XXXX. I never satisfied the debt and when I first called, possibly XXXX of 2020 ( not sure on exact date ) XXXX XXXX directed me to call Lloyd & McDaniels Law office and provided me their number. When I called in, the person on the phone told me my account was new and was locked, whatever that means. So I left my contact info hoping they would contact me. When I did not get a call, letter or email, I called back and was told the same thing. The lady on the phone understood my frustration but would not share a single detail of my account, answer any questions about why it was still locked and said I cant even pay on it. Yet again, still no contact from this law office that is supposedly in control of a debt on my credit report which is severely hurting my ability to get a simple loan or credit card. It is the only account in collections I have and they will not give me any options to move forward. I even submitted a settlement offer on their website hoping it would get things going but still ZERO contact from them. It is wrong for them to be able to negatively affect my credit report without ever sending me documentation as requested, not providing me any information, and failing to communicate with me. I was willing to pay but now I just want this removed from my credit report since they cant verify it or even unlock my file so I could pay on it.

I have been making regular payments on 3 accounts that I have with Lloyd and McDaniel. I have never missed a payment and I have kept all my confirmation numbers that I get each time that I make a payment. However, last month Lloyd and McDaniel claimed that I had skipped a payment of $XXXX. In doing so and without notice they levied our bank account and emptied it. They took $XXXX. Also our bank charged us $XXXX for them doing this. I contacted Lloyd and McDaniel and was told I had missed a payment. However, I was able to give them the confirmation number to the account they claimed that I missed. Once I did so they realized and admitted that it was their mistake. Somehow their payment system posted my payment to one of the other accounts even though I had put the correct account number in there. They said they would make it right and would have the funds released and would also pay for the fee the bank charged. I was told to expect the payment in a week. When that week came and went I called a week later and got the same story. So once again I contacted them and was told that if I hadn't received our money by this past Wednesday the 14th to call them. Our bank account was emptied and as of today Lloyd and McDaniel has still not corrected their admitted mistake. We cannot afford and attorney but I have been trying to find someone to help us. It has now been 3 weeks and they have still not returned our money to us. Please help us somehow!!!!!

I began receiving numerous phone calls every day at all hours along with letters that said I owed a debt that I didn't believe I owed. I asked my husband to contact them to find out what they were calling about. When he asked them for proof of the debt they didn't want to send it. Finally they agreed to send something. When it arrived it was only part of the story. They left off payments etc that would reduce the amount. They claimed it was what they were given as they had received it from another company and they were the 3rd party. When we offered to pay the amount that was actually due they wouldn't accept it and threatened to sue. Eventually they somehow got a " judgement '' on XX/XX/XXXX. We were not notified of the time, date, or meeting, whatever they had, for this " hearing '' so we couldn't be represented. I don't know how much they have taken in the interim from my checking account because my bank hasn't notified me who has been taking the money, but it has been several hundreds of dollars. Yesterday I was told they have somehow gotten an " Order of Wage Garnishment '' at my employers office. This one has a date of XX/XX/XXXX. AGAIN no opportunity to contest it, question it, or settle it. These people are dishonest and deceptive in their practices. I have had no opportunity to settle the debt and resolve this. Further, I suspect it has been reported on my credit bureaus again unfairly and incorrectly. This needs to be stopped!

My sole source of income is Social Security XXXX. I have a checking account and a savings account which had approximately {$800.00} in it. Lloyd & McDaniel, LLC of XXXX, KY garnished my savings account, taking more than half of it to collect on a debt that they 'd already attached to my condominium as a lien. My fear is that they will try and attach garnishment to my XXXX income even though I believe they are not allowed to by law. I need to make sure they ca n't take anymore of my income from me. I told them when they contacted me that I could not make payments on the debt at this time and that I planned to sell my property this year, thus allowing them to collect what I owed. But this was n't satisfactory for them. I have read numerous other complaints about this debt collectors practices. I live on a limited budget and while I realize I owe a debt I ca n't have what little money I have just grabbed from my bank account. This hurt me very badly financially and I do n't believe it should be a lawful practice. Also my own bank attached a high fee to the garnishment transaction adding even more distress to the situation. I contacted Lloyd & McDaniel several years ago about this debt and they were nasty and rude to me and gave me no credence as far my explanation for my financial situation. They act as sharks toward people without ability to pay them.

In XXXX of 2022, I was issued a summons from a debt collections agency in regards of a debt I owed to a credit card company. This debt came from a result of identity theft. I followed protocol and disputed the debt through the XXXX dispute portal online. I XXXX, I received a letter stating that my wages were to be garnished. On XX/XX/XXXX, I made a call to Lloyd and McDaniel and they stated that my wife called from a cell phone number that is not her number and setup a payment plan for this debt on my behalf. This is illegal. The next day I called back and talked to another lady who told me the same thing and that a payment actually posted from a bank account in which I do not have any association with. The lady became frustrated as I asked questions. She claimed that it was legal for my spouse to setup a payment for my debt ( it is not ). When I asked her for the law that stated that, she hung up. Mind you, all of their phone calls are recorded. It was mentioned once if I would like to hear the phone call for when my wife called in and I said yes, and that was the last it was heard about. On XX/XX/XXXX, I called and spoke to a supervisor. Supervisor was very adamant in saying that my account was placed on hold and there was nothing they could do. He then refused to notify my employer of my account being on hold.

I received notice from Lloyd & McDaniel XXXX XXXX XXXX XXXX ( dated XXXX XXXX XXXX ), stating that XXXX XXXX XXXX had referred my account to them for collection. The letter stated the amount owed and where payments could be made. I sent out a letter on XXXX XXXX XXXX ( Certified Return Receipt ) to the XXXX XXXX stating that I was willing to make payments on this account. The letter was received at the XXXX . On Saturday, XXXX XXXX XXXX I receive a n otice in the mail from XXXX XXXX XXXX , XXXX stating that it had come to their attention that a civil suit has been filed against me in XXXX XXXX XXXX . I have not received notice in reference to any of the matters and I have certainly been trying to resolve the situation without having to have a judgment filed against me.

This law firm does not seem to want to assist those who are willing to take care of their debts, they are automatically trying to sue and garnish wages.

I got a call from Lloyd and McDaniel I believe in XXXX from a very rude guy name XXXX regarding some alleged debt with a credit card from XXXX XXXX. He wasnt able to prove to me that I owe this debt by proving an original contract or anything showing this debt was mine. He proceeds to tell me that he sent a wage garnishment to my employer which was an old employer and all this was sent without my knowledge. I wasnt concerned being that I didnt work with the company he said he sent he garnishment too and I didnt owe this debt. XXXX then says thats fine and he continues to push and tell me that I needed to pay {$350.00} on this debt or my wages would be garnished with my new employer. I state to him I dont owe anything why would I pay. He goes on and on saying what will happen so me I give in without knowing my rights and made this payment of {$350.00} to avoid my wages being garnished while I dispute the account with XXXX XXXX being that this isnt my debt. Even though I made that payment in XXXX, Lloyd and McDaniel still sent a wage garnishment to my new employer and my wages are being garnished. Lloyd and McDaniels law firm apparently sued me for a debt in XXXX. The original debt they said was through XXXX computers and then XXXX XXXX. They wouldnt tell me how old the debt ( original ) was from XXXX but if this action took place in XXXX from the 3rd collector and its 4 years old Im going to guess it was at least 10-15 years old because Ive not even owned a XXXX in that long. My wages were garnished this past payday which was XX/XX/XXXX and I had no idea that was even going to happen. I called the number on the paper that my Human Resources got for me from the payroll department. They said they were not releasing the garnish. I had a car that was voluntarily repossessed about 15 years ago. The amount owed was {$6400.00} after the sell off the car. I dont remember any communication about it after that. Fast forward to XXXX or XXXX I was taken to court by XXXX and XXXX and a judgment against me was interred for almost {$19000.00} for the car. I was told to pay {$100.00} per month. I learned in 2013 a company named XXXX had filed a XXXX negative reports to the credit bureaus for a claim on XXXX and XXXX XXXX credit cards. I wrote and asked them about the reports, asked them to provide proof of a debt to which I was unaware, and to cease and desist. They mailed me statements that reflected fees and interest and otherwise gave no information. Apparently, then it was given to Lloyd and McDaniels and I wrote Lloyd and McDaniels and again inquired. Since my efforts, a suit was filed and a judgment granted, all without my knowledge even though they had my contact information and we were corresponding and talking by telephone, no one told me. I found out when my checking account began being garnished! This has caused me a great deal of stress and additional financial problems because of the garnishment. I may now have to file a bankruptcy! I need help getting the judgments repealed, the reports removed from my credit bureaus and my garnished money returned to me. This should never be allowed to happen to any American consumer. I believe these companies have acted illegally and in bad faith pursuant to Kentucky statutes of the Fair Consumer Act and the Federal Trade Commissions policies and ordinances.

On XX/XX/2018 A Motion for Judgment on the Pleadings was mailed to my residence from Lloyd & McDaniel stating that a court date had been set for XX/XX/XXXX in XXXX county District court. This was the first knowledge that a lawsuit had been filed against me. I had not been served previously with a Summons/Complaint as described by Kentucky statue. Having not been properly served, I was not afforded the time to file an answer. Checking with the court, the lawsuit was filed on XX/XX/2018. I had previously written a letter to Lloyd and McDaniel stating my financial situation. The letter dated XX/XX/2018 was a letter in general and did not attest to any knowledge of a lawsuit. I received a letter of a debt owed to Lloyd & McDaniel. so I called to see what was the best route to go to repay the debt ( that I 'm still not a hundred percent sure how I got it ). We agreed that I would pay hundred dollars on the XXXX of each month until the total amount was paid. After making the first payment I got a call from human resource at my job about a garnishment from this same company. Thinking there was a mistake I called Lloyd & McDaniel the debt collector to clear the issue up. After being called a liar for fifteen minutes and being reminded that all calls are recorded which I found funny because if they listen to the previous call it would have cleared up this whole situation so I decided to end the call and try back later. I woke up to today to see my bank account had a XXXX balance, so thinking there was a banking error a called them and I found out the company in question was no other than Lloyd & McDaniel. So pretty much they lied to me to get my bank information and withdrew all my funds. The debt was from a XXXX card with a {$300.00} limit from back in 2006. I have no signed contract with my name and XXXX XXXX XXXX XXXX XXXX. that is pursuing the debt through Lloyd & McDaniel. They have garnished my check already for over {$3000.00}. When it got to the amount said I owed, my employer stopped the garnishment. And just recently they received another paper saying my check is to continue being garnished for over another {$530.00}, until they tell the employer to stop taking money out. They are taking around {$180.00} out of each of my paychecks. I have disputed this debt with them several times because I have no signed contract between me and XXXX XXXX XXXX. I tried to offer an amount to end this and get it out of the way and they refused. Hello, for the past year or so I have been getting letters attempting to collect a debt from XXXX from the XXXX companies of debt collection including, XXXX XXXX and XXXX and now Lloyd and McDaniel the creditors law firm. I have disputed all these attempts and sent verification requests which have either been ignored or once they sent an alleged copy of a monthly statement and have repeatedly ignored my requests for actual verification of debt and their legal ability to collect it, including an original contract, a purchase agreement for the debt from the original creditor, and more against the fair debt collection act. It seems that after I request verification they just transfer it to another company within their network to avoid the verification request or send not up to power verification. I received a letter from the law firm Lloyd & McDaniel , PLC on XX/XX/XXXX stating my account from XXXX XXXX had been referred to the law firm for {$1200.00}. I mailed a written request for validation of this debt on XX/XX/XXXX. I had a charged off account with XXXX XXXX dated back in 2018, after several attempts both XXXX XXXX and I had agreed to settle the account for less than what was charged off. XXXX XXXX had a law firm by the name of Lloyd & McDaniel representing them. It was agreed upon payment that once I paid the balance that they would remove the negative account from my report. I have tried several times to communicate with XXXX XXXX and let them know this negative account was still reporting on my credit report after I had paid the agreed balance. She explained that my file was locked and she could do nothing about it. I explained that I understand the policy but can I then speak to the attorney handling the case. There was no explanation, verification of debt, or request. Llyod & McDaniel purchased a debt from XXXX Bank in XXXX. The alleged debt was opened in XXXX and the last payment was made in XXXX. The debt was charged off by the company. I had no knowledge of alleged debt at the time and did not pay attention to credit reporting, if it was there. I went to court and advised plaintiff that the debt was not mine. My check was garnished without me being served. Debt collection agency is confusing me with someone with the same name. Even after letting them know that they have the wrong person ( when they tried to garnish my wages ) they have continued to try to collect the debt, threatening to garnish bank accounts. The worst part is that the legal notices of the garnishment attempts are going to the correct person, but the actual garnishment attempts are against me -- so I do n't have an notice of the activity until it happens. XXXX XXXX XXXX XXXX will not answer any questions or provide any debt validation. I have called their collection agency : Loyd McDaniel, in XXXX, KY, to attempt to get information on the debt, and they say the " file is locked, '' and they can not provide any information. The numbers to XXXX XXXX XXXX XXXX either don't work or go to voicemail without a return call. This debt was supposed to be settled during the divorce proceedings, and we paid the $ XXXX in a settlement with them. Yet they still claim the debt is valid.

I received a Discovery Request dated XXXX XXXX, 2016 from Lloyd & McDaniel representing XXXX. They claim I had an account with XXXX, formerly XXXX and owe a debt. There is no record of that on my credit. I have spoken with their agents several times and they have advised me that they do n't have to provide any proof of the debt and a debt does n't have to be on my credit to be valid. I filled out and sent in a fraud packet in XXXX, but they said their client rejected it.

This firm has contacted me twice regarding an account from 2015. Twice, I have asked to be shown the unredacted Bill-of-Sale that shows both the DATE and the amount their client, XXXX XXXX, XXXX actually PAID for this old account. I have previously submitted complaints against discover. In short, the current debt collector ( McDaniel Lloyd ) has not properly validated the debt and has made negative remarks on my account. Ive requested that they validate the debt and proof they have authority to collect it. They have not done so adequately. Last XXXX I get a call about a debt on a credit card. I told them I didnt make those charges but they kept telling me they were gon na sue and it was going against me. That it would follow me and when I got a job they would garnish my wages. I paid 2300.00 but that wasnt good enough, they then served me from my local sheriff dept. I have since then set up payment arrangements because I dont want to go to court. But again this is a bit my debt.

My bank accounts have been frozen in order to collect a debt from 2015. I contact the lawyers who have submitted and obtain the freeze legally however, the correspondence regarding the debt was sent to an address I have never resided in. I had no way to choose to pay the debt or to act to keep my accounts from being frozen. I explained that I have never lived at the address they have on file and they are refusing to assist me.

I paid Lloyd and McDaniel law firm XXXX on XX/XX/2018, they are still reporting negative remarks to the credit bureau and they have not released the judgement off of my credit. They told me it would take 14 days to remove the negative mark on my credit but its still on there. I have reached out to them several times and they refuse to remove the judgement even after I have paid in full.

Man showed up in plain clothing to my home waited for me to pull in my drive way dropped paper work off from Lloyd and McDaniel did not give his name. Took pictures of my home and my children without my permission. I called the company and have not received a phone call back. I received a wage garnishment notice, but this was the first I had heard about it. The company had my wrong address the whole time.
