OnXX/XX/XXXX HR through my employer notify me that there was a writ of garnishment placed against me, I quickly asked for more information and was sent a package via email. I called the number listed on the packet and spoke to a lady at Livingston Financial LLC ; I asked the following questions and got the following responses. Q : what is this for? A : credit card Q : when was this account open? A:XXXX and last payment was made on XXXX. Q : can I get verification signatures, who made the last payment? can we trace that information and was told no information was available ; that they could not provide any information as they didn't have it. I went to the court house and filled a challenge of garnishment and the court date was set forXX/XX/XXXXat XXXX XXXX. I showed up at court and explained to Judge XXXX that this was not me and I provided my credit report, Judge XXXX asked the clerk if Livingston was present and the clerk said no the Judge then asked the clerk when they were served and the clerk said on the XXXX of XXXX. The Judge asked if they had been served in XXXX and the clerk said no they were served on the address on the garnishment in Utah. The Judge at that point apologized and then said the hearing would be set for another day. I told the Judge I had already been garnished and I couldnt afford to be garnished, they weren't there and they were served. I was told the garnishment would be stopped until next hearing. Please help me I have tried calling Livingston and they wont give me any information. I feel as XXXX County Court House has treated me unfair due to the fact that I was present they weren't I had proof that its not me and its not on my credit report and the Judge was not willing to hear me out. Its hard being a citizen of color and not being heard.

I submitted a compliant with CFPB ON XX/XX/XXXX and explained my side of the story. The debt is not mine, I also then went down to the court house and got copies of everything that was submitted for the case by the Plaintiffs. In that paperwork ( attached ) it notes that the DOB is XX/XX/XXXX which is not my date of birth. My date of birth is XX/XX/XXXX. Today during the hearing I presented the paperwork that Livingston had submitted. XXXX who is representing Livingston was not present but via phone. XXXX asked me a few questions and then I was giving the chance to talk I pointed out that I had my credit report and the debt is not listed, I also pointed out that the DOB on the paperwork is not mine. I also confirmed that I was not served and XXXX said they were going to close the case and return the garnishment immediately. However they wanted me to proof where I lived in XXXX. The judge agreed with Livingston in everything and then asked me if I was OK with the decision. I appealed the decision since in the court of law is what you can proof and I have been providing everything I can to show this is not me and Livingston has not provided anything just accused me. I have had to use my vacation time for the day I went in to challenge the garnishment, the first appearance that they were a no show and today, to get paid as I can not afford to miss any day. And yet Livingston wants me to contact them to provide some sort of verification of my residency in XXXX. Again I have been treated unfair and I'm asking to be compensated for this and not have to be harassed by Livingston any further.

Livingston financial LLC sent me a letter stating I owe over XXXX for some debt back in XXXX. Stated debt renewed in XXXX and again in XXXX. I've never been notified of this and have no idea what debt they're referring to. It's been XXXX years and built a lot of interest without any notifications. I need paperwork proving the debt owed and if it is my debt I'd like to resolve it minus all the added interest because I was never notified all these years. Please remove from collections.

The company claims i owed them and i have no knowledge of what they are talking about and they say this matter is fro m 2010 i am being a victim of stolen identity and i need them provided me with documents witch they should have staying that is me my signature and photo copy 's of documentation

The debt collector won a court case against me without me being served with any kind of court papers back in 2012. And got a amount awarded of XXXX and XXXX in court costs for a total of XXXX and is now garnishing my wages at 25 % till a total of XXXX is collected
