Parties involved : XXXXXXXX XXXX XXXX XXXX XXXX XXXXXXXX ( my day-to-day point of contact ) XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( CEO of the parent company XXXX XXXX XXXX he is on a couple of emails, and his name is attached to the " Release Agreement '' ) XXXX XXXX XXXX ( Affiliate Partner of XXXX XXXX ) XXXX XXXX - XXXX ( point of contact that XXXX worked with ) XXXX XXXX XXXX - XXXX ( I don't know who this is, but he was copied on email threads ) Complaint : I applied for a loan, and as a result, it ended up costing me {$5500.00}. Additionally, the lender ordered title work from a title attorney before being 100 % sure they could close the loan. The title company is now demanding payment of {$7300.00} for the abstracts and title work, and the invoice is directed to me. The lender is refusing to pay, and I certainly should not be on the hook for this payment, as I did not direct the lender to order title work, nor was I aware that it had been ordered. Details : On or around XX/XX/2023, I began working with XXXX XXXX on a loan to refinance my portfolio of XXXX properties. XXXX XXXX originally reviewed my portfolio and made me an offer. I accepted. Then it moved to XXXX XXXX 's processing & underwriting department, who came back and said XXXX XXXX would not be able to move forward with the loan based on their underwriting algorithms and calculations. Around XX/XX/2023, XXXX XXXX came back with a new offer. They involved XXXX of their affiliate partners, Lima One Capital. I was told that Lima 's lending model would work for my portfolio. I was then asked to pay a deposit for the appraisals upfront ... which I thought was highly unusual, but I agreed to do it because the representative ( XXXX ) seemed confident that Lima would be able to close the deal. The total appraisal deposit was {$15000.00}. On or near XX/XX/2023, I was informed that the appraisals came back too low, and that Lima One Capital would not be able to close the loan. And that I had lost my {$15000.00} deposit. The justification they gave was, " you paid for the appraisals '', and you have them. So the work was done, and you paid for the work. I argued that I would not have ordered, nor paid for these appraisals without the belief that they would accrue to my receipt of the loan. I argued that this was bordering on Predatory Lending, and this feels like a UDAAP violation. I then sent an email to XXXX, XXXX, and XXXX explaining that what I felt. I also felt there was some appraisal bias going on because my properties are in a predominantly XXXX area of town, and because I am a XXXX XXXX XXXX. Additionally, some of the appraisals came back lower than the original appraisals when I purchased the properties. Now, I know that is a heavy card to play, and I didn't have any real, solid proof of that accusation. Therefore, I only mentioned it in my email to XXXX, and didn't really pursue that piece of the matter any further. XXXX then came back and offered to settle with me to refund {$10000.00} of the {$15000.00} I paid as a deposit on the appraisals. The made me sign a release agreement that would prevent me from taking further legal action against XXXX XXXX, and that I would not disparage them publicly. I signed this agreement because I am a small business, and I didn't want to start a prolonged legal battle that would end up costing me more money in the long-run. And at that point I thought it was over, and I would just take my {$5500.00} loss and move on. Fast forward to XX/XX/2023, the title company sent me an invoice for {$7300.00} for title / abstract work that had been ordered by Lima One Capital for this deal. I then forwarded that invoice and email to XXXX at XXXX. I also called XXXX, and she told me that this was an issue between the lenders and the title company, and that I should not have any liability here. Now today, XX/XX/2023, the title company followed up with us about that invoice. XXXX responded to the title company stating that " that is the risk the title company takes if the loan does not close ''. I saw this email thread was becoming tense, and so I called the title company to ensure that I was not the target of their ire. I don't want to be sued as a result of this matter. And that I do believe that Lima One should pay the title company because they were the group who ordered the title. And it was their faulty business model and processes who had me pay for appraisals before they new with 100 % certainty that they could close the loan. And it was Lima One 's faulty business processes who ordered title prior to knowing with 100 % certainty that they could close the loan. Throughout the email exchanges with the title company, XXXX, the representative from Lima One, has been quiet and non-responsive. The bottom line here is that : I am a consumer who applied for a loan. And as a result of applying for that loan, I lost {$5500.00}, and could potentially be on the hook for another {$7300.00} ... or worse, I might have to retain an attorney and pay much more in legal fees to defend myself if the title company decides to sue us all. How is that right? How is that legal? I have attached most of the emails pertaining to this matter... going back to XX/XX/2023. There is a XXXX limit on attachments, so I could not upload all the documents I have. But can provide at a later time if needed.

This complaint is against XXXX XXXX XXXX XXXX XXXX, South Carolina. This lender financed the purchase of a Buy and Hold Rental investment property I acquired back in XXXX of XX/XX/XXXX They also approved a $ XXXX construction loan for the property. XXXX my down payment of $ XXXX - They rolled both loans into a single note, so I make a XXXX mortgage payment ( principal and interest ) each month. The problem is with the construction loan. 1. Once I got approval for the loans, I asked my loan XXXX and the broker who found this lender several times for the terms and guidelines for draw on the construction loan. No response- which should have been a red flag at the time but I chalked it up to them being busy. I asked a final time just before closing day and the XXXX XXXX XXXX XXXX responded saying " After you close you'll be able to login to your dashboard and get those details ''. After closing, I did what he said and to my surprise I found out the construction loan was actually a Reimbursement Loan. My contractors were waiting for a XX/XX/XXXX % down payment before they could start, I had no money after dropping $ XXXX and a construction loan that seemed worthless. I called and spoke to a representative at XXXX XXXX explaining the bind these terms were putting me in and how much it would delay my project if I had to find money to pay for the work first, then wait for them to re-imburse me. All I got was a recital of their policy and the rep telling me there was nothing he could do. 2. The other problem was they had pre-populated a list of construction line items with amounts they would re-imburse me for them. The numbers were way off and several items didn't seem to account for labor just materials. I called back and spoke to my rep to let her know and she said, " I'll give you one time to change the list but whatever # XXXX you put in you'll have to live with it. '' I asked, but what if we come in under on something or go over the amount allotted? Will I be able to reconcile and move excess cash to other categories. She said no. I pleaded with her to give us the flexibility we needed and allow me to plug in actual cost after the work is done and in the end as long as we didn't go over the $ XXXX there shouldn't be a problem. She said no, " Our policy doesn't allow us to do that. 3. When I tried to get a draw for over $ XXXX - she sent an email saying she could only reimburse for about $ XXXX because what I indicated had been finished was not. This is according to photos sent by an inspector they send to the house each time I request a draw whom they deduct a {$200.00} fee from my loan to pay. I had to get my contractors on a call with her to clear it up and it turns out the bank 's definition of finished differed from my contractors -- yet no where did the bank have in writing what any definitions were. It just seemed to be whatever my rep thought she saw in the pictures and it was apparent during the call she didn't even understand what she was looking at. She agreed to increase the re-imbursement amount by a few thousand dollars but it still was not the full amount. Using consumer credit lines, I purchased cabinets and appliances that were deeply discounted because they fit into the budget designated by XXXX XXXX - only to be told that although they are on site at the property, I can not be re-imbursed until they are installed. Without the full reimbursements, that was more cash I had to find somewhere to keep my contractors going and to pay on the credit lines. 4. I wrote an email and sent to XXXX XXXX managers and my loan XXXX explaining that the terms of this loan are going to cause my project to come to a halt and I pleaded with them to help me by adjusting their policy and releasing the funds. They refused. 5. Then on the next draw request - it happened again - the loan XXXX refused to reimburse me for the amount I requested. This time my construction project did stop because my workers could not continue without payment which was already slow. It became painfully clear to me that this lender was not the real estate partner they advertise. And although I have not missed a payment -- I feel they are trying to set me up to fail so they can take my property. 6. The final straw happened a few days ago, when after I was finally able to get more money to get things moving again - I submitted request for a draw. The inspector came on Thursday. Friday I called XXXX XXXX to ask if they could XXXX me a reimbursement that day because my contractors were willing to work on the weekend if I could send payment for some materials. My loan XXXX recited policy again and said she would get me the reimbursement Monday or Tuesday of the next week. In real estate, time is money and this lender has purposefully cost me time and money again and again. My contractors said they would have been finished in 3 months had the money situation been correct. We are now at the 7 month mark and counting. My project is in limbo because the bank is still holding over half of my construction loan funds ... meanwhile I'm paying principal and interest as if I have all the money -- when I don't. This is grossly unfair for any business calling themselves a lender and partner to ANY customer.

I was approached by a representative for XXXX XXXX after researching the firm found them to be reputable. I was told by the loan broker that I was going to be able to get a 7 % Construction loan that will be able to be refinanced 12 months after loan. The loan amount would be {$100000.00}. A few days before closing a different XXXX XXXX XXXX representative asked if I would like more money back at the closing to start the project and I said that would be great. At the closing table after I planned for this loan and set up contractors with the idea of actually getting money I noticed that the 7 % was really 12 %, my loan was brought up to {$150000.00} but I did n't get any money at closing because I was charged {$25000.00} in fees. The closing rep XXXX XXXX besides leaving a check on the table in my name to make it look like I was getting the check because he put it right in front of my face, he allowed the wrong zip code and said that no changes needed to be made its good do n't worry. So I signed all the paperwork and then he said I will be able to get money once this paperwork goes through. I cancelled the loan immediately after by calling the original loan broker. I told him that this is a hard money loan and has nothing to do with construction. I did not like what was going on. The loan officer said t they will take care of everything and they will get me money right away and that I will have no issues with this loan the 7 % will be for the next loans you do with us and I said no. The loan broker emailed and text me that I would have no issue at all and he wants to get this loan done so we can create a relationship and that he will make sure everything is taken care of. After being assured that I would have no issues and this would be the best way to get money going forward. I was told I was getting money back at closing there was a mistake. I was promised that the inspector is in XXXX 2 days a week and from the inspection request to wire transfer in my bank is 4 day turnaround and I would have no issues at all with getting the money as a draw. The company will pay me for work I have completed. I agreed more because I was desperate than being sold on the loan and also because I was told I was actually getting some money to start this project the next day just come tto the office and a check will be prepared. The check was {$2500.00}. Needless to say I was upset because I had to use more of my own money I did n't have to build this house. I thought that it wold get better from here but it just got worse. I was never given a draw request from company turns out my general budget was the draw request. The budget was a few lines of estimates that mostly included the total house being finished. Therefore unless the entire house was finished I would n't be able to get my money. Thank goodness I had siding and roof and windows by themselves on my budget so I could at least pay the workers for their time. After the windows were finished in the entire house and was able to get some money but the day I was supposed to get money they needed wire instructions. It took 2 weeks to get my first installment of {$19000.00}. It would n't be until a month later that I received some more money. Turns out that when asking for the 2nd draw I was told that closing paperwork needed the correct zip code. Since the zip code was wrong on the closing papers they will mail the paperwork to me and I need to get it back to them. This was on the day the wire was supposed to be in my bank. I drove to the office that I closed after fixing the zip code on closing paperwork and that office was not there anymore. That New Jersey Lima office was closed permanently and after calling the office and speaking to the rep. The same rep that told me my check was in the office she told me that she thought I was bringing check to South Carolina office. At this time I knew it was a scam. I called the office they allowed me to change my budget to make it more suitable but more of the same nonsense. I was given total of {$49000.00} in 2 draws that took over 2 months, I have paid close to {$40000.00} in fees because I am being charged {$1600.00} a month interest only and also I am being charged {$150.00} inspection fees and wire transfer fees. The situation is a terrible mess and I have all of my records including emails, texts and notes on phone calls. I have 2 XXXX XXXX I am a XXXX XXXX and XXXX and I can not let this company do this to someone else. Lima One Capital made misrepresentations relating to the loan, the term, the ease with which it could be extended as well as how the disbursement of the holdback funds we paid for repairs would work. Lima One Capital has also obstructed our ability to obtain a payoff demand and has grossly inflated the fees that we owe them .We are very disappointed in our experience with Lima One Capital and feel they have a sole focus on foreclosing on our home since the value has significantly increased since we completed the repairs. We took out a private rehab loan when we purchased this property and we bent over backwards trying to work with them but feel that Lima One Capital put up artificial requirements in order to force us into foreclosure. We bought the property in XX/XX/XXXX and were aware of the term, rate and payment for this loan. What was NOT disclosed was how the disbursement of our funds we had put into the holdback account would work. This was OUR money that we gave to Lima in CASH to use to repair the property. However, Lima made us pay for the work out of pocket, then supply invoice and receipt of the work completed and then there would be an inspection that Lima charged US for every time there was a repair. Because of Covid we would sometime have to wait weeks if not months to get an inspector out and then to get your company to sign off. This was burdensome and difficult, because we had financial difficulties due to the pandemic and had to pay the mortgage payment and front the cost of these repairs which dragged out due to Covid. The loan agreement does not include any of these guidelines or hurdles, it simply states that we need to make a written request for the funds and that the lender will verify it. As a result we could not get the repairs completed when the loan matured and Lima agents told us they would work with us because Covid was so unexpected. We were granted a loan modification extension in XX/XX/XXXX and then again in XX/XX/XXXX. We had completed the repairs in early XXXX and started working with conventional lenders to try and refinance out of the loan. We also were being told by your agents that we could get another extension. We were close to closing on a loan and asked Lima to give us more time and they stated they required a letter of intent from the potential lender in order to offer us another extension. The lender was in the process of underwriting our file and did not want to commit in writing to Lima One that this was a done deal, so Lima One used this artificial and fabricated guideline against us. We had never missed a payment for two years and the property had been rehabbed and we were in active review for conventional loans, but when we tried to make the XXXX payment on the loan Lima One rejected the payment and put us into default. Once we went into default status it was not possible to obtain conventional financing and things went from bad to worse. Lima One would not accept our payments and they initiated foreclosure proceedings against us. We got new lender but the payoff demand we received in XXXX was grossly inflated. We had an escrow disbursement of $ XXXX plus at origination to pay for property taxes and insurance, but somehow we now had a tax bill of {$20000.00} and would like to verify this payment and cost. We also question the force placed insurance because we had property insurance the entire time and there was no need for Lima to force place insurance at a cost of {$3400.00}. We would like documented evidence that our insurance had lapsed and that Lima was " forced '' to insure the property because we did not have an active policy. We also question the {$5800.00} extension settlement fee, this should have been {$2000.00} per our conversations with agents and it looks like you padded on additional costs and junk fees at our expense. We also question the amount of interest charged. The reason for our default was due to the disaster declaration from Covid and this qualifies as a force majeure.

We closed on this loan in XX/XX/2018 with Lima One. - The interest rate was raised by 1 % right before closing. I never received information regarding this matter. The only reason I even knew about it was because my title company all of a sudden got new documents from Lima One with a higher interest rate than the original documents right before we were set to close. My title company was concerned during the entire process about how the mortgage company was handling this closing and saw several red flags. I asked the broker what happened with the interest rate he said he didn't know and there wasn't anything I could do about it and I would be receiving information about it from Lima One, which I never did. - In XX/XX/2018 I was informed my insurance had been changed and didn't meet Lima One 's requirements. Which is not the case. When we were about to close in XX/XX/XXXX the underwriter told me and my insurance agent that all the properties needed changed to meet Lima One 's guidelines. So it wasn't until my insurance company changed everything and documented all of that information to meet Lima One 's guidelines that we were able to close. One of the properties did have a miss-understanding because Lima One assumed it was one insurance when in fact because there are 2 separate roofs/houses on one lot it was actually 2 separate insurances. - In XX/XX/2018 because of the insurance questions Lima One decided not to pay the escrowed insurance on 2 of my properties that were due, nor did they put forced insurance on my properties. Lima One just didn't pay the insurance on 2 of the escrowed properties. Which meant the insurance on 2 of my properties lapsed and the houses were not covered. Even though I have made all my payments including my escrow to Lima One they decided not to pay it. The proper way this is handled is through an escrow analysis and increases to my payment or one large payment to make up the difference if there is a discrepancy. Or forced insurance coverage. Not paying my insurance not only put my investments at risk but also Lima One 's investment at risk. So I paid the insurances on my own ( double paid ) so they would go back into effect and I received penalties I had to pay because of it. - In XX/XX/2018 I got flood notification 's from Lima One that all of my properties with them were in flood plains. And stating I needed flood insurance for all my properties. There are no flood plains were any of my properties are located. - Both my title company and insurance agent had many difficulties working with Lima One and had issues throughout the entire closing process and beyond. Due to the issues and miss-handling of my loan I do not trust keeping my properties at risk with Lima One. I am refinancing them and have asked Lima One to waive or at least reduce the pre-payment penalty due to their neglect with my loan and my need to look out for my business and refinance with a more reputable company. They have stated the contract says I must pay the 5 % pre-payment penalty and they will not waive it. I have also let them know that the contract also stated that my properties had to be escrowed and Lima One is to pay my escrow. And they did not live up to their end of the contract either by deciding not to pay my insurance.

On XX/XX/2023, I contacted the mortgage company to arrange payment arrangements for my mortgage payment that was due on XX/XX/2023. I was told by the lender, Lima One, that I could not make the payment because the loan was sent to a lawyer on XX/XX/2023 ( 3 days before my request ). I was told by Lima One that I had to contact the lawyer for a reinstatement quote. My mortgage payment was due for XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX in the amount of {$660.00} per month. I immediately contacted the lawyer hired by Lima One to request a reinstatement quote for which they told me would take up to 7 days to send to me because they had to get the amounts from the lender. The lawyer provided me a reinstatement quote on XX/XX/2023 of {$10000.00} to save my property. I sent emails questioning how they arrived at an amount of over 5 times the amount I was expecting to pay. The lawyer just gave a broad explanation of fees but no explanation on how they arrived at the numbers. Lima One refused to talk to me to explain anything. I requested another reinstatement quote on XX/XX/2023 as I was preparing to just pay the money because I did not want to lose the property. I requested the quote on that day because as I was previously told, it takes time to get the quote from the lender and the quote is only good for one week. The lawyer sent another reinstatement quote on the very next day, XX/XX/2023 and the quote for {$12000.00}, was only good for one week but my funds was not getting deposited until XX/XX/2023. Again, I questioned the fees and how they were being calculated. The lawyer did not explain how the interest or the fees are being calculated. On XX/XX/2023, I requested another quote so I could pay since the funds were secured in my account. I called the lawyer every other day trying to get a quote so I could pay and to avoid any further action. The lawyer informed me that they were still preparing the quote but in the process, they filed court documents to sell the house. The lawyer did not send the quote until XX/XX/2023 in the amount of {$17000.00}. When I spoke with a lawyer, they said the fees seemed very excessive. I am so confused, if the goal is to help save the house, it seems as if the lender and the lawyer is doing everything to make it impossible for me to pay. The amount of the delinquency just for the mortgage payment is only {$4700.00}. Can you please help??

In XX/XX/XXXX my business closed on a mortgage loan with lender Lima One Capital ( https : //limaone.com ) for 2 investment properties. It's unfathomable for a lending institution, but since Day 1 our online " Customer Portal '' has never shown our monthly statements. As a result we have never known how our payments are being broken down or if they are even being applied correctly toward principal, interest, and escrow. There has always been a link that says " Bill History '' but no bills. Only recently the Bill History began showing 3 documents, currently dated XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX, but each of those links to the statement dated XX/XX/XXXX. ( Also I am writing this on XX/XX/XXXX, so how could there even be a document dated XX/XX/XXXX? ) I have many accounts with many different institutions, banks, credit cards, utilities, etc and never have I been unable to view any monthly statements online. It should be something any customer has access to. I contacted the company numerous times in the past asking when this would be fixed but was never given an answer. I was actually told by someone from Lima One that if I wanted a statement I had to contact them every time, which is ludicrous. We should be receiving our monthly statements automatically, without having to ask. I then requested that someone from Lima One create a manual task to email us our statement every month, since this is their mistake, but of course this has not happened. I do not know if this is a companywide issue with Lima One, or simply with our account, but it's frankly unbelievable. We simply want to be able to view our monthly statements. We want this fixed. We also want PDFs of ALL of our past monthly statements.

Through my XXXX, XXXX DE XXXX, i entered into a loan agreement with Lima One Capital for {>= $1,000,000} subject to certain terms and conditions. Lima One provided and we signed a term sheet that included details on the loan including ; term, amount, interest rate, and prepayment penalties. I was also informed verbally that i could prepay up to 20 % of the loan each year without penalty, this was later confirmed after the loan closed via email. The loan documents provided to me incorrectly detailed the prepayment penalty and omitted the 20 % paydown feature. I raised the issue with the legal department who admitted to the mistake and agreed to change the prepayment penalty terms but not to honor the 20 % paydown feature. Also since Lima One has contractor XXXX to handle the loan servicing, Lima One through its servicer ( XXXX ), has not honored their obligation to service the escrow account. They have not paid taxes on time nor insurance, which has resulted in late penalties with the cities as well as affecting my other business endeavors within those cities, as i am considered a delinquent tax entity. They have also allowed insurance policies to lapse because of non-payment even though my agent and i have provided them with 2 months advance notice of pending renewals. I have attempted to resolve these issues with both Lima and XXXX but if i am able to reach a representative i receive apologizes and confusion, but no resolution.

On XX/XX/2019 I closed on a hard money loan with Lima One Capital for around $ XXXX. I was told they were charging me 10.5 % with 2.5 % in points. The closing date was the first time I saw the HUD statement. I believe the law states I should see it three days before closing. When I saw the document at closing, I could not determine what rates I was receiving and it would have been difficult to back out of the deal at this time. They ended up charging me 11.5 % interest and 3.5 % in points. This resulted in approximately {$3500.00} additional dollars I paid to them over about 10 months. I brought this issue to the attention to my sales rep and he denied there was an issue at first. Then I showed him the emails of the rates he promised me, and he admitted that a mistake was made. In fact, the underwriter did not include a $ XXXX wholesaler charge which made the loan appear to be less than $ XXXX and qualify for these higher rates. In fact, it was over $ XXXX and I should have been given the rates that were given to me over email. I have tried filing a XXXX complaint and talked to the company directly, and their attitude is very unhelfpul. It's a shame because I wouldn't mind doing business w/ them again, but it's difficult when they act this way.

Lender/ Serving Department of loan is not providing mortgage statements since XX/XX/2021 and their representative is constantly giving incorrect information. After emailing more than 20 times and trying to call over the last 3 months I am still getting nowhere with the lender. 1. My payment for XXXX and XX/XX/2021 is showing no payment due in the lender system. 2. I can not access my XX/XX/2021 and XX/XX/2021 mortgage statements. 3. I reached out to the lender to get information about my loan balance for no additional information was provided other than showing in the system. 4. On XX/XX/2021, I received an email from the lender that I have no payment due for XXXX. 5. On XX/XX/XXXX I received an email from the lender stating my first payment was due XX/XX/XXXX from the same representative. 6. No-One is calling me back or the lender repentative declined to connect to their manager or supervisor.

I sold my house and repaid the mortgage ( mortgage holder Lima One Capital , LLC ). During the closing process the lender was over paid by the closing company. The closing was XX/XX/2020 and the lender acknowledges receiving the funds wired by the closing company on XX/XX/2020. The lender also acknowledges the money that I'm owed but can not /will confirm when they will refund monies owed to me. I was told " We have many other loans and customers and can't say when they'll be able to send me my refund. '' The originally said that a check would be sent 30 days after close. Then they said they already mailed the check. Today they ( Mr. XXXX XXXX XXXX said " We have many other loans and customers and can't say when they'll be able to send me my refund. ''

Lima One keeps paying my insurance even though it has already been paid. The insurance company refuses payment and then the cycle starts all over again. I've explained this to them multiple times. Today, after going back and forth with their Portfolio Analyst, when I told them to not send the payment again because the insurance has already been paid and they need to credit my escrow, they stopped communicating with me. It's a simple process that they don't seem to understand. We've probably gone back and forth on this for over a month and I can't count how many emails and two phone calls. I have two mortgages with them and this occurred on both mortgages.

I got an alleged loan through Lima One Capital. The total loan was for {$100000.00}. They only gave me {$12000.00}. They kept the rest. They are trying to foreclose on my home. I need help from the CFPB to protect myself from Lima One Capital because I've been a victim of predatory lending. Lima refused to provide me with a mortgage because it saw an XXXX XXXX on XXXX. My personal background is absolutely clear and I work in the financial industry. They discriminated against me because they said people like me should not get more loans and they can deny any one a loan based on their choices and if I want to sue I can do so. They dont care

They gave me a loan for {$100000.00}. They kept {$46000.00} in escrow. They are taking me to court for for {$100000.00}. When it was all said and done I only received {$12000.00}. They are trying to foreclose on my house when they never gave me the the full loan. In short, they still owe me {$46000.00}
