XXXX XXXX XXXX has been the sole owner of record since XXXX. In XXXX, XXXX, took a 5-year owner occupied, residential loan against the above referenced property that was later modified and continued until XXXX. In XXXX, the loan was called due after 10 years of payments. The lender passed away and the daughter came onto The Ranch and noted she would at once call the balloon payment due. The property went into immediate default, then Trustee Sale. XXXX was put into duress and forced to quickly find a new investor/lender to clear the existing debt and any liens against the property. Further complicating the duress, XXXX is the sole legal guardian and XXXX of her sister, who is in a XXXX state that requires around the clock XXXX care. Beginning in XXXX of XXXX, XXXX at once began looking for a way to pay off the existing loan and for funds to improve the property to increase the revenues from short term rentals. While under heavy duress, she found XXXX, XXXX who subsequently signed a borrower/broker agreement to secure the lender to clear the existing loan and liens against the property, and to provide XXXX with funds for a residential loan and any liens. XXXX, XXXX opened escrow with XXXX XXXX XXXX initially on XX/XX/XXXX. At that time, XXXX was furnished with loan documents and all subsequent agreements and paperwork to secure a residential loan for {$610000.00} secured by the above referenced real estate parcels which included an executed Balloon payment document in the docs for {$610000.00}. She was also provided an estimated closing statement that showed all of the fees and liens to be paid off with the funds, which was inaccurate. Mr.XXXX agreed too, 6 months of loan payments and the {$32000.00} for the shade structure as XXXX had a set of engineered plans and a job card that she had been performing on to finalize the County of XXXX lien and that it would be paid for in the loan proceeds minus escrow, closing cost and fees. On XX/XX/XXXX, XXXX executed a complete set of loan documents and agreements that were dated on XX/XX/XXXX, with XXXX, XXXX acting as the mortgage loan broker. On XX/XX/XXXX, she executed another set of loan documents in the amount of {$610000.00} with a signed and executed balloon payment in the amount of {$610000.00} with the escrow and title insurance company, XXXX XXXX XXXX. She was told by XXXX , XXXX to give a mailing address and it had to be a resident home address for MAILING. XXXX signed all loan docs, which was a Commercial loan with a non-owner occupied. She was under heavy duress and did not read the paperwork since there was a pressured Trustee Sale the very next day from the last lender. The Escrow Officer, XXXX XXXX, was also pressured, raged at, and confused as she notarized the document at the last minute- as XXXX , XXXX threatened that they will not do the loan and XXXX would lose the property the next morning, unless they signed it and got it immediately in the Federal Express . XX/XX/XXXX XXXX was called into the office of XXXX XXXX and Escrow to sign more paperwork, completely confused what was going on, still signing stacks of unread documents pressured by the imminent doom Trustee Sale date that had been moved again and set for the next morning. XXXX was told to date XXXX on a document called a Mortgage Loan Disclosure Statement, for their records. At that point, totally confused and believing it was a residential loan, which XXXX later learned was pressured fraud that would equal the cool off period. On XX/XX/XXXX, the day before her original loan of approximately 10 years the Trustee Sale date was moved to the next morning again, DURESS she was called into XXXX XXXX XXXX to close on the funds provided by XXXX, XXXX XXXX was not present. XXXX XXXX the Escrow Officer called XXXX when the final close happened. XXXX was NOT told who the lender was, was NOT furnished a closing statement breaking down of all charges and fees and was told that all would be signed off and mailed to her. XXXX XXXX retired immediately afterwards and expressed that the loan was the worst closing she had ever experienced in 38 years of banking escrow and title. And said she would be available if there was ever an issue, which she very strongly knew there would be. On XX/XX/XXXX XXXX received a phone call from XXXX XXXX, He stated he was the lender and the payment was late, and he would break XXXX legs and burn the house to the ground. XXXX was immersed into a trial proceeding concerning the torturous abuse of her sister XXXX, whom was trapped in a XXXX facility, under a HUGE amount of stress trying to save her sister. In XXXX of XXXX, XXXX received a phone call from Superior Loan Servicing, insisting that the payment was due for the mortgage in XXXX. XXXX explained that she had never received the closing papers, never been told who her lenders were, never told the final loan amount, and never told where to remit payments to. Subsequently, she finally received a statement from Superior Loan Servicing demanding a payment of approximately {$5000.00}, which XXXX did remit payment for at that time. In XXXX of XXXX, XXXX received another statement from Superior Loan Servicing. At that time, XXXX was extremely confused and still under heavy duress, and could not understand the statement and paperwork being provided by Superior Loan Servicing. Further, the new statement did NOT show any record of her first payment of {$5000.00}. XXXX called to ask questions, but no further explanations were given besides payment is due and perhaps she was too XXXX to figure out the statements quote by XXXX XXXX, who also said it was a Commercial Loan. XXXX expressed she got a Residential loan for {$610000.00} on XX/XX/XXXX, and she lived at the property as her primary residence. It was agreed that 6 payments would be held back to pay for the payments so she could increase her credit and refinance. XXXX was not receiving any mail. Further, threats were made to XXXX, that you should know better than to XXXX with us. In XXXX of XXXX, XXXX received notice of default after she decided not to pay XXXX invoice because no proper accounting, closing paperwork, promissory note, or even final loan amount was ever disclosed to her. She questioned them about the missing paperwork, and how and why they were able to place the property in default so quickly. She subsequently pulled the property profile from the County Recorders and saw that an alternate version of the paperwork she had actually signed had been recorded with the county, dated and executed on XX/XX/XXXX. Upon further review, she realized that the paperwork recorded reflected a loan amount of {$490000.00} when all previous and documented paperwork showed a final loan amount of {$610000.00}. Further, she noticed that the original paperwork had been altered and replaced with documents that showed a {$490000.00} loan amount and a forged copy of her signature. In XXXX of XXXX under heavy duress, XXXX decided to pay off the default to prevent foreclosure. She subsequently spoke with the company and reports that she was kind and congenial to everyone and immediately began to look for other investors and lenders to take out and resolve the confusion and issues. XXXX reports her correspondence was light-handed since she won the trial of her sister, and XXXX returned home in the worst condition ever. She reported her sisters condition and her own hardship to Superior Loan Servicing by phone and was ignored. She requested to meet with the lenders in order to stabilize with a resolve, to no avail. There were escrows opened for new lenders to come in and take out the loan. Numerous requests for payoffs all were untimely. The market was at an all-time low, the property is over-improved XXXX manufactured houses, and the new loan offers were 12 % in 24 months. XXXX was told that she would need to pay approximately {$27000.00} to remedy the default. In XXXX of XXXX, XXXX remitted the payment to Superior Loan Servicing to remedy the default. No further information was provided, and no statement accurately showed the application of the {$27000.00} payment made. XXXX paid {$7800.00} and the money was taken and held instead of paying a payment. She never knew who her lenders were until the first default was found at the PO Box mailing address, in which was a false document- there was one payoff demand that had two DocuSign signatures of so-called lenders. XXXX requested on numerous occasions for approximately {$3300.00} forced placed insurance from Superior Loan Servicing and never received a copy of any invoices. On XX/XX/XXXX, a second notice of default was filed and served with an immediate payment due for {$34000.00} to remedy the default. Further penalties and fees were applied and approximately {$570000.00} was now due on the so-called original {$490000.00} loan that was originated on XX/XX/XXXX, in which only a {$610000.00} loan was originated on XX/XX/XXXX. On XX/XX/XXXX, XXXX filed Chapter XXXX bankruptcy to prevent the Trustees sale scheduled the following day on XX/XX/XXXX. The judge provided automatic stay and the next scheduled court date is XX/XX/XXXX. Superior Loan Servicing continues to post the Trustee Sale during an automatic stay, which was causing an interruption of her right to peace and quiet, causing catastrophic stress on the takeover from a fraudulent loan in which the lenders feel that they must take the property in order to cause huge attorney fees and the impossible rescission of a stolen property. In Summary : This is a very sophisticated fraud and forgery that involved a bait and switch where one set of documents was presented with a loan amount of {$610000.00} and instead a closing took place under heavy duress that XXXX found out later was only for {$490000.00} which was not enough to be an effective solution. Further, it appeared to her as though all of the loan documents that showed the {$490000.00} had been altered after the fact using the previous set of documents requesting the {$610000.00} loan amount. Further still, a county lien against the property for {$32000.00} was never cleared at the closing and title is still clouded. Allegations being made : 1. Fraud in the concealment and inducement 2. Forgery 3. Defective contract under duress which XXXX did not qualify to afford. 4. Violations of RESPA. 5 Violations of TILA. 6. Lack of standing to foreclose 7. Overcollateralizing the loan so no financial remedy exists. 8. Intentional infliction of emotional duress. 9. Breach of fiduciary duty 10. Breach of contract 11. Slander of title 12. Real party in interest and validity of lien ; to value collateral and determine lien principal and multiple other charges 13. Violation of California Business and Professions code sections 17200 ET SEQ 14. Violation of California Homeowners Bill of Rights HBOR 15. Violations of California Civil Code 2923.5 16. Negligence 17. Intentional infliction of emotional distress Relief being sought : 1. Rescission of the current loan 2. Quiet title 3. Declaratory relief 4. Compensatory and punitive damages Potential Courses of Action : 1. A temporary Injunction and Restraining Order to prevent any further sales or notices of sale being delivered to or recorded against the property. 2. XXXX to file a Lis Pendens to protect the {>= $1,000,000} plus she put into improving the property 3. File a lawsuit in Federal Court for Jury Trial against all parties and move the current chapter XXXX case to a chapter XXXX to continue the automatic stay and buy time to work out a solution.

I paid off a loan with Superior Loan Servicing and they withheld over $ XXXX for interest from another loan on a different property address that has nothing to do with this loan. I have been emailing them since XX/XX/XXXX and they will not respond back to me. They said my loan is closed and all I can do is email them to resolve this. They don't have a phone number to talk with them. When I call the company Im on hold for over 30 min and then leave my number. I left my number 5 times and they finally returned my call once. When I do get them, they say they can't help me, that all I can do is email them ( XXXX ) and I have sent several emails and they have been ignoring my emails. They charged over {$520.00} ( need to see final breakdown for exact amount ) in closing fees just to pay off the loan. I believe these are excessive. There was a forwarding fee of {$160.00} which they say was for processing ; however, they charged an additional {$360.00} + for processing the paperwork. Again, they couldnt explain what that fee was for on the phone. They said I have to email the request in. They also charged a {$75.00} rush fee when they didn't rush the payoff. I had asked to pay the loan off on XX/XX/XXXX so when I did receive the payoff it was for XX/XX/XXXX ; however, they didn't send that payoff to me until XX/XX/XXXX ( 4 days later ) so that was not a rush as they did not honor that payoff because they charged interest for the 4 extra days plus the {$75.00} rush fee. All I could do was to send in extra money as they didn't give me the payout breakdown for XX/XX/XXXX, I wanted to make sure everything was covered and so I wouldnt be charged more fees. When they sent the check refund they did not include a breakdown of the charges. All I had received was the incorrect payoff, and the check amount does not match with the payoff they sent me. I need the true breakdown for taxes and to find out what extra charges they added. They have not yet sent it to me despite all my emails to them. They kept {$190000.00} on a {$190000.00} loan. I had sent an excess amount in order to make sure they didnt charge any more fees. I wired in {$190000.00}. They only returned {$330.00}. Fees themselves of $ XXXX ( need final breakdown to get exact fees ). I called in when I got the check and she said the loan is closed and I have to email the " demand '' dept. I cant even talk with the people who are providing the charges. When I bought the property they charged excessive fees then, too. They kept adding endorsements to the closing and kept stalling and ended up causing my closing fees to be {$20000.00} and XXXX pages of several guarantees and redundant paperwork, which seems excessive. I didnt get all this information until the closing so it was either sign the paperwork or lose the deposit and property. I finally received a very brief reply this morning after my XXXX request. They said The demand was requested within 24 hours which is why the rush fee applies as the turn time is 3-4 business days. My email request was sent on Wed, XX/XX/XXXX at XXXX XXXX and requested payoff for XX/XX/XXXX. I received a payoff for XX/XX/XXXX on XX/XX/XXXX at XXXX XXXX so the 24-hour request did not happen. I received the payoff in their normal turn time of 3-4 business days. Besides, they should have honored that price on XX/XX/XXXX if they sent it on XX/XX/XXXX! They then said The other fees you are referring to are in regards to release of the liens on your property and are non-negotiable. I had asked for explanation of fees as they seemed the closing fees are $ XXXX ( need final breakdown to get exact fees ). I expect to get an explanation of fees I pay for! And they said the fees for the other property is in review. They did not send the breakdown and they did not address the XXXX questions I had. They expect me to trust them that their fees are fair. I do not trust them after all the fees they have collected on this loan. I do not believe them to be fair. I also believe I have the right to have the fees explained. I will attach the HUD from the purchase closing to show the closing fees of {$20000.00} and the payoff for XX/XX/XXXX. I wont be able to attach the loan package as that is XXXX pages and over the amount allowed to send in. Let me know if you need any other information.

I am writing to request correction of the error described below in regard to the mortgage on my client 's property at XXXX XXXX XXXX XXXX XXXX XXXX XXXX An improper balloon charge for the above-referenced loan has been assessed under a {$300000.00} " Promissory Note Secured by Deed of Trust '' ( the " Note '' ) dated XX/XX/2020. The paragraph of the Note named " Balloon late charge states, " In addition, if any balloon payment is delinquent more than XXXX days, the borrower will be charged {$30000.00} as liquidated damages. '' The lender incorrectly assessed a {$30000.00} balloon payment in its demand payoff. I sent a error resolution request to the lender, and it failed to respond. I also have submitted a complaint to the California Department of Real Estate, and it failed to respond. 1. The Note represents a " Higher Priced Mortgage Loan '' The Note represents a balloon payment loan and is subject to California 's Civil Code Section 2924i ( d ) ( 1 ), which defines a defines a " balloon payment loan '' to include a loan " which provides for a final payment as originally scheduled which is more than twice the amount of any of the immediately preceding six regularly scheduled payments ... '' The amount of each scheduled monthly payment was {$2500.00}, and the principal payment due upon termination of the loan was {$300000.00}, according to a letter from the lender. 2. The amount of the balloon payment charge exceeds the amount of liquidated damages allowed to be collected under California law. Under Section 10242.5 ( c ) of the California Business and Professions Code, a late payment charge for a balloon payment " shall not exceed an amount equal to the maximum late charge that could have been assessed with respect to the largest single monthly installment previously due, other than the balloon payment, multiplied by the sum of one plus the number of months occurring since the late payment charge. '' 3.Even if it were incorrectly assumed that the balloon payment was of a permissible amount, Superior Loan Servicing failed to comply with the notice requirements set forth in California Civil Code Section 2924i. That law requires : At least 90 days but not more than 150 days prior to the due date of the final payment on a loan that is subject to this section, the holder of the loan shall deliver or mail by first-class mail, with a certificate of mailing obtained from the United States Postal Service , to the trustor, or his or her successor in interest, at the last known address of that person, a written notice which shall include all of the following : ( 1 ) A statement of the name and address of the person to whom the final payment is required to be paid. ( 2 ) The date on or before which the final payment is required to be paid. ( 3 ) The amount of the final payment, or if the exact amount is unknown, a good faith estimate of the amount thereof, including unpaid principal, interest and any other charges, such amount to be determined assuming timely payment in full of all scheduled installments coming due between the date the notice is prepared and the date when the final payment is due. Please respond to XXXX, the attorney for XXXX XXXX XXXX.

Before signing the loan documents with XXXX XXXX XXXX , XXXX License # : XXXX, Owner XXXX XXXX , I contacted Superior Loan Servicing representative named Ms. XXXX who clarified my questions ; Manager is XXXX XXXX . Among the questions Ms. XXXX clarified ( see notes on Loan Terms ), I asked about the Default Interest of 17.50 %. She made it clear that that interest charge would only be due if a legal Notice of Default is filed. Upon closing, they padded the final seller 's statement. In addition to th e Interest of {$2800.00}, that added another interest line item for an inflated amount of {$15000.00} ; equivalent to 17.50 %. This doubles the amount that is due at closing. They misrepresented this charge as regular interest when it was the value of the Default Interest. I was never in default, nor did I ever receive a notice of default, nor was a legal Notice of Default ever filed. When I asked about this payment, they said it was default interest, but I never received a default notice and the itemized line item does not specify exactly what the charge is for. I only received multiple harassing phone calls and emails from both the servicer at Superior Loan Servicing and the mortgage loan originator XXXX XXXX stating that I was in default when I was not. I was under duress because XXXX XXXX and the Servicer constantly called me, threatening that they will take my house in foreclosure. He sent emails that presented coercive terms where he had investors who would pay off the loan I owed him, but that they would take the house. He just kept saying otherwise sue him, but I couldn't afford the attorney. I told them that their contract requires a notice of default which I never received because I was not in default. Plus, both the mortgage loan originator and the servicer knew I was waiting for my investor to buy the house and that the short-term private mortgage was needed until I found an investor to help me renovate. Which happened without being in default. I did pay agreed-upon late payments, but I was never in default. Therefor e, the Originator, by harassing me and claiming I was in default was in breach of contract. I sent several certified letters to the Originator. One he responded to, the other he completely ignored. The Servicer also received certified letters but pointed the finger at the originator. However, it is the servicer that reported the accounting to the XXXX Title Company 's Final Seller 's Statement, and therefore, responsible for the illegal padding. This was my family home, and after the tenants destroyed it and after the squatter recked it ( police used guns to get them out ), I had no choice but to figure out how to renovate it and bring it to market value. If you review the contract, this interest amount is fraudulent and at best, I would consider it padding.

My loan is with Superior Loan Servicing. I fell behind my payments and made contact immediately with them. I applied for a loan modification but never was I appointed some one or a single point of contact to discuss my petition for assistance, I was just told my application was declined but no reason why. I now borrowed the money in order to catch up but the lender or servicing company, SLS, is charging me an additional {$7000.00} dollars and the interest because I fell behind my payment went from 9.990 % to 17.990 %, increasing my payment from {$3000.00} to {$5300.00}. Now that the money I borrowed does not cover the excessive fees and charges I contacted the California Mortgage Relief, submitted my application, but I got an email from the program stating that my mortgage servicer is not currently participating in this program. that under current program guidelines they can not continue to process of my application if the servicer is not participating. My application is on a " on hold '' status for 30 days. If the servicer joins the program before the end of that period, they will update and reopen my application for review. I feel this is predatory lending by SLS and their only interest is to auction my property. This is a matter of extreme importance to me, I do not want to lose my home and be homeless. I was already a victim of predatory lending when I purchased the property, as the loan officer initially asked me for a low down payment but ended up paying XXXX dollars as a down payment and had to borrow money from the agent in order to close my purchase. This is the reason I have no other savings or resources to pay my mortgage and fell behind my payment as of XXXX of this year. Thank you for your collaboration.

I have been doing everything possible to keep this home that I have had for many years over my kids head but was not able to makes ends meet. I was told I could take out a loan on my home to help build my business and I took the opportunity as my kids are the most important thing in my life. I found this company after dealing with 1 other reputable company that told me I was able to qualify for XXXX at 11.50 % term was 48 months first position, as I was told I had to pay off my 5 % first in order to qualify and it is due on to be paid in full on XX/XX/22. I have missed one payment and they are telling me they are filing a notice of default and increasing the interest rate to above 17 %. I have attached the notice. I was also told before loan docs were sent out that I need to set the loan up as a rental property. So I needed to give an alternate address so they can foreclose on me quicker if I become in default. I am very worried about what is going to happen to me and my XXXX boys during the holidays so I would greatly appreciate any advice I can get.

I have been asking for a payoff demand and I did receive them. However the payoff demands are for XXXX and for XXXX and the month of XXXX the payoff demand is higher than the payoff amount in XXXX. I have been approved for a loan and are waiting on the updated payoff demand since XX/XX/ that was requested via fax and email and we are yet to receive the payoff demand. Escrow is unable to move forward with anything without the payoff demand. I have a trustee sale date of XX/XX/ which is why we call and email daily asking for a payoff demand and we are yet to receive it. I believe the lender and the servicer are purposely holding my payoff demand. I frankly believe they are wanting to foreclose on my property without giving me a chance to pay them off in full. All I need now is my payoff demand and an additional 15 days to closed escrow properly. I am asking that the trustee sale date is postponed for 15 weekdays to ensure everything is done properly since providing a payoff demand has delayed this long.

On XX/XX/XXXX setup to run payroll with Wave Financial ( waveapps.com ) and entered all banking information required for a direct deposit to one of our employees. The direct deposit was supposed to be completed by XX/XX/XXXX. On XX/XX/XXXX, received an email stating Payroll error and while chatting with their representative asked me to re-enter info. I explained the info entered before is 100 % accurate and how re-entering is going to help. Representative told me, that is the only way to see if it works and it will take 1 business day for success or 5 business days for a failure. This is not acceptable as the employee do not get any salary and my company money is further locked for 5 more business days. Also, they do not have any mechanism to do a test direct deposit to verify their system works. This should be investigated.

I tried to schedule ACH and they said we need to wait for your ACH clear untill you schedule ACH. that was never communicated to me earlier I have taken loan to pay off the loan. they asked me I have to send wire to close.and we will send you a payoff statement after that you can pay us it will happen on XX/XX/XXXX and this conversation is on XX/XX/XXXX. the reason they dont want to accept money for ach because 1. I tranferred too much money 2. They are not certified Finally I asked for the wire details they just deducted around {$100.00} fees for the XXXX knows what but never sent me wire details

Superior Loan Servicing is the servicing company for my loan. The lender, XXXX XXXX, was matched with me through my loan officer. The lender hired Superior Loan Servicing to handle my loan. The lender contacts me via text messages, email and phone calls unbearably. He is rude to me, embarrasses me, harasses me, threatens me and is very annoying. I had a fire on my property and my insurance sent the repair money to me and the mortgage company. The lender is micromanaging me and harassing me during the repair process. He threatens me with timelines and I dont know how legal his behavior is, but I know its not professional.

I called to pay my mortgage for the XX/XX/XXXX payment with one of Superior Loan Servicing representatives on XX/XX/XXXX, which was a XXXX. They stated they do not process same day payments in their office, therefore the XXXX payment was processed and debited out of my account on XX/XX/XXXX. XXXX states the Mortgage is considered paid when it is received. Thus, my payment should not have any 30 day late payments for my mortgage history. This is crucial to my refinance efforts for this mortgage. Please correct the payment history to show 0x30 days for the entire life of the loan.
