I hope this letter finds you well. I am writing to request your assistance in investigating a series of unlawful actions perpetrated by the entities mentioned in the matter described below. The events detailed herein involve violation of consumer protection laws and the disregard for proper debt collection practices along with civil right violations. I believe that an investigation by your agency is necessary to address these violations and protect the rights of consumers. The circumstances surrounding the case involve multiple parties, namely XXXX XXXX XXXX, XXXX XXXX, and Lien Enforcement Inc. I will provide a chronological overview of the events that have transpired to illustrate the severity of the situation. XXXX XXXX XXXX towed my vehicle from my designated parking spot in the XXXX XXXX parking lot without my knowledge or consent. This happened while I was out of town caring for a sick relative. It was only several weeks later that I discovered my car had been sold by the defendants when I arrived back home, which shocked my conscience. In addition, Lien Enforcement Inc unlawfully collected funds from me, using threatening tactics and falsely claiming legal consequences and damage to my credit if I did not comply. Despite notifying them of my attorney representation, they continued to make direct contact with me in violation of the RFDCPA ( Rosenthal Fair Debt Collection Practices Act ). The entities above sold my vehicle without my consent leaving me without transportation as of the date of this letter. The timeline of events leading up to this complaint is as follows : On XX/XX/2022, I took a flight from XXXX XXXX to XXXX and returned on XX/XX/2022, to attend to a sick relative. On XX/XX/2022, Woodchase Apartments sent a notice via email regarding garage maintenance, requesting information about vehicles that would remain in the garage during XXXX and XXXX. I promptly responded to this notice, providing the necessary details about my vehicle 's location and the fact that I would be out of town because I was already out of town when the email was sent. Despite sending a follow-up email on XX/XX/2022, I received no response from XXXX XXXX XXXX On XX/XX/2022, upon my return to California for a brief period before my next trip, I discovered that my car was missing. After contacting the XXXX XXXX Police Department, I learned that All XXXX XXXX had towed my vehicle. I immediately informed Woodchase Apartments of the situation, and they assured me that they would cover all towing fees. Subsequently, I contacted XXXX XXXX XXXX and was initially told that the fees had been paid by Woodchase Apartments. However, All XXXX XXXX later demanded full payment from me, which was contrary to the previous assurances given by XXXX XXXX. Feeling helpless, I returned to Woodchase Apartments, where I was informed that their accountant was handling the payment directly with XXXX XXXX XXXX. Despite Woodchase Apartments ' promise to return my vehicle, it was not recovered, as they had only partially paid the fees to XXXX XXXX XXXX. Woodchase Apartments also failed to discuss compensation for the inconvenience caused, and subsequent attempts to contact them were met with silence. I later discovered that the office manager, XXXX XXXX, had been terminated. Due to the prolonged stay of my vehicle in XXXX XXXX XXXX 's yard and the accumulating fees, a lien was placed on my car and it was sold at an auction. The proceeds from the sale did not cover the alleged outstanding balance, leading to the involvement of Lien Enforcement Inc. Under pressure from Lien Enforcement Inc, I paid them {$1000.00}, even though I did not actually owe any debt. Furthermore, despite notifying Lien Enforcement Inc of my attorney representation and revoking their authorization to contact me directly, they persisted in violating the RFDCPA by communicating with me after receiving notice. I firmly believe that each of these parties should be held liable for the actions and debt collection practices of the others not to mention the civil rights violations here. The conduct described above has left me without a vehicle and unable to afford a replacement, to date I have spent over {$3500.00} in rental cars and uber rides. I kindly request that your agency initiate a thorough investigation into these matters. I trust in your expertise to uncover any unlawful activities and ensure that appropriate measures are taken to rectify the situation and protect consumers from such unjust practices. I XXXX XXXX had a car towed that was previously stolen from me. Lien Enforcement INC. took over the Debt owed I put myself on a budget I personally could afford. I missed one payment by 7 days after paying for over a year DURING COVID 19. They tell me I have to pay the full balance because Im 7 days behind. I explain my situation to XXXX XXXX and hes not listening hes telling me I need to pay today or further action will be taken the debt is XXXX around there he tells me to hold on to get in lowered he comes back on the line and says I can pay XXXX to settle it today. If I told him before he put me on hold I dont even have {$500.00} why would he come back on the line with that response. Then 10 20 minutes go by of him telling me I need to go get a personal loan, pull from my 401k plan, I need to get a payday loan he asked me my position at my job he asked me how come no one else can help me pay it. He asked me how do I take care of myself which isnt any of his business he harassed me for 20 minutes about why I cant pay the debt. XXXX XXXX is very disrespectful and has no consideration for people. He asked me what banks have I tried to get a loan for like why is that any of your concern his only job is to collect debt not to harass me or try to force me to pay a debt when I can not. I paid XXXX for the car the tow yard sold it and now I owe XXXX $ for storage etc its really the last thing on my list. I explained I have no job I live with someone else its Covid 19 going on why are they calling harassing people all In personal business that has nothing to do with their job description. They have called me at work and held me up on the phone XX/XX/XXXX which was my last payment made after I repeatedly told them I was working. XXXX XXXX who I spoke to XX/XX/XXXX is the main harasser. He says how can we settle this today after I repeatedly told him either you can take my payment or you can put it on my credit he still kept going. Well I can split up the settlement into two which is over XXXX each after I just told him I dont even have XXXX to give.. its like he was intentionally antagonizing me. Trying to Belittle me as a person, because I cant pay a debt. Without People who owe debt they have no job. So they shouldnt be talking to people the way they do Lien Enforcement INC. Specifically.

On XX/XX/XXXX, I received a collection notice from Lien Enforcement Inc. for Tow and Storage fees incurred in late XXXX on a car donated to a California charity in XXXX. I responded to the notice via certified mail that I was not liable for the debt and included a copy of the DMV release of liability dated in XXXX. The certified mailing was signed for on XX/XX/XXXX. On XX/XX/XXXX, I received a voicemail requesting that I contact Lien Enforcement Inc. On XX/XX/XXXX, I received a second voicemail from Lien Enforcement Inc the agent left the name XXXX XXXX XXXX I called back and had a conversation with XXXX XXXX. During this conversation I stated that I was not liable for the debt and had sent evidence of that via certified mail. During this conversation XXXX XXXX stated that I was liable because I had failed to provide a smog certificate as required under CA XXXX XXXX Section XXXX. This is a false statement as the vehicle was transferred to an entity exempt from the provisions of section XXXX as part of a charitable donation. He also stated that it was fortunate that this matter was not yet in court and that it " had not yet impacted my credit. '' He went on to state that he might be able to work with his boss to reduce the amount owed. He offered to send me documents in his possession that showed that I was liable for the debt. I agreed that he should send me these documents via certified mail to my home. I also stated that any further communication should be by mail only. I restated that I was not liable for the debt before hanging up. I appreciate any assistance in resolving this issue on a debt that is not mine.

I received a letter that read " Final Notice '' from the company, Lien Enforcement , Inc., in the mail on XX/XX/2021. This was the first communication that I ever received from them. The letter said that they had made previous attempts to notify my of my debt of {$2300.00}, and that my account was unresolved and seriously past due. The letter threatened that if I did not contact them by XX/XX/2021, the company would refer my account to legal counsel for further collection efforts and take legal action if deemed necessary. The letter also mentioned that if I had an insurance policy for the vehicle, that I could consult them for help submitting a claim to them regarding this debt. The letter named the original creditor of the debt to be a towing company near me, where I had a vehicle towed two years prior. I had been in an accident, only had liability insurance, and ended up paying the towing company what I owed them for the tow and storage, and signed the title of the vehicle over to them. I called the tow company immediately to ask about it and they had no record of me owing them anything and in fact said that I was not even in their system because it happened so long ago. They told me not to worry about it. It seems clear to me that this is a convincing scam to scare consumers into paying a debt they do not owe but are tricked into believing they do. There are several XXXX reviews of Lien Enforcement , Inc., also hinting that they are a fraudulent company and share similar stories to mine. I have reported them to the Better Business Bureau, and attached a copy of the fraudulent notice they sent me.

I bought this car never registered the car under my name. I then sold this car to a unknown person I cant remember the name. This happened 3 years ago. Its been a long time I 've did my part by releasing liability to DMV but for some reason they have no record. i send out for XXXX inquiry witch I paid {$20.00} for but when it came back my release of liability was not on their, I know I did it online for some reason it did not save under the DMV system. The collection agency told me if i forgot to enter millage or any little thing it would not accept it I 'm not sure if a did an error on my behalf but I 'm 100 % sure I did it. DMV never rejected my application. I did file the release of liability but like i side they have no proof. I 'm the kind of person that takes care of her responsibilities but at this time i find my self very upset because I 'm being charged for something that i know in took care of 3 years ago. I tried talking to the collection agency and letting them know what happened but they do n't seem want to dismiss the case they keep asking me for money. I actually gave them a {$25.00} dollar payment to keep them away. I do n't find it fair to have to pay for something that i do n't have and sold 3 years ago and knowing I did the release of liability. I have in closed copies of a new release of liability that DMV had me redo but the collection agency will not accept it. DMV said they should accept it but they want the date to be a date before it got towed away.

In XXXX of XXXX I sold my XXXX XXXX XXXX to my dad. I sent in the release of liability to the DMV but then a couple of months later I was informed by a towing company called XXXX XXXX that I owed a {$2000.00} debt on the storage and towing of said vehicle. I explained to them the vehicle was not mine, and that the release of liability is on record at the DMV and they told me I would not be responsible if that is the case. A couple of months later I received a letter from a debt collector called Lien Enforcement , Inc stating that I owe them the debt plus interest. I sent them the release of liability twice. Once by mail in XX/XX/XXXX and then again on XX/XX/XXXX via an email to the email I was given by Lien Enforcement , Inc. I waited 5 days for a response, when I did not receive one, I called Lien Enforcement , Inc. on XX/XX/XXXX to check if they had received the documents I emailed to them, which showed that I was not the owner of the vehicle at the time of tow. Lien Enforcement , Inc. stated that they will continue their efforts to collect the debt from me because the smog was not submitted on the vehicle before it was towed. The gentleman I was speaking to on XX/XX/XXXX who works for Lien Enforcement , Inc. stated that if I don't make a payment, I therefore do not care about my credit score. According to the NRL forms I received from the DMV, the XXXX XXXX XXXX has been sold twice since their first contact with me.

My car was stolen in I believe it was XXXX. The towing agency did not notify me until 4 days after they towed the car to there garage. So when I talked to them on the XXXX day after the towing they told me it was {$150.00} a work day, plus $ XXXX mile to tow the vehicle. So in which case it was {$470.00} to get my car out that day. But that day was XXXX. Which is a national holiday. And the XXXX Said the cost would go up for those XXXX days XXXX and XXXX. Although they were XXXX national holidays which in law states it is illegal for them to work. So they told me another {$300.00} it was going to be to pick up the car. I had offered them to give them the title of the car and they did not take the offer. The car was worth {$2000.00}. They did n't want to take it. I do not understand any of this. I tried to work with them but they did not want to work with me. I am also on parole so I can not leave XXXX miles from my home or go out of the county. I am in XXXX XXXX XXXX. The only reason I go out is because of my work I did. So since I did not have my car I could not go to work and so forth I was fired. So I could not make enough money to pay the towing company for what was an outragerous debt. Of {$770.00} for 6 days of being in there garage. So now the result is they put a lien on my car and sold my car at an auctiom, and I now still owe them {$2100.00} which the maximum amount they told me was {$2000.00}.

They are calling me almost every day and harassing me. On XX/XX/XXXX lawyer XXXX XXXX wrote them a letter to stop contacting me as this debt is not mine. They still continue to call. I sold my car on XX/XX/XXXX. I did all the correct paperwork to transfer ownership to the new owner XXXX XXXX XXXX XXXX living at XXXX XXXX XXXX XXXX, XXXX XXXX, CA XXXX. I completed the release of liability, the sell as is letter and online notice of transfer up to the United States law in California code standards through the XXXX. XXXX did not do his end of the deal and transfer it under his name. I have proof of this as well. The new owner XXXX had the car towed on XX/XX/XXXX which was after I had sold it to him. The police sent me a letter or notice of pending lien for an impounded vehicle around XX/XX/XXXX. I spoke with one of the officers and showed them proof that I had completed everything on my end, and the car is no longer in my possession, and they told me to not worry about the notice as the car is no longer my responsibility. I am not responsible for this debt, the collectors need to stop contacting me.

My matter is not a payday loan but I was instructed by your representative to select that option. I received a notice of a lien on a vehicle that I have already transferred ownership of. I contacted the company to inform them that I was not the registered owner and they informed me that there was " no way to get out of paying the money to them. '' They told me that because they 're documents stated I was the last owner I would have to pay the fee. I informed them that I had the receipt of transfer of ownership that I filed with the XXXX, they informed me that that would not be acceptable proof. I spoke with a XXXX representative and they informed me that my recite of transfer of ownership should be sufficient enough. I contacted the company again while at the XXXX and the lien company representative said I would have to " order a XXXX $ XXXX and request for record, fill out section C '' and mail that to the XXXX in XXXX. He continued to detail an extraneous process of proving that I am not the owner of the vehicle which the XXXX continues to inform me is not necessary as I have a physical receipt. The lien company representative threatened that my credit would be negatively effected because they would put the balance of $ XXXX on my credit if I did not pay the lien for the vehicle. The XXXX informed me to file a complaint. The total amount of the fee is {$2200.00}.

Business is attempting to collect a towing fee for a vehicle I did not own when it was towed. XXXX said that there is no record in the system that I was ever a registered owner of the vehicle, and because I was never a registered owner I can not obtain a record of registered owners for the vehicle. The DMV states the sale date on the release of liability is XXXX/XXXX/XXXX and it must be honored. I never completed the registration process nor paid to register the vehicle, and the DMV states ( The record is not permanently transferred out of your name until the DMV receives a completed application for transfer of ownership and payment of appropriate fees from the new owner. ) So you need to find whomever 's name was / is on the title for the vehicle. Finally, you are refusing to honor the sale date, speaking on behalf of the DMV, which you can not do.

This vehicle was reported stolen to the XXXX XXXX Police Department in XX/XX/XXXX of XXXX. The vehicle location and condition was never given to me by either the XXXX XXXX Police Department or the XXXX Police Department and I only known the condition and status of the vehicle by Lien Enforcement Inc. XXXX XXXX XXXX XXXX, FL XXXX when they requested payment of {$1500.00}. Lien Enforcement is threatening to report the amount of {$1500.00} to the credit bureau as an uncollected debt but I never received notification of my stolen vehicle. The sale of my vehicle to XXXXXXXX XXXX XXXX is unlawful as there was no notification of the condition or location of my stolen vehicle. I am asking consumer financial protection bureau to work on my behalf to dismiss the debt requested by Lien Enforcement Inc and to help me avoid getting this debt reported to the credit bureau to my credit because the process followed did not allow me to work with my insurance company to resolve the issue.

I was called by Lein Enforcement Inc. regarding a debt that I was not aware of on Tuesday, XX/XX/2023. The debt they claim I owe is for overdue towing charges for a vehicle no longer in my possession. They then proceeded to name my employer my home address as well as other personal information. I explained I sold the vehicle long before it was towed and submitted a Release of liability to my DMV in California. They provided an email " XXXX '' to submit proof of the release of liability. Later that day I submitted proof and Called the next day. On Wednesday, XX/XX/2023 I called the debt collecting to inform them I submitted the proof of a release of liability. The operator then stated the information is incomplete and that I owe {$1500.00}. After I explained again that I submitted a release of liability to the operator they will talk to their supervisor regarding the situation after a short moment the operator comes back on and states their boss agreed to settle the debt for {$1300.00}. They told me I have one week until this new settlement is available, and a week has passed they stated they will garnish my wages.

I am disputing a collections attempt from Lien Enforcement Inc. for the amount of {$4300.00} plus interest of {$29.00}. The stated debt is from a previously owned and sold vehicle ( XXXX XXXX XXXX last of VIN # XXXX ) that incurred towing fees at a later date - not specified by the creditor. The vehicle was sold on XX/XX/XXXX and the Release of Liability was promptly submitted to CA XXXX. On XX/XX/XXXX I spoke with XXXX XXXX from Lien Enforcement Inc., and advised that I would be disputing the debt and sending them proper documentation via certified mail showing them proof that I was not the owner of the vehicle at the time the towing fees were incurred, including the Bill of Sale and Release of Liability. As of today, I have received another letter asking for the debt in full, but never received acknowledgment of the dispute. In attempt to resolve this issue, I have called Lien Enforcement Inc. and talked to several representatives that have only continued to tell me that this is still my debt and just hang-up on me. I have exhausted my options and need additional help resolving this matter.

I received a letter from Lien Enforcement , Inc. to collect a debt of {$4600.00} dated XX/XX/. I sent a letter through USPS Certified Mail with Return Receipt on XX/XX/XXXX that requested additional information for debt validation. This request for additional information for debt validation included the request for information such as the name and address of the creditor to whom the debt is currently owed, the account number used by that creditor, the amount owed, and verification and documentation that there is a valid basis for claiming that I am required to pay the debt to the current creditor. The USPS Return Receipt was signed by the addressee with a date of delivery on XX/XX/. I have not received any written communication related to my request for additional information to validate the debt as of XX/XX/. The only written communication I have received from Lien Enforcement , Inc. as of XX/XX/XXXX is another letter stating that a debt is owed and a negative credit report may be submitted to a credit reporting agency

A few months ago I began receiving letters and phone calls from Lien Enforcement , Inc. demanding payment of {$4000.00}. At first, I thought it was a simple scam, but after receiving another letter, I called to investigate. I was told that this debt is from XXXX XXXX, a towing company that claims to have towed and held a car I once owned. I informed Lien Enforcement , Inc. that I had sold the car the year before, therefore, I am neither the legal owner of the car or the debt. They asked for proof that I sold the car, but I have no written proof, as I submitted the pink slip form to DMV to remove ownership of the vehicle from my name. The representative from Lien Enforcement , Inc. informed me that they considered the debt mine and that they would use all means necessary to collect. On XX/XX/2023 I received a " final notice '' from Lien enforcement. I researched the company and found that they have a high complaint rate with this agency, so it appears that I'm not alone in being falsely accused by this company.

I received a letter on Friday, XX/XX/XXXX from Lien Enforcement , Inc. stating we should mail a payment to Lien Enforcement , Inc., dba Lien Enforcement CA , Inc., XXXX XXXX XXXX XXXX, XXXX PA XXXX for {$2100.00} for what they said was a towing fee due to XXXX XXXX for picking up a XXXX XXXX Motor Home that I no longer owned. I sold it in XXXX to a person who planned to live in it. I gave him the title and a bill of sale and had him to sign one for us that he had received the Bill of Sale and the motor home. We contacted both the Lien Enforcement and XXXX XXXX in XXXX XXXX, TX, explaining this, and neither would furnish us with any information. Lien Enforcement said they sent us a certified letter, which we never received. XXXX stated they don't have a file on this matter and couldn't send us any paperwork or information, but that the debt is owed. Please help us. We are seniors in our XXXX and this is terribly upsetting. We have nothing showing that any of this really happened. We don't know what to do.

My scooter was stolen from my place of residence in XXXX of XXXX. Due to the COVID-19 outbreak, the DMV was closed so I was unable to reach them concerning the matter. I filed a police report. I received a letter in XXXX of XXXX notifying me that the scooter was found earlier that month and was being held at a tow yard. The letter also notified me that I owed the tow yard over {$500.00} to cover the cost of the towing on top of the rate per day to keep it at the tow yard. I immediately called to let the tow yard know I had filed a police report for the stolen scooter and did not understand why I was not notified before the scooter was towed. I did not agree to have the stolen scooter towed and should not be responsible for the fee. I also told them I did not want to repossess the scooter. It was then sold at auction. Since then, I have continued to receive letters from a lien company claiming I currently owe {$580.00}.

I received a demand letter from Lien Enforcement, Inc. in the amount of $XXXX.The letter states the fee is for towing and storage fees of a company named XXXX XXXX XXXX XXXX. I am disputing, refusing, rejecting, this demanded a debt amount of $XXXX. The debt of $XXXX dollars does not belong to me and I will not pay the requested amount. I never contracted with XXXX XXXX XXXX. for towing and storage services. I never signed or made any verbal contracting with XXXX XXXX for towing or storage services. I will be filing a complaint with the Internal Revenue Service to have XXXX XXXX XXXX XXXX. and Lien Enforcement Inc. investigated and audited for fraudulent Lien Sale proceed collections. This company is attempting to collect a debt on a car tow that I did not incur, nor did I own the car, nor is it registered to me.
