I am extremely dissatisfied and disappointed in my dealings to obtain a mortgage through Liberty Home Mortgage. When I first applied for a home loan through XXXX I applied to several companies and this was one of three that I chose to pursue. I ultimately decided to continue the process with your company as I spoke with agent XXXX XXXX and he seemed eager to help me. I was excited to begin the search for a home not just any home but my first. After searching for a while I finally found a home that had the bones of what I was looking for. This home would require some work but given the pre-approval amount and the cost of the house I asked XXXX if it would be possible to do a renovation loan. He assured me that this was possible and even though he had not done one personally his company had done plenty of them ( as their website also states ). XXXX never explained to me how the XXXX process worked if he had I most definitely would not have gone this route as there was a lot more out of pocket payments involved. I did not know that I had to locate and pay out of pocket for a consultant. I did not even know what kind of consultant was needed and neither did the agent. It took for me to do some XXXX researching and speaking with a totally different lender ( who was willing to give me the info even though I was not doing business with them ) to find out I needed a 203 HUD consultant which I myself found and paid the sum of {$1000.00} ( which he is refusing to refund ). I was also unaware that I would have to locate my own contractor to do the repairs ( I assumed that the lender or agent would give me referrals for these ). I went under contract for the house I chose on XX/XX/XXXX and have been doing the run around with Liberty Home Mortgage since then. The agent XXXX XXXX refused to communicate with the sellers agent to let her know what was going on with the process. He would not answer emails or phone calls for updates. He told me she was too pushy so he would get back to her at a later time. We had a total of three closing dates as XXXX could not coordinate the appraisal and would not check on it unless I called him. I started bypassing him and talking directly to the appraisal company as he seemed never to know what was going on. Just a week and a half ago ( around XX/XX/XXXX ) he was just verifying my employment, shouldnt this have been done a long time ago. The agent just told me on about the XXXX of XXXX to remove some disputes from my credit history which now seemed like he was trying to sabotage the loan. All this time we were supposedly waiting on the appraisal which I had to pay {$700.00} for to come back and as of today I still have never received it. Now after all of this my credit score dropped because XXXX told me to charge the appraisal to my credit card and I am now out of a home and money paid out for something that never happened and this is the fault of Liberty Home Mortgages inexperienced and unprofessional agent. The agent also violated privacy laws by given my credit information not only to my realtor but also the sellers realtor which he did not have my permission to do so. When I informed XXXX XXXX that I was going to speak with a lawyer as I felt he was the cause of my losing this home and my money he stated he would pay me. He stated this was his first job out of college and he was sorry. They never said the would not do the loan just I would have to pay {$6000.00} to {$8000.00} more down and have a higher interest rate which was out of the question. Per Electronic Code of Federal Regulations I tried to resolve this matter with the owner before filing a complaint with no resolution. His only solution was I could come back to them again when my credit was better, as if I would go through this process with them again. Starting XX/XX/XXXX, as result of my search on the internet for a broker. Eventually, a gentleman by the name XXXX XXXX who presented himself as the Branch Manager NMLS # XXXX per his email. After having gone through extensive phone discussion with Mr. XXXX about my finances including my annual income, my mortgage liability on my primary residence and other related matters, I decided to furnish him with my XXXX and XXXX tax returns and bank documents to evaluate my credit worthiness. Consequently, though within a short time, he tells me that I " must absolutely include my wife '' in applying for the mortgage because " your income is not sufficient '' to meet the monthly mortgage obligations, therefore, you are not going to qualify. To further illuminate the issue at hand, please take note of the following facts : 1 ) My current credit score with XXXX and XXXX is XXXX and XXXX, respectively. 2 ) Our current monthly mortgage is {$2800.00} and we are current with our payments. 3 ) The amount of mortgage I am applying for is based on a property up to {$340000.00} with 1/3 down payment ( {$340000.00} x 1/3 = {$110000.00} ) ; So, the principle to borrow is {$220000.00}. 4 ) Accordingly, the mortgage payment with real estate taxes included is about an average of {$1200.00}. 5 ) Below, the computation of my personal income is far more than enough to meet my mortgage obligation for the second home. 6 ) I produce {$31000.00} a year without earnings from self-employment ; Current mortgage payment {$2800.00} plus {$1200.00} for second mortgage times 12 months will yield {$49000.00} ; my wife and i share these expenses 50 % each ; therefore, my personal is {$24000.00}. 7 ) As you can see my income of {$31000.00} versus {$24000.00} in expense and this is without earnings from my accounting. 8 ) Per tax returns sent to Internal Revenue Service, for XXXX and XXXX, I reported {$37000.00} and {$4800.00}, respectively. Being a tax payer on cash basis, I could only report what I had collected from my clients. Not being on accrual basis I could not report my accounts receivable. Between the years XXXX, XXXX and XXXX my clients owed me well over {$100000.00} in accounts receivable. This amount was ultimately collected on XX/XX/XXXX. Now, comes time to file my XXXX, I will be reporting well over {$100000.00} on my Schedule-C, Profit and Loss Statement. 9 ) My dispute is the unfairness that is exercised by the mortgage company, negatively effect every consumer like me. The credit reporting agencies show our current mortgage on both mine and my wife 's credit report and hold us individually and severally responsible, but are unwilling to accept that their payments are also coming jointly from two persons, in this case the husband and the wife the credit agency will have to report that payments are also being shared. 10 ) I believe that I am a credit worthy person and should be able to secure a mortgage based on my credit history and current financial standing, For example, the credit reporting agencies show the obligations or liabilities of the consumers but they leave out their equity. Just as in my own case, my house current market value is close to $ XXXX but the credit agencies show only what I owe. They create a picture that you are less than what you think you are. Obviously, we all know what all this nugatory or derogatory behavior is about and that is to hit you with higher finance charges. They basically would like to manipulate you to squeeze the juice out of you. 11 ) I strongly urge CFPB to audit the credit reporting agencies and determine if they are in collusion with financial institutions or at least advise the justice department to look into this type of abuses.. Millions of consumers are being denied their rights for the sake of benefiting these multi XXXX dollar companies.

I applied for a mortgage through Liberty XXXX and talked to a Loan Officer, lets call him E. He reviewed my financials, and he provided a letter on XX/XX/XXXX, for XXXX which I clearly understood the pre-approval was no guarantee. I advised this was going to be my primary address as I did not have a primary address. I started uploading the required docs days prior, on XX/XX/XXXX, to their online portal. At that time, all they required was XXXX, and paystubs which I provided, and he stated they had everything that they needed. He advised he was going to write a letter to my broker to confirm that I was placing 20 % down. On XX/XX/XXXX, he returned asking for additional information and to quote, I appreciate your due diligence and fantastic communicationHis loan officer then asked to verify employment wow, weeks after this started and only now he wanted to verify employment. He called my work, and they sent over letters, he called again, and they followed with more letters. On XX/XX/XXXX, I quote. my apologies, I mixed up the conditions that are my responsibility which once again, delayed this provider from their basic tasks. As he stated on XX/XX/XXXX well over a month since this process began, I am sorry for the confusion to me, having dealt with other loan officers for previous properties, E. is definitely not properly trained and the underwriters cant keep their files organized. On XX/XX/XXXX, he stated that he has everything that they need ready for closing. However, as common with this company, on XX/XX/XXXX they then pulled the rug and ask for additional paperwork. On XX/XX/XXXX, I locked my rate. XX/XX/XXXX, another letter to underwriting confirming my fully owned condo address which they had for a month, perhaps lost. XXXX XXXX asking for more proof of funds. On XX/XX/XXXX he stated in an email that the rate changed as corporate and I quote, unbeknownst to me changed the residence from primary to investment which I never authorized. However, although E stated nothing could be done due to time, I advised that I was going to be living in the unit, and continued with more documents. I had 30 % free and clear in my account and over an XXXX score for credit. He started he was ready to close and I faxed over a notarized POA due to Covid-19, I could not be at the signing. He agreed. However, then he asked for more funds. Due to time that it would take to transfer the money from another investment account, I called in a family investment and received a gift to cover the excess well over anything I had to do for my prior properties. He asked for more documents and then stated he only needed one more statement and he was good to approve and ready for closing ( not the first time I heard this from E ) I provided that statement. After a day of not hearing back from him, I received an email after messaging my real estate agent and Es response, he stated that sorry, the property was put through as an investment not primary and gift funds are not allowed. One day prior he had me, along with my family member, scan and email him the 60 days worth of statements, and yet one day later he decides to tell me, the rules once again have changed! Now, the seller is rightly frustrated, and E claimed it was my fault and Im out my escrow. I was clearly misled at every step of the way with E and Liberty Mortgage.

I submitted a inquiry through a 3rd party credit watch company for a Refinance. Liberty home mortgage contacted me about the refinance. During the call I told XXXX XXXX XXXX XXXX XXXXXXXX XXXX Liberty Home Mortgage I would call them back and to NOT pull my credit- he fraudulently pulled my credit anyways WITHOUT my permission. Liberty Home Mortgage keeps fraudulently pulling my credit over and over again. There have been 4 inquiries made by Liberty Hone MortgageXXXX XXXX, they pulled my credit twice on XXXX, and again XXXX all fraudulently WITHOUT my permission. XXXX XXXX XXXX of Liberty is the person who I spoke with and who accessed our information. I have reached out to his manager and the company XXXX they use to pull credit with no response. I was under a contract to purchase a property located at XXXX XXXX XXXX, XXXX XXXX, IL on XXXX.The lender was Liberty Home Mortgage Corporation in Ohio. Process went well, submitted all the paperwork, paid for FHA APPRAISAL of {$520.00} and Home Inspection of {$350.00}, earnest money to listing agent of {$1000.00}. I spoke to my lender 2 days prior to closing and everything was great. I received a call from the lender the day before closing which I did not have full disclosure the property taxes were {$8500.00} instead of {$3000.00}. So, the deal fell through. I am asking for my XXXX plus XXXX. I am waiting to receive my earnest money ( XXXX ) returned to me. Please advise.
