I contacted XXXX XXXX Rep. XXXX XXXX around XXXX XXXX about starting a VA home loan on our house. XXXX said that here would be no closing costs due to the fact that I am a XXXX XXXX XXXX XXXX. XXXX said that we could also pay our taxes and home insurance ourselves. XXXX was wrong from the start. The VA does not allow these options! XXXX XXXX was a terrible rep. from the start of this process. XXXX then told us that we had to give him a credit card number to get our home appraisal and the charge would be XXXX. He said that XXXX XXXX would pay us back because XXXX said that because I am a XXXX veteran I would not have to pay any closing costs or appraisals. XXXX had us sign electronic documents and these documents stated the loan will be at 3.83 %! We finally got the appraisal done and XXXX said that by XXXX XXXX we will close the loan! We got a extension from the home owner in Florida to extend the deal till XXXX XXXX because we flew to Florida on XXXX XXXX. From XXXX XXXX thru XXXX XXXX nobody called us from XXXX XXXX even thou we called them every day! XXXX XXXX XXXX - XXXX XXXX 's manager called us only again after we called XXXX XXXX to tell us that XXXX XXXX had medical issues! Why in the world did XXXX not transfer everything 7 days earlier while we are in a hotel with a rent a car! Again nobody called us during this time! XXXX XXXX said he would help us then he went on vacation and again nobody called us! Finally XXXX XXXX took over and again only after we called them! XXXX called us and said he messed up the electronic documents and said he laughed and said that the loan is now 4.25 % and I told him to never call me again and that he and XXXX XXXX are liars and cheaters. We called XXXX XXXX again and said how in the world do you people run a bank that treats people like this and he said the president would help us out. The next day XXXX said that they had to put closing costs in the loan and it would still be 4.25 % and this is terrible! XXXX said that we had to sign electronic doc 's again and wait 3 more days! Then on Saturday XXXX XXXX a notary came to our hotel and we signed doc 's for 1 and 1/2 hours! Then XXXX said we had wait 3 more days!! We were told again by XXXX XXXX that we could close by Wed XXXX XXXX this after we extended the purchase contract 3 times!!! I called XXXX XXXX personnel and said where in the world is the money and they said by Friday and I said that if we do not have the money Thursday morning the seller will not sell us the house! We had to go thru all of this due to XXXX XXXX personnel were very poor workers and terrible management! We finally got the money to the title company FRIDAY at XXXX XXXX - Florida time! Only after I called them many times to get this done! How in XXXX 's name does any bank treat their so called customers like this! We extended our plane tickets, we had to pay hotel bills rent a car, food etc. We had to do everything in 4 days before we flew home to keep my job! We had to pay people in Florida thousands of dollars on work we could have done ourselves. XXXX XXXX personnel were absolutely worthless! We were lied to about the loan being 3.83 % now 4.24 % - we need it to be 3.83 %! We were charged XXXX for a home appraisal and had XXXX XXXX fight XXXX XXXX to get this charge back! XXXX XXXX added another XXXX to the loan for another charge from the original appraisal and Lenox said they put that in the loan and we need that taken out - we are not supposed to pay appraisal or closing costs! We stayed in a hotel for over 2 weeks and we were told by XXXX XXXX 3 days - we want reimbursement for this and rent a car food etc. XXXX XXXXXXXX has told us XXXX XXXX terminated from XXXX XXXX! XXXX XXXX quit or was fired! XXXX XXXX XXXX XXXX XXXX XXXX had us sign ELECTRONIC DOC 'S! XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I sent all of this to her to get XXXX XXXX to address all of these problems! XXXX XXXX again told us in XXXX that XXXX XXXX would look into all of this! So far now XXXX XXXX nothing has been done and this all needs to be addressed so no one will have to go thru this XXXX again!

I tried to do a refinance with Lenox Financial on my primary residence, but as you can see from below there were several lies, inconsistencies and fraud throughout this whole process. I'm very upset. This is a classic case of bait and switch, which is blatant fraud. Here is the timeline : XXXX XXXX I contacted Lenox Financial and spoke to XXXX XXXX ( Loan XXXX at Lenox Financial ) about a no cost refinance on our home. He asked for paystubs, mortgage statement, W2s, and my home insurance policy. I was promised a no cost refinance of our home if my credit was approved, which was right away. I told him we were attempting to get rid of our PMI ( Mortgage Insurance ). He said the rates for a no cost refinance were 3.75 %. XXXX XXXX I find out that the no cost refinance is now costing me {$1300.00} in state fees that XXXX XXXX never told me about in the beginning. This made me very upset, but I decided to continue. XXXX XXXX XXXX XXXX ( XXXX XXXX ) reached out to me and asked me some questions and requested that I unfreeze my XXXX credit report. XXXX XXXX XXXX XXXX XXXX XXXX from XXXX XXXX XXXX XXXX XXXX XXXX XXXX out to me to schedule our appraisal. XXXX XXXX XXXX XXXX me a detail form, which showed the loan was now locked at 4 %, but now he was charging me .223 % in points. As always, he told me he would delete the points. XXXX XXXX The appraisal was completed by XXXX XXXX XXXX XXXX XXXX I spoke to Mr. XXXX and mentioned how the points are still showing up and shouldnt be on our loan and his exact words were, Ignore that, Ill make sure we get that removed. Also, on XX/XX/XXXX we got our appraisal back which shows our house appraised for {$330000.00} which is over {$100000.00} of the UPB ( Unpaid Principal Balance ). XXXX XXXX Shortly after I paid for the appraisal ( {$480.00} ) out of my own pocket and 24 hours before settlement, everything changed. Lenox Financial had my completed appraisal for one week and now 24 hours before settlement, Mr. XXXX mentions it didn't appraise for the right amount and he now needs to charge me points ( {$1700.00} ) for the no cost refinance. Throughout this whole process, Mr. XXXX kept telling me that he would have the points removed, in fact he now was charging me .723 % without my knowledge or approval. This was the first time MrXXXX XXXX mentioned the value of my home. Come to find out, Lenox Financial was estimating my home appraisal at {$340000.00}. This is simply not realistic since XXXX shows it for only {$300000.00}. My guess Lenox Financial never locked in my rate and now they are trying to recoup some extra money. This is a classic case of bait and switch, which is blatant fraud! XXXX XXXX I reached out for Lenox Financial to fix this as I was promised from Mr. XXXX XXXX XX/XX/XXXX. Hes now bringing up this phony value that was never mentioned before. Hes throwing this on me 24 hours before settlement. This is very upsetting, especially after I was promised a zero cost refinance at 4 %. I had this confirmed with Mr. XXXX on Thursday, XX/XX/XXXX. I contacted my attorney, XXXX XXXX, XXXX from XXXX XXXX XXXX and he represented me and tried to come to a resolution with Lenox Financial and their story keeps changing and they won't budge. If anything they want to charge me more now. My attorney told me to reach out to your agency- CFPB. I want what I was promised or a refund for the appraisal fee of {$480.00}. This has been a very frustrating situation and I'm sure you'll see several other complaints from this very dishonest lender. Please let me know if you need anything else. Below is a copy of the email I sent to XXXX at Lenox financial concerning he issue. After no response, I sent a follow up email on XX/XX/XXXX, to XXXX XXXX, Senior Sales Manager who replied that forwarded the email to XXXX and their legal department. Still no response. XXXX XXXX XXXX Attachments Mon, XX/XX/XXXX, XXXX XXXX ( 8 days ago ) to XXXX Dear XXXX XXXX XXXX XXXX instructed me to contact you concerning my bad and costly experience with Lenox. He did not have the ability to resolve the issue. I began a straight forward XXXX XXXX refi process with Lenox on XX/XX/XXXX. It was advertised on the radio as closing in two weeks. XXXX notified me that due to the volume of refi applications and lack of staff, I should expect to close in 30-60 days. Please review this message string to see all of my communications with your team. On XX/XX/XXXX, 5 months into a two week process, I cancelled my application due to Lenox 's failure to perform. During those five months, your team : Pulled our credit reports three times, dropping our scores nine points Requested payoff statements three times from XXXX XXXX. Each of the three statements, XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX, had language explaining that the escrow impound account would be frozen. My property taxes due XX/XX/XXXX and past due on XX/XX/XXXX were not paid. My property sits on two parcels, both incurred a penalty of 10 %, for a total of {$420.00}. I expect you to promptly reimburse me for the tax penalties. I went with XXXX, and the refi process was completed and recorded in 18 days. We lost 4 days, due to my delinquent tax situation your team caused. If your team kept their commitment to close in two weeks, or even 30-60 days, I would have saved about {$150.00} per month in lower payments. At this time, I am requesting you reimburse me for the tax penalties and we'll consider the matter closed. The cost of extra interest I paid and the damage to my reputation and credit score will be chalked up to the privilege of doing business with your company. I have attached supporting documentation for your review.

I responded to a radio commercial from Lennox Home Loans in late XXXX and it offered a no closing cost loan. I applied and was eventually approved for a loan, but neither the Loan Estimate nor the Closing Disclosure itemized the {$100.00} x 2 recording fees for recording the discharges on the 2 existing mortgages that would be paid off with the proceeds of the new loan. I asked Lennox for assurance that the discharge recording fees were included in the LE and CD disclosure documents, and Lennox represented that they were included. My loan was closed in XXXX, but it turns out that the 2 discharge recording fees were not included in the Loan Estimate, the Closing Disclosure or the Lender Credit that was supposed to pay for all such expenses. The attorney who closed the loan at my house emailed Lennox after the closing asking them to forward the discharge recording funds {$100.00} x 2 to him. He is the one who ordered the loan payoff numbers and he had the lenders send the original discharge documents to him for recording as is customary in a mortgage refinance transaction. Lennox Home Loans has still not sent the {$100.00} x 2 funds to their attorney despite their assurances that the discharge recording funds were accounted for in the Closing Disclosure and that the 2 discharge documents would be recorded. I have all the emails to back up my claim.

I entered the " Fast Track '' re-finance program with Lenox Financial, DBA Weslend Financial, XXXX XXXX. I was strung along for four months when they finally ordered the home appraisal when was to be reimbursed to be at the end of the process. I paid for the appraisal in XXXX ... in XXXX they were no closer to finalizing the re-fi and still could not give me a date for closer. I spoke innumerous times with XXXX XXXX my mortgage advisor who was also very frustrated and told me he would be leaving the company. He offered me the name of another lender and told me he would reimburse me for the appraisal fee of {$520.00}. I also spoke with the owner XXXX XXXX who too was apologetic ... he said they just had too much business. This certain looked like a bait and switch. I qualified for their " Fast Track '' program based on my excellent credit, income etc. I did everything timely. Just because they have too much business doesn't mean they do not have to live up to their part of the contract ... '' Fast Track '' re-fi! I feel five months with still no commitment to close is long enough for me to wait. I was very patient but do not feel that I should be penalized financially because of there failure to perform. Also I missed out on the better rates by wasting 6 months of my time with this lender. Thank you!

I have been trying to refinance with Lenox Financial Mortgage company since last XXXX. They have been waiting to receive subordination approval from XXXX XXXXXXXX XXXX ( I have a HELOC with them ) for some time now. One XX/XX/21, my XXXX credit card reported credit inquiry activity. It sited the source as XXXX, the inquiry date as XX/XX/21 and the company XXXX/Lenox Financial Mortgage Co. XXXX. XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX. Lenox did not call me to tell me they needed to run credit again and never asked my permission or received my permission to run a credit inquiry. When I called XXXX XXXX at XXXX about the credit inquiry she told me that XXXX XXXX was supposed to call me to let me know that they needed to run credit again. When I asked XXXX he said " I'll go check. The credit report have references numbers and sometimes get re-issued. They might have pulled a new report instead of re-issuing by mistake '' Since then, XXXX XXXX has never followed up or called me back to explain why Lenox ran my credit with my consent.

I started the process of refinancing my personal residence and vacation home in early XX/XX/2020. I was told several times that the loans were approved but then they kept asking for the same information over and over which was provided, then they lost underwriters, seems like they were always starting over. Now it's mid XXXX and they still have not been able to provide me with a closing date or if it has been " officially '' approved. I keep giving them updated bank statements, they changed my insurance to reflect them as mortgagee ( which happened early XXXX ) ; they contacted my CPA to ask a couple questions about one of XX/XX/XXXXXX/XX/XXXX, which cost me {$250.00}, and the list goes on-and-on. I have never experienced anything like this in all the refinancing transactions I've completed in 30+ years.

XX/XX/XXXX, I applied for a mortgage with Lennox Mortgage Corp/ DBA WesLend Financial and they quoted me for XXXX year fixed at 4.875 % and then the closing cost fee went from {$1500.00} to XXXX on XX/XX/XXXX and went up again to {$3300.00} on XX/XX/XXXX. In the beginning of the loan process, they were trying to earn my business against another lender and each kept lowering their fees while keeping the rate where it is. But after a few weeks in the process they're jacking up their fees again. They've sent me redisclosures two times this month but won't give me an update of when we can close. I think they plan on jacking up the fees until I'm desperate enough to just sign before the next payment is due. This is not very honest lending practices.

This is a technical issue regarding listed borrowers on a XXXX Mortgage interest statement ... ... I 'm aware and comfortable that only one designated ( listed as primary ) borrowers tax id number can be listed on this statement My issue is with Lennox Financial Mortgage Corporation saying they are not allowed to list multiple borrowers under the Payer's/Borrower '' s name ... ..I have previous and current years examples of other lenders listing multiple names on this form

In XX/XX/2017, I applied and was approved for a loan with Lenox Mortgage. They quoted a closing cost of approx {$900.00} to {$1100.00}. The company went through 3 loan processors on my loan due to lay offs etc. This delayed the closing of the loan by approx 6 months, and then charged me points to extend the loan. I paid over {$6000.00} in closing costs. They offered no relief. They said the informed the Vice President, but I never heard from her,.
