I need to make a complaint about a company called XXXX, aka XXXX XXXX aka XXXX XXXX aka Flourish. They state in their contract that in order to exercise my right to receive written notice if any loan payment would vary from the amount authorized, I am to send a written request. Authorization to Vary Amount of Payment. I have the right to receive written notice if any loan payment will vary from the amount authorized above. To exercise this right, I will send a written request to your service provider at XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, CA XXXX. Unless I exercise this right, I authorize you to vary the amount of payment you seek, without notice, so long as such payment is at least 50 % and no more than 120 % of the amount I authorize above. They also have it in their contract that to cancel the EFT authorization I am also to send a written request. Cancelling this Authorization. If I wish to cancel this Authorization, I will write to your service provider at XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, CA XXXX, or call you at XXXX in such time and manner so as to afford you and my depository institution a reasonable opportunity ( typically three ( 3 ) business days ) to act on my request. On XX/XX/XXXX I sent a written request to receive a written notice if loan payments would vary from what was originally authorized. I received no acknowledgment of this request. On XX/XX/XXXX I sent a letter via certified mail asking for a payment arrangement, canceling the EFT authorization and also the authorization to vary the loan amount. I never received the green card back from this certified mailing. The certified mailing went out on XX/XX/XXXX. I can only assume it was refused. The contract states they want such requests in writing, but yet they refuse to accept such requests. XX/XX/XXXX XXXX XXXX XXXX. They did give me an extension after I had stopped payment and the bank paid it anyway because the stop payment had the wrong date. Unfortunately I had to borrow again to cover this. On XX/XX/XXXX I sent an email again exercising my rights to cancel the EFT and varied payment authorizations and ask for a payment plan. XX/XX/XXXX XXXX XXXX XXXX. If I don't hear anything from you by Friday, XX/XX/XXXX, I will proceed to file complaints with the attorney general of the state of Ohio and XXXX XXXX XXXX XXXX XXXX XXXX ( XXXX ) stating unfair lending practices and violating your contract regarding the above rights. Unfortunately we can not modify your loan at this time. However, since you are unable to make your upcoming payment and in order to avoid any additional fees you may incur, we will not debit your account on XX/XX/XXXX. We have also temporarily deactivated your checking account on file. If you do not make your payment on your scheduled due date, we will place your loan in an overdue state. When you are able to make a payment, please contact us directly to reactivate your checking account and discuss payment options. If you have any additional questions or would like to speak with us further, please request a call back at XXXX. We hope this information was helpful and thank you for choosing us! Regards, XXXX How would you rate my reply? Great Okay Not Good -- XXXX XXXX XXXX I am not trying to get out of paying this debt. I was just asking for a payment arrangement. I also would like to know why my 2 written requests were ignored when it clearly states in the contract they want a written request. I feel they have violated their contract. As for requesting a call back, that's a joke too as they will not return calls in a timely manner. Several calls placed on XX/XX/XXXX were not returned until XX/XX/XXXX. They began calling me starting beginning XX/XX/XXXX. They called me twice on that day from XXXX at XXXX XXXX EST and XXXX XXXX EST. No message was left. No messages at any time. I keep my phone off most of the time because of robo calls and calls early in the morning as I work second shift. They denied knowledge of the written correspondence I had sent. The only way they would set up a payment plan and put me in " good standing '' was to start debiting my bank account again, which I refused. I told them I would make a payment on XX/XX/XXXX. I told them I don't want them in my bank account, that I don't care about being in " good standing '' with them. They refused to send me an email detailing the conversation and my plan to make a payment because I didn't sent up an automatic debit. Why do I have to follow their contract, but they don't have too? This is misleading, telling people to send correspondence to an address and then refusing such correspondence. There is no mention of sending an email in the contract. It is also stated in the contract that one does not HAVE to authorize EFT. I feel this company needs to be investigated. The people of the state of Ohio don't need this kind of unethical company. During a hard time in my life when I was unemployed I got caught up in the payday loan scheme to stay a float. I came across XXXX in XXXX, over the next year I was paying back the {$300.00} loan every week as promised. Then they push me in a large loan with longer payback period. At first this was okay, but then the interest began to accoumlated never allowing me to pay off the loan in full. Mind you in reviewing my history with them I had several short term loans all of which where paid on time and quickly, but with this longer term loan it became difficult. I tried on several occasions over the course of three years to pay it and/or make payment arrangements to settle without any results. They would began debiting my checking account so much to the point my checking account ranked up numerous NSF or over draft payment fees of {$30.00} a pop. This caused my checking account to reach as much as {$900.00} in fees causing my bank to close the account and report me to check systems. I tried to reach out since XXXX to lendup via online customer support their only direct means of communication with results. In the last three years I maybe spoken to an actual live rep 4 times and each time I was told that I had to pay the debt in full and they could reduce, settle or change payment terms. Every attempt to raise the principle amount of {$1000.00} in full was impossible. In fact this past year I attempt to pay the balance with proceeds from tax return and twice payment was reject from their system making it difficult to payoff this debt. I finally was able to speak to a live rep after several emails and was told that they would could take a payment over the phone, but that I need to have prepaid debit card, no credit cards or checking account payment. I borrowed the money and loaded it on a prepaid debit card and attempted to pay online again without success. Once again I reached out several times, the last time being on or about XX/XX/XXXX and go a rep on the phone to take a payment, but their system rejected it because they wanted need the entire balance plus interest. Fast forward, this issue has caused major damage to my credit file and fico as they continue to report current ( 120 days ) late on a four year old debt. At this point since have attempted to settle with this online lender over the course of four years without success and they have continue incorrectly report this debt current ( 120 days ) late, and that this loan is clearly and example of illegal prey of consumers for payday loans they can't afford. I humbly request this debt and line item of current, ( 120 days ) late and delinquency reporting be permanently removed from credit file.

I, XXXX XXXX, applied for a Pre-approved Credit Card and was approved for a Credit Card via XXXX for {$1000.00} Credit Line on XX/XX/XXXX. I received a credit card onXX/XX/XXXXand proceeded to activate my credit card via phone for purchases. The automated credit card services at XXXX ( XXXX ) indicated that my Credit Card Balance of {$1000.00} is available for purchase. I was later informed via email address ( XXXX ) that I needed to submit via uploading into their website additional verification information ; specifically copies : Social Security Card ; Recent Utility Bill, and Drivers License in order to gain access to my Credit Card Line of Credit. I proceeded to email and upload all requested documents on XX/XX/XXXX and XX/XX/XXXX. I called XXXX at XXXX to inquire about the status of receipt of my required identification documents and the customer service representative verified receipt of my Drivers License and XXXX XXXX XXXX Utility Bill and indicated that for some reason Card Services could not receive the emailed uploaded copy of my Social Security Card which was very concerning since Card Services received the Drivers License and XXXX XXXX XXXX Utility Bill from the identical email address : ( Support ) XXXX. I spoke with a Card Services Representative about their indication that my copy of my Social Security Card was not be received mysteriously and I re-emailed it at least 4 times ( between the dates XX/XX/XXXX and XX/XX/XXXX ) and 3 times while the Customer Service Representative was on the phone line around XXXX XXXX CST on XX/XX/XXXX. No plausible reason was provided as to why my Social Security Card was not received which is sensitive personal indentification information. On XX/XX/XXXX, the Customer Service Representative did not provide an alternate email address for me to upload and email my Social Security Card in order for my Credit Line to be made available. I was simply told that my Credit Card will not be activated until XXXX receives a copy of my Social Security Card. I am extremely concerned that my personal identification information has been obtained for Fraudulent Reasons and never was intended to provide me a Credit Card Line of Credit. I requested to escalate my concerns to a Supervisor and was denied an opportunity to complain to a Supervisor or Member of Management for review. I had no other choice but to file a complaint with CFPB on XX/XX/XXXX to protect my personal identification information to avoid potential fraudulent activity with personal identification information submitted for XXXX Credit Card approval and usage.

I have recently found myself in an unwarranted financial crisis with a company named FLURISH INC DBA LENDUP. On or about XX/XX/XXXX, I obtained a loan through this company to rebuild my credit. Shortly thereafter ( XX/XX/XXXX ), I changed banks and multiple attempts to contact LENDUP to update my account to reflect my new account changes went unanswered. Between the months of XX/XX/XXXX and XX/XX/XXXX, countless attempts to contact LENDUP were made. Additionally, LENDUP has not reached out to me neither. As of XX/XX/XXXX. 2 + years later, any and all attempts by me to make contact to pay this debt has failed. Every month, Lendup relentlessly updates my credit report with 120-149 Days Late, which has destroyed my credit score. My most recent and probably my last attempt to reach out to LENDUP was yesterday XX/XX/XXXX. Four different approaches were used to contact them ; 1 ). email ( XXXX ; XXXX ), 2 ). Online submit @ https : //www.lendup.com/contact ), 3 ). Cellphone, and 4 ). Attempted to create a new account to gain access to their system, however the system states the SSN submitted is already in use, prompting me to log in using a different account. Each time I send an email, I receive a system generated email response that states, Thank you for contacting us! We're currently experiencing higher than normal response times via email. Please note if you are not logged into your account, response will be delayed further. I have exhausted all efforts to contact this company. It is in my professional opinion that FLURISH DBA LENDUP is in violation of the Fair Credit Reporting Act. Furthermore, I feel FLURISH DBA LENDUP is engaging in unfair, deceptive, or abusive acts or practices or that otherwise violate federal consumer financial laws. The company has not given me the opportunity to repay this loan as I promised, to build credit and provide access to cheaper loans, as it claimed. My family and I are struggling tremendously with higher interest rates and I am unable to obtain a loan for a house or vehicle.

In XXXX of 2017, I was significantly affected by Hurricane Harvey. This tragedy left my family and me homeless for a month and a half and during the majority of the time, I had no access to a phone, Internet, or other communication sources. Additionally, I lost my job due to the hurricane and was unable to make payments on some of my credit card accounts. I was unable to reach out to companies as I didn't have the means to do so and, frankly, it was not a priority of mine. Knowing that I was affected by the hurricane, these companies still reported late payments on my account, which I feel to be disrespectful as I was going through a struggle. After I was able to move back home, I got a job and was able to start making payments on my accounts. In XXXX of 2017, I sent goodwill letters to companies explaining my situation. The majority of them did not agree to remove the payments. I am not contacting you all to see if this issue can be resolved. I tried to get this issue resolved already by contacting the company directly and submitting a complaint to the XXXX directly. Both of those were unsatisfactory and I would like other entities to investigate this matter, if possible. I have documentation from a representative of XXXX stating that the late payment was refunded, therefore implying that the late payment is inaccurate and needs to be removed from my credit report immediately. Additionally, I contacted the company to be informed of their relief efforts of victims of Hurricane Harvey and was not given a direct answer. This is not proper customer service. Finally, their response of saying that they are unable to remove it is blatantly false and should be investigated. I have had other credit card companies able to remove the payments from the reports, so them saying they are unable to modify is incorrect. Please investigate this company and my matter to the deepest extent possible.

On XX/XX/2018 I was directed to a XXXX XXXX XXXX Application from XXXX XXXX. It sent me to the application page and as i started filling out the information it asked me to verify my email. When i received the verification email i discovered that there was a technical issue in their system because it was recognizing me from when i applied several years ago. I immediately called their customer support line which is really only an application support line and notified them about the problem. The girl kept telling me that i was denied and that nothing has changed in their decision. I kept trying to explain that i had NOT even completed the application and could not understand their logic. She just kept repeating herself that everything on their end is fine and that they can't extend me credit. I kept asking for someone else or a supervisor because i could not understand how i could be denied for something i haven't even applied for yet. I considered this to be discriminatory and nature and just ridiculous. I decided to try to continue the application on my own but because of my old account i had to put a different phone number. So i put my secondary phone number and completed the application. I was told that it was denied because they were unable to verify my information. I sent in copies of my social security card and driver 's license and now i come to find out that i have been " permanently restricted '' because i made a typo on my social security by 1 digit. I stated that they have proof of what my social security is and that they should just be able to merge the profiles, delete one of them or just fix the issue. They stated that they won't do anything about it and that i can never get a card with them. Honestly i just feel like they were discriminatory from the beginning and their objective was to deny me for the card before i even applied.

This company offers both payday loans and installment loans. I took out a payday loan in order to be able to pay off my installment loan and renew it. I paid off the loan early but when I tried to initiate it again, it was denied. The stated reason was that my income was insufficient. This seems dubious for several reasons : 1. My income is the same as it was the last times I renewed the loan. 2. The loan amount is also the same, and is only {$400.00}. 3. I have the highest status in their internal reliability rating statement and a history of 100 % complete and on-time payments. The company will not allow me to apply again for 30 days, by which point the loan will not help me. In the past, they unilaterally changed the rules of their system and took away the most exclusive loans that offered friendlier rates and mandatory credit bureau reporting ( to build good credit ). This was frustrating as I was working toward the status level that would allow me to do this and had nearly attained it when they took it away. Their rates are excessively, punitively high- just like your local check-cashing place. I had continued to use them because they allowed me to choose for the {$400.00} installment loan to appear on my credit report. Now that they have denied it without giving me a legitimate reason, I will never use them again. In the long run, I will be better off because I will no longer be paying Lendup their abusive interest rates, but in the short term it has been painful. I used all of the money in my checking account to make the last payment early, so when they then did not allow me to renew the loan I found myself facing late bills and overdraft fees. I would caution anyone against using this companys services.

I have had a credit card with XXXX for about 6 months now. I have made payments to this account before online with my checking account which is stored in their system. I recently submitted a payment with this same checking account only to find that it was returned, charging me a XXXXXXXX XXXX fee, because the bank account was " unable to be located ''. So I asked them about it, and they told me to add the bank account again and submit a new payment and they would remove the fee. So I did, I submitted another payment which once again was returned for the same reason. Now I have {$50.00} in fees. Mind you, I have confirmations for all of these payments in my email. After this second attempt and fee charged, I called them again only to be told " well it might have been because you made them payment on a different platform, because your successful payment was made on the internet and your rejected payments were made over the phone '', WRONG. This is false, as I made the payments through their faulty app. The representative said he could only remove one fee after I made the payment over the phone with him, and refused to transfer me to a supervisor. So I said fine, gave him a payment over the phone, told him to remove the one fee and I would call back to get a supervisor later. " sorry sir but I can not remove the fee ''. Once again, the run around. So here I am, with XXXXXXXX XXXX in fees, lies, and no help from this horrible lender, and a payment made which who knows, will probably get rejected again! We will see! Representatives name is XXXX. Incredibly rude, refused to help, threatened to end the phone call. Unbelievable.

I have had 57 loans with this company over several years. This particular loan of {$1000.00} was initiated XX/XX/XXXX, and like previous, payments were set up to automatically debit my checking account for 9 months. I was away the early part of XXXX taking care of my parents. When I returned XX/XX/XXXX I called the company to get a paid-in-full letter and was told by a lady named XXXX ( sp? ) they had deactivated the automatic payments in XXXX and failed to contact to me -they were using an old email address of XXXX from XXXX AND they did NOT call either of my work or home numbers, or send notification to my mailing address of XXXX XXXX XXXX , # XXXX, XXXX XXXX , CA XXXX. She updated my email address and noted I could make payments via their website portal. I did so and made payments monthly and the final payment on XX/XX/XXXX. Upon reviewing my credit report in XX/XX/XXXX I learned the company reported they charged the account off for {$890.00} on XX/XX/XXXX and did NOT report any of the payments I had made right up to paying the account off XX/XX/XXXX. Even after disputing with all three Credit Bureaus they first insisted no payments had been made, and the information they reported was accurate and the account was past due {$620.00}. On the second dispute I provided bank account statements to the Credit Bureaus showing the debits and final payment made XX/XX/XXXX. Now they have switched their position again and acknowledging payments were indeed made and claiming the account was charged off in XX/XX/XXXX when I called them for the paid-in-full letter. They are now reporting the account as charged off in XXXX and paid.

During these times I have found that my internet email has been inordinately littered with requests for credit card loan and merchant credit card offerings, which may or may not be normal these days, but seem unusual and suspect. I took out two single payment loans with LendUp on XX/XX/XXXX and XX/XX/XXXX. The XX/XX/XXXX loan was in the amount of {$200.00} with an interest rate of 401.50 %. I repaid this loan as agreed on XX/XX/XXXX in the amount of {$230.00}. The XX/XX/XXXX loan was in the amount of {$350.00} with an interest rate of 521.32 %. I repaid this loan as agreed on XX/XX/XXXX in the amount of {$390.00}. While browsing recent CFPB actions, I noticed that the CFPB had filed a lawsuit against LendUp for violating the terms of a previous settlement amongst other illegal and fraudulent activity. Just as alleged in the CFPB complaint, I gained no benefit from being a repeat borrower with LendUp. Indeed, my second loan was issued at a HIGHER interest rate than my first and this loan was confected after the time period noted in the lawsuit. Interestingly, the company website now states that it's no longer in the business of direct lending, but does inform customers : " Although we're no longer lending, were now working with some third-party lenders to oer our customers multi-payment installment loans in higher amounts with longer repayment terms than the loans we previously oered. Enjoy the exibility and convenience of this new customer experience. '' I can only imagine that the third party lenders will continue exploiting consumers by engaging in usury and doing everything they can to evade state & federal regulation.

On XX/XX/XXXX my payoff amount on a {$500.00} loan was {$260.00}, I was paying {$48.00} a month. I was told if I paid off the loan with my debit card I could re-loan. I asked if I would be able to barrow more once the loan was paid off and I was told I would find out when I paid it off. OnXX/XX/XXXX I paid off the loan with my debit card and when I went to re-loan I was told I could get up to {$900.00} and I could pay it off in 12 months at {$88.00} a month. After answering some questions about income which were the same questions I had answered in the past to get the {$500.00} loan I was denied the loan and was told I could ask for a loan on XX/XX/XXXX. At no time was I given the option to barrow a lesser amount. I called XXXX and spoke to a XXXX and explained what had happened and I was basically told there was nothing they could do to over ride my payment to get a refund or barrow a lesser amount. I received a payday loan in XXXX of 2016 through the company XXXX but the lender was listed as XXXX XXXX XXXX XXXX XXXX XXXX. I defaulted and then set up a payment plan with XXXX, the collection agency that works directly with Lend Up. I have one more payment until this is completely paid in full. I began borrowing funds via payday loans from Flurish dba Lendup in XX/XX/XXXX. I made my payments on time and if I needed an extension I would request them. I accrued ladder points that would position me to borrow more funds at a lower APR. I began borrowing when LendUp was in its beginning stages and the ladder points system in Louisiana was incomplete. I borrowed so much that I made it to top tier really quickly and was not receiving the proper discounts/APR rates. Over time, I kept track of my payments and the high interest I was being charged despite what the company advertised and what I was told. I would file formal complaints and I would receive refunds. In XXXX -XX/XX/XXXX, I experienced financial hardship due to the government shut down. I reached out to LendUp to request a payment plan. I also inquired about the wrong interest rates and stated that I was being charged the wrong amount considering my ladder points. This is not the first time this happened. I took a loan out for XXXX and it was set to take out on XX/XX/XXXX. I called in on XX/XX/XXXX to have it extended to my next pay date of XX/XX/XXXX. Now before this call I already called in previously to inquire my options so I knew which option I was going with as the rep was also aware upon reading the notes. I have borrowed from XXXX since XX/XX/XXXX using my phone to conduct loans online. There has been only one incident in the past about completing a loan due to a " glitch '' in their software. Was resolved, although not quickly. I have never missed a payment and have sometimes paid early. I live in Wisconsin. I called LendUp and explained that my account is still open but being reported as closed on my credit report. I was asked to take a pic of the account showing its closed. I took one picture because its been reported to all credit reporting agency. They told me it would be a couple days and should be resolved and it still remains on my credit report dropping my scores because its listed as closed. They reported it closed because there was a .89 transaction made on the account last month that was not by me. So instead of calling, emailing, texting or evening faxing they decided to report my account as closed. The first time I called about the problem their attitude was terrible and they transferred me to the fraud department. They put me on hold and then hung up the phone and never called back. The fraud department operator was very rude and nasty to me. Terrible customer service and the company communication is the worst I have ever experience or seen in my life. LendUp could care less what it did to my credit report they just keep claiming it will be fixed. After 4 phone calls to the company its still on my credit report.

Hi, Around XXXX - XXXX of 2016 i fell victim to identity theft and my information was used to illegally apply for a loan from this company.This company allowed a fraudulent account to be opened in my name without my permission. I have been doing business with Lendup.com for some time now and have not had a problem with them except for this month. I established an installment loan with them of {$500.00} a few month ago and agreed to pay payments of {$93.00} per month, due on the XXXX of the month. I received a loan from this company on XX/XX/17, outlined in the agreement a payment schedule of XXXX was to be paid on XX/XX/17, XX/XX/17, XX/XX/17, XX/XX/17 and XX/XX/17 by automatic withdrawal. I never received any correspondence from Flurish Inc but they did mark my reports as disputed-resolved consumer disagrees. After a month with the card, I was not comfortable with the telephone customer service and the lack of information you receive on their website. I experienced financial difficulty as the result of the government shut down and was unable to remit a payment on my loans. A male rep reached out to me regarding the loans and we discussed a payment plan and I expressed my concern regarding being charged a higher APR rate/fees when it was suppose to be lower based on my level as the result of my ladder points. I was told that he would look into it and if I made so many payments the remaining balance would be waived. I applied for a payday loan in the amount of {$250.00} from LendUp.com. As of now, they show that I still owe them but I never received the money because while it shows it was successfully deposited on XXXX/XXXX/14 ( which was my ONLY deposit on XXXX/XXXX/14 ) there is also a reversal of {$250.00} + a {$5.00} fee charged to my account. So, I essentially never received the money. On XX/XX/2018 a cashier 's check was issued in the amount of {$740.00} to XXXX from XXXX as a credit consolidation and was mailed to XXXX with a tracking number. All of the appropriate information was on the check such as account number and name and also had a statement stub attached to the check. XXXX received the cashier 's check on XX/XX/2018 and still has not processed this payment. XXXX can not cancel and reissue this due to it being a cashier 's check. LendUp is refusing to credit my account for this amount and in the meantime I'm still paying a minimum payment to them every month so it won't affect my credit score. We have the tracking information that they received it as well as the check stub saying that it was written. They are saying they can't find it and we should have paid it online.

I am attempting to cancel a credit card. I called the customer service line provided on the back of the credit card on 3 separate occasions on XX/XX/19 and XX/XX/19. First, it's pretty difficult to actually get to a customer service representative ( CSR ) and when I finally do and inform the CSR I wish to cancel the card, the CSR 'checks ' my account and then informs me another department has to process the cancellation and provides me a number to call. The number provided is the same number I dialed to get to the CSR I'm talking to. When I inform the CSR of this fact the CSR insists it's the only number available. LendUps payment processing system wont process a payment using two different MasterCards. The error message is does not state a reason. This issue was duplicated by Lendup via phone support. Lendup is aware of the issue as it is indicated on my account early 2018 when first reported this issue. They have not resolved it and have not been able to process my payments. Although they say this is being investigated as an issue with their system, Lendup has still negatively affected my credit. I have made regular attempts to pay and their system still fails. It even fails with the account they sent the initial loan money to. They will communicate this issue with me over the phone but are very careful not to indicate it via email. I applied for a credit card, and was approved back in XXXX. My card and pin were supposed to get to me 10-15 days after. Both in separate envelopes. I did not receive either of them. I noticed that this company is reporting a bad debt under my Social Security number to XXXX XXXX and XXXX. I wrote a letter via certified mail formally disputing the account. Per FCRA, The creditor must validate and provide me with proof that the debt is truly mine. Valid proof should include something like a contract signed by me. We contacted the company and they agreed in writing ( even providing a reference number ) that they would update my credit report with all three bureaus to show that it was never delinquent.
