Lendmart is threatening to take me to court, via emails and calls. The debt was originated in 2017 and I have made every attempt to work with a debt consultation agency in writing. I have worked with debt resolutions center regarding this account and payments were made to Lendmart via XXXX XXXX debt resolution company. I am no longer able to continue my account with XXXX It and Lendmart continues to threaten me via email. They have said they will contact my employer and garnish my wages, I am a XXXX and I only work part time due to COVID 19. My hours have been reduced due to the pandemic and I am severely affected financially. I am on assistance from the HERO act and I can barely afford my bills. Lendmart states they have sent my account to collections but it does not appear on my credit reports nor do they use an outside party to send their emails. They still own my account and are being dishonest about having the account go to collections to a third party. I am providing a copy of their correspondence with me below : " If you do not do one of the three things listed below within fifteen ( 15 ) days of the date of the mailing of this notice or of its service by the court, we will go to court, unless we are otherwise precluded by law from doing so, and ask that your employer be ordered to withhold money from your earnings until the judgment is paid in full or, if applicable, is paid to a certain extent and to pay the withheld money to the court in satisfaction of your debt. This is called garnishment of personal earnings. It is to your advantage to avoid garnishment of personal earnings because the placing of the extra burden on your employer possibly could cause you to lose your job. YOU CAN AVOID THE GARNISHMENT BY DOING ONE OF THESE THREE THINGS WITHIN THE FIFTEEN ( 15 ) DAY PERIOD ( 1 ) Pay to us the amount due ; ( 2 ) Avail our 50 % settlement offer ( 3 ) Via Debit card There may not be enough time to set up an agreement for debt scheduling in order to avoid a garnishment of your wages based upon this demand for payment, but entering into an agreement for debt scheduling might protect you from future garnishments of your wages. Under an agreement for debt scheduling, you will have to regularly pay a portion of your income to the service until the debts subject to the agreement are paid off. This portion of your income will be paid by the service to your creditors who are owed debts subject to the agreement. This can be to your advantage because these creditors can not garnish your wages while you make your payments to the service on time. Lendmart has charged me 14 times in one day on XX/XX/18, via an ach withdrawal which I only authorized one payment amount to be paid for {$68.00} for XX/XX/18. They sent an email stating they have not charged me since XX/XX/18, however I have my bank statement showing the charges from this company. They later claimed an outside merchant charged my bank account 14 x, my bank account was drained, I was without money and had to leave work. The Banker sat there with me and could see the charges continue to be taken out of my account. They had to stop my account and made a claim through XXXX XXXX. Also my bank will also have to issue me a credit for Lendmart 's error which they are under investigation with my bank XXXX XXXX as well. Today XX/XX/18 I received an email saying I am now past due, which is impossible, as they have taken out several payments in one day. A few months ago Lendmart also took out money from a different account that was not only my account, I did not give permission on, I only made a previous payment with said account and they had to refund that charge.

Starting on Monday, XX/XX/XXXX until Today, I have called 8 times to their toll free number XXXX to get a payoff quote to pay the loan off. Each time I waited for 5 minutes on hold, then was told to leave a message and I would get a return call. Each time I left a message and my cell phone number. I finally got a call back late Tuesday XX/XX/XXXX and was provided a payoff for XX/XX/2018. They would not process a payoff sooner, charging me interest for 3 additional days. The interest rate on this loan is 149 %. Please note, although I provided my bank account information for a payoff on Friday, XX/XX/1018 I am NOT sure this will go thru. There was also an attempt and/or questions as to why I am paying off this loan early as they were trying to talk me out of it.

On more than XXXX occasion, I was called at work and on my cell phone by an Account Manager XXXX. An account manager left several messages for me through the office manager at my job. This has caused complete embarrassment and anxiety for me at work. More recently I've received numerous threatening emails. This ordeal has given me anxiety and stress. I communicated that I do want to work to clear my debt and that I'm currently under dire financial constraints. When I didn't reply as quickly as the Account Manager, XXXX XXXX expected, I was harassed.
