I am XXXX XXXX, XXXX of the Note that was created via the Application done with XXXX XXXX XXXX XXXX, which created the CREDIT. I was never informed or aware I would be an investor/party in a asset backed securities. According to the agreement on hand, my obligation was concluded from inspection of the transaction. I was also not informed that LendBuzz Funding LLC was a licensed DEBT collection agency as I was told LendBuzz Funding LLC is a Financial Institution. The document I received from LendBuzz Funding LLC XX/XX/XXXX " Payoff Statement '' is a clear indication that this is an attempt to collect a debt. This is a violation of my rights pursuant to the FDCPA. I am also confused as to the false and misleading correspondence LendBuzz Funding LLC has sent me with the terms Money Amount Owe " Payment '' that evidenced the actions of a Debt Collector. Is LendBuzz Funding LLC a financial Institution or, are they in the business of collecting Debts? LendBuzz Funding LLC has claimed I have broken promises in our agreement but has failed to disclose specifics as to how I have broken Any alleged promises made, nor have they responded to any of my written correspondents via registered and certified mails, demanding LendBuzz Funding LLC to provide me the way to pay them monies owed. Gold, Silver, coffee beans, legal tender, or the form of currency they are demanding PAYMENT. LendBuzz Funding LLC was acting above the law or just ignorant to them but ignorance of the law is no excuse. We the People were made private bankers according to the law with the authority to issue notes to discharge lawful debts. This must remain in effect until money and the property is returned to We the People without any encumbrances. '' LEGAL TENDER DEFINED : Legal Tender under the Uniform Commercial Code ( U.C.C. ), Section 1-201 ( 24 ) ( Official Comment ) : The referenced Official Comment notes that the definition of money is not limited to legal tender under U.C.C. The test adopted is that of action of the government, whether by authorization before issue or adoption afterward, which recognizes the circulating medium as a part of the official currency of that government. The narrow view is limited to, legal tender is rejected. '' in light of the holding of [ Fidelity Bank Guarantee vs. Henwood, 307 U.S. 847 ( 1939 ) ] a Federal US court of appeals ruled on Title 13 USC 5118. As of XX/XX/XXXX, Legal Tender for discharge is no longer required. That is because legal tender is not in circulation at par with promises to pay credit. Requirement of repayment of debt is against Public Policy, since legal tender was not loaned [ nor in circulation ] A payment or repayment is to be made in equivalent kind ; A negotiable instrument which I have not once received from XXXX XXXX XXXX. Despite all my efforts to resolve these claims, LendBuzz Funding LLC 's negligence and failure to provide the correct way to resolve the issue at hand left me without my property. For the record, if LendBuzz Funding LLC can provide me with the sum certain on the penal funds I have no problem to effect payment. I believe under further review LendBuzz Funding LLC may be in violation of Civil Rico Racketeering Laws 18 U.S.C 1964 as LendBuzz Funding LLC may have established a pattern of Racketeering activity by using mail and other means to collect an unlawful debt. Good afternoon XXXX XXXX, I hope this email finds you well. I come to you in honor and in good faith about several written correspondence I have sent to your offices, addressing my dispute and concerns regarding the transaction between I XXXX XXXX, and the creditor/dealer XXXXXXXX XXXX XXXX XXXXXXXX. I am aware that XXXX XXXX entered and completed a consumer credit transaction by signing a credit application which created the promissory note, but was told his credit is marginal, then signed over 20 pages of documents prepared by the dealer/creditor. Among the papers signed are a buyer 's order, a yo-yo form and a RISC - ( Retail Installment Sales Contract ) which contains a " Seller 's Right to Cancel '' Regardless of the euphemism, such forms and provisions are flatly illegal contrary to ; TILA, the FCRA, The ECOA and UDAP. Such deceptive actions mislead XXXX XXXX to accept draconian credit terms. Furthermore, The consummation of the transaction was completed the moment I completed the application and the dealer received full compensation based on the value of said NOTE/APPLICATION. XXXX XXXXXXXX XXXX XXXXXXXX and XXXX XXXX XXXX Failed to make clear and full conspicuously disclosure of TILA is a violation of my rights. TILA requires sellers to adhere to its purpose whether they reside in Florida, Illinois, Virginia, or California, Any form or pre-printed provisions such as a " Sellers Right To Cancel '' which purports to disclaim the seller 's creditor status is illegal and is flatly deceptive, unfair, and unconscionable trade practices contrary to the public policy enacted by TILA. As the Supreme Court observed in Brooklyn Savings Bank v, O'neil, 324 U.S. 697,65 S.Ct. 900-01 ( 1945 ) : Lendbuzz has also lied to the CFPB in regards to my previous CFPB complaint by responding, and I quote " Lendbuzz Funding, LLC reviewed the account to investigate the complaint. After review it was determined that the loan was appropriately provided. We then contacted the customer to see if we could resolve his concerns. The customer stated that he wanted to remove our security interest from the loan, which we could not do. We offered the customer alternate solutions, which he rejected. We will continue to work with the customer. '' I have reviewed all the extra documents ( RISC - Retail Installment Sales Contract ) and the Security agreement which was described as a consumer credit transaction given to XXXX XXXX to sign, which was then assigned to LendBuzz Funding LLC. Within these documents Lendbuzz Funding LLC has indicated numerous times they gave XXXX XXXX a LOAN, but according to the UCCC Section 3.301 ( 1 ) ( UNIFORM CONSUMER CREDIT CODE - XXXX ) The financing of an automobile by a bank was not a consumer loan transaction where the bank was only the assignee of the automobile sales contract and therefore acted illegally in taking security interest in addition to the purchased automobile. First nat. Bank Vs La Joie ( OKLA ) 537 P2d 1207, 86 ALR3rd 309. At no point in time have I asked Lendbuzz to release security interest in a LOAN which was not there from inception. I have demanded lendbuzz and The dealer to release my title that they are holding by extortionate means to have me pay for my property ( AUTOMOBILE ) more than once using yoyo forms Knowing that the dealer was the one who was given a loan after I, the consumer gave value to the dealer with the signed application and the RISC. The fact that I have been sending written correspondence since XX/XX/XXXX to both the dealer and the financial institution and neither has tried to resolve or respond to any of my disputes. I am left to assume that your company and representatives are in the business of fraud, coercion, racketeering, deception, trust fraud, taking advantage of innocent consumers, theft and misleading practices. Lendbuzz Funding LLC has repossessed my property without my consent which would be considered theft and damages to my personal property. The unlawful repossession of my property by Lendbuzz Funding has caused me major loss of wages, XXXX XXXX and stress. I have not received a notice in regard to me being in default or breach of contract or any form of notice of opportunity to cure such default according to federal and state laws. Furthermore there Is no contract between myself and Lendbuzz for my property. Myself on the other hand have received all return receipt slips showing proof that Lendbuzz Funding LLC and XXXX XXXXXXXX XXXX XXXX received and signed my affidavits of demands and all other exhibits.

Your company used my credit card ( AKA SSN ) 16 CFR 433.1 ( h ) Credit card issuer. A person who extends to cardholders the right to use a credit card in connection with purchases of goods or services. In a consumer credit transaction 12 CFR 1002.2 ( h ) Consumer credit means credit extended to a natural person primarily for personal, family, or household purposes. I did not received & benefit in this transaction which is identity theft Pursuant to CFR 1026.12 ( B ) ( 1 ) ( i ). Your Company Lendbuzz said in there letter that the reporting agency played no part in your company decision and cant supply specific reasons of why Lendbuzz denied me credit and then False and Misleading me the Consumer by saying your company Lendbuzz decision was based in a whole or in part on information that came from the consumer reporting agency which is XXXX. Pursuant to ECOA ( Equal Credit Opportunity Act ) Regulation that aims to give all legal individuals an equal opportunity to obtain loans and other types of credit from financial institutions/ lenders under Title 15 your company Lendbuzz are prohibit by lenders in any aspect of granting credit to an individual. The acts purpose is to prevent lenders from using race, color, sex, religion or other non- creditworthiness factors when evaluating a loan application, establishing terms of a loan, or any other aspect of credit transaction. Organizations that have shown a pattern of discrimination can have lawsuits brought against them by the Department of Justice. The owner who bought the car was XXXX XXXX ( XXXX ) XXXX, ( XXXX ) XXXX. He agreed that the total price including tax would be US {$16000.00}. He persuaded me to lend me US {$10000.00} at the car dealership, and the loan fee was US {$1000.00}. The other {$6500.00} is composed of {$4300.00} in discounted old cars ( a XXXX XXXX was also bought at the XXXX XXXX in XXXX for {$4800.00} ), {$1700.00} in bank transfers, and {$500.00} in cash ). All the procedures of the loan were handled through the first-stop second-hand car dealer, who asked me for a California driver 's license XXXX a XXXX passport, a US visa, and a US bank address certificate XXXX On XX/XX/XXXX, I saw the email from the loan bank I received on XX/XX/XXXX. The loan bank is Lendbuzz. Through the translation software, I know that the principal of the loan given to me by the first car dealer is {$16000.00}, and the car price is {$21000.00}, which is different from the actual car price. I rushed to the second-hand car dealer at the first stop on the XXXX, but I didn't get an answer about the car price. I found the loan bank Lendbuzz, on XX/XX/XXXX, the loan customer service XXXX ( XXXX ) XXXX gave me the answer that the car purchase contract with me was a car dealership located in XXXX, XXXX XXXX, Address : XXXX XXXX XXXX, XXXX, CA XXXX, Phone : ( XXXX ) XXXX. I haven't gone through this dealership since I bought this used car and I haven't been to XXXX. On XX/XX/XXXX, through verbal communication with the bank, I agreed that no repayment will be required for the time being. I disapprove of the {$5500.00} excess on the loan and can not afford it. My name is XXXX XXXX XXXX XXXX, I am writing this complaint under the penalty of perjury. I have never had - previously or currently, any accounts or dealings with the financial institution LENDBUZZ FUNDING LLC., www.lendbuzz.com, XXXX XXXX XXXX XXXX XXXX, XXXX XXXX MA XXXX, ( XXXX ) XXXX. During the process of purchasing a home I discovered through my credit report provided by XXXX that this financial institution reported on my credit an automobile purchased in XXXX of 2021 for the total amount of {$18000.00} with a current balance due of XXXX. Upon conversations with the financial institution and the auto sales shop it was discovered, clearly and conspicuously, that the purchase belongs to my older brother. We presented the contract number to LENDBUZZ ( which they confirmed they have it on file ) and they also confirmed that the purchase was made without an SSN or an ITIN number and that my non-public or public information was never a part of the process. I have no idea how they got a hold of my non-public information to add this debt to my credit report. We spoke to several people within their organization, including the supervisor XXXX and they refuse to remove it unless we file a complaint with all three credit bureaus. I consider unconscionable that they would make such an error and not fix the problem themselves giving that they have the sales contract in their files. They alleged the need to investigate, even though they have the contract as evidence that the vehicle does not belong to me and that they receive monthly automatic payments from an account that does not belong to me. How many others have they reported onto their credit reports without cause? I hope the CFPB can investigate how they get a hold of SSNs and report incorrect debts to the credit bureaus.

I purchased a vehicle in XXXX of XXXX with a down payment of {$20000.00} I was originally told by the dealership that the internet rate would be 12 % only to later find out that it was 13.87 %. I hit a hardship where I had to make substantial repairs to the vehicle which cased me to fall behind on payments. I was 2 months behind on the payment as a result of this at the time. I was attempting to contact the lender who is XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, MA XXXX. I was unsuccessful in my efforts to speak with them. Every time I called I got the automated service. The vehicle was repossessed on XX/XX/XXXX. Upon my attempts to pay my past due balances and retrieve my vehicle I was told that they would not accept the payment but instead wanted the entire balance owed on the loan which is {$32000.00}. I attempted numerous times to get in touch with someone in charge that could resolve the matter and was not able to. Since i opened the account with lendebuzz they haven't actively report the account to the credit bureaus, i had made another complain before witch they only reported the months before but they never reported again since 6 months ago, on my experian doesnt even show up Which is a clearly violations of Fair credit act, i had paid my loan already and they haven't reported yet
