My complaint is regarding failure to prove the validity and proper assignment proof of ownership and or custodial servicing rights of my mortgage debt. The loan in question derived from the purchase of my current residence which was completed on XXXX XXXX, XXXX, as an XXXX subprime mortgage loan. This particular portion of my loan is the XXXX mortgage and it has been transferred from XXXX, at XXXX XXXX, XXXX, CA. XXXX and at some point in XXXX XXXX, to XXXX XXXX XXXX ( XXXX ) at XXXX, TX. XXXX, after closing. This debt was discharged in my Chapter XXXX bankruptcy filed in XXXX. In XXXX of XXXX, I attempted to locate my XXXX mortgage lien holder in order to determine if the debt had been liquidated or " Stripped Away '' within my bankruptcy by contacting the XXXX XXXX property records department. After careful review of the lien holders on title for my property it was established that the last recorded lien holder was XXXX. After extensive additional research, it was discovered that XXXX XXXX XXXX ( XXXX ), acquisitioned XXXX in XXXX, during my execution of Chapter XXXX bankruptcy. XXXX, was contacted immediately in XXXX XXXX and XXXX to no avail, and we were not given any information in regards to ownership nor servicing information of any kind after multiple attempts. We also reached out to the holder of the Deed of Trust XXXX and there records indicated as well that XXXX and or XXXX should have the records for the loan. After multiple attempts at locating my second mortgage debt within XXXX extremely convoluted infrastructure and multiple consumer complaints filed on XXXX XXXX, XXXX, which resulted in XXXX claiming to have no knowledge of the debt.Finally there was a letter received from XXXX, which is the holder of the Deed of Trust account advising for us to contact XXXX, and speak with XXXX XXXX XXXX. *See Exhibit " A '' Letter from XXXX dated XXXX XXXX, XXXX, identifying XXXX as the new servicer.We immediately contacted the Director of XXXX Ombudsman 's Office named XXXX XXXX at : XXXXXXXXXXXX, via email and phone from XXXX XXXX, through XXXX XXXX, XXXX. He finally responded via email on XXXX XXXX, XXXX, stating that he was unable to locate the loan in question and we never heard from him again. I had no choice but to eventually file additional complaints with banking regulatory agencies in order to force a logical response on XXXX XXXX, XXXX. *See Exhibit " B '' Response email from XXXX XXXX XXXX from XXXX. XXXX, responded to the XXXX set of complaints, which slammed XXXX XXXX regarding his refusal to respond to any more requests to the whereabouts and location of our XXXX mortgage. This notice dated XXXX XXXX, XXXX came from and was addressed by a XXXX XXXX XXXX of the XXXX Ombudsman 's Office. *See Exhibit " C '' Letter from XXXX, naming Mountain XXXX XXXX XXXX XXXX holder of my XXXX Mortgage. The response provided by XXXX, was an alleged outdated letter from XXXX, XXXX XXXX, XXXX stating that my loan was transferred to a XXXX XXXX XXXX XXXX ( XXXX ) at XXXX XXXX XXXX XXXX XXXX XXXX. XXXX, CO XXXX, owned by Attorney XXXX XXXX XXXX, XXXX on XXXX XXXX, XXXX. XXXX XXXX was then contacted on XXXX XXXX, XXXX and he was quite flustered when questioned about the information and paper trail that led to his company XXXX. He attempted to explain how his former company had possibly been assigned the loan, however the company XXXX had been defunct years ago and that he needed to research the matter. On XXXX XXXX, XXXX, XXXX XXXX then passed us on to an attorney by the name of XXXX XXXX at XXXX, from XXXX.at : XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, CO. XXXX

I am the co-signer of some private student loans that my daughter had defaulted on back in XXXX. In XXXX I was notified by a collection agency that they would start proceedings to take my house if I did not start paying on the loans. My daughter was in the process of legal proceedings at the time which were going to result in state prison time so I set up a repayment plan with the collection company immediately. Since XXXX of XXXX either myself and then later my daughter have consistently made monthly payments to this collection agency for the amount agreed upon. At the time the collection agency took over the loan we owed them approximately {$24000.00}. Over the last 11 1/2 years we have paid them approximately {$35000.00}. The collection agency states we still owe them approximately {$13000.00}. We have never received documentation from the collection agency what the monthly interest rate and collection fees would be. This past XXXX they sent correspondence for two of the six accounts on what amount has gone onto principle towards the balance for those two accounts. We have received nothing about the other four accounts. For the two accounts they did send documentation for the following amounts were given -- opening balance on account XXXX, current balance on account XXXX and amount paid since XXXX on account XXXX. The other account had an opening balance of XXXX, current balance due of XXXX and amount paid since XXXX XXXX. If the other four accounts have similar scenarios how are we to ever get these accounts paid? At what point does it become extortion for these collection agencies to continue to pile on such exorbitant fees and interest year after year. When we make contact with the collection company they tell use we can send them a " pay off amount '' that is a huge lump sum, but without that there is nothing else they can do for us. By not providing us with the proper documentation of what their interest rate and collection fees would be are they in violation of our rights? Why have they not provided us with regular documentation of the accounts and why did they send us only information on two of the six accounts? Why is there not some type of amortization table provided by them since the beginning when we set up payments so we would know when the debt would be completely paid?

This is about an old forgiven and settled mortgages originated in XX/XX/XXXX by XXXX XXXX XXXX XXXX XXXX In XXXX Owned originated a 1st loan at 80 % and a 2nd loan at 10 %, we put 10 % on this purchase loan. XXXX was the first lender seeking federal protection at the very beginning of the market crash. All its assets were purchased by XXXX who in turn later, after going bankrupt, sold them to XXXX XXXX XXXX. All three companies got bailed out by the government and got billions of dollars in tax breaks. In XXXX XXXX XXXX XXXX, the owner of both loans, in accordance to the " National Settlement Act of the Obama administration '' worked out a Loan Modification on the 1st loan and eliminated/got credit by Federal program the 2nd lien in XXXX with us. We were told then by XXXX XXXX XXXX representative that the 2nd lien was " taken cared of ''. Everything was fine until around XXXX when a company by the name of Reliance reached out " claiming ownership of the 2nd lien ''. After presenting evidence of above arrangements with original owner of both liens, XXXX XXXX XXXX, Reliance proposed a {$3000.00} " settlement '' because a lawsuit may be " costly ''. After their " threatening '' position, we send them the documents requested by them but never heard back from them. Now, seven years later, a new company by the name of LCS Financial Services Corp, reached out my Bankruptcy attorney claiming ownership of same 2nd lien. I responded with above facts and evidence and requested a QUALIFIED WRITTEN REQUEST on XX/XX/XXXX. I called them today XX/XX/XXXX and left a message. My concern is that these collection companies technique is to delay the process because sooner or later they will collect with their bogus techniques, just like Reliance they have not even acknowledged my correspondence. During the months of XXXX XXXX. We received a letter from LCS Financial sending a demand for payment on the second mortgage loan that was charged off in XX/XX/XXXX. The letter referenced LCS Financial was collecting the debt for XXXX XXXXe company who was listed as the servicer for the loan. Since LCS couldn't provide any documentation that actually provided that XXXX XXXX was the actual servicer of the second mortgage loan, I ask for additional information from LCS. On XX/XX/XXXX I received an email from LCS and they reference they were in receipt of my dispute with them and they wouldn't be providing any more written correspondence or documents. See a copy of the attached email from LCS. I kept requesting and no information was provided by LCS. On XX/XX/XXXX, I received a demand letter from LCS and they continued to reference XXXX XXXX as the client they are collecting the debt. see attached letter. So on XX/XX/XXXX, I send a QWR to XXXX XXXX which outlined my request to confirm they actually were the servicer for the second mortgage. Please find a copy of the QWR request. As of XX/XX/XXXX. No response. Please find attached the receipt of the OWR and when it was signed for by XXXX XXXX.USPS certified letter was delivered. On XX/XX/XXXX I received an email from XXXX XXXX XXXX asking me and LCS Financial, to provide the following : A copy of the title report showing the lien is outstanding and also the following information. Please also provide copies of the recorded Mortgage, Assignments and any payoff information you may have, such as a copy of the payoff statement and/or the HUD1 Settlement Statement. This will help with locating the account in our records. This last request was very upsetting since if in fact, XXXX XXXX was actually our servicer, wouldn't in fact, they should already have this information in their system? My name is XXXX XXXX XXXX. InXX/XX/2007 I became late on a second mortgage that was through XXXX XXXX XXXX. The debt was subsequently sold a number of times including to XXXX and now LCS. The debt was satisfied as part of a Home Affordable Refinance by the government prior to ever hearing of LCS and the debt is no longer owed and should never have been sold. LCS continues to call me although I have requested that they stop. They continue to ask me to call XXXX or XXXX. I have called and requested that they stop contacting me about this debt, which is no longer valid. I called today and the person on the phone hung up the phone on me. To top this off this company has TWICE pulled my credit report with a hard inquiry when they have not been given permission to do such. They pulled my report in XXXX and again today on XX/XX/XXXX. At no time have I given permission to do this, and I DO NOT have a business relationship with this company. Perhaps there is confusion bc my mortgage was with XXXX, who is out of business. XXXX XXXX XXXX is also out of business. I have no legal relationship with this company, do not owe the debt in question, and want them to cease contact of me in any way, as well as to immediately stop unauthorized pulls of my credit report. I do not have an account number for them but my social is XXXX. XXXX XXXX is providing information pertaining to the identity theft that took place with my information. This company was presented with several police reports as well as identity theft affidavit report, federal trade commission report and now they report with the consumer financial protection bureau. Upon contacting the three major credit reporting agencies, I discovered that XXXX of the XXXX credit XXXX agencies did not investigate the information based on the fact that they thought it was a duplicate request. The documentation was presented with shows it was not a duplicate request and that it shouldve been processed immediately upon the consumers request to do so. By failing to properly investigate this fraudulent item for the consumers request, this company violated the fair credit reporting act as well as the fair debit collection practices act. Failure to you processes investigation, has left the customer without any means of using their credit to take the services for their family. This negative item has impacted the consumer financially. Furthermore, I also fear that this company has violated state and local laws. Upon receiving that information and their negligence to process the investigation, his company did indeed go in a different direction. They found a judgment on an account that they know was being disputed as I didnt either in an attempt to deprive the consumer of their money knowing that it will be a long drawn out process for the customer to receive any funds back.

This is a debt that had past its statute of limitations years ago. It 's no longer on my credit report and was n't there even when I filed for personal bankruptcy in 2008. This company LCS financial called me and told me I owed tens of thousands of dollars and I needed to make a payment. The person on the phone then read me a disclosure at light speed and when I stated that I did n't understand what he said he said sorry to hear that. I told him I currently have no income, XXXX kids and no property so I was n't making any payment not to mention that I did n't understand the debt. The letter said I owed XXXX and the person on the phone said I owed XXXX loans totaling XXXX. I was then told that I had a phone so the whole XXXX kids no job 'excuse ' meant nothing to him. He finally marked it down as a refusal to pay. My husband then called back and talked to a supervisor and he was told that all the legal talk at light speed basically said that they knew the debt expired, they could n't take legal action and they could n't attach my credit report unless I made a payment. They were trying to trick me into hurting myself. It 's not right.

I received a letter dated XX/XX/XXXX, indicating my information was part of a data breach from LCS Financial ( principal ). The letter came from a company called XXXX ( 3rd party, attached ), but the information was held by LCS Financial. I made multiple inquiries. During which the 3rd party eventually shared LCS was a debt collection agency who had my information for a XXXX or XXXX XXXX loan. I DO NOT HAVE either. I am current on all my obligations and have been since my XXXX XXXX XXXX XXXX. That XXXX was the result of taking care of a parent that initially needed 3-6 months of care and wound up needing 3 1/2 years of care. None of those loans were XXXX or XXXX XXXX. More importantly, they were XXXX in XX/XX/XXXX. Therefore no debt collection records should exist. And no collection agency should have possession of my information, specifically LCS Financial. My account was garnished for XXXX dollars. This account is my bills payment account with XXXX XXXX. I was not informed that my account was frozen by the bank until I tried to use my bank card. When I went to the bank they informed me to contact an attorney. They did not inform me that my account was frozen. The bank did not communicate with me. I was told by XXXX XXXX in XXXX XXXX, FL that they can not do anything for me. They said that I should hire an attorney. Hello, today XX/XX/2021 I found out that LCS Capital, one of my debt collectors, has been contacting my supervisor at my job on a regular basis. I found LCS 's phone number ( the same on they call me with everyday ) inside of my coworker 's phone. I asked my coworker about it and she denied everything about it even though we have the same number in both of our phones ( I have proof ) Now it would be important to note that my Supervisor doesn't have any private debt because she didn't go to college. It is also clear in the debt practices that a debt collector is not supposed to be contacting the people around me. .I want them to be penalized for this and I want them to stay out of my professional and personal life because it seems like they have no problem stepping over the line.

I received a alert that my credit was pulled for a installment loan. I havent applied for a loan so I called them. I provided my info and she stated it was in regards to a home my ex husband and I purchased in XXXX. I have been divorced from him since XXXX and I also filed bankruptcy which was discharged in XXXX that includes the house. I advised that I didnt authorize them to check my credit and I had never even heard of the company before. She stated something about them trying to collect a debt. I asked for it to be removed from my report because I didnt tell them they could run my credit for a home I havent had since XXXX and again was discharged on my bankruptcy. I told the guy that keeps calling XXXX XXXX, that I had XXXX XXXX and have no record of this debt. He calls 4-5 times a day. I called and told him that he was not to call me because it was causing emotional stress after a major XXXX and that he could only contact me through written correspondence.
