I received a letter from XXXX XXXX XXXX XXXX XXXX, XXXX. dated XXXX XXXX, XXXX in my personal mailbox on the evening of XXXX XXXX, XXXX. The letter stated that they are a debt collector and are trying to collect a debt from me. I immediately called the business the next day, XXXX XXXX, XXXX, while I was at work and asked what the debt was about and how they came up with the amount owed. To my knowledge, the debt they are attempting to collect on was charged off from the original creditor and sold to another company, not XXXX XXXX XXXX and XXXX, XXXX. I spoke to a customer service representative who identified herself as XXXX on the phone and told her I was willing to work out a payment plan to pay off the debt if was truly verified as mine. I explained that I only have XXXX income and could not afford more than {$20.00} per month as a payment, which is a major reason this debt was originally charged off and sent to collections. XXXX said that XXXX XXXX XXXX XXXX XXXX, XXXX. would not accept less than a payment of {$91.00} per month, to which I replied that this amount was not feasible on my income. I asked what would happen to me if I only made small payments and not the {$91.00} payment that I had no way of making and XXXX told me that her company could sue me and garnish my wages. I reported XXXX XXXX XXXX XXXX XXXX, XXXX. to the XXXX XXXX XXXX and Michigan Attorney General 's office in an attempt to protect myself from have legal action pursued against me as I am genuinely attempting to work with this business and pay this debt. I feel that XXXX XXXX XXXX XXXX XXXX, XXXX. does not care that I am willing to make payment arrangements with them, that I have XXXX income and I 'm living in poverty or that I am making an honest effort to repay my debt. They have poor business practices and to threaten legal action right away is very threatening and unacceptable.

This collector refuses to provide any written verification of debt or any requested information for that matter. At the judgement hearing, the attorney stated that he would send me the agreement to file a motion to set aside if I were to pay the judgement in full by the end of the following month. Nine days left of the month and I finally contacted them to request this information and they claim to have no knowledge of it, yet inform me that I now owe over {$200.00} more than the judgement due to statutory interest. They request that I call back the following day to see if they had a chance to speak with the lawyer. I was n't able to call back until 6 days later, only to find that instead of sending me the requested information, they filed a garnishment instead. I feel like they use the courts to prey on people who are n't able to protect themselves and do so using tactics like demanding you allow them to garnish real property if signing a payment agreement. I was not taken seriously during the entire court process by either the court or the collection agency and they need to be stopped from abusing their power. They still have not issued the garnishment or sent me anything in writing concerning the amount of interest they are now attempting to collect on as well.

I was garnisheed by Timothy E. Baxter & Associates for a balance of {$150.00} and I never received a notice that I was being garnisheed until after the money was taken from my savings account with my credit union when they sent me the notice. I never even knew this debt still existed until I was garnisheed by Timothy E. Baxter & Associates. The notice that they sent to my credit union was supposed to be received by me within 7 days of filing and I did n't receive the notice until today which is XXXX XXXX, 2016. I never received any communication about this debt until I was garnisheed i.e. the only communication I received was from my credit union after I was garnisheed.

On XX/XX/18 I received a credit alert from XXXX that a new hard inquiry was on my report. When I checked it was from the Law Offices of Timothy Baxter stating I applied for a new line of credit. I have never heard of or authorized this company to access my report. I immediately contacted the company and was told by XXXX they dont need permission to run my credit. I then called XXXX who removed the inquiry and placed a freeze and fraud alert on my account. Come to find out this is a debt collection agency attempting to collect an old debt HOWEVER they should not ran my credit as an attempt to say I applied for a new line of credit which I never did.

I understand that I do owe for the credit card, I 'm not denying that. However, when I called a spoke with a representative from the law office and explained that i am the only one with income. I told her I was willing to pay XXXX to XXXX dollars a month. She told me that was unacceptable. Next thing I knew they went into my bank account and took all my money. I have absolutely no money, no food,, light bill is due, car insurance, and other bills that I automatically have taken out of my account. I could understand if they took some, but, they left my account with a zero balance. I guess my question is can they do that?

On XX/XX/XXXX the law office of timothy pulled my credit report without my consent. I've never heard of this company or to my knowledge never done business with this company so I'm not sure why they would be request my credit report without my consent.
On XX/XX/XXXX the law offices of timothy pulled my credit report again without my consent on XX/XX/XXXX i contacted Experian and let them know about these unauthorized inquires and they told me they could pull my credit if i owed them a debt and i know that's not true this is against fdcpa

I have reported this law office 2 times already. I have called them twice and told them I am not the person they are looking for. This person was married to my brother almost 30 years ago. She has NEVER lived with me or been at this phone number. I have told them this. I have not seen or heard from this women in 30 years. They stopped calling for a while after I filed the last complaint but today they started again. XX/XX/21.
