I was a loyal XXXX XXXX XXXX XXXX client from XXXX until I had to file for XXXX and then instead of working with me, XXXX XXXX XXXX XXXX is suing me and discriminating against my XXXX. During the 5 years I was a client I had an active Checking and Savings account, a credit card which was paid on time, and I also took out and paid off a loan for {$1000.00} to help me afford to move into an apartment. I was mostly happy with the Customer Service I received from XXXX, however there were two separate occasions where I was billed for charges I should not have been. I had signed up for paperless billing but the system was billing me {$5.00} per month for not being enrolled in paperless billing. I had to have a Customer Service rep credit 8 months of incorrectly billed fees. Then months later the same thing happened again and they had to credit another 6-8 months of incorrect {$5.00} fees for not being enrolled in paperless billing even though I was enrolled. My struggles with XXXX were that you always dealt with a different person every time on the phone so it did get confusing when notes were not properly taken. I had a credit card with a {$1000.00} limit and I also took out a loan to repair our car at the time for {$1300.00} and had begun paying this loan down until I had a family emergency. For health reasons I had to relocate temporarily out of state on XX/XX/XXXX and I had spoken to several different Customer Service reps about why and what my health issues were. This went nowhere for several months due to different Customer Service reps misguiding me and not noting my account properly. I was worried this would not be handled properly if I kept getting passed around like a hot potato that nobody cared about or respected as a valued client. I finally asked to speak to just one Customer Service rep specifically and only them when I called in to discuss how we would avoid this winding up on my credit report and negatively affecting me. I was told Ms. XXXX would be helping me and I could count on her to follow up and get me through this process. Ms. XXXX and I spoke several times and I let her know she would be dealing with my husband due to my XXXX, and to email and finalize details of the payment plan with my husband. I informed her that during this process of filing for XXXX it will take 3-5 years and I will not be able to work during that time period so I will have no income. I said I wanted to be put on a financial hardship program and was going to have my husband help me pay my bills during this time. I had already done this with two other major creditors who I am still in good standing with today. Ms. XXXX informed me that they do not offer financial hardship program, but they can do a loan modification. We were shocked that they can't offer a financial hardship program since it seems pretty standard, however, we started the process and paperwork for the loan modification. I have to moderate my exposure to radiation, wifi, etc and can not go online or use cell phones like most people can without moderate to severe symptoms which are debilitating. This is why I trusted Ms. XXXX to deal with my husband and make sure everything was set up properly. Unfortunately my worst nightmare came true and now I am being sued by XXXX. I happened to call in to check in with Ms. XXXX about the status of the loan modification on XX/XX/XXXX and to my horror she informed me my case was charged off 2 days prior to my phone call. I was irate and in disbelief when Ms. XXXX informed me she had done everything on her end she needed to do and told me there was nothing she can do about it now it has been charged off. I asked what happened to her promise to follow up and make sure this was handled properly? She told me she had followed up in XXXX on missing information with my husband and felt she had done her part. I realized then that she had sealed my fate. I asked her what happened to you following up like you promised since it is now XXXX and that was back in XXXX? Couldn't she have given a call before they charged my accounts off? She had no answer for me and I asked for her Supervisor who is named Ms. XXXX and had to leave a voice mail. It took weeks to track down Ms. XXXX and she did not return my calls until I had left several messages and when she finally did call me it went horribly and she showed no mercy for me or my XXXX. I asked her how a good client of 5 plus years, who is an XXXX and XXXX in the business and is working hard to improve my credit with XXXX XXXX XXXX XXXX XXXX could be treated this way just because they became XXXX? She quickly informed me I would be receiving paperwork from the legal offices involved and ended the conversation. Once I received paperwork from the Law Offices of Robert Colclough, III, I called in to try to discuss what my options were, but I was verbally harassed by two different people, XXXX XXXX, and another horrible man that sounded like the meanest monotone man I have ever heard. I can't remember the mans name since I was severely traumatized, but I knew there was no working anything out with them even though the paperwork urges you to call in. I want nothing to do with this so called Law Firm who abuses people and preys on the XXXX just like XXXX. Both companies ' bullying tactics and retaliation are illegal. I am disputing this debt since it is a violation of my Fair Credit Reporting Act since they are filing a lawsuit against me unlawfully and in retaliation. XXXX XXXX XXXX XXXX has been aware of my XXXX for over a year and a half and neglected to help me enter into the payment plan we had been discussing for months. I was never told of the timeline or that they would charge off without warning. Instead they chose to sue me over {$2000.00} and ruin my credit score since they are showing over a year 's worth of late payments. Ms. XXXX told me there would be no reflection of late payments since I had been working with them, but now I know she and their company are all untrustworthy. I can't think of a more inhumane way to thank a client when they become XXXX. My husband and I are currently XXXX and unable to find a safe place to live if my credit score is under 600, and due to this negatively impacting my score it is in the 500 's! I am now officially doomed due to their discrimination. We have been denied from at least 4 apartments we have applied for and there is no hope with this on my credit. I want this and ALL LATE FEES removed from all of my credit reports since it is an illegal act of retaliation and discrimination against me and my XXXX. They have damaged my credit score and my livelihood due to this dropping my score below the accepted level to get approved for an apartment. Thanks to XXXX XXXX XXXX XXXX XXXX actions against me I am XXXX and unable to repair the damage they have done to my life unless this is removed. It's hard enough being XXXX and now they just kicked me when I'm down and my quality of life is in severe jeopardy. I am still willing to work with them to work out some payment arrangements which was my original intention. I also want an apology from XXXX XXXX XXXX XXXX for their lack of integrity and discrimination and retaliation, even though these illegal acts are unforgivable. They are a large company and {$2000.00} won't ruin them, but for me this is a death sentence.

I am having an issue of an ongoing nature with a collection agency reporting information on my credit report regarding a debt which was paid in full prior to being sent to collections. the debt regards a payment for rent in a condo where myself and my partner lived, in California. Prior to moving out, the debt was paid for in cash and then we were given permission to move from the property. Nothing was ever reported immediately following this transaction. Approximately 1 year after, the debt was placed into collection but we were never notified as to the legitimacy or lack thereof regarding the debt. I have disputed numerous times, citing FCRA compliance and requesting original paperwork from the company under the Fair Debt Collection Practices Act, which I would then use to validate such an amount being due, and then take action against the company reporting the information fraudulently. To date, no documents have been provided from these disputes, neither prior to dispute or after dispute. The company is simply stamping the dispute as meeting FCRA standards without actually meeting them, causing a hardship on myself with every new dispute. This is unfair and wrong and I am asking this federal agency to assist in mediation with this matter. The collection agency : Allied Collections, has to this date refused to reply with a response that meets FCRA guidelines, they have provided no tangible paperwork as requested, they have not communicated with myself in any manner and when i contact the reporting agencies, as to what material has been submitted to prove the debt is accurate, I am told the company has not provided any paperwork but have made the claim that it is correct. Also this collection has been systematically increasing in dollar amount even though it is in the hands of a debt buyer and long closed. This needs to be investigated and corrected. This debt is not factual as all monies owed were paid prior to vacating premises. I am asking for assistance in investigating this fraudulent collection claim in a timely manner.

I had a credit card with XXXX which was charged off in XX/XX/XXXX in the amount of {$2300.00}. On XX/XX/XXXX, I could not use a debit card, called my bank and they told me I had a levy put on my account in the amount of {$6100.00}. They referred me to the XXXX Sheriffs dept. I called the XXXX sheriff 's dept. which informed me that I had a judgment against me, they gave me a phone number for XXXX XXXX XXXX which turned out to be the Law offices of Robert J. Colclough , III. I called and he informed that he represented XXXX XXXX XXXX XXXX , XXXX. I contacted XXXX the original debtor and they sent me a letter which stated the account was sold in XX/XX/XXXX to XXXX XXXX XXXX. I had never received a judgment or notice of a judgment or was ever served, so I went to the courthouse in XXXX XXXX XXXX, XXXX XXXX division and pulled the paperwork. I found that the XXXX XXXX XXXX XXXX XXXX XXXX with XXXX XXXX XXXX sent a notice dated XX/XX/XXXX, stating that they represented XXXX XXXX XXXX XXXX , XXXX According to all of the paperwork, I was served 7 times, none of which I received. Some to a residence I no longer resided. On XX/XX/XXXX, the judgment was substituted to the law offices of Robert J Colclough III, to continue with the case, On XX/XX/XXXX, the law offices of Robert J Colclough III, finally sent me a notice that I owed {$6100.00} and to contact them with payment arrangements. Since they already levied {$3700.00} from my bank accounts ( my Mother 's inheritance ), On XX/XX/XXXX, I faxed them a letter requesting that they accept the amount of {$3700.00} as payment in full and to please file a " satisfaction of judgment '' with the court. and to close the case. I did not get a response from them. On XX/XX/XXXX, XXXX XXXX XXXX XXXX filed another levy notice from the XXXX Sheriff 's dept. requesting {$4100.00}. They did not subtract the amount of {$3700.00} from the original {$6100.00} that they had received, nor sent notification or acknowledgement of receiving the money.

I was a member of the XXXX in XXXX XXXX when I lived at the apartment complex that had their facility on the property. I lost my job and could no longer afford living there so moved from the apartment to XXXX. Before leaving i went to the office, told an employee what the situation was and left a note telling them I cold no longer afford the membership and was moving to another city. I did not get any sort of receipt nor was I told that this was not sufficient notice. Several months passed and as I did n't hear from them assumed it was done. Some time later they contacted me and demanded I pay nearly {$300.00} dollars claiming that I have not given them 30 days notice of my intention. They also claimed I had n't ever informed them on my desire to cancel. I called several times and left several messages. It took a long time to finally get talk with someone who was not even remotely helpful. I offered to print out a copy of the original letter but was told it would not be accepted because as they said, " How do we know you have n't just written it? '' I then offered to pay another month 's payment and mail them a new letter telling them I wanted to stop my membership. They refused to allow me to even consider this. I feel I have made good faith attempts to resolve this but no solution I have offered was acceptable. They have finally sold this account to a collection agency and I continue to be plagued by this. I am adamant that I will not pay any more than one single month payment. This seems to be a reasonable solution that a reputable company would accept. A company named XXXX XXXX put a lien on my bank account with XXXX XXXX XXXX back in XXXX of 2015. They took out almost {$2000.00} from my account at that time and drained it out. After filing court documents to get the judgment quashed because I was never served properly, XXXX and I worked out a deal. They agreed to keep all the money they took out of my account in exchange for resolving the outstanding debt. I was under the impression that this matter had been closed. I received a letter just yesterday from a firm called Law Offices of Robert Colclough that says I owe them money for a debt they purchased from XXXX XXXX XXXX XXXX, stemming from my debt owed to XXXX XXXX, nearly 8 years after I resolved my issues with XXXX. This was completely out of left field. I was completely blindsided by this letter. I have been under the impression for 8 years now that this debt has been resolved. During XXXX I worked tirelessly to repair my credit and resolve all outstanding debts that I had. I left no stone unturned. To receive a letter like this years later just seems like a shady attempt to bamboozle me out of more money when I have already reached a resolution with the original company, XXXX XXXX XXXX. I called the Law Offices of Robert Colclough to resolve this and explain the situation to them, but they do not seem like they are interested in helping me resolve this matter. They just want to bilk me out of more money. I had an agreement with XXXX XXXX. Theres no reason I should have a collection company sending me any letters about any debt stemming from that original debt. Everything has been resolved for 8 years now. Please help!

In the XX/XX/XXXX I found out about identity theft on my credit report while going through a car loan process with my bank. I have been working closely with Experian and have filed a report with the FTC, the Police Department, as well as with every incorrect collector on my credit report. The person who stole my identity had access to my information including drivers license, signature, addresses, and social security number. It has been documented all all reports that they had used both my name as well as a " AKA '' which has since XX/XX/XXXX. Some names and accounts been removed from my report since starting to fight this almost a month ago. While a few creditors have already given me notice that they 've removed their information from my reports XXXX companies have proven to be rather difficult. I will write a separate complaint for the other. The XXXX one called Allied Services has missed their 30-day window of validating the debit on my account. I sent them a certified signature and required letter, which I received confirmation that it was received XX/XX/XXXX. On XX/XX/XXXX I sent them a follow up certified and signature required letter informing them that they failed to validate the debit within the 30 days. I also informed them the account needed to be removed from my credit report in a reasonable time frame. Today, XX/XX/XXXX I received a phone call from Allied Services XXXX insisting that I contact them. This has prompted me to file my complaint. I specifically requested in my XXXX letter that all correspondence must be done in writing and that there I requested that no calls be made to my work or residence.

In XX/XX/XXXX I rented an old XXXX XXXX from Allied Rent a Car and returned it with a damage on the windshield about the size of a dime. The car rental then charged me {$450.00}. I agreed to pay the damage through my credit card that I used to rent the car. The credit card policy states that rented car damage ( s ) is covered when I use the credit card for car rent payment. So it's up to the credit card to approve the claim by Allied Rent a Car. But Allied Rent a Car and its collector Allied Collection Svcs asked me to pay for the claimed damage. As in an accident, parties exchange insurance information by which damage will be claimed and processed by insurance companies. Allied Rent a Car did not follow the calim procedure and proceeded the collection through its Allied Collection Svcs that the original amount {$450.00} was then increased to {$1600.00}. They then sent the collection to report agencies to damage my credit. I disputed the report 's inaccuracy and malice which XXXX removed it for about a year but then reports the negative collection again. I recently called XXXX to remove it mentioning that it was removed before and by Code of Civil Procedure 337, the report violated state of limitation. CCP 337 sets the limitation of collection report to 4 years with the clock starting to tick as soon as " you '' miss a payment. As in the email, the amount was tranferred to collection on XX/XX/XXXX and reported XX/XX/XXXX. So by the 4-year limitation the collection and its negative report should be stopped on XX/XX/XXXX or XX/XX/XXXX. But XXXX report shows that it stays until XX/XX/XXXX. That is unlawful act by CCP 337.

Description of Complaint : I have a dispute with Allied Collection Services who failed to verify and dispute 2 accounts according to my stipulations stated in a conditional acceptance contractual agreement that was mailed to Allied collections which did not properly respond, I sent out a Notice of Default which Allied Collections never complied I have properly documented the proof of mailing dates with stamped receipts of the contract then approximately after 10 days the Notice of Default to respond which they did not respond properly according to the stipulations of the contract I also have the original copies of the contract with the account in question. I have the right to demand what is stated in the agreement due to the fact there is a legitimate contract and the respondent refused all my attempts to remedy this through this contract. I have attached 2 conditional acceptance contracts, the Notice of Defaults and the postal proof of mailing receipts that I sent to allied collections that failed to respond according to what was stipulated in the contract ( see 1st paragraph of page 01 of contract ) approximately 10 days after not the response I sent a Notice of Default with Intent which they did not respond since my attempts to remedy this situation was unsuccessful I feel the need to report. The Law Offices of Robert J Colclough and XXXX XXXX have been calling me at work. They placed a judgement against my checking account for debt owed back in XX/XX/XXXX. Case XXXX. My understanding is that for California residents, collectors are not allowed to call you at work. The collection representative called me and identified himself by first name only and XXXX XXXX. I told him that I'm already working with someone from XXXX XXXX. When I asked the collection representative how did you get my work phone number. That's a clear violation of the Fair Debt Collection Practices Act. He hung up on me. I've been working with a Mr. XXXX XXXX ext XXXX who has been assigned to my case. In the beginning I made many attempts to get a hold of him. He was never available. Finally he calls me back and tells me that I owed {$6800.00} from an old credit card back in XX/XX/XXXX. I told him that I'm going through financial hardship and that I can be placed on an installment plan. He said that he would get back to me by XX/XX/XXXX. I've been calling and leaving messages but nobody has called me back. Instead I get this surprise letter that now I owe {$30000.00}. What is this? They won't call me back to explain. In the attachments are the court docs showing a total of {$6800.00} and letter from Law Offices of Robert J Colclough showing current balance due of {$30000.00}. Smelled like a scam from the beginning but now starting to feeling like one. The only reason why I contacted them is because they got into my checking account.

I sent a debt validation letter to Allied Collection Services requesting they send me proper documentation to myself such as a copy of the original contract with my wet signature, documentation proving they have the legal authority to collect on this alleged debt. They received my letter on XX/XX/2019 via tracking info & was confirmed with account specialist XXXX on XX/XX/2019 XXXX. In my letter I unequivocally asked Allied Collection Services to cease collections/reporting until such account was validated which they did not. XXXX XXXX ( supervisor/legal ) stated on a recorded call ; that the account was not going to be removed as it was " allegedly validated '' on XX/XX/2019. My validation letter dated XX/XX/19 was a rebuttal for Allied Collections to send me physical proof meaning documentation and not just verifying an address or name. As of XX/XX/2019, I have received no response/correspondence to my validation letter that was received by them on XX/XX/2019. I then spoke to account specialist XXXX who confirmed no other documentation was sent out following my XX/XX/19 rebuttal validation letter. This is a clear violation of the Fair Debt Collection Practices Act. ( section 623 states that the creditor can not continue to report it when disputed, unless they have proof to the contrary ) ( section 609 states that they are required to send me the paperwork associated with this account. )

I received a letter from The Law Offices of Robert J Colclough III originally dated XX/XX/XXXX stateing the firm is the Current Creditor and a Judgment has been entered against me for {$10.00}, XXXX I have already responded to this Old Credit Card Debt from the XXXX, a debt from which I do not owe. The XXXXXXXX XXXX XXXX filed a Levy with the XXXX Sherifs Dept. on or around XX/XX/XXXX I worked with the Leving Officer XXXX of the XXXX Sherifs Dept. to have the levyed funds returned and the Case of Levy dismissed. I never owed this debt, and will now seek Legal representation to defend myself against this debt collector and request the court for 30+ years of damages. HISTORY : This is an old debt of 30 years ago originally known as XXXX XXXX XXXX. The debt was not mine, however I have been fighting this for all of these years. I had funds taken out of my 2 different bank accounts from 2 different banks without any notice. I contacted XXXX XXXX as the Sheriffs department told me it had to do with account # XXXX which is from XXXX XXXX. I contacted them at XXXX ... I was told they had me listed for a XXXX Unsecured Credit Card and they have sold the account to XXXX XXXX and that XXXX XXXX has since sold the account to XXXX. XXXX, XXXX Case # XXXX I have no phone number for them. I have attached a notice, the only notice I have received regarding my bank account being Levied I did not have an account with XXXX XXXX so I don't know what year this was, as they didn't have a date to give me. They could not give me any information regarding this account. I also called my bank and they told me that the account was Levied and the funds had to be released to the XXXX Sheriffs Department after 10 days of Levy. The Sheriffs office gave me a file number # XXXX I pulled a copy of my credit reports from XXXX and XXXX to see if an account was listed from any of these companies. Not one of these companies was listed on my reports. I still do not know why my account is being Levied or by who. Can you help me fix this?

XX/XX/XXXX received notification from my employer my wages were being garnished XX/XX/XXXX. I sent a certified letter requesting information of the name of the original creditor, the amount owed to that creditor at the time it was transferred, a copy of the last billing statement, and when the creditor claimed the debt became due and when it became delinquent. XX/XX/XXXX I received a court document with a different attorneys name ( dated XX/XX/XXXX ) and a typed written letter citing original creditor was XXXX with a current stated balance {$10000.00} dated XX/XX/XXXX. I have obtained a copy of all three of my credit reports and indeed there is a student loan from XXXX for a student loan opened XX/XX/XXXX {$10000.00} it was transferred to another lender and closed XX/XX/XXXX my credit report supports I paid as promised 4 years until the account was closed. I filed for a claim of exemption and the attorney sent notice of opposition and a notice to appear XX/XX/XXXX ( memorial day ) when the courts were closed. I did call the court and verify the date, so I would not miss court. The judge would not review my credit report as a character reference.

This company has infringed on my right to privacy, I have never given this company any right to have my personal information. This company was trying to collect on an alleged debt. This company reported unverified inaccurate information to the consumer reporting agencies, which has greatly harmed my ability to offer or extend my credit to other financial institutions. Allied Collection Services a third party debt collector posted a balance of {$7600.00} on XX/XX/XXXX and which had been updated to {$8100.00}! I was not informed that I owed them and that I was obligated to pay them money or that my potential debt was taken over by them, I asked them for an accurate check of the debt and balance to make sure that it was mine and that the correct balance was mine and never got either! They reaged this supposed debt so that it can effect my credit without even given me notice or a chance to go over it with them and possibly pay. I reviewed a copy of my credit report and noted an entry from Allied Collection Svc that I could not apply. I received an alert on XX/XX/2020 that a collection account was placed on my report. I have perfect credit with no blemishes. I have never heard of the company or the collection agency, which I have never heard from via written or voice communications. I had pervasive and repeated Identity Theft over the last few years, I sent Allied Collection Services of California the FTC Affadavit of ID Theft with a nortarized statement, and two police reports regarding the ID THeft, and told them it was urent. Collection Agency threatening legal action for a credit card debt that I do not owe. Credit Reporting Agencies do not have the credit card number on my credit report. Robert Colclough, III attorney has obtained a judgment in XX/XX/XXXX ( that I was never served a summons for, nor did I get any kind of communication that I was being sued ) for a credit card debt that was charged off in XX/XX/XXXX . First it started with a phone call every few days. Now they call every other day numerous times. At first I told them this did not sound like it was my debt and I wanted them to send me proof.
