Please note : The original debt in question was not a student loan, it is not protected in any way from being discharged in bankruptcy. It was a fully dischargeable debt, and was discharged successfully in California Bankruptcy court in XXXX.The companies pursuing this debt illegally are doing so knowingly, while being in possession of the court order not to collect. They have been contacted in writing many times, I have retained these records, and these crimes have been on-going for nearly three years. The date of the original debt in question was XXXX I am reporting this creditor for multiple accounts of Fair Debt Collection Practices violations and intentional credit reporting fraud. I have discussed this matter at length with my attorney XXXX XXXX, and he has advised me that based on my record keeping over the years, communicating only in writing for the duration, and the repeat offences of the original creditor to collect a non-collectable debt in violation of court order/multiple accounts of fraud perpetrated by XXXX and its Agents ; I have a strong case to pursue them for damages related to legal fees and duress in Federal Court XXXX This complaint is primarily against the XXXX XXXX XXXX XXXX in XXXX, Florida. This institution has repeatedly, knowingly, falsified the record of a debt account that was XXXX in XXXX XXXX Bankruptcy XXXX years ago ; in order to keep re-submitting it to credit bureaus after they were ordered by the bureaus to delete it permanently. The fraudulent actions : XXXX has already been ordered by California Bankruptcy XXXX XXXX XXXX XXXX, and the major credit bureaus where they reported it, that this is not a valid debt. What XXXX has done, is they intentionally deceive the credit reporting agencies by repeatedly selling the debt to a new Collector each time they are ordered to delete the altered debt, so the name of the 'Creditor ' changes when being reported. Also, they then fraudulently alter the date of the debt so that it appears much more recent than what it actually was. Both of these actions, temporarily, succeed in defrauding the credit reporting agencies into reporting it as a different debt than they have already been ordered to delete. Then, when my credit score fraudulently plummets due to a false collection account on my report, I have to then file a written dispute to get it removed. This fraud and harassment has been on-going for nearly three years. My situation : not only are these offences being committed to an innocent citizen with a clean record, but it also happens that I am the Caretaker and Spouse to a 100 % ( permanent and total ) XXXX veteran. The damage that is being done includes negatively affecting the health of my XXXX XXXX Spouse by raising his XXXX XXXX and worsening his XXXX XXXX. Additionally, the time I have to waste pursuing justice and remedy regarding these offences also takes a significant amount of time and energy away from me that should be invested in caring for my XXXX Spouse and small child. I have had to pay for childcare multiple times in order to have the opportunity to focus on gathering documentation and pursuing remedies in this matter. My attempts at resolution : originally, I made the mistake of thinking that an institution of higher learning would possess the business ethics to correct their grievous error of violating a court order and attempting to collect a discharged debt if I simply contacted them and pointed out their wrong doing while providing all the official documentation to validate my claim. Sadly, this organization has proven itself to be exceptionally unscrupulous and insistent on continuing to violate my civil rights and break the law while fully knowing the harassment and fraud they are committing. The President of XXXX, whom I have attempted to contact many times, refused to ever even respond. I also included many other XXXX offices ( and the attorney representing them ) in an attempt to reach a Representative with enough ethics and sense to look honestly and intelligently at the situation and urge those in power at XXXX to stop their abusive actions. That never happened. When I did not get a response, I filed a complaint with the XXXX XXXX XXXX and provided documentation to evidence my claims. The business, also refused to respond to the XXXX when they reached out to mediate. I also attempted to contact their attorney in writing multiple times and never received a response. My husband filed a XXXX complaint on my behalf against the attorney and they finally responded with false statements claiming the debt had the protections of a student loan when it absolutely does not, and they neglected to address the issue of their falsifying the debt account on behalf of XXXX and submitting it fraudulently to my credit report under their name in an intentional effort to deceive the credit reports into reporting an account already ordered to be permanently deleted. Finally I did receive a response from a Representative at XXXX, well after I won my dispute against them with the credit reporting agency and they were forced to remove the falsified debt account yet again. Unfortunately, rather than admit the wrongs committed against me and issue an apology along with a promise to never commit them again ; this Representative essentially said they 'temporarily ' withdrew the account from collections while they 'think about " what their future efforts to collect are going to be. This is not nearly an expectable resolution. Please also note : That the court order to discharge has been sent to XXXX and its Agents many times recently, and historically in an attempt to resolve this issue. They absolutely have no claim of ignorance in the crimes they have committed against me. Particularly in falsifying a debt account in an intentional effort to deceive a credit bureau into reporting an account already ordered to be permanently deleted. The origin of this debt : The original debt in question occurred from a violation of XXXX XXXX XXXX XXXX 's drop/add policy. I was registered for a course, that I dropped during the drop/add period for a full refund. I never logged into the course or attended it in any way. Sadly, XXXX saw fit to turn it into an erroneous debt and harass me like criminals over it for the past six years. Their actions towards me in this matter have been an absolute disgrace.

My money was intercepted in the amount of {$1000.00} on XX/XX/XXXX for an alleged account they said I owed prior to XXXX. Further, XXXX XXXX XXXX refuses to send all documentation regarding this as he said he didn't have it. His excuse is unreasonable and confusing for me to understand. If this debt is over 10 years old, as he suggest it is, then I assume they would have a copy of all of the documents signed by me and the original creditor. This information also should include any calculations of all charges and/or excessive fees. I am positive this exist because XXXX XXXX said I owed this amount back in XXXX which I NEVER received money in that amount or signed for it. On XX/XX/XXXX was the first time I received correspondence from this collector. Therefore, I can not understand how and why they took all of that money. Your letter suggests I owe for an alleged account owed to the State of XXXX and University XXXX XXXX. The purpose of this response letter will address the above referenced amount of {$1300.00}. In concerns with the University XXXX XXXX has been settled via the Department of Education and its student loan forgiveness program. Once your firm has assigned an attorney it is advised to review this lack of attention to detail. This debacle has been reviewed and closed almost 10 years ago. Continuing this germane issue as well as this irrelevant storyline is in need to be finalized. If failure to do so does not take place ; then I shall take it upon myself to take action against all responsible parties. Please take particular notice these student loan matters have been resolved since XX/XX/XXXX. Via the Department of Education all programs were waived concerning XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX and any other Direct Student Loans at issue. At that time, it took years to untangle their mismanagement yet I was successful. It appears they didnt rectify their self-created err. Simply make phone calls and request the documents be sent for proof of settlement or waiver to the account mentioned above from all of the departments I indicated. On XX/XX/2018, I was contacted via phone from a representative claiming he was from the Law Offices of Robert A. Schueger Co., LPA, stating he was representing the Ohio Attorney General and they were hired by XXXX XXXX University regarding a Student Loan Debt. He went to state they were preparing a lawsuit against me and were going to do a search for assets. I explained that XXXX XXXX had already been receiving money and I had several Debt Collection Agencies contacting me trying to collect on the same debt. I also explained there were no longer any assets to seize and I asked for a Letter of Representation for my records. A week or so later, I received a letter from the Law Offices of Robert A. Schuerger Co. , LPA stating they were appointed by the Ohio Attorney General that demanded an amount of {$4500.00} on behalf of XXXX XXXX University. A few days later I also received another letter from yet another Debt Collection Agency demanding {$12.00}, XXXX also on behalf of XXXX XXXX and the fraudulent US. Department of Education. A separate complaint against them will also be filed. On XX/XX/2018, I called the Law Offices of Robert A. Schueger and spoke with a secretary named, XXXX. I explained the reason for my call was to ask for proof of the debt since I had also had money taken from other agencies on behalf of XXXX XXXX and I was continuously getting letters and threats from several agencies. XXXX became defensive and started arguing that I could look up their law office on XXXX so I stopped her by stating it was my right by law for them to send proof of the debt and that was all that was required from her. XXXX responded by threatening litigation and then disconnecting the phone call. Reactions and threat tactics such as those are usually indicative of fraudulent and abusive debt collection practices. I called back and spoke with a Mr. XXXX, who politely asked if I would like to speak with a Supervisor after advising me they had several people there named XXXX. I agreed and was then transferred to a voice mail for a XXXX or XXXX XXXX. I did leave my name, contact information and reason for the call, in addition to feedback for XXXX 's unprofessional and threatening communications.

On XX/XX/2015 XXXX XXXX of the Robert A Schuerger law offices contacted my employer and revealed sensitive data about student loans debt to them. They told them that they have a program to help me pay the debt and " not to worry and that I did not owe any money ''. I received a call from my employer telling me exactly what she said and My employer told me that they did not represent themselves fully as a debt collector and to report them if they turned out to be. I call XXXX XXXX and she told me there are programs that the government has to vacate the judgment against me and that I would qualify since I worked at a " school ''. I do not work at a school, My company has " tech in the name so she assumed that it was like XXXX XXXX. After trying to convince me to sign up for some of these programs for about 5 minutes and me asking for more information like the case number etc. I asked point blank, Is this a debt collection, and she said " No I am trying to do you a favor '' I then asked if she had contacted my place of work in order to contact me about a debt and she said no and that she gave them no details. I asked her how I was aware of all of the details of why she called there if she had not discussed my debt. After several minutes of asking " did you contact my place of business to collect a debt? '' " and is this an attempt to collect a debt? '' she became very angry and said " This is an atempt to collect a debt and all information gathered will be used for that purpose '' and she also added that I was being recorded. I asked if she is required to inform my of the attempt and the recording at the beginning of the conversation or at the end and she would not stop yelling or let me speak and then hung up on me right after I informed her I would be reporting this incident. They have the call on tape and everything I said can be proven. She did not have permission to contact my employer via phone or to record me and not inform me of her motives in making the call in the first place.

Hello, I was reached out to Schuerger Law Group ( https : //www.schuergerlaw.com ) via phone ( that was recorded ) on XX/XX/ indicating that they are a debt collection agency looking to collect about {$5000.00} from me through my previous university. During the call, I asked the representative for a validation request because the debt they indicated sounded much more inflated than the number I believe I owed. She denied me this request while berating me and yelling at me through the phone. I immediately told her to escalate the call to her manager and asked for a validation request through him, and he agreed. In the email I received to opt-in to their communications, I responded ( attached ) indicating the amount I owed about and a list of questions I am entitled to ask. On XX/XX/, nearly 2 months later, I received what I suppose is their validation request, but it looks to be an invoice ( attached ) from the university I attended, listing a debt to be around {$1600.00}. I never received an actual Billing Statement from this group. I reached out to my university 's XXXX XXXX XXXX on XXXX to confirm the debt amount, the amount a collection agency is able to increase the debt, and the debt collection agency my debt was sent to. After gathering this information, I can clearly identify the Schuerger Law Group was providing misinformation about my debt and hoping to deceive me into paying a higher amount. I have reached out to them to let them know that I will be submitting a complaint to CFPB I also reached out to CFPB on XX/XX/ to validate whether this complaint is warranted or not, and the representative agreed that I should move forward with a complaint due to the false information provide AND because the collection agency did not provide the full scope of a validation request ( they did not provide me an option to dispute the claim ).

I have never heard of this company until XXXX XXXX yesterday when I received my first voicemail on my personal cell phone from them. Then voicemail said they were from a law office attempting to collect a debt. I can not take personal calls at work, so I decided I would call them when I got off work to see what they wanted. They called my place of employment ( where I have only been working for 3 days ) and informed myself colleagues they were trying to collect a debt from me. The caller asked me for my social security number and my date of birth. I told them I would not be giving that over the phone, and that it is not ok to be calling my place of employment and I demanded that they stop and I hung up the phone. They called back immediately after I hung up on them and demanded to speak with my boss, and my boss boss about this. That is absurd and I informed them that they would not be getting through to my boss and to stop these calls to my work number, and I hung up on them again. They called my work a third time, and spoke with another one of my colleagues asking for my SSN and DOB and asking for my boss phone number. My colleague of course did not give it to them and hung up. The caller then somehow found my boss number and left him a voicemail. The caller ALSO called my sister and informed her that he was trying to collect a debt and asked how I can be reached. All of this occurred within a 45 minute period, and I have never hear of this company until XXXX XXXX yesterday. They refuse to tell me what kind of debt they want to collect, or from whom, until I give them my ssn and dob, and they have repeatedly called my place of employment, advertising to colleagues that I have known for 3 days total that they are trying to collect debt from me, even after I demanded that they stop.

I received notice that a law suit by Ohio Att General was filed. After I did my research I show the filing amount for the document is {$1600.00}. I reached out to and was advised I was being sued for the total amount of {$6400.00}. This was confusing to me as the court website appeared different. I advised it was impossible to pay the full amount and wanted to look into my options to avoid court as my state taxes have been taken since 2018 to be applied to this debt. I inquired about options and informed I will have wages garnished due to another judgement against me and I was not sure how this would effect me. Each time I mentioned wanting to know options to resolve in avoid court I was asked what I could afford. I explained my yearly tax returns are my extra money and being that they were already being applied I thought that would be okay. I inquired about a possible settlement and was informed that they wouldnt even know what would be acceptable settlement. I was informed to wait until Im served with the court notice and call back in a week or so. I felt that the attempt of collecting more than what appears on the court website as filed is misleading and unfair. I feel that since payments are being taken from my taxes over 4 years the act of still suing is unfair practice. I feel that telling me options are available but not providing those options and insisting on waiting until Im served is unfair and misleading. I was informed total debt owed to original provider was close to {$5500.00}, I was informed since 2018 {$600.00} plus interest has been billed and since 2018 a over {$1000.00} has been taken still owing {$6400.00}.

Schuerger Law Firm out of XXXX Ohio says the XXXX representing the Ohio Attorney General. They took XXXX out of my bank account today ( XX/XX/2022 ) after I emailed them and told them I had just started back to work and would be able to start payment to them XXXX XXXXI asked for the info I needed to set up an online account and make payments anytime I had extra money. I was given the information and set my account up with full intent on making a payment XX/XX/2022. I had been out of work for a while and had to catch up on utilities and obtain a vehicle to get back and forth to work. I made this clear to them. The representative, XXXX XXXX, has threatened me with criminal charges, garnishment and more. I can not even speak to him because he over talks me and is rude. I am doing everything I can to pay this debt but I also have to keep my utilities on and food and gas going. He has called my job and released info he should not have. He has called me multiple times a week and harassed me at my job. I would have to send a call log to even show how many times I have been called because there are too many dates to count. I've been called a liar, told to ask my family for the money, told to sell things that I don't even own. He is literally going to make me have a nervous break down. I have been receiving student aid to attend classes full time since the XXXX of 2012. There is an old XXXX loan that showed up on my account and has been included in the total of outstanding loans. A law firm has taken the loan and put it into default status which has put a hold on my student aid for this Fall semester. I am on the XXXX XXXX XXXX at XXXX XXXX University with a XXXX GPA. I have XXXX classes remaining to graduate. If I do n't get my student aid, I can not take my classes which I 'm registered for and ultimately wo n't be able to graduate. There is currently grant money sitting on my student financial aid which can not be released because of this. I 've contacted the original loan servicer which is XXXX XXXX University, they told me to contact the Ohio Attorney General 's office and they directed me to the law firm. The law firm is Law Offices of Robert A. Schuerger Co. , LPA, at XXXX XXXX XXXX XXXX, XXXX XXXX, XXXX, Ohio XXXX. XXXX. They told me there was nothing they could do and that I had to repay the entire loan plus extra fees and interest. The total amount is impossible to pay and I explained that I 've been enrolled in school full time for 5 years. In addition to that, the loan shows up on my list of loans two times with one showing default and the other as deferred. This also increases the total of my outstanding debt. If this is n't resolved so I can graduate, I 'll have wasted 5 years and gone into deep debt with no hope of getting a better paying job which would also enable me to pay off all of my student loans.

Today XX/XX/XXXX I received a message about an " Important Business Matter '' from the XXXX XXXX XXXX. Because i was at work at the time and headed to a meeting me intention was to contact them after my meeting was over. before i could, XXXX XXXX ( XXXX ) sent me an email to my job asking me to contact him about an important business matter and that he contacted my payroll department and they were nice enough to provide my company email address. He also quotes a XXXX in payroll gave him the information to contact me. I replied to his email asking him to not contact me at my place of employment and that i would contact him after i was out of meetings of that he could contact me via my personal email or via my home address since i was unaware of what this was pertaining to and have never received information regarding this " business matter '' previous to his call. He then replied to my email 2 times after stating that he could not contact me via my personal email to discuss this and that he would be contacting my payroll department again to have assistance with this information regarding me. He then sent an additional email apologizing for contacting yet again. to which i replied i would be forwarding this information to my attorney.

On XX/XX/XXXX, I recieved a debt collection letter from the Law Offices of Robert A. Schuerger. On XX/XX/XXXX I responded to that letter by certified mail asking for validation of debt under the Fair Collections and Debt Act. I got no response. Starting in XXXX, XXXX my credit report through XXXX showed a collection notice reported by the Law Offices of Robert A. Schuerger. This detrimental action is against the Fair Collections and Debt Act as collectors need to send proof of debt if requested before continuing collection on debt including reporting to credit bureaus. I made a complaint to the CFPB on XX/XX/XXXX. Company responded on XX/XX/XXXX saying they would rememdy the situation by sending out debt verification and moving the account to disputed. Neither of these happened. Instead my XXXX challenge was changed from disputed to verified. On XX/XX/XXXX, I received a letter from Schuerger. It contained a one sentence response of " Enclosed, is the information you requested regarding the account listed above. ". The documents contained inside were my letter and a copy of the certified mail receipt. There were no documents germane to the account and the supposed debt, nor was there any attempt to validate the debt.

Hello, At Approximately XXXX XXXX EST. XX/XX/2023 I had an inbound call from the Law Office of Robert A. Schuerger Co., LPA, in regards to a debt I owe for student loans, in the amount of {$920.00}. I work Monday through Friday XXXX, so I couldn't answer the call, he did not leave a voicemail, but instead decided to call my younger sister, XXXX XXXX XXXX who was also working. She is not listed anywhere as a guardian, or emergency contact. She answered the call, and described the call as aggressive, and that he was an attorney trying to reach me, he mentioned the University XXXX XXXX, and that he was asking for my employer, and where I lived. This caused her to call me, she was very distressed, and said that he was being very aggressive, and it made her worried that I was in some legal trouble of some sort. Now I can hardly focus at work on a busy Monday morning. Apparently XXXX XXXX University made a loan to me. I was never informed that XXXX XXXX was making loans personally ; I was told that it was a XXXX XXXX XXXX. That was circa XXXX or so. I graduated in XXXX. During that time I was experiencing chronic homelessness and severe financial difficulties. I made several attempts to address the debt with XXXX XXXX in XXXX, during a time when I was homeless, unemployed and broke. So XXXX XXXX sent the debt to the Attorney General, who then doubled the amount of the original debt, from {$6500.00} to now almost {$12000.00}. The Law Offices of Robert A. Schuerger Co., L.P.A has threated to sue me and even rudely informed me that the debt wasn't dischargeable in my Chapter XXXX bankruptcy I filed in XXXX, despite the debt being classified as university/institutional debt. They have informed me that I will be sued and they will take my tax refunds and garnish my wages and that there is nothing I can do with the debt except pay it. The statute of limitations has since passed for this debt and I don't appreciate the strong arm tactics being employed.

I got a call today on XXXX XXXX and the collector from Robert sugar law offices in XXXX Ohio called me in regards to a debt I/O for a student loan she wasnt very rude in tone but she did threaten legal action against me because I was unable to tell her a amount and date on which I was able to pay due to begin quarantined from my job from the COVID-19. yes I was getting paid at the time but had to spend most of my resources and some of my 401k trying to get everything clean in my home and trying to make sure me nor my elderly grandfather in the home caught the virus. I am in a very stressful position since working at home due to the extra bills didnt have before. I am Im very behind and I am unable to pay that bill at this time and with the legal action getting thrown against me during this hard time it definitely set me off and I really dont wan na work with a company again due to my ignorance of the law. Mr. XXXX XXXX, in a letter dated XX/XX/2021, created the impression as an agent acting on behalf of the Ohio Attorney General and as a practicing attorney in the state of New York. Mr. XXXX also created the impression that a default judgment would be made against me by the state of Ohio, if I do not contact him. Mr. XXXX made clear he would use any information I provide against me, if I contact him. Most importantly, I never owed such debt, never used the name appearing in the letter, never was associated with any person with the name appearing in the letter, and never, in any manner, was associated with XXXX XXXX. Mr. XXXX predatory practice is chilling. It is particularly onerous when targeting minority communities, members of which are often immigrants and are unfamiliar with the American legal system and their rights. I hope the agency will take action to protect vulnerable communities. I am outraged because I can imagine an old XXXX immigrant lady in XXXX XXXX receiving such a letter. It would deeply worry her and she may settle to pay a debt she never owes.

Requested proof of debt from the Ohio attorney General, Law Offices of Robert A. Schuerger Co. , LPA. If this is not the attorney General, then this office has outright lied to me, saying that's who they are and represent. As well as, in the last 2+ years, they call me once a week and they've been charging me for a debt from XXXX XXXX XXXX XXXX Without Proof of debt. I had asked them to provide the proof of debt around XX/XX/21 or XX/XX/21, possibly earlier, and had never received it. I returned a call to the law office on XX/XX/21 and the person working said that they were still waiting on XXXX University to send them the Proof of Debt. I told them I would continue to pay on this once the proof of debt was received. They have my correct information, and always have. So the law offices of Robert A. Schuerger Co. , LPA have been trying to collect on a debt, they legally had no proof of. I am reaching out to a lawyer about this issue. I hope it can be resolved without legal help, but obviously they can't even provide a simple proof of debt.

A law office has been contacting me up to XXXX times a day about me owing money to a school since I had taken out a loan and did n't finish the semester. Things happen in life and I obviously do n't have the money to pay the entire amount of the loan at this time or even an eighth of the amount. If I had that type of my money then I obviously would have just paid the tuition out of pocket rather than taking a loan out. All my other school loans are in deferment due to unemployment. This guy " XXXX XXXX '' talks very rudely to me and even had the nerve to ask me if I had any family or friends that could pay this " problem '' he referred to it being. After receiving several threatening letters from the Law Offices of Robert A. Schuerger, LPA, in addition to threats of lawsuit from one of their incompetent representatives after I demanded the proof of debt, I demanded to speak with a Supervisor. The Supervisor I spoke with was polite yet stated the debt was from a private loan from XXXX State University and promised to request the proof of debt from the University. Upon receipt of the " proof '' dated XX/XX/XXXX, it was clear the debt was not private, it was another government loan that had already been consolidated. The Law Offices of Robert A. Schuerger, LPA claim they are working on behalf of the Ohio Attorney General 's Office. Their practice should be penalized accordingly for false representation and for threats of lawsuits when asked for proof of debt as required by law.

I received a letter from XXXX XXXX XXXX on around XX/XX/XXXX stating they were collecting a debt. I have no idea about this debt or what it was for. I replied via certified asking them to validate this debt and I also asked that they cease and desist all electronic communication with me and my family as they were calling me and members of my family non-stop. I sent this letter certified and it was received in their office by XXXX XXXX, or something similar, as per the USPS return receipt. As of today, XX/XX/XXXX, no information concerning this debt has been forwarded to be and the calls continue to harrass me and my family. The person who is attempting to collect debt from me claims they are working for the law offices of Robert A. Schuerger. Received multiple voicemails from a Mr. XXXX XXXX, claiming to be a debt collector on behalf of XXXX XXXXXXXX University. Unfortunately, I do not have any record of when these calls or voicemails were sent to me, as I had checked my mailbox as of this complaint ( XX/XX/21 ). Recieved debt collection letter on XX/XX/2020. Sent a debt verification letter on XX/XX/2020 by certified mail within the 30 days disputing that I owed the debt and requesting verification of the debt. I sent a cease and desist letter as a result. The debt he is referring to was signed in 2008. He says that I owe {$860.00} and that it must be paid immediately. Schuerger Law Group contacted my employer regarding a debt on XX/XX/22. I called and spoke with XXXX XXXX 's from Schuerger that same day. I informed XXXX XXXX 's that he was not to call me or my employer, and that the debt was past the statute of limitations. XXXX XXXX 's disconnected the call. At random, my husband was contacted about student loans from 2005.
