To whom it may concern, Please accept this correspondence concerning my recent experience with XXXX XXXX ( XXXX # XXXX ) representing Land Home Financial Services as a local Area Manager in XXXX, FL. I am requesting a serious investigation to be done on this transaction that essentially left me and my minor child without a roof over our head ( homeless ) while violating Florida Statutes Chapter # 501 - Floridas Deceptive and Unfair Trade Practices Act ( FDUTPA ) sections .201-.213 and 95.11 ( 3 ) ( K ), Florida Statutes . Attached hereto you will find supporting documentation in form of emails ( additional text messages and emails available ) that prove that the above mentioned Land Home Financial Services ( LHFS ) representative has engaged in bait and switch, deceptive trade practices and breach of contract during this transaction that resulted in me losing my rental apartment that I was occupying and becoming homeless. I was lead to believe all along during this process that this loan will close. Also, enclosed you will find the receipts for the financial loss that I suffered due to this failed transaction. I would like to give you a description of how this transaction transpired and I am open to be contacted if any additional information or documentation is required for a full investigation to be launched. Please accept my apologies in advance for the lengthy explanation. Back in XX/XX/XXXX of this year I started looking on-line at different Real Estate properties. I was intending to buy a home for myself and my daughter in the near future. I came across a property on XXXX and entered my personal information which subsequently resulted in a call from a XXXX representative to further discuss my interests on that particular property. I advised the representative that I was not working with a Mortgage Broker or a Realtor at that time and she recommended XXXX XXXX with LHFS as one of their preferred lenders in the area. She stated that they have a very tight and in depth criteria when selecting a preferred broker since they recommend them to consumers. That put me at ease as I believed that I could trust their recommendation. I agreed to XXXX passing on my contact information to XXXX and shortly thereafter I received a call from him and our communication on obtaining a loan with LHFS started. On our 1st conversation we went over general and basic information needed such as income, debt, social security number, date of birth etc. and I was told that after my credit was pulled I will be in contact with him again to discuss the maximum amount on the loan approval, and some additional info if needed. Also, at that time I was told that LHFS actually offers a Government Grant Sapphire Grant that is not available to all lenders out on the market and his office is actually issuing that directly to me since I qualified for it based on my income and property value that I was looking for. I was pleasantly surprised by that because I was looking into an FHA mortgage loan and the 3 % -5 % Grant would help with down payment and closing costs. He also recommended to me a Realtor that he claimed to know for a long time and had been doing business with, XXXX XXXX. So far everything looked perfect and I was thrilled over the down payment assistance XXXX XXXX! Shortly thereafter I was copied in an email from XXXX that was addressed to XXXX and contained XXXX Pre-Approval Letters, XXXX for {$150000.00} and XXXX for {$200000.00} which explained the following : my initial pre-approval was XXXX and to go up to XXXX I was contingent to providing him with a document that the second vehicle that was showing on my credit report was not my vehicle and that I was not making the payments on it. At that point I provided XXXX with the second vehicle Sales Contract and he advised that we could start looking for properties up to XXXX or even a bit higher since we might be able to negotiate the sales price. In regards to my credit score, he advised that I was at XXXX and I needed to be at minimum XXXX or above by the time we find a property but that he was not concerned about me bringing my score up quickly because I only had XXXX credit cards that had a tad bit of higher than usual balance and I was planning to pay them off or down anyways. I found a suitable property located at XXXX XXXX XXXX XXXX XXXX FL, XXXX. Towards the end of XX/XX/XXXX I came across this townhouse and in working with XXXX ( Realtor ) we had a signed contract by end of the month. When the offer was placed on the property, XXXX was advised on the sales price, address and some additional info he requested about the property. At that time I was told that I NO LONGER qualify for the Sapphire Grant because this property is coming up over the maximum DTI for the grant. The asking price was {$180000.00} and we ended up in a contract for {$180000.00}. Quick reminder, I had a Pre-Approval Letter of XXXX for a property purchase. I was not told at any point in time fromXX/XX/XXXX till this property was under contract that a lot of other factors come into play that could throw your DTI off, like property taxes, HOA, Insurance etc. since they are all calculated into the monthly housing expenses. It was never mentioned that I should only look for properties up to X amount, add on the rest of the expenses, and then look at the DTI before choosing a property. As you can imagine, disappointment is an understatement at that point but I had no choice because I was already in a signed contract so I had to come up with the 3 % down payment. I was told that the rest of the closing costs will be wrapped into the loan. Bait and Switch is absolutely what this grant was to me at that point. The process to qualify for it was not properly explained and in contrary the XXXX Pre-Approval Letter does not specify anything else other then the fact that I can purchase a property for up to XXXX in value. Quite frankly, there was absolutely nothing special about me doing business with XXXX or LHFS other than this Grant that was promised to me at the beginning of our conversations since anyone within the mortgage industry can obtain an FHA loan. After the loan was submitted to the underwriting department I was contacted by XXXX and I was told that the second car loan, the one that I am not paying for and the one that I send him the Sales Contract on, will need to be refinanced out of my name. The reason for that is because it is still considered my debt since the payments on the car were not made by the new owner for at least 12 months. Quick reminder, the Sales Contract was given to XXXX in the beginning of our dealings inXX/XX/XXXX. The date on when the car was sold is recorded in the contract plus proof of payments was also given to him as well. Left with no other choice but to try to refinance the car, I tried every avenue possible to have that done and it just didnt work out. My credit cards were not an issue anymore because by then my credit cards balances were paid down and my credit score was into low XXXX. The problem was that the person that purchased the vehicle was not able to have it refinanced due to some credit issues on her end. XXXX was advised of the situation and kept informed along the way. He was also informed that I had to give my landlord 30 day notice for moving out and I knew that the rental apartment I was living it would rent quickly because of the price and location. I had multiple conversations with XXXX over this issue and even after all that, at no point in time did he advise me that this loan would not close, so the 30 day notice was given. He continued to push this through and continued to tell me, my realtor and the sellers realtor that this will be a closed deal at some point. We ended up extending the contract because we could not close in time due to the fact that the second vehicle was not able to get refinanced. If XXXX would have been a knowledgeable broker he would have known from day one that 12 months of car payments is a requirement for that second vehicle not to be considered my debt. Three other lenders that I had spoken to afterwards, not including XXXX XXXX, who herself is a Branch Manager at a different LHFS location in the state of FL knew of that requirement. At that point, he advised that another option to have this loan done would be add a co-signer to the loan and I told him that the only person that I could use could be my mother. I told him that my mother has gotten her XXXX XXXX XXXX XXXX in XX/XX/XXXX. Also, that she was in XXXX ( my home country ) from XX/XX/XXXX until XX/XX/XXXX therefore she only has documented income in the form of a paycheck sinceXX/XX/XXXX to which XXXX responded that that will not be an issue. The issue that we were having with my mother was that she had no credit whatsoever here in the XXXX, and for that I had to add her to my credit cards as an authorized signer which I did. It took a few weeks for that to start reflecting with the credit reporting agencies but once she showed a credit score he added her to the loan, changed the FHA to a Conventional loan and we were back on track to close on this townhouse. The contract got extended once again and we were working on the last conditions that came back from the underwriting department which I was told were minor and the majority were for them to meet. We were one week out from closing and XXXX left for a XXXX week vacation to XXXX leaving XXXX XXXX in charge to close my loan, along with a couple of other people in his own office. Not until XXXX got involved and spoke to the underwriting department, after all the remaining items were submitted, that I was told that this loan it will not close or better yet it shouldnt have been a loan from the beginning. Why? Because 1. I should have never been given a Pre-Approval letter for a loan considering that the second car that was under my name but for which the actual owner was making payments were not done for at least 12 months. 2. My mother would need to have 2 years of W2, 1099 or equivalent within XXXX in order for her to be added to a loan as a co-signer. Unfortunately, by that time I had already had to vacate the rental unit as of XX/XX/XXXX since a new tenant was coming in inXX/XX/XXXX. The seller agreed to allow me to move my 2 bedroom 2 bathroom apartment furniture and belongings into the townhouses garage because we were to close on the loan within the next few days. That was very kind of him to allow me to do that vs. moving all my stuff into a storage unit and then into the house once the loan closed. However, the scenario was not ideal because I had to throw out everything that I had in the fridge and freezer and some other food due to the fact that I was only allowed to use the garage, and I was concerned for rodents etc. Two days because the closing date I was told by XXXX that this loan will not close. To make matters even worse, I was homeless with no roof over my head or my daughters which I am primary custodian for. The seller agreed to allow me to move my stuff out of the garage and into a storage unit on a Saturday so that I did not have to use another day of vacation from work. We canceled the purchase contract and the seller agreed to return my escrow deposit simply because they realized that it was nothing that I had done to prevent this loan from closing, but it was actually XXXX incompetence and lies. So here I was 6 months later, working with a professional mortgage broker that has been in business for XXXX years with no place to call home, a minor child with me, all my personal and furniture in a storage unit, and living at the mercy of my friends in their house till I found another rental apartment. During this ordeal I did not receive XXXX email from XXXX while he was in XXXX, although he was very well aware that this deal fell through because he was copied in all email communications with XXXX. I reached out to LHFS corporate office in CA and I requested that an executive reach out to me, and later on I received a call from XXXX XXXX who advised that he is the VP of National Sales, and he will me handling this matter because he is part owner of the company and his interest to have it resolved. I provided XXXX with all the information for this transaction, and I expressed to him that I am out of pocket, at that time of probably XXXX plus, and at minimum I am looking into being compensated for that. He agreed that he will be looking into this matter further, he would discuss it with XXXX and, I agreed to forward him the invoices once I moved into a new rental apartment since I was still living with friends at that time. On XX/XX/XXXX I received a phone call from XXXX and he advised that he is back in town and he is deeply sorry for what happened and for the situation, and stressed that he was sorry for what he put me and my daughter through. He also said that he has no control over what LHFS will be reimbursing me for, but for whatever money they will not, he will do it out of his personal money to make me whole. I told him, just like I told XXXX, that I will put all the invoices together and I will be forwarding that to them once I know for sure the move in situation. I was lucky enough to find an apartment in the same community that I lived in before, and at the same rental price, but I had to wait for the unit to be ready. OnXX/XX/XXXX I was finally able to move in after having no place to call home for XXXX days. As soon as I was able to put all the invoices together I emailed XXXX and XXXX and I requested for the reimbursement check to be sent to me. I received one communication email after that from XXXX asking for us to find a time to speak to which I responded that he can reach me on my cell phone at any time. Not a word from anyone else after that! As we stand right now, I am out of pocket {$2200.00} because of a FL licensed mortgage broker that has against the law used unfair and deceptive trade practices by lying to me all along and making me believe something that was completely false and misleading, lured me into doing business with his company by promising a grant that was never given to me. That is bait and switch. He also breached a verbal contract when he stated that he will repay me the financial loss that I suffered but never gave me my money back. This is without taking into account the stress, the time lost and the pain and suffering that I went through yet it appears that LHFS and XXXX believe to have absolutely no obligation towards me as a consumer. I am asking that you step in and hold LHFS and XXXX fully responsible and accountable for their actions and facilitate that I recover my financial loss at minimum. Complaint Letter Date : XX/XX/XXXX Re : Loan No. XXXX Borrower Name ( s ) : XXXX XXXX XXXX and XXXX XXXX XXXX XXXX Address : XXXX XXXX XXXX, XXXX XXXX XXXX XXXX Dear Sir or Madam : I am writing to notify the regulatory authority that my servicer, Land Home Financial Services XXXX Inc. ( hereinafter referred to as servicer ), has committed numerous severe violations in the servicing of my account and in violation of 12 CFR Part 1024.41 and 12 C.F.R. 1024.35, New York State Department of Financial Services 3 NYCRR Section 419.7, Real Estate Settlement Procedures Act, 12 U.S.C. 2605 ( e ) and XXXX XXXX Law Section 9-X. The following violations have occurred : XXXX. Failure to provide mortgage statements from XX/XX/XXXX to XX/XX/XXXX despite our numerous requests for a statement ; XXXX. Failure to provide a deferral per the XXXX XXXX XXXX Section 9-X law ; XXXX. Failure to pay for homeowners ' insurance despite escrowing for it ; XXXX. Failing to pay property taxes in a timely manner and causing the accrual of late fees ; XXXX. Failure to respond to and negotiate in good faith with the New York State Homeowners Assistance Fund ( hereinafter referred to as XXXX XXXX ) so as to resolve the delinquency ; XXXX. Failure to accept mortgage payments by any other method other than certified check ; XXXX. Wrongful application of fees and late charges ; XXXX. Wrongfully applying mortgage payments to months that should have been deferred XXXX. Failure of representatives to provide accurate information as required by law I have provided a timeline of the communications between myself and the servicer since the violations have occurred. Below please see timeline documenting the errors that have occurred. Further, I have provided exhibits and relevant law for further necessary elaboration. Timeline XX/XX/XXXX XX/XX/XXXX - I was in a COVID-19 forbearance and my loan was being serviced by XXXX XXXX XXXX At the end of my forbearance, I was not provided with any options to address my arrears. I was not provided with the option to defer as required by XXXX 9-X law. As of XX/XX/XXXX, I was informed by a XXXX XXXX representative that my arrears during the Covid-19 forbearance were {>= $1,000,000} and that I had to pay the entire balance by XX/XX/XXXX. XXXX XXXX My loan was transferred from XXXX XXXX to Land Home Financial Services XXXX I called Land Home Financial Services on XX/XX/XXXX and spoke with representative XXXX XXXX. I was informed by XXXX that we owed from XX/XX/XXXX till XX/XX/XXXX. He said my arrears were {$22000.00}. In two weeks, my arrears allegedly jumped from {$18000.00} to {$22000.00}. Further, the dates we owed were inaccurate. I told XXXX that I would not be able to pay the arrears right now, but I could afford to give them our normal monthly payment of {$1800.00}. XXXX told us that we would have to mail the payment in. XXXX mentioned that we would have to complete a modification application but never provided us with the application. XX/XX/XXXX I submitted a request to the servicer requesting that they provide documentation as to the amount that the servicer alleged we owed. We received a response from the servicer that provided us with the Deed of Trust and executed Note dated XX/XX/XXXX. I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX XXXX XXXX payment was sent early in XXXX. I paid more than my payment in the amount of {$5500.00} to the servicer via certified check on XX/XX/XXXX, the same date I sent in the XXXX payment. XX/XX/XXXX I called the servicer and requested that I receive a call back and never received a call back. I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX - I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX I called the servicer again and spoke with representative XXXX. I was informed that she sent a notice to the loss mitigation department to have someone call me back and no one ever called. I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. I received a letter from the servicer dated XX/XX/XXXX. The letter returned the checks sent in XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX stating that my loan is in foreclosure. XXXX XXXX I called the servicer again and requested that I speak to someone in the loss mitigation department. I was put on hold and then hung up on. I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XXXX XXXX I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. I sent a second payment of {$5000.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX- I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX I called the servicer again and requested that I speak to someone in the loss mitigation department. I was finally able to speak to XXXX XXXX. XXXX stated that we were behind and said our only option was to modify the loan. I stated that we did not want a modification. We proceeded to communicate via email with XXXX and I requested that we be provided a transaction history. XXXX XXXX provided me a one page document which stated that I owed {$20000.00} in payments and then added {$7900.00} in LEGAL FEES. We are not in foreclosure nor have we ever been in foreclosure. I informed XXXX of this fact and he never responded. I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX - I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX I again called my servicer and requested that someone call me back and I finally received a call XX/XX/XXXX. I stated that I had emailed XXXX XXXX and never heard back. They said that they would let XXXX know and he would get back to me. XXXX never contacted me. I applied for NYS HAF. I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX- I received a tax statement from my servicer stating that I only paid {$4000.00} to the servicer in XXXX. This was wildly inaccurate and so I email XXXX again stating that this was wrong. XXXX did not respond. I received notice on XX/XX/XXXX from the Town that my property taxes were not paid in XXXX. I sent XXXX another email concerning my property taxes. I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX I received a call from XXXX on XX/XX/XXXX. The phone number was from XXXX. XXXX said he would again send me a modification application and would look into the issue with my property taxes. Further, he said he would address the late fees we were assessed because the property taxes were paid late. I did not receive an application and never heard from XXXX again. I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX - I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX I called my servicer on XX/XX/XXXX after I spoke with XXXX XXXX and was informed that my servicer was not responding to their inquiries. I spoke with XXXX who then left a message for XXXX to call me and took the phone number for XXXX XXXX. I sent a follow up email on XX/XX/XXXX with no response and then called again XX/XX/XXXX. I spoke to XXXX XXXX who was very rude and unprofessional. He kept on referring to my husband as XXXX XXXX XXXX and kept citing information about our file that was inaccurate. We told XXXX several times we believed he had the wrong file as he kept calling my husband by the wrong name and had wrong information. He continued, and when we finally became upset, XXXX then stated he did not need to talk to us when we were upset and then said I will not take any more payments from you and hung up on us. I received my first ever mortgage statement from the servicer on XX/XX/XXXX which shows that I have been getting assessed late fees every month since this all started. I paid {$1800.00} to the servicer via certified check on XX/XX/XXXX. XX/XX/XXXX I received yet another notice from the XXXX of XXXX that my property taxes were once again, not paid and that I was being charged late fees because my taxes were not paid. Exhibits and Relevant Law Error - COVID 19 Forbearance & NYS Law New York State regulated institutions are required under NYS Banking Law 119.3 COVID Relief Program and section 9-x ( 9-X ), to make forbearance of any payment due on a residential mortgage of a property located in New York, widely available to any individual who resides in New York and demonstrates financial hardship as a result of the COVID-19 pandemic. DFS further states that Section 9-x requires the forbearance of all monthly payments due with respect to the mortgage, which includes all components of a mortgage payment that the borrower is obligated to pay to the lending institution. Therefore, if a borrowers monthly payment includes escrow for the purposes of paying taxes and insurance, the regulated institution must include those amounts in the forbearance and the subsequent loss mitigation resolution. Once a forbearance has been granted to a qualified mortgagor as a result of financial hardship, the loan shall be subject to the following provisions ( 9-X Article 3 ) : 1. The mortgagor shall have the option to extend the term of the loan for the length of the period of forbearance. The regulated institution shall not charge additional interest or any late fees or penalties on the forborne payment ; or 2. The mortgagor shall have the option to have the arrears accumulated during the forbearance period payable on a monthly basis for the remaining term of the loan without being subject to penalties or late fees incurred as a result of the forbearance ; or 3. The mortgagor shall have the option to negotiate a loan modification or any other option that meets the changed circumstances of the qualified mortgagor ; or 4. If the mortgagor and regulated institution can not reasonably agree on a mutually acceptable loan modification, the regulated institution shall offer to defer arrears accumulated during the forbearance period as non-interest bearing balloon loan payable at the maturity of the loan, or at the time the loan is satisfied through a refinance or sale of the property. Any late fees accumulated as a result of the forbearance shall be waived. 5. The exercising of options provided for in paragraph ( a ), ( b ), ( c ), or ( d ) of this subdivision by a qualified mortgagor shall not be reported negatively to any credit bureau by any regulated institution. Furthermore, Article 4 of Section 9-X states the following : Notwithstanding any other provision of law, adherence with the section shall be a condition precedent to commencing a foreclosure action stemming from missed payments which would have otherwise been subject to this section. A defendant may raise the violation of this section as a defense to a foreclosure action commenced on the defendants property when such action is based on missed payments that would have otherwise been subject to this section. Furthermore, DFS states that Regulated institutions must inform borrowers who receive a COVID-19 related forbearance of all options available. In addition, regulated institutions may not prioritize or encourage borrowers to select one repayment option over any other, or place borrowers into loan modifications that are not affordable or sustainable. I have the right to receive in writing the outcome or denial of a requested loss mitigation option/ review. The fact that I was never issued a written denial is in violation of RESPA Regulation X and RESPA COVID amendments. My Covid-19 forbearance arrears have still not been deferred and in fact, payments I have made after the forbearance period have been applied to months that should have been deferred rather than the current months. I have only ever verbally been offered the option to apply for a modification despite never receiving a modification application after being promised several times. This is a direct violation of 9-X as my Covid-19 forbearance arrears should have been deferred. Error Homeowners Insurance As shown in the above listed timeline, please see attached as Exhibit A homeowners insurance receipt where I was required to pay my homeowners insurance out of pocket as the servicer would not pay for my insurance. Error - Property Taxes As shown in the above listed timeline, please see attached as Exhibit B and D communications from the Town of XXXX stating that the property taxes have not been paid and that late fees would be charged to my account. Further, I had to inform the servicer that the property taxes were not paid and that I was being assessed with late fees. Error NYS XXXX As shown in the above listed timeline, please see note that I spoke to XXXX on XX/XX/XXXX where I was informed that my servicer has failed to respond to repeated attempts to reach them by XXXX. This failure to respond has stopped me from being able to gain access to funds which could be used to reinstate my account and therefore was a failure to negotiate in good faith. Error # XXXX Certified Checks As shown in the above listed timeline, please see attached as Exhibit C copies of the certified checks sent to the servicer as I was told that they would not accept payment via any other method. Conclusion I respectfully request your agencys intervention in the servicing of my loan. Any assistance that you could provide would be greatly appreciated. My specific request from my servicer are as follows : I request that the forbearance arrears from XX/XX/XXXX XX/XX/XXXX be immediately deferred as required by New York State 9-X law. I request that there be an accounting and adjustment of my escrow account and that any late fees or accrued interest that has resulted due to the late payments of my property taxes and homeowners ' insurance be waived from my account. As the servicer did not cooperate to mitigate losses before referring the file for foreclosure and I have not received a 90-day notice, I request that legal fees and other wrongful fees be immediately removed from my account. I request that Land Home Financial Services XXXX Inc. investigate what has transpired in the servicing of my account and that the employees be trained in appropriate customer service skills and loss mitigation options. Finally, I request that my servicer reach out to XXXX immediately so as to assist in the potential settlement and reinstatement of my account. I purchased my home in XX/XX/XXXXwith a first and second combination mortgage to XXXX XXXX XXXX XXXX. The first mortgage is current. Both mortgages were permanently modified while serviced by XXXX under HAMP in XX/XX/XXXX. The second mortgage payments were reduced from {$760.00} to {$520.00} and the balloon was eliminated. The modification agreement states that in the event of any conflict with the original Note and the modification, the modification controls. In XX/XX/XXXXa company called XXXX XXXX allegedly purchased the second mortgage and hired Land Home Financial Services to be the servicer. XXXX was just formed in XX/XX/XXXX. Land Home sent demands for payments of {$760.00} despite the modification and ignored all my requests to correct/validate the debt under FDCPA. They have no capacity to service mortgages. I have recordings of my conversations and emails. I told them I would pay if they proved they had the right to collect the debt and collected the correct amounts. They refused to listen even though they had a copy of the modification ( see Exhibit E to Lender 's Affidavit attached ). Land Home sent strangers to my house, who would be outside taking pictures, walking across my lawn and posting notes on my door. In retaliation for my QWR of XX/XX/XXXX, they acknowledge receipt in writing but started foreclosure proceedings on XX/XX/XXXX. They lied in the Notice of Hearing that was filed to start the non-judicial foreclosure action and wrote that I had not submitted a written request in the past two years. On XX/XX/XXXX, the attorney that was the trustee 's attorney and had switched hats to become the lender 's attorney sent a letter responding only to two questions on my QWR. He said additional information would be coming but it never did. In the foreclosure hearing that occurred in XXXX, XXXX through its servicer Land Home Financial submitted an affidavit swearing as true and correct, a fraudulent payment history ( See Exhibit H to their Affidavit ) showing me making payments of {$760.00} each month and stopping XX/XX/XXXX. They even submitted the XX/XX/XXXX permanent modification agreement and swore it was true and correct but still are demanding {$760.00} each month. The payment history was made on an XXXX spreadsheet just to support their allegations. proved the payment history was false but still XXXX and Land Home are trying to foreclose. When the Clerk of court asked for an explanation, the Lender 's attorney said he didn't have one. The Clerk gave us 2 more weeks to submit follow-up briefs before she would make a decision. The Lender is committing fraud and their attorney admitted that he didn't know what had happened but they are still trying to foreclose and assess attorney fees that I shouldn't have to pay. I have incurred many legal fees and untold stress fighting them. My analysis leads me to belief that the company is not legitimate and trying to carry out a scam because any mortgage servicer has to have controls in place to comply with RESPA so that something so outrageous doesn't happen. Land Home employees were unable to respond to any questions when they are written or called. They intentionally tried to bully me into paying amounts that I do not owe using the threat of losing my home. Only two people, XXXX and XXXX work for Land Home with respect to XXXX. The paperwork submitted in support of the foreclosure is contradictory in itself. From the fraudulent payment history, I see they have added fees to my account monthly without ever sending me the disclosure each month as required by law. This is easy to do in nonjudicial foreclosure states. There also is a possible fraudulent indorsement on the Note when comparing the original to the copy of the Note on the CFPB complaint website posted previously by XXXX. The lender that allegedly assigned them the deed of trust through MERS authorization was out of business on the date of the transfer. Somehow the note for the Second mortgage produced by XXXX/Land Home has a new signature of a person who worked for XXXX XXXX XXXX in XX/XX/XXXX when the company was out of business. After Land Home committed perjury on the affidavit with regard to the payment history, it is unknown how far the Lender will go in its fraud. Affiant XXXX XXXX and Land Home Financial Services should be prosecuted for flagrant perjury. I am a XXXX XXXX I see that they have done this to other people from internet searches. It seems that others have been successfully bullied or have lost their homes. I have never experienced anything so flagrant. There are multiple consumers that need to be protected from irreparable harm. I know the CFPB handles countless complaints but this company needs to be enjoined from servicing due to acts that have reached the criminal level. If it were just me being harmed, it would not be as important. However, so many others need to be protected from them despite the fact that it is probably too late to step in to help me. A couple months ago we switch homeowners insurance companys and so we had escrow checks mailed to us. In which we were instructed by insurance agent to return toward escrow upon receiving. First check we applied, but second one we recieved i wasnt able to pay on website because their website only allows one pending payment at a time. Which i then figured id apply it to our following mortgage payment. I believe this all started end of XXXX into XX/XX/2023. XXXX of XX/XX/2023 we recieved a escrow analysis stating our morgage payment was increasing almost {$400.00} a month, in which made me realize the escrow had to be messed up. Upon calling the mortgage company the employee on the phone said she didnt see any ecrow payment not even the {$730.00} made on XX/XX/2023 but she did see a payment for {$730.00}. I explained the {$730.00} was paid on the website to be applied to the escrow she said she would put in a request to fix the mistake, but then i explained that small amount shouldnt have change our escrow to that extreme. Her and I agreed there must have been 2 escrow payments made and she said she would request the payment of {$1800.00} from XX/XX/2023 also be applied to escrow. Upon reviewing documents with my insurance agent and on my own personal time i then remembered i never applied the second check and now they were requesting one of my mortgage payments to be applied to escrow. So then i contacted the mortgage customer service once again explained what i wanted to correct. {$2000.00} was the missing escrow payment, I asked for the {$1800.00} to repay my XX/XX/2023 mortgage payment that we reversed then asked for the remaining to be applied to the escrow. Fast forward to XX/XX/2023, I logged online to now schedule my XX/XX/2023 mortgage payment to find out they are stating my XX/XX/2023 payment was never made when in fact it was paid according to my checking account and their website on XX/XX/2023. I then proceeded to call their customer service, in which i was told multiple times they didnt see any mistakes then asked to speak to a supervisor who then said her customer service rep and herself reviewed all payments and see no error but I could email they research division with my concern to see if they can find the mistake. I did just that, everyday for multiple days. I tried contacting them the next day again to get a solution and once again was told they didnt have one and that research could take up to 48 hours to correct it. In which i stated XX/XX/2023 payment would be due soon and i didnt have time to wait to figure out whats going on. I was then transfered to 3 supervisors who all kept claiming to be the next persons superior before eventually being hung up on and never called back. Upon calling back and asking to speak to the last person i was on with i was told she wasnt available because she was in fact on a new call, funny because i was told if disconnected she would call me back. I then asked to be transfered to the manager who i was told I couldnt be directly connected to but i could leave a message and wait for a call back. So I then proceeded to leave a message for the Manager in which i was told was XXXX asking for a call back with a brief message in regards to my concerns, to this day havent heard from XXXX. On XX/XX/2023 I recieved a letter in the mail stating my XXXX payment was late and a late fee would be added. I then called customer service and asked how this is possible when they are still working on the issue, the rep chuckled stating she doesnt understand it either as she sees over {$6000.00} just floating not applied to anything and it would be more than enough to bring our mortgage up to date plus cover the escrow amount mailed to us. She then asked supervisors for permission to apply the money to the payments, in which she did now everything we had been arguing with them for months over seemed to be fixed. Nobody could answer me to whether they can reversed the negative report to my credit report or not, or whether my request to remove my PMI was approved for still awaiting to request a new escrow analysis to get our payment back to a normal dollar amount. We havent received ANY apology for their mistake nor has anybody even acknowledge the negative treatment we recieved during the past two months over this situation making it difficult for us to even want to stay with them as a mortgage company. Two months of stress and damage to our mental health and time lost with our precious children, and they see no guilt in any of it. We even lost work over hours upon hours of time spent trying to fix their mistake. Still NOT ONE PERSON AS OFFERED ANYTHING TO US.

My closing for my mortgage with Land Home Financial Services XXXX was scheduled for XXXX, XXXX XXXX, 2019 at XXXX. On XXXX XXXX, 2019 at XXXX I received a text message from my realtor telling me to check my email because XXXX XXXX, the loan officer, had sent over docs that needed to be signed by XXXX. I reviewed my email and noticed that the owner's policy fee was not listed on the Closing Disclosure. I called XXXX XXXX and informed him that it needed to be corrected because I will not purchase a house without an Owner's policy. XXXX called me at XXXX on XXXX XXXX and instructed me to just sign the disclosure before XXXX and that he would correct the error the next day. The Closing Disclosure that I signed stated that my cash to close would be $XXXX. The amount disclosed for my homeowner's insurance premium was $XXXX. (XXXX XXXX team referred me to use XXXX XXXX XXXX XXXX. I had initially received the quote via email from XXXX, the pre-underwriting processor at Land Home Financial. It was forwarded from XXXX XXXX, insurance agent at XXXX XXXX XXXX XXXX. The quote was for a XXXX XXXX XXXX XXXX XXXX.)On XXXX XXXX, 2019 at XXXX I received XXXX emails from XXXX XXXX XXXX companies stating that my policy premium changed from $XXXX to $XXXX, then $XXXX to $XXXX, then from $XXXX to $XXXX, then from $XXXX to $XXXX. I called XXXX XXXX XXXX XXXX to see why my premium was changing and they told me that my lender called and increased the deductible on my policy to $XXXX to get my premium lowered. I never requested or authorized to increase my deductible on my policy. They told me that XXXX XXXX from Land Home Financial instructed them to increase my deductible. THIS CHANGE WAS DONE WITHOUT MY CONSENT TO EITHER LAND HOME OR XXXX XXXX XXXX XXXX.I called XXXX at XXXX to find out why they made changes to my homeowners policy and he said he would look into it and call me back. I did not hear anything back from XXXX until he sent me a text message at XXXX stating "Cash to close is $XXXX". I immediately called him to find why my cash to close was increasing. He stated that he would have the closer call me back to explain. I did not receive a call back so I called and spoke with XXXX XXXX at XXXX XXXX XXXX, the settlement agent listed on my CD and asked them why my cash to close increased. XXXX informed me that the amount listed on the CD they received from my lender matched the $XXXX. They never received a CD from Land Home listing $XXXX. XXXX and I compared the CDs that we received line by line and we found the that lender failed to disclose the Lender's Title Policy fee on my CD. In addition the homeowner's insurance premium was less on hers so that is what caused the change in cash to close. So I assume they called and made changes to my homeowner's policy in order to offset the increase in closing costs that their error caused. In the end I had to pay over $XXXX out of pocket because of their error. All of my closing costs would have been paid by the down payment assistance program that was paying my closing costs if they would have correctly disclosed my fees. In addition, they (Land Home Financial AND XXXX XXXX XXXX) made changes to my homeowner's policy without my consent.On XXXX XXXX, 2019 at XXXX I emailed XXXX XXXX and XXXX at Land Home Financial and requested a copy of the Loan Estimate that I signed. On XXXX XXXX XXXX emailed me a copy of the CD and part of the HUD statement. I emailed her back stating that she sent me the wrong document. I informed her that I needed the Loan Estimate and requested that she send me a copy at her earliest convenience. On XXXX XXXX I received an email from XXXX with the Closing Disclosure attached. As of today, I have not received the document that I requested, which is the Loan Estimate. I searched all of my esigned docs and cannot find when they sent it to me. I only have the Loan Estimate from the down payment program. As of today, XXXX XXXX, 2019, I still have not received the Loan Estimate copy that I requested. I sent an email to XXXX XXXX requesting him to call me to discuss my homeowners policy because on XXXX XXXX I received an email from XXXX XXXX requesting for me to esign docs listing a policy premium of $XXXX. Land Home Financial Services Inc. services are mortgage loan. At the end of XXXX we fell behind with our mortgage payment. We were then enrolled into their Loss Mitigation Program. Shortly thereafter, the pandemic hit, and my wife and I where told Forbearance would be good for us while they found the best way to move forward. 18 months had passed without any communication from them. XX/XX/XXXXwe came out of Forbearance, We contacted our servicer 30 days prior to exiting Forbearance and was given four options from which we choose Loan Modification/Partial Payment. We were asked if we could start making mortgage payments again. We asked did we have to make the full payment. We were told if we were not able to make the full payment, partial payments would be fine. We were told in 30 to 60 days, a packet would arrive, outlining the Loan Modification with Partial Payment details and for us to read over sign and return. 60 days had come and gone and we still had yet to see any agreement. Not a call from anyone. Only a letter of default and one of three partial payments sent in was returned and some other persons loan documents. We called, are told to call back or someone would call us. No one calls us back so we call again, again and again. We are then told we have to complete and submit an application. They send us an application at the same time they file with the court Notice of Default Foreclosure declaring they tried with due diligence to contact us to explore options. We have submitted their Loss Mitigation Alternative Program Application with all the requested documents. We have submitted this application now for the third time. We've been denied stating they didn't have a complete application due to missing documents.(False) We have sent all the documents requested via email, fax and upload them threw their XXXX portal multiple times. On the XXXX site XX/XX/XXXX showed the application as being complete, but we are sent a letter of denial due to incomplete missing documents. We submit a new application with all the requested documents again, and the application is closed with no explanation. We have been calling them the entire time, weekly if not multiple times a week. Every time we call we are put on hold for 1 to 2 hours before we are able to talk to a person Who doesn't know or can't help us. We where assigned a dedicated single point of contact. But we are unable to reach this person, though we have requested to speak to her and have asked for her to call us back many times. We have even sent a letter asking her to please call us. We were told we would not ever speak to this person they assigned to us. She is not going to take our call nor is she going to return our call she is to busy. During all this they filed for foreclosure due to unable to contact us. Which is false since we have been calling nonstop only to be told their was no one available to call back or someone would call us back. No one has called us back. I was told Loss Mitigation was a good thing they where there to help you keep your home. This could not be further from the truth!! We done everything humanly possible to resolve this, we done everything they have asked. Including contacting a HUD counselor and completing a session. Call log to Land Home Financial Services XX/XX/XXXX - told to wait until Forbearance was over and call back XX/XX/XXXX - Ask which option we wanted. we picked the loan modification/partial payment. was told someone would get in contact with us in 30 to 60 days and that we should receive a packet to review, sign and return. First, I would like to start off with my hardship. When I first started my job, I had the pleasure of being hourly. I brought an extra {$300.00} or more home every two ( 2 ) weeks. I had a wreck on XXXX XXXX XX/XX/XXXX and accumulated over {$40000.00} dollars worth of medical bills and 8 months worth of physical therapy bills. The wreck was caused by a driver who did not have the right away. After my house closed, I was switched to salary which cut my household income by 30 %. This caused the perfect ingredient for collision. I informed Land Home Financial of my circumstances and they tapped danced on my loss mitigation application. I am confusing about several things. I only received a few emails regarding my application with the items that were needed. Once I was told they needed something, I would send it in and they would ask for additional documentation that should have been sent the first time. On XX/XX/XXXX, I completed my list of items that Loss Mitigation requested. I sent an email asking for XXXX, my loan processor, to assist me by giving me a call like she had prior to. I made a check list and sent the following items in that were requested with detail on all documents. Every time, I would call and ask for an update, I was told that Land Home Financial Services ( LHFS ) is not required to respond until after 5 business days. Thinking that the application was complete, I received a letter from LHFS dated XX/XX/XXXX stating that an appraisal was ordered and I would receive a copy. I never received a copy of my appraisal neither did I receive a call back when I requested assistance. Every time that I would ask for XXXX, I would consistently get shot down. I told several individuals at LHFS that we could not afford to live due to hardships ( medical bills, {$400.00} XXXX bill, income reduction, and a few others ). I constantly asked for help with the documents, and received no help. Since my mortgage has closed, I have received the worst service and had the worst experience as a first time home buyer : - When speaking with the lender about rates for our home, I was informed that the rate was 5 % for the program and the rate would not change or increase. From early XX/XX/XXXX, I spoke with the lender on several occasions. I was told my rate was locked ; however, my rate increased a quarter of a point to 5.25 % right before closing. We decided not to proceed with the mortgage, but was convinced after talking it out with LHFS. LFHS informed XXXX ( other homeowner ) and I that we would have the option to refinance in 90 days for 1.75 % credit toward the loan. If we had known that our credit would have dropped so low after the loan, we would have never did the loan. We banked on the word of the mortgage company stating that we could refinance into a FHA loan to lower our payment just after 90 days of closing. - When I arrived at the closing table, I did not have to bring anything to closing except {$1100.00}. We received a first time home buyer down payment from Land Home Financial and received 3 % of our closing cost from XXXX by XXXX XXXX. Over the last eight ( 8 ) months, I have found out so many things were not paid. Between late XXXX and early XXXX, our house insurance lasped due to none payment. We resolved the issue since then ; however, I feel like it should have been handled at the beginning. I found out recently that our HOA statement has been passed due for 8 months now. I have never received a bill by mail or internet because the house was not listed in my name with HOA. We went to Land Home Financial thinking it was too good to be true. Unfortunately, it was too good to be true. We feel like we have been mislead and abused to the point where we are at a dead end. Personally, I believe that Land Home Financial really wants us to foreclose on my home to reap profit. We want to stay in our home. We have never missed a payment on anything until we fell on hard times. We looked for assistance from the bank, and received no help regardless of the number of times we asked. Will you help us? I have contacted Land Home Financial Services, INC repeatedly over the past 5 weeks leaving voicemails and sent emails and have not received one single call back or reply. have also contacted the lenders attorneys off over the past 3 weeks also leaving voicemails requesting a return call and have not received 1 single call back. I have filed a debt dispute with this lending ( after repeatedly informing them since they purchased my loan ) that the amount of incorrect that they are claiming I owe. I also sent a letter to both LHF Services and their Attorneys office on XX/XX/XXXX and XX/XX/XXXX disputing the debt and requesting a follow up in regards to this matter. Yet 2 months later I still have not been contacted with updates in regards to this matter and all my attempts to contact them go unanswered as they have for the previous 2 years with this lending service in regards to this. On XX/XX/XXXX ( date of identifiable event ) a cancellation of debt was issued in the amount of {$21000.00}. But that was never removed from the principle nor balance of the Mortgage loan in question. But yet I received also received the debt cancellation notice from IRS and had to pay taxes on this. In XXXX a loan adjustment agreement was entered in which " the unpaid principle balance of {$100000.00} would be decreased by {$30000.00} for a total unpaid balance due of {$72000.00} '' Servicer also agreed to forgive {$41000.00} as written in the loan adjustment, Which the agreement as stated in writing and notarized in this agreement " You will never be required to pay these amounts '' The said above amounts were never deducted at all from the principle of the said mortgage nor were any behind payments fully cleared out. I have requested repeatedly for these errors with this mortgage be corrected and LHF has done nothing since Day 1. I have also requested a loan modification to bring loan current once my account is correct to the correct principle and balance in accordance to the loan adjustment dated in XXXX. I have yet to hear anything back in regards to a loan modification if needed once account is corrected and I have not been contacted with options they will provide me. Also due to COVID hardship I did submit a hardship notice, but LHF continued to charge me late fees, reported my account as late and delinquent to credit bureaus, they also refused to pay homeowners insurance and taxes that are suppose to be escrowed into my payments and are included on my loan agreement dated XXXX and any and all loan papers prior. They didn't pay the Homeowners insurance and then placed " forced insurance ' on my account. They failed to pay my taxes during the COVID hardship. I received a notice for delinquent taxes from tax office in which School taxes were over due by 8 months and Town/County taxes were overdue by at least 4 months. I had to contact the bank repeatedly to straighten out the taxes. They also added {$20000.00} in legal fees onto my account during the COVID hardship periods allowed by law. I have also requested that any further foreclosure proceeding be placed on hold until the matter is resolved and the correct amounts be applied and my loan agreement be followed. I would like to respectfully request for LHF to release my deed/title and mortgage to free and clear from any liens and for the remaining mortgage debt for my property be canceled. They have repeatedly violated my loan agreement and are trying to get more money that what they should have been owed.

Also, we tried to refine it with a mortgage lender company ( XXXX XXXX XXXX : XXXX, License Number : XXXX ( XXXX ) XXXX XXXX, and at first, they said they would help us. After two months of trying to save the home and get a refi on our house, we provided all the information to the lender. The lender was not responding to us, and finally, we heard back on XX/XX/XXXX and the reply was that they couldn't help us with the refi, as this is a gosht/zombie loan, and it did not appear on our credit, and they were not able to help us. We are trying to save our only home ; no one will help us. This loan is out of our means, and this is the second time we have struggled to survive and save our home due to the economic deceivingness of lawyers/banks/lenders. We need help.

I started out with Landhome Financial Services about 2 months ago The agent`s name is XXXX XXXX and the complaint is about this individual. He was referred to me by the owner of the property. The owner is also the buyer and the real estate agent for this property. His name is XXXX XXXX. At the very beginning XXXX relayed to XXXX XXXX that I can only qualify for XXXX This was not relayed to me. XXXX kept dragging the situation never telling us whether we would qualify for the loan which is held at XXXX. and also never telling me that we would not qualify. Next I was suggested that I should find another job which I did but had to resign after 2 weeks as the job was not on par with my qualifications i.e. the job entailed me XXXX 5.5 hrs for 4 nights a week. I am a XXXX and our XXXX is very much restricted to at most 9 hrs per week. This coupled with a XXXX and being in XXXX I had to resign. I was grilled by XXXX and XXXX as to why I resigned when they were so close to closing. XXXX XXXX advised me to find another job and quit after securing the loan which is a fraud. I have to apply for a job in the academic market which has its own timing so I refused to look for a job and wait until the academic market opens up again. XXXX and XXXX also informed me that the property needed some repairs and such should be included in the loan amount which then makes it a XXXX. XXXX called his agents to make an appraisal and came up with this price. I objected to this and told XXXX that I do not want to pay a larger tax and interest and I would rather pay for the repairs out of pocket which I never received any bills for. In addition I received an email from my lawyer in XXXX that notified me of a deed as per a land sale. Under legitimate conditions the translation is done via the XXXX XXXX XXXX in XXXX XXXX via sworn translators who have the permit to operate in the US. XXXX got this translated via google translation which naturally came out as a nonsensical set of words that have no legitimacy. I was in the process accused of lying as well. XXXX XXXX also allowed us to stay in the property until the loan is closed as we were lead to believe that this would close. Now the interim contract is about to expire and the purchase contract which is signed is also about to expire. We are also told by XXXX that he advised XXXX to list this home after all to be sold in the market rather than selling this to us. I dismissed him from this job but now XXXX is still interfering with the process. I also have the emails from XXXX asking us to leave his property right now. This is the type of greed that collapsed the housing market in the U.S. I am not sure if the loan officers and the real estate agents are scrutinized.

I closed on my home XX/XX/XXXX. My mortgage was {$1200.00}. I received a statement in XX/XX/XXXX that my mortgage was increased to {$1600.00} due to an escrow shortage. After speaking with my loan servicer ( Land Home Financial ) I was informed that I didn't have enough money to cover my taxes. {$2400.00} was paid by the lender since I didn't have enough money to cover in my escrow account. They are charging me the overage amount. I did not take ownership of the property until XX/XX/XXXX so I was not responsible for XX/XX/XXXX taxes. I don't see how the loan servicer can use my escrow to pay taxes for a year when I did not have ownership of the property when the dates are on the tax bill. I don't understand why they mortgage broker was contacted AFTER the loan servicer already had paid the taxes from my escrow instead of prior to. I spoke with the mortgage broker whom stated to me that the Title Company ( XXXX XXXX XXXX XXXX ) didn't pay all of the liens during closing. I submitted a complaint to the title company and it was discovered that the seller did not pay the XX/XX/XXXX taxes. The title company subsequently denied due to they had no way of knowing this at the time of closing and stated to me that both attorneys for me and the seller should've caught this. I spoke with my attorney that did the closing and he stated to me that the title company is responsible because they estimated my taxes incorrectly. He said I got credit the taxes at closing, however, I only got credit for XX/XX/XXXX not XX/XX/XXXX since the seller was suppose to pay those taxes. He stated if the seller didn't pay the XX/XX/XXXX taxes that I would have to go after him, but at this point I would get no money. He offered little help and showed no concern that he did do his due diligence acting as my attorney. If the seller did owe XX/XX/XXXX he and the seller 's attorney should've made sure they were paid or I got credit. If the title company did estimate figures incorrectly at closing and he was aware of this, he should've stopped the closing process until they were done right. This is my first home purchase and this has been a very stressful experience by far. Since my XX/XX/XXXX taxes have been taken out of escrow my mortgage has again increased to {$1700.00} effective XX/XX/XXXX. My escrow account has not been refunded and I am left stuck with being penalized for XX/XX/XXXXtaxes and nobody will do anything to correct this error. This is my last recourse, as I am depleted of the little savings I had to pay the overage and have fallen behind in other bills, including my mortgage payment. My credit has suffered and I am at a loss. Please help.

Our mortgage with Land Home Financial Services has been in forbearance/loss mitigation since XX/XX/XXXX due to hardships caused by the COVID-19 pandemic. On XX/XX/XXXX we applied for the XXXX XXXX program and were approved for the government assistance funding on XX/XX/XXXX. Since that date the XXXX program has tried reaching out to Land Home Financial Services by sending them requests for information on three separate dates. From what I was told from XXXX those dates are XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. They also tried sending out an email on XX/XX/XXXX in hopes of getting in contact with someone. XXXX has not heard back from XXXX XXXX XXXX from any of these attempts. XXXX is simply requesting the information and documentation they need in order to be able to transfer the funds we were approved for in order for us to get out of loss mitigation and back to current with our account. We have made XXXX XXXX aware on multiple occasions that we will not be signing any modification paperwork because if we do we are not longer eligible for this assistance that we are already approved for and very much need. We have been in constant contact with the XXXX program as well as call the Loss Mitigation department at XXXX XXXX. However, every time I reach out to find out why they have not yet responded to the requests I am given a different answer. The most recent two times I've spoke with them they have told me that they have no record of us being approved for XXXX or that XXXX has tried reaching out to them. However, all phone calls previous to this I was told something different. At one point I was told they were just short staffed and will get to it when they can. I spoke to XXXX XXXX on Friday, XX/XX/XXXX and asked them to speak with a supervisor. They informed me they were unable to transfer me to a supervisor and the only way to speak with one was to have them call me back within 3 business days. I told them that my next step was to submit a complaint to the Consumer Financial Protection Bureau if I did not hear back as I have not many times before. It has now been 4 business days since being told I would hear back from a supervisor and have yet again not heard anything. I feel as though we are being lied to and that Land Home Financial Services is trying to have some sort of financial gain from our hardship or choosing not to respond to these attempts at funds being offered to them in hopes that we will give up and they can either foreclose OUR home or make money off of interest in a modification. These are all unacceptable.

This complaint is to request CPFB to enforce RESPA on the following Servicers/owners : XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX and Land Home Financial Services that have been appearing one after another in the case explained here below. On XX/XX/XXXX XXXX XXXX XXXX filed an unsupported foreclosure on XXXX XXXX XXXX case # XXXX XXXX against my home, claiming amounts out of the permanent modification agreement signed on XXXX at the XXXX XXXX XXXX XXXX XXXX XXXX, the same entity that on XX/XX/XXXX did proof in Court that I was current in my payments according to the permanent modification agreement ; Legal Aid repeatedly scheduled on XXXX a non-jury trial motion to dismiss with the Judge that was delayed and opposed by XXXX XXXX. Many unnecessary delays have kept the unsupported foreclosure going on for 21 months now and with the appearance of 3 more new Servicers/owners in the case. A phone conciliation conference was finally scheduled but cancelled twice, I was told to give way to the settlement. On XX/XX/XXXX the new and fourth servicer/owner appeared : Land Home Financial Services ; this company made the attempt several times for me to sign a new hardship modification package that I refused as it is obviously out of order ; then on XX/XX/XXXX I was informed of a settlement to deduct about {$10000.00} from the loan amount, cover lawyer fees and reinstate the payment according to the permanent modification agreement ; but it was astonishing to realize they were increasing the balance amount of the loan in {$20000.00} more, what of course I did not accept. The last communication through Legal Aid from Land Home dated XX/XX/XXXX, was to send again a new hardship modification package to be signed, what of course I refused. I guess Legal Aid is under a lot of pressure from this block of entities created to try to crush the system. I am out of debt and I always honor my payments on time but this situation did low my credit score to the incredible number of XXXX. I just sent again to Land Home FS the full payments accumulated that they sent back as well as the payment of XXXX. Because I dont see an end to this negotiation is that I humbly ask you to enforce Respa on these 4 servicers/owners. They are abusing me because I am a defenseless XXXX Senior Citizen female that will turn XXXX next XXXX, and which health has suffered with this underserved and heavy attack. During the final stages of the home purchase transaction ( under the new XXXX regulations ), I received, reviewed, and signed off on the final closing disclosure documents submitted by the lender. After signing the documents at escrow and waiting for the lender to fund the mortgage loan, I was notified that the lender required additional monies before the mortgage could be funded. I complied under duress ; to avoid homelessness. In reviewing this situation and XXXX requirements, identified several missteps on the part of the lender : The lender failed to review or audit documents prior to submission to the consumer. In multiple closings, my agent personally identified errors in the closing disclosures. Errors include splitting apart fee amounts so that they can not be matched to information previously received by the consumer, incorrect entries, and missing entries. Each situation places the burden of disclosure detail accuracy on the consumer, who in all fairness, should not be charged with auditing and identifying issues on bank disclosure documents without the financial details and calculations required for a " clean '' assessment of document accuracy. The lender notified me via the title company and did not alert the consumer directly ; the title company representative was placed in the position to notify the consumer of a lender change and that funding would not occur unless additional funds were remitted. My agent followed up directly with both the title company and the lender, neither had a clear explanation as to why the change had occurred. The lender ( the person that interfaces with the public ) said the change was put in by the " processor '', was aware of the change, but had no knowledge as to why the change occurred. The XXXX process is an arduous, administrative process that allows lenders to give a show of compliance, but lack the consumer protections which were perceived as the " intent '' of the new requirements. The end-to-end XXXX process is not defined. The XXXX documentation suggests that the review timeline is the " end '' of the process and does not clearly account for changes following escrow signing. It would seem that any change, especially a change that is detrimental to the consumer should not be allowed once the final closing documents are completed, reviewed, approved, signed, and executed. The financial institution should take the loss in the event that it fails to deliver complete and accurate documents to the consumer.

Borrower suffered financial hardship resulting from a temporary COVID 19 related furlough of Borrowers spouse and Co-borrower on XX/XX/XXXX. Borrowers financial hardship was exacerbated when spouse unexpectedly and prematurely passed away on XX/XX/XXXX. Borrower was granted Covid forbearance effective XX/XX/XXXX. Borrower notified Lender on XX/XX/XXXX that Borrower wished to end forbearance and seek relief under the COVID-19 FHA-HAMP Combined Loan Modification and Partial Claim with Reduced Documentation as described on pages 12-13 of HUD Mortgagee Letter of XXXX XX/XX/XXXX ; and pages XXXX of HUD presentation, Update to FHA 's COVID-19 Loss Mitigation Policy. It was specified at that time that Borrower was not eligible ( could not afford ) loan modification based on a partial claim covering COVID related forbearance alone. Borrower provided justification and documentation to support this petition. Lender acknowledged that Borrower 's application was complete on XXXX XX/XX/XXXX. Despite assurance from Lenders Loss Mitigation department that the FHA-HAMP waterfall guidelines would be used, Lender provided Borrower a loan modification offer dated XXXX XX/XX/XXXX limited to the COVID-related forbearance. The Borrower has made several attempts to correct clerical errors in the original offer and have the loan reviewed in accordance with FHA-HAMP waterfall guidelines. Lender has not provided any evidence that it has made a good faith effort to promptly and properly review borrower 's request. To the contrary, Lender issued a second edition of the COVID combined partial claim and loan modification, on XXXX XX/XX/XXXX. On XXXX XX/XX/XXXX Borrower was advised by Lenders Loss Mitigation Depart to disregard that offer ( copy of email attached ). However, since that time Borrower has not received another offer and has be contacted to execute the XXXX XXXX documents on multiple occasions. On XXXX XX/XX/XXXX Borrower confirmed by phone that Lender was unwilling to consider Borrowers petition for a FHA-HAMP based partial claim. Monthly payments have been reinstated according to the original loan and Borrower remains current ( excluding the forbearance amount ) on this loan at considerable cost to Borrower 's limited disposable income. I received a VA loan for my home from land Home Financial. During COVID they offered payment assistance for the mortgage that was to be resolved by a loan modification. I received a loan modification which was supposed to have a three-month trial and if all provisions were met, then it would become permanent. I sent in all the notarized documents in XX/XX/2021 and made monthly payments as stipulated. I also obtained tracking information to as proof that the company did receive the loan modification paperwork. About two months later, I began to receive collection information to which I called the company and resent the loan modification docs and proof of delivery. Also noted that the company cashed the certified check that was requested of me. I continued to received collection notifications over the ext 17 month, I called the company XXXX times, requested to speak to a manager, and was told managers don't speak with borrowers. They directed to me three different divisions within land home financial. This company only communicated by generic email addresses so you never really get the chance to speak with a person whom toy can call back or provide further info. I have made every mortgage payment in a timely fashion and sent proof but they still insist on the collection and potential foreclosure. Recently I found out my loan modification was never entered into their system or processed. Again, i was told to call back in a week all the while, i make monthly mortgage payments that my back insists are made and provide electronic proof of transfer while Land Home Financial still struggles with answers as to why the loan modification was never processed and why the money I spend every month is not applied to my mortgage. Since I have tried in vain repeatedly to get answers, I finally resorted to hiring an attorney in the hopes that I can get answers and land Home Financial attention to solving a problem that should never have existed in the first place. I hated even spending XXXX dollar to hire a lawyer as this was totally unnecessary if their departments would communicate with one another. This company will provide the VA loan but are completely unreliable at servicing the VA loan appropriately.

Our problems began with our mortgage company from day one with the deed .My wife 's name has never been on the deed but the company kept saying it was and that they would send us proof. Proof never arrived and we had to pay a lawyer XXXX dollars just to verify that we were correct. Next our payment for XXXX of this year was sent out in XXXX but got lost in mail during the massive flooding in Texas ( The payments have always been tracked through priority mail, just as this XXXX was and proof can be furbished ) .To correct the lost payment we sent BOTH XXXX and XXXX payments in XXXX check together with copies of the tracking info and stated that we cancelled the check that got lost in the mail during the weather issues in Texas . When the payment was processed their processing department misprocessed the payment and only payed the XXXX portion and put the XXXX potion toward our escrow. They also made a payment amount error there because our XXXX payment was lower than the increased payment that started in XXXX. We fought with them for days before we finally got someone to actually look at our payments and admit they made the error, they then told us it was our problem to fix. How in the XXXX am I suppose to go to their processing department and fix their mistake? We sent our payment this is not OUR problem to fix, IT IS THEIRS TO FIX. Furthermore in the middle of XXXX our XXXX payment, Which we told them in writing was cancelled, arrived. They proceeded to try and cash the check they were informed was cancelled and then have since tried to send our account to collections. They have also charged us unwarranted late fees due to both the error they made processing our XX/XX/XXXX/XX/XX/XXXX payment as well as charged us a late payment for the check that we proved got lost due to weather in XXXX. We have all our records and provide proof that our payments are all up to date, including the extra XXXX a month we pay to get our escrow sorted out. We are not sure what you will actually need from us but we will be able to provide any statements and proof of payments needed.

Land Home FS is making the understatement that I dont have Hazard Insurance to justify XXXX reasons to the filing of a Frivolous Foreclosure on XX/XX/XXXX. ( Exhibit 1 ) o Also XXXX XXXX made a refund of charge for wrong placed hazard insurance fees ( Exhibit 2 ) Land Home FS sent me a letter on XXXX this year ( Exhibit 3 ) saying my hazard insurance had expired therefore they know I have that coverage from my XXXX XXXX XXXX XXXX ; Proof of insurance of XXXX was sent to Land Home through Legal Aid Society. ( Exhibit 4 ) Please find here enclosed proof of insurance on my property from XXXX to XXXX ( Exhibit 5 ) Land Home FS continues in an unlawful request of payments ; in their mentioned answer they said : we have not received the payment ( s ) due beginning with XX/XX/XXXX on your mortgage loan. Please send the amount shown below which includes any additional fees and charges dueTotal amount due {$15000.00} But payments have been timely made according to the Permanent Modification Agreement from XXXX this year, and all payments have been returned ( Exhibit 6 ) Because there are not pending insurance issues and Land Home FS said the Permanent Modification Agreement is not in dispute they must accept the check I sent to them on XX/XX/XXXX for {$4200.00} that includes all pending payments. If they dont agree with the allegations of this complaint they must explain it clear and simple without making reference to any previous letter and send proof of any statement that can differ from those exposed in this letter. I lost my job due to XXXX, and was able to find my current job but unfortunately the process of hiring took about two months, so I asked my mortgage company about the options for a forbearance, they helped me during my time of need, and discussed how placing all balances on the back end of the loan was the best option for me... but I had XXXX major issues coming back from it... . they never told me about the escrow being an issue and how it would affect my monthly payments being a lot higher I had a conversation and they told me property taxes and home owners insurance almost doubled bring my payments from XXXX to XXXX and that I was able to understand I received the agreement assuming my monthly payments for that amount and I agreed and signed it ... no problems there, problem 1... At that point they don't even told me about a higher amount ... one day I checked my mortgage app on my phone and I see a payment scheduled for next month for XXXX I was alarmed and called and asked what was that about and that's when they told me about the escrow balance needed to be paid. And I wish they would have told me about that when I first started because I would have paid at least the escrow that is my first issue. Problem 2... I checked my credit and it shows derogatory account and late for 120 days wich affected my credit... I called them about this and they said that was a mistake and before I submit a claim in the credit bureaus to give them 30 days to fix it, and I did I just got a notification on my credit saying that my account is current... but they never removed the late payments report negatively affecting my credit and this is something I asked them and they told me it would definitely not affect me credit wise. Now I must call them again and call the bureaus to remove their mistake from my credit. Thank you.

I applied for a loan modification with Land Home Financial Services and I also applied for the XXXX XXXX XXXXXXXX XXXX XXXX ( XXXX ). I received a modification agreement for a partial claim mortgage/deed of trust for {$38000.00} with instructions dated XX/XX/2023. The instructions stated I had thirty ( 30 ) from the date on the letter to accept, sign and return the partial claim mortgage/deed. Which is XX/XX/2023. I received a call from XXXX at Land Home Financial Services, telephone number ( XXXX ) XXXX on XX/XX/2023 at XXXX. He stated, " Hi XXXX this is XXXX from Land Home Financial Services. Did you sign and return those loan papers you received? We need those papers signed and returned immediately. " I felt pressured to sign and return the papers or fear losing my house. So I complied and signed, returned the documents as XXXX requested. I had a appointment on XX/XX/2023 with a HUD counselor at XXXX XXXX XXXX to review the documents before returning them to Land Home Financial Services. XXXX approved my application and ACP Land Home Financial Services around {$53000.00} on XX/XX/2023 to pay my delinquent balance and some future payments. I called Land Home Financial Services on XX/XX/2023 at XXXX and informed them I would like to cancel/rescind the contract I signed and accept XXXX offer. I explained I submitted the documents early because XXXX called andI felt pressured. I was informed by Land Home Financial Services that they have to talk to the underwriter. I was told to call them back in 48 hours and they would inform me what the underwriter said. I called Land Home Financial Services back on XX/XX/2023 at XXXX and was told I can't cancel or rescind the documents and the XXXX funds would be returned. I felt pressured to sign and return the documents before the due date.

I received a grant from XXXX in the amount of {$53000.00} in May that was sent directly to Land Home Financial Services. HUD provided me a breakdown of the funds as : Primary delinquency : {$45000.00} Primary future payments : {$7400.00} Total released : {$53000.00} Upon speaking with Land Home Financial Services in XX/XX/2023 I was told HUD only sent {$45000.00} to them and I was behind XXXX and XXXX payments. I spoke with Land Home Financial Services in May and they informed me HUD sent {$53000.00} and they were applying payments. I would receive a breakdown of how the funds were applied and when my payments would be due. I never received the breakdown or payment due information. I called Land Home in XX/XX/2023 for the breakdown information and was told Land Home no longer service my loan, I would receive that information from my new loan provider. I never received any information from anyone. I received statements in XX/XX/2023 from Lamd Home stating I owe {$5000.00} for XXXX and XXXX payments. My homeowners insurance is paid by my mortgage company. Land Home has refused to pay my homeowners insurance for {$2300.00}. The policy is set to cancel on XX/XX/XXXX for nonpayment. Land Home has damaged my credit reporting incorrect information stating I'm behind in payments. That has caused damaged to me, I have been rejected Financial Services, credit cards etc as a result. I have withdrawn from my family and cry most of the time. Land Home doesn't respect CFPB they tell them one thing and do not do what they say they will do. I'm a senior lady and Land Home is determined to take my house and there's nothing that can be done. They called me a couple weeks ago at XXXX XXXX The harassment never stops.

To Whom It May Concern, I am writing this letter of plea for assistance. My mortgage company has not been cooperative with obtaining my payoff. I requested a payoff and never received the payoff information as requested. Instead my lender contacted me asking me did I want to refinance. I told him I was selling the house and I need an active payoff. I never received a response from him when I asked to have a conversation. The mortgage company said they sent the letters out, but we never received any of the information stating that we had received any of the letter stating that we were being foreclosed. I requested a pay off in early XXXX XXXX of XXXX. My lender, XXXX XXXX, messaged me on XX/XX/XXXX to say, Hey XXXX, We got a payoff notice. Are you wanting refinance or sell the House? Would you have a few minutes to talk? XXXX XXXX -NMLS XXXX. I replied, Hey XXXX. Im selling the house. We can still have a conversation. I never heard from him. My title company requested a payoff early XXXX so that we would be able to close ; however, we get a notification before closing that the payoff was never received. I called the mortgage company and the young lady said she had record of it ; however, Land Home Financial and XXXX XXXX XXXX XXXX XXXX XXXX, XXXX. XXXX office are both stalling. I had a buyer for a my house and it was supposed to close on XX/XX/XXXX. The house was supposed to close, but it was still stalling because they will not give a payoff. I requested assistance with my foreclosure packet and never received assistance. Land Home Financial ended our calls several times when I asked for help. I am not sure what to do because they are being uncooperative. Will you help me?

Our lender has caused nothing but problems since pretty much day 1 of this loan. We've had them misplace numerous documents, lose access to ex-employee info that included our file that she was working on, communicate with the seller of our home instead of us directly, and so many more things that I can't even get into right now, but what we really need them to fix here is the fact that since XX/XX/2019 we have been calling repeatedly, sending messages and leaving messages about refinancing our loan due to a loss of income, and more recently with the covid-19 pandemic, we filed again for help with the loan, all with NO REPLY OR RESPONSE from the company! They have been made well aware of the financial situation, we've sent them the hardship papers twice now, and again, the covid-19 application too, so that's 3 applications we've filed for help with them, only to have them completely DESTROY our credit every month by reporting it late despite our pleas for help with this. We just found out they raised our monthly payment roughly {$100.00} per month with absolutely no idea why or explanation from them whatsoever! They refuse to add my wife on the mortgage information ( even though they talked to her thru the mortgage process and not me ) with having that request sent in several times as well! I've been yelled at, transferred, hung up on, and when I finally do get someone on the phone, it's a different story or information every time, so I have no idea what's going on or how to get out of this situation!?! They basically have me screwed right now because no one will touch this loan being it's been reported late from them.

I have a VA Loan Mortgage with Land Home Financial. On XX/XX/2022 both Land Home Financial and myself received notification of my request for property tax exemption based on my 100 % XXXX from the military. It stated that I would receive 100 % exemption by the City and County of XXXX. I sent copies of that letter to Land Home Financial on XX/XX/2022 along with the property assessment paperwork. On XX/XX/2022, I received from Land Home Financial Tax Division, Escrow Department a letter stating all/adjustments have been completed. Since I didnt receive any adjustment to my mortgage payment, I called Land Home Financial several times , speaking with XXXX XXXX XXXX XXXX a supervisor ), and XXXX from Customer Service XXXX who all asked me to resend all the paperwork regarding my tax exemption. The last time I sent paperwork was XX/XX/2022. At that time I was informed a change would be made within XXXX ( XXXX ) days and I would receive written notification within XXXX ( XXXX ) days. On XX/XX/2022 I received online an Annual Escrow Account Disclosure Statement and Change of Payment Notice. It reflects an increase of property tax payments instead of a decrease as assessed by the City and County of XXXX Property Tax Office. Also received on XX/XX/2022 was a check from the City and County of XXXX a refund check for the Real Property Tax that was paid after the change in exemption status. Now, I dont get any response from Land Home Financial and I am not allowed to speak with anyone outside of Customer Service because their Escrow Department Tax Division does not take calls.

I filed for hardship assistance due to covid and have not made payments on my account since XXXX of XXXX until XXXX of XXXX. When I started making payments again Land Home Financial told me that I would be able to do a Loan Modification as this would take into account the change in rates since I started my loan. They told me that if I was looking to refinance or sell my home that this was my only option otherwise I would have to pay back the past due balance prior to doing that. I then received a letter that my loan was being differed, where all the money owed was being moved to the end of the loan. When I called about the issue I asked to speak to a supervisor to have everything sorted out. I have never received a call back when they informed me I would receive a call back within 24 hours. I have since called them 2 or 3 additional times without a response back from a supervisor to address the complaint. From the person that I spoke to earlier today they told me that my loan is now in a Flex Modification state, which is not the same as a Loan Modification that I would have been available for if they did not put my loan into a differed state. I would like to have all the options that I would have had in the first place coming out of hardship. This time has been hard enough and dealing with this is making it more difficult. I have been in contact with the hardship assistance team and the loan team during this entire process to ensure I was doing everything correct and taking all the necessary steps to prevent issues like this.

Hello, I was experiencing financial distress 1 year after acquiring my home through land home financials. I called to request a short term forbearance on my loan but they told me I have to submit it through a process call loss mitigation. I originally submitted the required paperwork in XX/XX/XXXX, they did not accept my application until XX/XX/XXXX, which is when I made my XXXX late payment. I called them several times weekly or every few days to get an update, first I was told it was under review and could take 60 days. It wasnt until XX/XX/XXXX when I got a packet in the mail stating I made them aware that I was able to resume payments and my next payment is due XX/XX/XXXX, my past due balance was pushed at the end of my loan and this was a partial claim. My other option was to short sale my home. Under no circumstances I made anyone aware that I could resume payment. I also have multiple late payments reported to my credit report which is significantly impacting my ability to obtain credit or improve my finances. If forbearance was granted, I have no documentation and if so, I shouldnt have late payments reported to the bureaus. The entire point of reaching out for assistance was to avoid all the negative impacts this could bring upon my family finances. I am a XXXX mom with XXXX kids, and struggling to find a second job because of childcare issues. Please help at least with the negative reporting as my account should have been under forbearance for 6 months not under review for 6 months. Thank you

The servicing of my second mortgage was sold to Land Home Financial Services XXXX XXXX as of XXXX XXXX, XXXX. It was under temporary modification and as of XXXX is now under permanent modification. Land Home Financial Services sent me a statement in XXXX XXXX indicating they have not received the payments I sent to XXXX Fund in XXXX and XXXX. They show my XXXX payment as a partial payment and show my monthly amount due as the amount before the loan modification. The XXXX payment is not reflected at all. I made the XXXX payment over the phone directly with XXXX XXXX and they do not show this payment at all. I mailed the XXXX payment ( due XXXX/XXXX/XXXX ) on XXXX XXXX, XXXX and as of XXXX XXXX, XXXX, they still have not cashed this check. I sent it to the address on my Hello letter under RESPA and they do not know where my check is. Land Home 's XXXX XXXX XXXX XXXX XXXX told me over the phone that Land Home 's computer systems can not handle temporary modifications. I know that modifications and the sale of loans and servicing are a regulatory focus to protect consumers and honor loan modifications. Finally, I have asked for a current principal balance of my loan and Land Home has not provided me this. Given my on time payments under the loan modification, all accrued interest and late fees are forgiven 25 % each of the first four years. On XXXX I contacted Landhome Finance in XXXX, Ca and spoke with XXXX in customer relations. She advised my loan in XXXX # XXXX was pooled and sold along with being FHA insured # XXXX. The attached XXXX XXXX document shows XXXX XXXX XXXX as the Servicer and XXXX XXXX XXXX XXXX as the investor. XXXX XXXX XXXX trades under XXXX see the SEC XXXX database starting XXXX. This means you disolved my " NOTE '' into a securitized special pooling vehicle ( security instrument ). Landhome Financial breached my contract before I ever made my first payment and opened the door for a completely fraudulent process of my note and deed seperating them. Not to mention in XXXX I advised XXXX XXXX from Landhome Financial 's office by email under no circumstances would I do a mortgage with XXXX XXXX XXXX for they had already deceived me in years prior. Landhome Financial 's negligence along with several other entities allowed the fraudulent stealing of my home, my personal property inside and locked my animals inside XXXX them. Landhome Financial knew all along the devestation and fraud they caused me when they set me up on XXXX. The Truth in Lending laws tells me I had the right to know who my lender was and Landhome Financial took that away. I feel i was discriminated against during my process of buying a house. I started the process back in XXXX of XXXX and finally culminated with a denial in XXXX of XXXX. During the process I was given plenty of hurdles to jump through, which is normal in the home buying process, and I successfully managed every hurdle i was given. I provided every bit of paperwork and documentation that was asked for. The mortgage company did not accept all of my documents for an unknown reason. They had an issue with my earnest money and the way it was sent to them. They made me send in my closing cost and down payment before funding for my loan was secured. I have never heard of a company doing that before. I was given a closing date and bought a ticket to fly out to sign documents for my home and that did not happen. I paid for an appraisal and Termite inspection. Roughly {$1300.00} in total. My credit was pulled too many times by the mortgage company causing my credit score to drop almost 100 points. I have had so much trouble trying to get my score up again to try to buy another home. I was told by the manager of the Mortgage company that I would be ok and the issue would be resolved but that was not the case. They were just stringing me along in order to find something to get my loan denied. When my closing date came and went i tried to get financing through another company and that's when the First mortgage company hit me with a denial letter.

1. I financed a manufactured home through Land Home XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX Il XXXX. I borrowed {$180000.00} to do so as a construction loan. 2. XXXX XXXX charged me interest on a {$210000.00} loan balance from XX/XX/XXXX through XX/XX/2022. XXXX XXXX had approved me for a {$210000.00} loan, but I did not require that amount. I used about {$180000.00}. However, they charged me interest on the full amount until the loan was recast on XX/XX/2022. 3. XXXX XXXX was to impound insurance and property taxes on said HOUSE as a stipulation of the loan. 4. The current escrow and loan do not reflect any Property Taxes on the HOUSE I financed. 5. The only property taxes XXXX XXXX impounded is on XXXX valued at {$25000.00}, which is {$370.00} annually. 6. I own the land free and clear. I have contacted XXXX XXXX on many occasions to discuss the problems with the loan. Each time I talk to a representative and they tell me a different solution. I can not find anyone high up enough to solve my problems. They have sent me several letters which state the same exact thing as the first letter. The loan was not written correctly in the first place, and XXXX XXXX did not redraft the loan papers to fix the errors. Instead, they persist in charging excessive monthly escrow fees over and above the {$1600.00} needed annually for the escrow account. They are charging me {$410.00} per month. Under CARES Act protection I entered into forbearance for 3 months XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. I made all of my payments on time before and after that period. Since XX/XX/XXXX I have been trying to resolve the unpaid amount from the forbearance period. I was told they lend would reduce my payment by 20 % while maintaining my 30 year mortgage. This did not happen. What happened instead is the lender is offering to extend my mortgage to a 40 year mortgage causing me to pay an additional {$70000.00} or more in interest. When I call weekly to Land Home Financial loss mitigation department they can not discuss any of this with me and promise a call back from a supervisor in 24 hours, which never happens. The loan modification docs they sent said to call and discuss this 40 year modification or the other option to just defer the 3 missed payments to the end of my current loan. I have been calling to discuss and declined the 40 year mortgage modification option and formally requested the 3 payment be deferred until the end of my current 30 year loan. The loss mitigation department can only make this noted on the file and say my servicer or their supervisor will reach out to me in 24-48 hrs. I just want to roll these 3 payments ( defer them ) to the end of my current mortgage. I dont want to be strong armed into a 40 year loan with an additional {$70000.00} or more in additional interest.

I refinanced my home in XX/XX/2020. Prior to refinancing, I was set up in auto pay so my mortgage plus additional principle was automatically deducted at the beginning of every month. I cancelled this at the end of XXXX ... Unfortunately, I was too late and my XXXX payment was deducted ( ~ {$1600.00} ) ... Land Home Financial Services provided the loan and was supposed to pay me back within 30 days by check ... I never ( and still haven't ) received it ... Since then, I've called/talked to them several time where they've stated a check is in the mail and it can take time to arrive ... When the checks don't arrive, they've ( supposedly ) cancelled them and issued new ones ... This has happened 3 times since we initially spoke, I believe the dates were : XX/XX/XXXX, XX/XX/XXXX, and XX/XX/2020. When I spoke to them last, I offered to drive to their office in the XXXX area to pick up the check or asked if they can send it via a carrier for sign off ... They said this is not an option and they can only send through standard mail. With all this going on, I'm receiving all my other mail with no issues ... This includes utility and credit card billing statements, personal mail, magazine subscriptions, and everything else ... This has been going on for +4 months. XX/XX/XXXX After 3 attempts to register a complaint, I have been directed by XXXX XXXX XXXX to file my complaint with the company that the mortgage was transferred to and sold without my knowledge. I do not know how XXXX can not be held accountable, as they issued the attached document advising the owner of the property, who is incapacitated, and not her guardian, myself of the transfer of the mortgage. Please see the attached document that was sent to the address of the property that was sold on XX/XX/XXXX without my knowledge. It was not sent to me as her legal guardian. As I have expressed previously, my address was given to XXXX XXXX XXXX as caretaker of the property and as my mothers legal guardian. The only correspondence from Land Home Financial was sent to this address where it was never received by XXXX nor myself. I had no knowledge of the transfer of this loan until the property was sold at a sheriffs sale and upon registering a complaint against XXXXXXXX XXXX XXXX, they provided me with a copy of this document. Landhome financial never contacted me at any time by mail, phone nor email. All of these contact methods XXXX had on file. I would like to know how this property could be sold without Landhome financial ever contacting the owner nor myself as XXXX XXXX XXXX daughter and legal representative.

I recently filed a complaint against my mortgage company. On XXXX I contacted Land home financial services 5 times in one day. I was hung up on two times then advised a supervisor would be calling me back. I filed a loss mitigation packet so that I can save my home. The packet was denied after all of my documents were received. I've been trying to speak with a supervisor to explain that i am paid every two weeks. The examiner stated that the last pay stub received was on XXXX and that I never sent the most updated report. I've been trying to explain that I'm paid every 2 weeks and that my next paycheck was not until XX/XX/2023. Every supervisor is refusing to speak with me. I wouldn't even say the complaint is against the company its more so the workers. I requested that a call i had with a worker be reviewed due to me being removed from a trial payment period however that was never done and i never heard back from anyone. I filed a complaint back in XXXX and I guess due to the complaint against the company retaliation was done against me. XXXX of 2023 my house was assigned to foreclosure while being in loss mitigation status. Just a brief summary of the case : On XX/XX/XXXX XXXX XXXX XXXX filed a fraud foreclosure claiming unlawful payments out of the permanent modification agreement that they signed on XX/XX/XXXX, and which document I am attaching to this complaint. XXXX XXXX XXXX later transfer the service to XXXX XXXX that did follow the same pattern of returning my payments made accordingly to the Permanent Modification Agreement, and Land Home FS is also doing the same from they took the Service in XX/XX/XXXX this year. Because it could be that the Permanent Modification Agreement contract ruling this loan hasnt been disclosed to Land Home FS is the reason why I am enclosing the document for review ; it proofs that I have always been correct in my payments and as proved in Court I have never been in default. Land Home have returned all accumulated payments, including theirs, and I sent the payments back on XX/XX/XXXX including the payment of XX/XX/XXXX, according to the established modification contract, I exhort Land Home to accept the payments in order to make things straight and not let extend the length of their mishandling that could also impact their amount of Respa fines.

I contacted my mortgage company, Land Home Financial, to remove the PMI off my account because my homes value has increased significantly from when I purchased. My loan company is refusing to do so, In a letter dated XX/XX/XXXX they state that my outstanding balance is {$560000.00} and the appraised value is {$610000.00}. This is absolutely not the case as several homes in my neighborhood have sold well over {$700000.00} and my neighbors home sold recently for {$740000.00}. They have given me two options for removing PMI. 1st option is to pay down the loan by {$78000.00} and the other is to show there have been substantial improvements to the home bringing up its value. Neither of these things should have to be done as I know my homes value is today valued at more than $ XXXX. I called Land Home Financial on XX/XX/XXXX and they still refused to do anything about the PMI and only presented me with two options. Either pay down the loan or prove that I have made significant upgrades that would increase the homes value. Which neither are good options since my home is already valued much higher than their $ XXXX value.

My loan with Land Home Financial Services. I went in forbearance last year but I made my payments until I was told that I could stop and came off forbearance on my own by starting to make payments before forebearance was removed. Meanwhile, I had passed my XXXX months PMI required minimum period and my house value went up a lot. Even with the silent second, I am at 65 % XXXX. I had requested several times to have my PMI removed. The customer service shows that I had late payment, which I didn't, and therefore my PMI removal request was denied. Eventhough the PMI was supposed to be removed based on XXXX alone. The loss mitigation department confirmed that I was never late. They sent it couple times to escalation and nothing happened. We received an email from XXXX XXXX on XX/XX/2021. I emailed him twice for update and no reply. His voicemail is always full. I am being charged unfairly $ XXXX and it doesn't seem like anyone at LHFS cares or willing to do anything. During 2018 I was plagued with medical issues which cost me a large amount of money. It also caused me to have to take some time off of work to recover. I was still not 100 % when the XXXX pandemic hit. Due to my compromised health I had to take every precaution. I had to take time off of work and had to pay for delivery to stay away from people. I called my lender and they put me on a XXXX forbearance. My forbearance ran out and I was still not back to my pre pandemic income. When the forbearance ended I was asked if I was able to resume my payments, I was not. I am finally back to my income and my lender is refusing to let me access FHA post XXXX assistance. My interest rate is at 5.125 %. I have researched and as long as my past due does not exceed {$46000.00} I should be able to get a partial claim and keep my rate. If my past due is more than that figure, I believe I should be able to get a recovery modification. I have been through medical issues, a pandemic and I am in XXXX and was effected by XXXX XXXX and I believe FHA has assistance that can benefit me and my lender is refusing to let me access it.

I had a hardship that caused me to default on my mortgage in XXXX. I went into the HAMP program and the 2nd mortgage refused to participate. The second mortgage refused to do anything on the note, and sold the loan several times until after the new servicer Land Home Financial took over the loan. The books were fraudulently changed by one of the mortgage servicer 's to reflect that payments were made through XXXX of XXXX. Land Home has refused to supply payment record 's to myself, but did produce them for the New Mexico Attorney General. The payments reflect false information that the company used to then file for foreclosure, and to make it look as if the last payment was 7 months later than it truly was. They have also refused to hand over the default letters, and if Land Home only has default letters from XX/XX/XXXX, then the previous letters were either erased and hidden to try and make it look as if the loan had been paid through XXXX, and foreclosure would still be valid, but this loan is past the statute of limitations if not for the fraud that was written by the servicer.

Sent tax statement to Land Home Financial Services. Company provided me with an escrow analysis. Escrow analysis was done incorrectly and taxes were added twice onto the statement. I called and finally got through to someone who understood the analysis was not correct. New analysis was sent to me a month later. Our mortgage is due on XX/XX/XXXX and they still have the incorrect amount due. Called and spoke with several supervisors and they say they cant un-do this and that I must pay the incorrect amount which is {$2300.00}. The actual payment I should owe is {$1700.00}. Land Home FS is unlawfully asking me to pay the amount of {$15000.00} while accepting there are not pending insurance issues and being aware of the limits shown by the Permanent Modification Agreement. I received and signed the attached loan estimate and closing disclosure statements with this lender for a mortgage which stated a monthly mortgage insurance rate of {$220.00}. The final closing disclosure statement increased the monthly mortgage insurance rate to {$270.00} with no explanation or change in circumstances XXXX days before our closing. This means that tomorrow I will be forced to accept this last minute increase so that I do not lose the home or I have to forego the closing and I do n't really know what would happen to my paid deposits, appraisal fees, inspection fees, etc. It should not be legal to change the mortgage insurance once the closing disclosure is signed.

I was talking to my realtors lender and giving her my information to get a Pre-approval to put a contract on a home.
