XXXX XX/XX/XXXX, I had a mix of some fees caused by checks I had written which in turn made my account go negative. I've had this account for XXXX years at this point and never had an issue close to this. They were inflexible with the fees and one lady I talked to was downright nasty. I decided I no longer wanted to bank with LMCU after XXXX years because of the interaction. My last direct deposit to LMCU for {$1800.00} was sent on XX/XX/XXXX. I call LMCU to discuss closing the checking, saving and two credit cards with balances I had with them. This is where the issue comes. The deal that was presented to me was that half of my paycheck would be used for the negative balance, the other half I could come into branch and pick up cash. The remaining negative {$1000.00} balance would be put on the loan with the balances from the credit cards and ALL accounts would be closed. The rep reassured me multiple times that the checking and savings balances were {$0.00} and I have to call in to make a loan payment. At this point my login info no longer works so I have no way to verify that the account balances were {$0.00}. So I take her word for it. At this point 3 months later, a rep has called me from LMCU to make a loan payment. This was the only topic of discussion and led me to believe everything is just fine. There were NO other attempts at contacting me. On XX/XX/XXXX my Mom calls me ( she has an account at LMCU and opened mine for me when I was about XXXX XXXX XXXX, so her name was attached to the account ) saying LMCU withdrew {$1000.00} from her account. SHE called in to see what was going on. Mind you she did not recieve a single phone call before they took from her account. And even after the transaction, SHE was the one who called in. The rep told my mom my checking account ( a different rep later on says it was my savings that was overdrawn ) was 90 days overdrawn and since she opened the account for me XXXX years ago, that gives them the right to pull from her own checking account with no notice. Mom calls me and asks me whats going on with my LMCU accounts. I tell her I don't have any and that they were closed 3 months ago. As I have had no access and haven't heard anything about it. She gives me the story of what happened. I call LMCU to get some clarity as to how this is possible. The rep told me that the accounts were still open with a negative balance and she " didnt know '' where half of that paycheck went that was supposed to cover the negative amount. The other negative portion didn't get added to the loan like I told it was. When I brought this up the rep said " Well you signed loan documents didn't you? Wouldn't you have seen the incorrect amount? '' I said I didn't have access to the exact balances of all the accounts. So when the original rep told me that it encompasses everything, im wrong for believing her? Saying things like its my fault for ASSUMING the accounts were closed. I said PULL UP THE PHONE RECORDS. She wouldn't. When I asked if we can talk to the original rep that made this mistake, they REFUSED saying their system can't see who it was. I asked for the phone call recordings and they refused to furnish those as well. They also said they are not going to reverse the charge from my moms account. I went into a branch to talk to someone and it was the same result. Refusing to find out who helped me and phone call records. To summarize ; My money was mishandled, I signed for a loan under false pretenses and an incorrect amount. I was told my checking and saving were closed at {$0.00} balance. My login info didn't work so I had no way to verify any of this. No correspondence for 3 MONTHS except when I recieved a call to make a loan payment. Even then the gentleman NEVER brought up that the account was negative still. Then my mom gets charged {$1000.00} with not a single phone call to me or her. Then when I ask to talk to the orginal rep who made all the mistakes, they tell me they don't know who it was. Refused to give phone call recordings.

Dear Sir/Madam, I am writing to file a formal complaint against Lake Michigan Credit Union XXXX XXXX ) regarding multiple issues related to my accounts with them. The details of my complaint are as follows : In late XX/XX/XXXX, I suffered a severe concussion due to an auto accident, followed by contracting XXXX for the second time in XXXX. These medical conditions significantly limited my ability to manage my business, which, in turn, led to financial difficulties. Due to my health challenges, my personal checking account with XXXX went into negative balance, resulting in numerous overdraft charges that I did not opt-in for. These charges occurred without my consent. On or about XX/XX/XXXX, Lake Michigan Credit Union charged off my personal checking account without providing proper notice. Despite my immediate attempts to pay the outstanding balance in full, XXXX refused to remove the charge-off from my credit report. In exchange for settling the balance, I requested that XXXX remove the charge-off from my credit report, but my request was denied. I believe this led the loss mitigation department at XXXX to take questionable, if not illegal, steps to punish me. Shortly after the charge-off, XXXX denied XXXX online access to my account, which included my credit card and auto loan accounts held by them. This also suspended e-delivery of all statements and notifications. Since I hadn't received a monthly statement, I called XXXX customer service on XX/XX/XXXX, to inquire about my VISA payment amount. I was told the amount was {$200.00}, which I immediately paid through a transfer from my business checking account. However, I later discovered that XXXX reported me as 30 days late to the credit agencies because the amount given to me over the phone ( on a recorded line ) was allegedly a couple of dollars short. In addition to my personal account issues, I also had a business account for my S-corporation with LMCU. They started restricting this account as well. First, they froze my debit card in early XXXX. Subsequently, they restricted online access, and finally, they refused to accept a cash deposit on XX/XX/XXXX, which resulted in my car payment being returned. As a result of these actions, I made the decision to close my business account with XXXX on XX/XX/XXXX. While I have written notes detailing the events above, I also possess recorded calls with LMCU that provide further evidence of the issues I have faced. I request the Consumer Financial Protection Bureau 's assistance in investigating these matters and ensuring a fair resolution. The actions taken by Lake Michigan Credit Union have had a significant negative impact on my personal and business finances and have also affected my credit standing. Thank you for your prompt attention to this matter. I look forward to a resolution that addresses these issues and prevents similar situations from occurring in the future. Sincerely,

XXXX XXXX XXXX XXXXXXXX I received a text stating that there was a {$150.00} transaction pending on my account. This text was quickly followed by two other text stating that two other {$150.00} transactions were pending on my account. I logged in to my online banking and saw these XXXX transactions were from XXXX. I do not and have never had a XXXX account. When I called LMCU the first time, I was told I could do a dispute online. Went to the website to do it, transactions were not available for me to dispute. So I called back a second time at which point I was told the transactions needed to post before I could dispute them. I then chatted in to see if there was anything that could be done at which point I was informed since it was fraud then something could be done and I was given the phone number for the fraud department. I called the fraud department and was told that it was actually a debit card transaction not ACH as the mobile app intially stated. I asked which debit card it was and was told the last four numbers. This representative then transferred me to the debit card fraud team. The gentleman from the debit card fraud team was less than helpful. Literally zero empathy and told me go to a branch or do it online. I hung up with this gentleman and called back for a fifth time hoping to get someone a little nicer to assist. The final person I spoke to was helpful and he was the first person out of the SIX I spoke to that offered to block my debit card for me. Ridiculous that it took SIX people before that was even offered up as a solution to prevent further transactions coming out of my account. So since I was not able to dispute the charges at the time I noticed them, the fraudulent charges caused legitimate items to bounce on my account and resulted in " courtesy '' fees to be assessed. Honestly what I find to be the absolute most ridiculous part out of all of this is their fraud department is constantly texting me to make sure transactions for {$20.00} or {$39.00} dollars are legitimate, which they have been, but when XXXX transactions for {$150.00} dollars occur within seconds of each other on XXXX XXXX, even though XXXX XXXX has NEVER taken money from the account before, not a single eye is batted and no attempts to block it are done. Absolutely ridiculous. This whole experience is making me consider switching financial institutions because I feel like I am having to jump through so many XXXX hoops to get my money back from a fraudulent charge when the fraudster was just able to waltz in and steal the money and LMCU was just like " go ahead, these charges on an account that has never ever had any sort of sports-betting or gambling charges on it ever in the almost XXXX years it has been open seem totally legitmate '' I am just absolutely disappointed and disgusted with how this is being handled. I want my money and all the fees that were charged back immediately.

I had an appointment with Lake Michigan Credit Union on XX/XX/22 to discuss mortgage forbearance from the CARES Act due to financial hardship from the pandemic. My mortgage is backed by XXXX XXXX and I'm not delinquent on payments. The employee handed me a Mortgage Assistance Application which required the following documentation : Borrower Assistance Form and Worksheet, Hardship Letter, 4506-T, last 30 days of pay stubs, most recent statements for all bank accounts, most recent utility statements, proof of obligations which contribute to your hardship, last two years signed Federal Tax Returns with all schedules, W2s and 1099s, and the most recent retirement account statement. I explained that the CARES act only requires that I report that I'm experiencing a pandemic-related financial hardship and that because my loan is backed by XXXX XXXX , I am allowed to request a mortgage forbearance without disclosing additional information. The employee made a phone call to another XXXX employee and shared what I said. After she got off the phone, I was told that even if the government said that there was no additional documentation needed, XXXX would still need it. I let the employee know that I would contact one of the agencies who help lenders navigate these requests and come back another time. After I left the office, I received a voicemail from another employee with XXXX. I returned the call and was pushed for more information about my need for a forbearance. I explained the CARES Act rules and that I could ask for a forbearance for up to 180 days and later request an extension. That my loan would still accrue interest but there would be no late fees and no report to the credit bureau that I was delinquent. How the missed payments would be repaid would be figured out between me and XXXX. The employee acted like she didn't know about these rules and kept pushing me for personal information so she would know which forbearance plan would best suit my needs. She also said that a forbearance might still negatively affect my credit and the missed payments would be due in one lump sum after the end of the forbearance. I explained that the CARES Act prevents mortgage services from requiring a lump sum repayment unless the borrower chooses to do so. I added that a foreclosure notice would be much worse for my credit than having a mortgage loan that wasn't decreasing in amount. I again shared that I would be reaching out to an outside agency to help me navigate this issue.

Subject : Complaint Regarding Account Opening Process at XXXX XXXX XXXX XXXX XXXX, MI Branch On XX/XX/XXXX I spoke with the representative emailing all the necessary documentation, including an Employer Identification Number ( EIN ), articles of organization, and my identity documents, as an alternative to a Social Security Number ( SSN ). I expected to proceed with the account opening smoothly, but to my surprise, the representative went into default refusing to fill out a Form P1 ( Reasonable cause for not obtaining a payee number ) and requested a Social Security Number. This request caught me off guard as I was under the impression that providing an EIN, along with the other requisite documents, would suffice. My concern arises from the misunderstanding that occurred during this interaction. It is essential to clarify that while bank staff may request a Social Security Number, they are not mandated to obtain one. The distinction between requesting and requiring such information is crucial. In cases where a banker wishes to demonstrate their effort to collect a Social Security Number, Form P1 should be utilized, as it serves as a reasonable cause form. This form is designed to protect banking staff and ensure compliance with relevant regulations. I strongly believe that the bank staff XXXX XXXX and branch manager XXXX XXXX at the XXXX, MI XXXX should be well-informed about Form P1 and its purpose, as it plays a vital role in protecting both customers and the institution itself. By utilizing Form P1, clients can attest to the fact that the bank requested their Social Security Number but it was not provided. This procedure aligns with the provisions outlined in XXXX XXXX XXXX and Treasury Regulation XXXX ( c ), which allow for the waiver of penalties in such cases. I kindly request that you address this issue promptly and ensure that your staff at the XXXX, MI branch is educated on the proper application of Form P1 and the difference between requesting and requiring a Social Security Number for account opening. It is crucial to provide a more transparent and efficient process for customers who may not possess an SSN but have valid alternatives, such as an EIN, as recognized by the relevant regulations.

I have funds in my joint Lake Michigan Credit Union ( LMCU ) checking account with my wife. She had an unpaid LMCU credit card that was a very small fraction of the total funds in the account. LMCU would not allow me to withdraw a small amount of funds because of the fractional charge on an account I am not on. LMCU denied disbursement because of a fractional charge that my wife had been trying to pay for the last month online. She didn't get to LMCU before they shut down all funds. We were unable to make it to LMCU during hours during a difficult period as my father passed away XX/XX/XXXX and had been actively transitioning since XX/XX/XXXX according to the hospice nurse. We tried to pay using the online tools but LMCU had technical issues sending the money from our joint checking account to her separate XXXX account. Note the amount that LMCU cancelled us over was < 1 % of the total funds they froze due to my wife 's unsuccessful attempts at paying. LMCU then removed all rewards she had on the credit card which totaled {$200.00}, well over the amount LMCU froze all funds for. Since they took these terrible consumer threatening actions we closed our credit accounts and are actively working to move our funds out of this place because of their terrible company policy that keeps funds away from the consumer for very fractional amount of funds. As a consumer I am appalled that my funds ( ie paycheck used to operate my family expenses ) was froze and restricted from me for a fractional amount that was late and that I was not associated with. This practice was highly impactful for our family and law should be made if not already to ensure these institutions don't continue to threaten hard working American consumers.

See complaint ID XXXX I submitted last month. XXXX says that the account went negative on XX/XX/23 and the loan was finalized on XX/XX/23 and they " respecfully disagree '' that any conversation regarding adding the negative amount on to the loan took place. That was it. THIS IS WHAT THE WHOLE COMPLAINT IS BASED OFF OF. They have still withheld which employee it was that gave me false information. They also have no produced any phone records that would CLEARLY show which one of us is correct. I feel like these two reason alone is pretty telling. I have asked for this information on multiple different occasions. Also in their response they say they attempted to contact me, but could'nt leave a voicemail? I got those messages they sent me but I thought it was in regards to the loan payment! Both very vague messages like " call us when you can '' so when I did call, all that was discussed was the loan! They did not bring up the negative amount once!!!! How am I supposed to know that its negative when I am originally told that the account are closed and when I do call in they made no mention of it! Their response was baseless, incorrect and insulting. They still did not produce any evidence that they are correct except saying they " respectfully disagree ''.

Lake Michigan Credit Union [ LMCU ] has continued to charge me overdraft fees and nsf fees dispite numerous attempts by myself to remove the so-called " overdraft protection '' from my acct. I was able to successfully unsubscribe from the checking acct. and they did not tell me that I needed to do a separate form for my savings account. I then went back to do this for my savings account, but then it started on my checking account AGAIN! They informed me that everytime I get a new debit card I have to go back in and resign the forms. Then I STILL received more fees. I was told that if I have an auto-bill pay setup then it would happen again. I understand and went to the different companies that auto debit and asked them to stop. XXXX of them [ XXXX, XXXX XXXX, and XXXX XXXX ] would attemt to withdraw multiple times FOR THE SAME TRANSACTION and I would get a {$30.00} fee each time. To date I have paid over {$1200.00} in {$30.00} fees on this checking account. I lost my job and have been to XXXX different branch locations begging for some sort of freeze on my accounts until I get a job, yet they happily continue to charge {$30.00} fees.

My computer was compromised on XX/XX/2022. Several pop-up alerts were on my computer saying that I needed to call XXXX to fix the issue, I contacted the number and someone was guiding me through several pop-ups leading to a black screen. They told me to enter certain letters, numbers, and symbols by the blinking cursor. They were talking to me about the amount of money in my bank account. They told me that I need to go to XXXX or XXXX to get gift cards, then come home, because they needed to get the information off the cards. I purchase {$4800.00} in gift card. I found out later that they took the money out of my bank account. I was very nervous about this whole issue. I have XXXX and on very heavy duty medication. I contacted my son and he told me that this is a scam. I contacted the police department to get a statement and a detective is also suppose to contact me. Right now I am not getting any help from anyone about this matter to get my money back. I was told by XXXX to contact you to tell you what happened. I hope I can get some help from you. Thank you for your time in this matter.

On XX/XX/2023, Lake Michigan Credit Union charged me three ( 3 ) overdraft fees for payments that were already deducted from my positive balance. These payments each were for {$30.00} which totaled {$180.00} they stole. I called Lake Michigan Credit Union four times, three times on XX/XX/2023 and once on XX/XX/2023. Additionally, I went to their XXXX XXXX, Mi branch on XX/XX/2023 and spoke to their representatives. I showed their XXXX proof that the money was already deducted from my available and positive balance. They refused to refund me. I called and emailed XXXX because the overdraft fees stemmed from my payments to them. They confirmed that my payments were deducted from my account with them on XX/XX/2023. Lake Michigan Credit Union is committing fraud by using their courtesy fee system to steal money from its members. I would like my {$180.00} refunded from them.

On XX/XX/XXXX and on XX/XX/, I called Lake Michigan Credit Union to inquire about why they were charging me for overdraft fees when I left enough money in my account to make my payments. And I also told them per 12 C.F.R. that a customer can opt out of overdraft fees. I did opt out on XX/XX/. LMCU still charged me {$30.00} on XX/XX/XXXX and {$30.00} again on XX/XX/XXXX after I opted out of overdraft. In addition, my payment to XXXX was already processed and validated as gone through on XX/XX/XXXX in the amount of {$35.00}. Therefore, I had to pay that {$35.00} once again because LMCU sent the overdraft on XX/XX/XXXX as my payment not going through. I can verify I made this payment a second time through my XXXX XXXX account. Charging for overdraft fees when a customer has opted out is illegal and fraudulent.
