My name is XXXX XXXX. I am trying to get a recorded subordination agreement from the law office Kyle Law Group. This is a judgement lien against my husband, XXXX XXXX, that was filed XXXX/XXXX/XXXX. This was federal student loan judgment. I went through a HAMP re-modification with my mortgage lender XXXX XXXX XXXX XXXX. I successfully completed the terms of the HAMP agreement. I was told by a mortgage representative that in order to receive the final documents, and wipe the slate clean to get back on track with my mortgage I need to take care of the liens and/or judgments that belonged to my husband. I am the only one who is on the original mortgage loan agreement. I receive social security XXXX, my only income. My husband who was working at the time I started the HAMP re-modification process had to have his income included because we needed his income in order to qualify for the HAMP re-modification. We have been paying {$75.00} every month for the last 3 and a half years to the Kyle Law group towards the student loan judgment. This {$75.00} goes toward the interest and not the principal. Even though we are paying as agreed ( the funds are debited from our bank account on the XXXX of every month and we 've never missed a payment ). The law group says that they will not give my mortgage company a recorded subordination agreement. If they do n't do this for me then I will not get approved for permanent modification and could lose our home. This attorney is collecting this debt on behalf of the US Department of education. I wish that my husband 's income did not have to be calculated and therefore, I would not be in this dilemma. I am the original borrower on our mortgage. I do n't fully understand what my right 's are as a borrower. I originally fell behind in my mortgage payments after being diagnosed with XXXX XXXX ( XX/XX/XXXX ) and present. My employer laid me off, so the end result is where I am now. These liens have nothing to do with me. My husband recently submitted a lien complaint to your agency on XXXX XXXX, XXXX. My mortgage company said that this issue must be resolved by XX/XX/XXXX. I would really appreciate any help that you can give.

I have a student loan judgment debt with the XXXX, in which I must pay {$75.00} each month. I receive social security on the third Wednesday of each month therefore I ca n't have the Kyle law group which is the debt collector for the U XXXX take the payments automatically from my bank account each month, so my wife elected to have my payments deducted from her bank account instead, because her social security XXXX check is deposited on the XXXX of each month. However, that can change as well because if the XXXX falls on a weekend then the deposit will go in a day or XXXX early. This causes an overdraft on her account as well as mine. Also the Kyle law group is setting our accounts up with the pay .gov website where the payments are being collected. XXXX Kyle is not sharing any account information with me or my wife ie. username, password, security questions. If I want to make changes on the website I have to go through the Kyle law group, I ca n't make the changes myself. When I cancelled the payments from being collected from my bank account on XX/XX/XXXX2016 the Kyle law group took the payment from my account as well as my wife 's account on XX/XX/XXXX2016. Because I did not know the username, security questions, or password I could not make the changes, because Kyle law group set the account up, and did not let me know any information. Now the same thing is happening to my wife, and their office has set up a pay.gov account for her and will not share any of the account with her. She does not owe them I do. I do n't mind paying on my debt each month but I prefer to call the Kyle law group each month and let them run my debit card, therefore, not causing me or my wife overdraft charges. We both are on a fixed income in which the dates for depositing our checks are not set in stone. This is why I would rather call them each month and process a payment. I do n't know why the Kyle Law group does not want to share the account information with me or my wife. I would appreciate your help. Thank you.
