I refinanced my primary home in TX through XXXX mortgage XXXX originator ), their parent company is Kwik Mortgage based out of NJ. XXXX hired XXXX XXXX title for escrow. The closing statement stated i need to pay {$6800.00} for closing but they have collected {$8800.00} and refusing to refund excess money {$2000.00} paid into escrow. It has been over 6 weeks now. XXXX XXXX Mortgage told me to wait for 2-5 weeks and now XXXX XXXX and XXXX both refusing to resolve the issue amicably but giving me runaround asking me to contact my previous lender. I did contact the previous lender, they have stated that XXXX did not pay the full excess amount but paid {$400.00} more than the closing statement. Which means XXXX owes me XXXX, at least. First, Kiwi mortgage told me to wait 5 weeks but nothing happened after that. I reached out to Escrow, now they say my previous lender has the excess money collected by XXXX XXXX and XXXX XXXX XXXX. But, XXXX confirmed that they did not receive XXXX excess payment. Which XXXX XXXX / Kiwi Mortgage and XXXX XXXX refusing to even acknowledge my email anymore. I would like to get a refund or the loan amount reduced by XXXX. Or if there is a legitimate reason if the cost has gone up, i would like to know that and need someone to explain. I was looking to buy a home and found Kwik Mortgage out of XXXX XXXX NJ to get a loan from. I met with the mortgage broker ( XXXX XXXX ) and explained my entire situation. And what had happened to me in the past. I explained to him and Kwik Mortgage that I had a precious foreclosure and that I wasnt sure the exact date the foreclosure was finalized. Even before I filled out all the paperwork, the mortgage broker and the Vice President of the Kwik mortgage assured me that I was going to be approved and granted the loan and also before founding out the exact date of the foreclosure was found they approved me and ordered the inspection and appraisal of the home. They told me I was approved for a conventional loan at a 3.2 % interest rate. And was told that because of my foreclosure it was at 3.2 and not at 2.8. I have a XXXX credit score, I work full time and I was putting 10 % down. My official foreclosure date was confirmed that it was XX/XX/2017. Once again the mortgage broker and the Vice President reassured me that I was going to be approved. Without any hesitation. So they ordered the inspection ( which was {$550.00} ) and appraisal ( {$500.00} ). I provided every document they asked for and needed. 10 days before my closing date and even after being approved the underwriter explained that I didnt not met the guidelines and was short 4 months from 3 years. But after talking to an Attorney an Another Mortgage broker I was told that a conventional loan is 7 years after a foreclosure and 3 years for an FHA. I was wondering if there was anything that can be done.
