Dear Sir or Madam, XXXX. KUBOTA CRED Account XXXX Please correct this inaccurate information on my credit report. I recently pulled my credit report from your Bureau and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 30 days late on this account in XX/XX/XXXX as well as 60 days late in XX/XX/XXXX. I immediately disputed this information with KUBOTA CRED and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( 4 ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. 1666a. Regulation of credit reports ( a ) Reports by creditor on obligor 's failure to pay amount regarded as billing error After receiving a notice from an obligor as provided in section 1666 ( a ) of this title, a creditor or his agent may not directly or indirectly threaten to report to any person adversely on the obligor 's credit rating or credit standing because of the obligor 's failure to pay the amount indicated by the obligor under section 1666 ( a ) ( 2 ) of this title, and such amount may not be reported as delinquent to any third party until the creditor has met the requirements of section 1666 of this title and has allowed the obligor the same number of days ( not less than ten ) thereafter to make payment as is provided under the credit agreement with the obligor for the payment of undisputed amounts. ( b ) Reports by creditor on delinquent amounts in dispute ; notification of obligor of parties notified of delinquency If a creditor receives a further written notice from an obligor that an amount is still in dispute within the time allowed for payment under subsection ( a ) of this section, a creditor may not report to any third party that the amount of the obligor is delinquent because the obligor has failed to pay an amount which he has indicated under section 1666 ( a ) ( 2 ) of this title, unless the creditor also reports that the amount is in dispute and, at the same time, notifies the obligor of the name and address of each party to whom the creditor is reporting information concerning the delinquency. ( c ) Reports by creditor of subsequent resolution of delinquent amounts A creditor shall report any subsequent resolution of any delinquencies reported pursuant to subsection ( b ) to the parties to whom such delinquencies were initially reported. 1666b. Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). I DEMAND to see proof that I was mailed my statement to the correct address notifying me of both payment due date and delinquency of payment on the account. If you can not provide 100 % Verifiable proof and proper documentation that the CREDITOR fulfilled its obligations under the ( FCBA ) and ( FCRA ), I therefore demand these late payments be removed from my account or I will be forced to be in contact with the Attorney General of my State and the Consumer Financial Protection Bureau. I therefore am submitting my written request to you to conduct an investigation. Per the FCRA, you have 30 days to conduct this investigation and respond to my request. I have been trying to figure out how my payments are applied to interest versus principle on my monthly loan and there doesn't seem to be any information available, and I believe that Kubota Credit is being intentionally obtuse or outright dishonest about their methods of computing it because they have been evading giving me any kind of answer at all to my very direct questions and request of assistance in figuring this out. I am trying to figure out what day of the month i need to make my payment to maximize the amount going to the principle instead of interest. There is no information available, it is not clear at all how the division of money is applied, and I have seen a huge difference in how much goes to interest versus principal depending on the day of the month. Unfortunately, there isn't any logic that I can discern based on previous payments that will allow me to see what day of the month will provide me with the best bang for my buck. I am unable to figure out whether or not I will be able to pay off my loan in the agreed amount of time because so much of my payment has gone to interest instead of principal and there doesn't seem to be any logical methodology that I can work with. I have called several times to try and get more information on the division of interest versus principle with my payments and have not been able to get a straight answer from customer service and have been told at least five times that a manager would call me and I have never heard back. I have even been told by one of their representatives that they wouldn't, not couldn't, tell me what day would allow the most of my payment to go towards principle, instead of interest. I have complained multiple times with their customer service, and asked to speak to a manager or to have my request for information about my loan brought to the attention of someone that can answer my questions, but I can't get any further than basic customer service. I have had them send me a copy of my contract to see if the information is in there about how they apply my payment towards principal versus interest and there is nothing in the contract. I need some help getting Kubota Credit to be open and honest about their loan and its repayment terms and conditions. They have not been clear about this from the beginning, and I suspect I have lost hundreds of dollars that could have been applied differently if I was able to have the information about this.

I purchased a Kubota XXXX skid steer around XX/XX/XXXX. I set it up for the payment to automatically come out of my bank account every month. A payment was never missed. I believe I owned the unit for just under a year. I took it to XXXX XXXX XXXX dealer for warranty service work. The XXXX XXXX was stollen off of their property while they had it. After a few months their insurance company came to an agreement to pay the skid steer off. I called Kubota credit to make sure they received the check because I was going to purchase another skid steer. They said the check had been received and that everything was paid for. I asked them what I needed to do to close the account so that an auto payment wouldn't come out again. They told me how to go online and do it. This is where the issue comes in. I received an attachment called a Grappler with the skid steer in XXXX of XXXX. It was financed within the same account. The lady that told me to close the account must not have caught that. I didn't know it was financed as a separate piece. They finally called me and I paid it off right away. Next thing I know they reported me as not paying it on time and my credit score dropped XXXX points. I've had my new Kubota skid steer for XXXX plus months and still have not missed a payment or been late. I talked to them about the issue on XX/XX/XXXX and again to a person that said a manager would look it over on XX/XX/XXXX. They said they would call me back and never did. I received a letter that they denied my request to fix the credit reporting and that was it. I try to pay everything on time and because of a mistake on their end telling me to close the account..ended up ruining my credit.

hi i called the company and told them i could pay on the 4th but my bank account was stolen thy said that kubota took back the account i called kubota thy said we dont have the account avanta usa had it i was told by andrew at avanta no thats not true kubota took account back so know one knows whare the account is im trying to take care of the account my uncal co signed for the loan his bank said that kubota took XXXX out of his account to pay the loan both kubota and avanta usa said no check was cashed but he has proof from his bank the bank going to send proof to kubota and i have an email i owe XXXX from kubota i sent to kubota as proof and avanta is saying XXXX or will repo it next week thy never tryed to contact me or i would have taken care of this matter i asked what number thy tryed calling and the numbers thy called was not mine and i asked them to call kubota to get the right in fo and somone droped the ball boy he got mad at me on the phone and stated not our job and we will not contact them for the info and we will repo in next week after all this even know thy made a mistak are un willing to correct it myself and my uncal have spoken to both companeys 3 times and can not get this corrected

Kubota Credit Corporation has reported XXXX big accounts on my credit report as a charge-off and has been aggressively attempting to collect debt on the accounts that do NOT belong to me and failed to provide any supporting documentation... This year I received a summons for the XXXX loans Kubota was trying to collect from me, when I contacted the number on the summons, I was told it was NOT my account and that they have made a mistake, so I did NOT need to respond to this lawsuit .... However, they are still reporting XXXX negative accounts on my credit ... and attempting to collect debt. This is never-ending... My numerous attempts to resolve this with Kubota went ignored... With some legal help I finally received a copy of the contract ( XXXX ) from Kubota which date XX/XX/17, XX/XX/17 and XX/XX/17 and XXXX ) do NOT contain my signature, XXXX ) do NOT provide social security, XXXX ) have address for " XXXX XXXX '' as XXXX XXXX XXXX never resided at this address and not familiar with it, XXXX ) no proof of payment provided and XXXX ) no proof of identification provided to support their claim that they have the right person on these accounts .... On XX/XX/XXXX, I was sold a XXXX XXXX XXXXXXXX by XXXX XXXX in XXXX Texas for XXXX by XXXX and XXXX. I was XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX. Everyone in the dealership could smell and see that I was XXXX XXXX XXXX, they have all since admitted it to me, including the owner XXXX. They even tried to sell me another tractor then, however I was too XXXX to go through with it. My XXXX date is XX/XX/XXXX. I do not recall much of the ordeal. They have an email registered to that account that I do not recognize. I dont think I signed the agreement, I dont remember. Within the last 2 weeks, I contacted the owner XXXX and although he agreed that I was XXXX XXXX XXXX, he did not grant me relief. I then contacted kubota credit corporation. Kubota credit then began a series of misleads. XXXX, XXXX, XXXX, XXXX, XXXX, and XXXX made consistently misleading statements about the email of record as well as their chain of command. Each of them sent me to each other, claiming to be the supervisor. I wasnt told if I received any veteran discounts or agriculture exemptions. To this day, Ive not been given a copy of the contract, that I can remember.

i tryed to make payments on the dept from kubota on a XXXX that was taken from me and got told no the first time i called on the {$5000.00} letter thy sent me i called on XXXX got told hold on let me check then thy came back on the line and said XXXX a month or we will send it to a lawyer then will offer you a settlement i explaind i dont have that kind of money thy refushed to send me any paperwork so i can pay XXXX a month thats all i van do i adviced them if i file XXXX XXXX and its discharged thy can not collect on the dept due to bankrupancy laws iasked them again ide like to pay it but will not take payments no less then XXXX a month this is wrong and in XXXX ill seek a laywer and let him deal with this im on a fixed incom i adviced thim of this XXXX dont go vary far i aslo told them i have a wage garnishment now and if thy try that thy will ony get 10 percent of my wage thats law

The complaint I have with each company is, my rights were violated. I recently came across information from the Federal Trade Commission more specifically the Gramm-Leach-Bliley Act 15 USC 6802. On one of the accounts ( XXXX ) my now ex-husband purchased the unit with me as the buyer and him as the co-buyer with all of my information. I never signed any documents, nor did I give him premission to do so, because we were married at the time, I didn't want to prosecute him. After looking at the original documents. I've never lived at the address on the document, nor did I sign anything, someone had to sign my name. I will attach all of the following correspondence letters I've sent to these companies as of XX/XX/2022 with no resolution. My student loans have also been XXXX due to a permanent XXXX, but they're still being reported.

I recently purchased a co-op apartment in XXXX. When I looked over my final closing paperwork, I noticed a lien against my name from Kubota Credit Corporation with a file date off XX/XX/XXXX and a lapse date of XX/XX/XXXX. It appears that this company is out of Texas ( XXXX XXXX XXXX XXXX TX XXXX ) and finances lawn mowers and tractors. I have never financed any such items ( I live in XXXX! ) and have no need for any such items. I believe this lien is in error or fraudulent. I contacted the company and spoke with a XXXX in the finance department at XXXX ext XXXX on Monday, XXXX XXXX. Nobody from the company could identify what this was on their end. XXXX informed me that he would look into the matter and follow up via email. He did not.

My estranged husband applied for a Kubota Credit loan to purchase machinery. He used my name and credit to obtain the loan with myself as a co-signer. I have never been in the XXXX, Tn Kubota store nor did I agree to co-sign. I never signed for a loan with Kubota. I found this loan when I checked my credit report and I immediately called Kubota Credit Corporation. They sent me the contract which was electronically signed. I filed a report with the XXXX, TN police department. They admitted they only spoke to " me '' over the phone and that " I '' was not in store that day. Kubota is dragging their feet in trying to resolve this issue. I have made a fraud complaint with Kubota Credit and I am still getting the run around.

I filed bankruptcy which was discharged the first of this year. Kubota Credit Corporation shut off online access to my account and failed to restore as promised. In addition they still show derogatory credit information on my credit report even though a reaffirmation agreement was signed and account is current. They should be paid ahead, however they will not provide an accurate statement of account as requested five times. They improperly did not credit a payment to my account made by check, and will not provide account information requested. My credit report shows delinquent on this account even as been paid on time, ahead for months.

I had a retail installment loan through Kubota Credit. The loan was paid off ( total loss insurance claim ) on XXXX My autopayment was then deducted XXXX XXXX ( per my bank ) a second auto payment was drafted AGAIN on XXXX I have contacted Kubota Credit and they are doing an internal investigation for the last XXXX days. As of this date they are giving me the run around and refusing to return the two fraudulent charges. Their system shows a partial refund, I have not received any refund, and why WOULD IT BE A PARTIAL RETURN!!?!

Kubota credit USA is unlawfully reporting information on my report and will not remove as requested. They show late payments that per 15 USC 1681a ( 2 ) A ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; are to be excluded from the report. Kubota credit issued me a 1099C last year. I paid the taxes on the amount wrote-off. Kubota is reporting the acoount to the credit reporting agency as a charge-off acount with a balance due.
