Received a letter in our on XXXX XXXX. Letter from collection attorney was dated XXXX/XXXX/2016 given me an opportunity to respond. Upon further investigation the envelope it was sent in was dated XXXX/XXXX/2016 this explained why I received it so late. I responded in writing on XXXX/XXXX/2016 and sent it via XXXX. Now today I am served a suit for the money amount dated XXXX/XXXX/2016 and filed XXXX/XXXX/2016. It was filed 3 days before I received the initial letter. I believe the letter was deliberately held 5 weeks and then mailed in an attempt to claim I never challenged the claim or responded to the claim.
