On or before XX/XX/XXXX of XXXX, I received a letter from a debt collector and after which responded to the debt alleged.
I sent a certified letter to them requesting I see the debt as I was a victim identity theft and even added the debt to the report.
I sent the letter certified the following day.
I never received anything back from them.
I assumed 1 ) I did not owe it based on being sent information not from them but by the Hospital and it was to a patient that was not me but was my address.
2 ). I voiced my concern and also asked about financial assistance to a bill that I did owe. However, I faxed it to the Hospital for them to review prior to having my daughter on XXXX XXXX.
I told her after my c section Id like to see what I could work out. She said great.
At that time I had my daughter and followed up with the hospital. I told them my concerns of a few of the dates from the 2 creditors that they sent bill and assured me that this was the same Bill.
I made 3 payments and was promised a discount and also was made to make a XXXX dollar payment due to outstanding bills that they never did discount.
After attempting to pay after having my daughter it was sent to XXXX after the promise made to me in XXXX.
I asked for a debt validation in XXXX of XXXX based on making 4 payments of almost XXXX af XXXX without the discount promised.
A year has now gone by and learned today Im being sued by them.
To be fair I moved in XXXX of XXXX but they had months to respond so I could negotiate and instead decided to sue on the inflated amount and after I sent in my information for a sliding scale.
The hospital has my information as they sued me recently for a XXXX dollar bill and after contested and summoned against me.
The judge never heard my case and I tried to get a set aside and was denied as they said I was given the information by mail and can see on the In.Gov site I did not and was returned.
Judgement just came down and now another suit from a collector now I guess an attorney suing me for a cost I have no clue us mine.
I have all this proof and they waited a year from the date of my certified letter.
Im being harassed and at a loss of what to do and at what point this will stop.
If you look pack I filed last year against XXXX XXXX as well when I was stalked but didnt answer a response in time.
Im being harassed and sued and cant get it to stop. I had state XXXX most the time and have a judgement already that appears it may be violated as I wrote to my insurance as well with balance bills and their stop loss.
Ive been hit hard with COVID and losing my job and on the verge of losing my home.
I put that into the judge who denied my case to be heard and didnt care and a big red DENY.
Please help me get this to stop. I fear the hospital will continue the retaliation by hiring debt collectors harassing me to than now being attorney suing while they collect court costs Im on my now second attorney or debt collector and thank god someone sent me something in the mail spam mail that I had a court case as the same court again sent it to my old address after updating 7 times now.
Its a clear violation of fair debt collections act so much one attorney wrote and apologized and I fear the hospital gave it to this debt collector that I had written to with no response to date and now being sued.
When does this end. I have a XXXX XXXX XXXX and XXXX XXXX XXXX that was incapacitated and now I have the hospital illegally having junk buyers after me to then saying they are attorneys Is this even legal. Im already on forbearance and not even my county cares or maybe to busy and a mistake.
I feel like theres no one to help for me and I cant find an attorney due to barely staying afloat. I fear I wont have the right to due process now in this case again.

I had a XXXX done on XXXX XXXX, XXXX. I received XXXX bill for this, which I promptly paid off. However, in XXXX of XXXX I received a notice from the collection company Komyatte and Casbon, P.C. that XXXX medical bills from that same XXXX had been sent to collections in XXXX of XXXX. I had NEVER received either of these XXXX bills that had gone into collection. I called Komyatte and Casbon and asked what this debt was for, since I had never heard of it. The lady I spoke with told me sometimes you do not receive bills for things and that she would send me a itemized list of what the bill was for. This did not sound normal to me, so I called the original company the debt was from. She told me what the charges were for, and that the debt was sent to collections in XXXX because of a bad address, meaning I NEVER received any bills for the debts. The first I was aware of them was after they went to collections. So I called Komyatte and Casbon back, made a payment plan, assuming this would prevent it from being reported to my credit score. The lady I spoke with said it does n't matter if I am making payments, it is still going on to show reported on my credit account as an account in collections. I then called XXXX XXXX XXXX ( the company the bill was from ) and spoke with someone who told me since it was n't my fault I never received the bill due to a bad address, that they would pull the account out of collections. However, after checking my credit score the account has now shown up on my credit score as XXXX accounts in collections. I never had a chance to pay these bills. The first I had heard about them was when they were sent to collections.

This law firm and collection agency does not comply with FCRA regulations. They have failed to validate the debt as allowed to the debtor under 15 USC 692 ( g ) Section 809 ( b ) but has attempted to collect the following balance of {$1000.00} and {$2500.00} ( two separate accounts ). There is no question that they have willfully violated my rights repeatedly tried to collect debts beyond the state statutory limits. This company has refused to validate the debt and HIPAA authorization as I have requested the following : - Please provide a breakdown of fees including any and all collection costs and medical charges - Please provide a copy of my signature with the provider of service to release my medical information to you - Immediately cease any credit bureau reporting until debt has been validated by me They have been reported to the state and federal agencies that provide regulatory and enforcement oversight. Confirmation of the previous credit reporting date - beyond 7 years - has been provided to credit reporting agencies.
Finally, they have refused to acknowledge the fact it is an illegal attempt to collect a debt that is beyond the statue of limitations.

XX/XX/2018 i requested that that the two collections on my credit reports be validated and i received no response what so ever. I have tried to dispute this with all three credit bureaus as well and they refuse to acknowledge my request. I have a right to know what is in my file and who provided it without my consent. Currently it is two collections on that is being reported by the name of ( XXXX XXXX XXXX XXXX XXXX with a balance of {$1800.00} ). The second collection account that is being reported is by the name of ( Komyatte & Cabson P.C with a balance of {$8600.00} ). I also know that I am allowed under the Health Insurance Portability and Accountability Act to protect my privacy and medical records from third parties. I did not give permission to any of my current or prior medical providers to release any of my medical information to a third party. Not one of these companies can provide me a signature stating that i authorized the provider to release my medical information to them and that is a violation of the FDCPA.

I already reached out to the credit bureaus and to this company to notify them of their errors. I DO NOT OWN THIS DEBT, I NEVER HAD A XXXX ACCOUNT, and I have been monitoring my credit report for any changes since my several dispute letters, but I am yet to see the correction that I asked for and desperately need. When XXXX XXXX XXXX XXXX did not send any response to my correspondence, I thought they had dutifully complied to the law to cease any collection efforts unless proper validation has been provided. Then I found out that the issue still persists, I just had to escalate to CFPB.

Back in XX/XX/2020, I submitted a payment to the Collection Agency ( Komyatte & Casbon ) in the amount of {$55.00} and asked them to update or remove the negative information from my credit file, along with issue a letter to this effect. To this date, XX/XX/2020, my credit file has not been updated nor have I received the letter stating this account had been paid in FULL. I have called on several occasions and was told this is being processed, but as stated above, my credit files have not been updated.

I was diagnosed with XXXX XXXX in XX/XX/2014 and insurance company took their time paying XXXX hospital in XXXX so XXXX hospital sent the amount to XXXX XXXX XXXX within a month of my XXXX. Insurance paid this debt. No matter how many times we talk to the law firm they wont take it off my credit. I have called XXXX hospital and they apologized but nothing was done. Whats my next step. Oh I did go to the clerks office and they are sending me the paid bill.

My consumer rights are being violated. I have contacted this company for debt validation and have also sent a notice to cease and desist of all illegal activities and communications. It has been well over 30 days, and I still haven't had a response. I have no contract with this company, nor have I been provided with any information with my signature staying I have agreed to do business with them.

Komyatte & Casbon P.C. without verification of debt sent derogatory marks to all credit bureaus that resulted in me receiving negative credit reports and disqualification of loans.
